ccording to a recent Colliers India report, the Indian office leasing market witnessed an unprecedented surge in the fourth quarter of 2023, reaching a record-breaking 58.2 million square feet of gross absorption. ata Motors has successfully secured a significant order from the Uttar Pradesh State Road Transport Corporation (UPSRTC) to provide 1,350 bus chassis. The competitive procurement process, conducted through e-bidding and government tendering, resulted in Tata Motors emerging as the chosen supplier. The company expressed its appreciation to the Uttar Pradesh State Government and UPSRTC for the opportunity to contribute to the enhancement of public transport. The delivery of the bus chassis will be carried out in phases, according to an official statement by Tata Motors. In an official statement, Rohit Srivastava, Vice President & Business Head – CV Passengers at Tata Motors, emphasized the company's mission to make public transport more effective and efficient.

Controversial French Immigration Law Passes Parliament

Both President Emmanuel Macron's centrist Renaissance party and Marine Le Pen's farright National Rally (RN) supported the amended bill, creating a significant majority in the lower house. Despite accusations from the left that Macron made concessions to the farright, the ruling party's overwhelming majority rendered support from Le Pen unnecessary. Macron had underscored his reluctance to owe victory to the RN, expressing a preference for a new reading of the bill instead of relying on their backing. Some key provisions in the new legislation include making it more challenging for migrants to bring family members to France and delaying their access to welfare benefits.

Russia Luring Migrants from Finnish Border for War in Ukraine

ussia has been recruiting foreign migrants detained at its border with Finland for military service in Ukraine, as evidenced by several cases reported by the BBC. This practice involves coercing individuals in pre-deportation detention centers to sign contracts for army service. While this tactic is not new, the numbers increased significantly as foreign migrants arrived at Russia's border with Finland. Finland temporarily closed its Russian border crossings, accusing Moscow of using migrants as part of a destabilization campaign after Finland joined NATO. In the past three weeks, 236 people in Karelia, one of the three Russian regions bordering Finland, were arrested for staying in Russia without valid visas. The pattern was similar in the other two border regions of Leningrad and Murmansk.

Could you give us a bird’s eye view of your journey from being a Naval Architect to becoming an experienced Clinical Hypnotherapist, handwriting analyst, and holistic life coach? I graduated from the University of Southampton in the UK in Marine Engineering and Naval Architecture, following the family tradition in the marine industry. Once I began working in this field, I realized it didn't resonate with me as I had hoped. I felt compelled to pursue something that truly fulfilled me. Remembering my childhood dream of becoming a psychologist, I decided to explore that path alongside my Marine Engineering career. I delved into Clinical Hypnotherapy, initially as a side interest. Through extensive research and a year and a half of dedicated study, I seamlessly transitioned into the world of therapy. Opting for a parttime role in the family business and part-time as a Clinical Hypnotherapist, I discovered the vast and continually evolving landscape of therapeutic methods. My journey expanded as I explored vari-

ous modalities such as handwriting analysis, transpersonal regression therapy, Clinical Hypnotherapy and energy work, continuously seeking to deepen my understanding and help individuals deal with mental health challenges and emotional distress.

How did you integrate your engineering background into your therapeutic approach? What unique perspectives did it offer in your practice? It's about the approach to problem-solving, examining issues from various perspectives—an inherent skill cultivated through engineering. When addressing problems in relationships or stemming from childhood experiences, the key lies in identifying the root cause. This is where hypnotherapy diverges from common misconceptions. Contrary to the belief that it involves mind control or entertainment, hypnotherapy is about delving into the origin of issues. It's about uncovering where and how things began. To navigate clients toward resolution, it's crucial to pose the right questions and guide them effectively, which requires a comprehensive understanding of

Can you elaborate on your professional achievements in podcasting and hypnotherapy, and could you provide insights into your involvement with the movie DAM999? Certainly! In the realm of podcasting, I am honored to have been acknowledged among the top 7 podcasters, showcasing my expertise in diverse areas such as hypnotherapy, holistic well-being, and cognitive behavioral therapy. My credentials in mind sciences extend to Clinical Hypnotherapy and transpersonal regression therapy, happiness coaching, handwriting analysis, metaphor therapy, therapeutic tarot reading, sound therapy, and family constellation therapy. Turning to my involvement with the film DAM999, it has been a profoundly enriching experience. This cinematic piece serves as a poignant tribute to the 1975 Banqiao Dam disaster, shedding light on a tragedy that claimed 250,000 lives. The film is particularly notable for its compelling storytelling and historical significance. DAM999 has received global acclaim with multiple selections and awards, including recognition in the Oscars. for Original Score, Original Song, and Best Picture categories. Additional accolades include honors at the Golden Rooster Awards, International Film Festivals, and the documentary "DAMs - The Lethal Waterbombs," drawing attention to the critical condition of aging dams worldwide. Being part of this project has allowed me to contribute to a significant narrative, addressing a historical event and its aftermath through the impactful medium of film.

