We’ll have to wait another 50 years (maybe 25) to have in your hands such an Agora issue like this. An issue that summarizes the history of the USB with its lights and shadows.

It is not only a commemorative text but a practical vademecum of everything you need to know about our statutory achievements, many, if not all, of which are due to the action of Union Syndicale.

Of course, there is the METHOD. This word evokes everywhere a procedure for adjusting our wages, conceived by Union Syndicale (with the opposition of some trade unions, it must be said) and included in the Status. You will find, in the dedicated article, all the nuances of a system, admittedly complicated, which has been able to withstand the attacks of certain member states.

In addition to the METHOD. From entry into service to retirement, through promotions, our health insurance or the working environment, Union Syndicale has been present on all fronts. The Status testifies to this, and the Courts Judgements are there to prove it.

Moreover we have also invested in extra-statutory matters, developing information and advice lines in matters such as tax residence or inheritance.

We cannot ignore ignore the shadowy areas, indeed the USB has undergone several splits. One could say that it has been an incubator for unions. These splits have been encouraged by administrative policies aimed at dividing the staff and by a segmentation of the different categories which is sometimes more theoretical than real. Union action is therefore more complicated and unity of action more difficult to achieve.

USB is responding to this challenge by strengthening the Union Syndicale Fédérale, which is increasingly present in other international organizations and agencies. This allows for a solidarity that goes beyond the institutions of the European Union and allows for an exchange of best practices.

A big family happy about this 50th anniversary !

ARCHÉOLOGIE DE L’UNION SYNDICALE La petite histoire : l’Union Syndicale service public européen – Bruxelles (USB) fut fondée le jeudi 25 janvier 1973 lors d’une assemblée générale constitutive regroupant les adhérents du SGPOE – regroupement Bruxelles1 et du SGPOI – unifié2.

L’assemblée, convoquée à 14h30, a réuni plus de 600 adhérents au restaurant du 2ème sous-sol du Berleymont. Elle s’est tenue sous la présidence du Secrétaire Général de la centrale générale des services publics belges (CGSP).

Il y a 50 ans naissait l’USB dans un contexte d’élargissement de l’Europe avec, en toile de fond, la guerre froide qui polarisa les luttes sociales et fractura le mouvement syndical international.

L’ÉLARGISSEMENT DE L’EUROPE À la fin des années 60, les États-membres des Communautés3 sont frappées par des désordres qui nuisent au fonctionnement du marché commun. Pour éviter les divergences provoquées

par des réponses politiques nationales, les Six conviennent d’un plan par étape en vue de la création d’une union économique et monétaire européenne.

Durant les années 60, les Britanniques réorientent leur politique étrangère vers une Europe continentale de plus en plus prospère, alors que lors de la décennie précédente, ils s’étaient tenus à l’écart de toutes les tentatives d’intégration européenne susceptible de remettre en cause leur souveraineté, les liens avec leur ancien empire et leur relation privilégiée avec les États-Unis. Après deux refus de la part de la France, en 1961 et 1967, qui redoutait un affaiblissement de la CEE, le Royaume-Uni voit enfin s’ouvrir les portes du marché commun. Suite au traité d’adhésion, signé le 22 janvier 1971, il y est officiellement admis le 1er janvier 1973 en compagnie de l’Irlande et du Danemark (cf. Événements historiques de la construction européenne (1945-2014) sur l’infrastructure de recherche CVCE.eu de l’Université du Luxembourg4 .

LES INSTITUTIONS ARCHITECTURES DE L’INTÉGRATION Dans la construction européenne, la dimension intellectuelle et idéologique est importante, mais ses traductions concrètes le sont plus encore car ce sont elles qui lui assurent sa réalité. Parmi ses nombreuses traductions : les institutions européennes, véritable architecture de l’intégration européenne. Elles sont les formes et les structures sociales rapportées à l’Europe. Celles-ci prendront une forme spécifique puisqu’il s’agit nécessairement d’organisations internationales.

Dominée par la stratégie du containment visant à développer systématiquement une opposition aux syndicats communistes ou à ceux risquant de basculer de leur côté, la CISL apporte son soutien à la construction européenne en mettant en place un comité de coordination de la CECA. En 1957, elle crée un Secrétariat Syndical Européen (SSE) par l’intermédiaire duquel elle poussera ses organisations à participer au processus qui aboutira à la création de la Confédération Européenne des Syndicats (CES). Elle crée alors des organisations régionales afin d’organiser les luttes au plus près du terrain ; pour décupler son action, la CISL s’appuie généralement sur les fédérations syndicales professionnelles.

L’EXPLOSION DE LA FONCTION PUBLIQUE EUROPÉENNE

LUTTES SOCIALES DANS LES INSTITUTIONS EUROPÉENNES

Pour faciliter l’expansion économique de la Communauté, le Traité de Rome (1957) institue une banque européenne d’investissement. Il prévoit également l’association des pays et territoires d’outre-mer, c’est à dire les colonies françaises, italiennes, néerlandaises et belges en vue « d’accroître les échanges et de poursuivre en commun l’effort du développement économique et social ». Pour réaliser ces tâches, le Traité institue un Parlement européen, un Conseil, une Commission et une Cour de justice. Autant d’institutions qu’il va falloir garnir en personnel affecté à leur fonctionnement : au début des années 70, les effectifs sont portés à près de 10 000 fonctionnaires et agents.

Dans ce contexte d’élargissement de l’Europe, de développement des institutions, conséquence des actes du Traité de Rome, les effectifs de fonctionnaires et agents se développent pour atteindre près de 10 000 au début des années 70. Le personnel des institutions se mobilise. Les appels se multiplient pour réclamer des négociations sur les salaires des agents locaux, la lutte contre la discrimination du personnel féminin, l’indemnité de dépaysement et surtout la reconnaissance du fait syndical.

GUERRE FROIDE ET MUTATIONS DU MOUVEMENT SYNDICAL Les années 1968-1974 connaissent un très fort développement des grèves par rapport aux années précédentes. Le regain de combativité se double d’une évolution de la distribution des pouvoirs dans les syndicats. En effet, l’augmentation de l’influence de la base réduit la puissance des appareils syndicaux dans le même temps où les enjeux et les stratégies des conflits se définissent toujours plus au niveau du lieu de travail.

DE LA CISL À LA CES Sitôt après la fin de la seconde guerre mondiale, le mouvement syndical international se polarise, suivant en cela la logique de guerre froide qui va s’intensifier progressivement. Dès 1949, sous l’impulsion de la centrale syndicale américaine AFLCIO, est créée la Confédération Internationale des Syndicats Libres (CISL) qui rassemble à l’époque des organisations syndicales issues de 53 pays et qui revendique représenter près de 48 millions de travailleurs organisés. Les actes du Congrès désignent le « totalitarisme soviétique » comme « l’ennemi prioritaire », mais une minorité sociale-démocrate, issue essentiellement des pays européens, parvient à faire inscrire dans la résolution finale la condamnation de toutes les dictatures et l’idée que le marché ne doit pas être le seul moteur du développement.

LE PROCESSUS D’UNIFICATION À partir du 27 août 1971, l’Internationale des Services Publics (ISP), fédération internationale professionnelle affiliée à la CISL, organise une série de rencontres avec les représentants des organisations syndicales5 du personnel travaillant dans les institutions basées à Bruxelles et à Luxembourg. L’objectif affiché est de créer une structure fédérative se réclamant politiquement de l’ISP et de la CISL. C’est le Secrétaire Général de l’ISP (Carl W. Franken) qui préside les six rencontres qui se tiennent entre août 1971 et novembre 1972. Ce travail de discussion et de coordination débouche sur un protocole d’accord très détaillé en six points.

L’objectif de l’ISP est d’ériger la construction du syndicat en modèle d’unification syndicale. C’est le sens de la déclaration liminaire de l’assemblée générale de l’unification. Les premiers articles des Statuts de l’USB portent dès l’origine la marque de ces affiliations.

De plus, les syndicats s’accordent déjà pour étendre le processus d’unification à l’ensemble des syndicats des institutions des Communautés européennes en vue de la « remise en place d’une structure fédérale ». Ils s’engagent également à étendre les contacts aux syndicats d’autres organisations internationales implantées en Europe et se réclamant du syndicalisme libre (c’est-à-dire anti-communiste et social-démocrate) en vue de la création d’une structure fédérale. Cette volonté conduira à la création, en 1974, de la Fédération baptisée Union des Syndicats.

CONCEPTION ET ORIENTATION GÉNÉRALE DE L’ACTION SYNDICALE & VIE SYNDICALE En décembre 1972, les exécutifs des deux organisations bruxelloises organisent chacune une assemblée générale invitant les adhérents à rejoindre l’AG constitutive de l’USB qui se tiendra la 4ème semaine de janvier 1973. Les tracts adressés aux adhérents les exhortent à s’engager pour l’unification et à venir voter.

Au menu : • Politique salariale et sociale Le nouveau syndicat devra s’attaquer aux problèmes de la politique salariale et sociale : rémunérations, sécurité sociale, lutte contre les discriminations, action sociale.

Un programme-cadre est soumis à l’Assemblée générale constitutive.

• Conception de la fonction publique européenne (Statut) Cette partie du protocole est consacrée à la défense des intérêts du personnel étendue à la notion de fonction publique européenne. Ce n’est pas la somme des revendications des institutions, mais le protocole définit à cet effet un ensemble d’objectifs généraux en gardant à l’esprit la nécessité d’assurer l’indépendance, la permanence et la qualité de la fonction publique européenne.

Dans une Europe à un moment charnière de sa construction, la question de l’équilibre des nationalités se pose. La politique syndicale doit s’efforcer de combattre les discriminations selon la nationalité. À cette époque, on a tendance à considérer implicitement les fonctionnaires comme les dépositaires des intérêts de leur pays d’origine.

D’autre part, les États-membres sont très intéressés à s’assurer des places « à pouvoir » au sein des institutions européennes aux divers degrés hiérarchiques.

• Ressources de l’organisation Le nouveau syndicat revendique plus de 2 200 membres (fonctionnaires et agents) ; soit près d’un tiers de l’effectif total des institutions et organes européens de Bruxelles de l’époque.

Les institutions représentées sont : Commission, Conseil, Comité Économique et Social, Eurocontrol, Parlement).

Roger Van Campenhout fait adopter le premier barème solidaire des cotisations en fonction du traitement de base : allant de 30 FB pour une personne dont le traitement de base est 12 000 FB jusqu’à 250 FB pour un traitement de base dépassant les 250 000 FB. Il revendique devant l’AG « une cotisation forte pour garantir un programme de travail ambitieux » à savoir : - Un programme d’information et de formation syndicale pour les représentants syndicaux, les mandatés et les dirigeants.

- Un paquet de services aux adhérents : une assistance juridique, un fonds d’entraide, un programme de formation professionnelle pour évoluer dans la carrière, un fonds de grève, un programme d’accueil des nouveaux fonctionnaires et agents.

- Le maintien et le développement des relations avec les syndicats affiliés à l’ISP/CISL dans les organisations internationales et autres lieux d’affectation, mais aussi les confédérations et syndicats nationaux.

L’ensemble du programme générant des frais de fonctionnement accrus, les ressources nécessaires sont évaluées à 2 millions de FB par an.

1973-2023 : LES MÊMES LUTTES ?

moyens qui vont lui permettre de peser sur les négociations, tant au niveau de chaque institution, qu’au niveau interinstitutionnel. Sous l’impulsion de l’ISP et de la fédération belge des services publics, le syndicat va continuer à œuvrer pour l’unification du mouvement syndical dans les institutions et organes européens et internationaux.

L’histoire de sa création n’est pas pour autant cousue de fil blanc. En effet, un groupe de syndicalistes, essentiellement constitué d’agents locaux et de fonctionnaires de grade B, C et D très peu représentés dans le nouvel exécutif6, réagit et déplore la mainmise des haut-grades sur le fonctionnement du nouveau syndicat. Ils jugent également les cotisations mensuelles « inutilement très fortes ».

Partout où l’administration encourage le morcellement et la division syndicale, l’USB développe la solidarité, là où d’autres prônent une action syndicale catégorielle.

Fidèle aux principes posés dès sa fondation, l’USB a maintenu et développé l’ensemble de ses affiliations, l’intégralité de son programme d’aide aux adhérents, y compris le fonds de grève qui sera mobilisé à plusieurs reprises au cours des cinq décennies de conflits sociaux interinstitutionnels dans lesquels le syndicat s’est engagé pour la défense du personnel.

