India Approves Rs 3,300 Cr Semiconductor Packaging Plant in Gujarat, to Boost Chip Production

The Union Cabinet has approved a Rs 3,300 crore proposal from electronics manufacturer Kaynes to establish a semiconductor packaging plant in Sanand, Gujarat. The 46acre facility will produce 6.3 million chips daily, serving industries such as automotive, telecom, electric vehicles, consumer electronics, and mobile phones. This move adds to Gujarat's growing semiconductor ecosystem, which already includes two chipmaking projects under the Rs 76,000-crore India Semiconductor Mission, with the first approved in June 2023 and construction progressing swiftly. In February 2024, additional semiconductor units were sanctioned for Dholera and Morigaon, further expanding the sector. Combined, the four semiconductor units will bring in investments of around Rs 1.5 lakh crore and have a total production capacity of 7 crore chips per day. These efforts are expected to create a robust semiconductor ecosystem, enhancing India’s competitiveness in the global electronics industry.

oyota and Maruti Suzuki are ramping up marketing efforts for hybrid vehicles in Uttar Pradesh, leveraging new state tax waivers that offer buyers savings of up to $15,800 on luxury models like the Toyota Vellfire. The tax cuts have triggered a surge in showroom enquiries, resulting in a 50% increase in hybrid sales, with dealerships urging customers to act quickly before the incentives potentially expire. The waivers, secured by Toyota through successful lobbying, come as Uttar Pradesh accounts for 10% of India’s car sales. However, the move has created tension within the auto industry, with rivals Tata Motors, Mahindra, and Hyundai expressing concerns about the negative impact on electric vehicle (EV) sales. These automakers unsuccessfully lobbied to reverse the July decision, which taxes hybrids at 43%, compared to 48% for gasoline cars. Industry leaders worry other states may adopt similar measures, potentially slowing EV market growth. This development highlights the broader debate between hybrid and EV technologies in India’s rapidly evolving automotive landscape.

USA’s Delaware Supreme Court Confirms Byju's Default on $1.2-Billion Loan Amidst Ongoing Insolvency Proceedings

The Delaware Supreme Court has upheld a ruling that edtech firm Byju's defaulted on a $1.2 billion Term Loan B (TLB), validating claims made by US-based lenders. The lenders, represented by GLAS Trust, had approached the court alleging payment defaults under the credit agreement and sought early repayment. Byju's contested the claims, but the court ruled in favour of the lenders, confirming the default and allowing them to take legal action. Byju's founder, Byju Raveendran, and his brother Riju had acknowledged the default in amendments signed between October 2022 and January 2023. The lenders have raised their claims to $1.5 billion, escalating the dispute during ongoing insolvency proceedings in Indian courts. The ruling entitles lenders to take control of Byju’s Alpha Inc. and exercise legal remedies. Lenders accuse Byju's of deflecting blame and failing to disclose the whereabouts of $533 million in missing loan proceeds. A response from Byju's is awaited.

UP Government to Announce 4% DA Hike for 15 Lakh Employees and 8 Lakh Pensioners Before Diwali

The Uttar Pradesh government, led by Chief Minister Yogi Adityanath, is expected to announce a 4% hike in dearness allowance (DA) for its 15 lakh employees and 8 lakh pensioners before Diwali. The DA hike, which will be declared after the Central Government’s decision in late September or early October, will benefit around 8 lakh state employees and add an estimated Rs 3,000 crore burden on the state exchequer. Non-gazetted employees are also likely to receive bonuses based on their basic salary and DA, with this year’s bonus expected to slightly exceed the Rs 7,000 given last year. Meanwhile, the 8th Pay Commission is anticipated in 2026, with salary increases projected between 20% and 35%, potentially raising Level 1 salaries to Rs 34,560 and Level 18 to Rs 4.8 lakh. Enhancements in retirement benefits and allowances are also expected, along with the implementation of a 1.92 fitment factor in the new pay matrix.