Could you walk us through a typical session with a client struggling with chronic pain or a chronic disease? How does hypnotherapy play a role in managing

such conditions? When clients approach me with chronic ailments or persistent physical pain, I emphasize that these physical manifestations are often the endpoint of unresolved emotional distress. Physical ailments are often linked to underlying emotional attachments or meanings. Different parts of the body tend to harbour specific emotions. For example, anger might be associated with the jaw, vulnerability with the thighs, or bitterness with the liver. Hypnotherapy focuses on tracking the root cause using regression. By addressing and releasing stored or unresolved emotions from the body, the energy meridians, of which there are around 72,000, regain their flow. This often results in significant healing, sometimes quite rapidly. In cases like these, hypnotherapy sessions typically don't exceed 10 because of its deep work with the subconscious mind. This depth contributes to its effectiveness and often leads to quick and substantial healing.

When addressing anxiety disorders or addictions through hypnotherapy, what strategies do you employ to ensure lasting behavioural changes? Anxiety and addiction are two distinct issues, each requiring different approaches in hypnotherapy. For anxiety, we delve into the root cause, employing various tools and techniques to restore the parasympathetic nervous system. Panic attacks often stem from an overactive sympathetic nervous system, and once we address the underlying cause and regulate the system, managing anxiety becomes more feasible. Addiction, on the other hand, often arises from unfulfilled aspects of life, creating voids that individuals seek to fill. This can manifest in various addictive behaviours as an attempt to alleviate the pain of these voids. By identifying and addressing

the root causes, we aim to desensitize and guide clients through it. This approach helps diminish the need to rely on substances or behaviours to cope. While these sessions can be intense, typically requiring six to seven sittings, it's entirely feasible to navigate through these issues and emerge on the other side with a healthier perspective and reduced reliance on addictive behaviours.

What advice would you offer to individuals sceptical about the effectiveness of hypnotherapy in treating conditions like stress or fears and phobias? Certainly, I understand the scepticism around hypnotherapy, largely stemming from misconceptions perpetuated by media representations. However, what's portrayed on TV lacks the therapeutic depth and scientific protocols that underlie genuine hypnotherapy practices. When engaging with hypnotherapy, it's important to acknowledge that it operates on the subconscious mind, a realm governed by its own science and methodologies. Following these steps correctly renders hypnotherapy an effective tool. In addressing phobias, and fears, and helping the cessation of smoking, hypnotherapy stands out as a valuable treatment method. Its success isn't mystical but rather rooted in the process of accessing and dealing with the root cause. Unlike other modalities that often engage primarily with the conscious mind, hypnotherapy accesses the subconscious mind, which accounts for 88 to 90% of our mental capacity. It's this part of the mind that stores logical solutions for life's seemingly illogical situations. By effecting changes within the subconscious mind, which is exponentially stronger than the conscious mind, hypnotherapy can significantly alter thought patterns and behaviours. This process essentially over-


rides the conscious mind, influencing and shaping an individual's thinking patterns.

As someone deeply committed to guiding clients toward self-discovery, how do you measure success in your therapeutic practice? Could you share a particularly rewarding client transformation journey? I find immense fulfillment in my practice. To me, success is measured by the cases I handle—those referred by psychologists, psychiatrists, or doctors who've struggled to help their patients. Conditions like IBS, psoriasis, autoimmune diseases, and strange muscular movements-are instances where hypnotherapy proves effective. Working with these cases brings me profound joy because witnessing clients find relief when other avenues fail is truly remarkable. For instance, one client battled an eating disorder for two decades. In just one session, a 20-year habit of midnight binging came to an end. It was a monumental transformation without any medications. Another person had a perplexing jaw movement defying medical explanation. After three weekly sessions, he went from a debilitating 10 out of 10 to a manageable 2 out of 10 on the discomfort scale. It's not that hypnotherapy is the ultimate solution for all, but it undeniably works. Unfortunately, people often turn to hypnotherapy as a last resort due to stigma or sheer desperation. Yet, its effectiveness lies in tapping into the part of the mind where answers are held.