Mais le feu couve encore, comme celui de la menace d’une nouvelle réforme du Statut de la fonction publique européenne.

Certaines luttes sont encore d’actualité, telle la construction de l’unité syndicale ou encore la reconnaissance du fait syndical, notamment dans les agences de l’UE. Ce combat a 50 ans, l’Union Syndicale continue de le mener…

UNION SYNDICALE INVESTS MORE IN ITS MEMBERS UNION SYNDICALE INVESTS MORE IN THE LEGAL DEFENCE OF ITS MEMBERS THAN ANY OTHER TRADE UNION.

The examples below, which are based on real events but have been altered to protect the anonymity of those involved, clearly demonstrate that anyone can require legal assistance.

One of Union Syndicale’s main areas of activity is legal assistance, whether it involves advice on how to interpret the Staff Regulations or financial and technical assistance with lodging a complaint or an appeal with the courts.

LEGAL SUPPORT OF UNION SYNDICALE: WE CAN ALL FIND OURSELVES IN NEED OF ASSISTANCE.

While each member organisation of Union Syndicale Fédérale (USF) has its own rules, they all provide legal assistance and have the possibility, namely via USF, of calling on the lawyers of Union Syndicale Bruxelles (USB).

Unfortunately, however, some colleagues only become a member of Union Syndicale when they have a serious problem.

This equates to taking out fire insurance when your house is already burning down, at which point it’s usually too late.

Foreign residence allowance Maria has always lived in Belgium, but as her parents are Sardinian, she holds both Belgian and Italian citizenship.

When she was recruited by Ispra (Italy), she was refused the foreign residence allowance on the basis that she is an Italian citizen, which she considered normal. Almost three months later, while talking with some Union Syndicale colleagues, she found out by chance that she should have been granted

ACCESS TO JUSTICE Within the statutory framework of the European institutions, access to justice is not guaranteed.

While anyone can lodge a request, a complaint or a request for assistance without a lawyerand therefore free of chargeit is compulsory to be assisted by a lawyer in order to bring an appeal before the courts.

this allowance as she had not lived in Italy over the past ten years. With the help of Union Syndicale, she quickly drafted a complaint and submitted it within the three-month deadline: she was granted the allowance.

Serious illness

Liam is employed as a contract agent in an agency. His son, Kevin, had a serious accident and was in a coma for several months. Fortunately, the PMO fully reimbursed all of his medical expenses. However, three years after the accident, even though Kevin is still disabled and must undergo various treatments, the PMO considers that his life is no longer in danger and therefore no longer fully reimburses his treatment.

With Union Syndicale’s support, Liam will fight his case in court.

There is no standard fee for legal services, but based on our experience, we can safely say that an appeal rarely costs less than €5,000. As for the maximum amount, there is none. Depending on the law firm chosen, the complexity of the case and the various procedures that can arise one after the other, the cost can reach several tens of thousands of euros.

On top of that, if you lose, you are generally sentenced to pay the costs incurred by the institution. If an outside lawyer has been hired, the cost can be doubled or tripled, especially if it is a prestigious, and therefore expensive, law firm.

Without Union Syndicale’s legal assistance, many members would not have the means to assert their rights.

Harassment Christos was parliamentary assistant to the leader of a political group and was the victim of harassment. When he sought the help of his institution to stop this harassment, his request was dismissed: MPs are not covered by the Staff Regulations and, as a result, Christos could not invoke Article 24 of the Regulations to obtain Parliament’s assistance against an MP. Union Syndicale refuses to let harassers act with impunity and therefore lent its support to Christos and several of his colleagues who were victims of the same MP. Their claim was rejected: they were all fired and had to lodge an appeal with the court. After winning their appeal, they then had to lodge a second appeal because Parliament was dragging its feet and refused to enforce the decision. All of these proceedings cost several tens of thousands of euros; but the suffering experienced by the victims was finally acknowledged and Parliament had to pay them a considerable amount of compensation.

Transfer of pension rights

Juri was a contract agent for almost five years before passing the EPSO exam and becoming an official. A few years later, he inquired about the possibility of transferring the pension rights he acquired under the Polish national scheme before his entry into service. Unfortunately, he missed the deadline.

Convinced that this deadline was unfair, he lodged a complaint, which was rejected. He then turned to Union Syndicale to help him lodge an appeal. We advised him not to file such an appeal as the Staff Regulations and case law are clear on this issue: deadlines must be respected.

Promotion

Francesco is an official of the EEAS and has always had good professional relations. The head of his unit put his name forward for promotion and he was selected by the Promotion Committee. However, his name was then removed from the list

at the last minute, without any explanation. Union Syndicale’s lawyers drafted a complaint on his behalf. As a result, based on the legal arguments presented, the appointing authority (AIPN) chose to uphold the complaint and promote Francesco, rather than risk losing face in the Court of Justice.

Mobility

Hans applied for a position as Head of Unit. He met all of the conditions in the job advertisement and proved to be the best applicant. However, instead of giving him the position, the AIPN decided to cancel the selection procedure, to reorganise management slightly by modifying the description of the duties corresponding to the position, and to publish a new vacancy notice requiring a higher level of experience than that of X. As a result, Hans contacted Union Syndicale. Our lawyers advised him to lodge a complaint and possibly an appeal. As he was not a member of Union Syndicale, he was obliged to bear the cost of the complaint himself, which was rejected, and decided not to lodge an appeal which would no doubt cost him €5,000, not including the possible reimbursement of an even higher amount for the fees of the lawyer chosen by his institution. He will never be Head of Unit and his chances of being promoted above AD12 are doomed.

Harassment

Several members of Union Syndicale have contacted us to report their experience of harassment in their department.

This is not a rare occurrence, but our regular procedures are not adapted to this kind of situation. Union Syndicale has therefore decided to set up a “listening room”, with a lawyer trained specifically in listening and mediation. Each of our members can talk freely about their situation (what they are going through, what they are feeling, etc.) in the strictest confidentiality. By coming together, they are stronger in the

face of harassment and can decide what actions to take to stop the harasser. This specific care for a group of harassment victims has paid off and helped the individuals concerned to rebuild their lives, even though the extent of the results did not live up to our initial expectations.

Disciplinary inquiry

Dragos is a translator. The administration of his institution discovered his name on a list of freelance translators in spite of the fact that he did not submit a request to practise independently. It therefore decided to carry out an inquiry in order to determine whether disciplinary action was necessary.

Accompanied by a delegate from Union Syndicale, he managed to prove that he had ceased all freelance activity when he took up his duties, but that he was unable to have his name removed from lists automatically generated by advertising websites.

LEGAL SUPPORT OF UNION SYNDICALE: IT’S BEST TO PLAN AHEAD.

UNION SYNDICALE BRUXELLES Each branch of Union Syndicale has its own rules regarding its scope of intervention. For example, here are the rules applied by USB: Members of USB can call on our lawyers for a consultation, whether it involves a professional or private matter. If they have been members for at least one year or have been recruited recently, this consultation is completely free.

As far as their private life is concerned, our involvement ends there. For all matters relating to their professional life, we can help members draft a complaint or have it drafted by one of our lawyers.

If it is necessary to go to court, the Executive Committee decides whether USB will fund the appeal, based on its relevance to all staff and the chances of success. As a general rule, we ask the member to bear part of the costs, proportional to their salary. Beside this contribution by the participant, we cover all of the costs, including the possible cost of the institution’s lawyer. As a result, when it comes to deciding whether or not to lodge an appeal, our members know the maximum amount they will have to bear.

FÉLIX GERADON Félix Geradon was a translator at the General Secretariat of the Council. He was for many years a member of the Staff Committee, where he held various positions (secretary, vice-chairman, chairman) and represented the staff in several joint bodies. He was also Deputy Secretary General of Union Syndicale Brussels for a long time. Retired since 2019, he continues to participate actively in the life of Union Syndicale by being associated with the Executive Committee.

Pourquoi choisir l’Union Syndicale plutôt qu’un autre syndicat ?

A quoi sert-elle ? Quelles sont ses caractéristiques, quel est son ADN ? Et tout d’abord : pourquoi se syndiquer ?

Toute l’histoire de l’Union Syndicale repose en fait sur la solidarité. La solidarité entre collègues, pour s’aider mutuellement. Mais aussi, pour se faire entendre ensemble.

FACE À L’EMPLOYEUR Face à un employeur, un individu compte très peu. Les intérêts des travailleurs - qu’ils soient fonctionnaires, ouvriers ou employés - ont besoin d’une expression collective pour être entendus. C’est la raison première pour laquelle les travailleurs se syndiquent.

Si, aujourd’hui, pour ne citer que quelques exemples, • vous continuez à percevoir votre salaire quand vous êtes malade ; • vous avez un salaire qui évolue chaque année pour maintenir votre pouvoir d’achat ; • vous jouissez d’une très bonne couverture médicale ; • vous pouvez prendre du temps pour vous occuper de vos proches, grâce aux congés parentaux et familiaux ou au travail à temps partiel ; • vous pouvez espérer une évolution correcte de carrière grâce aux taux de promotion garantis ; • vous êtes libre le samedi ;

• vous pouvez rentrer chez vous à une heure décente ; • vous êtes assurés de pouvoir prendre vos congés annuels.

C’est grâce au progrès social que les syndicats, et en particulier l’Union Syndicale, ont obtenu par la négociation ou la grève.

Ces droits ne sont pas tombés du ciel. Leur concrétisation dans la Fonction publique européenne et internationale n’a été possible que grâce aux dizaines de milliers de collègues qui ont adhéré à l’Union Syndicale, et ont ainsi donné à l’ensemble du personnel le pouvoir de se faire entendre. LA FONCTION PUBLIQUE : COLONNE VERTÉBRALE DE LA CONSTRUCTION EUROPÉENNE Sans la Fonction publique, la construction européenne serait restée lettre morte. Les institutions ne fonctionnent et ne vivent que grâce à la permanence, la compétence et l’indépendance de la Fonction publique.

La triste vérité, c’est que ces principes doivent être défendus en permanence par l’Union Syndicale. Que ce soit au niveau législatif (le Statut, adopté par le Conseil et le Parlement) ou au niveau interne de chaque institution, nos «patrons» agissent souvent de manière schizophrène, en négligeant le

fonctionnement optimal des institutions : • ils tentent de raboter la Fonction publique en revoyant constamment à la baisse les conditions salariales et sociales ; • ils veulent recourir systématiquement aux contrats précaires, à durée déterminée - voire à la privatisation des services ; • ils succombent facilement à la tentation du népotisme (“pas de souci mon pote, j’ai une place bien au chaud pour ta nièce”) ; • ils acceptent ou encouragent le parachutage de bons soldats au service de Sa Majesté ou d’un autre gouvernement national.

Face à de telles pratiques, la construction européenne a besoin d’une Union Syndicale forte !

50 YEARS OF THE METHOD 1972-2022, FROM THE FIRST TO THE SIXTH A LEGACY LEFT BY LUDWIG SCHUBERT AFTER HIS BRILLIANT EUROPEAN CAREER AND HIS TRADE UNION AND COMMUNITY LIFE.

remuneration of the first officials and servants depended almost exclusively on the political will of the Council of Ministers: the Commission proposes, the Council decides!

Officials and other staff, whether in active service or retired, we are all accustomed to finding out at the end of the year – usually1 – that our salary or pension is increasing by a certain amount, backdated for 6 months.

As inflation often reached double-digit levels in the emerging European Community, salaries were only adjusted when staff and their trade unions mobilised to push the Commission to put forward a proposal that ultimately became an arbitrary and often unsatisfactory decision of the Council. Not only is industrial peace constantly disrupted by strikes to the detriment of the functioning of the institutions, but the attractiveness of the emerging EPS is threatened by a loss of purchasing power estimated at 25% compared to the evolution of remuneration in national civil services, not to mention private sector multinationals.

This is the result of the application of the “Method” designed in early 1971 by Ludwig Schubert. This benefit in our lives as staff and pensioners of the European Public Service (EPS), as some of us know, did not appear from nowhere.

On the one hand, this allows each official or other servant, irrespective of their career and remuneration or the fixed amount of their pension2, to have an income which adjusts annually according to a combination of the cost of living in their place of employment or residence and the average of the change in salary of officials of the main national civil services.

