Garda ‘stamped on Traveller’s head’ A Garda sergeant, who was seen assaulting a member of the Traveller community, was not prosecuted or disciplined over the incident, it has emerged. The victim of the alleged assault was at the time suspected of raping a woman a few days earlier. Despite a complaint from the woman and supporting evidence, this man was never charged with the rape offence. Members of An Garda Síochána familiar with the incident believe the alleged assault the man — known as Mr A — suffered at the hands of the garda, contributed to the failure to press charges over the alleged rape. The Irish Examiner has reported that the sergeant is now in line for promotion. The alleged incident occurred in 2016 in Waterford. Mr A was being sought by gardaí after an earlier altercation. Three gardaí, including the sergeant, came upon Mr A in a service station forecourt and were planning to arrest him. Two other gardaí later arrived on the scene. According to

one of the statements from a garda present at the scene, the sergeant went to Mr A’s car and kicked him a few times. He then dragged him from the car, threw him on the ground, and was seen to “stamp on this male’s head twice with his feet and kick him into the face and stomach with his foot”. The statement says the sergeant then punched Mr A in the head twice. Mr A was then arrested and taken to hospital. The sergeant is believed to have suffered a hand injury in the incident. Another garda’s statement also tracked the build-up to the incident with Mr A sitting in the car in the forecourt. Then: “I observed (Sgt B) kick (Mr A) into the upper body as he was seated in the BMW. (Sgt B) removed (Mr A) from the vehicle, placing him on the ground and kicked him in the upper body.” This statement went on to describe how, following that, Mr A was “resisting being arrested” by Sgt B and another Continued on next page

DUBLIN-headquartered biotech company Horizon Therapeutics is planning to hire 100 new staff over the next 18 months, with half the new hires to be located in the firm’s manufacturing facility Waterford. The roles in Waterford will be high-end science and engineering specialist roles, which the company hopes to have filled by the end of this year. The company also invests in scholarships to help students from disadvantaged backgrounds in Ireland access education.

Spain’s stake in N25 THE Spanish Government now has a €6.5m stake in the longest bridge in Ireland, after taking over the debts of a company owned by Florentino Pérez, president of Real Madrid. Pérez, one of the most powerful men in world football, controls a construction company called ACS, which had a major stake in the N25 Waterford bypass. The bridge, which opened in 2009, is a publicprivate partnership (PPP) scheme between Transport Infrastructure Ireland (Tii), and three main private partners.

Waterford Institute of Technology earned a place among the top institutes in the country, as they took home two awards recently at the prestigious National Student Media Awards as the event returned to the Aviva Stadium. It was the first in-person awards ceremony for the students since 2019 and participants joined the ceremony from all over

the country to be honoured for their hard work in media and journalism over the last 12 months. The two proud Waterford students were Martina Flavin and Ciarán Ó Goibín (above), who took home the Léiriúcháin Teilifíse i nGaeilge — Faisnéis agus Drámaíocht (Irish TV Production) award for their work on the documentary Capaill agus Caráiste. The

documentary deals with the sport of carriage riding and focuses around a masterful carriage driver, Paddy, and also featues archival material. The awards were attended by a number of famous faces and media leaders, such as Fionnan Sheahan, Ireland Editor of the Irish Independent, Aoife Moore of the Irish Examiner, Ray D’Arcy, Sean Defoe, Zara King and Gavan Reilly.

Continued from previous page garda. This version stated there was a struggle to subdue Mr A and one of the gardaí “subsequently deployed pepper spray in an attempt to subdue (Mr A)”. Following this, Mr A was “restrained on the ground until the arrival of a patrol van”. A female garda, who was among those on the scene, has been absent from work on stress-related leave since. Gsoc investigated the incident but Mr A refused to make a complaint. In 2019, the DPP ruled that no prosecution should be pursued. The matter was referred back to the Garda Commissioner for disciplinary action, but the Irish Examiner understands none was taken. The sergeant, who was transferred but not suspended during the investigation, is reported to have returned to his former duties. He subsequently received expenses for the period during which he had been temporarily transferred. A spokesperson for Gsoc said it does not comment on individual cases.

‘Seismic shift’ as region gets first university

Minister for Mental Health and Older People, Mary Butler, welcomed the Education Minister, Simon Harris, to Waterford recently for the official opening of the South East Technological University (SETU). Commenting on the visit, Minister Butler said: “ We are witnessing a seismic shift for education in the South East this week with the establishment of SETU. “Unfortunately, we are all too familiar with the reality that thousands of students left this region each year to attend university elsewhere. “I believe the establishment of SETU will be significant in reversing the brain drain trend we witnessed previously. “Our bright young students now have the option to develop their potential and skills in the South East. “I firmly believe that the educational future for young generations to come has now been secured as Waterford is now officially a University City. Speaking on his visit to Waterford, Minister Harris reiterated his belief that the

headquarters of SETU will be in Waterford. Minister Butler added: “I am encouraged to see Minister Harris double down on his radio interview with WLR on his last visit to Waterford in February in which he stated that it would ‘bonkers, mad and bizarre’ for he HQ to be based anywhere but Waterford. “The decision will ultimately be down to the governing authority however, but I am hopeful that a determination will be made sooner rather than later and Waterford should be the clear preference. “The establishment of SETU,” Minister Butler concluded, “will bring with it more investment in Waterford and the South East. Further backing will be necessary for the expansion of the campus here to ensure that we build on this progress and provide more courses for more students. “I will also push for more funding for investing in research here in Waterford. There is huge potential and opportunity to develop the relationship between the new university and our business community.”

