Tourism conference to counter negative publicity BY VANESSA NARINE

THE PUBLIC relations fallout following the arrests of two American citizens for possession of ammunition has mired the Turks and Caicos Islands in a negative light. However, Premier, Dr. Rufus Ewing, noted that the TCI’s presence at a tourism conference scheduled to be held in New York City in June will be a platform that will assist the country in better countering the negativity. At a press conference last Friday (May 10), he said: “This is an unfortunate situation for people involved and in terms of the negative exposure.” Ewing, however, stressed that the TCI is a country that respects the rule of law. He explained that everything will be done to ensure that local officers in charge of enforcing the law exercise discretion when allowable under the law; expedite matters as quickly as possible, particularly where the issue is sensitive; and employ the best judgement in the execution of duties “I would hope that this was done,” Ewing said. The Premier added his assurance to the American authorities that everything will be done to ensure a thorough investigation takes place. Ewing said: “We, however, cannot interfere with the judicial process and ask from a political standpoint, from a government standpoint for any charges to be dropped.” He added that his administration is working with the Tourist Board to formulate a strategy to counter the bad publicity. “There is a lot to be done to counteract the negativity,” the Premier said. INVITATION Last Friday, the Tourist Board also finally broke their silence and issued a statement which said the developments in the matter are being

closely followed. As an act of good faith, the Tourist Board extended an invitation to any American official who wishes to travel to the TCI and experience, first hand, the tremendous amount of goodwill that exists here for the United States and its people. The statement said: “These are unprecedented events for our destination and are most regrettable for all involved, including ‘Brand TCI’. “However, the security apparatus at the airport functioned as it was designed to; now we need to find out how the facts surrounding these matters fit together. “A thorough investigation is currently being carried out by the Royal Turks and Caicos Islands Police Force, and the Minister and the board has complete confidence in

the country’s judicial process. “In the interim, we would like to reassure the travelling public that the Turks and Caicos Islands, remains grateful to all of our guests that have vacationed with us in the past and we are looking forward to sharing, with our American friends, the warmth and friendliness that have become synonymous with our brand.”

EVERYONE’S BUSINESS Opposition Leader, Sharlene Cartwright-Robinson, commenting on the issue, made it clear that tourism is everyone’s business. She said: “We need to realise what we are doing and look at our visitors as very important. They need to be welcomed and when they encounter a problem we need to treat them like gold.” Cartwright-Robinson added that

the Premier, who is also Minister of Tourism, has not made any tangible first steps towards the realisation of the vision he outlined for the sector in the House of Assembly last month. Ewing told Parliament that his vision for the sector is a strategy that puts emphasis on safety, security and services, ‘the three Ss,’ as he dubbed it. He explained that as it relates to safety, regulations are being looked at to ensure visitors can be safe when accessing TCI’s tourism products. When it comes to crime, the Premier maintained that his Government stands by its zero tolerance policy and is working together with the community, as well as other agencies, to provide tools and support police work. RESPONDING to concerns over possible motives behind the closure of Beaches Turks and Caicos Resort Villages and Spa, Premier, Dr. Rufus Ewing, put them to rest, making it clear that no such circumstances exist. Sandals Resorts International (SRI) announced last week that Beaches Turks and Caicos Resort Villages and Spa will temporarily close from September 1 and reopen on October 19, in order to undertake a wide-ranging enhancement programme. Last Monday’s announcement raised questions, particularly given its timing.

It coincides with the Government’s negotiation of a new development agreement that will cover both Beaches and what was formerly known as the Veranda, which was acquired by SRI recently. Also fuelling concerns was a report published in the Jamaica Observer, headlined ‘Beaches TCI pumping over US$60m a year in local economy’, which detailed the areas of the local economy impacted by the resort’s operations – everything from the locals on payroll to the utility usage Ewing stated that the closure will be monitored and in the event of an increase in bookings he will be in talks with SRI to address the

possibility of earlier opening. He added that he met with Labour officials last Thursday (May 9) and they are expected to be in touch with the organisation to ensure arrangements will be in place for employees who will be without work during the six week closure. The Premier noted that Cabinet, last Wednesday (May 8), reviewed the draft development agreement and is satisfied with its terms. The new agreement will replace the 2006 one, which was a source of contention. According to the Premier, the new agreement has been passed to the Governor for signing with the SRI developers.

Up to the end of the financial year 2012/2013 in March, before the negative publicity, the Premier reported that March was the best month for tourism for the Island, with over 90 per cent of hotels reporting 100 per cent occupancy. This stellar performance he credited to the investments made by the former administration in promoting and marketing the TCI and partnership with the industry’s stakeholders, as well as bringing investors and developers to the Islands.

