COUNTY Jesse Garcia Unanimously Re-elected as Suffolk County Republican Chairman

Committee Cites Numerous GOP Victories at Federal, State, County and Local Level Under His Leadership

Suffolk Republican Chairman Jesse Garcia was unanimously re-elected to lead the County GOP Committee at a convention held in Bay Shore on September 20. Garcia has served as Suffolk Republican Chairman since April of 2019, and Brookhaven

GOP Leader since March, 2007.

“I am humbled and honored to receive the support of all 10 Town committees to serve as Suffolk County Chairman,” said Garcia, who was nominated tor re-election by Brookhaven Town Supervisor Ed Romaine. “Over the past three years we have acheived great things together. Through the hard work of this committee, we took back control of the Suffolk County legislature

for the first time in 16 years and elected Ray Tierney as our first Republican District Attorney in 20 years. I’m proud of all that we have accomplished together.”

Over the past three years under Garcia’s leadership, Suffolk Republicans have won critical victories at the federal, state, county and local level. Republicans have scored victories over a number of incumbent Democrats, including the defeat of Democratic County Presiding Officer Robert Calarco and NYS Senator Monica Martinez.

This year, the Suffolk GOP under Garcia’s leadership went 5-for-5 in fending off challenges by insurgents and outside special interest groups in Republican Primaries. Now, Garcia said, the party is focused on the elections this November.

“The fiscal mismanagement of Democrats in Albany and Washington, their dangerous pro-criminal agenda and support of open borders have put our future at risk. We

have important work to do. We need to elect Lee Zeldin as our Governor and support his rescue plan for New York. We need Nick LaLota and Andrew Garbarino to continue to fight for us in Washington, and we need to begin the work now

to elect a Republican County Executive,” he said. “None of this will be easy – but I know that working together with our Republican committee members and town chairs, we are more than up to the task.”

South Country Appoints New Supervisor of Operations and Maintenance

South Country Student-Musicians Named to All-State

Four Bellport High School students have been selected to perform in the All-State Festival of the 2022 New York State School Music Association Winter Conference.

The South Country Central School District Board of Education appointed Frank Pirro as its new supervisor of operations and maintenance, effective Oct. 11, during their Sept. 14 meeting.

“We are excited to welcome Mr. Pirro,” said Superintendent of Schools Antonio Santana. “He joins us with a wealth of experience, and we are certain he will take great care of our buildings and facilities.”

Since 2021, Pirro, of Center Moriches, has served as lead maintenance mechanic IV in the South Huntington School District. In that position, he supervised

the district’s maintenance staff and coordinated with the director of facilities and district architect regarding capital projects. He took on that role after working as a maintenance mechanic in the same district from 2017 to 2021. Previously, he was an electrician and project leader at Brookhaven National Laboratory for experimental projects.

Pirro is currently working to obtain his school facilities management certificate from Mohawk Valley Community College. He received his training from the IBEW Local 25 National Joint Apprenticeship.

The students were selected after receiving perfect scores from state adjudicators on their solo performances at last spring’s NYSSMA Solo Evaluation Festival. They are among only 565 students selected for the state conference out of over 4,300 auditions. South Country had 17 high school students audition for All-State last spring.

William Floyd High School Student & NYS Youth Governor Named Vice Chair of National Youth Organization

This past June, Jae Kim, the now William Floyd High School senior elected as the 2022-23 YMCA Youth and Government program’s youth governor by his peers across the state, was named the vice chair of the National Youth Governors Association (YGA) during their annual conference held in Washington D.C. Kim also met Douglas Emhoff, the second gentleman of the United States and spouse of Vice President Kamala Harris, at the Youth Governors Conference.

While representing New York at the YGA conference in his capacity as youth governor, Kim and his peers shared the different lifestyles and experiences in their home states, and highlighted the differences in how each state operates. “As leaders, it is crucial for us to gain these perspectives as they allow us to connect better with our delegation and become more understanding,” said Kim.

Now as vice chair of the YGA, Kim’s peers are entrusting him to represent their missions; work with the Youth Governors Association chair to organize national meetings; address any concerns that a state may have and help coordinate all national events and partnerships.

“This is a role that is crucial to the operation of the YGA and one that I highly regard,” said Kim.

As vice chair, he will also provide direct lines of communication between 47 different member states, and co-chair all of the YGA meetings. He is also responsible for addressing any concerns that may arise between any of the youth governors.