Supreme Court Rejects AAP Government’s Plea to Expand NRI Quota in Punjab Medical Colleges

The Supreme Court rejected the AAP-led Punjab government's plea challenging the High Court's ruling against expanding the ‘NRI quota’ to include distant relatives for medical and dental college admissions. The Punjab government aimed to allow admissions for relatives like uncles, aunts, and cousins of NRIs, which the apex court criticised as a “money-spinning machine.” The bench, led by Chief Justice DY Chandrachud, stated, “This fraud must end now,” emphasising the detrimental impact of such schemes on meritorious students. The court termed the High Court's verdict “absolutely right,” noting that candidates with significantly higher marks would lose out on admissions. Currently, 15% of total seats are reserved for NRI candidates in Punjab’s medical colleges, with around 185 MBBS and 196 BDS seats allocated under this scheme, many of which remain vacant due to a lack of eligible candidates. The Supreme Court underscored that prioritising distant relatives over deserving candidates was unacceptable and could not be permitted.

Star Union Dai-ichi Life Insurance to Launch AI-Driven Investment Product

Star Union Dai-ichi Life Insurance Co. Ltd. (SUD Life) is set to introduce a new investment product leveraging artificial intelligence (AI) insights to enhance returns from Indian large-cap portfolios. The insurer will collaborate with QuantumStreet AI to develop the product, utilising IBM's watsonx AI model. The announcement was made at the IBM Think Mumbai 2024 event. Sandip Patel, Managing Director of IBM India & South Asia, emphasised the critical role of AI in transforming investment solutions, stating that it would foster a new era of responsible investment practices. The challenge of outperforming large-cap stock portfolios is becoming increasingly evident in India, reflecting similar trends in Western capital markets. Arindam Ghosh, Chief Technology Officer, and Prashant Sharma, Chief Investment Officer at SUD Life, highlighted that AI is now an essential tool for fund managers, enabling them to extract valuable insights from vast data volumes. They noted that AI has transitioned from being a "nice-to-have" to a "must-have" in today's investment landscape.

EU Commissioner Thierry Breton Resigns, Cites

Pressure From von der Leyen Over Commission Candidacy

European Commissioner Thierry Breton abruptly resigned on Monday, accusing Commission President Ursula von der Leyen of pressuring France to withdraw his candidacy for the next Commission "for personal reasons". Breton claimed Paris was promised a more influential position in return for dropping his name. His resignation, announced in a scathing social media letter, criticised the "questionable governance" of the European Commission. Breton’s departure complicates von der Leyen’s efforts to finalise her College of Commissioners, already delayed by Slovenia’s political issues. Breton, a key figure in COVID-19 vaccine production and military support for Ukraine, will be replaced by France’s foreign affairs minister Stéphane Séjourné, though concerns arise over his lower profile. The European Commission has declined to comment on the matter.

Boxing Champion Oleksandr Usyk Briefly Detained at Krakow Airport

Undisputed heavyweight world champion Oleksandr Usyk was briefly detained by law enforcement officers at Krakow airport in Poland, as confirmed by Ukrainian President Volodymyr Zelenskiy. The 37-year-old boxing star, who holds the WBC, WBO, and WBA titles, was handcuffed in what his team described as a misunderstanding that was quickly resolved. Zelenskiy expressed outrage over the incident but confirmed that Usyk had been released. Usyk took to Instagram to reassure his fans, expressing gratitude for their concern and praising the professionalism of the Polish officers involved. Ukrainian Foreign Minister Andrii Sybiha criticised the detention as "disproportionate" and announced that Ukraine's foreign ministry would engage with Polish authorities to address the situation. Polish officials have yet to comment on the circumstances of Usyk's detention. A video shared by Polish media appeared to show Usyk being escorted through the airport in handcuffs, though its authenticity remains unverified. As a national hero in Ukraine, Usyk has been an active supporter of Kyiv’s war efforts against Russia, providing humanitarian aid through his foundation.

EU Court Upholds €2.4 Billion Fine Against Google for Market Abuse

Europe’s top court has upheld a €2.4 billion fine against Google for abusing its market dominance through its shopping comparison service. This penalty, initially imposed by the European Commission in 2017, concludes a lengthy legal battle that began in 2009, initiated by UK-based Foundem. The European Court of Justice ruled that Google’s practices were "discriminatory" and completely rejected the tech giant’s appeal. Google expressed disappointment, stating it had made changes in 2017 to comply with the Commission's ruling. However, the court’s decision underscores the seriousness of Google's actions in monopolising online price comparison by prioritising its own shopping recommendations over competitors. This ruling could have broader implications, as additional antitrust cases and compensation claims from affected rivals are still pending. The case adds to Google's mounting legal troubles in Europe, where it has faced €8.2 billion in fines across various cases related to its Android software and advertising practices. Meanwhile, Google is also facing a separate antitrust trial in the US and ongoing UK investigations into its advertising technology.

