Family wants police to admit fault in crash

A

teenage girl has been left battered and bruised after crashing into a marked police car that was allegedly parked in the middle of the road with its lights off.

The 16-year-old, whose name the Times has withheld, says she drove into the back of the police vehicle on Bucklands Beach Road at around 11.30pm on Saturday.

“Two police cars driving on opposite sides of the road had stopped to talk through the window. They had no lights on so I couldn’t see them and by the time I did it was too late,” she says.

While she is on her restricted license and was in breach of the conditions of her license by driving past 10pm, she and her family are shocked by how she was treated by police following the crash.

“They accused me of being drunk, and left me sitting in the crashed car alone while they moved the police car I had hit,” she says.

The teen contacted her brother who arrived shortly after.

When he arrived he says his sister was drifting in and out of consciousness and the car she had hit had been moved.

“I couldn’t understand why no police officer was sitting with her to make sure she was okay, or had

called an ambulance,” her brother Jamie says.

Jamie says he too was accused of drunk driving, despite having not had anything to drink, at which point he got upset and was arrested. He was later released without charge.

“They said I was being arrested for drunk driving, and then when my breath alcohol test came back negative, they changed their reason to the fact that I was [interfering with] their investigation.”

The teen’s sister-in-law arrived at the scene and went to her aide.

She was later taken to hospital where she was found to have whiplash, a sprained right leg, a slight

concussion and chest bruising. Her blood alcohol test was negative.

“We are just really shocked by how the police have handled the whole situation. Nobody was concerned with getting help for my daughter, and more interested in moving the police cars so that nobody on their end got in trouble,” the teen’s father Michael says.

Her car is “totalled” he says, and insurance won’t pay out because she was in breach of her restricted license rules.

He says the only way to have the damages covered by insurance is to prove the police were at fault for the crash.

A police spokesperson told the Times that an investigation is underway.

“Police are investigating a crash that occurred on Bucklands Beach Road involving a stationary marked police vehicle and a vehicle driven by a member of the public,” the spokesperson says.

“It occurred shortly before midnight on Saturday as two police vehicles were attending a nearby incident at the time. The exact circumstances are still being looked into and we are still speaking to all parties involved.”

Interestingly, Karen has homeschooled all of her 10 children that includes a set twins and three adopted children from Ethopia.

“I don’t know how she manages to juggle all her responsibilities but she has a very supportive husband and wonderful friends who help her out,” says John, who volunteers at the blacksmith’s shop on Live Days at the Howick Historical Village.

“In fact none of the cast is paid and yet they were happy to volunteer their time and spend their own money for their flights to New Zealand.

“It speaks a lot of the relationship they share and how much they respect Karen for the work she does as a founder and artistic director of Tin Roof Productions Monument, Colorado a non-profit organisation that produces community and children’s theatre.”

photographer Jana Bussanich arrived from the US a week earlier to work on the stage sets, Karen has just arrived with the crew and is excited about the vibrant new show they have been planning for the last two years.

“Getting everyone’s dates and booking a theatre that early in Auckland was a bit of a challenge,” says Karen, who gives credit to her sister who has always been in local theatre.

Karen finds pure joy in using theatre as a tool for transformation to help prisoners who may never get out.

“It helps them to dig deep into emotion and may even give them a spiritual impetus as they want to be something more than what they have done.

“It becomes a lifeline and it’s heartening to see some of them try and memorise different lines,” says Karen who volunteered with the women’s prison in Mt Eden more than 20 years ago.

“The joy of this partnership is beautiful.”

Is Howick Market in jeopardy?

A

battle is brewing over the old Howick Library building in Fencible Drive – and it could jeopardise the future of the Howick Market.

The Howick Village Association (HVA) has held keys to the ageing building at 16 Fencible Drive for a decade, according to one HVA member. The building was used for storing equipment used in the community.

Now the HVA has been locked out by Panuku Development, Auckland Council’s development arm, citing public safety.

HVA president Ken Scott said Howick businesses are not impressed, particularly as they were given very short notice.

“We’re not happy about it,” he said.

“We got notification about a month-and-a-half ago that they wanted us to exit it.

“The issue now is it’s going to be a challenge to find somewhere close to the market (for storage).”

Before the locks were changed at the old library on Monday, June 24, awnings and gazebos used to shelter the Howick Market stalls were stored there for the week. The equipment is used for winter protection in the “wind tunnel” they occupy in the village square each Saturday. Now we may have to consider closing the market,” said Scott.