Cllr calls for small firm rebate scheme

AT a recent meeting of Waterford City and County Council, local Fianna Fail Councillor Eamon Quinlan requested support for a commercial rates rebate scheme to businesses impacted from large-scale Public Realm works run by the Council. Cllr Quinlan said: “Waterford Council has delivered some large projects, is in the process of doing so and has plans for even bigger ones. “While this mentality and

resolve is most welcome, the timelines around almost all have been way off as well as over budget. “While the Council can recover from such issues, small local businesses who have their trade strangled for months if not years are running the risk of closure, or having to let go staff to keep the show on the road.” Waterford Council’s Director of Economic Development Mr Michael Quinn said there was no plan yet for such a scheme.

50 groups spring into action for big clean-up

THERE was a great response to this year’s Spring Clean initiative in Waterford, as over 50 groups from the county registered to get down and dirty. #SpringClean22 was Ireland’s largest anti-litter campaign to date, give the turnout, and this year, the campaign returned to it’s usual month-long cleanup after two years of restricted clean-ups due to the pandemic. Over 4,000 Waterford volunteers participated in organised clean-ups throughout the county, joining the other volunteers who collected, nationwide, an estimated 2,800 tonnes of litter. This year the theme of community pride was at the forefront of the campaign with The National Spring Clean urging people of all ages to gather friends, family, classmates, neighbours or colleagues to unite in cleaning their shared green spaces together. Commenting on this year’s success, Environment Minister Eamon Ryan said: “The statistics for what the National

Firms to focus on green goals

businesses across the county have being urged to prioritise sustainability efforts and commit to urgent action, according to Sue Garrard, the former EVP of Sustainable Business at Unilever, now an independent Global Sustainability Strategy Advisor. A recent worrying survey by EY found that four out of five businesses do not believe that they will reach their climate goals by 2030. Speaking ahead of a recent masterclass in Waterford on sustainability, Sue said: “There is no ‘one-size fits all’ approach

to corporate sustainability. But, from SMEs to major international firms, there are common actions that can be undertaken to achieve a more sustainable business. “For Irish businesses who perhaps haven’t yet implemented a sustainability plan, this is now an urgent priority. “For businesses who are further along on their journey, it is vital to keep up the momentum, set stretching goals, and start reducing their environmental impact,” she added. Lucky Lotto neighbours

A Waterford Lotto player scooped the top prize of €1m in the Lotto Plus 1 draw recently. But this paled in comparison to the Co Kilkenny player, who won the “life-altering prize” of more than €8.5m in the Saturday night’s Lotto jackpot (May 7). The weekend’s triumphs bring the number of National Lottery millionaires to 18 so far this year. It is also the fourth jackpot win of the

year, followed by wins in Mayo, Meath and Dublin. A Lotto spokesperson said: “This truly has been a lifechanging weekend for not one but two Lotto players in neighbouring counties who have both now become Ireland’s newest Lotto millionaires. “We are advising all of our players in Kilkenny and Waterford to check their tickets carefully.”

People got the power

consumers in Waterford recycled the equivalent of 15 AA batteries per person in 2021, equalling the national average, new figures reveal. Data from WEEE Ireland shows Ireland achieved a 46% battery recycling rate in 2021, reaching its EU directive obligations. The spike in recycling is equivalent to 15 AA batteries saved from landfill per person – an increase of two per person on 2020. Consumers in Waterford city and county were in line with the national trend, replicating the national average of 15 AA batteries per person which were prevented from entering landfill. “This small increase of two extra AA batteries recycled per person across Ireland made a huge difference and we are urging everyone in Waterford to recycle at least two more in 2022 to reach our target – and to stop and think before throwing them in the bin,” said WEEE Ireland CEO, Leo Donovan. Younger consumers are being urged to stop binning used batteries, as a survey reveals almost half of 18-34-year-olds are tossing them in bins.

Chamber hit for six on award shortlist Waterford Chamber has been shortlisted for six Chambers Ireland Awards in nine individual categories, with one Chamber also taking home the award for Chamber of the Year 2022, the title which is held by Waterford Chamber for 2021. The Chamber has been shortlisted for their work on Network Magazine for Best Marketing Campaign; Waterford Chamber Engineering: Making a Better World; Shop Waterford Support Local for the Local Authority Collaboration category; University of Substance for the South East for the Most Successful Policy Campaign category; the Regional Leaders Programme was chosen for the Partnership for Business Category and finally, the Waterford Green Deal was nominated in the Engagement with the Sustainable Development Goals Category. Winners will be announced on at a gala event on June 2nd.