On the other hand, the annual adjustment – which is certainly not an automatic adjustment for inflation – maintains the attractiveness of the EPS through jobs and pensions that in principle remain financially competitive. This regular adjustment ensures the continuity of a competent, permanent and independent European Civil Service serving an ever closer Union of its Member States.

However, between 1962, the year of the first version of the current Staff Regulations, and 1972, the year of the first implementation of the Method, the adjustments to the

In the context of the years 1970-1972, where the prospect of enlargement to three new Member States and the rapid deterioration of the economic situation due to the first ‘oil shock’ were becoming clear, a solution needed to be found to the adjustment of salaries and pensions4 and to enable the restoration of social peace.

Ludwig Schubert, then a young administrative official in DG II, where he had worked since 1966, and a member of Union Syndicale, a progressive and reformist union5, proposed to the Commission and the other trade unions a ‘method’ for adjusting the remuneration and pensions of Community officials.

by staff mainly carried out by US, was of unlimited duration. As early as 1980, however, it was again denounced by the Council in an economic context made worse by the second ‘oil shock’.

It is in this period, which was not conducive to wage demands that one of the longest and most difficult negotiations of the existence of the Method began.

ESTABLISHING PARALLELISM OF CHANGE TO OUR SALARIES AND PENSIONS WITH THOSE OF THE NATIONAL CIVIL SERVICES AS THE BASIC PRINCIPLE OF THAT METHOD MAY APPEAR SIMPLE TODAY, BUT AT THE BEGINNING OF THE 1970S, IT WAS AN UNPRECEDENTED, SENSITIVE AND HYPER COMPLEX CONCEPT IN THE RATHER DIFFICULT POLITICAL, SOCIAL AND ECONOMIC CLIMATE OF THE COMMUNITY.

Faced with a Council which had sworn that there would never again be a Method, it took staff more than six months of action to obtain the third method, lasting 10 years, but with a ‘disaster’ clause which7 the Council may apply in the event of a serious and sudden deterioration of the economic and social situation. The Council also required, in compensation for the ‘exceptional’ period of 10 years of the agreement on the Method, the introduction of a crisis levy, the application of which spared the most disadvantaged categories, in particular C and D. Under different names and variable rates, it remains to this day the price to pay for the Method.

It was a question of persuading the Member States to disclose at Community level their data on the remuneration of national civil servants, which at that time was not politically or statistically easy.

The basic principle was to obtain from each of the Member States verifiable data on the nominal change – positive or negative – of general government remuneration, disregarding career progression, inflation and (net) taxation at national level.

The weighted average provided the percentage of the change in purchasing power – specific indicator, positive or negative — added to the cost-of-living index (inflation) at headquarters (Brussels/Luxembourg). The final percentage obtained6 was applied to the table of basic salaries of officials (Article 66 of the Staff Regulations), as well as to most allowances, and to the salary tables for other staff.

Thanks to the correction coefficients already present in the 1962 Staff Regulations, the equivalence of purchasing power between places of employment is maintained and consolidated, despite the statistical vagaries of the 1960s in some Member States.

It is again Ludwig Schubert within the US and the USF who led the negotiations on this levy. Thanks to his exceptional skills in economics and statistics and his resulting authority, he achieves the setting of objective parameters that will limit the percentage of this levy and which, if the economic situation improves, should enable the rate to be further reduced.

Also at the initiative of Ludwig Schubert and US, a Conciliation Commission (COCO) bringing together trade unions, institutions’ administrations and Member States’ representatives was set up at Council level. It played an important role in reaching this agreement, which would not have happened without the actions of staff, particularly in the General Secretariat of the Council, in order to maintain the balance of power between staff and the legislator.

In 1991, staff would have to mobilise for four and a half months to extract from the Member States the fourth method, identical to the previous one, but which then became an integral part of the Staff Regulations (Annex XI).

The first three-year method was adopted in March 1972 by the Council, which denounced it almost immediately at the end of the year.

Restored at the beginning of 1973, thanks to the Commission, which, under pressure from staff, brought an action against the Council, the Method began its long and ultimately brilliant career, which has now lasted 50 years.

The second method, adopted in 1976 as a result of new action 5 Ludwig Schubert was always a member of Union Syndicale, of which he was one day to become a leader and, once retired, President of AIACE and Honorary President until his death.

The fifth method, similar to the previous two, was adopted with the Staff Regulations of May 20048. It should be noted that for the first time, it legally guarantees an identical adjustment of the level of pensions.

During the 2004 reform negotiations, Ludwig Schubert, who was by then retired, also designed two other important elements of our current Staff Regulations: the method of adjusting pension contributions9 and the new salary scale10.

The Council, which since the 1973 judgment, had always complied with the Method, decided in 2009 not to apply it, relying on the exception clause11 and the degraded economic and budgetary context. The Court of Justice again ruled in favour of the staff and obliged the Council to apply the Method.

In 2011 and 2012, the Council repeated infringements with the same arguments, but taking care to comply scrupulously with the procedures and it was then the European Court of Justice which legitimised recourse to the exception clause12, although it was economically unjustified and contrary to the results of the Method during that period.

In this context, the Commission, Council and Parliament are negotiating the Sixth Method, slightly amended and renewed, which remains in the 2014 Statute. It is the culmination of an

It was in December 2018 that the case ‘Schubert et al. (P. Blanchard and others)’ was the subject of a very surprising judgment of the Court in favour of the legislature. It was also on 28 December that Ludwig Schubert died (www.aiace-be.eu/informations/l-ecrin-magazine-aiace-be).

The Court’s judgment sweeps aside all the applicants’ arguments to confirm a previous judgment of the Court against the Commission and uses this case-law as the main ground justifying its findings: with regard to the adjustment of remuneration, it is ultimately for the legislature to decide whether and how it applies the exception clause.

The Council’s decisions for these four years (2011-2014) caused a virtual freezing of nominal salaries in the EPS (+ 0.8%) and a loss of purchasing power for active and retired staff of 9.2% compared to officials of national central governments. This loss will never be recovered: the remuneration of officials and other servants will remain perpetually almost 10% lower than the level corresponding to parallelism: the competitiveness of the European Civil Service’s emoluments system has been and remains severely degraded.

optimal method obtained through an informed administration, an indisputable expertise from Eurostat and the representation of staff in particular the USF, as well as the AIACE, where Ludwig Schubert and its now retired members played a key role.

The process set out in Annex XI is now entitled: annual update of the level of remuneration provided for in Article 65(1) of the Staff Regulations. Member States are direct actors in the statistical process, but calculations, reports and proposals and decisions remain within the competence of Eurostat and the Commission. The co-legislators — Council and Parliament — are informed.

THE PRINCIPLE OF PARALLELISM WITH NATIONAL CIVIL SERVICES AS LAID DOWN IN 1972 REMAINS THE BASIS OF THE METHOD. As with the previous ones, this sixth method is of an exceptional duration of 10 years in relation to the Union’s wage agreement. On the basis of Eurostat’s annual report, of which the College of the Commission takes note, remuneration, including allowances and allowances, is to be automatically updated. The result is communicated to the co-legislators and published in the OJ C series.

In addition, the exception clause in Annex XI, which gave full powers to the co-legislators in the event of a crisis, is replaced by ‘moderation and exception clauses13’ based on objective and verifiable arrangements for spreading the update, in particular in the event of a deterioration in EU GDP.

Since the economic, budgetary and social crisis did not fully end in 2013, the co-legislators imposed in the Sixth Method a new solidarity levy14, the application of which does not penalise the most disadvantaged categories of staff or pensioners15.

Finally, the Statute provides for the application of the sixth Method until 2023 and beyond if necessary, until an agreement with the co-legislators has been reached for a possible seventh Method.

ON 1 MARCH 2022, THE METHOD, WHICH HAS FACED, AND OFTEN WITHSTOOD, MANY OBSTACLES AND CHALLENGES, CELEBRATED ITS 50TH ANNIVERSARY. Over the years, the ups and downs faced by these six methods include: economic and social crises, in particular the consequences of three oil shocks (1972, 1980 and 2003); the legislator’s refusal to apply the Method (1973, 2009, 2011 and 2012); its denunciation in 1980; the difficulties encountered at each deadline in obtaining its renewal (most often under staff pressure), legal actions brought by the Commission and by members of staff to defend it – but also by other staff members to annul it; the difficult negotiations on the justifications and 13

levels of the various levies (crisis, exceptional, temporary or solidarity), the exception clause16 ; the creation of weightings, including for a certain period of time at headquarters, and the inclusion in the salary scale of the Brussels-Luxembourg coefficient; the application of the Method to the progressiveness of the Community tax ; the introduction of the Method into the Staff Regulations; the major revision of the Staff Regulations in 2004 and, more recently, the great 2008 global financial (‘subprime’) crisis, which had serious budgetary consequences within the EU that were used to justify the 5th Method not being applied for 4 years from 2011 to 2014.

This half-century of existence of these six methods is something of a reflection of the economic and social evolution between the 1970s and 2022 (from the European Community to six Member States to the European Union with 28 members [27 since 1 February 2020]).

Between 2004 and 2019, the results of the Method show that the FPE was more severely subjected to the general austerity imposed on central national civil servants and civil servants.

These European citizens are representative of an EU middle class that has suffered the full brunt of the 2008 crisis, but who tends to attribute responsibility to the EU? It is undoubtedly for this political aspect of the Method, as well as for its impact on the European Civil Service constantly

committed to an ever stronger Union, that several Member States — not the least and not the less Europeans — under financial pretexts, try to adapt it to their requirements, or even simply denounce it.

UNFORTUNATELY, AT THE BEGINNING OF 2020, YET ANOTHER CRISIS EMERGED WITH THE SEVERE ECONOMIC CONSEQUENCES OF THE COVID-19 PANDEMIC. In 2020, the economic downturn caused by this new crisis resulted in an unprecedented decline of -5.9% of EU GDP. The new exception clause therefore applied and froze the result of the Method, which would have been an increase in purchasing power by 2.5%. It will only be reactivated on 1 July 2022, according to the forecast in the Commission’s report to the legislator for the period 1 July 2021-31 December 202117.

ICING ON THE CAKE OF THIS YEAR 2022, BARELY WERE WE OUT OF THE CRITICAL PERIOD OF THE COVID-19 PANDEMIC, YET NOT ENTIRELY FREE FROM ITS THREATS, WHEN RUSSIA UNDER THE ORDERS OF THE AUTOCRAT PUTIN DECIDED ON 24 FEBRUARY TO INVADE UKRAINE MILITARILY. This aggression, which those in power in the Kremlin refuse to call ‘war’, but rather a ‘special operation’ that was supposed to be brief, is entering its fifth month.

This war on the EU’s borders is a humanitarian and material disaster for Ukraine and its citizens. It poses a military threat to the Union and to its democratic values. The consequences are already disastrous and are manifested, among other things, by an unprecedented energy crisis that has exacerbated the return of rising inflation in the EU since the end of 2021.

It is in this new inflationary context reminiscent of the 1980s that the interim update foreseen by the 6th Method resulted in an increase of 2.4% for the 2nd half of 2021 (Belgium Luxembourg).

A further adjustment will take place with effect from 1 July 2022. This is expected to compensate for ongoing inflation of more than 8% in some Member States. However, the result is expected to be moderated by a decrease in the purchasing power of national civil servants still to be confirmed. However, with the recovery of the 2.5% purchasing power of 2020, the update to be decided at the end of 2022 could reach 4% (Brussels and Luxembourg).

CONCLUSIONS: To prepare for the future, you need to know the past. Let us bet that the Method will again be a victim of its historic success.

Some Member States18 will criticise and challenge it as soon as

the Commission, no later than the end of 2023, decides either to extend the sixth method or to propose a possible seventh method on the basis of the report COM (2022) 180 final19.

This will be all the more critical in the new economic situation linked to Russia’s war in Ukraine, which is likely to continue.

Moreover, the judgment of the Court of Justice of December 2018 on the application of the Method in 2011 and 2012 reminds us that the updating of our remuneration, which has been included in the Staff Regulations since 1991, is not an acquired right20 and unfortunately, Ludwig Schubert will no longer be there!

Active staff and pensioners, and hopefully all trade unions united with an ‘informed’ Commission, will have to mobilise themselves to make tireless use of the acquis of the Method and its win-win aspects for the EU institutions and bodies and their staff as well as for the 27 Member States.