The Howick market has operated in some capacity for around 22 years. It was called the Howick Bazaar and, in its present format with gazebos etc, it has run for approx 13.

The old library building has progressively become worse forcing Panuku Development to lock the doors for good.

When the library on Uxbridge Rd opened in 1997 the old library was left vacant and largely unused.

The old library has provided a handy and free storage lock-up for the HVA, Christmas Lighting Trust and, to a lesser extent, the Radio Trust. The contents occupied a good proportion of the ground floor.

Scott has also underlined his dissatisfaction with inaction by the Howick Local Board – except for member Jim Donald. “They’ve not done anything on this at all,” he said.

There is frustration too that an idea for development or maintenance of the building has been put to the local board in the past but was rejected. A number of Howick businesses had also expressed a

desire to buy the building but that too came to nothing.

Storage - especially for the crucial Howick Market equipment – is the priority, he said. At the moment they’re using storage space at the RSA on Wellington Street although Panuku has come to the party, temporarily at least, with a container in which to store Howick Market equipment. It is positioned near the old library.

“Our next step is to find something close to Howick Village Market.”

Meanwhile Ian Wheeler, director of portfolio management for Panuku told the Times the Fencible Drive building is no longer safe for use by the Howick Village Associa-

tion or any member of the public.

“Our priority is to ensure people’s safety so we let the HVBA (HVA) know as soon as it was deemed unsafe,” said Wheeler.

“Local markets help make town centres vibrant and enjoyable places and contribute to local economies so we want to do all we can to help the Howick market thrive. We have been working closely with the HVBA to provide an alternative temporary storage option to assist them in keeping the Saturday markets functioning.”

Panuku has taken on the cost of providing a container for the market equipment in the Fencible carpark for a six-month period.

of the HVBA, we met them on site last week (week beginning Monday, June 24) under managed access so they could remove items, and we have organised to meet them again this week to remove the remainder.”

As to the old library’s future, and timing, nothing further is forthcoming from Panuku.

“The site may be needed for future transport needs but there are a number of issues to work through with Auckland Transport and other stakeholders before a decision is made,” said Wheeler.

News bites Aggravated robbery Reeves Road Counties Manukau Police are investigating a serious aggravated robbery which occurred in Reeves Road Pakuranga at around 11.20pm on Sunday night.

Police were called following a report of two people being approached by another group on Reeves Road, Pakuranga, and their car being taken.

One person received injuries and was in Middlemore Hospital in a stable condition.

Senior Sergeant Steve Meade told media that one of the victims was chased down the road and attacked with a hammer resulting in a head injury.

Police are making enquiries to locate the vehicle and those responsible.

Eastern Stars shine Eastern Stars Youth Band took the stage at the China Youth Art festival recently.

Performing a selection of modern classics, the Eastern Stars helped raise money for the Better Life Foundation and other charity organizations.

The festival was held at the Bruce Mason Centre on July 2 by Aj & Elijah Co. Ltd an Auckland based company offering professional education and immigration consultancy to international students looking to study in New Zealand.

‘We need rain’

hile last week’s muchneeded heavy rain was welcomed by water utility company Watercare, the region’s dams are still wellshort.

The dams in the Hunua Ranges – and Waitakere Ranges on the opposite coast – are one of the three main water sources in Auckland (the other sources are an aquifer in Onehunga and the Waikato River).

The exact proportion supplied from each source varies daily.

Watercare says it depends on the levels in the storage lakes, forecast rainfall, treatment plant capacity, maintenance requirements and the cost of transmitting water to the treatment plant.

Watercare is concerned with the lack of the usual rainfall so far this year.

National Institute of Water and Atmospheric Research, autumn rainfall totals were below normal (50-79 per cent of the autumn normal) with isolated pockets of well below normal.

Meanwhile over the majority of summer, rainfall was well below normal (less than 50 per cent of the summer normal).

In 2018, yearly rainfall was above normal (120-149 per cent of the annual normal).

The dam level data shows levels have improved but the dams remain far from capacity in the lead up to spring and summer.

Watercare’s Roseline Klein, head of water value, says, “Thursday’s heavy rainfall was useful because it saw our total

water storage increase from around 58 per cent to around 63 per cent.

“However, in order to bring the dam levels back up to a normal level, we would need normal rainfall for this time of year, plus a lot of extra rain to make up the deficit from January to June.

“Therefore, we are still encouraging Aucklanders to use water wisely this winter.