As the Chief Happiness Officer of a multinational consortium, how do you balance your corporate responsibilities with your therapeutic practice? Balancing my role as the Chief Happiness Officer of the Aries Group's Happiness Division with my therapeutic practice and other commitments involves meticulous time management. I've adjusted my schedule, dedicating

two days per week to my therapeutic center while overseeing operations at our family business and the dental clinic. At Aries Group, our goal is to increase life expectancy by 10% through holistic well-being initiatives. As the daughter of Sir Sohan Roy, how has your father's vision and leadership at Aries Group influenced your own roles, and what key lessons have you

learned from his business experience? I believe his greatest strength lies in his hyper-efficiency and growth-oriented mindset. His ability to structure the company, implement systems, and measure the efficiency of every team member using his own software, EFFISM, is remarkable. This approach has created a self-sustaining system within the company, ensuring


smooth operations even in his absence. His emphasis on numbers and creating real-time strategies to address any setbacks has been invaluable. He's taught me the importance of proactive problemsolving, instilling the belief that every problem has a solution. This mindset has become ingrained in me, making it hard to sit back and feel like a victim when faced with challenges. Instead, I instinctively focus on finding solutions and taking action—an invaluable quality I've gained from him, for which I'm immensely grateful.

Your professional journey spans across various industries, from entrepreneurship and hypnotherapy to naval architecture. Could you elaborate on how these diverse experiences have influenced your approach to investments, particularly focusing on your involvement? My diverse background in Naval Architecture and Hypnotherapy and experiences in entrepreneurship has deeply influenced my approach to investments, guiding me to ventures that align with my passion for innovation and accessibility in healthcare. I serve as Director for Wolf/ Tenshield Airmasks, where our focus is on pioneering health products, particularly advanced air masks that offer unparalleled protection. The company is committed to crafting cutting-edge solutions that prioritize enhanced safety and well-being. AM Health Hub, a medical tourism company, embodies my dedication to transcending global healthcare barriers. Partnering with Aries Group and Macins Group, our mission is to facilitate seamless access to top-tier medical services across 40+ countries. This initiative aims

to break geographical barriers and make high-quality healthcare a borderless experience. I have also invested in a medical app, Cliniqally that stands as a testament to my belief in revolutionizing healthcare accessibility. This platform empowers doctors through virtual clinic setups, leveraging technology to enhance doctor-patient interactions. Its features like digital prescriptions, AI-driven recommendations, and a reliable referral scheme, are pivotal in bridging the gap between patients and superior healthcare choices. Each venture I choose to associate with embodies a unique facet of my background, converging in a collective vision to transform and elevate the healthcare landscape.

Entrepreneurship often comes with ups and downs. How do you build resilience to navigate challenges and setbacks? I owe a tremendous amount to my dad for being my unwavering support system. Having someone there who allows me to make mistakes, to stumble, and still provides guidance and support is invaluable. It's this assurance that helps me cultivate resilience. Growing up, I encountered numerous rejections that, while challenging, taught me to develop a tougher mentality. Rejection, from an early age, instills the ability to not just feel emotions but to channel them into finding solutions. It's crucial to acknowledge emotions, even cry if needed, but it's equally important to move beyond that and strategize the next steps. This growth mindset, cultivated through facing various challenges, has been instrumental in building both my

resilience and a robust approach to problem-solving.

Beyond work, what brings you joy? How do you balance personal interests with professional responsibilities? Outside work, I cherish hitting the gym, indulging in salsa and bachata dancing, although I wish I could do it more frequently. Most of all, returning home, completing my daily physical activity, and unwinding with my family and dogs are my ultimate go-to things. That's my haven. Moreover, I have a profound passion for outdoor pursuits. Whether it's wake surfing, hiking in the lap of nature, or engaging in any physical activity outdoors, I'm all in. Plus, I'm a dedicated yoga enthusiast. That pretty much sums it up!

What advice do you have for young professionals aspiring to take on leadership roles, especially within the context of a diverse and dynamic business environment? You can never fully prepare for everything that comes your way; life always throws curveballs. I firmly believe in diving headfirst into things. For instance, I'm a Marine Engineer and a Clinical Hypnotherapist who recently ventured into the dental and aesthetic clinic industry, despite knowing very little about it. Learning as you go is key. Having a growth mindset and the resilience to persevere are crucial. With these qualities, along with a commitment to finding solutions, you can navigate any entrepreneurial journey. Additionally, constantly explore different strategies, staying dynamic and attentive to your business's day-to-day and week-to-week performance. Adapting strategies based on analysis is invaluable advice in entrepreneurship. That’s my best advice!!

