Enacting the law by crimi nalising marital rape would give women a basic human right, a sense of security against the most horrible crime that can happen within a marriage. Unfortunately, when sexual experience involves force, coercion or violence against one spouse, it can lead to devastating results to the union, and the victim. Whether we admit it or not we do have a rape cul ture in this country.

I WRITE in response to the fatal shark attack of a female American tour ist in waters off Green Cay, also as a descendant of Lowe Sound, Andros, Bahamas. While growing up in this small farming-fishing community, nestled by the sea...as children and all of the various residents were family.Much of our time was spent among school life, tending the fields, fishing and boat building. It was also customary for us to pursue sharks that would come in near the shores and these were of all sizes and breeds. The weapons for defending ourselves were homemade wooden poles and a length of 1/4 inch steel that was bent to form the pickup-end-ofa-fork...four holes were placed at intervals on the pole and the temper steelrod was threaded through the last holes on the staff and then bent the width of the pole. To fasten the rod in place we either used carpentry nails to fasten it, or strips of electrical wires secured it...the ends of steel rods were sharpenedto desired point, and each rod received a beard cut out into the steel that had the affect to hold the catch inplace...final product a pick

The truth is that sexual expression was designed by God to be an act of love within a marriage, and vio lence or coercion should never be a part of it. Forced sex is not love; it is the opposite. The Bible is clear: “Husbands, love your wives and do not be harsh with them.” (Colossians 3:19). The scripture can either repair or destruct. It can be an effec tive weapon for personal and spiritual battles, however, if the Bible is misused, just like a sword that is handled care lessly, it can cause danger and conflict. As believers we must not misuse scriptures to manipulate, condemn, judge and mislead others.

There is an effort afoot to find a vessel since the bridge is a far more expen sive investment. Whether it can even be repaired or must be replaced is an open question. For a government to condemn a structure, especially this government that does not do so unless human life is endangered, it takes a lot. But it only takes one look at the underbelly and the side of the bridge to agree with the decision. Looking at it makes you queasy.Rebar hangs out una shamed of its protrusions.

So here we stand, on the precipice of a new school term with 45 young people who want a future at sea or connected to the maritime world, willing to give their all for courses that range up to 39 months, parents who are willing to sacrifice so their son or daughter can get the nautical orientation, experience and education they need, and they will stand there in a few days and look at the buildings and grounds and not be able to get there.

The lack of a bridge or a means to the future is not just a mystery, it’s incred ibly wrong. LJM is not just for students who want a career at sea whether cruise, cargo, merchant ship or other or a job in one of those industries. The acad emy works with the Royal Bahamas Defense Force. It

Parts of the old bridge that must at one time have been attached to something now float loosely, so discon nected that if innate pieces could fly, these just might flap their wings.

The point is this. If a man cannot beat his wife without being punished by the law, in fact punishable by up to 15 years in prison, how is it he can rape her? Sexual assault is assault. The prime minister recognises it as a crime. Rape is rape, he said bravely. If you saw a woman being assaulted by a man in public, you would do eve rything in your power to stop it or call for help to stop it. So why would we, as a country, condone rape in a marriage and not con done a good beating? If a man has a right to his wife’s body whether she wants him at that moment or not, he might as well have all rights to it, put his burning cigarette out on her arm or break her little finger for kicks.Sound preposterous? Of course. Just as preposterous as being able to rape her without paying the price.

THE discussion around marital rape – whether it exists under the law or not – has divided the country one more time. But the divisiveness, it seems to me, while focused on the rights of a man to a woman’s body when he slips a ring on her finger misses the point.

When it came to late mort gage payments, RBC and its BISX-listed home financing arm, FINCO, again led the way with a 5 percent levy or minimum of $100. And the Court of Appeal also found that the investigation into the dis appearance of the 41-foot Luhrs motor yacht “appears flawed”, as its owners - the Modronos - were not all probed on whether they had removed the Rum N’ Coke or instructed anyone else to do so.

And the Court of Appeal added: “As a side note, Lazaro did not interview two of the purported opera tors of the vessel, nor did he himself obtain photo graphs of the men, nor of the two men who were said to have accompanied Tony to Bimini, and show them to O’Neil.“Moreover, it does not appear that, although Tony had photographs of the four operators on his computer when he went to meet with O’Neil, he actually showed

them to O’Neil. Addition ally, six of the individuals said to have been with the vessel in Santa Domingo, following the theft of the vessel, had business addresses in the area where Mr Modrono lived in Florida.”TheCourt of Appeal ultimately decided in RAV Bahamas’ favour, and over turned the Supreme Court’s verdict that it was guilty of negligence, based on para graph 17 in the boat slip lease agreement’s fourth schedule. This stated: “The tenant is responsible for proper operation and moor ing, and taking all necessary precautions to ensure that the boat is secure from damage from any and all causes including - without limitation - theft, fire, van dalism and storm.”

