Ethics Probe Called on Bellone and Ex-Staff for Jobs

with Taxpayer-Funded Groups

Former County Executive Steve Bellone and members of his staff may have violated ethics laws by taking jobs with organizations they funneled taxpayer money to while in office. Suffolk officials requesting an ethics probe have also questioned how funds were distributed from the county’s $50 million share of the Opioid Settlement and how the money relates to the former Bellone officials.

County Comptroller John Kennedy, who has requested a Suffolk County Board of Ethics investigation, called possible conflicts over the new positions taken by Bellone and three members of his administration “disturbing.”

“I have done financial disclosure every year since 1987,” Kennedy said. “I have to affirm that I have not used my public position to develop private employment.

We now have four highly placed former county employees, including a county executive, who are on private payrolls within 70 days of separation. I am requesting a county ethics board opinion and will work with the county executive’s office to revise the code to make it clear that this revolving door behavior is unacceptable.”

Answering a question that has swirled in political circles for months—what will Bellone do once he leaves public office?—the former county executive took a job with Northwell Health in Staten Island as an assistant vice president of operations. Northwell is the largest health system in the state, with 85,000 employees treating over two million New Yorkers every year. County officials said the healthcare giant received the lion’s share of the opioid settlement money, won from purveyors of the highly addictive narcotic, handed out by the Bellone administration.

Bellone’s former deputy, Vanessa Baird-Streeter, raised eyebrows when she took over as head of the Health & Welfare Council of Long Island, a Huntington Station nonprofit that received $75,000 from the Bellone administration prior to him leaving office. Baird-Streeter’s predecessor at the council was Rebecca Sanin, now a member of the Suffolk Legislature.

Another former county employee, Scott Mastellon, went from chief of Bellone’s Department of Information Technology to SVAM, a Great Neck company that Suffolk previously contracted with for computer technology work. According to Kennedy, Bellone used emergency powers after the 2022 cyberattack that crippled county government for months to okay nearly $14 million in “unnecessary” spending without legislative approval, a matter he said he has referred to District Attorney Raymond Tierney for investigation.

“Most of the people who died from opioids in Suffolk came from Brookhaven,” noted County Executive Edward Romaine, the former town supervisor. “The second most came from Islip. How much did the two largest towns get from the opioid money? How about zero,” Romaine exclaimed. “How much did the district attorney’s office get? Zero. How much did the medical examiner get? Zero.”

According to Romaine, who said his office will conduct a full review of the opioid disbursements in conjunction with the county controller, no minutes of the meetings conducted by Attard’s committee were taken, and records pertaining to the expenditures may have been removed. District Attorney Tierney has offered former Bellone administration employees a one-month amnesty to return any records they may have or face possible prosecution (see related story in this week’s South Shore Press).

In published reports, Bellone noted that Attard “was not required to file a recusal form when applying for the position with FCA, which posted in December, because she was not personally or directly dealing with FCA at that time.” He also said his position at Northwell “did not require submission of a recusal form because I was not personally or directly dealing with Northwell Health or personally involved in any of their business dealings as a county official at the time.”

Chick Day Gives Lessons in Life for First Graders

Tuttle Elementary first grade students got a firsthand lesson on how to care for and hatch chickens, as the fruits of their labor literally came to life on “Chick Day” at the school.

The Yaphank Educational Center gifted eight baby chicks to the first grade students. They were placed in an incubator inside the classroom, which was donated by the school PTO. Once the baby chicks hatched, the school celebrated with “Chick Day” for all to see.

A lesson was then given to students on the chicken’s life cycle.

Amnesty Offered in Suffolk File Gate Case

Anyone removing government files while Steve Bellone was heading for the door after 12 years as county executive has one month to return them under an amnesty offer announced by Suffolk District Attorney Raymond Tierney. After that, they face prosecution in a case that has grown into Suffolk’s own “File Gate.”

Saying that it is in the best interest of the public, Tierney took the extraordinary step of revealing that an investigation is underway, a move rarely made by a prosecutor. Any missing records, Suffolk officials said, could be valuable in getting to the bottom of the cyberattack that crippled the county in 2022 and could assist in a probe of the money allocated to organizations Bellone and some of his staffers went to work for after he left office on January 1.

Tierney confirmed in a statement that he has “received allegations that, during the transition of county administrations, members of the outgoing Bellone administration improperly destroyed and removed data belonging to Suffolk County.”

Offering an explanation why the

investigation was made public, his chief deputy, Alan Bode said it was “determined that the public’s awareness would assist the investigation or mitigate harm from any alleged criminality.”

Tierney is looking into any duplication or destruction of records and whether any actions by the Bellone administration were inadvertent or intentional, and if criminal charges are warranted. According to a source speaking on the condition of anonymity, the outgoing county executive left no files or electronic data. The county executive’s suite turned over to the new executive, Edward Romaine, was described as a “mess.”

The investigation was spurred by Suffolk Comptroller John Kennedy, who said he was tipped off by several county employees that email records were destroyed and equipment that would hold the information was deactivated.

“This is theft of public property and could be damaging to government operations,” Kennedy said.

“Ray Tierney is doing something that no other DA has done before; he announced that he's investigating this and saying when they return the records, they won't

be prosecuted,” Romaine stressed. “There will be amnesty. And the reason is because these records are vital to the security of the county; they could harm the county in a major way.”

Legislator Anthony Piccirillo pointed to a “transition of power” law he sponsored after taking office in 2020 and finding an empty office that requires outgoing county officials to retain documents

and other information for their successors. He is chairman of a special committee investigating the cyberattack, an effort that has yet to produce a report pending an appearance by Bellone Deputy Lisa Black. Concern has been raised that data that would aid the investigation, which is expected to detail how attackers accessed the county’s computer system and make security recommendations, may have been deleted or destroyed. Rate Hike on Tap for Suffolk Water Customers

A rate hike is on tap for customers of the Suffolk County Water Authority, with average quarterly bills going up $4.18 starting June 1. A typical residential ratepayer will see their annual water cost go up to about $574, a nearly 3% hike under the new rate schedule passed by the authority board of directors.

