Short-Term Rental Rules & Regulations for the Association of Property Owners of the Hideout, Inc.

Approved by the Board of Directors of the Association of Property Owners of the Hideout, Inc. (“the Hideout”), the following will be added to the community’s Rules and Regulations regarding Short-Term Rentals:
DEFINITIONS
BEDROOM: A room or space containing a minimum of 80 square feet, designed to be used for sleeping purposes with two means of egress (one of which may be a window acceptable under the latest International Residential Building Code), a closet, and in close proximity to a bathroom. Space used for eating, cooking, bathrooms, toilet rooms, closets, halls, storage or utility rooms and similar uses are not considered Bedrooms. Space used or intended for general and informal everyday use such as a living room, den, sitting room, or similar is not to be considered Bedrooms.
DAY GUEST: A visitor to the Short-Term Rental property, but not constituting an occupant. Guests must be escorted by those with membership status or their “person in charge” from the Public Safety Gate Facility and to/from the dwelling. Owners must call the day guest into the gate prior to the Day Guest is arriving.
OCCUPANT: Person staying at the Short-Term Rental property overnight. A person located on the Short-Term Rental premises shall be deemed an occupant unless established otherwise by the Owner, Person in Charge, or Tenant and must be listed as an occupant on the rental application.
OWNER: Person having legal or equitable ownership of the Short-Term Rental property. If there is more than one such person then owner shall mean each such person, indvidually and jointly.
PERSON IN CHARGE: A person or agent with actual authority to represent the Owner for the purposes of contact and communication regarding the Owners’ Short-Term Rental. A Person in Charge must reside or have an office within fifteen miles of the Short Term Rental property and be able to act as the legal agent for the Owner. The Hideout must be notified, in writing, within fourteen (14) days if there is a change in the identity of the Person in Charge.
TENANT FAMILY: In accordance with the Hideout By-Laws, Article ll (L), “Tenants” means a person or persons entering into a lease of a private home of a Member. One couple and dependents OR not more than three unrelated adults are considered “tenants” for amenity use purposes. All others are considered “guests of tenants” and should not stay overnight for the duration of the rental term
SHORT-TERM RENTAL AGREEMENT: A Hideout issued document granting permission for the owner of a Single-Family Dwelling to use said residence as a Short-Term Rental.
SHORT-TERM RENTAL: Any residence in the community utilized as a Single-Family Dwelling rented for the purpose of overnight lodging for a period of up to 28 consecutive overnights, and not more than **10 times per calendar year. ** Enforcement of the 10 limit has been temporarily postponed. You will be notified of updates.
SINGLE-FAMILY DWELLING: A residential dwelling for one or more persons, each related to the other by blood, marriage or legal adoption, or a group of not more than 3 persons not so related, together with his or her domestic servants, maintaining a common household in such dwelling. (PC 11 5/11/70)
TENANT PRIVILEGES: In accordance with the Hideout By-Laws, Section 8 page 5: The Owner in good standing who leases his residential unit for occupancy shall be deemed to have assigned limited membership privileges to the tenant provided, however, that a copy of the lease or Association rental form shall be filed in the Office of the Secretary of the Association. By the mere acceptance of the lease and act of occupancy, the Tenant shall be deemed bound and shall abide by all guest, rental, and other rules, regulations, ByLaws and policies of the Association. Once membership rights are assigned by the Owner, the Owner shall not have privileges of use of the amenities or facilities. The privileges are reinstated upon expiration of the Lease. Neither the lease nor the Association rental form shall relieve or release the Owner from their obligations and responsibilities incident to their membership. If an Owner rents to another member in good standing, then the Owner need not assign their membership rights and privileges.
TENANT: For the purposes of Short-Term Rental rules in the Hideout, “tenant” shall refer to the primary individual who entered into an agreement with the Owner or Owners agent for the temporoary use of the Short-Term Rental for a period of up to 28 days/overnight periods
Short-Term Rental Agreement Required
No owner of any property in the Hideout shall operate a Short-Term Rental without first obtaining a Short-Term Rental Agreement from the Hideout and a municipal rental permit. Operation of a Short-Term Rental without such Short-Term Rental Agreement having been submitted and accepted in full is a violation of Short-Term Rental rules and maybe subject the owner of the lot in question to citations, fines, possible suspension of rental privileges, and review by the Hideout Disciplinary Committee.
Property Owners will be responsible for damages incurred by tenant(s)/tenant to any Association owned property and accepts responsibility of insuring tentants’ compliance with all rules and regulations, By-Laws and policies of the Association.
Only members in good standing may engage in a Short-Term Rental of their Single-Family Dwelling in the community. Any member who has registered their Single-Family Dwelling as a rental property and request the Hideout allow a guest or guests (a non-tenant) to enter the community, must accompany, escort, and be physically present before the guests will be allowed to enter the community. *On a rare occasion that you are not able to be present, please contact us for special permission to proceed.
Rental Packets will not be issued unless all POA fees are paid in full and the Short-Term Rental unit has submitted agreement paperwork in full.