“The caller directed O’Neil as to how he was to perform the tasks. He told O’Neil to go on board the boat, to look in the top left corner for the breaker box and switch on the break ers for the air conditioning and the water pump. He told O’Neil to let the water pump run overnight and then shut it off, but he was to make sure the air condi tioner cools before leaving the“Thevessel.caller also asked O’Neil to have the water line of the vessel cleaned. The person said the vessel was moored at Dolphin 16 and was unlocked. A price for the service O’Neil was to perform was negotiated and he was to be paid when the captain came to take the vessel.”The judgment contin ued: “O’Neil did as he was requested, having met the vessel unlocked,

“O’Neil explained that he did not suspect the speaker on the telephone was not who he said he was because the man knew so many details about the vessel. O’Neil was off from work on the day that the men came and took the vessel, but he had gone to the marina to collect the money owed to him.”

it sank in that the boat really was stolen, with the theft going undetected until the Modronos made a complaint.*TheCourt of Appeal verdict also questioned why Great Lakes Reinsurance, the vessel’s insurer, would make a full claims payout at a time when the theft inves tigation remained active and had not eliminated the possibility of insurance fraud by the Modronos.

The judgment also noted that:* O’Neil Rolle, the porter/dock hand who prepared the vessel for departure prior to its August 2009 theft, said he received his instructions via phone from a 305 Miami area code. Appeal justice Isaacs said it was “curious” that a search of Mr Rolle’s phone revealed that, at the relevant time, he instead received eight calls from a 954 area code, which is for the Fort Lauderdale/Bro ward County area.

Detailing the background to the dispute, the Court of Appeal said the Rum N’Coke was owned by a corporate entity known as Modrono’s Bimini Place LLC (MBP). Manuel Modrono Jnr, an owner and officer of the company, together with his father, also named Manuel, purchased the vessel but monthly pay ments to cover its expenses were also made by the son’s cousin, Tony, and another man, James Begera.

As a result, RAV Baha mas argued that it “owed no duty of care” to the Modronos and that it was the latter who had primary responsibility to secure the vessel from theft. It suc cessfully asserted that this lease clause absolved it of all responsibility, and added that “the owners were con tributorily negligent at the very least because they did not secure the vessel by locking it since the employee of the marina would not have been able to ready the vessel for sailing had the cabin been locked”.

reasonable” to place the onus for theft prevention on Bimini Bay’s first developer.

“One may ask why would a theft claim be paid if there was an ongoing fraud investigation which could possibly conclude that there was complicity of the owners in the alleged theft?” the Court of Appeal asked. It also noted other potential inconsistencies and“Curiously, coincidences. although O’Neil claimed that the number the caller used had a 305 area code, his phone records revealed some eight phone calls during the relevant period from a tel ephone number with a 954 area code, a US area code,” the judgment noted.

and two days later he met two men, one of whom he assumed was the captain. The captain searched for the cruising permit on the vessel and located it. The man then paid O’Neil $400 cash, $180 of which was paid to the young man who had cleaned the waterline.

However, the Court of Appeal noted that nowchief justice Winder did not

“The telephone number belonged to a corporation called Air and Sea Group, and may have been con nected to an individual named Fabian Pesantes, who Lazaro reported ‘was a person of interest involved in a previous Osprey claim’. That may be taken to mean Pesantes was a suspect in the earlier theft of a boat.”

The number belonged to a company called Air and Sea Group, which the judg ment said was connected to a person potentially sus pected of being involved in a previous boat theft.

The Court of Appeal backed the arguments over paragraph 17, finding that it made the vessel’s owners primarily responsible for securing it. And there was no evidence to support the Supreme Court’s “finding of systemic failures to provide adequate security”.

left the same day, adding that he locked the Rum N’ Coke but did not know if anyone else had a key.

“Sometime around July 18, 2009, O’Neil Rolle received a telephone call from a 305 area code number,” the Court of Appeal ruling recorded.

Besides acquiring resi dential units at Bimini Bay, the Modronos entered into an agreement to lease a 54-foot boat slip at the development for $200,000. The Rum N’ Coke travelled to The Bahamas on June 9, 2009, under the charge of Tony, Norberto Albalat and two of their friends, with the necessary cruising permit obtained from the Bahamian authorities.

The Rum N’ Coke was subsequently taken by the men and has never been recovered. Alphonso Lazaro, of Nautilus Inves tigations, who was hired to probe the theft, ultimately tracked it to Venezuela fol lowing stops that it made in Long Island, Turks and Caicos, the Dominican Republic, St. Croix, St. Kitts and Guadeloupe.

The investigation ulti mately concluded that none of the vessel’s owners were involved in the theft. Great Lakes, as a result, paid out the insurance claim and took their place by initi ating legal action against RAV Bahamas, as Bimini Bay’s then-majority owner, to recover the $579,721 claims payout and $18,545 investigation costs.

The first, and most important, question to be answered is whether the business can and should be continued. Many businesses, especially service-oriented ones such as a professional practice, cannot realistically be saved because its success was based almost entirely on the deceased owner’s efforts. In a medical prac tice, for example, patients will immediately go to other physicians, making continuity difficult. Unless a successor is equipped to step in immediately upon the owner’s death, there is likely no one at the ready to take over.
