A young Brimbank migrant who could not afford legal representation was allegedly under pressure to plead guilty to an assault he claimed he didn’t commit. This was despite ‘‘serious’’ flaws in the investigation.

The man represented just one example of the difficulties migrants face getting adequate legal representation, according to a Brimbank Melton Community Legal Centre (BMCLC) report, Justice Out West.

The report, released last week, said ‘Mr A’, who was charged with seven counts of assault, did not qualify for legal aid.

BMCLC lawyers found “significant deficiencies” in the investigation and said an interpreter was not present during Mr A’s police interview. “[Police] failed to obtain CCTV footage that Mr A had referred to in the interview as demonstrating his innocence,” the report stated. “After the first two mentions at court, the prosecution suggested withdrawing six

A Liberian migrant was escorted from a Brimbank used car dealership by police after protesting at the dealership’s refusal to acknowledge a warranty on his car.

BMCLC helped the man lodge a complaint with Consumer Affairs Victoria.

A Vietnamese student was given an inaccurate credit rating over a phone account she never held.

Another migrant learned her insurance provider had not taken “the appropriate steps it was obliged to” after a car smash.

The woman was being pursued for damages, although she had already paid her insurance excess in full.

“It is not uncommon for initially minor credit/debt legal needs of Brimbank community members to quickly develop into substantial legal needs due to insufficient access to the legal system,” the report stated.

It was designed as a grand town, fit for ‘‘good money’’, but suddenly became the suburb nobody wanted.

The rich story of St Albans has been put on paper in Frontier Suburb: A Short History of St Albans by writer and documentary-maker Jeff Maynard.

The book, to be launched today, reveals the suburb came alive only through a sudden influx of post-war migrants.

“Until World War II, most people avoided the area,’’ Mr Maynard (pictured) said. ‘‘Sunshine, Albion and Keilor all grew and developed as suburbs, but St Albans stagnated until the influx of migrants after the war. ‘‘As late as 1950, it had a population of less than 1000 people.’’

Mr Maynard said St Albans was designed

to be a place full of ‘‘gentlemen’s residences’’ in the 1870s. But the Melbourne land crash of the 1890s sent developers broke. ‘‘It reverted to farmland, and not very good farmland at that,” Mr Maynard said. “It was struggling to get going again in the 1920s when factories were expanding in Sunshine and Albion, but the Great Depression brought that development to a halt as well.

Today, it’s a vibrant, multicultural suburb that’s constantly changing and facing new challenges.”

The book, which has been in the works for a year, was funded by a St Albans Community Centre grant.

Brimbank walkers are being urged to help improve the lives of sick kids at Sunshine Hospital. Western Health’s WalkWest will be held along the Maribyrnong River from Footscray Park to Riverside Park on Sunday, April 6. Walkers can tackle a five-, 10- or 15-kilometre course, raising funds to support a $1.1 million refit of the Sunshine children’s ward. The 24-bed ward cares for more than 7300 kids, from toddlers to adolescents, each year. Revised plans for the controversial Cairnlea mixed use precinct, including fewer shops and more houses, are expected to be revealed soon.

The Weekly revealed late last year that Places Victoria had dropped plans for industrial properties as part of the 72-hectare Cairnlea Drive development.

The urban renewal authority now says it could reduce further the size of proposed commercial areas.

Places Victoria is expected to make its final submission to the state government next month.

After meeting on February 7, residents and Places Victoria are united in wanting a commercial zone 1 applied to the mixed use precinct.

“After the meeting, Places Victoria did state that the commercial zone was changing in significant size and there was to be more housing within the new development,” Cairnlea resident Peter Brandecker said.

“Commercial 1 is more of a shop type of business and commercial 2 more of a warehouse style. We are on track and still fighting hard.”

Brimbank council has written to the Planning Minister, requesting a designation of commercial zone 2.

Places Victoria acting chief executive Peter Armstrong said the authority was considering an extension of the residential area further south towards Ballarat Road.

“Places Victoria’s preference is for general residential and commercial 1 zone to be applied to the site,’’ he said. ‘‘This would provide for commercial uses that typically support a residential area, such as services and retail, and would restrict industrial land uses.’’

DEER PARK-calder plans aimed at taming traffic snarls ROADS

A six-lane road could eventually link Melton Highway and the Deer Park bypass, Transport Department documents reveal.

But while the documents – which were tabled at an east-west link planning panel earlier this month – propose the upgrades be completed by 2031, both Public Transport Victoria and VicRoads say there is no guarantee the works will be funded.

A Sunshine filmmaker who once played a surgeon on English soapie East Enders hopes to make the cut at a Yarraville festival with his film on an asylum seeker success story.

Andrew Robb’s Tofu Man, a five-minute film shot on a mobile phone, won the ‘‘Dream Voices’’ award at this month’s Shepparton Short Film Festival.

