After years as a print publication, TwinWest’s Directions magazine is set to go exclusively electronic next month. The change marks the recognition that Directions distribution has been limited based on the economics of printing and mailing a 16-page magazine, as well as TwinWest’s strong desire to deliver the most timely, up-to-date information to the TwinWest business community. Directions as a print publication has been distributed to TwinWest members for over 20 years, and has featured some of the best business leaders and their stories. It has always been a good source for business education articles and a reliable place to turn for the ins and outs of your Chamber. Also Directions is read each month by three thousand business leaders, community stakeholders, and public officials. Beginning with next month’s issue, Directions will arrive in your inbox instead of your mailbox. Based on this distribution model we expect that Directions will reach twice as many readers in the western suburbs by year end. And we expect to deliver more original, timely content in this new format, all while providing enhanced advertiser value. Identity Theft BY PENNY SPRINGER You probably don’t plan on becoming a victim of an identity theft in 2011; however, are you planning not to become a victim? Steps can be taken to diminish the threat of identity theft; this article examines current statistics and how to raise your awareness to minimize risk for you and your business. In 2009 one out of every 23 Americans had experienced identity theft, Javelin Strategy and Research 2009. This equates to 1.6 million households, and households with incomes higher than $70,000 were twice as likely to experience thefts compared to those with salaries under $50,000. Stolen wallets and physical paperwork account for 43% of all identity theft. On the rise is medical identity theft, with 7% of Americans having their information stolen.

Phishing is the act of sending an e-mail to a user falsely claiming to be an established legitimate enterprise in an attempt to scam the use into surrendering private information that will be used for identity theft. The advancement of technology has led to phishers are now able to ‘spoof,’ or forge both the “https://” that you normally see when you’re on a secure Web server AND a legitimate-looking address. In addition, phishers may also forge the yellow lock you would normally see near the bottom of your screen on a secure site. The lock has usually been considered as another indicator that you are on a ‘safe’ site. The lock, when doubleclicked, displays the security certificate for the site. If you get any warnings displayed that the address of the site you have displayed does not match the certificate, do not continue. Pharming is a scamming practice in which malicious code is installed on a personal computer or server, misdirecting users to fraudulent Web sites without their knowledge or consent. Have an antivirus program from a trusted security software provider in order to reduce your exposure to pharming scams. Maintain a personal firewall to protect your data from hackers, viruses, worms, and Trojan horses. Also, download the latest security updates for your Web browser and operating system. The Federal Trade Commission (FTC) suggests some tips for protecting yourself, which are to think, deter, detect and defend. Deter thieves by safe guarding the obvious personal information including social security number, bank, credit card and insurance information. Keep passwords unique, and change them frequently. A good tip for passwords is to have a phrase or sentence that you can remember that codes the password. For example: I went to Colorado in January 1998. IWTCIJ1998. Start out the New Year by photocopying the front and back of all cards in your wallet. If lost or stolen all the phone numbers and accounts are easily accessible for notifying the companies. Keep personal information secure at home from visitors and outside employed help. Guard your mail and shred financial documents and new credit card applications.

Identity theft occurs in a variety of ways including: shoulder surfing, hacking, credit card scams, dumpster diving and corrupt employees. Two important terms to describe techniques for identity theft are phishing and

about unknown purchases. Inspect your credit report yearly. Be ready to defend against identity theft if you suspect a problem. Place a “fraud alert” on credit reports, consult with your bank about closing tampered accounts, and file a police report. Finally, report to the FTC at www. consumer.gov/idtheft. Protecting your business all starts with having a sound data security plan. Identify what sensitive information you have on your desk, in your files, and on your computer. Your employees and clients’ personal, financial, and health information are covered under legislation like the Gramm-Leach-Bliley Act (GLB), Health Insurance Portability and Accountability Act (HIPAA), and Fair and Accurate Credit Transactions Act (FACTA). This type of information should be kept secure and destroyed, not thrown in the trash or recycling. Train your staff to keep only the information you require for your business. Destroy documents based on retention schedules and back up files on servers. Protect documents in locked areas; storing in a box under the desk marked shredding is not a safe location. Protect information via email by using encrypt transmission for sensitive data. The destruction of material does not stop with paper documents; therefore, properly destroy computer hard drives, copy, fax hard drives, DVDs, and CDs. Lastly, develop a plan for how to respond to a security incident. Delegate who in your company should be involved and how will the security breach be handled to minimize damage. Start the year 2011 strong with a plan for both yourself and your business to minimize the risk of identity theft. Let this be the year to have a plan for your security. Penny M. My interest in public service started as a child, grew as a college student and was cemented as a parent. As a child, I spent a lot of time with my grandparents on their sunflower farm in North Dakota. I remember being in the field with my grandfather and noticing parcels of land that were not planted. When I asked why, my grandfather

told me the government had declared them a wetland. After an injury ended my football career, I became interested in student government and soon was campaigning for Senator Rod Grams. Now, as a parent to two young children, I want to ensure Minnesota remains a great place to live, work and raise a family.