The rate increase to cover a $304 million spending plan comes on the heels of a 4.1% jump last year for the authority’s 1.2 million customers. SCWA officials, who stressed that the rates are lower than other Long Island water providers, attributed the higher fees to rising costs and capital project debt.

The water authority’s 2024-2025 budget includes $158.7 million for annual operating and maintenance costs, $103.5 million for capital improvements, and interest on debt at $41 million. The spending package, 6% higher than the previous year, anticipates about $9.8 million in reserve funds.

The authority also approved a service charge increase from $32.07 to $33.18. Users in Tier 1 of the rate schedule, the standard rate, will see costs go up 9 cents for every thousand gallons to about $2.41 from the current $2.33 charge. A conservation rate, charged to larger users consuming more than 89,760 gallons per quarter, will increase by 13 cents per thousand gallons for amounts above the threshold. This new rate will go to $3.48 per thousand gallons, up from the current $3.36, meaning if you use a lot of water, you’ll pay more.

The water authority also charges customers an $80 annual surcharge to deal with polyfluoroalkyl substances (PFAS), known as “Forever Chemicals,” and other groundwater contaminants, requirements made more stringent by state and federal regulators. The surcharge remains unchanged in this budget cycle.

The water authority has been keeping busy, recently announcing

the installation of 1,480 feet of new water mains in Shirley to eliminate dead ends in the system.

“Dead ends can create challenges when flushing water mains in certain areas,” Board Chairman Charles Lefkowitz noted. “With this project complete, residents will not only see improved water service, but they will also experience the

benefits that come from easily flushed water mains. This is an exciting project for us at the Suffolk County Water Authority, and we are proud to see it come to fruition.”

The South Shore Press was unable to obtain comment on the investigation from Bellone or members of his defunct administration.

The situation is reminiscent of the File Gate case against former President Donald Trump, who was charged after federal agents raided his Mar-a-Lago estate and seized Oval Office records. Michael McCormack, Irish Historian

A special guest was part of Suffolk’s Irish Heritage Celebration: Internationally known historian, author, and composer Michael McCormack, a top official of the Ancient Order of Hibernians.

McCormack helped organize a division of the Hibernians in 1967 and served as its Secretary, Vice President, and President before his knowledge of Irish history earned him the post of Division Historian.

The Centereach resident is a U.S. Army veteran with a long career as a writer and editor with a number of publications, including the Hibernian Digest, Irish Echo, Arizona Desert Shamrock, San Francisco Gael, Florida Irish American, as well as St Patrick’s Monthly and Ireland’s Eye magazines in Ireland.

He won the AOH National Essay Competition for three years straight starting in 1978, and became the first ever to win the bronze, silver, and gold National Awards in three consecutive years. He was elected Suffolk County Hibernian Vice President and soon settled into the office of County Historian.

McCormack was elected to the AOH New York State Board as Director for Long Island in 1982 and by 1984, was State Historian. He succeeded himself in all three offices and in 1988, was appointed

to the National Board. Soon after, he was named National Historian, becoming only the second person ever to hold the same office at all four levels of the Order at the same time.

Looking to create a forum for Ireland’s musical heritage, McCormack hosted “Echoes of Ireland,” a weekly radio program at WLIM in Patchogue in 1983. A year later, WLIM was rated the number-one station in the county in his time slot. He was also featured in AIRPLAY Magazine and on several TV documentaries on Irish themes. He continued his program on Long Island’s top station, WALK, for 21 years until illness forced him to retire.

Construction Zone Crash Leads to Serious Injuries

McCormack worked with local officials to win historic landmark status for the former Manorville home of the Irish patriot, Tom Clarke and was the prime mover behind a Wicklow Granite monument, carved in Ireland, at the site. He was also involved with the publicity for the New Suffolk test site of the first U.S. Submarine, the Holland I, invented by Irish-born John Holland, and spear-headed a nationwide fundraiser to get his original submarines properly displayed in museums. In addition, he served on the committee that erected a centennial memorial to the men and women of Ireland’s Easter Rising.

McCormack helped create a

set of history panels explaining Ireland’s Great Hunger of 184550 for the international tour of the Jeanie Johnston, a full-scale replica of the three-masted ship that carried Irish Immigrants to America in 1848. He is a member of the New York Irish History Roundtable and is an honorary member of both the Suffolk Police and Suffolk Firefighters Emerald Societies. He’s been Grand Marshal in a number of St. Patrick’s Day Parades, including Ronkonkoma, Glen Cove, Patchogue, and Port

St. Lucie, FL.

McCormack was part of the bicentennial commemoration of the 1798 Irish Rebellion and, while there, was privileged to speak at the grave of national hero Wolfe Tone and at the Commodore Barry Memorial in Wexford. He is a recipient of the Washington D.C. Friends of Ireland Award and had the honor of speaking at the Grave of the Patriots at Arbour Hill during the 2016 Centennial Commemoration of the Easter Rising in Dublin.

The Future is Bright for ESM Students

What do you want to be when you grow up?

It’s a question posed to all of us at some point.

That answer was easier to answer for a group of EastportSouth Manor Jr.-Sr. High School students, who participated in “Career Connection Week” in the school’s library.

The district’s Shared Decision Making Team invited a number of professionals from different fields to share their experiences with students, inspire them, and

answer all of their questions about the working world.

“This was a unique experience for community members and parents to share their experiences in the workforce and to inspire and help students to start thinking about their careers,” said ESM Jr.Sr. High School Assistant Principal Kristyn Pellegrini.

Students were able to learn about jobs in many fields, including medical, public relations, small business owners, civil service, law, accounting, entertainment, security, and transportation.

Police Asking for Eyewitnesses to Fatal Crash

The Suffolk County Police Department is putting out a plea to the public for anyone who witnessed a fatal crash in East Moriches or if they have information about those involved in the accident.

The crash left the Medford man with serious injuries. He was rushed to Stony Brook University Hospital.

The vehicle was impounded for a safety check. Anyone with information on this crash is asked to call the Suffolk County Police Department’s Sixth Squad at 631.854.8652.