WE WILL HAVE TO COMMIT OURSELVES TO DEFENDING THE LEGACY OF LUDWIG SCHUBERT, SYNONYMOUS WITH THE PERMANENCE, INDEPENDENCE AND COMPETENCE OF THE EUROPEAN CIVIL SERVICE AS WELL AS A SOCIAL PEACE ESSENTIAL FOR ITS FUNCTIONING IN THE SERVICE OF THE CITIZENS OF THE UNION.

He was for many years a member of the Staff Committee, where he held various positions (secretary, vice-chairman, chairman) and represented the staff in several joint bodies. He was also Deputy Secretary General of Union Syndicale Brussels for a long time. Retired since 2019, he continues to participate actively in the life of Union Syndicale by being associated with the Executive Committee.

LE RÉGIME COMMUN D’ASSURANCE MALADIE (RCAM) DE L’UE EN BREF SOULIGNONS DÈS LE DÉPART DEUX ÉVOLUTIONS RÉCENTES VISANT À RÉPONDRE À CERTAINS DES PROBLÈMES RENCONTRÉS : Le PMO a conclu avec une mutuelle néerlandaise un accord permettant aux affiliés de bénéficier des tarifs négociés par les mutuelles, ce qui représente pour les affiliés une économie sur les frais médicaux pouvant atteindre 40 % et leur permet de bénéficier du système de tiers payant appliqué par les mutuelles. Une solution similaire pour la Belgique est en cours de négociation. L’Union Syndicale soutient pleinement ces initiatives si le recours à la mutuelle nationale reste volontaire et permet aux affiliés d’exercer leur liberté de choix.

Le régime d’assurance maladie du personnel des institutions de l’UE (RCAM) est un des éléments essentiels de la couverture sociale du personnel des institutions car il couvre les frais de santé non seulement du personnel et des retraités des institutions, mais également de beaucoup de personnes qui sont à leur charge.

Ce régime comporte de nombreux aspects positifs, notamment (pour ne citer que les plus importants): • un taux de contribution relativement faible (1,7%) du traitement de base, ce qui est nettement moins que les contributions payées dans la plupart des États membres ; • une très large couverture, y compris pour de nombreux frais médicaux qui ne sont pas remboursés dans les États membres (par exemple les lunettes et les soins dentaires au-delà de 18 ans) ; • une complète liberté de choix, permettant à l’affilié de décider librement à quel praticien de soins s’adresser (dans de nombreux États membres, la liberté est limitée) ;

• une couverture réellement européenne, qui permet de se faire soigner dans toute l’UE (alors que, dans de nombreux États membres, le remboursement des frais médicaux à l’étranger pose souvent problème).

Notre régime présente toutefois aussi certains inconvénients : • des plafonds dépassés, ce qui fait que, pour certaines prestations, le taux de remboursement de 80 ou 85 % n’est plus garanti ; • des plafonds qui ne sont pas adaptés aux différents coûts des prestations médicales dans les différents États membres ; • quand on s’éloigne de Bruxelles, beaucoup de prestataires de soins ne connaissent pas les règles et procédures de notre régime ou essaient d’en profiter indûment (surfacturation) ; • le remboursement peut être refusé si, malgré l’avis du médecin, le traitement n’est pas considéré comme médicalement nécessaire.

L’US a soulevé et continuera de soulever ces questions, en proposant des améliorations pratiques.

Il y a quelques années, le PMO a mis en place un groupe de travail chargé de réviser et de moderniser les règles du RCAM. La procédure est longue et laborieuse car les règles sont nombreuses et complexes. Les principaux objectifs de l’Union Syndicale sont les suivants : • adapter les plafonds et mettre en place un mécanisme permettant de les actualiser automatiquement ; • moderniser les règles, mettre à jour de nombreuses procédures dépassées ou excessivement complexes ; • rationnaliser les règles, les rendre plus simples à lire et à comprendre ; • mettre en place une procédure permettant réellement d’adapter les plafonds aux coûts des prestations de santé dans les différents États membres.

Depuis de nombreuses années, l’US s’est tenue et se tiendra prête à conseiller et à soutenir ses membres lorsqu’ils sont confrontés à des difficultés liées au régime commun d’assurance maladie. Encore un avantage évident d’être ou de devenir membre de l’Union Syndicale Bruxelles.

CAREERS OPPORTUNITIES Within USF, Nicolas Mavraganis is best known for having been the president since July 2019, but he is also a European official at Eurostat. He arrived at the Commission in 1989 and joined its staff in 1994. For the 50th anniversary of US, he wanted to share with us his career path in the European Public Service and highlight US’s contribution to career development. What is his view of the landscape of the European Public Service today?

WHAT ATTRACTED YOU TO THE EUROPEAN PUBLIC SERVICE? Being multicultural and multilingual by virtue of my family background, I wanted to join an international organisation and in particular the European project, which matched with what I like to be and do. The big advantage of the European Public Service is that it offers the same opportunities to everyone, regardless of their academic, social and linguistic backgrounds.

CAN YOU TELL US ABOUT YOUR JOURNEY? I was able to try out the various kinds of employment relationship by working for the Commission, first as a consultant in service providers, then as a temporary agent and finally I was able to develop my career by passing a competition.

WHAT MAKES THE EUROPEAN PUBLIC SERVICE ATTRACTIVE TODAY?

WHAT DEVELOPMENT OPPORTUNITIES DOES THE EUROPEAN PUBLIC SERVICE OFFER?

Joining the European Public Service must always be a conscious decision and a lifestyle choice. It is important to emphasise this, because if I have career prospects, I will be able to commit to a long-term personal and professional project, included in the private sector.

Within the career structure of the European Institutions, there are opportunities for development, either through promotion or through different procedures such as certification. The recruitment stages are very long: two or three years may pass

We have a matrix career development, i.e. grade by grade with automatic step change every 2 years, within the institutions. We can start as AST and end up as top manager. In the European

WHAT ARE PROMOTION COMMITTEES?

Public Service, we can break free of social determinism on the basis of personal merit, chances…I’m not naive, some people evolve faster than others, but the possibilities are there.

Career developments, including promotion rates, are also part of what makes the European public service attractive.

CAN YOU TELL US MORE ABOUT THE PROMOTION RATES? The big advantage since the 2004 reform of the Statute is that there are promotion rates. This means that staff members have a rough idea of when they will be promoted. Prior to 2004, the promotion rate varied according to the budgetary resources available each year. Today, one can plan one’ s career progression. Unfortunately, this system does not apply to permanent contract staff, whose possibilities for development are limited. This is one of the Achilles heels of the European civil service.

IS THIS ALSO A NEGOTIATION THAT US HAS PUT IN PLACE? Union Syndicale at the time and in particular US Brussels was very active in setting up these promotion rates. This was offset by lower starting salaries and lower competition grades, but promotion rates are guaranteed. Today, promotion rates form an integral part of the institutions’ Staff Regulations (Annex 1b).

HOW DOES US SUPPORT THE CAREER DEVELOPMENT OF OFFICIALS? US offers training to pass all stages of competitions and mock interviews to help candidates with mobility. It also offers advice and training for all career development procedures (certification, mobility, promotion). It can also help unsuccessful candidates to formulate their appeal on the basis of their case, regardless of the level of selection, by providing access to its specialised lawyers.

Promotion is carried out on the basis of the comparison of merits, i.e. ‘evaluations’. There are two possibilities: either it is my service that put me forward for promotion, or my service does not put me forward for promotion and in this case I can make an appeal that is analysed by a Promotion Committee. This is a joint committee, meaning that half of its members come from the administration and half from the staff representation.

IS THE CURRENT FISCAL POLICY CONTEXT LEADING TO CHANGES? The current budget context does not respect the outlook of the general framework. There is a restriction on the recruitment of permanent staff, with the emphasis shifting towards staff with short-term contracts. More and more posts are being removed from the establishment plan. The Commission had committed to downsizing its staff, but there is still just as much, if not more, to do, so short-term staff were used to carry out the tasks of civil servants. US continues to request recruitment of officials, in particular through internal competitions.

ARE THERE CAREER PROSPECTS FOR PRECARIOUS CONTRACTS? Career development prospects for staff with precarious contracts are significantly less favourable or even non-existent compared to officials, unless they pass a general competition, since these are open to all, without age limit.

LES GRANDS ARRÊTS DE LA COUR DE JUSTICE EN MATIÈRE DE PERSONNEL Depuis sa création, l’Union Syndicale s’est maintes fois adressée à la Cour de justice pour obtenir l’interprétation des dispositions du Statut et du RAA, pour contester la légalité de certaines dispositions statutaires ou règlementaires.

Elle organise depuis près de trente ans des consultations juridiques gratuites pour ses adhérents et soutient, tant d’un point de vue juridique et technique que financier, leurs actions précontentieuses ou contentieuses ainsi que les plaintes qu’ils portent devant le médiateur européen. Pour permettre à ses adhérents de faire valoir leurs droits devant la Cour de justice, l’Union Syndicale prend en charge les frais de défense suivant ses règles internes.

LE DROIT À L’INFORMATION ET À LA NÉGOCIATION L’Union Syndicale a négocié, avec le Conseil en 1981, la Méthode d’adaptation automatique des rémunérations des fonctionnaires et autres agents. L’article de M. Günther Lorenz retrace les péripéties de cette négociation-marathon. Suite à

l’accord intervenu, le Conseil a adopté, le 15 décembre 1981, la Méthode d’adaptation automatique des rémunérations. En contrepartie, l’Union Syndicale a accepté un prélèvement, dont la dénomination a évolué avec le temps, qui a été instauré pour tenir compte des difficultés particulières de la situation économique et sociale au sein des Etats membres et s’est engagée à maintenir la paix sociale au sein des institutions de l’UE. Grâce à la mise en œuvre de cette nouvelle Méthode, le pouvoir d’achat du personnel a été maintenu depuis près de quarante ans.

Un recours en annulation ayant été introduit devant la Cour de justice contre ce prélèvement et, donc, contre la Méthode, l’Union Syndicale s’est portée partie intervenante au soutien de la Commission et du Conseil. Par son arrêt du 3 juillet 1985, la Cour de justice (Grande Chambre) a validé la Méthode en constatant, notamment, qu’elle était le résultat d’un accord réalisé après de longues négociations entre les institutions et les organisations syndicales du personnel les plus représentatives. La Cour de justice a ainsi

reconnu formellement le rôle des organisations syndicales et professionnelles (OSP) dans la défense des intérêts du personnel et l’obligation des institutions de respecter leurs activités1.

Dans son arrêt du 18 janvier 19902, la Cour de justice, réunie en Grande Chambre, a précisé que la liberté syndicale impliquait la possibilité pour les syndicats de participer effectivement aux concertations techniques et politiques préalables à l’adoption de toute proposition de règlement modifiant le Statut des fonctionnaires et le régime applicable aux autres agents.

La Cour de justice a ainsi précisé la portée de l’article 24 ter du Statut, qui reconnaît le droit d’association au personnel. Ce droit a été consacré, depuis lors, par les articles 27 et 28 de la

Charte des droits fondamentaux de l’UE (la Charte). La Cour a précisé que la liberté syndicale implique que les institutions respectent les activités syndicales, qui s’avèrent nécessaires pour assurer une participation effective du personnel au processus de concertation et que les représentants des OSP devaient, dès lors, bénéficier de dispenses de service selon les modalités à fixer par les institutions. C’est à la suite de cet arrêt que les institutions ont signé, avec les OSP, les accordscadres fixant les ressources mises à leur disposition pour exécuter, dans l’intérêt de l’ensemble du personnel de l’UE, leurs activités de défense du personnel et, notamment, de permettre leurs participations aux concertations politiques et techniques ainsi que la représentation du personnel dans les différents comités paritaires, dont le Comité paritaire de promotion.

LE DROIT AU RESPECT DE LA VIE PRIVÉE Dans son arrêt sur pourvoi du 5 octobre 19943, la Cour de justice a rappelé que le droit au respect de la vie privée, qui comporte notamment le droit d’une personne de tenir son état de santé secret, constitue l’un des droits fondamentaux protégés par l’Ordre juridique de l’Union. Dans cette affaire, le requérant s’était vu proposer un contrat d’agent temporaire pour une durée de six mois. Constatant qu’il n’avait pas donné un consentement éclairé à un test médical pratiqué à son insu, la Cour de justice a annulé la décision de la Commission de ne pas l’engager en raison d’une soi-disant inaptitude physique aux motifs que, si un examen médical d’embauche sert un intérêt légitime des institutions de l’UE, cet intérêt ne justifie pas que l’on procède à un test médical contre la volonté d’une personne.