Ewing maintained that the entire settlement of the development agreement was transparent. According to him, the new agreement reflects an improvement in the duty rate, in terms of concessions they get; and all immigration matters have been taken out of the agreement. The 2006 document included immigration clauses, a move that was contrary to the immigration ordinance. The Premier stated that SRI will have to conform to regular immigration procedures, the only concession being the use of a particular immigration protocol that allows for faster processing for major investors in the TCI.

Confidential settlements defended as ‘practical’ BY VANESSA NARINE INVESTIGATIONS by the Special Investigation and Prosecution Team (SIPT) and the Civil Recovery Programme (CRP) have yielded significant returns to the country’s taxpayers. However, some of the confidential settlements agreed on have come under question, the most recent being the $12m settlement with Sandals Resorts International, owned by Jamaican national, Gordon ‘Butch’ Stewart. That settlement drew criticism from beyond the shores of the TCI. Executive director of the National Integrity Action (NIA), Professor Trevor Munroe, in a letter dated January 24 called attention to what he described as inequality as it relates to the laws governing the rich and the poor. In his letter the NIA director said: “The matter dealt with therein involving Sandals and the Turks and Caicos Islands Government is attracting wide spread attention from not only citizens of the Turks and Caicos Islands, but as well persons throughout the Caribbean and wider afield. “One aspect of public concern and attention relates to a fundamental principle of the rule of law and of democratic governance, namely, that there should be one law for the rich and for the poor, one law for the connected persons and for the man in the street. “In relation to this fundamental principle, Caribbean people have been, for decades, distressed at its inadequate application in so far as the perception, and I dare say to a significant extent the reality, is that the full extent of the law is applied to the ordinary citizen while the wealthy and the powerful find ways to get around the law. “Within recent times, the issues of arrest warrants for highly placed

politicians and private sector persons by the authorities in the Turks and Caicos Islands, as well as in Cayman, have provided some reassurance that traditional ‘untouchables’ are not beyond the reach of the law.” PRACTICAL However, a May 8 report by Edwards Wildman Palmer, the international firm undertaking the CRP here in the TCI, claimed the confidential settlements are practical. The report published on the Association of Corporate Council’s website, www.lexology.com, said: “Some civil defendants have elected to settle rather than take their chances in court. “However, the practical reality is that many parties would not settle without the comfort of confidentiality, and this could lead to lower recoveries and higher fees; and particularly prior to the commencement of civil proceedings, confidentiality provides an additional incentive to defendants for quick settlements.” The firm acknowledged the argument in their report that no settlements should be confidential following a corruption investigation. However, also stated that from the outset, the Government has agreed to keep settlements broadly confidential consistent with it accounting for cash and land recovered so that the success of the programme can be judged by the people of the Islands. The report said: “It is important at the outset of an asset recovery programme objectively to analyse the advantages and disadvantages of pursuing civil and criminal routes for each case.” It also addressed the key characteristics of a good asset recovery programme. The report said: “We have sought to identify the key characteristics of a good civil asset recovery programme on the basis of our experience over

the past few years working in the TCI. “We hope that other government and anti-corruption bodies that are embarking on a corruption investigation of this nature may find them helpful. We have broken them down by key stages.” According to the report, the initial stage saw the firm making all efforts and embracing the use of a rage of civil and criminal mechanisms, as well as appointing key contacts at each department. As it relates to the proceedings, the firm reported that its procedures included selecting a balance of cases, which include those with the potential for early success as well as more complex issues, that may take time; focusing on a manageable number of cases and key issues; and allowing for confidential settlements consistent with the Government’s need to account publicly for recoveries as well as for the cost and benefit of the programme. The report added that the firm has maintained contact between the key decision-maker at the level of client and advisers. RESULTS The asset recovery programme in the

TCI is still on-going. The results to date of the programme have seen the Government making over 50 civil recoveries since December 2009 and a number of further trials scheduled for 2013. Cash recoveries by the Government in respect of civil recovery claims (some jointly with SIPT) total $15.9m. A further $1m has either been agreed to be paid or has been ordered to be paid, and is in the process of being collected. Additionally, some 2,447 acres of land has been recovered to date by the Government and is now registered in the Government’s name. The proceedings against the developers of Salt Cay were highlighted in the report as the largest proceedings undertaken to date by the Government in relation to the issues identified in the Auld Report. The report said: “They involved a dispute over 1,500 acres of land on Salt Cay, which had been acquired by the developers over a period of almost ten years partly from the Government and partly from other private owners. “The developers planned to construct a luxury hotel and villa complex with golf course and leisure facilities at a cost of over $200m.