According to police, Andrzejczyk ignored a construction worker who was directing traffic and subsequently hit a construction vehicle on the job site.

Police said 66-year-old Donald Kwarta was behind the wheel of a 2018 GMC Yukon and was driving westbound on Sunrise Highway. Law enforcement stated that’s when Kwarta lost control of his vehicle, veered into the median in the middle of the road, and crossed into the eastbound lane.

The driver of the Mack Truck, 58-year-old Keith Schwamb, was taken to the same hospital and treated for minor injuries.

After the fatal crash, the Mack truck was inspected by the Motor Carrier Safety Section. The GMC Yukon was impounded for a safety check.

Happy Easter to you and your families! Thank you for your love for the inspired Word of God. Thank you for your love for the Resurrection appearances of our Lord in this Easter season and the way your lives are set on fire in your meditation and contemplation of these mysteries. Thank you for your fidelity to the Eucharist and the Sunday Mass and your Catholic spirit of evangelization. Thank you for being instruments of Eucharistic Revival.

In The Joy of the Gospel, Pope Francis states: "Christ's resurrection is not an event of the past; it contains a vital power which has permeated the world. Where all seems to be dead, signs of the resurrection suddenly spring up. It is an irresistible force... Each day in our world beauty is born anew, iti rises

transformed through the storms of history...Such is the power of the resurrection, and all who evangelize are instruments of that power." (276)

We continue to live through "the storms of history" and we rely on the Risen Lord and his glorified wounds to touch the wounds ni Ukraine, the Middle East, Nicaragua, Venezuela, Armenia and Azerbaijan, the region of the Sahel, the Horn of Africa and Sudan, as well as Cameroon, the Democratic Republic of the Congo, South Sudan and so many other troubled areas of the world.'

We ask the Risen Lord and his glorified wounds to touch the wounds experienced in our own country.

In The Everlasting Man, G.K. Chesterton captured the power of our Lord's Resurrection experienced in the cycles of history. He wrote: "Christendom

has had a series of revolutions and in each one of them Christianity has died. Christianity has died many times and risen again; for it had a God who knew the way out of the grave."

This Easter and every Easter we celebrate this Everlasting Man who knew his way out of the

grave and who invites us and the Catholic Church on Long Island to a great Resurrection.

Commerdinger Mark in Suffolk History

Members of the Commerdinger Family have left their mark on the Smithtown community, having served as town assessor, postmaster, and operators of the Nesconset General Store and Post Office. Their memory will forever be preserved through Suffolk’s Walter S. Commerdinger, Jr. County Park.

Commerdinger settled in Nesconset in the early 1900s when his father purchased a parcel of land on Lake Avenue. Walter Senior was active in community affairs and served as the Smithtown Town Assessor in the 1920s and 1930s. Walter's mother was a member of the Crolius Family, who were one of the first potters in New York City in the early 1700s.

After serving in France during World War I, the junior Commerdinger returned home and purchased the Nesconset General Store and Post Office. He became the second Nesconset

Postmaster from 1926 to 1933 and then again from 1946 through 1959.

Like his father before him, Commerdinger was active in local government and community affairs, having served as a charter member of various organizations that had a major impact on local affairs.

For generations, the Commerdinger Family owned all of the property north of Lake Ronkonkoma. That land today is known as the 90-acre Lily Ponds Park & Nature Preserve. It will remain natural and preserved forever, thanks to the generosity and foresight of the Commerdinger Family. Until 2006, the family lived in a historic home on a 5.7-acre parcel within the preserve. Developers targeted it for housing, but through the coordinated efforts of the Suffolk officials and the Commerdinger Family, the land was preserved as a county park.

Sadly, the home, with portions dating back to 1810, was neglected during the last 12 years of former county Executive Steve Bellone’s administration and is in dilapidated condition. His successor, Edward Romaine, a former history teacher, said he supports the rehabilitation of the historic homes owned by the county, which include properties at Swan River and Robert Cushman Murphy Park in Manorville, Avery Homestead in East Patchogue, and the Hawkins House in Moriches.

Legislator Leslie Kennedy noted that the former Commerdinger home features a 1960s World’s Fair kitchen, and when she toured it with other county officials, she said they found Civil War discharge papers

belonging to a previous owner. According to Kennedy, funds have been approved to repair the basement of the home, which she said she would like to be made into a community center.

The Commerdinger estate boasts a diversity of wildlife and wooded trails winding down to Lake Ronkonkoma. Much of the land has been untouched since the last ice age 10,000 years ago when a huge piece of ice left behind by a receding glacier created the “kettlehole” lake. A headwater to the lake, the park hosts a vast ecosystem of wetlands and marshes vital to keeping Suffolk’s water clean. A smaller waterway, Lily Pond, is filled with the floating vegetation that is its namesake.

New York Preps for Rare Solar Spectacle

Eyes will look to the skies Monday, April 8 as a large swath of the country will see a total solar eclipse when the moon passes directly between the Earth and the Sun. The Earth’s satellite will start its path in front of the star at 2:12 p.m. and at 3.26 p.m., will completely blot it out. At the moment of “Totality,” the moon, which is the perfect size to completely cover the Sun, will appear as a dark disc as light dances around its edges. The Earth will become decidedly darker. After the total eclipse, the moon will continue on its 2,000-plus mile-per-hour path until it completely passes by at 4:37 p.m.

DO NOT look directly at the Sun during the eclipse, or any time for that matter, since the bright rays will damage your eyes. Special glasses are made to view the eclipse–not regular sunglasses–and a pair can be picked up at the state Welcome Center between Long Island Expressway Exits 51 and 52 in Dix Hills. Gov. Kathy Hochul, who has had a special Interagency Task Force working for the last 17 months to prepare the state for the event, urged residents to

be wary of counterfeit glasses that may not offer adequate eye protection. She also asked for people to be patient while traveling to watch the eclipse and cautioned against phony accommodations advertised in the optimal viewing areas.