We are also carefully balancing Auckland’s water supply, drawing more water from our river and underground aquifers sources than normal to reduce demand on our dams while the dry weather continues through winter.”

Ashley confronts the challenges The Cerebral Palsy Society gives away 3000 pedometers – and calls for schools and workplaces to step up for annual fundraising event

shley Jia-Qi Neilson would probably not be as patient and dedicated if she didn’t have Cerebral Palsy (CP), says Ashley’s mum Victoria Wen-xin Neilson.

“She’s a much more dedicated and observant child because she must constantly improve and watch out for danger,” says Victoria.

Because of Ashley’s CP - a physical disability that affects movement and posture - she has a much better and supportive family than if she didn’t have CP, her mum admits.

“Having to deal with all the unexpected and challenging situations, I have changed almost completely as a person.

“I’ve not talked to my father much for years, however, due to the chal-

ter as the Cerebral Palsy Society of New Zealand begins to ramp up marketing for its annual campaign.

Office workers walk on average 3000 steps a day and the Cerebral Palsy Society wants Kiwi workers to step it up for Steptember, to raise important funds for people living with cerebral palsy.

The Steptember campaign challenges New Zealanders to take 10,000 steps a day for 28 days in the month of September (Sept 3-30), or the equivalent exercise from a choice of 40 alternate activities.

Participants can log their steps online or via the Steptember app using a supplied pedometer given to them when they sign up. The fundraiser has been designed for

lenging situations that came with Ashley, we are now a much closer family than before.”

And the biggest challenge for Ashley, who attends Pakuranga Baptist Kindergarten?

“It’s hard to limit to one challenge,” says Victoria.

“Ashley depends on others to get to where she needs as she can’t walk without assistance, while at the same time, she has issues making others aware of what she needs because of her struggles with speech.

“Cognitively she is doing well but it will be hard for others to realise this and treat her appropriately.”

Victoria is opening up about her and her husband Derek’s daugh-

ber sends a powerful message to their workforce or community that their organisation recognises the importance of keeping active and nurturing their health and wellbeing.

All this, and the Government cancelled the previous National Government’s planned tax cuts, which would have removed some of the burden Kiwis are now facing, and meant they had a bit more in their wallets at the end of the week.

Now Labour is introducing another new tax – the motor vehicle tax.

People who purchase cars which the Government deems to emit too much carbon will be forced to pay thousands of dollars in tax to subsidise people who purchase electric vehicles.

For example, the Mazda CX-5 will jump by $1500 while the Hyundai Tucson will be an extra $2000 under the Government’s proposal.

Fight against 71 units continues

On July 1 and 2, a hearing was held allowing the residents of Reydon Place to express their opposition to commissioners to the proposed redevelopment of 30, 40 Sandspit Rd. The applicant has a right of reply, before a decision is made on whether the development of 71 apartments will go ahead.

very submission put to a two-day hearing concerning a proposed large-scale apartment development in Cockle Bay has been against the project.

Voices of notified community members have been heard on the proposal.

Three hearings commissioners last week heard presentations on the proposed development of 30 and 40 Sandspit Road, prior to making a decision on whether or not to grant a consent.

The development of what’s commonly known as the old Stewards Motors site would include the construction of an apartment building with approximately 70 apartments, a swimming pool and a cafe open to the public. Speaking rights were limited to the applicant (the developer and his support team), council staff and the notified submitters.

Submissions were presented by 14 notified residents, all in opposition to the proposed development.

Chair of the Cockle Bay Residents and Ratepayers Association Laurie Slee said it was also encouraging to hear members of the Howick Local Board speak in

opposition to the proposed development.

Until very recently the board had been very passive in advocating on behalf of local residents, Slee said.

Board chair David Collings and board members Adele White, accompanied by John Spiller, presented to the hearing commissioners stating that they support intensification but believe the proposed development is unsuited to the location.

In their presentation they said the development could bring with it significant problems to the immediate and wider neighbourhood, and that allowing it to proceed could set a dangerous precedent. “They spoke of concerns regarding traffic, the impact on schools, additional vehicular traffic, inadequate and dated stormwater and sewerage infrastructure and the flooding and damage that has already occurred,” Slee said. “[They also spoke of] the potential disastrous results from the additional load on current infrastructure, the fact that the Local Board will not be in a position to fund extensive and expensive

remedial work resulting from the development, and the fact that the development does not fit with the character of the area.”