Zelenskiy Nominates Andrii Sybiha as Ukraine's New Foreign Minister Amid Major Government Reshuffle

Ukrainian President Volodymyr Zelenskiy has nominated Andrii Sybiha, the current first deputy foreign minister, to replace Dmytro Kuleba as the country’s new foreign minister. This nomination is part of a significant government reshuffle— the largest since the war with Russia began in February 2022. Sybiha, a career diplomat, has worked closely with Zelenskiy on foreign policy and strategic partnerships. Despite the leadership change, analysts believe Ukraine's foreign policy will remain consistent, with the president’s office continuing to play a dominant role in key decisions. The reshuffle has already led to the resignations of Kuleba, two deputy prime ministers, and several other ministers. Zelenskiy is scheduled to travel to the US later this month to present a "victory plan" to President Joe Biden and participate in a Ramstein group meeting to discuss arms supplies to Ukraine. Abolishing the Angel Tax is the best move the Finance Minister could make to rejuvenate the startup ecosystem

Sometimes, well-intentioned policies can inadvertently hinder certain sectors of the business community. The Angel Tax, levied at a flat rate of 30% on startup investments, may fall into this category. Introduced in the Union Budget of 2012, it has been a thorn in the side of the startup ecosystem. Industry associations and trade bodies have long clamoured for its removal, arguing that it has created obstacles for both early-stage in-

vestors and venture capitalists. While the tax was initially introduced by the government to curb money laundering, many in the industry argue that it has deterred investors from backing the fledgling Indian startup scene.

For those unfamiliar, the Angel Tax is imposed on the share premium that an investor pays when investing in a startup. This share premium, which is the amount paid over the Fair Market Value (FMV) of a company, is

considered income and is therefore subject to taxation. Proponents of the Angel Tax argued that the substantial premiums paid by investors over the FMV were unjustified, as the valuation methods—whether based on the Net Asset Value (NAV) of a company, the discounted cash flow method (which considers future cash flow projections), or the income-based cash flow method (which is based on expected future earnings)—often resulted in inflated valuations

for companies, particularly those not yet showing profit.

On the other hand, critics of the Angel Tax argued that it distorted their cap tables. Investors were willing to pay a premium over the FMV because they wanted to participate in the company’s future growth. Given the inherent risks in equity investment, these investors were prepared to take on that risk for the potential of future profit. They often pointed to the significant returns that investors enjoyed when exiting the company by selling their stake at a later stage.

Both sides of the debate have valid points. However, the situation reached a critical point as startup investments began to dry up following consecutive interest rate hikes by major central banks in their efforts to combat rising inflation. India, once proud of its rising rank in the global startup and unicorn landscape, suddenly felt the squeeze as investors became more cautious with their capital. Aspiring founders found themselves in a bind, with company valuations plummeting and investors demanding more equity for less capital. This affected subsequent funding

rounds, leaving many startups unable to scale operations—an essential strategy for survival in the startup world.

Now, the Finance Minister has decided to scrap the Angel Tax as part of the Budget announcements. In my view, eliminating the Angel Tax is the best move the Finance Minister could make to revive the startup ecosystem amidst a funding winter. This decision will significantly contribute to the growth of startups with market-winning ideas, as it will attract investors back to these transformative ventures

Developing Hospice and Palliative care centres should be given top priority in future

Palliative care is a holistic care which fulfills the requirements of chronically ill or terminally ill patients. It has become an emerging need of the day as the existing healthcare facilities play only a limited role in the care of chronically ill people in society. Patients with a terminal illness in most cases spend their lives in the community among their family and neighbours, so there is a need for a multi-disciplinary team for their constant care. General practitioners working with palliative care teams stated that home care was the preferred option for most people with a terminal illness, and it relies on good community-based services, a general practice workforce competent in palliative care practice, and the willingness to accommodate patients.

Palliative care volunteers are primary caregivers who originate normally from the same locality

with local knowledge and good public contact through which they can make significant contributions in teamwork by bridging the gap between the patient community and the outside world.