“We saw from the last experience many years ago that there were a lot of traffic jams and people running out of gas," Hochul noted. "We're not going to let that happen in New York. We're New Yorkers, and we'll be prepared." While partial eclipses are more common, the last time New York experienced

a total covering of the Sun was in 1925. The next totality for the state will be in 2079. While Long Island will see a neartotal eclipse, the exact path for maximum coverage will span across 29 counties in the western and northern parts of the state, drawing viewers to those areas and necessitating the abundance of caution expressed by the governor.

"The April 8 eclipse is a oncein-a-generation experience, and there’s no better place to view it than in our beautiful state," Hochul said. "New York is ready to welcome millions of

visitors, and my administration has been working hard to ensure everyone in the path of the eclipse can safely enjoy this rare event. I encourage anyone traveling for this experience to plan on arriving early to their destination and staying late to enjoy all of what our state has to offer."

Showing off her “I NY” spirit, the governor offered, “Come for the eclipse, stay for New York.” The Buffalo Bills football team, the only NFL franchise that actually plays in the state, appeared in a promotional video as part of a multi-platform ad campaign. and tortoise shells known as oracle bones. They noted that the “The Sun has been eaten.” A team of astronomers at NASA’s Jet Propulsion Laboratory studied these records to research changes in Earth’s rotation. Knowing exactly when the eclipse was seen and where the Moon's shadow fell on Earth enabled them to calculate the rate of Earth's spin and determine that it has slowed down 47 thousandths of a second per day in the past 3,200 years.

Lunar eclipses also occur when the Earth passes between the moon and the Sun. Christopher Columbus used his knowledge of the movement of the sphere’s to save himself and his crew during one of his voyages. The explorer found himself stranded in Hispaniola and the native inhabitants were growing weary of the foreign presence. They stopped providing food and were becoming hostile. Knowing an eclipse would occur, Columbus told the tribal leader that God was angry with their treatment of him and would show it by making the moon appear “inflamed with wrath.” When his prediction came to pass, they supplied Columbus’ ships with fresh provisions and begged him to pray to his God for protection.

One Year Later, Police Arrest Second Driver in Fatal Hit and Run

One year after a fatal hit and run crash in Patchogue, Suffolk County Police made an arrest of the person who they believe was behind the wheel of a vehicle that fled the scene.

It was March 12th, 2023 when 25-year-old Nicholas Puzio was struck by two cars one minute apart and later died at Long Island Community Hospital.

The driver of the first car that hit Puzio at the early morning hours on Medford Avenue,

19-year-old Jurado-Zavala, of Les Street in Bay Shore, was arrested last year and charged with Leaving the Scene of an Accident with a Fatality.

He entered a plea of not guilty to those charges and is awaiting trial.

For over a year police searched for the second vehicle that also struck Puzio one minute later.

Cops believe they now have their man.

Police placed Patchogue resident Jesus Matute under

arrest and charged him with Leaving the Scene of an Accident with a Fatality.

Law enforcement said the 73-year-old was behind the wheel of a 2005 Nissan SUV that was the second car that took off after Puzio was hit and killed.

Senior Medicare Patrol Issues “Fraud of the Month”

Unauthorized claims related to urinary catheters that weren’t ordered by Medicare beneficiaries were exposed as the “Fraud of the Month” by the New York StateWide Senior Action Council. Scammers are targeting seniors and billing for supplies that aren’t medically necessary and the council wants to warn seniors and help them file complaints.

“This activity hurts the Medicare program and compromises the beneficiary’s medical identity,” said Maria Alvarez, Executive Director of StateWide, a 52-year-old nonprofit organization dedicated

to advocating for the needs and well-being of New York’s approximately 2.5 million senior citizens. The bogus charges can range from $1,200 to $2,400, Alvarez noted.

“One of our key initiatives is the Senior Medicare Patrol, the definitive resource for New York State’s senior citizens and caregivers to help detect, prevent, and report Medicare fraud and waste,” Alvarez explained. An important component of the Senior Medicare Patrol program is a monthly “Fraud of the Month,” which calls attention to the various kinds of fraud perpetrated on our State’s elderly. This month we are

advising seniors to watch out for Unwanted Catheters Billed to Medicare.

“Thankfully, we have organizations such as StateWide to keep an eye out for fraud and help seniors avoid scams,” said state Assemblyman Joseph DeStefano. “They are an important part of the system.”

StateWide, which is the state’s grantee/administrator for the federal program. advises New York’s Seniors to protect themselves from such fraud by doing the following:

Do not accept ANY medical supplies unless they were expressly ordered by a trusted physician or caregiver.

Be suspicious of those who offer “free” medical supplies, then ask for your health insurance information.

Medicare Beneficiaries should always be cautious of any unsolicited requests for their Medicare number, do not give it out to ANYONE but your doctor or other trusted caregiver.

Review Medicare Summary Notices (MSNs) and Explanation of Benefits (EOBs) for claims out of state or by a doctor who is unfamiliar.

Catholic President Biden declared Easter Sunday, March 31st, 2024, as “Transgender Day of Visibility.”

Word for word, here is the Executive Order signed by President Biden and how he decided to honor and celebrate the resurrection of Jesus:

“By virtue of the authority vested in me by the Constitution and the laws of the United States, do hereby proclaim March 31, 2024, as Transgender Day of Visibility. I call upon all Americans to join us in lifting up the lives and voices of transgender people throughout our Nation and to work toward eliminating violence and discrimination based on gender identity.”

Not to be outdone in the race to insult Christians around the world, New York Governor Kathy Hochul doubled down on Biden’s bowing down to the trans cult. Catholic Hochul ordered state buildings to be lit pink, white, and light blue in honor of “Transgender Day of Visibility,” Easter Sunday 2024.

Governor Hochul believes the hallowed ground of One World Trade Center is a perfect location to ignore Easter and celebrate “Transgender Day of Visibility” by blasting those pink, white, and light blue colors up and down the length of the building.

