Meet Your 2018 Board of Directors

Officers Claire Michael, CAM, is a Regional Vice President with Fairfield Residential for the Southeast, overseeing communities throughout North Carolina, Georgia and Florida. She has worked in the apartment industry for 14 years, and earned her NAAEI President Certified Apartment Manager (CAM) credential in 2008. In 2015 Claire was the recipient of the Property Management Executive of the Year award at TAA’s TOPS Awards, and in 2017 she graduated from the NAA Leadership Lyceum course. Claire has been active in the TAA for many years, serving on the Public Relations & Community Outreach Committee, Government Affairs Committee, PAC Sub-committee, and Finance Committee. She has served on the Board of Directors for the last four years in many roles, including Treasurer and Vice President. In her spare time, Claire enjoys spending time with her family, exercising, going to the beach and anything outdoors. April Vasta, CAPS, CAM, is a Regional Property Manager with Blue Ridge Companies. She has worked in the apartment industry for over 15 years, and has been active with TAA for over 14 years serving as co-chair of events such as the Trade Show and Triangle Achievement Awards. Currently, April Vice President is Vice President on the Board of Directors for the New Lease on Life Program which assists families with affordable housing in the Triangle area, and served on the Nominating Committee. At the state level, April serves on AANC’s Public Relations & Marketing Committee, and at the national level, April serves on NAA’s Apartmentalize (education conference) and Advocate (legislative conference) committees. April loves to spend her free time outside and can most often be found in her “happy place” at Umstead Park with her husband and 2 dogs. Kelli Lea, CAM, is a Senior Community Manager with Greystar and has worked in the apartment industry for 13 years. Active with TAA for the past 11 years, Kelli served a 2-year term as Education Committee Co-Chair and during her tenure on EducaTreasurer tion she helped finalize the Leadership of Excellence Program that begin in 2013. Kelli has also facilitated multiple courses and assisted with trainings. Last year, Kelli earned her Certified Apartment Manager (CAM) credential from NAA. In 2017, Kelli was a member of the TAA Finance Committee and will serve as its chair this year. Rita Zepeda, CPM, CAPS, CAM, is a Regional Director with PRG Real Estate overseeing their portfolio in the Triangle Area. She has been involved in the apartment industry for close to 10 years and in TAA for over 8 years. Rita earned the NAAEI Certified Secretary Apartment Portfolio Supervisor (CAPS) and Certified Apartment Manager (CAM) credentials, and is also a Certified Property Manager through IREM. Rita is an Honor Graduate from UNC-Chapel Hill, and a 2014 graduate of TAA’s Leadership of Excellence Program. She serves as a member of the Government Affairs Committee as well as the Finance Committee. Rita is happily married, has two sons, and a dog. Rita enjoys traveling, hiking, and spending time with family and friends.

Andy Meador, CAMT, is the Vice President-Director of Capital Projects with McDowell Properties, a real estate investment firm based in Plano, Texas. McDowell is a leading multifamily operating company in the United States that acquires and repositions Immediate multifamily investments across the country. Joining their team in 2008, Andy coordinates the activity of Past President McDowell’s Construction Management Team that is responsible for evaluating potential acquisitions and renovating its 21,000 unit investment portfolio. Andy has been affiliated with the apartment industry for 31 years. He is a faculty member of the National Apartment Association Education Institute (NAAEI); a Certified Pool Operator Instructor for the National Swimming Pool Foundation, a proctor for the CFC certification exam, and also instructs portions of the NAAEI CAPS and CAM credential programs. Over the years, Andy has served on the Membership, Education, and Special Events Committees; and served as a Board Member on the Triangle Apartment Association Education Foundation (TAAEF). Andy earned his Certified Apartment Maintenance Technician (CAMT) credential 22 years ago, as part of TAA’s first graduating CAMT class!