Aim:

The present study has been undertaken to analyse the impact of palliative care services on patients by considering 51 variables. Materials and Methods:

The respondents of the study include 50 pain and palliative care patients selected at random from 15 palliative care units functioning in Ernakulam district. The analysis was made by using statistical techniques viz. weighted average method, Chi-square test, Friedman repeated measures analysis of variance on ranks and percentages.

Results:

The study revealed that the major benefit of palliative care to the patients is the reduction

of pain to a considerable extent, which was unbearable for them earlier. Second, the hope of patients could be maintained or strengthened through palliative care treatment.

Conclusion:

It is understood that the services of the doctors and nurses are to be improved further by making available their services to all palliative care patients in a uniform manner.

Palliative care is a prerequisite for complete medical care. The existing healthcare facilities are more attuned to caring for acute health problems and they play only a limited role in the care of the chronically ill in society. At least in India, the present medical and hospice systems do not have

the capacity to guarantee the quality of life for the majority of people with life-limiting illnesses. Patients with terminal illness need a multidisciplinary team and constant care leading to a mounting need for palliative care.

Palliative care remains the only and indeed the most appropriate form of treatment for patients at incurable stages. Pain and palliative care units touch the lives of those who are in need of care and attention. In Kerala, the tremendous developments made in palliative care have made the end-of-life phase of the terminally ill more bearable. As much as 80% of all palliative care services in the country are delivered in Kerala, reaching 30% of the needy patients, whereas these services

reach only to 2% in the rest of India. Kerala’s attempts at caring for terminally ill patients have been regarded as a model for the rest of the world. Kerala Government is the only State Government in Asia that has introduced a palliative care policy in the State for the first time.

There is a need to advocate adequate policy development and effective programme implementation in the area of palliative care. As much as 50% of the beneficiaries of palliative care services are cancer patients. The remaining groups included post-stroke survivors, patients with Alzheimer’s, terminal renal and liver diseases, chronic arthritis, old age with severe malnutrition, etc. Huge medical expenditure is the major financial problem

faced by the patients resulting in intractable debt. The major medical care provided by doctors is prescribing medicines. They also help the patients to reduce their sufferings through emotional bondage and empathy. Trained staff nurses help in administering medicines as well as catering to basic daily needs in addition to providing love and compassionate care.

Necessity for a full-fledged palliative care service

• Diagnosing imminent death is an important clinical skill

• Too many patients die an undignified death with uncontrolled symptoms

• Resources should be made available to enable patients to die with dignity in a setting of their choice

• One of the key aims of specialist palliative care is to empower generic healthcare workers to care for dying patients

• Core education objectives related to the care of dying patients should be incorporated into the training of all relevant healthcare professionals

• National indicators for care of the dying patient should be identified and monitored

The impact of death in our society is easily underestimated. Evidence-based guidelines now exist to help with the care of people who are dying, including guidelines for symptom control, psychosocial support, and bereavement care. Nonetheless, highly publicised cases continue to occur of patients dying in distress with uncontrolled symptoms and relatives being unsupported at this vulnerable time in their lives. Ensuring a good death for all is there-

fore a major challenge not only for healthcare professionals but also for society.

However, diagnosing death is often a complex process. In a hospital setting, where the culture is often focused on cure, continuation of invasive procedures, investigations, and treatments may be pursued at the expense of the comfort of the patient. There is sometimes a reluctance to make the diagnosis of death if any hope of improvement exists and even more so if no definitive diagnosis has been made. When recovery is uncertain it is better to discuss this rather than giving false hope to the patient and family. This is generally perceived as a strength in the doctor-patient relationship and helps to build trust.

Recognising the key signs and symptoms is an important clinical skill in diagnosing death.

It is usually preceded by a gradual deterioration in functional status. The patient becomes bedbound

• The patient is semi-comatose

• The patient is able to take only sips of fluid

• The patient is no longer able to take oral drugs

The most important element in diagnosing imminent death is that the members of the multi-professional team caring for the patient agree that the patient is likely to die. If the team members are in disagreement then mixed messages together with opposed goals of care can lead to poor patient management and confused communication.

Healthcare professionals are sometimes reluctant to diagnose death, as they have not been trained to care for dying patients and therefore feel helpless. One example of

this is the practice of transferring the patient to a side room and withdrawing from the patient and family, a strategy that has been used for many years, particularly in hospitals. However, this is the very moment when the hospice model of “intensive palliative care” should come into action, providing physical, psychological, social, and spiritual care for the patient and the relatives.