As NYS youth governor, Kim oversees the entire state Youth and Government program from a student perspective, coordinates different projects and establishes direct lines of communication between different districts throughout the state while promoting greater youth involvement and understanding

of state government. Kim believes his number one priority is to help the hundreds of delegates in the state reach their fullest potential.

“During my election, I made several promises to bridge the existing gaps between different areas of New York and the different branches of the program, assist any delegate, and provide them with any resources that they may need. I am making it my mission to make sure I uphold every promise I made,” Kim said.

Kim’s experience with the New York State Youth and Government program, including his role as the youth governor, as well as earning

the “Best Bill” award in March 2022, and the “Outstanding Debater” award in March 2021, has helped prepare him for this new level of responsibility and leadership. He also earned an invitation to the prestigious Conference on National Affairs, the federal equivalent of the state Youth and Government program, held each summer in Black Mountain, North Carolina.

Kim worked hard over the summer on several projects that will positively impact his community. Currently, he is focused on expanding the Youth and Government program across Long Island and the entire state. He has been in contact with several liaisons and is planning on filming a series of videos explaining to interested students what Youth and Government is, the resources that are necessary and to demonstrate how students can participate no matter where they reside.

Kim is also planning to host a movie night - both locally and across the state – showcasing the new film, The Youth Governor, a documentary-style movie based on California’s YMCA Youth and Government program and the journey of candidates running for youth governor. According to Kim, the film follows their journey and highlights how they learn more about their own beliefs

and the issues that exist within society, helping them to learn what it takes to be true leaders.

At William Floyd, Kim, in addition to his service with Youth and Government, is a member of the William Floyd High School Senior Class Council, National Honor Society, and the varsity golf and tennis teams. He was elected to serve as the student body president for this school year. In his role as student body president, Kim plans on setting up stations around William Floyd High School where students can submit ideas to make their experiences at William Floyd High School even better.

Kim plans on attending college after graduation to major in and pursue a career in public policy and government. He hopes to secure an internship that will allow him to continue to learn and grow in the field. He credits his desire to continue to help as many people as possible as his main objective in finding the right career path.

In the 38 years of this program’s existence at William Floyd High School, many Youth and Government alumni have had successful careers in business, finance, law and government and Jae Kim is well on his way to achieving great things.

Knights of Columbus BBQ

The JV Knights of Columbus Council had a fabulous turnout Sunday at its annual barbecue in Mastic. The neighborhood was invited to join in with council members and local elected officials to enjoy good food on a warm September afternoon. “It was nice to see the community come together and we were glad to host this great event for our friends and neighbors,” said Deputy Grand Knight Frank DeNatale, who thanked the event’s many sponsors including the South Shore Press.

With Election Day coming in November, area representatives were eager to chat with their constituents, including Assemblyman Joe DeStefano and Congressman Andrew Garbarino. Former Assemblyman Dean Murray, now running for the state senate, also attended along with District Court Judge Edward Hennessey, a long-time Bay Area resident.

Bellport High School Senior Earns Perfect Score on AP Research Exam

Bellport High School senior Rachel Li has much to celebrate. She is among just 1.14% of AP Research exam takers from around the world to earn a perfect score.

To earn the score, Li was required to submit a collegelevel research paper that she penned following a year’s worth of research while enrolled in her school’s AP Research class. Her paper explores New York City’s specialized schools and the stereotypes associated with them, as well as the history and discussions surrounding those stereotypes, specifically those related to Asian Americans.

“I wasn’t expecting it,” Li said of her perfect score. “I wasn’t even thinking about the score when working on my paper.” She urged her fellow students to enroll in the AP Research course. “I learned a lot about myself and my work habits. My teachers and classmates were very supportive.”

Li is an exceptional

academic. She is a member of her school’s National Honor Society, is an AP Scholar with Distinction and recently earned an AP Capstone Seminar and Research certificate. She is expected to graduate with an AP Capstone Diploma designation in June.

Tribute Paid to Gold Star Families at Special Ceremony

The Annual Gold Star Families Recognition Ceremony was held Sunday in honor of those who made the ultimate sacrifice for our country and their families.

Among the monuments at Bartlett Pond Park in Middle Island, were elected officials, family and friends who made tributes to the fallen.