Directors Rob Boggs, CAM, is a Community Manager with TriBridge Management and an active member of the TAA community. In his job with TriBridge, he is currently overseeing a new lease-up in the Raleigh market. Rob enjoys working with lease-up and distressed occupancy assets the most as it gives him the opportunity to be hands on with all of his residents. He earned the Certified Apartment Manager (CAM) credential in 2016, as well as completed the TAA Leadership of Excellence Program. Rob has been active with TAA for 8 years and is currently serving as the Co-Chair for TAA’s XCEL Committee, and a member of the Special Events Committee. Rob is an avid Disney enthusiast, and enjoys spending his free time at the most magical place on Earth! Rob likes to live every day in accordance with one of Walt Disney’s philosophy’s of “It’s kind of fun to do the impossible!” Berry Craven, CAMT, is a Regional Service Manager with Ginkgo Residential, covering assets in North Carolina and Virginia. He specializes in acquisitions and renovations for owned and managed assets. Berry has been with his company for 17 years and active in the TAA for 13 of those 17 years. He earned his CAMT in 2013 through a TAA scholarship and completed the Leadership of Excellence Program in 2017. He has served on the Membership Committee for 5 years and was the Co-Chair of this committee in 2016 and 2017. He has helped at many fundraising events and been on task forces for TAA. In his spare time Berry likes to spend time with family and friends and loves to hunt. Steve Hayworth is the Director of Maintenance for Drucker + Falk and is responsible for the oversite of all maintenance, renovation and capital improvement projects for the company’s portfolio of nearly 30,000 units. He has worked in the apartment industry for over 31 years, and holds General, Mechanical, Plumbing, Electrical and Home Inspector licenses for the State of North Carolina. Steve is a CPO Instructor and an EPA, CFC Proctor. He has been an instructor for TAA since 1999 and was elected to a two-year term on the board in 2002. During this time, he also cochaired the Membership Committee. Steve also enjoys spending time with his family, boating and traveling!

Kristi Henderson is an Account Manager with Redi Carpet and has worked with the apartment industry for the past 9 years in the triangle area. Kristi has been an active member of TAA and the special events committee during this time. She completed a 3-year term as Special Events Co-Chair and also volunteers regularly, has been a part of multiple task force and focus groups, and most recently co-chaired Casino Night. Kristi enjoys DIY household projects, Tar Heel Basketball, live music, and going to the beach regularly with her two teenage boys and family. Craig Nardi, CPM, is a Regional Manager with Palms Associates and has been working in the Triangle since 2006. Craig has worked in Property Management for the past eighteen years in several large markets including Phoenix, Washington D.C. and Maryland. Within the industry, Craig has a background that is well rounded and has experienced Class A, Lease Up, Single Family Management, Mid Rise Buildings, Property Rehab and Renovations along with some commercial management experience. In 2009 Craig earned his Certified Property Manager (CPM) credential through IREM. Craig is serving his third year as Co-Chair of TAA’s Government Affairs Committee. Cindy Nitschke, CAS, is the General Sales Manager with ForRent.com. She has been in the apartment industry for over 25 years. Cindy started working onsite while attending Oklahoma State University and worked onsite for 9 years before becoming an Associate Member in 1999. Cindy has served on and chaired numerous committees throughout her career and served on the Board of Directors and as secretary of the Executive Committee in 2001-2002. Cindy was the proud recipient of the TAA “Associate of the Year” award in 2001. Most recently, Cindy has been a member of the Special Events Committee and CoChair of the Trade Show Committee. She currently is also a member of the AANC Supplier’s Council. Cindy has been blissfully married for 24 years and has 2 children and a dog. In her spare time, she loves watching football and spending time with friends, traveling and being a “dance mom” and a “wolfpack mom.” Jessica Patterson is a Community Manager with Greystar Real Estate Partners, and has been a property management professional since 2001 in the Hampton Roads and Greater Richmond, Virginia markets along with the Northeast Ohio market and now the Triangle. Jessica joined the Triangle Apartment Association in 2011 as a member of the Independent Rental Owners Committee, and is currently a member of the Public Relations and Community Outreach Committee. Jessica previously served on the Board of Directors for a family life center in Richmond, Virginia and also co-founded a non-profit career development organization and served on the Executive Board of Directors prior to relocating to North Carolina. Jessica is a member of The Summit Church and enjoys traveling, fitness, attending sporting and live music events and making memories with friends and family in her spare time. Rebecca Rosario-Bueno, CAM, NALP, NAAEI, is a trend-spotting visionary with over 25 years of tried and true on–site and corporate property management experience. She is President of Full House Marketing, Inc. ® North Carolina, a single resource for lease up and marketing services, staffing and talent acquisition, and training and talent development. Rebecca is Co-founder of PMManuals.com, a property management policy creation company, and an Apartmentor.© She is the

current AANC Supplier Council Chair, and a NAAEI faculty member. Rebecca is a multiple NAA Education Conference Speaker and a multiple Multifamily Pro Brainstorming Presenter and Facilitator. Judy Wade, CAPS, CAM, is a Vice President with TradeMark Residential in Raleigh and has worked in the apartment industry for 24 years. Judy has earned the NAAEI Certified Apartment Portfolio Supervisor (CAPS) and Certified Apartment Manager (CAM) credentials. She has volunteered with TAA in numerous capacities throughout her 23 years of service. Most recently Judy has worked as an active member of the Special Events Committee, serves as co-chair of the After Work Network events, and served on TAA’s Nominating Committee. Judy has been married for 26 years, and her hobbies include visiting Pensacola Beach, Florida, gardening, Florida State Football and socializing with people. Chris Williams is a Senior Sales Executive with RentPath, a digital marketing and business solutions company that is dedicated to serving the multifamily industry. With 16 years of experience in the apartment industry and as a member of the TAA, he has served on the PR & Community Outreach Committee for 6 years, recently completing a 3-year term as the committee Co-Chair. During this time, the PR & Community Outreach Committee helped create A New Lease on Life (NLOL), TAA’s transitional housing program designed to help families who have become homeless, get back on their feet. Prior to joining RentPath, he spent 11 years in various on-site roles including Property Manager overseeing both new construction and stabilized assets. He also served as a Sales Trainer for Altman Management working with the Director of Training for Signature Sales Classes as well as providing field training and comprehensive development of marketing plans for challenged assets. Chris is a graduate of North Carolina State University and remains a proud Wolfpack alumnus. When not working, he enjoys time at the beach, jogging, spending time with family and friends, volunteering with charitable organizations, and attending First Presbyterian Church in Durham, NC.

