uying a brand-new home offers you an opportunity to customize it to your liking. It can be a dream come true and an investment for the future – but don’t forget, it’s also legal transaction. The term “get it in writing” has never been more important than in the case of the new-home purchase, since such a document outlines everything your home will have in it, on it and around it. Otherwise known as the Agreement of Purchase and Sale, the contract spells out the terms and conditions between you and your builder. Without it, if there is a misunderstanding or disagreement, it’s impossible to prove what was agreed upon. Since building a home is much more complicated than a resale transaction where the unit and/or property likely already exists, there is no set Agreement of Purchase and Sale or standard contract for buying a new home. In some provinces, builders may have standard contracts prepared by the local home builders’ association or their new-home warranty program. Builders often prepare their own agreements so contracts can vary from one builder/developer to another and from province to province. Before you sign a contract, review it carefully with the builder and ask questions to make sure you fully understand what it contains. Your next step is to then take it to a real estate lawyer and have it reviewed. Once it is signed, it becomes a legal document and an agreed-upon contract, so seeking the services of an experienced real estate lawyer is an important step toward ensuring that your dream home becomes a reality.

Ottawa remains affordable Sometimes, being “average” is a good thing

O

ttawa may not get the same attention as some of Canada’s other housing markets, such as Toronto or Vancouver. But when it comes to certain performance measures – namely affordability – that can be a good thing. Indeed, “average” seems to best describe most aspects of the Ottawa-area market these days, according to RBC Economics Research, in its Housing Trends and Affordability Report for the second quarter of 2013. The latest affordability levels in the Ottawa area are basically on par with their long-term averages, RBC says. Whereas other markets might record larger price gains, indicating strong market performance though also testing affordability, Ottawa continues to quietly hum along, slowly and surely performing at a healthy clip. Even though affordability decreased very slightly in the detached bungalow and standard two-storey categories, and improved slightly in standard condominiums, Ottawa remains far more affordable than many – if not most – major markets in Canada.

Affordability and fairness must be made a cornerstone of Ontario’s planning system:

The Ontario Home Builders’ Association

(OHBA) welcomes the recent announcement by Minister of Municipal Affairs and Housing Linda Jeffrey that the provincial government intends to launch consultations on Ontario’s land-use planning system and growth-related infrastructure financing. “Currently, new neighbours are being forced to finance massive infrastructure projects and urban renewal across Ontario. The Development Charges Act should be renamed the New Neighbour Tax,” says OHBA Chief Operating Officer Joe Vaccaro. OHBA recognizes that the time is right for the province, municipalities and industry to make affordability and fairness a cornerstone of Ontario’s planning system. “This is an opportunity to have a fact-based discussion about how Ontario’s lengthy and complex public planning system is challenging housing affordability and adding to the costs of new communities for Ontarians,” says Vaccaro. Buying a new or existing home? by John W. Herbert One of the questions often asked by potential homebuyers