Change from definitive care to palliative care

As patients become weaker, they find it increasingly difficult to take oral drugs. Non-essential drugs should be discontinued. Drugs that need to be continued, such as opioids, anxiolytics, and antiemetics, should be converted to the subcutaneous route and a syringe driver used for continuous infusion if appropriate. As required, subcutaneous drugs should be prescribed according to an agreed protocol (including those for pain and agitation). Inappropriate interventions, including blood tests and measurement of vital signs, should be discontinued. Evidence is limited

but suggests that continuing artificial fluids in the dying patient is of limited benefit and should in most cases be discontinued. Patients who are in the dying phase should not be subjected to “cardiopulmonary resuscitation”, as this constitutes a futile and inappropriate medical treatment. The patient may have an advance directive that can be used to facilitate discussion about care at this sensitive time.

Regular observations should be made and good symptom control maintained, including control of pain and agitation. Attention to mouth care is essential in the dying patient, and the family can be encouraged to give sips of water or moisten the patient's mouth with a sponge. If urinary incontinence or retention is a problem, catheterisation may be needed. Invasive procedures for bowel care are rarely needed in the dying phase.

In the community, as required, drugs need to be readily accessible in the patient's home. Twenty-fourhour district nursing services should be made available, and with the development of general practitioner

cooperative out-of-hours services the continuity of patient care must be ensured. Innovative models are being developed in the community to support patients dying at home and to prevent inappropriate admission to the hospital.

The family's insight into the patient's condition should be assessed and issues relating to dying and death explored appropriately and sensitively. The family should be told that the clinical expectation is that the patient is dying and will die. The use of ambiguous language such as “may not get better” can lead to misinterpretation and confusion. A constant source of frustration and anger voiced by bereaved relatives is that no one sat down and discussed the fact that their loved one was dying. If relatives are told clearly that the patient is dying they have the opportunity to ask questions, stay with the patient, say their goodbyes, contact relevant people, and prepare themselves for the death. Relatives of patients dying in the community should be given contact telephone numbers so that they have access to help and advice on a 24-hour basis

Bail – Emerging Trends In The Context Of Money Laundering Laws

Our Constitution in Article 21 guarantees the right to life and personal liberty, subject to procedure established by law. In the context of right to personal liberty, Courts in the recent past have enunciated certain important aspects on the scope of Article 21 of the Constitution of India especially in the context of bail jurisprudence entailing special laws. Recently, the Hon’ble Supreme Court in the case of Frank Vitus Vs Narcotics Control Bureau and Others 2024 SCC Online SC 1657 reiterated the proposition that an Accused whose guilt is yet to be established is presumed to be innocent. Further, an Accused cannot be deprived of all of his rights guar-

anteed under Article 21 of the Constitution of India. In the said judgment, it was also held that Courts while imposing the bail conditions should exercise restraint else the very purpose of granting bail would get frustrated.

It must also be remembered that the object of granting bail cannot be to keep a constant vigil on the movements of the accused enlarged on bail. In the judgment of Frank Vitus, the Hon’ble Supreme Court made certain pertinent observations of the bail conditions that may be imposed by a Court granting bail, which is extracted below:

“The investigating agency cannot be permitted to continuously peep into the private life of the ac-

cused enlarged on bail, by imposing arbitrary conditions since that will violate the right of privacy of the accused, as guaranteed by Article 21. If a constant vigil is kept on every movement of the accused released on bail by the use of technology or otherwise, it will infringe the rights of the accused guaranteed under Article 21, including the right to privacy. The reason is that the effect of keeping such constant vigil on the accused by imposing drastic bail conditions will amount to keeping the accused in some kind of confinement even after he is released on bail. Such a condition cannot be a condition of bail.”

BAIL IN THE CONTEXT OF PREVENTION OF MONEY LAUN-

The Hon’ble Supreme Court in case of Manish Sisodia Vs Directorate of Enforcement 2024 SCC Online 1920 has upheld certain key propositions that where a trial has not merely been delayed but has not even commenced after a long period of incarceration, the same would be violative of Article 21 of the Constitution of India.