Other state landmarks and buildings to adorn these prideful colors are the:

Kosciuszko Bridge, The H. Carl McCall SUNY Building, State Education Building, Alfred E. They Will Never Forget Cuomo’s Disastrous COVID Decision

Still pressing for answers four years later, state legislators marked the anniversary of former Gov. Andrew Cuomo’s decision to send COVID victims to nursing homes, leading to the deaths of nearly 15,000 seniors. The infamous order was a public health catastrophe that devastated long-term care facilities and nursing home populations during the pandemic.

Local officials assembled in Albany along with organizations such as Voices for Seniors and residents who lost family members after Cuomo directed COVIDinfected patients from hospitals to the senior homes. The group renewed their call for a longawaited independent review of the state’s disastrous COVID response. Despite commitments from the Hochul Administration to conduct an investigation, little to no progress has been made, they noted. As thousands of families continue to wait for answers, the investigation process has only identified an outside consultant, The Olson Group, Ltd., from Virginia. Hochul was also urged to convene a promised “Reimagining Long-Term Care Task Force.”

“Assembly and Senate Republicans have repeatedly requested legislative hearings equipped with subpoena power to seek answers and provide accountability for the families who lost loved ones due to the previous administration’s mishandling of the pandemic,” said Medford Assemblyman Joseph DeStefano, a Republican who attended the somber anniversary event. “The now publicly disclosed

After suffering losses in State Supreme Court and at the Appellate Division, supporters of the New York City law to allow illegal immigrants and noncitizens to vote in local elections filed their notice of appeal with New York’s highest court, the Court of Appeals.

Days later, the New York City Council, the body that initially passed this law, filed their own notice of appeal. The Appellate Division decision in this case, however, was correct; the state constitution does not allow illegal immigrants and noncitizens to vote. The Court of Appeals must uphold the integrity of our elections and let this decision stand.

Unlike the U.S. Constitution, our state constitution explicitly protects the right to vote. The right to vote, however, is a right that can only be exercised by citizens.

Andrew Cuomo and his staff, and the damaging reports from Comptroller Tom DiNapoli and Attorney General Letitia James support the need for further examination of the state’s COVID response by an independent entity. No one has been held accountable,” said Tracey Alvino of Voices for Seniors,” whose grandmother died of “failure to thrive, which became an epidemic on death certificates as the elderly withered away and gave up on life.” Alvino promised: “We won’t stop until there is justice for every person that was killed with a stroke of Andrew Cuomo’s pen.”

Earlier this month, Cuomo, a Democrat, was subpoenaed by a Congressional panel investigating his role in the pandemic. “Former New York Gov. Andrew Cuomo implemented nursing home policies that had deadly consequences for New York’s most vulnerable population,” said the chairman of the Select Subcommittee on the Coronavirus Pandemic, Ohio Republican Brad Wenstrup. “Not only did the former governor put the elderly in harm’s way, but he also attempted to cover up his failures by hiding the true nursing home death rate. It appears that politics, not medicine, was responsible for these decisions and that while Mr. Cuomo is adept at seeking legal advice, he is not necessarily adept at seeking medical advice.” Wenstrup continued: “Former Gov. Cuomo owes answers to the 15,000 families who lost loved ones

in New York nursing homes during the COVID-19 pandemic. His testimony is crucial to uncovering the circumstances that led to his misguided policies and for ensuring that fatal mistakes never happen again. It is well past time for Cuomo to stop dodging accountability to Congress and start answering honestly to the American people.”

The subpoena moved a Cuomo spokesman to lash out in a statement: "This is an obvious press charade: they issue a subpoena as a press release. The simple fact remains that this issue has been reviewed three times by the Department of Justice under Trump and Biden, as well as Congress and the Manhattan District Attorney who found no there there. New York followed the guidance put forth by the Trump administration in March of 2020 - as did other Democratic and Republican states. If they have a problem with that, they should look in the mirror. Congress knows this, but it's not about the facts; this is about politics.”

Cuomo initially praised President Donald Trump for his actions during COVID, including his sending the Navy hospital ship USNS Comfort to New York to care for patients, and then turned against him.

Former New York Lieutenant Gov. Betsy McCaughey, an outspoken opponent of Cuomo’s COVID response, including the $5.1 million advance he received for writing a book about it, charges that he bowed to the requests of the hospital lobby, a top political contributor, which wanted the COVID patients out of their facilities. In order stifle kudos for Trump during the

crisis, McCaughey argues, Cuomo declined to utilize the Navy ship or a massive COVID center set up by the federal government at the Javits Convention Center and instead, sent the patients to the nursing homes.

Marc Molinaro, a Republican representing a district south of the state Capitol, noted, “Today is an emotional day for so many. Four years ago, Gov. Cuomo mandated that COVID-19-positive seniors be forced into nursing homes. Instead of addressing it, he covered it up. Actions should have consequences. Those responsible for the deadly mandate and cover-up must be held to account.”

Speaking at the anniversary event, the leader of the state Assembly Republicans, Will Barclay, agreed: “Four years of unanswered questions, four years of families grieving, four years of zero transparency. Gov. Kathy Hochul

promised families an independent review of the state’s policies during the early phases of the COVID-19 pandemic; New York families are still awaiting that review. The state’s approach to the pandemic was severely mishandled, and we will continue to fight until proper action is taken. We must seek to learn from the mistakes of the past, or I fear, we will be doomed to repeat them in the future.”

The leader of the state Senate Republicans, Rob Ortt, concluded: “The best way to ensure New York is better prepared in the future, is to openly and honestly assess the mistakes of the past. Thousands of families continue to mourn the loss of their loved ones in nursing homes due to the disastrous March 25th directive from former Gov. Cuomo. They deserve the thorough, transparent investigation that was promised, not more inaction from their state government.”

The New York City law that was challenged is unconstitutional; it is dangerous as well. Under New York City’s noncitizen voter law, a Russian national working at the Russian consulate and living in New York City would be eligible to vote in local New York City elections. The same is true for Chinese nationals. As outrageous as it seems, under New York City’s law, nothing would stop foreign nationals from states hostile to America and Americans from voting in local New York City elections.