“It doesn’t seem like a year ago that we were last here paying tribute to the Gold Star Families

and remembering the heroes who gave everything so we could live free,” said Assemblyman Joe DeStefano, who attended the event with Assemblywoman Jodi Giglio and Dean Murray, a former state legislator.

“It was a beautiful day last year just like today and it was gorgeous the year before that if I remember correctly,” DeStefano told the crowd which included Middle Island Fire Department members, local Boy Scouts and Gail Lynch Bailey, of the Longwood Alliance and the Middle Island Civic Association, who organized the event.

“Of all the events I attend, this is one of my favorites,” DeStefano continued. “The setting is stunning. Every conflict involving our nation’s brave men and women is represented here. This memorial park inspires awe and thankfulness, devotion and appreciation.”

HIA-LI Recognizes Outstanding Long Island Firms for Leadership, Performance, and Commitment to the Community

‘Business Achievement Awards’ Honor The Region’s Exemplary Businesses

HIA-LI, one of Long Island’s largest business associations, honored four of the region’s most outstanding businesses at the organization’s 28th Annual HIA-LI Business Achievement Awards ceremony held September 20 at the Crest Hollow Country Club in Woodbury.

An award selection committee evaluated competing firms and organizations based upon such factors as corporate accomplishments, exemplary employee relations, and commitment to the overall Long Island community and beyond.

“It’s critically important to recognize and celebrate excellence and achievement within our business community,” said Terri AlessiMiceli, President and CEO of HIA-LI. “Our honorees serve as inspiring examples of innovation, dedication, and accomplishment. They are true role models for all Long Islanders.”

“We’ve come together at this award ceremony to celebrate our love of Long Island and our desire to see our region prosper

and grow,” said Rich Humann, Board Chair of HIA-LI as well as President and CEO of H2M Architects and Engineers. “We should all take pride in our honorees’ accomplishments, their strength, and their spirit.”

HIA-LI presented awards in the following categories:

The honoree in the “Large Business” category, comprising firms with a workforce of 100 or more, was Jerichobased Engel Burman, a fully integrated real estate company with an expansive portfolio including residential, commercial, senior living, and healthcare. The award was presented to company president Jan Burman.

Other finalists in the “Large Business” category included Citrin Cooperman, based in Melville; PSEG Long Island, based in Uniondale; LNK International, based in Hauppauge; and Little Angels Center based in Blue Point.

The second award category consisted of “Small Businesses” employing fewer than 100 workers. The award went to Hauppauge-based National Business Capital, a firm that helps entrepreneurs secure quick and fair financing to save time and cultivate sustainable growth. The award was presented to CEO and Founder

Community Presentation to be Held on Capital Reserve Vote

South Country Central School District Board of Education invites the community to attend a presentation regarding the district’s upcoming capital reserve vote on Wednesday, Oct. 12, at 7:30 p.m., at the District office, 189 Dunton Ave., East Patchogue.

The vote, which is scheduled for Tuesday, Oct. 18, requires approval by South Country School District voters for use of the district's capital reserve fund, which was established by voter approval in May 2016. Proposed projects include security upgrades to camera

and door access systems districtwide, replacement of handrails and interior doors at the high school, and replacement of the turf field (not the football field), which is near the end of its useful life. Paying for these projects through the capital reserve means there will be no cost to taxpayers and the district will receive reimbursement from New York State in the form of building aid for a portion of the project costs.

The vote will be held via paper ballot on Oct. 18, from 7 a.m. to 9 p.m., in the Bellport Middle School gymnasium.

Joe Camberato.

In the “Small Business” category, other finalists included Garden City-based Allied Risk Management; East Meadow-based Creative Plan Designs Ltd.; Copiague-based Electrical Training Center; and National EAP, based in Hauppauge.

A third HIA-LI Business Achievement Award was also presented to a “Rookie of the

Year” honoree representing firms in operation less than five years. The 2022 award was given to Long Beach-based Trellus, an innovative same-day local delivery service serving Long Island and Eastern Queens. Accepting the award was company co-founder and CEO Adam Haber. Joining Haber were co-founders Brian Berkery, the COO, and J.R. Jensen, the CTO.

There were three additional “Rookie of the Year” finalists: Pupfish Sustainability Solutions, based in Hauppauge; Lety Algeri Coaching, based in Holtsville; and Lake Ronkonkoma-based Lucidi Technical Solutions LLP.