DERING ACT, 2002 (“PMLA” OR “THE ACT”)

The provisions regarding the grant of bail in the context of PMLA is regulated by Section 45 of the Act. The provisions of Section 45 at the outset regards offences under PMLA as cognisable and non bailable. It further provides that no person shall be released on bail unless the following two conditions are satisfied:

i. The Public Prosecutor has been given an opportunity to oppose the application for such release; AND

ii. Where the Public Prosecutor opposes the application, the court is satisfied that there are reasonable grounds for believing that he is not guilty of such offence and that he is not likely to commit any offence while on bail.

The term “reasonable grounds for believing” was upheld in the landmark judgment in Vijay Madanlal Chaudhary Vs Union of India 2022 SCC Online SC 929 to mean

that the Court has to only see if there is a genuine case against the Accused. Further, the prosecution is not required to prove the charge beyond reasonable doubt.

The Hon’ble Supreme Court in the said judgment in the case of Vijay Madanlal Chaudhary Vs Union of India 2022 SCC Online SC 929 also held that the right to bail of an Accused stands restricted by the provisions of Section 45 of the Act. Under such circumstances, questions have arisen on whether an accused can be kept behind bars indefinitely despite speedy completion of trial being a fundamental right under Article 21 of the Constitution of India. Some of these issues have recently been a subject matter of deliberation before the Hon’ble Supreme Court and various Courts in the country, including in Kerala.

In Kerala, the Hon’ble Special Court for Trial of PMLA cases in Ernakulam was pleased to grant the Accused bail in Crl MP No 217/2024

in SC (PMLA) No 3 of 2024 duly considering the fact that prolonged incarceration of a person would be violative of Article 21 of the Constitution of India especially when the case is unlikely to be decided in a foreseeable future. This in my view is a bold judgment by the Hon’ble Special Court for Trial of PMLA cases clearly upholding the fundamental rights of a citizen.

In a recent judgment, the Hon’ble Supreme Court in case of Manish Sisodia Vs Directorate of Enforcement 2024 SCC Online 1920 has upheld certain key propositions that where a trial has not merely been delayed but has not even commenced after a long period of incarceration, the same would be violative of Article 21 of the Constitution of India. It would also be fruitful to extract a passage on this principle, which was upheld by the Hon’ble Supreme Court in the case of K A Najeeb (2021) 3 SCC 713 whilst dealing with provisions analogous to

Section 45 of the Act:

“It is thus clear to us that the presence of statutory restrictions like Section 43-D(5) of the UAPA per se does not oust the ability of the constitutional courts to grant bail on grounds of violation of Part III of the Constitution. Indeed, both the restrictions under a statute as well as the powers exercisable under constitutional jurisdiction can be well harmonised. Whereas at commencement of proceedings, the courts are expected to appreciate the legislative policy against grant of bail but the rigours of such provisions will melt down where there is no likelihood of trial being completed within a reasonable time and the period of incarceration already undergone has exceeded a substantial part of the prescribed sentence. Such an approach would safeguard against the possibility of provisions like Section 43-D(5) of the UAPA being used as the sole metric for denial of bail or for wholesale breach of constitutional right to speedy trial.” [Emphasis Supplied]

The Hon’ble Court in the case

of Manish Sisodia (supra) upheld that the right to liberty is sacrosanct which cannot be comprised without a just cause. Further, the Court also held that the concerns of the prosecution could be mitigated by imposing suitable conditions. The said proposition was further elucidated by the Hon’ble Supreme Court in Prem Prakash Vs Union of India 2024 KHC Online 6461 where the Court held that Section 45 of the Act does not in any manner imply that deprivation is the norm and liberty the exception. On the contrary, liberty is always a Rule and deprivation an exception. Recently, the Hon’ble Supreme Court in the case of V Senthil Balaji Vs Deputy Director, Directorate of Enforcement 2024 SCC Online SC 2626 held that Courts cannot allow the provisions of Section 45 of the Act to become an instrument in the hands of the Enforcement Directorate to continue incarceration for a long time especially when there is no possibility of a trial of the scheduled offence and the PMLA offence concluding with a reasonable period of time. It would also be profit-

able to extract a passage from the judgment which eruditely sums up the proposition:

“If the Constitutional Courts do not exercise their jurisdiction in such cases, the rights of the undertrials under Article 21 of the Constitution of India will be defeated. In a given case, if an undue delay in the disposal of the trial of scheduled offences or disposal of trial under the PMLA can be substantially attributed to the accused, the Constitutional Courts can always decline to exercise jurisdiction to issue prerogative writs. An exception will also be in a case where, considering the antecedents of the accused, there is every possibility of the accused becoming a real threat to society if enlarged on bail. The jurisdiction to issue prerogative writs is always discretionary”. [Emphasis Supplied].