Slee said the Cockle Bay Residents and Ratepayers Association welcomed the board decision to be more proactive and become involved in the hearing process, echoing the concerns of many local people.

He said that, at one point, the chair of the hearing commissioners praised the quality of the submissions presented.

“The commissioners also did not accept at face value the statements made by the developer and planners that the development should be approved because it complied with the definition of an Integrated Residential Development,” he said.

The applicant now has a right of reply to all the submissions before the Commissioners make a decision on the application.

The right of reply is to be presented by the end of July, with a decision on the application relatively soon after that.

Comment has been sought from both the Howick Local Board and Auckland Council.

he Real Estate Institute of New Zealand (REINZ) is calling for clearer guidelines from MBIE Tenancy Services as confusion continues to arise around the obligations in relation to the condition a property must be left in when ending a tenancy.

For example, as to whether tenants need to clean items such as the carpet or the oven before departing a tenancy, whether picture hooks need to be removed and the timeframes in which the cleaning needs to be undertaken once the tenancy has ended.

Under the legislation, tenants are required to leave a property “reasonably clean and tidy” however, this does not mean being cleaned to professional standards.

Bindi Norwell, chief executive at REINZ says: “Where the confusion arises is the difference between what a landlord or property manager determines to be reasonable and what a tenant believes is reasonable – and these two views naturally tend to differ in around 90 per cent of cases.

“From a landlord’s perspective, if they’ve paid for professional

cleaners to clean their investment property between tenants, when the new tenant leaves, they expect and assume that the property will be left in the same condition.

“It’s also about the timeframe in which the cleaning needs to be undertaken, as this can be compounded when the next tenant is due to move in and there is still cleaning to be done.”

In Australia, the rules are more specific than they are in New Zealand and stipulate, for example, that when a tenant leaves a property that the property needs to be professionally cleaned and that receipts are required as proof. They also stipulate that picture hooks need to be removed from walls and the holes are filled in.

“Unlike in Australia, where the rules are much more prescriptive, there is no yard stick in New Zealand as to what actually constitutes being reasonably clean and tidy. If landlords/property managers and tenants had an actual check list, then everyone would know exactly where they stand,” says Norwell.

“If we had a more specific regime in New Zealand we wouldn’t end up in these situa-

tions where people’s views differ so significantly. Additionally, it would also be of significant benefit to the Tenancy Tribunal which is currently clogged with cases about cleaning.

Where confusion also occurs is that some property managers, in many cases those who don’t belong to an industry body, insert clauses into contracts to include professional cleaning, but then this gets thrown out when the case reaches the Tenancy Tribunal.

“Currently you can’t insert a clause into a contract that goes above and beyond the law, but as the industry isn’t regulated some property managers do this to appease their clients (landlords), but this can ultimately create further problems down the track.

“Right now, all we can do is recommend that property managers educate their clients as to the requirements of the law, but also explain to tenants upfront that the landlord really does expect the property to be cleaned to a high level when they leave the property. However, clearer guidelines to reduce the subjectivity would go a long way to resolving this issue.”

Musick Point needs our help What is happening to Musick Point? No longer a beautiful and awe-inspiring place to visit. It was a lovely place to take the family, older visitors and relations – and a popular tourist destination.

Unfortunately, it has become a magnet for people who treat it as their own private fun-park – to speed/ race/do burnouts, throw their take-away packaging/ bottles/cans out of the window, rip up the grass, use the bushes as open toilets, pull up the fencing – and indulge in other activities not suitable for family viewing.

■■ Some background:• Musick Point covers the entire area from the junction where Musick Point branches off the end of Clovelly Road - all the way to the radio station.

• Musick Point is private property – it is not ‘public’ or council property.

Many locals avoid accessing the point as they find it too depressing to see what it has become – and some are frightened of being hit by vehicles or threatened by vehicle owners if they ask them to slow down.

Owners/lessees are fully aware of the issues – the police are supportive - with some good results having been achieved as a result of the public reporting bad behaviour and collecting number plates.

■■ Suggested fixes: • The current closure at 6pm has seen a significant reduction in local after-hours traffic and bad behaviour – so extend this to close at 5pm all year round – does not fix the issues of day time anti-social behaviour.

• Fence or put in a ditch to protect the grassed areas - and add speed bumps, more cameras – cost.

• Close the point to all vehicles. Whilst allowing limited access to pre-approved groups (radio group, golf club staff, retirement homes) • There is apparently no money to put in 1:33 PM

traffic calming measure, so it might end up being closed altogether, which is sad for everyone else – and all because the antisocial, selfish part of society.

