When assessing your insulation, remember to take care when entering ceiling cavities and watch for any electric wiring!! If insulation was installed post 1 July 2016, or is yet to be installed, you will need to determine whether the Regulations apply to your property and take the required action. You will need to determine the climate zone the property is in. You will then need to determine the appropriate type of insulation for the property, to ensure it is ‘qualifying insulation’. The Government tenancy website provides helpful information with respect to climate zones, insulation ratings and qualified installers. What do I have to do? Spring is here and Summer is on its way but let’s not forget that by next winter, July 2019, most residential rental properties are required to meet new insulation standards. Are you ready? Insulation standards The Residential Tenancies (Smoke Alarms and Insulation) Regulations 2016 sets out the standards with respect to insulation for residential rental properties. The Regulations provide that where ‘reasonably practicable’ residential rentals must have ‘qualifying insulation’ in the ceiling and floors. There is no similar requirement for wall insulation. If you are a landlord, you need to be aware of your obligations to insulate. Of course, there are some exceptions and qualifications in place for certain types of properties. However, if you do not meet one of the exceptions, and you fail to comply with the requirements set out under the Regulations by July 2019, a penalty of up to $4,000 may apply. If you are a tenant, entering into a new tenancy agreement, you should check your agreement to ensure an insulation statement is included.
