How do I find the right solicitor?

A good solicitor will help and support you through a stressfree property purchase, while the opposite can cause delays and place unnecessary pressure on the buying process. So finding the right solicitor is crucial. One of the best places to start is with your agent. We deal with multiple solicitors on an almost daily basis, so we know who some of the best in the business are. I regularly recommend to both buyers and sellers solicitors I have known for years who I trust to facilitate a smooth and efficient purchase, but also provide an individual service in the time that is required. Word of mouth is another effective way to find the right solicitor. Asking friends or family who have had a great experience with a particular person or a legal firm is a solid way to validate them and their service. Finding a solicitor that is also able to act for your lender will save you both time and money. It can be worthwhile getting a few quotes from a couple of recommended solicitors. Sometimes paying that little extra will pay dividends regarding the service you will get. As a rule of thumb, it’s likely that a solicitor who offers a lower price will have more clients, which can put limitations on the level of service you might receive and increase the likelihood of potential delays. From my experience, using a solicitor who is based in the area you are buying, or someone who is at least familiar with it, can also be an advantage. They will have a closer understanding of the local market, including how the council operates and any planning regulations, for instance. Certainly using someone locally will allow you to have face-to-face catch-ups or meetings if needed, which can be reassuring over relying on emails or phone calls. Likewise, if your solicitor can visit the property in person, that can be a real added bonus too.

marketview It is a good day to be a builder. We have all heard the mantra ‘improve rather than move’ and this is sound advice, writes property finder Robert Bailey. With stamp duty levels at seven per cent for many homes in prime central London, and the associated cost of moving creeping ever higher, moving house is becoming a very expensive option. With the threat of the mansion tax looming, I expect even more people will aim to improve their homes instead. While improvements may add value to a home, the Government is unlikely to revalue homes regularly. I suspect they will wait until the house is sold before assigning a new valuation. The good news, though, is that the Government is making it easier to extend homes. Under the most recently implemented guidelines, larger extensions to homes including loft conversions and mansard roofs can be added without the need to go through planning. Instead, they will simply be subject to a neighbours’ consultation scheme. Terraced homes can create extensions of up to six metres in depth and four metres in height, while semidetached properties can create extensions of up to eight metres in depth but of the same height. The only issue is that the property can only be extended if it has not already been improved and I cannot think of too many properties in prime central London to which that would be applicable. Even so, if such generous proportions are allowed without planning permission, it would follow that larger extensions would be allowed with it. This new legislation could not be more timely as the home improvement du jour, the basement conversion, is falling out of favour. Kensington & Chelsea are cracking down on these extensions by limiting them to a single story plus 50 per cent of the garden. Just recently, the writer Rachel Johnson and her neighbours persuaded planners to disallow a huge basement conversion in Notting Hill and similar plans have been turned down elsewhere in the royal borough. The end of the fad is not a bad thing, though, as the extensions were becoming ridiculous. (Swimming pools with high dives? Really?) And homeowners often erroneously felt that they added more value to the home than they did. While many in the press are warning against a property bubble, I simply do not see one in central London. Existing taxes and the threat of more have dampened people’s enthusiasm for trading up the property ladder. Instead, the only ladders we are likely to see in the near future will belong to the local building firm.

New development G&T London is breathing new life into two Grade II listed Georgian townhouses on one of Islington’s most desirable garden squares. The luxury London developer is restoring 58 and 59 Myddelton Square to their former glory, to create ‘two of Islington’s most opulent and exclusive residential properties’. Having been raised in the Royal Borough of Kensington & Chelsea, living all my childhood in what is now known as Brompton Cross and attending Marlborough Primary School on Sloane Avenue in the mid 1960s, I feel in a reflective mood as to how Chelsea/ Knightsbridge has changed over the years. While most people are perhaps understandably fixated on how prices have risen, especially in the last few years, I find the change in the character of the area more interesting. There is not much, if any, of the bohemian Swinging Sixties in Chelsea still in evidence. The Punks came

