Justices unanimously overturn decision that would have voided part of FOID law

SPRINGFIELD – The Illinois Supreme Court last month vacated a lower court ruling and reinstated a statute that authorizes the state to revoke a person’s Firearm Owners Identification card once they’ve been charged with a felony, even if they haven’t yet been convicted.

The case involved Aaron and Charles Davis, a father and son who were charged with reckless discharge of a firearm, a felony, for allegedly shooting their rifles into the air over the Fourth of July weekend in 2016.

Soon after the charges were filed, the Illinois State Police revoked their FOID cards pursuant to a provision of the law that authorizes the agency to revoke permits from anyone “who is prohibited from acquiring or possessing firearms or firearm ammunition by any Illinois State statute or by federal law.”

Illinois Army National Guard Pfc. Harry Jerele, of Berkeley, is finally home, nearly 84 years after Company B, 192nd Tank Battalion, based in Maywood, was activated for federal service on Nov. 25, 1940. The flag-draped coffin containing his remains arrived on Oct. 1 at Chicago O’Hare International Airport, aboard American Airlines Flight 2412. A Military Funeral and Honors team conducted the dignified transfer of remains from the airline to a hearse from Russo’s Hillside Chapels, where services were held on Oct. 3 and Oct. 4. Jerele was buried on Oct. 4.

Berkeley Legends Get Honorary Street Designations

Village board voted on the honors for John ‘Dumbo’ Pezza And Stella Kendziora in the summer

Two well-known Berkeley residents were recently given honorary street designations. The Berkeley village board unanimously voted on July 16 to honor late Berkeley residents Stella Kendziora and John “Dumbo” Pezza with the distinctions. The village installed signage in the fall.

The 5000 Block of Ridge Avenue will be named in honor of Kendziora, who lived on the block for 20 years before she died in April at 77.

Relatives said Kendziora was well-known with Berkeley Village President Robert Lee, his staff, and her neighbors. They said she was particularly popular for the homemade Italian meals she cooked and shared with village firefighters, police officers, and other community members. Kendziora also donated regularly to local causes.

The 1200 Block of Sunnyside Drive will be named in honor of Pezza, affectionately known as Dumbo. Pezza lived in Berkeley for 60 years at 1232 Sunnyside Dr. and was a fixture in the suburb, his grandson, David Pezza, Jr., wrote in a nominating letter.

“John’s commitment to service even extended to the workplace, where he was president of the local IBEW for many years, always looking out for the best interests of his coworkers,” Pezza Jr., wrote.

Pezza, Jr. wrote that his grandfather moved to Berkeley after serving in the Korean War and marrying his wife, Joan Kinsler.

“From helping older neighbors with their landscaping, to serving as Village Trustee for over 20 years, John lived and breathed Berkeley,” Pezza, Jr. wrote.

“I specifically remember his pride every time we passed the library, where he always pointed out the Golden Jubilee Time Capsule that I was lucky enough to see opened this year,” he added. “It was quite touching that, upon seeing my name tag at the event, almost every person shared a kind word or story about him.”

Pezza coached with the Berkeley Youth Baseball program for more than 40 years. He also

Pezza Jr. said his grandfather, who died in 2015 at 82, was proudest of his service to his country and “his involvement with the American Legion and VFW. He was present for every parade, proudly wearing his hat, and even honored at various sporting events. He instilled in us – and everyone he coached – a great respect for our military and everything for which our flag stands.”

Broadview Honors Longest-Serving Employee

Joe Marbach, a Broadview firefighter whose 30 years of service makes him the village’s longest-serving firefighter and municipal employee, was honored at a village board meeting on Sept. 16.

“Joe is a well-respected person,” said Broadview Fire Chief Derek Bryant, who presented Marbach with a plaque of appreciation. “He is always the one who is calm, cool, and collected. On a personal note, his 30 years of perspective on the Broadview Fire Department has been valuable to me. One thing about Joe, his commentary will be colorful and unfiltered.”

Marbach was short and to the point when asked the secret to his career longevity.

“Loyalty,” he said. “Everybody I work with is a family. Share the love and keep your family happy.”