“The Government’s claim was that the developers had bribed the Government to obtain the land and necessary development permissions. These claims were strongly denied. “The allegations principally involved the issuing of credit cards to certain ministers where balances were allegedly settled by a third party; the gift of 50 per cent of the shares in one of the development companies to a relative of a minister; and a substantial loan to a minister which had been granted by a third party. “The developers denied that any of these transactions were bribes. “The Government’s claim was issued in April 2010 and was defended by the developers who did not admit liability. “In August 2012, after several years of claims and counterclaims a civil and criminal settlement was reached. “The developers agreed to pay $7m and return land totalling 1,500 acres to the Government. “There was no admission of civil or criminal liability.” Edwards Wildman Palmer was appointed by the Attorney General in December 2009, to conduct a civil investigation into the allegations of corruption identified in the Auld Report.

Opposition Leader questions cost of change

THE POSSIBILITIES associated with education sector reform have been the focus of many stakeholders. And one of those possibilities is the change in curriculum, from the current CXC system of assessment. Opposition Leader, Sharlene Cartwright-Robinson, questioned the risk of diminishing regional ties if the CXC system were to be abandoned. This is of concern at a time when Premier, Dr. Rufus Ewing,

has committed his administration’s efforts to fostering greater ties with the Caribbean Region. She stated that the cost of change must be carefully considered. In response, the Premier said the two, curriculum change and fostering greater regional ties, can both happen. He said: “I think we can still build regional ties and have a curriculum that best suits our environment. “This is why we need the

consultation so that whenever we make a decision on anything, the curriculum we decide on is one that meets the need of this country, which are different from the needs of other Caribbean countries. “I think we should wait for the outcome of the consultation and then sit and strategize.” Ewing maintained that the outcome of the consultations should not be pre-empted. Misconceptions surround education consultation – Missick

THE NATIONAL consultation commenced last Monday and has met with criticism by the Opposition. But Education Minister, Akierra Missick, adding clarification on some of the criticisms voiced at a press conference last Friday (May 10), noted that there are misconceptions surrounding the Island-wide consultation. She acknowledged that the turnout at the first session in Providenciales was poor, but noted that the second session was better. Missick stated that the consultation lasts five weeks and much work was done to make the public aware of the focus of the sessions. She said: “I think the challenge that the Opposition Appointed Member [Oral Selver] is faced with is this system was put in place when he was Minister and basically we are moving forward to a new age and

Fenimore’s statements were unfair - Premier BY VANESSA NARINE PREMIER, Dr. Rufus Ewing, minced no words when he responded to former president of the Chamber of Commerce, Tina Fenimore, calling her comments on the Chamber’s engagement with his administration unfair. Last week in an exclusive interview with the Weekly News, Fenimore said the Government, as it relates to policies and decisions that affect the local business community, is functioning like “a ship without a rudder” by ignoring the expertise within the community. She charged that the Chamber offered its expertise by requesting to sit on key boards that make decisions that affect the business community, but had not been taken seriously. Fenimore also said better public private partnerships could have been fostered to better deal with the challenges facing the local economy. “Working with the Government has been frustrating and it does not have to be that way,” she said. On Friday (May 10), Ewing pointed out that his administration has an open relationship with the Providenciales Chamber of Commerce, He said: “Even before the elections I sat and engaged them…. the Minister of Finance engages them regularly.” On the question on the Chamber’s

POSSIBLE CXC CHANGE On the issue of a possible curriculum change, Missick made it clear that the focus of reform is to fix what is broken. “The system is very broken,” Missick said. She pointed out that while CXC is a system of assessment that is largely focused on regional issues, awareness of global events is also important. She said: “The problem we are finding is that the curriculum needs to be expanded so that there is more global knowledge, not just regional knowledge. “It is good to know about Norman Manley, but also good to know about Adolf Hitler. “This is why we are looking at how we can strengthen the current CXC curriculum or if we should look at another curriculum that would have a more global, holistic view of the world or if we should move to the International Baccalaureate Programme, which is taking the

world by storm…this is what the discussion is about.” The Education Minister noted that the focus is change simply to better equip students. Missick said: “We are not trying to do away with anyone that has CXC qualifications or anyone that teaches that…at the end of the day the CXC is an exam…the skills the person has can be transferred.” Turning her attention to a possible exodus of teachers, she noted that it is not likely to be on the grounds of reform, but on the basis on remuneration, particularly with the current financial state of affairs in the TCI. Missick added that if extra training is needed, it will be facilitated either through distance education or rotation of teachers. She said: “We don’t have to have a new curriculum, but focus on strengthening the end result of the current curriculum.” The Education Minister stressed that change will come and it is better to embrace it. “We can be the flagship for this kind of change,” Missick said. The national education consultation ends in first week of June, at which time a report is expected to be complied with plans for the Government to implement changes in the new school year 2014/2015.