and went in the late 1970s, and the retail and restaurant experience has changed dramatically Opposite where I used to live on the Brompton Road, just where it joins the Fulham Road, retail guru Mary Portas would have been purring with delight. There was a wonderful parade of shops consisting of Simpsons grocers, a florist called the Flower House, an independent record shop, an off-licence, an estate agent (where I later worked), and around the corner in Draycott Avenue, Dewhurst butchers with a Mac Fisheries opposite. There was also a fruit and vegetable barrow stall run by the Lay family. All the

shops are now occupied by high-end boutiques – including Chanel and Joseph among their number – or restaurants. The only shop that has remained is perhaps not unsurprisingly the estate agents office. These changes have been driven by the new type of resident moving into the area. Having once been the preserve of the well-heeled British family, both from the professional classes and the aristocracy, together with more than one or two of their errant offspring, the area is now called home by a whole host of buyers from around the globe. They recognise what a fantastic city London is to live in, both commercially and socially, and nowhere in my view is this better illustrated than in the Royal Borough of Kensington & Chelsea. Overall I love the vibrancy that these groups have brought to the area, but with all the positives there have to be one or two negatives. I think it is a shame that

many of the wonderful buildings, both houses and flats, spend so much time unoccupied. These are often bought as second or even third homes. In addition, for many the new buzz words when buying in London are yield and return. With so many investors entering the market, property is now treated in much the same way as any other commodity. But as time moves on, there is no point in looking wistfully over one’s shoulder at the past and the days of the wet fish shop across the road, or the Dowager Duchess downsizing from the family home in Egerton Crescent. Markets change continually and we have to adapt and embrace these changes. I, for one, cannot conceive of a better place to live. I just wish I could afford to.

How do you determine the true value of a home? Agents assess value by working out how much comparable places have recently sold for, comments Alex Peto from Aylesford International. “However, true value is what someone’s prepared to pay. If there have been 50 viewings and no offers, the property’s overpriced. And if someone’s desperate to live on that street, they may pay more than historical evidence shows it’s worth,” says Peto. Tim des Forges at W.A. Ellis says in a strong market, buyers have concerns they’re buying at topend prices. So they look for unmodernised property as they perceive there’s value to be gained. “To the inexperienced, once costs of refurbishment and time, hassle and risk factors are taken into account, they’ll be in for the same as buying a newly refurbished property.” But there can be uncertainty for a vendor achieving ‘true value’ if the property is sold off-market, cautions des Forges. “The risk here, with the lack of exposure the internet commands, is that the vendor might miss out on a buyer in Malaysia who’s always wanted that property, but won’t be aware of it due to the low exposure.” In terms of cold finance, location is the number one factor – not only to influence value but also to maintain it. “Proximity of good schools, transport links, shopping and restaurants all contribute to the true value of property,” comments Penny Court at Beauchamp Estates. Freehold houses offer a solid investment as the property is owned outright, she adds, but on the other hand, a fully portered block may well represent true value to a busy purchaser who wishes to delegate the management of the property. Value isn’t in surface extras, says Jo Eccles from Sourcing Property. “Keep that extra 10 grand you were going to spend on naff brown carpet in your pocket. It’s really annoying having to rip out something average that still cost money. Either sell a spanking brand new place, or leave it alone.” She adds that buyers will see the potential in a home that needs some work. “Most of the sealed bids I come across are for an immaculate property or a wreck. Buyers will bid against one another for something where they can add their own value.” For investors, Anita Mehra of Benham & Reeves advises looking at historical values of sale prices and rents in the area. “Ask letting agents local to the property what rent they’re likely to achieve for you; not the agents selling you the property.”

Rate dilemma

Doors are open to first-time buyers The number of first-time buyers making the move in London rose to its highest since the end of 2007, according to figures from the Council of Mortgage Lenders. Youngsters accounted for 11,200 loans for house purchase in the capital and they make up a larger proportion of house purchase loans compared with the UK overall. In the second quarter, 56 per cent of house purchase loans were to first-time buyers in London compared with 46 per cent in the UK overall. David Newnes, director of LSL Property Services, owners of Your Move and Reeds Rains, said: “The catalyst behind all this has been a swift upturn in the availability of mortgages. Government schemes have emboldened lenders, and given their balance sheets plenty of extra muscle. They are much more willing to extend an olive branch to high LTV buyers, which has opened the door to scores of first-time buyers who previously had it slammed in their face by the force of weak wage growth, high inflation and high deposit requirements. “It’s vital that lenders continue to ease lending criteria to encourage more first timers in the capital to buy as, ultimately, these are the people who make it possible for the property chain to stay fluid.”