And New York City isn’t the only municipality to attempt to open up its local elections to noncitizens. A number of other local governments have followed the Big Apple’s lead. In Vermont, three cities — including Montpelier, the state capital, and Burlington, Vermont’s largest

city — permit noncitizens to vote in local elections. When these laws were challenged, Vermont’s highest court, amazingly, found nothing impermissible with giving the right to vote to noncitizens, and the noncitizen voter laws were allowed to remain in place.

This movement to allow noncitizens to vote has even reached our nation’s capital. The government of the District of Columbia, in 2022, enacted a law to allow noncitizens to vote in municipal elections. The law was challenged, but a court recently rejected this lawsuit on procedural grounds.

Thankfully, efforts are underway to stop the movement to grant voting rights to noncitizens. An amendment to the state constitution prohibiting noncitizens from voting will appear on the ballot in Wisconsin this fall. More recently, an amendment to the state constitution prohibiting noncitizens from voting in any elections was introduced in the Illinois state legislature. Concerned state legislators introduced this amendment after at least one Illinois city began toying with the idea of opening up its elections to noncitizens.

New Yorkers, however, are fortunate; we have a state constitution that upholds the integrity of our electoral system and clearly states that citizens — and only citizens — may vote in our elections.

The voting rights of American citizens are infringed upon when voting rights are granted to noncitizens. New York City made a terrible decision almost three years ago by opening up its local elections to noncitizens. Both courts to hear the challenge to this law made the right decision, defended our state constitution, and invalidated the noncitizen voter law. The Court of Appeals must uphold these lower court decisions and maintain the integrity of New York’s electoral system.

The Rise, Fall, and Lonely Death of Sheldon Silver

No one knows the power, anger, and wretched wrath Sheldon Silver once yielded in the halls of Albany more than former Democratic New York State Assemblyman Michael “Mickey” Kearns.

The year was 2012. Kearns, who now serves as Erie County Clerk, was in a hotly contested special election against an establishment Democrat.

His main campaign message: I won’t take marching orders from legislative dictator Silver and won’t support him for Speaker.

This hard line stance made Kearns “persona non grata” with Democrats and especially the Assembly Speaker.

“He was so powerful. But I ran against him. When I won Silver said to me ‘a lot of guys run campaigns against me, then they fall into line.’ His aide told me ‘when I tell you how to vote, you vote that way.’ While I didn’t do that, lots of people succumbed to that power,” said Kearns.

Silver left this mortal coil more than two years ago, on January 24th, 2022. Just recently “The City” publication posted a poignant, tragic, and sad story on his final days in federal prison. Silver died

in solitude behind bars in a prison hospital, serving time on a public corruption charge.

The man who once ruled Albany with an iron first died frail and alone.

Politicians and lobbyists once lined the hallways of his office, begging for him to allow legislation to be passed.

No one came to see Silver as he lay dying on his deathbed according to The City. He lost 60 pounds because of horrific intestinal issues, could not move due to debilitating back pain, and prison officials blocked his wife from seeing him.

Sheldon “Shelly” Silver was a shell of his former self. The Albany Kingmaker whose subjects bowed down and repeatedly kissed the Speaker’s ring died a broken, lonely peasant.

He died alone on a cold prison hospital bed.

It is one of the biggest rises and falls in the history of New York politics, one Kearns reflected on during an interview with the South Shore Press. The way he died compared to how he ruled and dominated could not be more different.

“We did not get along. I looked him right in the face and told him

‘I’m not voting for you for Speaker. I’m not supporting you.’ Silver threatened me. He wanted my 100% approval. I wouldn't give him that,” added Kearns.

The political and legislative consequences for not bowing and buckling to Silver were swift and severe. Kearns was not allowed to join his own Democratic conference. He was given no staff in Albany. Silver refused to bring any of his proposed bills to the floor. Kearns held firm and held his

head high. He was a conference of one.

As for Silver, his sharp and hard downfall began shortly after being charged in the kickback scheme that ultimately led to his prison sentence. He submitted his resignation as Speaker on January 30th, 2015, but remained a member of the Assembly. Silver became a lonely backbencher, one of 150 lawmakers.

No one came to his defense when Silver needed it most.

Even before the horrific attack by Hamas on Israel on October 7th of last year, the New York State Republican Senate Minority created an “antisemitism working group” with the goal of collecting a report on rampant discrimination and attacks on Jews across New York State.

After hosting two roundtable meetings, the working group released its final report on the rising tide of antisemitism across the Empire State.

“I am disgusted by the recent increase of anti-Semitic hatred that we have seen in New York. The idea that any citizen should

feel threatened on the basis of their deeply held religious beliefs is sickening. Together with the other members of the working group, we have put forth necessary legislation that would ensure that our Jewish brothers and sisters no longer have to live in fear,” said Senator Patricia Canzoneri-Fitzpatrick, 9th Senate District.

The report calls for a dedicated funding stream to secure synagogues and yeshivas. Specific legislation is also enacts the “New York State Anti Semitism Vandalism Act” being recommended, including:

Blocks funding for SUNY,

CUNY or community colleges which, directly or indirectly, permit terrorist organizations on campus.

Makes a specified offense or a trespass at a house of worship a hate crime

Prohibits students from receiving TAP financial aid for college if they engage in antisemitic behavior.

Enhances penalties for those who obstruct traffic and access to buildings during protests and allow for it to qualify as a hate crime.

Expands the prohibition of harassing conduct involving Nazi symbols.

York City Assemblyman. He was close friends with Silver. When he lost the Speakership, Silver was in the members lunchroom. Someone said to him that no one fought for him when the chips were down. Silver then exploded and raged ‘all you motherfu$&ers who I helped over the years, you fu$&ed me. At least Kearns had the (testicles) to confront me to my face,’” recalled Kearns.

That moment of being abandoned and alone at a time of need turned out to be prophetic for Silver. It happened once again at the time of his death.

Silver was 77-years-old when he died of cardiac arrest. The City reported that he exhibited “altered mental status changes” as he lay dying. The former Assembly Speaker was confined to a prison hospital bed, had no friends or loved one at his side, and for all intents and purposes died alone, outside of prison staff.