Property owners are not permitted to rent their property to anyone who within the last two (2) years has violated the rules and regulations and in which case said violation constitutes a crime as defined in the PA Crimes Code.
*Property owners are responsible for ensuring compliance with any applicable state, county or local township ordinances or taxes related to operating a rental property.
*Last minute bookings during non POA business hours must be called into the gate, rental agreement submitted, and fees paid online prior to the rental party arriving. Noncompliance may lead to violations and penalties.
*Owners requesting to be an “Account Charge” must have funds in their account in order to cover each rental at the time of submission.
Short-Term Rental Agreement Requirements
A. Short-Term Rental Agreement applications shall contain all of the following information:
1. The name, address, email, and 24-hour telephone number of the Owner.
2. The name, address, email, and 24-hour telephone number of the Person in Charge if different from the Owner. A local person in charge shall have written authorization to accept service for the owner.
3. Municiple Township Permit issued by Salem or Lake Township
4. Signatures and date of signing for both the owner and/or the local Person In Charge .
B. A Short-Term Rental Agreement shall be issued only to the owner of the Short-Term Rental property.
1. A separate Short-Term Rental Agreement is required for each Single-Family Dwelling being rented as a Short- Term Rental.
2. A Short-Term Rental Agreement is effective for a period of up to 28 Days/ overnights and must be renewed for each new, subsequent Short-Term Rental, up to 10 Rentals per year. Enforcement of the 10 rental limit is temporarily postponed. You will notified of updates.
3. The Hideout will provide forms and procedures for the processing of Short-Term Rental Agreement applications.
4. Short-Term Rental Agreements are non-transferrable. If ownership of a Short-Term Rental changes, the new Owner(s) must complete a new Short-Term Rental Agreement form before renting out any part of the Single-Family Dwelling for a Short-Term Rental
5. The Owner or Person in Charge shall respond to Hideout Public Safety forthwith after being notified of the existance of a violation of rules pursuant to Short-Term Rentals or any disturbance requiring immedediate remedy or abatement. If the Person in Charge is not the Owner, they shall immediatley advise the Owner of any notification of a violation.
Short-Term Rental Standards
A. All Rental properties must obtain and submit a Lake or Salem Township Municipal Permit in order to rent their property. We will be strictly folloiwng the STR rules established by both the Lake and Salem Township regulations.
B. Occupancy of a Short-Term Rental shall be limited to no more than: Two (2) persons only per documented bedroom as per the township rules and regulations for STR.
C. The maximum number of day guests allowed at any one time into the Short-Term Rental, in addition to the occupants, shall be fifty percent (50%) of the maximum permitted occupancy of the Short-Term Rental. Owners are required to call Day Guests into the gate prior to the arrival of the Guests.
D. Amenity Badges: Three permanent amenity badges will be provided for each Lot to be used for any rental through the 2023 season. If anyone else in the rental party wishes to have amenity badges, those can be purchased for an additional non-refundable fee at the POA, Tues-Sat 8AM-4PM. Temporary badges will no longer be put in each rental packet. The primary rental group (not exceeding the indicated and approved maximum occupancy for your particular lot and consisting of no more 3 unrelated adults and their families) shall receive a packet with current Hideout information only. During the new homeowner orientation, owners of lots are provided with 6 amenity badges automatically, which can be used by your tenants during their stay if granted by the owner. Anyone over the age of 7 is required to wear an amenity badge at all times while in the Community common areas and to access the Community’s amenities (ski hill, golf course, Tiki bar, clubhouse, etc.). The permanent badges are required for any alcohol purchases.
Access to specific amenities, such as the pool, would require a pool pass sticker upon the amenity badge. Specific amenity passes can be purchased for an additional fee by the Registration Department or at that particular amenity’s facility.
E. Outdoor parking for occupants and day guests shall be limited to available parking areas on the Short-Term Rental property. In no event shall parking for Short-Term Rental tenants include spaces in any public street rightof-way or on any lawns or vegetated areas. A maximum of one car per bedroom is permitted for any Short-Term Rentals. Vehicles are to be a minimum of 5’ off of the edge of the common roadway.
F. A Short-Term Rental property shall not have any outside appearance indicating a change of use from the surrounding residential uses.
G. Neither Short-Term Rental occupants nor guests shall engage in disorderly conduct or disturb the peace and quiet of any neighborhood, neighboring lot, or person by loud, unusual, or excessive noise, by tumultuous or offensive conduct or creating a dangerous or physically offensive condition.
H. Overnight occupancy of recreational vehicles, camper trailers, and tents at the property where the Short-Term Rental is located shall not be allowed. Outdoor overnight sleeping of occupants or guests of the Short-Term Rental is prohibited.