ll finance is climate finance. For me, this is the most important takeaway from the 28th session of the UN Climate Change Conference -- better known as COP 28 -- held in Dubai, United Arab Emirates (UAE) between 30th November 2023 and 13th December 2023. In a nutshell, the message from the history-making UAE consensus, as the final document adopted by all parties to COP 28 is now known, is that the financial industry should go where the emission is to see the ‘accelerated transition’ to green energy sources, clean and transformative

technologies at a rapid pace than ever to stop climate change and to make the planet a better, happier and safer place to live in. This means the financial firmament should gear up to address the intertwining risks and opportunities to get there – the net zero goal within the timeline. Since a lot has already been written and spoken about the COP28, which some sceptics even termed as 'dead on arrival', I will confine this piece mostly to the role finance has to play to achieve the ultimate goal of the UAE declaration with a brief mention about the commitments made. This is because finance is the

oil that powers the global growth engine and if finance gets the path right then the rest will follow on its trail. Let me now list out a few landmark agreements achieved during the COP 28 conclave. To me, the first and foremost among the many accords materialised during the event was the landmark agreement to set up the loss and damage fund. In my view, this will accelerate the energy transition faster than before since it is for the first time the world’s biggest CO2 emitting nations agreeing to compensate for the damages they have done to the


planet and their lesser rich cousins instead of seeking low emission and not-so rich countries to share the burden of transition equally. I would like to call this fund as a climate justice fund since it provides a level-playing field for not so rich nations for their sufferings from the sins of the richer nations. A large part of the credit should go to the Indian Government since it was the steadfast stand the nation as the former president of G-20 and the leader of the Global South that helped clinch this watershed deal. India can also take credit for the consensus decision to triple the green energy capacity by 2030 as it was first mooted by the New Delhi Leaders’ Declaration at the G20 meet. Besides, the host UAE has set the ball rolling by vowing to set up, capitalise and operationalise a

fund worth $30 billion to invest in climate friendly projects across the globe, with $5 billion earmarked for the Global South. Besides, UAE banks pledged to mobilise around $270 billion in green finance which will be deployed elsewhere. There are numerous other such pledges at the global climate meet which I am not mentioning to avoid risk repetition. At the same time, it is important that inter-governmental commitment to channelise finance to net zero goals are right, albeit small, steps in the right direction. However, I firmly believe that, to make the UAE consensus work, a calibrated and synchronised action is needed, involving the governments, regulatory authorities and the financial institutions so that financial institutions use their leverage with portfolio companies to promptly set internal targets to

achieve unit level net zero goals which should be a key monitorable in future project financing. There is also a felt need for a mechanism that could track such targets on a regular basis as in the case of financial reporting. This is because, if history is anything to go by, many a time big finance often found it convenient to toe the line that underscore the adage, 'promises are hard to keep'. As the host of COP28, Sultan Ahmed Al Jaber, rightly observed: “An agreement is only as good as its implementation”. Therefore, let us hope the historic consensus on climate action reached at the Dubai meet is put to action in its letter and spirit by all parties so that it will be the beginning of a new road that takes the planet to somewhere to achieve the goal of a carbon free planet

Some Awesome Books I Read in 2023

nother year passed with me clocking the target of 100 books (and a wee- bit more). In recent times I often get this question by friends and colleagues – ‘Is it not a colossal waste of time, when you can get the summary of the book in wellarticulated essays, ChatGPT and YouTube videos?’. Well, I normally smile and let it go and perhaps to the younger generation, I remind them that it is the process of reading that gives me pleasure – uncovering new topics, entering different labyrinths of knowledge and most importantly looking to understand the world a little better. And the time to read? Travel, waiting at airports, the odd insomniac spells and the ferocious thirst for the written word – well, the world does conspire to give you more time. Anomaly – Herve Le Tellier – This is clearly one of the smartest

fiction I have read in recent times. A flight hits an electronic cloud and miraculously becomes two flights – a replica of each other including a copy of all the passengers. The flights land at the same airport in the space of months – what do you do when you have a double of yourself in the world? Besides the creative story and some of the questions the book poses will leave you thinking for weeks. Very smart writing and premise building. Fincher by Adam Nayman – Those of you who know my movie habits know my addiction to Fincher movies and admiration to Aaron Sorkin as a screen writer. This book which is still not complete is one of those lovely books I want to peruse through one page at a time. It is a brilliant exposition into the mind of a technician, who is at the peak of his craft and brings a new meaning to relentless. Must read for the movie

buffs only The Ministry for the Future – Kim Stanley Robinson – My work in Sustainability got me to read a lot of books on the subject in the last year and this one is a really well written one. The ability to articulate complex ideas related to climate change in simple unpretentious language makes it a compelling reading and it is a sort of one stop guide to climate change and understanding where we stand around this important subject. Slow Horses Series – Mick Herron – I saw this very interesting British spy series on Apple Tv couple of years ago and have recently wrapped up the third season. It has the best of British writing – sardonic humour, realistic settings and Gary Oldman doing some awesome line reading along with an outstanding ensemble. But the surprise package were the books. Mick Herron paints