LA COUVERTURE CONTRE LES RISQUES DE MALADIE Un agent a été employé par la Commission pendant plus de deux ans en tant qu’agent local et, ensuite, pendant trois ans, en tant qu’agent auxiliaire au titre d’un contrat à durée déterminée, qui a été renouvelé à dix reprises et a été couvert, à ce titre, contre les risques de maladie par le régime de Sécurité sociale belge. Il a ensuite été au service de la Commission en tant qu’agent contractuel auxiliaire pour une nouvelle période déterminée de trois ans. La Commission lui a, toutefois, appliqué une clause de réserve en raison des conséquences d’une maladie qui s’est déclarée alors qu’il était à son service en tant qu’agent auxiliaire.

L’Union Syndicale a soutenu, tant d’un point de vue humain et technique que financier, cet agent, lequel ne pouvait être laissé sans couverture médicale liée à la maladie qui s’est déclarée alors qu’il était déjà au service de l’institution depuis plusieurs années et couvert par le régime de Sécurité sociale belge.

Dans son arrêt du 29 septembre 20094, le Tribunal de la Fonction publique (TFPUE) a constaté qu’un ressortissant de l’Union travaillant dans un Etat membre, autre que son Etat d’origine, ne perdait pas la qualité de travailleur, au sens de l’article 45 du Traité sur l’UE, du fait qu’il occupe un emploi auprès de l’UE

et qu’il ne pourrait, à ce titre, se voir refuser le bénéfice des droits et avantages sociaux que lui procure cette disposition du Traité. Le TFPUE a également rappelé que c’est précisément pour garantir que l’exercice du droit à la libre circulation n’ait pas pour effet de priver un travailleur davantage de Sécurité sociale que le législateur a édicté la règle de totalisation des périodes d’assurance, de résidence ou d’emploi dans le domaine de ladite Sécurité sociale (règlement [CEE] n° 1408/71 du Conseil du 14 juin 1971). Il en a conclu que la clause de réserve médicale (articles 32 et 100 du RAA) devait être interprétée en tenant compte des exigences découlant, dans le domaine de la Sécurité sociale en particulier, du principe de la libre circulation des travailleurs, lequel fait partie des fondements de l’UE. Le Tribunal a constaté que l’application de l’article 100 du RAA pénalisait la requérante en la privant de la couverture contre les risques de maladie et était, dès lors, de nature à produire un effet dissuasif, de même qu’elle était susceptible d’entraver l’exercice du droit à la libre circulation de l’agent. Le Tribunal, après avoir constaté l’illégalité de la réserve médicale imposée à la partie requérante, a annulé la décision de la Commission.

LE PARTENARIAT ENREGISTRÉ Suite à l’adhésion de l’Autriche, de la Finlande et de la Suède, un fonctionnaire, reconnu comme partenaire enregistré par sa législation nationale, s’est vu refuser le bénéfice de l’allocation de foyer au motif que ce statut n’était pas visé par le Statut.

Par son arrêt du 31 mai 2001 sur pourvoi5, la Cour de justice a rejeté l’action au motif que la décision attaquée ne violait pas les principes d’unicité du statut personnel d’une personne, ne constituait pas une discrimination fondée sur le sexe, une entrave à la libre circulation des travailleurs et à l’égalité de traitement.

Les motifs de cet arrêt de rejet ont toutefois joué un rôle important dans l’adoption du règlement du Conseil n° 723/2004 du 22 mars 2004, qui modifie le Statut et, notamment, l’article 1er de son annexe VII qui octroie le bénéfice de l’allocation de foyer aux fonctionnaires et agents enregistrés comme partenaires stables.

LA RECONNAISSANCE DE MALADIE GRAVE Le TFPUE a rendu, le 28 avril 20166, un arrêt particulièrement important quant à la prise en charge des frais médicaux et à la reconnaissance de maladie grave. Dans son arrêt, il a rappelé que, aux termes de l’article 24 de la Charte, dans tous les actes relatifs aux enfants, l’intérêt supérieur de ces derniers doit être une considération primordiale. Il a ensuite constaté que toute décision relative à la reconnaissance de l’existence

d’une maladie grave devait se fonder sur des avis médicaux adoptés sur la base d’un examen effectif de l’état de santé de l’intéressé, examen qui doit être approprié aux circonstances de l’espèce en tenant compte de manière globale des critères médicaux prévus par la règlementation. Enfin, le TFPUE a rappelé que le médecin-conseil est tenu d’expliquer son avis pour permettre au destinataire de l’acte d’en connaître les motifs réels et d’assurer ainsi son caractère contradictoire.

Constatant que la décision était motivée de façon défectueuse et contradictoire, le Tribunal l’a annulée.

LE DROIT AU CONGÉ ANNUEL Dans son arrêt du 19 septembre 20137, la Cour de justice a procédé au réexamen de l’arrêt du Tribunal de l’UE sur pourvoi. Cette procédure de réexamen était exceptionnelle et n’intervenait que sur proposition du Premier Avocat général de la Cour à l’encontre d’un arrêt du Tribunal de l’UE rendu sur pourvoi à l’encontre d’un arrêt du TFPUE. Cette procédure n’existe plus depuis la disparition du TFPUE. Dans cet arrêt, la Cour de justice a constaté que, en vertu du principe général d’interprétation, le Tribunal de l’UE, statuant sur pourvoi, avait commis une erreur de droit en ne privilégiant pas une interprétation de l’article 1er, sexies, paragraphe 2 du Statut, qui permet d’assurer la conformité de cette disposition avec le droit au congé annuel payé en tant que principe du droit social de l’Union consacré à l’article 31 paragraphe 2 de la Charte. La Cour a précisé que cette disposition devait être

interprétée en ce sens qu’elle permet l’intégration, dans le Statut et le RAA, de la substance de l’article 7 de la Directive 2003/88 en tant que règle de protection minimale venant compléter les autres dispositions statutaires traitant du droit au congé annuel payé et, en particulier, l’article 4 de l’annexe V de ce Statut. Cet arrêt est remarquable en ce qu’il rappelle les principes d’interprétation d’une disposition statutaire ou réglementaire applicable au personnel de l’UE et de la nécessité d’assurer une interprétation en conformité avec les principes du droit social de l’UE consacrés par la Charte et les directives, qui doivent être respectés par les institutions de l’Union bien que les directives sont adressées aux Etats membres.

Le Tribunal s’est ainsi référé au principe de coopération loyale, rappelé par le TFPUE dans son arrêt du 4 juin 20098. Ce principe, énoncé à l’article 4 paragraphe 3 du Traité sur l’UE, oblige non seulement les Etats membres à prendre toutes les mesures propres à garantir la portée et l’efficacité du droit communautaire mais impose également aux institutions de l’UE des devoirs réciproques de coopération loyale avec les Etats membres et entre les institutions elles-mêmes. Le TFPUE a constaté que, à ce titre, il incombait aux institutions d’assurer, dans toute la mesure du possible, la cohérence entre leur conduite interne et leur action législative menée à l’échelle de l’UE, notamment, à destination des Etats membres.

Ainsi, les institutions de l’UE doivent tenir compte, dans leur comportement en tant qu’employeur, des dispositions législatives imposant notamment des prescriptions minimales destinées à améliorer les conditions de vie et de travail des travailleurs dans les Etats membres au moyen d’un rapprochement des législations et pratiques nationales, ainsi que de la volonté du législateur de l’UE de faire de la stabilité d’emploi un objectif proéminent en matière de relations du travail au sein de l’Union. Le TFPUE a également rappelé que cette obligation était d’autant plus contraignante que la réforme administrative a accentué une tendance à la contractualisation de la Fonction publique européenne. Ces principes ont été rappelés par le Tribunal de l’UE dans son arrêt sur pourvoi du 21 septembre 20119.

L’IMPRESCRIPTIBILITÉ DE LA RÉMUNÉRATION La Chambre des pourvois du Tribunal a rendu, ce 27 février 201810, un arrêt important qui précise la portée des droits d’un fonctionnaire ou d’un agent sur le paiement d’une partie de la rémunération non payée à la suite d’une erreur d’encodage.

Le fonctionnaire avait vu sa rémunération varier très sensiblement en raison d’affectations successives hors Union et à l’intérieur de l’Union. En outre, il assumait des fonctions importantes dans des conditions particulièrement difficiles.

Source : Cour de justice de l’Union européenne C’est en raison de ces conditions de travail très spécifiques et compliquées qu’il n’avait pas pu se rendre compte de l’erreur d’encodage commise par les services de la Commission dans l’établissement de ses fiches de rémunération. La Commission a reconnu qu’elle s’était effectivement trompée, mais elle a refusé de lui payer toute la rémunération à laquelle il avait droit au motif qu’il n’avait pas contesté sa première fiche de rémunération irrégulière dans le délai de réclamation de trois mois. Par son arrêt sur pourvoi, le Tribunal de l’UE a annulé l’arrêt rendu en Première instance par le TFPUE et, statuant au fond, a infirmé le refus de la Commission de payer le solde de rémunération dû constatant que, dans le cas d’espèce, les crédits nécessaires au paiement avaient été réservés et qu’il n’existait aucun risque de mettre en péril une situation juridique déjà acquise. Le Tribunal en a déduit que la Commission ne pouvait invoquer la violation du principe du délai raisonnable et a ainsi précisé la portée de l’article 62 du Statut qui prévoit, notamment, que la rémunération est due du seul fait de la nomination du fonctionnaire et que celui-ci ne peut y renoncer.

En exécution de l’arrêt du Tribunal, la Commission a payé au fonctionnaire le solde de la rémunération due, majorée des intérêts de retard et des frais de défense afférents aux procédures de pourvoi et de Première instance. Certaines institutions de l’UE refusent systématiquement tout dialogue avec son personnel et rejette d’office les réclamations de ses

fonctionnaires. Le refus de toute forme de négociation ne me semble pas de nature à motiver le personnel ou à renforcer les liens de confiance. Il induit aussi des frais importants pour le budget de l’UE, qui supporte les frais de fonctionnement tant des services de ces institutions chargés de gérer les très - trop - nombreuses procédures précontentieuses que de ceux de la Cour de justice.

Les arrêts cités ci-dessus ne constituent qu’une partie des affaires soutenues directement ou indirectement par l’Union Syndicale aussi bien au titre de la défense d’un intérêt individuel qu’à celui de la défense de l’intérêt général.

UNION SYNDICALE ACHIEVEMENTS: PAST, PRESENT, AND FUTURE The following summary shows how much we have achieved and how much we were able to defend and keep. However, in a world where globalisation induces salary cuts and unemployment it is impossible to completely isolate ourselves and stay immune from change. There are times when we have to make some concessions because we are temporarily too weak or because lacking unity among staff unnecessarily weakens us.

However, under the guidance of Union Syndicale, EU staff has over time achieved considerable improvements and has been able to defend almost all essential items.

Among the three big families of international organisations (EU Institutions and agencies, Coordinated Organisations and United Nations) the European Union staff still enjoys the best conditions of work and the highest salaries.

Knowing that EU Member States wanted to scrap the pay adjustment method some 45 years ago and that we not only managed to keep it but that it is in the Staff Regulations until agreement on a new one is reached is an almost unbelievable success story. The same is true of the 16% expatriation allowance which Member States wanted to abolish some 40 years ago and which we were able to keep.

BUT WHAT WE ACHIEVED DID NOT FALL FROM HEAVEN It is the result of long and tough strikes and all kinds of industrial action, of successful negotiations conducted by talented and knowledgeable trade unionists. And we stand to lose much of our achievements if we do not resist the pressure from Member States and if we do not resort to industrial action when needed and if trade unions fight each other instead of fighting those Member States who attack our salaries and working conditions.

New colleagues often seem to take everything for granted or think that everything is due to the employer’s generosity.

Even in the past when strikes took place almost exclusively at the Council, colleagues of other Institutions believed that everything fell from heaven and that they did not need to participate in any actions.

Like any real trade union with its members’ interests at heart, Union Syndicale concerns itself first and foremost with their working and living conditions, both material and non-material.

REMUNERATION The first salary conflicts and industrial action took place at the end of the 1960s and the beginning of the 1970s and lead to the adoption of the first pay adjustment methods in 1972 and 1976.