In the fourth and final “Not-for-Profit” category, the recipient was West Babylon-based Winters Center for Autism, which works to enhance the lives of adults with autism through job creation, training, and placement. Executive Director Christine Ponzio accepted the award along with Michele Winters, the Founder of the Center. They were followed by Christopher Cortale, a selfadvocate for adults with autism, who delivered a poignant firstperson testimonial.

“Not-for-Profit” finalists included Blue Umbrella Experience, Inc., based in Hauppauge; Family Service League, based in Huntington; CN Guidance and Counseling based in Hicksville; Gurwin Healthcare System based in Commack; and EPIC Long Island, based in East Meadow.

Nearly 300 people were in attendance at the gala event, which was held at the Crest Hollow Country Club in Woodbury.

TOWN

On Thursday night, the Brookhaven Town Board will hold a public hearing on a proposed map for boundaries of all council districts for the next decade. We support the adoption of this map, and urge the Town Board to vote yes on this proposal. This map makes minimal changes, affecting less than 10 percent of the Town’s residents, but makes important corrections where they are needed.

After a vigorous and transparent process, where more than a dozen public hearings were held in each council district, hundreds of residents offered their thoughts and suggestions as to what their districts should look like. Major boundary changes were rejected, and most sought to keep their neighborhoods, school districts and communities together under the representation of a single elected official. This map does just that.

Unlike the newly adopted congressional maps, which split the Town of Brookhaven for the first time in this nation’s history, the proposed maps

attempt to unite previously split communities.

Where 13 communities had previously been split between council districts, there are now only 10, and the number of school districts that had been split in the past drops from nine to four.

In our area, the South Country School District is unified in Council District Four, where previously more than a quarter of the district had been in Council District Five. This has come up numerous times in over the past year during debate over major projects affecting the community.

The map also puts 100% of North Bellport within the Fourth District for the first time since council districts were first enacted in the Town. Gordon Heights remains in this district as well, resulting in an increase in the minority population in the area and no statistical change among those of voting age.

Just as important as what this map contains is what it does not have – blatant gerrymandering. Unlike maps

that were originally put forward by the Suffolk County and New York State Legislatures, this map does not put sitting legislators together in new districts to force primaries or retirements, nor is it gerrymandered to benefit the party in power by diluting districts of members in the minority party. The map embraces the concept of least change, as was repeatedly recommended by residents attending public hearings.

This map complies with federal, state and local requirements, with less than five percent population deviation between districts. It satisfies the town code requirements to have substantially equal populations; be convenient, contiguous and compact; maintain hamlets within a single council district where possible, and where not possible have them split into the fewest districts; and to have clear and readily identifiable boundaries.

Because of this, we urge the Town Board to vote in favor of this new map and adopt these new district lines immediately.

“The water is coming—there’s no longer much doubt about that,” began an article in The Washington Post this month. A just-issued analysis, it reported, done by Climate Central, a Princeton, New Jersey-based non-profit research group, determined that “hundreds of thousands of homes….and other properties” would “slip below swelling tide lines over the next few decades.”

That increased sea level rise is already happening.

And, the Climate Central researchers found, said The Post, that “nearly 650,000 individual, privately-owned parcels across as many as 4.4 million acres of land” along the coastlines of the United States “are projected to fall below changing tidal boundaries by 2050. The land affected could swell to 9.1 million acres by 2100.”

Long Island will be among the areas heavily affected. Indeed, the East Hampton Town Board this month, in a unanimous vote, approved a Coastal Assessment Resilience Plan (CARP), “in recognition of the need for proactive planning to address its vulnerabilities to sea level rise, shoreline erosion and flooding.”

CARP, an analysis put together over two years, flatly warned that

the projected range of sea level rise “will transform East Hampton into a series of islands with permanent submergence of low-lying areas as early as 2070.”

It says: “Rising sea levels and increased intensity of coastal storms undoubtedly will have an impact on nearshore homes and communities.”

CARP proposes a “retreat” of waterfront development away from the shoreline.

And that is a breakthrough for this area.

Perhaps “retreat” isn’t the best word to use. In a prescient talk in Quogue in 2013, titled “Alternatives for Protecting Our Dunes and Beaches,” Dr. Robert Young, director of the Program for the Study of Developed Shorelines at Western Carolina University and co-author of the then recently published book, The Rising Sea, said “I don’t say ‘retreat’ anymore.” That’s because Americans, he said, don’t like to talk about retreating. Said Young: “No, we say relocate.”