this fabulous world of misfits, misadventurists from the MI5 shunted and parked in a division Slough House (alliterating with Slow Horse) and their fantastic adventures. Must read and must watch! The Jolt Effect – Mathew Dixon and Ted McKenna – This is a dissection of selling in management consulting. The thesis revolves around the fact that our true competition is not another competitor but the indecision of the customer. I typically avoid 'how-to' books and never recommend them. However, this one is a thoughtful read, grounded in diligent research, featuring great case studies, and it almost provides templates and structures to help you think and work! For you professionals out there – read it! Ruthlessly Caring – Amy Walters Cohen – As a caveat – Amy is a colleague in our UK office. She brings out a series of five paradoxical mindsets, leaders need to embrace

while negotiating the new world – Ruthlessly Caring, Ambitiously Appreciative, Politically Virtuous, Confidently Humble and Responsibly Daring! Intrigued? Read it! It is a fantastic mental exercise on how we visualise management scenarios of the future and become future-fit professionals. Elon Musk – Walter Issacson – This is a very well written biography and also perhaps first comprehensive attempt to humanize Elon Musk as a human being, a professional and an entrepreneur. If you have read Issacson classics on Steve Jobs and Leonardo Da Vinci – you know what to expect. There are very few writers who can get into such depths of the human psyche and then be able to explain their minds, their aspirations and their vision to others. Constructed as a tome, it is a voluminous read but manages to keep your engaged. Don’t worry about the bulk of the book – it is a

breezy read. Time Shelter – Georgi Gospodinov – This one is a classic from the writer who gave us ‘The Physics of Sorrow’ some years book. It is one of really emotionally moving novels I have read in recent time s that deals with a very contemporary question: What happens to us when our memories disappear? Crafted with a questioning mode, the book poses a lot of personal questions to each reader and I think the experience of reading it will be different for different readers depending on your age and social setting. But one thread is clear – it is a masterful read! Same as Ever – Morgan Housel – Morgan Housel’s earlier book ‘The Psychology of Money’ was part of my 2021 list. ‘Same as ever’ is an equally compelling read. While we ponder on the future and the disruptions that it will bring in, we forget to ask a more fundamental question – What will remain the same

But it also presents a number of challenges, new pandemics, the irresponsible nature of human in neglecting hard facts like climate changes and public health systems. A brilliant read that sifts between the spirit of a thriller and

a detailed textbook. I also confess a recency bias though Anomaly was one of the first books of the year. There were some fabulous books which I did not include like Rewired (on AI), The Digital Mindset, Clear Thinking by Shane Parrish (Knowledge Podcast), The Global trade paradigm by Arun Kumar and the recent book Beyond Three generations - Family business by MSA Kumar, Navas and Firoze Meeran

How to Tackle Positional Vertigo Is there any permanent solution for this disgusting problem?

Benign paroxysmal positional vertigo (BPPV) is the most common disorder of the inner ear's vestibular system, which is a vital part of maintaining balance. Usually benign are generally not progressive. BPPV produces a sensation of spinning called vertigo that is both paroxysmal and positional, meaning it occurs suddenly and with a change in head position. It's typically unilateral, although in some cases it is bilateral. BPPV occurs as a result of otoconia, tiny crystals of calcium carbonate that are a normal part of the inner ear’s anatomy, detaching from the otolithic membrane in the utricle and collecting in one of the semicir-

cular canals. When the head is still, gravity causes the otoconia to clump and settle. When the head moves, the otoconia shifts. This stimulates the cupula to send false signals to the brain, producing vertigo and triggering nystagmus (involuntary eye movements).

Symptoms

Mainly vertigo, then dizziness (lightheadedness), imbalance, difficulty concentrating, and nausea. Symptoms are precipitated by changing the head’s position with respect to gravity. With the involvement of the posterior semicircular canal in classic BPPV, common problematic head movements include looking up, or rolling over and getting out of bed. BPPV may be experienced for a very short duration or it may last a lifetime, with symptoms occurring in an intermittent pattern that varies

by duration, frequency, and intensity. It can be tremendously disruptive to a person’s work and social life, as well as pose a health hazard due to an increased risk of falls associated with dizziness and imbalance.

A typical case scenario…

A 53-year-old computer professional has the problem of recurrent vertigo. It comes suddenly and really makes her helpless. Many times there is a tendency to fall with a nauseating sensation. Vertigo is maximum in the morning. Many medications were tried but no permanent relief. Have seen so many doctors and have done many tests. But all seem normal. Tried many exercises as per doctors' advice but have not produced any satisfactory relief.