With TAA, Norm has been an active member of the Government Affairs Committee and the Independent Rental Owners (IRO) Planning Committee. Norm also sits on the Board of Directors for the Apartment Association of North Carolina (AANC), and on the Legislative Committee of the National Apartment Association (NAA). WHAT CAN I CHARGE AND WHEN?

By Brownlee Whitlow & Praet, PLLC As it is the start of a new year, we thought, although this topic may seem somewhat basic, that we would begin with an article on this oftenmisunderstood area: late fees and eviction fees. We regularly receive questions from both new and experienced property management professionals, particularly when property management professionals are first beginning to work in North Carolina. The good news is that, unlike many areas of North Carolina residential property management law, we have pretty definite answers to many of the questions that arise with respect to late and eviction fees. If you are the type who likes to read and try to make sense of the Legislature’s work, the statute can be found at NJSA Sec. 42-46. First, things first, when can you charge a late fee? You can charge a late fee when rent is five or more days late. You may wonder why, if your lease states that rent is due on the first of the month, you have to wait four more days before charging a late fee. The short answer is because the legislature says so. The next big question is “how much can I charge?” This answer depends on the circumstances, but generally the answer is “the greater of $15.00 or 5% of the late rent.” The qualifiers for this answer are: 1) rent must be due in monthly installments (if the rent is paid weekly the fee is “the greater of $4.00 or 5% of the monthly rent); 2) if the rent is subsidized, the fee is only calculated using the resident’s share of the rent; and 3) water and sewer fees cannot be included if they are paid to the property owner. Another important point to keep in mind is the late fee can only be calculated one time against any given month’s rent, and unpaid late fee cannot be deducted from a

subsequent month’s rent so as to put that next month’s rent in default. Next, we look at what you can charge if the resident has failed to timely pay rent and you decide to move forward with a summary ejectment (eviction). If the landlord has included provisions concerning fees in the written lease, there are a few different fee options that can be charged depending on when and how the matter is resolved. 1) Complaint-Filing Fee: If the matter is resolved after the Complaint has been filed with the court and served on the resident but prior to a judgment, the property manager/owner may charge a Complaint Filing Fee. This fee may not exceed the greater of $15.00 or 5% of the monthly rent. The landlord may include this fee in the amount required to cure the default. The landlord may also include any court and, to some extent, reasonable attorneys’ fees as allowed by law. 2) Court-Appearance Fee: If a Complaint was filed in Court and served on the resident, and the property owner received a judgment at court, then the property manager/ owner may charge a Court-Appearance Fee. This fee may not exceed 10% of the monthly rent. If the property manager/owner is willing to allow the resident the opportunity to cure the default, they may include this fee in the amount required to cure the default. The landlord may also include any court and reasonable attorneys’ fees as allowed by law. This fee can only be charged INSTEAD OF the Complaint-Filing Fee, and not in addition to it. 3) Second Trial Fee: If the property manager/owner obtains a judgment in Small Claims Court, and the resident appeals, but the property manager/owner won in the ApartMentor | January/February 2018 8