Our Wives Under the Sea by Julia Armfield Miri thinks she has got her wife back, when Leah finally returns after a deep sea mission that ended in catastrophe. It soon becomes clear, though, that Leah may have come back wrong. To have the woman she loves back should mean a return to normal life, but Miri can feel Leah slipping from her grasp. Published by Pan Macmillan, this is the deliciously strange debut novel from the critically acclaimed author of salt slow. Our Wives Under the Sea is a story of falling in love, loss, grief and what life there is in the deep, deep sea… At its heart, Our Wives Under the Sea is a tender love story that straddles two worlds. With evocative and lyrical prose, Armfield has spun a fantastic tale positively soaked with eerie atmosphere. An ominous feeling pervades the novel with Armfield deftly weaving both Miri and Leah’s points of view skilfully throughout. Miri’s perspective is grounded in the everyday, whereas Leah’s is told in a series of dreamlike, claustrophobic flashbacks of her time trapped in a submarine at the bottom of the sea. The mysterious Centre for Marine Inquiry looms in the shadows; a malevolent and unnerving presence throughout. Armfield shows great skill and dexterity in sketching her characters, managing to convey a lot with little. The exchanges between Miri and her mother, although not part of the main action, are pitch perfect and their strained relationship injects a little humour. Not for those who aren’t willing to engage in a little suspension of disbelief, but a sublimely beautiful book that moves inexorably towards an inevitable, perfect end. This spectacularly disturbing book will crawl under your skin and linger for a long time to come.

Time to end this sham fight and build the new hospital

T

HE politicians who are trying to block the construction of the new National Maternity Hospital on the site of St Vincent’s, in south Dublin, are waging a phoney war. This battle was won more than 40 years ago and even then it was a bit of a sham fight. The loser was not the Catholic Church, which has been cast as the villain in the current controversy, but a more traditional bogeyman, the landlord. The issue was one of principle and it concerned, not public buildings, but the land on which most private houses stood. Before 1978 very few people in Ireland owned the land on which their houses were built. They leased it from whoever did own it. In legend, and popular imagination, the owners were Eng-

lish aristocrats whose grasping, grinding forebears had seized the land from oppressed Gaels. In practice they were usually construction companies and lo-

cal authorities. The terms of these ground leases were not onerous. They typically covered many lifetimes - 900-year leases were not uncommon - and, although a ‘ground rent’ was levied on householders, it was usually for a very small amount. Nevertheless, people were annoyed that these landlords (that’s the origin of the word) could oblige them to pay money while providing no service of any sort. So in 1978 an Act was passed forbidding the creation of new ground leases and a scheme introduced to let home owners buy out the existing ones. The abolition of ground rents put paid to any suggestion that ownership of land conferred rights over the property built on it. But, in truth, that was always the case. If the householder wanted to build a pigeon loft or an outdoor gym, use the garden

walls as a handball court or sunbathe nude on the balcony, that was none of the land owner’s business. The householder might fall foul of planning regulations, noise abatement rules or laws on public decency, but the preferences of the land owner had no bearing on these matters. Nowadays, nearly all householders own the land their homes are built on but that is not true of public properties. Many public offices are rented in their entirety, both the land and the building, while others - some Garda stations and law courts, for instance -are on leased land, not owned by the State. The ownership has no practical relevance. A local authority may own the land on which a courthouse is built, but it cannot pick the juries or tell the judge that sentencing is too harsh. And that’s how it will be if the

new National Maternity Hospital goes ahead, as planned, on the south Dublin site owned by the St Vincent’s Healthcare Group on behalf of the Religious Sisters of Charity . St Vincent’s has said all medical procedures legal in the State will be available at the new hospital, including those that run contrary to Catholic ethos, such as termination of pregnancy. But it doesn’t really matter what St Vincent’s says because it’s not going to have a say. The State, in the form of the HSE, will own the hospital building and have a 299-year lease on the land. The lease will probably outlast the Sisters of Charity but, in any case, until it is up they will have no right to interfere in the running of the maternity hospital. The plan to move the National Maternity Hospital from Holles Street in central Dublin was ap-

proved in 2013. The Elm Park site was chosen in 2016. So the issue has been debated and examined for almost a decade. The projected cost of the hospital has risen in those years from €300 million to €800 million and will almost certainly top €1bn by the time it is built. Until then, thousands of women will give birth in a hospital opened in 1894. Its medical facilities are restricted, the ancillary facilities are woeful, and there is little privacy on its wards. Women want the new hospital and none of the medical professionals who will work in it have expressed any fear of Church interference. The Minister for Health and his two immediate predecessors have backed the move, as has the Taoiseach. So, please, let us get on with it and stop fighting a phoney war over an issue that doesn’t exist.