Whether it’s called “retreat” or “relocate”—that is what is needed in the face of rising seas largely caused by melting glaciers caused by global warming.

Still, despite the realism out of East Hampton, all over Long Island,

"The Water is Coming" -on Sea Level Rise

section” of recent climate legislation passed by Congress and signed into law by President Biden marks “a shift by the federal government toward funding nature-based climate solutions.” It said: “Escalating climate threats have prompted a continuing debate among policymakers and experts how best to guard against devastating damage, between those who prioritize building manmade infrastructure like sea walls—sometimes called “gray infrastructure”—and those who favor nature-based solutions, or socalled green infrastructure.”

says Kevin McAllister, founder and president of the Sag Harbor-based organization Defend H20, in an effort to ostensibly protect houses built along coasts, what’s now happening is a “rapid transformation of natural shorelines” with the placement of steel and vinyl bulkheads, geotextile sandbags and giant boulders.”

This effort at “armoring” shorelines, says McAllister, “if left unchecked will erase walkable beaches and critical shoreline habit”—and also lead to more coastal erosion as armoring, in fact, ends up accelerating coastal erosion.

In a number of states, the folly of coastal armoring is being

recognized. Stateline, the web publication of Pew Charitable Trusts, published an article last year about Virginia and Washington having “recently enacted laws to discourage armoring structures and promote ‘living’ shorelines which use natural elements to slow erosion and maintain habitats.”

Stateline said “seawalls and bulkheads…known collectively as shoreline armoring, can block the natural flow of sand and sediment down the coast and multiply the forces of waves onto nearby shoreline—accelerating erosion elsewhere.”

The New York Times last week reported on how “a little-noticed

Long Island is far from alone. A headline this month in USA Today: “Oceans rise, houses fall. The California beach home is turning into a nightmare.” Its story said: “Tens of thousands of people who live along California’s coast may be forced to flee in coming decades as climate change leads to rising seas and makes swaths of the state’s iconic coast uninhabitable.”

Harmonizing with nature and relocating structures built in the teeth of the sea, both are essential as seas rise. Still, the New York State Department of Environmental Conservation is allowing armoring all over Long Island with “permissive permitting,” says McAllister. And many local boards, he says, aren’t doing much better.

SHORT STACKS FOR A TALL CAUSE

When Garrett Wilson's name was called last April during the NFL draft, many evaluators said that Wilson had the most upside of any receiver, even any player, in the entire draft. That is not praise that the New York Jets, or more specifically, the New York Jets draft picks are used to getting from the media and scouts. After all, this is an organization that selected the likes of Sam Darnold, Darron Lee, Quinton Coples, Vernon Gholston, Kyle Brady, Blair Thomas, and the list can go on. But, with Wilson there was a different feel and certainly a different reaction.

The early returns on Wilson are of not just a solid

first round pick, but of a true superstar in the making. Just in the past week we have heard national analysts and players compare Wilson's explosiveness to Justin Jefferson and Ja'Marr Chase. They believe he has game changing qualities and in the most unlikely of scenarios it has been Joe Flacco to bring those out early on.

Wilson is a prototypical wide receiver one. He has the size and strength, plus the leaping ability to get to every ball. The difference between good and superstar though is his route running, which has been applauded by the coaches and beat reporters all through camp. There is another factor

There are always football players who drop into the taxi rounds of a fantasy football draft. I have always felt that the team that cleans up in the taxi rounds of a fantasy football draft become prime contenders for the title in a given season. One of the guys who dropped in one of my drafts this fall was Amari Cooper in his first season out of Dallas. A 2015 1st round draft pick of the then Oakland Raiders, Cooper has always enticed as a large framed and rugged wide receiver. And so in 2022 at age 28 he is with his third team in the NFL. After a relatively quiet Week #1 he emerged in Week #2 with 9 receptions and 101 yards and a touchdown score. He was expected to get a tough matchup with the sturdy pass defense of the Pittsburgh Steelers on Thursday night to start Week #3 but Cooper hauled in 7 receptions out of 11 targets for another 101 yards and another touchdown score.