To switch or not to switch, that is the fixed question, says Duncan Farmer The question every homeowner and house buyer wants an answer to is: when will interest rates rise again? The short answer is: not for a while, and nobody had predicted five years ago that the rates would have been at their present low level for so long. Recent remarks by the Bank of England’s new governor, Mark Carney, that his Monetary Policy Committee would peg rates to the level of unemployment signalled to many that they would stay low for another three years. Although he has also said that the Bank could introduce other measures to restrict credit and prevent another housing bubble. However, the money markets now suggest that they will rise earlier than that, and the swap rates – the level at which banks borrow from each other – are now pointing towards a rise as early as May 2015. That would suggest that homeowners and new buyers should get hold of the lowest fixed-rate loans that they can while stocks last. There are some great deals out there, as our best buy tables show. Remortgaging surged in July at its fastest rate since 2008, according to latest figures. Existing borrowers took out new loans totalling £4.2 billion in July, which is up 12.7 per cent on June. Remortgaging accounted for more than a quarter of total lending, which was £16.6 billion. According to statistics, people remortgaging not only switched to a better rate but also increased their loan by an average of £20,425, although that figure is lower than in June when the extra amount borrowed was almost 10 per cent higher at £22,615.

Existing borrowers in this climate of low rates have had little excuse for not making regular payments off their loan, and those that have will have seen not only the term of their mortgage and their total interest bill fall, but will have also built up more equity in their own home. This is important. As lenders have tightened their criteria in the post credit-crunch era, borrowers looking for a lower loan-to-value are given more favourable treatment and cheaper rates. As the best buy charts show, Norwich & Peterborough’s loans are for applicants with at least 35 per cent equity in their homes. Anyone who needs to borrow more must pay a higher rate. If you already have enough equity in your home to qualify the lowest deal, then now may well be the time to switch. If not, start overpaying enough to get yourself into a lower loan-to-value band. It might be a struggle to start but the long-term benefits will be worth it. In any event, whether you are looking to switch or not, overpaying will help soften the blow when rates do rise – whenever that may be – or if the Bank of England’s new governor decides to tighten mortgage lending further.

Patrick pontificates House price bubble may undermine Help to Buy Is the Government’s Help to Buy scheme likely to cause another house price bubble? Mortgage lenders certainly think so, and according to the Institute of Mortgage Lending Intermediaries, almost two thirds of intermediary lenders and brokers single out a bubble as the most likely factor that may undermine the Government scheme. Research shows lenders already anticipate a 2.7 per cent increase in the average house price by the end of the year, pushing it to £166,418 according to the Land Registry measure. The prediction is based on the market’s performance in the first half of 2013 and the initial impact of the Help to Buy equity loan scheme. If this same growth rate continues for the duration of Help to Buy, the average house price will reach £180,265 by the end of 2016 – an overall rise of 11 per cent in four years. This would bring house prices close to their last peak of £181,975, recorded in November 2007. There are concerns that the rate of increase could be even greater with the upcoming Help to Buy mortgage guarantee offer still to launch in January 2014.

Patrick Bullick, managing director of Stanley Chelsea and chairman of NAEA London Region, holds forth families tend to be farther flung from each other than they used to be. This makes it difficult for granny to move in with the generation below, or vice versa. We should focus on providing suitable housing for the elderly, allowing them to sell their oversized homes. This will free up these bigger homes for families to move into, in turn releasing the smaller properties for those fighting to get onto (and up) the housing ladder. This is a far more natural and sustainable approach than current Government housing policies, all of which seem to be obsessed with giving first-time buyers an artificial boost – just the types of policies that might well produce price inflation leading to a housing bubble. To be avoided. So the challenge is to find practical ways to encourage the supply of homes suitable for the elderly. Local authorities and home building firms should be given tax breaks and other incentives to build for the older person. Apart from lack of supply, the second big reason people felt unable to move from their current property is the cost of the transaction. This brings me to one of my old bugbears: stamp duty, the root of all evil in the property market. As a minimum, any retired person downsizing should be entirely exempted from the tax. My mother-in-law has already downsized and is very happy with her flat. She has just arrived for Sunday lunch (my wife picked her up in the car this time). “Look dear, my casts are off and I have brought you back your document shredder. Isn’t it a splendid machine?”