Broadview Mayor Katrina Thompson thanked Marbach for his three decades and contextualized his tenure. The mayor said she’s been in the village for 29 years—a year shy of Marbach’s long career.

“You have seen a lot of change. A lot of good things have happened,” Thompson said. “Love, family, and loyalty, like you said, Joe, keep a community connected. So, we are happy you’re not leaving because your institutional knowledge is important to us. So, thank you for staying the course with me and the fire department.”

Historic Maywood Church To Celebrate 120 Years

The Second Baptist Church, 436 S. 13th Ave. in Maywood, turns 120 years old this year and will mark the milestone with a series of services in late October.

Founded in 1904 under Rev. James Swanson, its founding pastor, Second Baptist was the first Black church in the village, church officials said.

The congregation will host celebratory services at 6:30 p.m. on Wed., Oct. 16, Thursday, Oct. 17, and Friday, Oct. 18.

Church officials are asking former choir members to attend a reunion choir rehearsal from 2 to 4 p.m. on Saturday, Oct. 19, at 6:30 p.m., in preparation for a culminating anniversary service during morning worship on Sunday, Oct. 20., at 10:45 a.m.

The anniversary’s theme is, “We’ve come this far by faith.” Scriptures are: 2 Corinthians 5-7 and Hebrews 11:6.

Vote By Mail Now Open

Vote By Mail is now open for the upcoming election on Tuesday, Nov. 5. According to the Cook County Clerk, “This option will allow you to vote by mail in all subsequent elections held in Cook County. You will still have the option to vote by mail in a single election if you so choose.

“Please note: If you change your voting residence and move within Suburban Cook County, you must re-register at your new address. Your

permanent vote by mail status will remain the same and be updated to the new address.

Tour De Proviso Rolls Into Bellwood Oct. 5

The annual Tour De Proviso will happen on Oct. 5 at Bellwood Village Hall, 3200 Washington Blvd. in Bellwood. The check-in will start at 7 a.m. while the race will kick off at 8:30 a.m.

The event is free and is open to all age groups and features a community expo afterward for riders to meet, mingle, and learn more about the participating communities.

AutumnFest Back In Town Oct. 5-6

The villages of Hillside and Berkeley will host their Annual Autumnfest event on the Prairie Path on Saturday, Oct. 5 and Sunday, Oct. 6, 11 a.m. to 4 p.m. The event will feature free parking and a shuttle to the festival area.

This year’s Autumnfest will feature: free kiddie rides, cool attractions for kids, free wagon rides, pumpkins for sale, arts and crafts vendors, organization booths, and entertainment on the Prairie Path and under the Berkeley Gazebo, among other things.

New Book About Married Couple’s Love Story Begins In Maywood

A book published in August exploring the power of youthful romance features a surprising character–not a person, but a place: Maywood.

“First Love, Only Love,” by Bob and Christine Balgemann, begins in the Proviso Township suburb, where the couple fell in love as preteens “smitten with each other,” according to a press release.

In an email, Bob said he spent his early life in Maywood at 814 N. 2nd Ave. and fell in love with the place.

“It was my ‘World,’ as I called it,” Bob wrote, adding that he and his wife wanted to memori-

alize some of that time in their first book, which is available at Amazon/Kindle, and Barnes and Noble, among other platforms.

The love story, Bob added, is a warm and fuzzy novel chronicling “what happens to a new, young couple, rising eighth-graders at the time. They found themselves one morning, at Chicago and 7th, while walking to Lincoln Elementary School on the last day of the 1955-56 school year. That same day [Bob] discovered his family was moving further into the suburbs.”

That was one of many challenges the couple overcame as their bond was tested. Bob is a retired newspaper journalist whose awardwinning, 57-year career spanned the Chicago suburbs, Georgia, and northern Illinois. Christine’s life has served as a volunteer Girl and Boy Scout leader for 17 years, while working as a travel agent, hair stylist, and paraprofessional. imprisonment for a term exceeding one year to ship or transport in interstate or foreign commerce any firearm or ammunition or receive any firearm or ammunition which has been shipped or transported in interstate or foreign commerce.”