I. All Short-Term Rentals shall have a clearly visible and legible notice posted within the residence containing the following information:
a. The name and Owner of the unit or Person in Charge and a telphone number at which that party can be reached on a 24-hour basis.
b. The emgency number sign for the lot and the lot number/street name, which would be provided to 911 or Public Safety dispatch if need be.
c. The maximum number of Occupants permitted to stay in the residence and the maximum number of Day Guests (50%) permitted at any one time.
d. The maximum number of all vehicles allowed to be on the Short-Term Rental proprety and the requirement that all guest parking must be parked in the available parking areas on the property, not in or along any private or common roadways or on any lawn or vegetated area on the property.
e. Household trash expectations and where to take trash/recyclables. Refuse shall not be left or stored on the exterior of the property at any time.
f. Notification that an occupant or guest may be cited and fined for creating a disturbance or for violating other provisions of the Hideout’s Short-Term Rental rules or community standards, including parking and occupancy limits
g. Copies of the Hideout Governing Documents – An initial booklet will be supplied by the POA. It is the owner’s responsibility to be sure the booklet is availabel to each tenant group. * please make arrangements to pick up your initial booklet prior to your first rentals.
Fees, Terms, and Renewals
A. Initial Registration fee of $1000.00 is required in order to register your Rental for the season, $500.00 to renew in subsequent years.
B. Short-Term Rental fees, payable to The Hideout upon the filing of a Short-Term Rental Agreement application, shall be as listed in the fee guides.
C. Any Short-Term Rental Agreement is good for the timeperiod indicated from the date of issuance until expiration and must be renewed with each new subsequent Short-Term Rental.
D. Short-Term Rental fee rates may be changed at any time by the Hideout Board of Directors after consultation with the Budget Commitee
Enforcement
A. Hideout staff, including its Public Safety Officers, shall have the authority to administer and enforce all provisions within the rules pertaining to Short-Term Rentals.
B. The issuance of a Short-Term Rental Agreement is not a warranty that the premises is lawful, safe, habitable, or in compliance with Short-Term Rental requirements.
C. If there is reason to believe than any provision of the rules of Short-Term Rentals are being violated, the Board of Directors or their appointee may or may cause through an authorized representative of the Hideout, entry onto the premises to ascertain the existence of Short-Term Rental violations. In those matters where the nature of an alleged violation is such that an inspection of the interior of a building or structure is necessitated, prior arrangements must be made with the owner or his agent to secure access thereof.
Marketing
The marketing of a Hideout based Short-Term Rental in which the advertised occupancy exceeds the maximum occupancy requirements permitted by these rules, or which promotes any other activity which is prohibited by ShortTerm Rental rules established by The Hideout, shall be a violation subject to a Failure to Comply citation, fines starting at $1,000.00 for the first violation up to $3,000.00 including the potential for suspension of property rental privileges for subsequent violations
Notice of Violation
If it appears to a Hideout staff member or Public Safety Officer that a violation of the Short-Term Rental rules exists or has occurred, the staff member or officer shall send a written notice of violation to the Owner or Person in Charge by email by US First Class postage mail. The staff member or Public Safety Officer shall identify the premises which is the subject of the violation, enumerate the conditions which constitute the violation, cite the specific sections of Short-Term Rental rules which are violated, indicate the action required to correct the violation, and provide a time frame (established by the staff member or Officer) to correct said violation. If possible, a phone call will be placed to the Owner or Person in Charge to inform them of the issue at hand and to have it remedied forthwith.
Nuisance
In the interest of promoting the public health, safety, welfare, and in an effort to minimize the burden on neighboring properties, Hideout management, employees, and the communities infrastructure by Short-Term Rentals, a violation of any of the provisions within Short-Term Rental rules is declared a public nuisance.
Violations and Penalties
A. Short-Term Rental rules and policies shall be enforced by Hideout staff, Public Safety Officers, the Hideout Disciplinary Committee, and/or brought before the local courts of Wayne County, Pennsylvania. Any legal disputes will be litigated at this venue location. Any person, partnership, corporation or other entity who or which violates or permits a violation of the Short-Term Rental rules of the Hideout shall, upon conviction in a summary proceeding, pay any fine costs per violation, plus all court costs and reasonable attorneys fees incurred
by The Hideout in the enforcement proceedings. Each day or portion thereof that a violation exists or continues to exist shall constitute a separate violation. Further, the appropriate staff member or Public Safety Officer of The Hideout are hereby authorized to seek equitable relief, including injunction to enforce compliance with all Short-Term Rental rules established by the community and its Board of Directors.
B. Illegal renting activities will result in the following fine structure:
a. 1st Offense: $1,000.00
b. 2nd Offense: $2,000.00 plus six (6) month suspension of rental privileges
c. 3rd Offense and subsequent Offenses: $3,000.00 fine plus permanent suspension of Short-Term rental privileges.
C. Any single-family dwelling registerd for short-term rentals that receives three (3) citations for violating any Hidout governing document within a calendar year shall be denied the abiltiy to rent that property for one (1) year starting from the date the third ciatation was issued.
Owners Severally Responsible
If the Short-Term Rental premises are owned by more than one owner, each owner may jointly and/or severally be subject to disciplinary action for a violation of The Hideout’s Short-Term Rental rules and regulations.