Running over my wife’s mother’s feet the day before we were all supposed to be going on a family holiday together has put issues of the older generation at the forefront of my mind this summer. It was a particularly grim experience for all concerned but fortunately ‘Grannette’ is an irrepressible, optimistic creature who finds positives in everything: “Don’t worry dear. I have been meaning to shred all those old documents, and now I can.” So when Demos, a left-leaning but nevertheless sometimes wise policy think-tank – came out with a report entitled Top of the Ladder, it caught my eye. Sadly, and this is typical of the press, the report was only thinly covered by the media. So a very important topic is usurped by mythical housing booms and daft suggestions that the Bank of England should ‘manage’ house price inflation to no more than 5 per cent per annum. Why the RICS think the BoE has a chance of this sort of micro-management, I cannot imagine. It cannot even hit its primary objective to manage inflation. Anyway, the core point of the Demos report is that there are around 3.5 million older people who could/should downsize their properties to ones that are easier to manage, and more suited to their needs, as they grow older. Seemingly, there is even an appetite on the part of retired people to downsize, but they are hampered mainly by a lack of supply of suitable properties. The demographics of the country have changed and not only have we many more older people, but also

Marylebone celebrates super prime status

Two working as one Savills has opened a new office in Marylebone with sales headed by Claire Reynolds and lettings by Isabel Lacey. Watch this space A parking space in Hyde Park Gardens has gone on sale for £300,000 – £50 more than a studio flat half a mile away that sold recently for £299,950. Kay & Co’s Hyde Park office was instructed on the parking space with a 91-year lease. “Parking in this part of prime central London is always scarce,” said Matthew Abernethy, associate director at Kay & Co, who added that last year the company sold two parking spaces for £250,000 each. “The fact that people will pay more than the price of a small flat for the privilege of their own parking space is indicative of the desirability of having parking in Westminster. We anticipate that the space will attract interest from local residents eager to secure parking close by.”

Swimming for St Christopher’s A team of Faron Sutaria agents made a huge splash in raising more than £1500 for charity at the Great London Swim. Aqua Agents Ian Brownridge, Polly Ogden, Tanya Hasking, Dylan James, Sally Livemore and Nick King swam a mile in open water in Millwall Docks in aid of St Christopher’s Hospice, Sydenham. The six all completed the course, with Nick King achieving a sub30-minute mile. Now in its fourth year, the event is the biggest outdoor swimming event in the

South of England and is organised to promote open water swimming. Polly Ogden, manager of Faron Sutaria Fulham, said: “St Christopher’s Hospice provides the most amazing support to those in the hospice as well as their families. Through personal experience, and many friends who have been offered support by the nurses at the hospice, I couldn’t think of a charity more worthwhile. The swim was certainly tougher than we all imagined but a great achievement for us all.”

Writer and historian James Stourton, former chairman of Sotheby’s, will be talking about great houses of London at St Peter’s Church on Belgravia’s Eaton Square this month. He will discuss some of the capital’s lesser-known architectural gems, offering a glimpse inside extraordinary houses that are mostly inaccessible to the general public. These include Apsley House, former home of the Duke of Wellington at Hyde Park Corner; 10 Downing Street; Lambeth Palace; and the contemporary home of Richard and Ruth Rogers. 