The local community have had enough.

Interested residents are now considering how best we gather together to take this issue on. We are hoping to work with the local groups (like the BB Ratepayers group), build a Facebook page and help gauge local opinions on options.

In the meantime, I encourage the community to continue to report bad behaviour – don’t ignore it - to the Howick police, to *555 and to Colliers Corporate (Wellington), Spark Property Department and Crown Property at LINZ. You are not alone!

Bus driver a hero

I was running up to catch a 70x H&E bus on June 19 when I fell and hit my head on the road.

The bus driver must have seen me in his rear vision mirror. He and a passenger picked me up and helped me on the bus. Another passenger put some sticking plaster strips on my head and, as I had an appointment at Auckland Hospital, the driver diverted the bus to go by the hospital to drop me off where I spent the next week.

I would like to thank all these people who helped me, especially the bus driver who I think was named Sandeep.

Risks for Turanga Estuary Auckland Council has approved a company to discharge treated wastewater into Turanga Estuary (Whitford) which has upset many locals. Quoted by some “you

will be able to drink it” is untrue.

The quality of treated wastewater will be reduced and no longer of such a high quality that it will improve the overall conditions in Turanga Creek.

Instead, dilution will be relied on to avoid adverse effects.

The discharge may result in a marginal reduction in water quality on occasion (especially with regards to ammoniacalnitrogen and nitrate-nitrogen).

Said informant has pointed out something every serious operation should consider: anything you say may be held against you. In this case, when do they leave home and when do they usually return. Riiight.

AT has now spoken up to say they are legitimate, providing perfect cover for the wolves to be dispatched to a less wary neighbourhood.

Come on, AT. And well done, name withheld. How many of us have had calls from people claiming to have something very important to discuss before asking for personal details?

aving suffered hamstring problems soon after making the All Blacks’ 39-man squad, Sonny Bill Williams is skating on thin ice.

Injuries have plagued the 33-yearold since rupturing his Achilles at the 2016 Olympics but national selectors Steve Hansen, Ian Foster and Grant Fox have retained their faith in him at the expense of others who have shown consistent form.

Hansen is a great believer in experience and with Ma’a Nonu having failed to make the squad and Ryan Crotty out for eight weeks with a hand injury, Williams is his most experienced midfield back.

Unfortunately, given his history over the past four years, he could be a liability rather than an asset.

Other midfielders in the squad include Anton Lienert-Brown, Ngani Laumape and Jack Goodhue while Braydon Ennor can play centre as well as wing and versatile Jodie Barrett can play 12, 13, 14 and 15.

Of the regular midfielders Lienert-Brown has the best off-load and the powerful Laumape is the most prolific try-scorer.

Joining former St Kentigern College student Ennor as new All Blacks are Chiefs flanker Luke Jacobson, flying Crusaders wing Sevu Reece, Highlanders lock/ flanker Jackson Hemopo and firstfive Josh Ioane.

All Black and Blues back Sonny Bill Williams is carrying another injury.

With the 11 Crusaders expected to be rested for the July 20 Buenos Aires test against Argentina, others will have a chance to stake their claims for a regular berth.

With Liam Squire making himself unavailable, competition for his No 6 jersey between Vaea Fifita, Shannon Frizell, Dalton Papalii and Jacobson should be fierce.

Such was the Jaguares overall defence, the Crusaders were confined to just one Codie Taylor try, with Richie Mo’unga scoring the remaining 14 points from a perfect kicking performance.

Teen sailors selected for Blake adventure

Pak Premiers secure win Pakauranga United Rugby Club’s Premiers recorded a solid 33-10 win over Waitemata on Saturday.

hree talented young sailors have been selected to represent their sailing clubs at Blake Inspire for Sailors, a sixday environmental leadership development adventure developed by Blake (formerly the Sir Peter Blake Trust) and Yachting New Zealand.

They are Cameron Evans (Year 11) Howick Sailing Club; Luke Townend (Year 11) Bucklands Beach Yacht Club and Sean Hancock (Year 11) Bucklands Beach Yacht Club.

The programme will run from July 7 to July 12 in Auckland where 30 teenaged sailors from yacht clubs across New Zealand will gather to learn about environmental issues facing New Zealand and the impacts they have on our marine and coastal environments.

Blake Inspire for Sailors enables delegates to come away with enhanced leadership capabilities and strategies to start driving positive change and action within their sailing clubs and communities, the organisation said.
