Keynotes. The latest news from Property Consultants and Chartered Surveyors

Our Building Surveyors have been busy this month! We have been been appointed as Construction Managers, Party Wall Surveyors and Structural Engineers for the refurbishment of a luxury property in Chelsea. Similarly, we are currently preparing a fee proposal for a development of three properties in London.

VARO team is Growing! We are happy to announce the appointment of Ambra Carminati as a Graduate Surveyor. Ambra has a combined Architectural and Structural Engineer studies and great experience in Italy. At the London Office she will give support to our senior members of the team. Our London Office also welcome David Linley as a Senior structural Engineer. David is a fellow member of the Institution of Chartered Engineers with more than 40 years experience in the field. Alongside his experience in residential development, he has previously worked in the oil and gas industry for several contractors and clients. One of the main clients he has worked for is the Spanish contractor Iberdrola.

Our article "Party Wall...What's that? What do I do?"

The Party Wall etc Act 1996 provides a framework for preventing and resolving disputes in relation to party walls, boundary walls and excavations near neighbouring buildings. A building owner proposing to start work covered by the Act must give adjoining owners notice of their intentions in the way set down in the Act.

This means that if you’re working on a wall that divides your property from your neighbour’s property, or building a new wall on or near the boundary you may need to give your neighbours a party wall notice, in other words, you need to inform them of your plans and get their consent. The combination of informing (referred as serving notice) and receiving permission from your neighbours is often known as a party wall agreement and it's often prepared by expert Party Wall expert Surveyors. A Party Wall Agreement (technically called an “award”) is the document produced by the two party wall surveyors (or the “agreed surveyor”) acting for the respective owners. The Act is effective when: •Work is proposed on an existing wall that is shared with another party •Building on a boundary with neighbouring property •Excavating near a neighbouring building.

Once the award has been agreed between the two surveyors it is “published”. In practical terms this means that a signed and witnessed copy is sent to the two owners by their appointed surveyors. Although there is a 14 day right of appeal if either owner believes the award to have been improperly drawn up the award this is seldom observed. An additional copy of the award is given to the building owner to be passed on to their contractor. If you have received a Party Wall notice and don’t know what to do or if you are unsure of whether the works you are proposing are covered by The Party Wall etc Act 1996 then you should always seek professional advice.