Those methods were similar to the present-day method but technically less elaborate. For the purpose of pay adjustment, the European Statistical Office EUROSTAT calculates the inflation rate for European staff based at Brussels (and

Luxembourg) and the average rate of increase or decrease of purchasing power in the civil services of Member States and applies those two factors to existing salaries.

Member States found the results to be too favourable and swore each time that no new method would be “granted”.

In the 1960s strikes and other kinds of industrial action were concentrated at the Commission. Since 1981 all industrial action has focussed on the Council which seemed logical to some extent because it was Member States that either terminated an existing method or refused to negotiate or agree on a new one.

In 1981 the Council solemnly declared that the old method would be terminated once and for all and that there would never be a new method again. It took 6 months of industrial action for Union Syndicale to achieve a 10 year method. In return for the long duration staff had to accept a relatively modest crisis levy (net effect: -3,5%). But weekly working hours were reduced from 40 to 37,5 without any reduction in pay. This amounted to an indirect pay increase of 6.25%. In 1991 it took 4,5 months of industrial action to achieve an equivalent solution. In 2001 the method was extended for two years and within the framework of the 2004 reform it was extended for another 8 years.

THE 2004 REFORM OF THE STAFF REGULATIONS Most trade unions practiced an empty chair policy which caused Union Syndicale to negotiate the reform almost alone. The result was a compromise in which starting salaries and pension entitlements were reduced and the door was more widely opened to precarious jobs. But the positive results far outweigh the negative ones.

Positive results

PAY AND PENSION • A new pay adjustment method was agreed by the parties and a new levy was unilaterally imposed by the Council.

• A new method for calculating the pension contribution rate was introduced. It ensures that staff pay their fair share.

ALLOWANCES • The main allowances were fully maintained. Some secondary allowances were streamlined and partially reduced.

CAREERS • Guaranteed promotion rates allowing promotion on average ever 3, 4 or 5 years (annex I B) were introduced and the problem of end of career blockage (which typically occurred at age 45-50) was solved. The former A and LA categories were merged and became the AD function group. This allowed mobility to an extent hitherto unknown.

• The former B and C categories were also merged and became the AST function group. This facilitated upward mobility.

PENSIONS • The main changes were the following: • The fairly attractive invalidity pension was replaced by a less attractive invalidity allowance.

• The correction coefficients on pensions were abolished but transitional arrangements apply. The deadline for requesting a transfer of pension rights was increased from 6 months to 10 years and 6 months.

• Conditions for early retirement, except for the earliest age at which early retirement is possible, were greatly improved.

SOCIAL CHAPTER • A new parental leave of 6 months and a new family leave of 9 months (with favourable conditions) were introduced.

• Maternity leave, adoption leave and paternity leave were considerably extended.

• The total duration of leave on personal grounds was increased to 15 years.

• The conditions of part-time work were improved and job sharing was introduced.

• Registered partnerships could now be treated the same as marriages (with all the rights attached to marriage), if the couple had no access to marriage.

Negative results

CAREERS • the lowering of starting salaries (-4 to -10%, in some cases up to -20%) • the replacement of the old D category by contract staff, who earn 25 % less than the D officials who occupied the same posts • the possibility for agencies and offices to hire contract staff at all levels on indefinite duration contracts.

It is important to know that the lowering of starting salaries was supposed to be compensated for in the long term because new officials should all, when they retire, have arrived at higher grades than those provided for in the old Staff Regulations and leave with a pension 15-20 % greater than the old maximum level.

PENSIONS • The accrual rate was reduced from 2.0% to 1.9% and to 1.8% in 2014.

• The normal retirement age increased from 60 to 63 and to 65 (or even 66 for new officials) in 2014.

• The age for early retirement increased from 50 to 55 and to 58 in 2014.

THE 2014 REFORM OF THE STAFF REGULATIONS This new reform constituted a considerable roll-back. New blockages were created, a pay freeze imposed for several years and working hours increased to from 37,5 to 40!

Positive results:

The new 10 year pay and pension adjustment method is as good as the preceding methods. If no agreement is reached on a new method it remains in force indefinitely.

Annual pay adjustments no longer depend on the agreement by the Council.

We were also able to prevent the systematic recruitment of all assistants as contract staff. In the Institutions the contractualisation of assistants remains limited to the former D category.

Otherwise, only minor improvements have been achieved.

Negative results:

The main objective of Member States was to undo some of the major improvements of the 2004 reform which - contrary to popular belief or to the propaganda of some trade unions was largely positive and brought about many important improvements.

Most importantly, the extension of the careers by two grades was undone, except for a few special cases. Thus, the possibility of compensating for the lower starting salaries by reaching higher grades has been scrapped.

Weekly working hours were increased from 37,5 to 40 hours and staff were reduced by 5%. In so doing, the main social achievement of 1981 was reversed after 25 years. To many colleagues this is the worst feature of the 2014 reform.

But Union Syndicale also had and has to deal with many other issues - often at institutional level - such as …

• the General Implementing Provision (GIP) for many staff regulations • an assessment and promotion system that is transparent, predictable and fair • working conditions • compensation for overtime • favourable rules on Flexitime • mobility conditions • conditions for teleworking • travel and working conditions during missions • in the research sector : conversion of almost all temporary contracts to permanent posts • significantly improved reimbursement of medical expenses.

BUT THE UNION SYNDICALE IS BY NO MEANS A “BRUSSELS ONLY” ORGANISATION In 1984, at the instigation of Union Syndicale - Brussels, the unions in the various places of employment established a federation, now called “Union Syndicale Fédérale”. Its nearly 10 000 members make it by far the most representative trade union in the European and International Public Service.

CONCLUSIONS After the 2014 Reform we could legitimately hope for a long period of peace, especially because the duration of the method can be considered to be unlimited.

Political events such as the British referendum on leaving the European Union (Brexit) cast a long shadow on the future of the EU. Apart from all the political implications and the serious setback that Brexit constitutes to the European integration, it also has terrible financial consequences. The UK contributes 12% of the Union budget. The easiest approach would be to reduce all expenditure including salaries and pensions by 12% but, of course, that is exactly what we are actively opposing.

What will the future hold in stock? Quite frankly, nobody knows.

However, economic factors such as globalization, automation, robotisation and digitalisation may bring about changes that may exceed our imagination. Rising unemployment may be one of the results of this new (post-) industrial revolution.

The European project - an ever closer union -, and consequently the European Public Service, are now seriously threatened by strong nationalist tendencies in many countries. There is a nationalist group in the European Parliament now. The UK is leaving. Nationalists participate in the Polish, Hungarian, Belgian, Finnish, and Austrian Governments. They are getting stronger in France, Germany, Italy, Denmark. This is a reaction to neo-liberal deregulation and globalization but also to the various crises we have witnessed in the last couple of years.

European leaders fail, at European and national level, to understand the underlying causes and to maintain social protection and cohesion.

Union Syndicale will help defending the European idea, the European Public Service as backbone of the European integration, the welfare of citizens, and will contribute to achieve social progress, at our workplaces, but also in solidarity with the workers and their trade unions all over Europe.

LE STATUT DU DOMICILE FISCAL ET L’EXCEPTION DE RÉSIDENCE Quoique soumis à un régime d’imposition particulier, le fonctionnaire européen est un contribuable comme les autres, assujetti aux obligations fiscales en vigueur dans son Etat de résidence fiscale.

Les fonctionnaires européens ne déposant pas de déclaration fiscale sont donc dans l’erreur et les conséquences pouvant en résulter sont sérieuses.

Il est donc important de rappeler les principes applicables, en ce compris les règles spécifiques, dont la compréhension n’est pas toujours aisée.

ÉTAT DU DOMICILE FISCAL ET « EXCEPTION DE RÉSIDENCE » En principe, le fonctionnaire européen est résident fiscal du pays sur le territoire duquel est établi son domicile fiscal. En Belgique, on vise le lieu de résidence effective, caractérisé par une certaine stabilité dans le temps. Le domicile fiscal est le lieu où est établie la vie familiale et sociale du contribuable.

Par exception, le fonctionnaire européen conserve son domicile fiscal dans le pays où il résidait au moment

de son entrée en service, lorsque les trois conditions suivantes sont cumulativement remplies : 1

le domicile initial du fonctionnaire était situé dans un Etat membre de l’Union ;

2

le fonctionnaire a établi sa nouvelle résidence sur le territoire d’un autre Etat membre ;

3

en raison de l’exercice de fonctions professionnelles au service de l’Union.

Cette exception dite « exception de résidence » a des effets particuliers : des fonctionnaires européens vivant et travaillant dans certains Etats membres (essentiellement, la France, le Grand-Duché de Luxembourg et la Belgique) sont considérés comme des résidents d’un autre Etat membre.

Cette règle s’impose au fonctionnaire européen, aussi longtemps qu’il est en service. Dès ce service terminé, en raison par exemple d’un départ à la retraite, l’exception de résidence ne s’applique plus. Le fonctionnaire européen peut alors voir sa résidence fiscale transférée d’un Etat à un autre, du jour au lendemain, sans que ses habitudes de vie n’aient changé.

QUELLES OBLIGATIONS ?

Impôts sur les revenus Dans son Etat de résidence, le fonctionnaire européen doit déposer une déclaration fiscale. Le contenu de cette déclaration peut varier d’un Etat à l’autre, mais le principe reste constant. Précisons encore qu’en Belgique, si le fonctionnaire européen est marié à ou cohabite légalement avec une personne résidant en Belgique, ils établiront une déclaration fiscale distincte.

Par exception, le fonctionnaire européen ne doit pas déclarer les revenus de son travail pour l’Union, qui sont effectivement taxés par l’Union. En revanche, tous les autres revenus devront être déclarés, quelle qu’en soit la source.

Il en sera de même pour de nombreuses autres informations à communiquer à l’administration fiscale de l’Etat de résidence, notamment les comptes bancaires ouverts à l’étranger dont le fonctionnaire européen serait titulaire.

Dans un Etat membre autre que son Etat de résidence, le fonctionnaire européen peut également avoir des obligations déclaratives s’il est, par exemple, propriétaire d’un bien immeuble situé sur le territoire de cet Etat.

Droits de succession Il existe également des obligations à charge des héritiers du fonctionnaire européen, dans l’hypothèse de son décès.

Il faut alors être attentif au fait que, si le décès intervient alors que le fonctionnaire européen est encore en service, l’exception de résidence s’appliquera.

La succession d’un fonctionnaire européen, dont le domicile fiscal est établi en Espagne, mais qui réside en Belgique, sera donc soumise à l’impôt espagnol, s’il décède « en service ». S’il demeure en Belgique après son départ à la retraite et décède, sa succession sera en

En conclusion

Si le fonctionnaire européen est incontestablement soumis à quelques règles particulières, elles ne modifient pas sa qualité de contribuable qui, dans l’un ou l’autre Etat, est tenu, chaque année, de déposer une déclaration fiscale, en y mentionnant de très nombreuses informations.

En réalité, le fonctionnaire européen, du fait des règles évoquées ci-dessus et de son style de vie, partagé entre l’Etat membre où il travaille effectivement et son Etat membre d’origine, se retrouve souvent dans une situation complexe, avec bien plus d’obligations fiscales qu’un contribuable ordinaire.

LA RÉPÉTITION DE L’INDU La répétition de l’indu est l’un des principes fondamentaux du droit des obligations : quiconque a versé sans cause légale une somme à quelqu’un est en droit d’en exiger le remboursement.

Il s’agit donc d’un « retour à l’envoyeur ». Ce principe, a priori simple, peut cependant conduire à un casse-tête lorsqu’il s’agit de l’appliquer en droit de la fonction publique européenne.

Tout au long de sa carrière, l’agent va devoir actualiser ses données personnelles ou encore introduire des demandes d’octroi de droits statutaires. À cet égard, il lui incombe un devoir de diligence et il est essentiel qu’il soit vigilant lors de tout changement dans sa situation familiale, personnelle, résidentielle ou autre, ce changement pouvant provoquer une réduction ou une suppression de droits dont il était auparavant bénéficiaire.

Par le lien statutaire qui le lie à l’Union, le fonctionnaire ou l’agent1 se voit conférer un certain nombre de droits individuels.

Ceux-ci visent, notamment, les allocations pour enfants à charge ou scolaires, la pension d’invalidité ou d’ancienneté, les allocations de chômage, ou encore le remboursement des frais de déménagement, de voyages ou médicaux.