 Stourton’s latest book, Great Houses of London, follows the success of his Great Smaller Museums of Europe; Great Collectors of Our Time: Art Collecting Since 1945; and The British as Art Collectors: From the Tudors to the Present. He is currently writing an authorized biography of Kenneth Clark, former director of the National Gallery in London. His talk in Belgravia on 22 October, sponsored by estate agency John D Wood & Co, is the third in a series organised by the new Pimlico Society, whose co-founders are Peter York and Clive Aslet. Demand for London property is 30 per cent up on last year while housing stock has dropped by 33 per cent, according to latest figures from Douglas & Gordon. “The majority of activity is clearly taking place in the £350,000 to £750,000 and £1m to £2m levels, implying ongoing SDLT/Mansion Tax concerns and a desire to invest in buy-to-let property,” said D&G director Ed Mead. “The second phase of the Government’s Help to Buy scheme is launching in January and will affect all our areas given the threshold is £600,000. This price range is already busy and areas like East Putney, Clapham and Battersea could, unusually, be feeling the benefit of HMG-sponsored buyers,” he said. “Press talk of a boom may be wide of the mark, but another year of modest above-inflation gains look assured.”

A car is born As part of Aston Martin’s year of global centenary celebrations, 150 of the rarest and most famous models roared into Kensington Gardens in July to document this legendary marque’s remarkable story. The company was founded by two friends, engineer Robert Bamford and sporting motorist Lionel Martin, who added Aston to Martin after successful runs at the Aston Clinton hill climb in Buckinghamshire. Martin’s wife approved as she felt the name would appear high up on alphabetical lists of carmakers. Aston Martin’s 100 years began on 15 January 1913, under the original name of Bamford & Martin Ltd, at Henniker Mews in Chelsea. It was here that the company’s year of centenary celebrations was launched on 15 January 2013, with the new special edition Aston Martin Vanquish standing side by side with A3, the oldest Aston Martin in existence. CEO Dr Ulrich Bez said: “I am proud to be celebrating 100 years of heritage and the best of British craftsmanship.” Unveiling a green plaque, Roger Carey, chairman of Aston Martin Heritage Trust, said: “This is where

the workshops were first located and the Aston Martin Heritage Trust felt it was important to record the centenary by creating and displaying a plaque commemorating the start of such an iconic car business.” Aston Martin’s historic birthplace is now for sale in the shape of a 700 sq ft three-bedroom mews house. Its interior designed by Mark Howarth has an impressive reception room, large kitchen breakfast room, and plenty of natural light. Berkeley Square’s only penthouse From Rod Stewart to Frank Sinatra, and from Nat King Cole to Dame Vera Lynn, they’ve all crooned the romantic 1939 tune A Nightingale Sang in Berkeley Square. Art space of royal portrait painter Society portrait painter Carlos Luis Sancha (19202001), born in London to a Spanish father and English mother, lived and worked at his Melbury Road apartment for around 40 years. Special report by Henry Hopcroft, head of Lettings at Stanley Chelsea Perhaps it is because I love property, and I care about the aesthetics of all things, that I am constantly surprised by how many poorly presented properties are available to rent in London. All too often there is a huge disconnect between the expectations of tenants and the finish of the properties that they are supposed to be renting. Most landlords recognise that they need to keep their investment property well maintained but many appear not to see how out of date it can look. Fashions change very quickly and it takes surprisingly few years for that beautiful new kitchen to become passé. At ten years old, a kitchen or bathroom is probably reaching, or has already reached, its sell-by date. At this point it is definitely time to think about how the property is perceived by potential tenants and either replacing, or significantly overhauling, the offending rooms. Not because they do not function well but simply because they have been overtaken in terms of style and presentation.

Central London has a mature rental market and unlike the rest of the country, where the rental market seems to be booming because the sales market has been difficult, there is a reasonable supply of property to rent and landlords cannot afford to be complacent. Certain times of year are very busy and a landlord can get away with poor presentation, but if a flat or house comes free at the wrong time of year, the presentation is key to getting it let quickly and for the highest possible rent. A few weeks with the property empty makes a huge dent in the overall return. If raising funds to get work to a property done is an issue, a landlord might look at increasing the lending on the property by the sum needed to get the works done. The interest on the increased lending can usually be offset against the income, lessening the income tax payable. Keeping your rental property up-to-date and beautifully presented should not only maximise its income potential but should also enhance its capital value. And isn’t that the real reason you own it?