“What good is being powerful when you die alone in prison? What good are the accolades? It’s sad. At the end of the day, we are not in control. God is the higher power. How you treat people matters. But he monetized his office for personal gain. Where were his friends? What a way to end your life,” concluded Kearns.

Enacts the “New York State Anti Semitism Vandalism Act.”

This makes it a crime to destroy or vandalize pro-Israeli flyers, banners, or posters.

Bans students from enrolling in or taking classes at any SUNY or CUNY school if they’ve been convicted of a hate crime.

Adds antisemitism to the definition within the State Human Rights Law.

“This report is just the beginning of our attempt to address this hate-crime in meaningful, and thoughtful ways. If this report has proven anything it is that New York must do more to combat

antisemitism. We all have a role to play. We must address higher educational institutions weeding out hate speech, the media reporting these crimes and our elected officials, in all levels of government, should put partisanship aside and pass laws to end this crime. It is essential that we do our part,,” said NYS Senator Jack Martins, Chair of the Antisemitism Working Group.

Republican State Senators sent a letter to New York State Governor Kathy Hochul, urging her to encourage Democratic colleagues in the Assembly and Senate to pass the proposed legislation and spending initiatives.

“New York is home to the largest Jewish population outside of Israel, and it is incumbent upon us to take action to ensure nobody is ever made to feel unsafe because of their religion. I want to thank the members of the working group, as well as the stakeholders throughout the state who offered their input, for their work on this issue. NBC's Left Turn: The Ronna McDaniel Debacle Exposes Network Bias

In a stunning turn of events, NBCUniversal's decision to retract the hiring of Ronna McDaniel, former chair of the Republican National Committee (RNC), as a paid contributor has thrown the spotlight on the network's apparent left-leaning agenda. The about-face came amid vocal opposition from key figures within NBC, particularly at MSNBC, reigniting concerns about the network's commitment to journalistic impartiality.

Initially touted as a valuable addition to offer "expert insight and analysis" on politics, McDaniel's appointment quickly drew condemnation from prominent MSNBC hosts like Rachel Maddow and Chuck Todd. Maddow, a leading figure at MSNBC, blasted McDaniel's hiring as "inexplicable," drawing a striking analogy likening it to appointing a "wiseguy" or a "pickpocket" to a position of trust.

"I will tell you, the fact that Ms. McDaniel is on the payroll at NBC News, to me that is inexplicable," she remarked. "You wouldn't hire a wiseguy, you wouldn't hire a made man like a mobster to work in a D.A.'s office, right? You wouldn't hire a pickpocket to work as a TSA screener. So I find her decision to put her on the payroll inexplicable,

and I hope they will reverse their decision."

New York Extends Aid Following Baltimore Bridge Collapse, Disrupting East Coast Commerce

Following the devastating collapse of the Francis Scott Key Bridge in Baltimore, New York Governor Kathy Hochul has offered immediate assistance to aid recovery efforts and mitigate the significant disruptions to regional commerce. The bridge collapse, triggered when a container ship lost power and struck the structure, has sent shockwaves throughout the East Coast, prompting an urgent response to address the aftermath and restore vital transportation links.

The Francis Scott Key Bridge, a critical thoroughfare connecting Washington, Baltimore, Philadelphia, and New York, collapsed in the early hours of Tuesday morning. The collision caused the bridge to buckle and collapse into the river below, resulting in a construction crew and multiple vehicles plunging into the icy waters. Six individuals remain unaccounted for, sparking a massive search and rescue operation.

The incident disrupted traffic flow and severely affected the Port of Baltimore, one of the busiest ports in the United States. The port's closure has halted vessel traffic indefinitely, posing a significant threat to cargo shipments and commuter traffic along the East Coast for the foreseeable future.

After a daylong search, officials called off the rescue mission and announced that six workers were presumed dead. Two bodies have since been recovered from a submerged pickup truck in the water, identified as Alejandro Hernandez Fuentes from Mexico and Dorlian Ronial Castillo

The victims, immigrants from Honduras, El Salvador, Mexico, and Guatemala, were part of a construction crew tasked with repairing parts of the bridge. The historic laboratory in Suffolk County in which genius inventor Nikola Tesla did important, breakthrough work in a building designed by his friend, famed architect Stanford White, suffered a fire last year as restoration was beginning to turn the lab into a museum.

But the project of creating the Tesla Science Center at Wardenclyffe very much continues—with its leadership working hard on it.

“Terrible,” Jane Alcorn, a driving force behind the Tesla Science Center project in Shoreham, said last week about the damage from the blaze in November. But there is “momentum to bring back Tesla’s laboratory to its former glory,” said Alcorn, a center director.

As it declares on the opening page of its website: “Mission: Rebuild. Keep the momentum going. Donate today to see Tesla’s dream come to fruition.”

Marc Alessi, executive director of Tesla Science Center, said of the blaze: “It was heartbreaking.” He spoke last week of how firefighters from 13 departments who battled it “took it personally. It means a lot to everybody." In 2018 Tesla’s lab in

Suffolk was placed on the National Register of Historic Places.

The fire was “a gut punch,” said Alessi, a former New York State assemblyman and Shoreham resident. It was originally estimated to cost $3 million to repair the damage. Now, said Alessi, that’s projected at $4 million, bringing the Tesla Science Center’s total cost to $24 million which includes restoration of the lab and also building a visitor’s center on the 16.5 acre site.

Fundraising is in high gear with grant applications being sent to foundations and the seeking of government support and donations from contributors. Since the inception of the Tesla Science Center project, some $14 million has been raised including from the state and local governments, foundations and contributors “large and small,” said Alessi.

A “Metals for Tesla” effort has begun. This month, on April 20th, Earth Day, or any day earlier, metal that can be recycled—including metal furniture, vehicles and pipes—can be dropped off at the lab site. Details are on the Tesla Science Center website at https:// teslasciencecenter.org/

As the book “Tesla, Inventor of the Electrical Age,” published by Princeton University Press, relates: “Tesla was a major contributor to the electrical revolution that transformed daily life…His inventions, patents, and theoretical work formed the basis of modern AC electricity and contributed to radio and television.” Its author is Dr. W. Bernard Carlson, a University of Virginia professor of science, technology, and society.