is whether they should purchase a new or existing home. As with most important decisions in life, there’s no universal answer, so the correct response must be, “it depends.” Individual and family priorities can differ significantly and these must be balanced against a constantly changing set of local, provincial and national dynamics in order to arrive at the best solution at a specific point in time. One of the oldest and most reliable adages is that you don’t buy a home, you buy a neighbourhood. Unfortunately, buying in one’s preferred neighbourhood isn’t always possible because of the extreme price differential that exists between urban (within the greenbelt), suburban (outside the greenbelt) and rural home values (outside the city boundaries). Many new-home buyers would prefer to live in an inner city neighbourhood because of proximity to schools, the availability of reliable bus transportation, minimal commute times and mature tree growth. Unfortunately, based on the laws of supply and demand, the value of such amenities drives up the price of homes to the point where inner city locations are the most expensive of all three options. Suburban homes outside of and adjacent to the greenbelt are usually somewhat less expensive, and this trend continues as the distance from the city centre increases, with new homes in outlying communities being the least expensive. This is because the most expensive component in the price of a new home has become the land that it sits on. Until recently, the marketplace determined prices based on pure supply and demand principles, however this balance is now being impacted by municipal government policy of restricting the supply of new land. In the past 10 years, only three per cent of the lands used for new housing have been replaced. When you combine this with the fact that over the past 25 years, the fees, charges, taxes and levies have increased from three to 23 per cent of the cost of a new home, you begin to understand how municipal governments throughout Ontario have come to rely so heavily on new-home buyers as a revenue source. The more revenue that a municipal government can accrue by taxing new-home buyers, the easier it is to maintain low annual increases across the tax base at large. Another significant shift in the cost structure of new housing that has occurred over the past decade has been between capital and operating costs. Until recently, consumers were generally more concerned with keeping the purchase price of a new home low, rather than with the longer term operating expenses. These priorities have now changed with the advent of higher energy prices. Whereas in previous decades, it could take 15 to 20 years to achieve a payback on the increased capital cost of energy efficient measures such as insulation and windows, homebuyers generally refused because they might only own the home for five to seven years. Higher energy costs have now reduced the payback period to the point where many new-home buyers are now interested in paying a higher new home price that incorporates a range of energy efficiency measures. Some builders have even gone so far as to include energy efficient elements in every new home that far exceed building code requirements. The bottom line is that potential homebuyers who don’t care about living in an inner city location and purchase a new suburban home, have a very significant cost advantage in terms of total square footage, purchase price and long term operating expenses. The acquisition price is lower because of the land valuation issues, and the operating costs are lower because of better technology. This means that more recently constructed suburban homes are much bigger and less expensive than their inner city counterparts but are much cheaper to operate. New homes tend to have more efficient gas-fired, forced-air furnace systems, more efficient hot water production and tanks, better insulated and sealed windows and doors and a better building envelop including wraps such as “tyvek,” modern framing techniques that minimize thermal br idg ing and higher levels of insulation. Most Ottawa homes employ natural gas fired forced-air heating systems and we are currently very fortunate in having natural gas prices that are close to an all-time low. But this will not last, and whenever energy prices begin to increase, homes that have more efficient building envelopes will demonstrate much lower levels of energy consumption and cost in the short, medium and long term. Without a doubt, it’s one of the most thrilling parts of

the new home purchasing process – touring your beautiful, newly finished home shortly before you take possession. This is when the space you’ve been dreaming about so long crystallizes into reality. All of the finishes and features you’ve chosen with so much care are assembled together: for the first time, you’re able to see the way the drawer pulls on the kitchen cabinetry complement the lighting fixture, or the way the coffered ceiling and gleaming hardwood floors create the most glamorous dining room you could have imagined. That’s the fun part. But there’s a serious purpose to the pre-delivery inspection (PDI), which is a necessary step for new-home buyers enrolled in Ontario’s compulsory Tarion Warranty Program. This is your opportunity to go over your new home with a fine-tooth comb. This is the time to speak up if you see incomplete items, workmanship that doesn’t meet your expectations, or if one of your finishes has been substituted without your authorization. (I always remind my clients to read their agreements of purchase and sale carefully, as such substitutions may be perfectly legal once you’ve signed the dotted line.)

Tarion provides builders with a standard PDI Form that lists all the items contained in a home, from faucets to furnaces to flooring. Outdoor elements such as landscaping and driveways are all included. As you inspect the home together, the builder is responsible for noting any unsatisfactory items on the form, while you are responsible for signing each item indicated. This document stands as proof of your home’s condition before you’ve moved in, so there can be no question about responsibility. The inspecting process differs somewhat for condominiums, depending on which elements are considered “common” to the building owners. Items such as furnaces and air conditioning systems are sometimes inspected by the condominium board of directors rather than the individual purchaser. If you feel hesitant about your ability to recognize properly installed work or systems, I’d strongly encourage you to hire an independent building professional to come along. Missing a deficient item isn’t the end of the world – there are other opportunities to notify Tarion. But, by my calculations, paying a little bit more for a lot more certainty is always a good investment.