As discussed, joint pain can arise from a variety of sources, ranging from physical injury to underlying medical conditions. Here’s a breakdown of the most common causes:

1. Ageing and Osteoarthritis: As we age, the natural wear and tear on our joints increases. Osteoarthritis, the most common form of arthritis, occurs when the cartilage cushioning the ends of bones deteriorates

over time, causing bones to rub together. This results in stiffness, pain, and decreased mobility. Osteoarthritis typically affects weight-bearing joints such as the knees, hips, and spine, but it can also occur in the hands. Though age plays a major role, factors like previous injuries, obesity, excessive activity of the joint (linked to a job or sport), nutrient deficiencies and even genetics can accelerate the development of osteoarthritis.

2. Inflammation and Autoimmune Disorders: Inflammation is a key contributor to joint pain, particularly in autoimmune diseases such as rheumatoid arthritis, psoriatic arthritis, and lupus (SLE). In these conditions, the body’s immune system mistakenly attacks healthy joint tissues, leading to swelling, pain, and joint deformities. Repetitive movements, often linked to certain sports or jobs, can also lead to overuse injuries, such as tendinitis or bursitis, where the tendons or bursa (fluid-filled sacs around the joints) become inflamed. Such joint overuse is particularly common in athletes or individuals with physically demanding jobs.

4. Gout: Gout is a form of arthritis caused by a build-up of uric acid crystals in the joints. These crystals rub against the joints causing severe pain. It is usually seen in small joints such as the toe, but it can affect other joints as well.

Gout attacks are often triggered by a diet high in purines - found in animal protein such as red meat and seafood, which increases uric acid levels in the body. Uric acid levels may also increase with alcohol consumption or less water intake. Gout is more common in men and those with a family history of gout. Medications along with necessary dietary changes are important to manage this condition.

5. Infection (Septic Arthritis):

Though less common, joint pain can sometimes be caused by an infection in the joint, known as septic arthritis. This condition occurs when bacteria or other harmful organisms enter the joint, leading to swelling, pain, redness, and fever. Septic arthritis can develop after surgery, an injury, or from an infection that spreads from another part of the body. It’s a medical emergency that requires prompt treatment to prevent permanent joint damage.

6. Obesity: Carrying excess weight places significant strain on weightbearing joints such as the knees, hips, and spine. For every pound of excess weight, your knees endure an additional four pounds of pressure when walking. This increased stress can accelerate the breakdown of cartilage and lead to joint pain or osteoarthritis. Losing even a small amount of weight can reduce joint pain and improve overall joint function.

7. Poor Posture and Alignment:

Long hours of sitting, slouching, or using improper form during physical activities can cause misalignment in the body, leading to joint pain. Poor posture places undue stress on certain joints, particularly the back, neck, and knees. Over a period of time, this can lead to muscle imbalances, joint stiffness, and pain. Cor-

recting the posture and engaging in regular exercises to improve alignment can alleviate and prevent pain caused by these factors.

8. Sedentary Lifestyle: A lack of movement can lead to stiff joints, muscle weakness, and reduced range of motion. When the muscles around the joints are weak, they provide less support, increasing the strain on the joints themselves. Prolonged sitting or inactivity can also reduce synovial fluid production, which lubricates the joints, making them more prone to stiffness and discomfort. Regular movement and low-impact exercises like walking, swimming, or yoga can help keep joints flexible and pain-free.

Thimphu shows the world how modern amenities can peacefully and harmoniously co-exist with centuriesold traditions and heritage. One of the iconic spots in the city beckoning visitors is the Tashichho Dzong fortress-monastery that dates back to the 17th century. visit the world’s tallest Buddha statue which is just six kilometres from Thimphu. The Buddha Dordenma Statue measures 169 ft and it is surrounded by more than 900 acres of pristine forest comprising the Kuenselphodrang Nature Park. This spot is ideal for clicking selfies, meditating and hiking as well.