Looking back on the tiers that I used to sort out the draft in my research, I had Amari Cooper listed on the 6th Tier in my classification system. I drafted both Terry McLaurin and DK Metcalf ahead of Amari Cooper as they resided in the 4th Tier of wide receivers that I had sorted out the group with. Many leagues

use a set lineup for the first 15 or so players drafted in a fantasy football draft. So the 4th wide receiver that I selected was in the taxi rounds when the value proposition for Amari Cooper was simply too high for him to remain unselected. Matt Ryan is another guy who fell into the taxi rounds and is proving to be a good value.

At age 37, and a Tier #7 ranking going into the draft, Ryan was hardly a hot commodity on draft day. Yet, when you review my Tier #7 QB’s you see quickly this is not a bad tier of quarterbacks. Jameis Winston, Zach Wilson and Ryan Tannenhill were the other members of my 7th Tier going into the draft. Winston threw for 5,000 yards in 2019. Ryan was the #2 QB in all of fantasy football in 2018. If you suffer an injury at QB, you could do much worse than plugging in Ryan Tannenhill in a pinch. One thing that I have never understood is how quickly the draft picks happen in the taxi rounds of a fantasy football draft.

It would seem that with the pressure off the draft picks go much quicker. The opposite should be the case. Matt Ryan had 50 pass attempts in Week #2 and threw for 352 passing yards. The team that took the extra time in

Garrett Wilson = Superstar in the Making

as well, one that you can't quite see, but you know it's there. That is the "it factor". Very few have it and it can't be taught but Wilson certainly looks the part.

Garrett Wilson sits at 8 to 1 to win the Offensive Rookie of the Year award, which is only behind Drake London's 6 to 1 for the best odds. Wilson began the season at 10 to 1 odds, but once the news of his quarterback going down hit the market his odds tanked. You could have gotten Wilson at 17 to 1 in late August. With his play the first few weeks I don't expect the odds to ever be this good again. Wilson is a superstar in the making and the world is catching on.

Start Amari Cooper and Other Shockers

you have a player put up a truly historic season, it does translate to wins on the field and points in the fantasy games. When you review the Player Rater on ESPN you see that Trea Turner is chasing Judge at 14.05 points to Judge’s 20.04. Folks that really isn’t edging someone. That is eclipsing someone. It’s a beatdown. It’s a dominant showing.

And what a surprise to find Randy Arozarena listed at #8 overall this year at the moment. But seriously, check out the standings in your league. The 2nd place team in my mixed dynasty league has Paul Goldschmidt at #3, Francisco Lindor at #13, Marcus Semien at #20 and Arozarena at #8. Thanks to missing a month with injuries Mike Trout does not even crack the Top 40.

the taxi rounds to make him come away with a steal. I take my time in the taxi rounds because I see those rounds as where the draft is won or lost.

As I talk to other owners in fantasy baseball leagues, I am running into the same story this year in 2022. The guy that has Aaron Judge in our league is running away with the title. Should we be surprised? With

60 home runs hit and 16 stolen bases tossed in for good measure, Judge is having a historic season. The .316 batting average and the .422 on base percentage almost get overlooked. And yet with 118 games played in 2018, 102-28 and 148 games played in 2019-2021 the NY Yankees are certainly very happy with the fact that he has been healthy for all of this 2022 season. This is the very essence of fantasy baseball though. When

The last week of the Fantasy Baseball season will be a 10-day week. This is a remnant of the fact that the season began with a labor work lockout and though we got in a full season, it was accomplished through a lot of doubleheaders and a final week of 10 days. Make sure you don’t plug in players for the final week that will only be pitching once. That could be critical for the counting stats of strikeouts, wins and quality starts.

When residential property is owned by a trust, the trustee may sell the property if the terms of the trust permit it. The trust would be the seller of the property and the trustee must sign the listing agreement, contract of sale and closing documents. Upon closing, the net proceeds from the sale are payable to the trust and the trustee handles opening a trust bank account if one does not already exist. The trustee would then deposit the net proceeds into the trust bank account.

Many people transfer their homes to an irrevocable trust to protect the asset for purposes of qualifying for Medicaid long term care. Medicaid Asset Protection Trusts typically provide that the creator of the trust (the Grantor) receives income from the trust, but not principal. Also, Grantors reserve the right to live in any residential property owned by the trust during their lifetime. After the death of the Grantor, the assets either continue for the

life of a spouse or pass to the trust beneficiaries.

If a home owned by a Medicaid Asset Protection Trust is sold, the Grantor is not entitled to the proceeds from the sale. But, if the Trustee invests the proceeds from the sale, the Grantor could collect

any interest or dividends generated.