The charges were later reduced to misdemeanors and each of the defendants had their FOID cards reissued after pleading guilty. After receiving their new cards, the Davises sued, arguing they were denied their constitutional right to keep and bear arms for self-defense during the time their FOID cards were revoked. They sought a declaration that the FOID Card Act is unconstitutional as it applies to people who have been charged with, but not convicted of, a felony.

Their attorney, Thomas Maag, of Wood River, also represents one set of plaintiffs in a federal lawsuit in the Southern District of Illinois challenging the constitutionality of the state’s ban on assault-style weapons and largecapacity magazines. A trial in that case was held last week in East St. Louis and a ruling is now pending.

In March 2023, Madison County Judge Ronald Foster granted the Davises’ motion and declared the law unconstitutional as it applied to people charged with, but not convicted of, felonies. He issued a permanent injunction barring the state from enforcing that provision of the law.

The state appealed directly to the Supreme Court, which stayed the lower court order while the appeal was pending. And in a unanimous opinion Thursday, the high court reversed the lower court decision, saying because the Davises had already had their FOID cards reissued, they no longer had standing to sue and claim they were being injured by the law.

Hospital room privacy

The Illinois Supreme Court last month unanimously ruled that patients admitted to a hospital should not have a universal expectation of privacy that would prevent law enforcement from entering a hospital room to question them or search their belongings.

The case stretches back to October 2016, when Cortez Turner arrived at St. Joseph Memorial Hospital in Murphysboro with a gunshot wound to the leg.

Emergency room staff had already been notified that a gunshot victim would be arriving via ambulance, but Turner was dropped off by a friend two minutes before the ambulance arrived carrying Detrick Rogers, who was fatally wounded by a gunshot to the head.

In the middle of the night, detectives from

the Murphysboro Police Department and Jackson County Sheriff’s Office showed up to the trauma room in which Turner was being treated. During the course of being questioned, Turner agreed to the officers’ request to seize his blood-stained clothing, which was on the counter in the room.

Eventually, Turner was implicated in Rogers’ death, an alleged drive-by shooting. Turner was later charged with first degree murder in addition to perjury for lying to a grand jury about the murder. After his 2019 conviction, Turner was sentenced to 30 years in prison.

During trial, Turner’s lawyers argued the bloody clothing collected from the hospital room should have been suppressed as evidence as it was not in plain view, and because he did not provide consent for officers to take them –despite testimony and detailed hospital chart notes from a nurse who took care of Turner in the emergency room indicating otherwise.

But after trial, Turner dropped those reasonings and began arguing the evidence should have been suppressed because the detectives should have first obtained a warrant

before entering the trauma room.

On appeal, however, Illinois’ 5th District Appellate Court did not agree, and after arguments in front of the state high court in May, neither did the justices of the Illinois Supreme Court.

Quoting from both a 1992 Illinois Supreme Court opinion and a 1990 U.S. Supreme Court ruling, Justice Elizabeth K. Rochford wrote that Fourth Amendment protections against unreasonable searches and seizures “offer protection to people, not places…but the extent to which they protect people depends upon where the people are.”

Rochford went on to explain a six-factor test to determine whether a person should have a reasonable expectation of privacy, eventually reaching the conclusion that the only factor in Turner’s favor was that he was “legitimately present” in the trauma room.

Turner’s attorneys tried to argue that he should have the same expectation of privacy as a person who rented a hotel room. But the justices rejected that reasoning, noting that Illinois law requires hospital personnel to call

the police when a gunshot victim enters the emergency room.

The ruling pointed to a dozen or so similar cases across the country in which courts at both the state and federal level have “reached the same conclusion,” – including a recent 8th Circuit Appellate Court’s decision in a case with facts “remarkably similar” to Turner’s. In that case, the court “relied on the existence of a similar statute” to Illinois’ law requiring hospital personnel to notify law enforcement about gunshot wound victims, rejecting arguments “that a person being treated in a trauma room has the same reasonable expectation of privacy as a hotel occupant.”

Rochford noted that Illinois’ appellate courts have previously ruled in favor of a defendant’s expectation of privacy in two separate cases involving patients in hospital rooms. But, she wrote, those rulings were careful to note that the question of reasonable expectation of privacy “depends on the totality of the circumstances and those circumstances will vary from person to person and from case to case.”