Spirituality meets adventure

Located right in the heart of Thimphu is the Memorial Chorten (a Buddhist shrine) built in the early 1970s in memory of the third ruler Jigme Dorji Wangchuk. One can see throngs of believers on its premises to offer prayers while circumambulating and turning the huge prayer wheels. This white structure with a golden spire has images of the Buddha, Padmasambhava and other deities.

Want to explore more about the mystique of Buddhism? Then there is no better option than a trip to the captivating Chagri Dorjeden Monastery perched on a cliff at the northern end of the Thimphu valley located 15 km away from the capital. One needs to trek for an hour up the hill to reach this monastery that was established in 1620. It was the first monastery established by Ngawang Namgyal, who established the state of Bhutan.

Located at 3,100 m above sea level, the Dochu La pass is characterised by a cluster of 108 Chortens and hundreds of prayer flags in multiple hues. This is the best spot to soak in the majesty of the mountain peaks framed by the lapis lazuli sky above.

The colourful handicrafts market in the capital is the best bet if you wish to buy traditional artefacts crafted from bamboo. They come in different shapes, sizes and colours showcasing the rich tradition of the country. Among the items on sale are traditional bags, apparel, masks, and souvenirs to name a few. Right in the heart of the city is the Clock Tower Square, which draws hordes of tourists.

There are four clocks facing the four directions and the tower reflects traditional architecture with attractive wood carvings. Not to be missed are the dragons facing each clock. It's an ideal spot to chillax with a drink and snack and click umpteen number of selfies. Cheesy, meaty love affair

Best time to visit

Spring season, which is from the middle of March until May, is the ideal time to visit this picturesque country. The frosty weather gives way to warmth and greenery and the mountains come alive with shrubs, blooms and ferns providing a feast for the eyes. To say that Mahindra knows the Indian customer really well, will be an understatement. Their biggest hits have come in various forms over the years, from the XUV500 to the XUV700 and the Scorpio N in recent times. People queue up to buy them with online bookings pushing waiting periods up to two years. Enter the Thar Roxx. If you thought that the three-door Thar wasn’t very practical to be your family car, the Roxx has got you covered. You have the wheelbase extended by 400mm to 2850mm. It’s not a stretched chassis and a longer body put on top, but a totally new chassis which has more in common with the Scorpio N. It is also slightly wider to give better track and improved dynamics. any car, Mahindra claims. The seats are finished in white which will be a pain to keep clean, but if you opt for the four-wheel drive version, you can get brown seats, too. One downside of the interiors is the lack of storage space. For instance, the door pockets cannot hold large water bottles and there is very little space for knick-knacks. Boot is sufficient at 447 litres and you can fold the rear seats down for additional space. The

tail gate retains the split functionality which was a requirement in the three-door because of the extra body styles, not on the Roxx.

The Thar gets two engine choices a 2.0 litre petrol and a 2.2 litre diesel. The engines have various power outputs, depending on their transmission and in the case of the diesel whether it’s four-wheel drive. The most powerful petrol version gets 177bhp and 175bhp for

the diesel. That’s nearly 27bhp and 45bhp over the equivalent threedoor Thars respectively. The diesel is the one I spent considerable time with, and ideally the one you should get, too. The familiar 2.2litre engine is so refined that you question the need to go for petrol. What’s more, it’s just as powerful and almost twice as efficient. The 370Nm torque is delivered across a wider powerband and makes for easy off-roading and

highway cruising. It is very punchy and the automatic keeps the engine in the meat of the powerband on all occasions. The Thar Roxx is very capable off-road with new features like Intelli-turn that reduce the turning circle by locking the rear wheels and Crawl mode which is like a cruise control for tough terrain where it maintains the right throttle to get you out of tricky situations.

Not only is it light at city speeds, it weighs up and gives lots of confidence at high speed. There is a hint of body roll, but the car feels composed and grip is great. big 19-inch wheels and suitable 255/60R19 tyres, it rides over broken roads with an authority than only a body-on-frame SUV can. The Thar is available in various trim levels but only the diesel gets four-wheel drive. The bulk of the sales will be two wheel drive variants and they are priced rather well. With prices starting from Rs12.99 lakh, you are in for a long wait, if you want one. But, you know what? It will be worth it