A Trustee cannot deposit the sales proceeds in any other type of account – to maintain protection the proceeds must be deposited in the name of the irrevocable trust. A Trustee of such a trust can purchase a new residence for the Grantor,

which the Grantor has the same right to reside in for their lifetime.

Note that if the terms of the trust are violated, any assets inside the trust are no longer protected for Medicaid purposes. For most people their home is the most significant asset in their Medicaid

trust. Thus, it is very important to consult an experienced elder law attorney whenever selling or spending trust principal.

At the Grantor's death, the Trustee must distribute the assets held in trust according to the trust beneficiaries. It is advisable for the trustee to account to the trust beneficiaries and have them sign a receipt, release and refunding agreement before making any distributions of the trust funds. This releases the Trustee from any liability for their actions as trustee. A Trustee should seek out an experienced trust attorney to help prepare the necessary documentation.

ON THE SEA

Usually, as soon as I write a column on de-commissioning the boat for the winter season, Indian Summer arrives to bathe us in the last warmth of the year. As of this writing, it hasn’t happened so I’m writing it for information – and in the hope Indian Summer will get here! This weather is windy, wet and cold – but a reminder that many months of kindly weather are behind us and many months of dark, cold and dreary weather are ahead of us. So, here we go – Indian Summer or not! Even if you hand off your boat to your dock master and say, “see you in the Spring”, there are some tips in here that you will want to be aware of. This column is about that.

“On the Hard” or In The Water

Clearly, there are some basic steps to de-commissioning and one of them is to get the boat safely “onto the hard”, as the old-timers call dry-dock. Storing your winterized boat in the water can only be done in a very controlled environment with, generally, professional and near-constant attention. Even with signs of global-heating all around us, (I think “global warming” sounds too benign), the creeks and coves of “Out East” freeze up for much of the winter. Even Moriches Bay itself has frozen across over the years

and I am talking about recent years. The only upside to storing your winterized boat in the water is that you don’t have to pay to haul the boat and return it to the water in the Spring. I still believe that that can be penny-wise and pound-foolish if this watery winter berth isn’t a very controlled environment… Recall that 80% of boats that do sink do so at the dock. So, let’s focus this column on spending the winter “on the hard”…

Making a List and Checking It Twice

If you are going to hand the boat over to the dock master and say, “see you in the Spring”, do so with a written check list, especially if you intend to do some of the work yourself. As you’ll see, the advice below is not 100% extensive. I’d need most of the newspaper to give you a check list that could be used by every boat. (BTW, if you want a copy of the Boat-US/Seaworthy article on winterization, email me below and I will email a copy to you.) So, work with your dock master in signing off on what will be done by the yard and, if you desire to be involved, by you.

Some ideas/categories:

4. Fill the boat’s fuel tanks completely full

5. Add biocide and/or stabilizing agents to fuel

6. Change the fuel filters

7. Add antifreeze to the engine’s cooling system

8. Add distilled water to batteries, charge completely and disconnect

9. Charge batteries to capacity

Before thinking about covering the boat with shrinkwrap or canvas, inspect the hull. Any blisters in the gelcoat? If so, that has to be addressed sooner rather than later as that will lead to water infiltrating the hull, making the boat less sea-worthy. Stress cracks,

which often develop at the bow, need professional attention.

Just putting a patch over it and sanding, a la the gelcoat blister, won’t fix that one. It’s structural.

As to washing and waxing the hull, I opt for cleaning now and waxing in the Spring.

Does the boat have a cabin of any kind? Get the “moisturesoaker-uppers”, i.e., desiccants, in there. Inexpensive and they inhibit the build-up of moisture that leads to mold. And don’t forget the hatches, closets and lazarettes.

Other than covering the boat, the “mechanical system” is the most obvious place to start. Your mechanical system may only be your gasoline-powered 90-HP Johnson outboard. If so, you are going to flush the engine with

fresh water (attach a garden hose to the intake and let it flush –engine OFF!), “fog” the engine with lubricating oil (be sure the fuel system is disconnected from the engine when you start the process), clean/replace the spark plugs and fuel filter, lube the carburetor and anything else that moves – choke, cam, starter linkage, etc. Don’t forget the lower unit (what the prop comes out of). Replace the lube oil. BTW, if you open the drain plug and water comes out first (oil floats), you need to replace the seal. Inspect the prop(s). Any dings? Get a professional to look at that. A bad “wheel” can shake your engine apart…

So that’s your outboard. Did I ask if you had a diesel engine or an I/O? Does the boat have a transmission? In-board water system (sink/shower)? Airconditioner? Electronics going to stay aboard or come home with the owner? So, as you can see, the list is far more extensive than the short list above.