Etiology

The most common cause of BPPV in people under age 50 is head


injury and is presumably a result of concussive force that displaces the otoconia. In people over age 50, BPPV is most commonly idiopathic, (occurs for no known reason), but is generally associated with natural age-related degeneration of the otolithic membrane. BPPV is also associated with migraine, cervical spondylitis and ototoxicity. Viruses affecting the ear (such as those causing vestibular neuritis) and Ménière’s disease are unusual causes. Occasionally BPPV follows surgery or after long periods of inactivity.

Diagnosis

BPPV is diagnosed based on medical history, physical examination, the results of vestibular and auditory (hearing) tests, and possibly lab work to rule out other diagnoses. Vestibular tests include the Dix-Hallpike manoeuvre and the Supine Roll test. A radiographic imaging such as a magnetic resonance imaging scan (MRI) to rule out other problems such as a stroke or brain tumor, and Auditory tests to help pinpoint a specific cause of BPPV, such as Ménière’s disease or labyrinthitis.

Treatment

Recommended treatment for most forms of BPPV employs particle repositioning head maneuvers (Epley manoeuvre) that move the displaced otoconia out of the affected semicircular canal and back into their proper location in the utricle. These manoeuvres involve a specific series of patterned head and trunk movements that can be performed in a healthcare provider’s office in about 15 minutes A single particle repositioning procedure is effective in treating about 80% to 90% of cases of BPPV. Additional exercise or repositioning maneuvers may be needed if symptoms continue. The particle repositioning procedure (Epley manoeuvre) begins by sitting up on a bed or table. Turn your head 45 degrees toward the affected ear (see how to determine your affected ear above). Quickly lie back, keeping your head turned toward the affected ear as you lie back with your head slightly over the edge of the bed or table. Wait about a minute or until you stop having symptoms. Without raising your head,

turn your head quickly in the opposite direction so that your “good” ear is parallel with but slightly over the edge of the table or bed. Wait about a minute or until you stop having symptoms. Roll onto your side. Continue to turn your head another 45 degrees in the same direction as the previous step so that your nose is now facing the floor. Wait about a minute. Keeping your chin tucked in toward your shoulder, sit up in the direction your body is facing.

Post-Treatment Considerations

After successful treatment with particle repositioning manoeuvre, residual dizziness is often experienced for up to three months. Patients sleep in an elevated position with two or more pillows and/or not on the side of the treated ear, wear a cervical collar as a reminder to avoid quick head turns and avoid exercises that involve looking up or down or head rotation.

home-based exercise therapy, surgery, medication, or simply coping with the symptoms while waiting for them to resolve.

Vestibular Rehabilitation Home Exercises

After receiving training from a doctor or physical therapist, a patient can perform the exercises at home Brandt-Daroff exercises involve repeating vertigo-inducing movements two to three times per day for up to three weeks., it reduces vertiginous responses to head movements in 95% of cases. Another home exercise method is the daily self-administration of particle repositioning head maneuvers.

Surgery

If head maneuvers and vestibular rehabilitation exercises are ineffective in controlling symptoms, surgery is sometimes considered. Several surgical approaches are

possible; however, a procedure called posterior canal plugging, also called fenestration and occlusion of the posterior canal, is preferable to other methods. These include removing the balance organs with a labyrinthectomy; severing the vestibular portion of the vestibulo-cochlear nerve with a vestibular nerve section, thus terminating all vestibular signals from the affected side, or severing the nerve that transmits signals from an individual canal with a singular neurectomy.

Medication

Medications are not beneficial always. Motion sickness medications are sometimes helpful in controlling nausea associated with BPPV and are sometimes used to help with acute dizziness during particle repositioning manoeuvres. Medication that suppresses vestibular function in the long term can interfere with a person making necessary ad-

aptations to symptoms or remaining physically active because of side effects such as drowsiness.