Dès son entrée en fonction, l’agent est amené à participer activement à la transmission d’informations qui sont supposées permettre à l’administration d’établir lesdits droits2. Une fois les formulaires remplis, l’administration se charge de l’établissement des premiers droits, en fonction de la situation concrète et factuelle démontrée.

Les cas de figure qui se présentent à l’administration sont divers et variés dans le contexte d’expatriation très singulier dans lequel évolue la fonction publique européenne. Il n’est dès lors pas rare que les agents des différents services chargés d’établir l’un ou l’autre droit individuel commettent une erreur dans l’application des règles et attribuent un droit de manière indue. Il n’est pas non plus exceptionnel que pareille faute ne soit détectée que plusieurs années après versement.

En pratique, aussitôt que l’administration s’aperçoit de l’erreur commise, elle la notifie à l’intéressé et sollicite ses observations sur la situation. Ensuite, si le droit est toujours octroyé, une première décision de suppression du droit pour l’avenir (parfois même avec un effet rétroactif) sera adoptée.

Enfin, une seconde décision3 suivra au travers de laquelle le remboursement de sommes indument versées sera réclamé.

Le risque pour l’agent se situe dans l’éventualité d’avoir à justifier de situations factuelles des années après l’élément générateur du droit erroné4. En effet, l’article 85 du Statut crée un droit pour l’administration d’exiger le remboursement 3

de sommes payées parfois pendant des années, voire depuis l’entrée en service s’il est considéré que l’agent a induit délibérément l’administration en erreur. Ce risque peut concerner des sommes parfois considérables5.

Cette restitution n’est autorisée que si l’administration prouve que l’une des conditions fixées par le Statut est remplie : soit le bénéficiaire a eu connaissance effective de l’irrégularité du versement, soit l’irrégularité était à ce point évidente qu’il ne pouvait manquer d’en avoir connaissance. L’examen de ces conditions se fera au cas par cas, en fonction des circonstances du paiement indu.

Afin de juger de l’évidence de l’irrégularité, il faudra prouver que l’agent « normalement diligent et censé connaître les règles régissant son traitement » aurait pu ou du déceler l’irrégularité6. À cet effet, l’administration pourra se fier au grade, au niveau de responsabilité ou à l’ancienneté du fonctionnaire7. Elle pourra également prendre en compte le « degré de clarté des dispositions statutaires définissant les conditions d’octroi des émoluments dus à l’intéressé ainsi que, 5 Ainsi, le paiement indu d’une IDE sur 5 années peut représenter 80% d’un salaire annuel de base.

le cas échéant, l’importance des évolutions intervenues dans sa situation personnelle ou familiale, lorsque le versement de la somme litigieuse est lié à l’appréciation, par l’administration, d’une telle situation »8.

Il ne peut être requis de l’agent d’être à ce point méticuleux qu’il ait pu déterminer l’étendue précise de l’erreur de l’administration. Cependant, il n’est pas pour autant dispensé de tout effort de contrôle et de réflexion. Il faut, à tout le moins, qu’il ait éprouvé des doutes suffisants quant aux versements générant un devoir de les signaler à l’administration, pour lui permettre d’en vérifier le bien-fondé avant de confirmer l’octroi du droit9.

Le Statut fixe à cinq ans le délai de prescription du droit à répétition de l’indu, qui a été considéré comme vecteur de suffisamment de sécurité juridique10, laquelle est indispensable lorsqu’une situation, bien qu’irrégulière, a été consolidée par le temps.

Cependant, une exception à la prescription existe : la mauvaise foi de l’agent. Il en va ainsi de l’agent qui a falsifié des documents, qui a menti sur sa situation civile, ou qui a généralement volontairement manqué de communiquer toute l’information utile et avérée en vue de l’établissement exact d’un droit dans l’unique but de le percevoir. Dans pareil cas, une enquête administrative et une procédure disciplinaire devront être mises en œuvre par l’administration de sorte à pouvoir démontrer le comportement fautif de l’agent.

Avisé sera l’agent qui conservera, à chaque octroi de droits, la documentation prouvant le fondement de la perception, et ce, jusqu’à au moins 5 années après la fin de son service au sein de l’Union. Il veillera également, en fonction de sa situation, à invoquer le bénéfice de la pratique consistant à limiter à un certain pourcentage de sa rémunération les prélèvements opérés sur ses émoluments11.

Il ne sera certainement pas inutile de conclure par un appel à la prudence. Les administrations, lorsqu’elles mettent en œuvre la répétition de l’indu, ne suivent pas une procédure comportant des étapes identiques. Le désordre règne en la matière et il est parfois malaisé de comprendre laquelle des notifications constituerait un acte faisant grief au sens du Statut qui fait courir le délai de trois mois dont l’agent dispose pour introduire une réclamation. Mieux vaudra ainsi s’assurer, immédiatement après réception d’une notification, des conséquences légales de celle-ci afin d’éviter toute mauvaise surprise.

DERNIER JOUR DE TRAVAIL Il y a plus de 35 ans, lorsque Laurence est entrée au Secrétariat général du Conseil en suivant les traces de son père, elle n’imaginait pas qu’un jour elle quitterait définitivement son bureau avec un petit pincement au cœur.

C’est grâce à la calculette « Pension » de l’Union Syndicale qu’elle a compris exactement à partir de quand elle aurait droit à une pension complète de 70%. Ce fut une bonne surprise. Elle pouvait prendre sa retraite anticipée avec une pension complète avant même d’avoir 60 ans. Son père avait aussi voulu prendre une retraite anticipée, mais il y a renoncé parce que, avant 2004, c’était nettement plus défavorable. C’est la réforme négociée par l’Union Syndicale qui a amélioré les choses.

Certes, comme dans tous les États membres, l’âge normal de la retraite a progressivement augmenté, mais partir plus tôt est maintenant nettement plus facile : • comme Laurence a plus de 35 ans de carrière, la « pénalité » pour départ anticipé est calculée sur l’ensemble de ses droits et c’est le résultat qui est plafonné à 70% ; avant 2004, la pénalité était plus forte et s’appliquait sur une pension déjà plafonnée à 70% ; • elle continuera à percevoir les allocations familiales pour ses deux enfants encore à charge, qui resteront aussi couverts par notre régime d’assurance-maladie (RCAM), contrairement à ce qui se faisait avant ; c’est d’ailleurs ce qui avait dissuadé son père de prendre une retraite anticipée.

Finalement, pour Laurence, cette réforme tant décriée par les autres syndicats avait aussi beaucoup de bons côtés. Et les avancées en matière de pension ont été conservées en 2014, contrairement aux carrières. « Peut-être que si l’Union Syndicale avait réussi à mobiliser le personnel dans les autres institutions comme elle a pu le faire au Conseil, et surtout si les autres syndicats avaient suivi, il n’y aurait pas eu tous ces blocages de carrière ».

Laurence est tirée de ses rêveries par l’arrivée de Cristian, un collègue roumain. Il est énervé parce qu’il ne sait toujours pas quand il pourra prendre sa retraite et comment elle sera calculée. Il a travaillé depuis 2006 comme agent contractuel puis comme agent temporaire avant de devenir fonctionnaire et le PMO considère qu’il est entré en service après 2014. Il a introduit un recours mais il attend toujours l’arrêt. Heureusement qu’il était membre de l’Union Syndicale, qui finance une très grosse partie de son recours, car son salaire d’AST 3 ne lui permet pas de payer les frais d’avocat, encore moins s’il est obligé d’aller en pourvoi. « Quand on y pense, c’est peut-être sur les pensions que l’Union Syndicale a soutenu le plus de recours.

Imaginez qu’avant 1984, si une fonctionnaire décédait, son conjoint survivant n’avait pas droit à une pension de survie. Le Statut parlait d’une pension de veuve, et non d’une pension de veuf. » « L’égalité n’a été obtenue qu’en 1984, par un recours devant la Cour de Justice. Et c’est la même chose pour le transfert des droits à pension. L’Union Syndicale a dû

là aussi introduire de nombreux recours pour obliger certains États membres à accepter le transfert vers notre régime et même ensuite, dans le cas de la Belgique, pour l’obliger à modifier son régime de transfert afin de le rendre conforme au Statut. » « Même lorsque les transferts ont enfin été possibles, il a encore fallu introduire des recours pour que les droits dans certains régimes nationaux (notamment au Royaume-Uni et en Irlande) soient aussi transférés. » « Mais j’ai lu », répond Cristian, « que certains de ces recours avaient été introduits par la Commission, qui voulait elle aussi forcer les États membres à accepter les transferts. »

Ils entendent à ce moment du brouhaha dans le couloir : les collègues et amis de Laurence qui sont venus lui souhaiter une heureuse et longue retraite commencent à arriver. Tout est prêt pour les accueillir. Et Laurence sait qu’une autre bonne nouvelle l’attend : dès demain, sa cotisation à l’Union Syndicale va diminuer de moitié.

Car elle va bien entendu rester membre du syndicat.

D’abord par solidarité envers ses collègues, mais aussi et surtout parce qu’elle pourrait encore avoir besoin d’aide : allocations familiales, RCAM, adaptation des rémunérations et pensions, autant de dossiers qui continuent à la concerner personnellement et dans lesquels elle pourrait se trouver démunie face à l’administration si elle n’avait pas le soutien de l’Union Syndicale.

« C’est vrai, mais c’est en revanche contre la Commission qu’il a fallu aller en justice pour l’obliger à rembourser aux fonctionnaires les montants qu’elle refusait de prendre en compte pour le transfert ou encore pour qu’elle accepte d’appliquer correctement les règles en matière de taux d’intérêt pour les transferts, etc. etc… » « C’est tellement compliqué, les transferts », soupira Cristian. « Oui, d’ailleurs Giustino s’en mord encore les doigts », lui rappela Laurence. « Il avait commencé à travailler très jeune dans son pays et il a transféré ses droits, l’équivalent de presque dix ans. Mais comme il est agent contractuel GF I, il bénéficiera de toute façon de la retraite minimale, qui sera la même que s’il n’avait pas fait le transfert. À part que, dans ce cas, il aurait aussi eu une petite pension de son pays. S’il s’était adressé à l’Union Syndicale, on l’aurait mis en garde et il n’aurait pas accepté le transfert. Mais son syndicat ne l’a pas fait et quand il a compris, il était trop tard pour réagir. » « Il y a aussi cette fameuse règle des 5 ans de mariage », continua Laurence. « Si un fonctionnaire décède, le conjoint survivant a droit à une pension de survie s’ils étaient mariés depuis au moins un an. Mais si c’est un retraité qui décède, il faut qu’ils soient mariés depuis au moins cinq ans. Cette absurdité est également contestée par devant la Cour. » « Et, maintenant, l’Union Syndicale se bat pour que ma date réelle d’entrée en service - et celle de centaines d’autres collègues - soit prise en compte pour le calcul », ajouta Cristian. « Tu m’a vraiment bien conseillé quand je suis arrivé dans ton service en me montrant tout ce qu’avait fait l’Union Syndicale et tout ce qu’elle pouvait encore faire pour moi. » « Oui, on peut vraiment se demander quelle serait réellement la situation des fonctionnaires et autres agents si l’Union Syndicale n’avait pas été présente depuis cinquante ans pour les défendre, que ce soit dans les négociations ou en justice. »

FÉLIX GERADON Félix Geradon a été traducteur au Secrétariat Général du Conseil. Il a été de nombreuses années membre du Comité du Personnel et y a exercé différentes fonctions (secrétaire, viceprésident, président) et a représenté le personnel dans plusieurs organes paritaires.

Il a également été longtemps Secrétaire général adjoint de l’Union Syndicale Bruxelles. Retraité depuis 2019, il continue à participer activement à la vie de l’Union Syndicale en étant associé au Comité exécutif.

FLEXIBLE WORKING HOURS AN ESSENTIAL UNION SYNDICALE ACHIEVEMENT!

THE EXAMPLE OF THE COUNCIL Today, working at the Council would be unthinkable without flexitime. It allows for the right balance between the needs of an unpredictable Institution, which needs its staff at all times, including nights, holidays and weekends, and the needs of the staff to preserve their health and to have a life outside work.

In 2004, things started to change changed. The Council’s administration introduced a system of automatic recording of attendance hours, to combat so-called ‘illegal absenteeism’”. Union Syndicale, quickly supported by the FFPE, took advantage of this to demand flexible working hours in return.