What are your legislative priorities this session that will positively impact the economy, jobs, and issues important to the business community? Legislation that creates a competitive business climate for job creation is the number one priority. We are aggressively pursuing reforms that will streamline the permitting and environmental review process as well as looking at the corporate tax structure. With a Republican led House and Senate, and a DFL Governor, what areas of agreement will be achieved this session? Regulatory reform such as permitting and environmental review streamlining; some areas of education reform such as alternative teacher licensure; and government reform that focuses on a more efficient and effective service delivery model for state agencies.

What do you think will be the most notable accomplishment from the legislature this session? A balanced budget, and legislation that will streamline the permitting process and make Minnesota a more competitive business climate. What advice would you give to TwinWest members on making an impact this legislative session? Stay abreast of the issues at the State Capitol and offer your experience and advice. You know what it takes to meet the bottom line, make payroll, adapt to changing technologies and more. We can learn from you and put your experience to use in state government. What is your favorite Minnesota Landmark or activity and why? Traveling along the North Shore, my wife and I always enjoy Gooseberry Falls and the Split Rock Lighthouse. I also enjoy hunting and fishing whenever I get the chance. What is something from your past or present that people would be surprised to know about you? Some may be surprised to know that I dealt blackjack in college to pay my tuition.

Governor Dayton Addresses TwinWest Business Community The TwinWest Chamber of Commerce was honored to host Minnesota’s 40th Governor, Mark Dayton, at the February 11 Legislative Breakfast. Over 260 business and community leaders listened to Governor Dayton as he discussed his priorities including investments in education and strides to close the achievement gap existing in Minnesota’s schools. Governor Dayton noted his

At the event, Governor Dayton also defended his February 10 veto of Republican-passed legislation to cut nearly $1 billion in State spending. Given the $6.2 billion shortfall, the Governor stated that the bill was only a partial solution to the problem. Governor Dayton hinted that his budget, which was released on February 15, would include comprehensive solutions with a balanced bottom line, making no secret that his budget will include spending cuts and increased revenues.

Summary of Governor Dayton’s Proposed Budget Governor Mark Dayton’s 2012-2013 budget proposal seeks to balance Minnesota’s $6.2 million budget deficit with $4.13 billion in tax increases and $1.94 billion in spending reductions, and includes using $136 million from Minnesota’s cash flow account.

In addition, the Governor acknowledged that transportation and infrastructure investments are important as they directly impact the business community’s ability to provide goods and services.

At the heart of the proposal, the Governor calls for a new 4th tier income tax bracket at 10.95%, and includes a 3% temporary surcharge on Minnesotan’s making over $500,000. The 10.95% bracket would apply to single income earners making $85,000 or more, or married joint filers reporting incomes of $150,000 or more. Also, the Governor’s proposal places an additional property tax on homes valued at more than $1 million. The balance of the Governor’s revenue raising comes from $430 million in increased corporate taxes, $877 million in health care surcharges, and $34 million in other taxes.

TwinWest is analyzing the Governor’s budget, but is concerned that increasing taxes on job creators at a time when the economy is already suffering will stifle job stability and growth, and delay real recovery. In addition, Minnesota needs a long term structural solution to our budget problems, not just a short term fix.

Impacts of the Tax Relief Act of 2010 BY TIM KENYON “What’s in it for me?” That’s a question often asked by our clients when new tax legislation is passed. And in 2010, there were several new tax laws enacted in which the question was raised. There’s no doubt that the most recent legislation, passed in December 2010, will impact the majority of taxpayers – individuals, businesses, estates, and not-for-profit organizations. Most notably, the individual income tax rates which were to expire at the end of 2010, also known as the “Bush Tax Rates”, have been retained for two years. A few highlights of the Tax Relief, Unemployment Insurance Reauthorization, and Job Creation Act of 2010 are summarized here. Also known as the Tax Relief Act of 2010, this legislation gives taxpayers and their advisors a degree of certainty for at least the next two years. Many of the new rules are complex, and this summary is necessarily brief. I encourage you to consult your tax advisor before acting on this information.

Individuals Many individuals will experience the law’s most immediate impact with a payroll tax cut and the

extension of the reduced individual income tax rates. For 2011 only, the Social Security tax is reduced by 2% for employees, resulting in higher take-home pay. Self-employed individuals also receive the reduced payroll tax, but won’t see results as immediate since the self-employed pay the Social Security tax through quarterly estimates or with their income tax. A number of credits available to working families have also been extended. These include the Higher Education Tuition Deduction, Child Tax Credit, Dependent Care credit, and many more. It’s important to note that some are extended through 2011 and some are extended through 2012. Some taxpayers will be excited to hear that the alternative minimum tax (AMT) exemption amounts have been ‘patched’ for 2010 and 2011. Also for 2010 and 2011, many nonrefundable personal tax credits will be allowed to offset the AMT.