Robb, who has lived in Sunshine for two years, worked as an actor in the UK on The Basil Brush Show and produced the cult-hit Australian comedy The Vegemite Tales in London’s West End. In keeping with his history of producing quirky films telling simple stories, Tofu Man is up for best director, best cultural diversity, best screenplay and best documentary at this weekend’s Setting Sun Short Film Festival at the Sun Theatre.

The film, Robb’s first documentary, is described as a candid portrait of Vietnamese refugee Duc Nga. Nga came to Australia after being orphaned aged 14. He built a tofu-making business in an old converted milk bar across the road from Robb’s Sunshine home.

“I realised there was more to this story than

Sex shop hold-up man in court A Keilor Downs man, disguised in a woman’s wig and wearing a long trench coat, held a sawn-off rifle to a sex shop worker’s face before demanding the victim open a cash register, a Ballarat court heard last week.

But Justin Nathan Wilson, 22, left the Ballarat sex shop with nothing after the employee produced an iron bar and refused to hand over cash. Wilson pleaded guilty to the attempted robbery. The court heard that he and a co-accused had been coming off heroin when they devised the plan to commit the armed robbery on June 24 last year. Crown prosecutor Tim Hoare said the co-accused put fake number plates on his car and provided Wilson with the wig, trench coat and sawn-off .22 calibre rifle before

the pair drove to the shop about 9.45pm.

Mr Hoare said Wilson cocked the rifle while holding it on the employee, “making it go ‘click’.” The co-accused is expected to plead guilty in the Melbourne County Court next week. Judge Michael McInerney adjourned Wilson’s matters until June 11 in order for a pre-sentence report to be completed. \

It is possible that the half of the site that’s zoned residential could be rezoned for high-rise apartments, given that it sits in Sunshine’s centre. Brimbank council’s own parks planning showed that Sunshine needed a large, landmark community park. The council’s community consultation also showed residents did not want half a park.

There’s a clear link between the lack of open space for active and passive recreation and the poor health of our community, with spiralling type 2 diabetes, obesity and social isolation. My shout to mislead readers of this paper with alarmist claims on Victoria’s economy (Letters, March 4).

The facts are that since December 2010, Victorian employment has grown by 64,200 workers. In western Melbourne, employment has grown by 7.2 per cent in that time, slightly more than 23,000 people.

This encouraging growth in employment has not happened by accident.

The state government is working hard to encourage business and employment. Since December 2010, we have facilitated more than $7.4 billion in new projects which are creating more than 15,000 jobs.

Maintaining a strong budget position has allowed us to make investments that will serve western Melbourne for generations.

These include infrastructure improvements that generated thousands of jobs and boosted the local economy, such as the $4.8 billion Regional Rail Link and the $505 million Western Highway duplication. The government has invested $11.5 million for a

primary school at Melton North West and upgraded the Ferris Road interchange.

And we are ensuring young Victorians have the skills they need to secure sustainable jobs.

Victoria invests more in vocational training than any other state, with a record $1.2 billion provided in 2012-13. Our reforms mean that the vocational training sector is not only financially sustainable, it is training students to work in industries where there are genuine skill shortages.

There is a misguided campaign to cap council rates to the rate of inflation. This would be a disaster for our communities, especially when state and federal governments are cutting social services because they’re too gutless to increase taxes.

Councils need to set their rates based on community needs.

We can’t, on one hand, demand rate rises be limited to CPI while expecting councils to continue to maintain infrastructure and provide social services.

So-called “greedy” councils have had to take over community services from Spring Street, while accounting for the state government’s hefty landfill tax, and ensuring they can cover entitlements of all council employees. Setting rates needs a horses-for-courses approach, particularly for those councils with few alternative revenue streams. eing the one in the family who knows about cars has its drawbacks. Like the time I was asked to fit a child seat.

I read the instructions. I followed the directions. For two hours I struggled. It just wouldn’t get in there tight enough to make me happy. I gave up and called a Kidsafe installer.

She looked at my work, shook her head sadly and said “Nup. Hardly anyone gets it right”.

But she said it nicely.

Fifteen minutes later, there it was. I realised later that, even if I had managed to fit it correctly, I wouldn’t have known.

In the US, they have frightening data on this business. Three in four child seats over there are fitted incorrectly; more than a third of children under 13 who are killed in car accidents are incorrectly restrained.

The local data is equally scary. Research suggests children who are not restrained correctly are up to seven times more likely to be seriously injured in a car accident. On an average day in New South Wales, 11 people are fined for having an incorrectly fitted seat or for having kids not properly restrained.

Incorrect fitting attracts a fine of $317 and three demerit points in Victoria, and you’d most likely be pinged after a smash.

One reason seats are incorrectly fitted is that it sometimes requires a lot of strength.