Wait-And-See

Sometimes, adopting a “waitand-see” approach is used for BPPV because it frequently resolves without intervention. Coping strategies during this wait-and-see phase can involve modifying daily activities to help minimize symptoms. This may involve using two or more pillows while in bed, avoiding sleeping on the affected side, and rising slowly from bed in the morning. Other modifications include avoiding looking up, such as at a high cupboard shelf, or bending over to pick up something from the floor. Patients with BPPV are also cautioned to be careful when positioned in a dentist’s or hairdresser’s chair, when lying supine, or when participating in sports activities

Arbitration Law In India The Year Gone By A Brief Review

T

he Former President of the United States, Franklin D Roosevelt said “The only limit to our realization of tomorrow will be our doubts of today.” As one turns the leaf of 2023, the saying seems more relevant than ever. In this article, I intend to delve into some of the key judgments in 2023 that have shaped the law governing Arbitration in India. As one bids adieu to 2023 and prepares to step into 2024, it is indeed clear that the dynamic legal landscape in India has brought several glorious moments for India. Arbitration in India has since its origin firmly rested on the consensu-

al autonomy of parties to a contract. The Arbitration & Conciliation Act, 1996 (“the AAC Act”) firmly rests on the consent of the parties from the stage of choosing the arbitration mechanism to the conduct of arbitration and the form and content of an award. The Act also envisages complete consensus on all points. This consensual resolution of disputes through the process of arbitration forms the leitmotif of the AAC Act. These essential principles were recently reiterated by the Hon’ble Calcutta High Court in the case of Mehrotra Buildcon Pvt. Ltd. vs. South Eastern Railway reported in MANU/WB/2464/2023.

Jurisdiction of the referral court under Section 11 of the AAC Act In the context of the scope of exercise of jurisdiction under Section 11(6) of the AAC Act, the Hon’ble Supreme Court in the case of NTPC Limited Vs SPML Infra Limited (2023) 9 SCC 385 has reiterated certain key tenets. The Hon’ble Court held the following key principles: • The Arbitral Tribunal is the first preferred authority to decide all questions of non-arbitrability. • However, relying on the judgments in the case of Vidya Drolia (2021) 2 SCC 1 and Nortel Net-

works (2021) 5 SCC 738 held that the Court exercising jurisdiction under Section 11 of the AAC Act must undertake a prima-facie test to screen and knockdown ex-facie meritless, frivolous and dishonest litigation. This limited jurisdiction of the Courts would ensure expeditious and efficient disposal at the referral stage. • The referral Court would also be required to examine whether the assertion of arbitrability is bona fide or not. The prima facie scrutiny of the facts must lead to a clear conclusion that there is not even a vestige of doubt that the claim is non-arbitrable. On the other hand, even if there is the slightest doubt, the referral Court must refer the dispute to arbitration. In the judgment in the case of

NPTC Limited (supra), the Hon’ble Court introduced a test coined the “eye of the needle test” whilst undertaking the limited scrutiny under Section 11(6) of the AAC Act. The Court held that it was the “duty of the referral court” to protect the parties from being forced to arbitrate when the matter is demonstrably non-arbitrable. This would help prevent wastage of public and private resources. The Court also held that if the referral court does not fulfil this duty of a limited review or becomes reluctant to intervene, this would in essence undermine the effectiveness of both the arbitration mechanism and the referral court. In another judgment, the Hon’ble Supreme Court in Magic Eye Developers (P) Limited Vs Green Edge Infrastructure Pvt

Limited (2023) 8 SCC 50 held that the question as regards the existence, and the validity of the arbitration agreement should be conclusively decided by the referral court at the referral stage itself. The Hon’ble Court in the said judgment placing reliance on the judgment of the Constitution Bench in the case of NN Global Mercantile (P) Limited (2023) 7 SCC 1 observed that the objective behind the said review at the reference stage is to “cut the deadwood and trim off the side branches in straightforward cases where dismissal is barefaced and when on the facts and law the litigation must stop at the first stage.”

Group of companies’ doctrine in the context of Arbitration law In a significant judgment, the

Constitution Bench of Hon’ble Supreme Court in the case Cox and Kings Limited Vs SAP India Private Limited 2023 SCC Online SC 1634 upheld the application of the group of companies’ doctrine in the context of arbitration which in

essence allows a non-signatory to an arbitration agreement to be bound by the arbitration agreement. The Group of Companies doctrine is also premised on ascertaining the intention of the non-signatory to be party to an arbitration agreement. The

doctrine requires the intention to be gathered from additional factors such as direct relationship with the signatory parties, commonality of subject-matter, composite nature of the transaction, and performance of the contract.


The Court noted that if a claim is made against or by someone who is not originally a signatory to an arbitration agreement, the Group of Companies doctrine can bind the “non-signatory affiliates or sister or parent concerns” to arbitration, “if the circumstances demonstrate that the mutual intention of all the parties was to bind both the signatories and the non-signatory affiliates”. The Court also noted that the doctrine of group of companies was clearly subsumed in Section 7(4)(b) of the AAC Act. Consequently, the record of agreement that evidences the conduct of the non-signatory in the formation, performance, and termination of the contract and surrounding circumstances such as its direct relationship with the signatory parties, commonality of subject-matter, and composite nature of transaction, must be comprehensively used to ascertain the existence of the arbitration agree-

ment with the non-signatory. In this inquiry, the fact of a nonsignatory being a part of the same group of companies will strengthen its conclusion. In this light, the Court held that there would be no difficulty in applying the Group of Companies doctrine as it would be statutorily anchored in Section 7 of the AAC Act.