Most of the world would adopt AC or alternating current. And Tesla was responsible for many more inventions, among them hydroelectric energy technology,

remote control through electricity, fluorescent lighting and the bladeless turbine, notes the book. Regarding radio, Guglielmo Marconi is usually credited with originating radio but, the book points out that the U.S. Supreme Court, after Tesla’s death in 1943, determined that much of Marconi’s work was based on 17 Tesla patents.

He went to Shoreham in 1901 to pursue his vision of providing wireless electricity. “Tesla was convinced that he could set up stationary waves in the Earth and transmit power and messages,” writes Carlson. He received a $150,000 loan from “the most powerful man on Wall Street, J.P. Morgan…to support his wireless work.”

He had been “approached by James S. Warden, a lawyer and banker from Ohio who had relocated to Suffolk County,” purchased farmland and “christened his property Wardenclyffe.”

He offered Tesla land. On it, the laboratory was built along with a tower 187-feet tall. Below the tower a deep “ground connection” was dug. “In many ways, Wardenclyffe was the fulfillment of Tesla’s

dreams. For nearly a decade he had been planning in his imagination a system for broadcasting power around the world, and now that system was taking shape in the real world,” says Carlson. But then Morgan pulled out of the undertaking and Tesla faced huge financial problems. The tower was demolished in 1917.

As Alcorn, a retired teacher and librarian from Shoreham, explained in a presentation at the Suffolk County Historical Society, Tesla’s “plan and dream was to… provide wireless electricity to people around the world.” He was a “visionary” with ideas that would revolutionize the world.

He envisioned that not only radio signals but electricity could be sent far distances by linking into the resonance of the Earth. She said Tesla believed that if electricity could be “wirelessly” transmitted, people all over the world “would be able to tap into it”—for free

A lack of self-confidence negatively impacts quality of life. Having little self-confidence creates feelings of

• Inferiority to others

• Apathy

• Loss of enjoyment

• Anxiety, depression, and other mental health challenges

March Madness will be coming to an end this week with the culmination of the Final Four. The prestige of being one of the Final Four teams is unlike any other sport. In no other major or college sport is the idea of finishing among the last four teams celebrated as much, but that doesn't mean the remaining players and coaches are resting on their luarels.

In a season where the brackets were dominated by heavy favorites we find ourselves with potetntially the most dominat favorite in history. The reigning champion UConn Huskies were ranked near the top of the rankings all season long, before eventually steamrolling teams in the Big East tournament and eventually continuing that pure dominance in the big dance. UConn has had the best NCAA tournament ove rthe past 10 seasons, and many are saying this could be the best team of all time. Hurley and the Huskies grabbed

the #1 overall seed and proceeded to beat 7 teams in a row by double digits, beating the spread in each game. They wont on a 30-0 run against Illinois to get here and are still the clear favorite to win it all.

They will face the Alabama Crimson Tide. Alabama's offense has never been in doubt. All year long this running Tide team have routinely threatened 90 points and they can boast a claim for the best offense in the country. That offense has now had some complimentary defense and their run and gun style gives them just as much of a shot as anyone to take down the big, bad Huskies.

On the other side we have the Purdue Boilermakers and their remarkable season. Matt Painter has finally got the moniker off his back of 'the coach who can't win in the tournament' and much like Virginia they look for a massive rebound. Virginia was the first team to ever lose as a #1 seed to a 16 seed in tournament history and

returned the next season to win the championship. Last season Purdue joined that horrible list and they believe they can mimic Virginia's revenge type title run. There is plenty of reason to agree with them but the biggest reason is 7'4" Zach Edey. The nation's top player will be the focus and he will need to be stopped if Purdue will be thwarted in their march

for a title.

The only true Cinderella team will have to face Edey in North Carolina State. It is truly remarkable what State has done to get here. They were mere seconds away, and egregious blunders away, from being sent home against the Cavs. Instead they had a miraculous win, then went

on to win the ACC tournament, while playing 5 games in 5 days, and then continued to win. NC State has been underdogs in every big game they have played this month, and they have beaten the odds every time. NC State's futures odds since mid February look like the sort of thing a Hollywood movie studio would reject because it was unbelievable. They sat at 300-1 to win it all on February 13th, that went to 350-1 on Febrary 20th and finally 650-1 on March 6th.

It has been a fun March to get to the Final Four teams and the storylines write themselves. We will either have one of the most dominant teams of all time cut down the nets, or maybe it will be one of the most explosive offenses that we have watched in a decade. Perhaps it will be a redemption story for the ages, or a true underdog story come to life. Whoever is left standing when these titans finish their battle, we will have a story to tell.

A good rule of thumb is to review your documents every 3-5 years. Also, additional review may be warranted if there are significant life changes including altered health status for you or your loved ones, a death in the family, a new birth, or a divorce.

When reviewing your plan, here are some things to consider: Do you remember who you named as your healthcare proxy? Is that person still the best person to serve in this role? Are successors named? Every new health care proxy supersedes the prior one. How many powers of attorney do you have? Are they all consistent? It is not uncommon for individuals to execute new powers of attorney without revoking the prior ones. This can create a huge amount of confusion amongst multiple agents. For instance, mom

creates a power of attorney in 2015 naming her son as agent. A few years later, she sells her house and gives her daughter a power of attorney. Now there are two documents that are not consistent and this can be a recipe for disaster. We call this the “dueling” powers of attorney.

Too often we find that clients execute documents and forget about them. We want to avoid this because when emergency strikes, you want to be sure the documents reflect your wishes and do not leave your agents with ambiguities. Do not wait until this dire time to find out that you do not have the proper documentation in place.

We recently helped the family of a woman who suffered a stroke, leaving her with severely diminished mental capacity. The agent under the power of attorney came to the office to

learn about Medicaid planning to help with the cost of longterm nursing facility care.