District Court, then the property manager/owner may charge a Second Trial Fee. The Second Trial Fee may not exceed 12% of the monthly rent. If the property manager/owner is willing to allow the resident the opportunity to cure the default, they may include this fee in the amount required to cure the default. The landlord may also include any court and reasonable attorneys’ fees as allowed by law. This fee is instead of the Court-Appearance Fee, and not in addition to it. We want to reiterate that to charge these fees they must be in provided for in your lease. If you allow the resident to continue to reside at the rental home without paying these fees, you may not deduct them from the resident’s subsequent rent payment or declare the failure to the fee as a default under the lease as a basis for a subsequent summary ejectment action. Also, you will notice we underlined “as allowed by law” with respect to the reasonable attorneys’ fees charged to the resident. A discussion of what that actually means is somewhat amorphous and beyond the scope of this article. A final point to be aware of, is that you cannot agree to different fees in excess of those provided for above in your lease, and that the Courts have found those who charged in excess of the fees above to have committed an Unfair and Deceptive Trade Practice, which provide for treble (triple) damages and possibly paying the resident’s attorney’s fees. That being said, often the law is a little grey regarding property management in North Carolina, so at least we have some bright lines here, and that is hopefully a good thing, maybe. Get Organized: 10 Tips from 10 Really Organized People Rob Boggs | Break away from your computer! Our offices and jobs all have those crazy and overloaded days. Take the break, get with your team and do a 30 second dance party or walk around the building! Just that short time can help you and your team feel better about tackling that next objective together. Michel Charbonnier | One thing I do to manage my time and not forget important things is to manage a task list by assigning an importance number from 1 to 5 and also a due date for each task. I always start by doing tasks ranked #1 and also complete any tasks that are due today. That way I do all the tasks in order of importance and I also never forget things that have a strict deadline. Julie Chu Zhang | Develop your system, whether you work better with a digital or paper format or a combination of both. Spending time to organize upfront will save you countless hours later on when you are searching for something. I also recommend prioritizing tasks and tackling your hardest ones first, that way, you feel a great sense of accomplishment. Berry Craven | Use all technology available to help stay organized. From outlook reminders, mass emails, and being able to sync your phone with your company’s software and apps—most of what we need to do can now be done from your smart phone. There are pool apps, HVAC apps, and many more that help us stay organized and efficient.

Another suggestion is to start with the hard stuff. Most people put off the hardest things they must do for last. This causes extra undue stress that could be avoided if they would just get the hard items knocked out first. That removes the stress and allows you to focus, which increases efficiency, and the more efficient you are the more organized you will be. Most can access their calendar from their phone, and it’s always with us, unlike paper and pen. As you complete the task you can delete it or if time does not allow, you can slide it over to the next day. This keeps your desk, computer, and car free of sticky notes and your mind more at ease about the possibility of forgetting things. Andy Meador | Retire that dinosaur notepad and download a note application on your phone to keep all your important notes and task list. My favorite is Evernote. I use if for all my tasks! Jessica Patterson | Once a month, declutter and purge your workspace (electronic and physical). Go through your email, tote bag/briefcase, desk top and drawers, computer files, and reorganize or get rid of anything you don’t need. Keeping your work space decluttered will help you staff efficient and know where everything is! Bret Smith | One tip that I can give on staying organized is keeping a clean inbox in my Outlook email. I have subfolders within sub-folders within folders, and once I am done and complete with the email, I will move it to the folder it calls home for eternity. My inbox is never filled with hundreds of emails and if the email is still in the inbox, I still need to work on it. This also makes life easy when searching for emails that you need to go back and reference. Chris Williams | Learn how to use the calendar on your mobile phone and make sure it syncs to all of your devices: iPad, laptop, etc. Set multiple alerts depending on the type of event it is and make sure to set a reminder to start preparing for the event. Depending on the amount of prep work required for the event, you may want to set a separate calendar event. Make sure you are thorough and doing things right the first time so that you won’t have to fix them and/or re-do them—this alone will save you from a lot of wasted time! November Membership Dinner Meeting

On November 9, over 150 members and guests came together at the Embassy Suites by Hilton Raleigh Durham Research Triangle for a Membership Dinner Meeting. A Networking Hour provided an opportunity for those in attendance to connect before settling in for dinner and the program. TAA President Andy Meador welcomed everyone and provided general remarks before sharing a number of 2017 fundraising efforts for TAA’s New Lease on Life program. Andy explained that the Triangle Apartment Association Education Foundation donated $5,000 of the proceeds from the Take 5 Breakfast Business Exchange. TAA’s PR & Community Outreach Committee presented a check for $4,088.50 from their Collection Drive themed “Donations Never Take Vacations.” And, Brownlee Whitlow & Praet, PLLC, also presented a check, for their pledge match of $2,500 from the Collection Drive. Board members from the New Lease on Life program were welcomed to the stage to accept the very generous donations. The evening’s Featured Speaker, Mindy McCorkle, Enhancement Talent Development, was welcomed to the stage by Robyn Gastol, Trane Company. TAA New Construction Bus Tour Highlights Raleigh On November 30, TAA held its fall Bus Tour highlighting new construction in and around the inner beltline of Raleigh. Attendees gathered at Hyatt House North Hills to network and to hear the afternoon’s itinerary. After boarding two buses, the 100 attendees heard information from the moderators about the Raleigh market, including new product trends, demographic and employment statistics, factors driving new development, apartment sales transactions and recent top trades. While on tour, there were stops at four communities, which provided an opportunity for each to showcase their unique product. Trivia questions about Raleigh and prizes kept the drive time lively!