Businesses As the economy grows, businesses may wish to invest more capital and resources to meet growing demand. If so, there are a number of incentives in this new bill that businesses can capitalize on when planning those investments. A number of tax breaks that expired at the end of 2009 have been extended through 2011. These credits are related to research, new markets, write-offs for qualified leasehold improvements, restaurant buildings and improvements, and retail improvements.

Businesses who invest in machinery and equipment may be interested in new incentives related to bonus depreciation, an election to accelerate the AMT credit instead of claiming additional first-year depreciation, and increased Section 179 expensing limits for 2010 and 2011. If your business is considering the purchase of offthe-shelf computer software, the software may qualify for the Section 179 expensing election if placed in service in a tax year beginning before Jan. 1, 2013. Businesses may also be interested in the Business Energy Incentives, Transit Benefits, Business Charitable Contributions Deductions, and the provisions related to capital gains and qualified dividends.

Estates Most people will need to review their estate plans and gifting strategies. Under this new act, the estate tax and generation skipping tax changes can be applied to decedents who died in 2010, but are generally effective from Jan. 1, 2011 through December 31, 2012. Estates will have a $5 million exemption that is indexed for inflation after 2011 and a top tax rate of 35 percent. Inherited assets will receive stepped-up basis. With proper planning, married couples may be able to avoid some or all of the estate tax for combined estates aggregating $10 million, depending on the exemptions and gift taxing strategies the couple has implemented. Business owners may want to develop succession planning strategies that consider these new $5/10-million provisions. Other provisions affect the estate tax and gift tax calculation and are not mentioned here. It’s important to discuss these provisions with a tax advisor to maximize your estate plans and gifting strategies. The annual gift tax exclusion is expected to remain at $13,000 for 2011. The Tax Relief Act of 2010 provides $801 billion of tax cuts and $57 billion for extended unemployment insurance. Wanted: Prepared workforce Needed: Education reforms BY CECILIA RETELLE U.S. Education Secretary Arne Duncan says Minnesota has lost its “sense of urgency” to improve education and needs to take bolder steps to reduce the achievement gap. State Education Commissioner Brenda Cassellius says she is “shocked” by the lack of proficiency by Minnesota fourth- and eighth-graders on science tests. It’s little wonder that the primary customers of our state’s education system – employers – are distressed over the prospects of their future workforce. The dynamics of a persistent achievement gap among Minnesota students and a growing shortage of workers are at the core of the Minnesota Chamber of Commerce’s education and workforce development initiatives at the 2011 Legislature. Minnesota businesses have traditionally counted on a highly trained workforce to make a niche in the marketplace, whether competing with their peers in neighboring states or across the globe. But that is changing. Immediate steps must be taken.

These are the facts: Minnesota has one of the widest achievement gaps in the country. It persists among racial groups and across socioeconomic levels. The state’s demographics are changing and, by 2020, the populations that are expected to grow are on the “wrong” side of the achievement gap. In 2009, 82 percent of Caucasian students graduated; in contrast, rates for students of color ranged from 41 percent to 68 percent. By 2018 it’s projected that 70 percent of all jobs in Minnesota will require some postsecondary training. At present, about 40 percent of current jobs in this state require training beyond high school. Each of these statistics by itself is troubling. Taken as a whole, they represent a distress signal for the state’s economic vitality. Minnesota cannot sit idle. Developing a worldclass workforce is a long term process; we must act now. To that end, the Minnesota Chamber of Commerce, working in partnership with

the TwinWest Chamber of Commerce and our statewide Chamber Federation, is advancing an aggressive and broad-based agenda at the Capitol with attention to early childhood, K-12 and higher education. Our priorities include:

Higher education reforms: Invest 30 percent of the state higher education appropriation in programs that distribute money directly to students rather than institutions; currently it is 10 percent.

K-12 reforms: Place an effective teacher in every classroom. Second to parents, teacher quality is the biggest predictor of student success.

Hold all programs and institutions accountable for their performance, and provide transparency so students can make educated choices on the institutions and programs that best fit their needs.

Require reading at grade level by the time a student leaves third grade. Through third grade, children learn to read. After third grade, they read to learn. Students who can’t read at grade level when they leave third grade are significantly less likely to graduate from high school. Increase high school graduation requirements. High school graduates must be prepared to enter college or the workforce.

Early education reforms: Create effective early education programs. We support recommendations advanced by the Minnesota Early Learning Foundation.

Too many students across the state are falling behind in the skills necessary to succeed in today’s economy. We must elevate student achievement to world standards and, simultaneously, accelerate the learning of those students who are farthest behind. Both of these challenges can be solved if policymakers seize the directive. For starters, we must target resources to underachieving students and invest more in education’s lynchpin – teachers.