Another is that although restraint anchor points have been standardised by car manufacturers, there’s no standardisation in the child seats themselves – so what works

for one may not work for another. It’s a point sometimes criticised by car makers.

Seat manufacturers have views about car makers too, especially regarding inflatable seatbelts. These are a relatively recent idea; belts that inflate on impact, providing cushioning between the wearer and the webbing to reduce injury and especially don’t webbing burn. But they pose all sorts install of problems for child-seat makers, to child seats the point where some recommend yourself against buying cars with them fitted in the rear seats.

It’s illegal, but it’s not unknown for people in a hurry to fit child seats using only the seatbelts, and not the car’s restraint anchors. Do this and you’re asking for trouble.

Child seats fitted this way can have significant forward travel in a big hit, enough that the kid’s head impacts the seat in front.

Professional installers can advise on when it’s best for your kid to go from rear facing to forward facing, and then to a booster.

Kealba-Green Gully’s bid for a North West Metropolitan Cricket Association Luscombe Shield three-peat fell short at the final hurdle.

The Cougars got a dose of their own medicine in a 127-run grand final defeat to Pascoe Vale Central at Jack Ginifer Reserve.

It was sweet revenge for Central, after losing to the Cougars in the two previous grand finals. On both of those occasions, the Cougars won after compiling small totals, but it didn’t work out this time.

They were set a massive target of 283 for victory but were all out for 155.

Jarrod Catania was the pick of the Cougars bowlers with 5/83, while Tristan Krizanic had a strong all-round game with 40 and 2/45.

Meanwhile, grand finals in the VTCA were set to go down to the wire at the weekend, finishing after the Weekly went to press.

In north A1, Sunshine Druids (223 and 7/60), led by Leigh Wilson’s 115, got the job done in the first innings against Seddon (144).

But the trailing side opted to play on into Sunday in the hope of an unlikely fightback.

The new-look Western Jets on-ball brigade was dealt a harsh lesson by arch-rival Calder Cannons with a 40-point flogging in the opening round of the TAC Cup at Highgate Recreation Reserve on Saturday morning.

The bulk of the Jets who ran through the midfield were familiar faces but had little experience at the coal face.

Jets coach Torin Baker wasted no time sifting through the match footage to come up with answers for players who he wants to fast-track into their new positions.

“We have a new on-ball group that haven’t played on the ball a lot in the TAC Cup because our top age group from last year were our stock onballers,” he told the Weekly.

“Most of them are new in the role, but they have to learn and quickly.

“I’ve identified some things they can work on – not talent wise, just positioning – and I’m sure they’ll get better for it.”

Corey Ellis was the exception to the rule for the Jets. He was switched into the centre in the second half and did a lot of the grunt work, while also hurting the opposition with his run and carry and exquisite foot skills.

“He was hard at the contest, really cracked in,” Baker said. “He’s also got sublime foot skills and gave us some good ball use.”

The Jets were behind on the scoreboard from the get-go as the Cannons made full use of the breeze to lead by 23 points at quarter-time.

A flurry of wasted attacking opportunities in the second quarter term consigned the Jets to a game of catch-up football.

They took the wrong option on numerous occasions, be it playing on and getting tackled or fluffing a short pass when using the wind might have been a wiser choice.

The Thunder came back from a four-point three-quarter time deficit to beat the Sharks 76-74 on the back of two late trips to the free-throw line by Kristen Mavor.

Mavor was fouled twice in the last 14 seconds, earning two shots on each occasion and draining one from two both times to give the Thunder the two-point break.

It was a pressure situation for Mavor, who had missed her previous four free throws, but she put it out of her mind to come up big for her side.

Mavor had a tidy all-round game, finishing with eight points, six rebounds and four assists.

But in an even performance from the Thunder, it was captain Jessica Francke who stood head and shoulders above.

She finished with 19 points, six rebounds and four assists to be the most valuable player on her side.

Aside from the skipper, the numbers were evenly spread across the board, with players one though 10 figuring in at least 10 minutes of action.

A nice start for the Thunder, who improved to 2-0, but their credentials will be serious tested when title favourites Geelong Supercats (2-0) visit Keilor Basketball Stadium on Sunday afternoon. \ LJ

“Ultimately, we should’ve been much closer at half time,” Baker said.

“Not pegging back that difference in the second quarter made it really hard to win once they kicked a couple more in the third quarter and it got out to a six-goal margin.

“We rued the opportunities we missed.”

Connor Menadue was one of the standouts for the Jets in the practice matches and he carried his form into the first home-and-away match, while Mitch Norton excelled in a variety of roles and Liam Carter was solid down back.

Brenton Payne only made a handful of appearances in Jets colours last season, but with three goals and commanding performance in attack, he could become permanent this winter.

“He’s a tall, hard-working, hard-leading quick forward,” Baker said.

“He really leads up well at the footy.”