But have fun! She’s your boat!

One of the major problems veterans or their family face is what to do when the veteran or spouse dies. As a chaplain and minister this is one of the most common problems for which veterans or their families request assistance. Many of the spouses have no idea what a DD-214 is or where to get a copy. Actually many of the veterans have no idea where their copy of the DD-214 is or how to obtain a new copy.

In New York State we are very fortunate that we have a very strong Veterans committee. They have produced a manual that is of great help to those facing casualty problems. The manual is “New York State Senate Veteran’s Casualty Assistance Program.” This document serves as a checklist for veterans and their families

in obtaining access to forms, military data, burial benefits and other official documents which may be required to satisfy U.S. Veterans Affairs, as well as insurance companies, the Social Security Administration and others. It has eight sections:

Veteran’s

Assistance Program

6. Application for U.S. Flag for Burial Purposes (VA Form 27-2008).

7. Application for Burial Benefits (VA Form 21P530).

8. Application for Military Records Requests (NARA Standard Form 180).

1. Federal, State and Local resources.

2. Veteran’s Personal Data.

3. Checklist to use at time of veteran’s passing.

4. A list of official documents needed to submit claims for VA benefits, a summary of

veteran burial honors and a form for miscellaneous data.

5. Applications for Headstone or Grave Marker (VA Form 40-1330) and Government Medallion (VA Form 401330M).

This manual should be in every Veteran’s posts and even in fire houses which also have numerous veterans. Our local State Senator Alexis Weik states in the manual; “Please do not hesitate to contact me for any assistance you may require in obtaining the honors and benefits the United States confers upon the death of those who served in time of war.”

Senator Weik can be reached at her Albany office at (518)-455-2950 or locally at (631) 360-3356.

OF MEN & ANGELS

Except for Matthew’s account of the Nativity of Jesus, Luke is the only evangelist to write of the events surrounding His early years. He tells the story of the messenger-angel Gabriel and Zechariah, the father of John the Baptizer, second cousin to Jesus.

Zechariah was one of the priests of the Temple in Jerusalem. There were far more priests than were needed, so they used to take turns. Each served for a week at a time and then went home until his turn came around again. Zechariah’s home was in a little village out in the country, about five miles from Jerusalem. His wife was Elizabeth, who like Abraham’s wife Sarah had never had a baby although she and Zechariah had both prayed fervently for one. The couple was old and had given up all hope that their prayers would be answered.

Zechariah entered the Temple. No one could see into the sanctuary. Everyone else waited for him to leave and tell them that incense had been offered. As Zechariah stood by the altar spreading incense onto

hot coals, he suddenly saw an angel standing next to the altar.

He became terrified. The angel said to him, “Do not be afraid, Zechariah. Your prayers have been answered. Elizabeth is about to have a baby, a son. You will name him John. He will bring great joy to you and

to many other people because he will prepare the way for the Lord and make His people ready to receive Him.”

Unfortunately, the old priest hadn’t remembered the story of Abraham and Sarah although he was very familiar with it. He replied to the Angel. “How

Gabriel and Zechariah

come true at their appointed time you will be silenced and lose your power of speech until after the child has been born.” With that, Gabriel zapped Zechariah mute.

Meanwhile the people were waiting for Zechariah outside the sanctuary and were wondering why it was taking him so long. When he finally did come out and could not speak, they realized that he had had a vision in the sanctuary. He could only gesture to them and remained speechless. He returned home to Elizabeth who eventually did conceive a child.

can I be sure of this? I am an old man and Elizabeth is past childbearing age.” This infuriated the angel.

“I am Gabriel who stands in God’s presence and I have been sent to you to bring this good news. Since you have not believed my words which will

On the eighth day friends and neighbors came together to celebrate the circumcision of the boy. They wanted to name him Zechariah after his father but Elizabeth spoke up, “No, he is to be called John.” They said to her that no one in the family had that name and gestured to his father asking him what he wanted the boy named. Zechariah wrote on a tablet, “His name is John.” Immediately he regained his speech, fulfilling the prophesy of the Archangel Gabriel.