These are things that our elders dreamed of. Prior to 2006, working hours were fixed, with no adjustments, from 8:30am to 5pm. Any absence had to be covered by annual leave. Night or weekend work was not recoverable (except for grades 1-4) - some of them might have found an understanding boss...

The deal succeeded! Opposed by some of the staff, in particular the embryonic new R&D organisation, Union Syndicale and the FFPE submitted the compromise with the administration to a referendum. More than 80% of the Council’s staff voted in favour of the deal. The new system came into force in 2006.

From now on, if Margus wants to take care of his school children every Wednesday afternoon, he can plan a free slot accordingly. Clara had a trilogue meeting until 4:00 a.m.; she can take that day off, and not return to work until the next day.

Susanna’s mother-in-law shows up unexpectedly, and Susanna takes time off to recover her overtime. Finally, Dirk has to see the doctor in the middle of the day. He can do so during his working hours if there is no other possible appointment.

Union Syndicale will work with all colleagues to find the answers for tomorrow!

However, there is another challenge hanging over everything: the massive digitalisation of office work is erasing the boundaries between work and free time.

When I look at my screen the last time in bed, at 11:17 pm, while spending 20 minutes answering some ‘urgent’ messages, it raises brand new questions about how to protect the privacy of colleagues.

THE NEW CHALLENGES The system works perfectly, to everyone’s satisfaction, as long as there are enough staff for the work to be done. The overload of work at the Council, which has exploded over the last 10 years, is undermining the flexitime system. When the workload is such that the extra hours accumulated in the counters can no longer be recovered, or that even the minimum daily and weekly health breaks can no longer be guaranteed, the system loses its interest for the staff.

But it is not the system as such from which a solution can come - it is only through the reduction of the workload that weighs on each and every one of us, in particular by changing the number of staff, that a balance can be found.

Notre regretté Ludwig Schubert, le père de la méthode d’adaptation salariale des fonctionnaires et autres agents des institutions européennes, me racontait une fois que la première manifestation syndicale à la Commission avait été organisée par une douzaine de personnes qui s’était planté devant le bureau du commissaire compétent avec un radio cassette qui jouait l’hymne à la joie.

Nous sommes à l’aube de changements profonds dans le contenu même de nos missions. Les nouvelles technologies aidant, le travail à distance, même partiel, s’impose. Les réunions virtuelles prennent le pas sur les conversations informelles dans les couloirs ou la cafétéria. Le paperless aliène les rapports de l’agent avec ses dossiers parfois limité à un simple tick dans un flux informatique.

Image naïve, vue de la distance, qui donne le ton d’un temps révolu : fini l’administration bienveillante, qui protégeait ses employés. Maintenant, une administration de plus en plus hostile pousse vers la précarisation, interprète le Statut de façon de plus en plus restrictive et restreint la liberté syndicale.

D’autres éléments de notre environnement ont fortement évolué. La pandémie COVID n’a été que l’accélérateur de tendances qui préexistaient : la dispersion en sièges et agences ; l’anonymat des open spaces ; la multiplication de collègues précaires, etc.

qui résulte du télétravail et de la multiplication des centres de travail. Cela permet aussi la montée d’idées nouvelles et une militance plus active.

L’un des fleurons de l’Union Syndicale, dont on peut être fiers, est sa capacité de soutien juridique aux collègues en situation de difficulté. Nous nous devons de maintenir cette capacité de les accompagner jusqu’aux dernières instances, sans pour autant devenir une compagnie d’assurance dans laquelle le membre ne se rappelle l’existence de l’US que lorsqu’il en a besoin.

Une militance éveillée est absolument nécessaire et des discussions étendues sur les différents sujets sont fondamentales y compris pour préparer des éventuelles actions légales.

En bref, la survie de l’Union Syndicale se jouera à sa capacité à s’adapter aux changements et à renforcer les liens avec ses affiliés.

L’esprit d’appartenance, la fierté d’être une modeste brique dans la construction européenne ont été remplacées par le sentiment de faire la même chose que ce qu’on ferait dans une banque ou une usine.

Comment refaire le syndicalisme dans ces circonstances ? Plusieurs pistes s’ouvrent devant nous : les nouvelles technologies bouleversent le modèle de communication désormais digitalisé entre les organes du syndicat et les affiliés. La création de groupes de discussion, sectoriels ou locaux est un élément indispensable pour contrer la tendance à la dispersion

A BRIEF HISTORY OF SUEPO SUEPO (Staff Union of the European Patent Office) was born in 1979 out of the “Syndicat du Personnel de l’Institut International des Brevets” (SP- IIB) which was founded in 1969, following the creation of the European Patent Office (EPO) in 1977, and the merging of the IIB into the EPO. In agreement with its 1979 Constitution (SC), SUEPO comprises four local sections, at the four EPO sites : Munich, The Hague, Berlin and Vienna. A Congress, a Central Bureau and an Audit Board were established as central bodies of SUEPO. Despite the existence of these central bodies, the local sections enjoy quite a lot of autonomy and can be considered as quasiindependent entities. Some of them have legal status under their respective national law, like SUEPO-TH under Dutch law.

As the acronym USOEB, the French name for SUEPO, clearly suggests, SUEPO was created with the intention of being a branch of USF. Presently two of the SUEPO local sections, SUEPO-TH and SUEPO-BE, are affiliated with USF. SUEPOMU was also affiliated in the past. Today, SUEPO is by far the largest union of the EPO, and around 40% of all EPO employees are members of it. As for other unions in international organisations, SUEPO is involved with issues that go well beyond the scope of Staff unions at the national level.

The objectives of SUEPO were primarily stated as “…to defend the interests of all persons employed by the European Patent Office, as well as all former employees and their successor in title, especially by seeking to improve conditions of employment…” and

“… to ensure that employees’ rights as individuals are respected…” (cf. SC, Article 2). These objectives could be summarised as ‘to represent and defend staff interests’. This is surely what one can expect from a Staff union. In the jargon of the EPO, we would say that these objectives are neither novel nor inventive for a union….

However, the objectives stated in the SUEPO Constitution further included “… to contribute to the attainment of the objectives of the EPO and to its proper functioning, and to safeguard the independence of permanent employees of the Office as international public servants” (cf. SC, Art. 2). These objectives are not necessarily what could be expected from a Staff union.

The reasons they were stated in the SC, are probably linked to

the peculiar legal status of the EPO, i.e., a quasi-judicial entity in a legal vacuum. The quasi-judicial aspect is evidently linked to the granting (or refusal) of patents, or to be more precise to the green light given by EPO to the national patent offices to grant them. The legal vacuum is linked to the EPO’s governance or to the lack or the shortcomings of it. Unlike Labour Law in a national civil service, the rules dictating employment conditions and staff rights at the EPO are determined by the Office’s Administrative Council, an organ with only limited accountability. This loose governance combined with the low visibility of the EPO on the public stage set the scene for a long history of social tensions and union actions at the EPO. The huge number of complaints originating from the staff of the EPO pending (or judged) at the International Labour

Organization Administrative Tribunal (ILOAT) over the years is a clear sign of this “malaise”.

Since its creation SUEPO has always striven to attain the above objectives through a large variety of means : discussions, negotiation, publications, general assemblies, demonstrations, work-to-rules, strikes… Many legal actions were also launched or supported by SUEPO with good results.

Discussions and negotiation with the management have always been the first choice of SUEPO, whenever possible. When the EPO administration was serious about social dialogue, good outcomes could be reached without resorting to industrial actions, a win-win situation for everybody. However, despite all the good will, divergences with the management led many times to confrontation and to industrial and/or legal actions from the first years onwards.

The issues at stake have been similar throughout the more than 40 years of existence of SUEPO. Careers, salaries, pensions, contracts, financial sustainability, work pressure, recruitment, staff well-being and IT development are just some of the recurrent items that have been at the centre of the discussions with management and have more often than not led to confrontation, escalation and industrial or legal action.

The lack of proper consultation of the Staff representation and SUEPO is probably the most recurrent and important issue.

Most of the other problems faced by the EPO in all these years can be seen as originating from this. As a former SUEPO official and later EPO manager once said: “There is a fundamental

difference in approach between Unions and Management.

Management takes decisions based on short term gains, whereas Unions think in the long term.1 ” The advent of the Battistelli presidency in 2010 inaugurated a new era. Until then the relations between SUEPO and the management had been mostly in line with what one could have expected, sometimes cordial, sometimes tense. From then onward, things evolved dramatically at the EPO. In May 2013 a Communiqué2 was issued stating that sending emails to more than 50 employees would be allowed only for authorised employees. Since “surprisingly” neither the Staff representation (SR), nor SUEPO were part of these “authorised employees”, this limitation, still in force today (19.09.2022), amounts to plain censorship for the SR and SUEPO. In June 2013 an article3 was added to the Service Regulations, de facto limiting the fundamental right to strike of the employees.

In March 2014, new amendments4 introduced to the Service Regulations violated the right to freedom of association of the Staff. All these amendments (or at least parts of them) to the Staff Regulations and the cited Communiqué have been

recently found unlawful by the ILOAT (see respectively ILOAT J 4551, J 44305 and J 4482).

During all this time SUEPO has continuously and actively supported the complainants. Having muzzled SUEPO and the Staff Representation, the Battistelli administration took the opportunity to pass some more convenient reforms. In December 2014 a New Career System6 (NCS) was introduced to the detriment of Staff, in particular to the newcomers and to the ones who had already been negatively impacted by a 2009 reform of the pension system. In March 2018 a new employment framework7 was introduced, which in practice amounted to offer 5 + 5 years of contract to almost every new newcomer, despite the inadequacy8 of such a system for the staff of the EPO. Since SUEPO and the SR did not like to be muzzled and were still voicing their discontent, the administration in January 2016 dismissed two SUEPO leaders, and downgraded another in Munich on various alleged charges. In June 2018 the ILOAT ruled that the decision to dismiss the two SUEPO leaders and downgrade the other were unlawful and must be set aside9.

At the end of 2016 another SUEPO leader was dismissed in The Hague. This last case was settled in 2020 before going to court. Other SUEPO officials or SR nominees had received different kind of reprimands. Some cases should still be settled. No official excuses from the EPO have been received to date, even though such harsh and unlawful treatment of Union leaders has never been heard off in any other international organisation.

In June 2018 the Administrative Council (AC) elected Mr. A. Campiños as the new president of the EPO, with a mandate to establish and foster social dialogue. Today, after four years, the climate of fear of the previous presidency has given way to a climate of disengagement and disillusion, as a recent Technologia10 Staff survey has shown. Despite some initial optimism, Mr. Campiños has failed so far to fulfil the mandate the AC gave to him. Social dialogue with the Staff representation seems like a tick all the boxes exercise, and social dialogue with SUEPO is almost non-existent. There has been no meeting, in person or by videoconference, between SUEPO and Mr. Campiños, for more than a year.

The reforms introduced by the previous administration, like the New Career System and the New Employment Framework are still in place. Some more reforms were pushed through during the last four years, like the new Salary Adjustment Procedure (SAP)11, while SUEPO and the SR were impeded from operating properly due to the limitations introduced by the former presidency. Moreover, it took an ILOAT judgment (J 4430) and 8 years, 3 of which under the present presidency, to remove the limitations to the fundamental right to strike. Similarly, concerning the removal of the limitations on the freedom of association (J 4482) it took more than 8 years, 3 and a half of which under the present presidency. The last ILOAT judgment (J 4551) concerning the removal of the limitations on the number of emails addressees had not been implemented at the time of writing (19 September 2022). It has been more than 9 years since the email limitation was introduced. This is not worthy of an International Organisation like the EPO, the second largest European Organisation by number of employees after the EU Commission.

The history of SUEPO is intrinsically linked to the history of EPO. Since its creation it has always acted tirelessly to attain the objectives stated in its Constitution, i.e., to defend the rights of the Staff and to safeguard the proper functioning of the EPO. Even in the worst moments, its leaders have fought hard to defend these principles, sometimes at a very high cost for themselves. SUEPO has been and continues to be a major actor in shaping the present and the future of the EPO. Mr. Campiños has just been re-elected for a second mandate of five years, starting in July 2023. I wish him well, but if he wants to succeed in his endeavour, he will have to commit to proper social dialogue with SUEPO and the Staff Representation.