Enforceability of an arbitration clause in an unstamped agreement In a landmark judgment delivered in December 2023, the Constitution Bench of Hon’ble Supreme Court in the case of Interplay Between Arbitration Agreements Under The Arbitration And Conciliation Act 1996 And The Indian Stamp Act 1899 2023 SCC Online SC 1666 held that agreements which are not stamped or are inadequately stamped are inadmissible in evidence under Section 35 of the Stamp Act. However, such agreements are not rendered

void or void ab initio or unenforceable. The Court held that nonstamping or inadequate stamping is a curable defect which does not fall for determination under Sections 8 or 11 of the AAC Act. On the contrary, the Court held that any objection in relation to stamping of the agreement would need to be considered by the Arbitral Tribunal, thereby overruling the majority decision of the earlier Constitution Bench in the case of NN Global Mercantile (P) Limited (2023) 7 SCC 1.

Parting thoughts 2023 has been an eventful year from the angle of the litigation landscape. 2024 is also poised to be an action-packed year as new thinking peppered with changes in law continues to unfold. In my view, some of the course correction undertaken in 2023 through judicial construction would augur well for the growth of arbitration as an efficacious alternative to litigation

Technologies Versus Foods High-value non-essentials versus low-value essentials The modern corporate valuation formula exposes the human follies as essentials and never-ending needs are underrated while non-essentials are rated too high.

One does not need to be so brilliant to discover that food is the most potential business without which none can live even a day. Where do all the foods come from? Humans cannot survive without farmers and farmlands. This essentiality itself constitutes the business potential of farming and trading of farm products. But farming is not as lucrative as any other business, which is not essential for human survival. Farming is the least lucrative, though no human being can live without food that comes only through farming sources. It is a grave distortion of

Now fertile agricultural lands are cheaper than infertile non-agriculture lands! In the modern capitalist world, we give high value to those things which humans can live without. Those things humans cannot live without are valued low. Is it not a

paradox? Is it not a result of our perceptional foul? The modern capitalist economy, while claiming to have engineered many changes to make the human living ecosystem far more comfortable with the abundance of everything around, changed the meaning of what is essential. There is nothing more important than food for human beings, so for all living beings. Yet, there is no farming company in the list of top 100 companies. Nestle, a Swiss food giant but not a farming company, with a value of roughly $90 billion, is much smaller than Apple, the most valued company with $2.72 trillion in market value. No farming company or food company in the world comes anywhere near the technology giants like Amazon, Alphabet, Microsoft, Meta, Tesla, and Walmart.


Humans can survive and live happily without these companies’ services, but not without food. Let us look at the biggest farming company in the world, the family-run Cargill. Its estimated value may be still lower. Cargill comes nowhere near the so-called top corporate value creators. Even Cargill, the largest farming company to call so, is only a grain trading company but not a direct farming company, even though it connects several hundred thousand farmers as Nestle does. Though Cargill does not directly do farming, it works with farmers as it needs direct procurement for global supply. As a trader, it connects users and producers. However, hitherto, there is no corporate model worth the name

However, sales were strong and buyers liked the additional practicality and huge presence. The Safari, you know, has an identical wheelbase as the Harrier, but with an extended rear overhang, it offers a third row of seats mak-

ing it more appealing to larger families. Three years on, Tata has done an upgrade similar to what we saw on the Harrier. Ride quality however has gone for a toss with the 19-inch wheels. It no longer rides with the same authority over potholes as it used to. Sharp thuds are felt inside the cabin. Things improve as speed picks up.

The Safari gets the 2.0L 170bhp, 350Nm engine as the Harrier and though refinement isn't great, it's up to the job. There is plenty of pulling power at low revs and it picks up speed in a linear manner. The Hyundai-sourced six-speed torque converter gearbox is a relaxed unit and makes the Safari an effortless

car to drive In town. Demand quick acceleration and it fumbles a bit. You can use paddles on the steering wheel for a quick overtake if you want to. The Safari also gets adaptive cruise control, lane departure warning, collision warning, automatic braking, rear cross-traffic alert, and

blind spot monitoring as part of the safety package. The updated Safari has enough tech to fight against rivals like the MG Hector Plus, Jeep Meridian, and Skoda Kodiaq. We think, if your budget permits, it's an overall better buy than the Harrier it's based on too