He stated that like the Tourist Board, different stakeholder agencies have been developed to ensure representation of everyone. The Premier said: “The Chamber of Commerce is made up of several different corporate entities and if they want representation of their executives on boards, then that is something that can be discussed. “That request has never been made…. we have no problem with catering to requests for greater representation of stakeholders.” This was a point endorsed by the Minister of Border Control and

Immigration, Ricardo Don Hue Gardiner, who maintained that no such request for representation was made. He said: “In any event there are six Chambers in the TCI…people have to be realistic….there has been no contact with the Chamber, no representations made to the Ministry and this is the first time I hear about this.” The Administration’s last public engagement with the Chamber was made by the Minister of Finance, Washington Misick, who was the main speaker at the Chamber’s last meeting on April 29, where he addressed the TCI’s return to sustained economic growth and stressed the importance of public private partnership.

THE MAJORITY of investors’ interests have been in Providenciales recently, but in the last week the current administration has looked into three major developments for the nation’s capital, Grand Turk. Premier, Dr. Rufus Ewing, last week, gave his endorsement for the Dolphin Cove Project. He said that the developers’ town hall meeting was well supported and since residents support the development, the Government will stand by the peoples’ wishes. However, Ewing pointed out that the developer still has to meet the requisite requirements of the Planning Department and secure the requisite permissions before going ahead. Dolphin Cove’s fifth ‘swim with the dolphins’ park will be a $3m investment. The Premier added that Cabinet, last Thursday (May 9), also reviewed the terms of a

Memorandum of Understanding (MOU) for the development of a marina in North Creek, Grand Turk. He said Cabinet recommended changes to the development and those were sent back to the developers. Ewing said the document will be finalised in collaboration with the Attorney General (AG). The Premier added that the White Sands Resort is another development scheduled for Grand Turk. The resort’s development would mean a 168-room hotel in the nation’s capital. Ewing said the developers have presented a MOU and Cabinet reviewed the terms, most of which were agreed to and the changes recommended and sent back to the developer. He stated that efforts are being made to settle on all three developments.

Shooting incident a code of conduct issue

PREMIER, Dr. Rufus Ewing, promised a thorough investigation after concerns were raised that Minister of Immigration and Labour, Ricardo Don Hue Gardiner, was at the scene of a shooting incident. And last Friday (May 10), he said the investigation is on-going. The Premier made it clear that no criminal charges have been brought against Gardiner and nothing has been evidenced to suggest the same. However, Ewing noted that as a matter of accountability, the issue remains a procedural one for the House of Assembly and the Integrity Commission, as it relates to determining whether a code of conduct was breached. The son of the owner of Royal Jewels, Sanjay Tolani, was arrested last month for discharging his firearm on the sidewalk opposite Danny Buoys Restaurant in Grace Bay at about 1.40am. He was taken into custody but later granted bail with surety to return to the police station at a later date. According to police, the 26-yearold shot a single bullet from his firearm on the pavement of the road which resulted in two bystanders, a male and a female, in the vicinity being injured by splinters from the

ricochet. They were taken to the Cheshire Hall Medical Centre in Providenciales where they were treated for non-life threatening injuries and later released. The Minister, according to eyewitnesses, was on the scene. When the issue was made public, Ewing said: “Persons in public life, including members of Cabinet and of the legislative and judicial arms of Government, should conduct themselves throughout, in a manner that is befitting of the offices that they hold.” (VANESSA NARINE)

Significant revenue from work permit fees REVENUE from work permits and residency fees as of February totalled some $8.9m, an increase of more than $3m from August 2009 when the amount was only $5.9m. Minister for Border Control and Labour, Ricardo Don-Hue Gardiner, reported to the House of Assembly at its last sitting that as of March some 1,195 work permits were issued. These included 73 to selfemployed persons, 813 to skilled or professional persons, and 1,039 for unskilled labour. He noted that the breakdown on an island by island basis will be laid before the House at a future sitting. Commenting on the numbers, Opposition Leader, Sharlene CartwrightRobinson, stated that the Government seemed to be using the issuance of work permits as a source of revenue, rather than based on the actual need balanced against the local skills pool – a dangerous pitfall. The Minister of Border Control and Labour had strong words in response to CartwrightRobinson’s comments, calling it

“absolute nonsense”. Gardiner explained that the Government has an obligation to the people of the Turks and Caicos Islands, both Belongers and permanent residents, as it relates to employment. The Minister made it clear that the Government’s say is limited to creating policy to support employment for the people of these Islands and attracting investments that would advance job creation; any decision other than that is guided by the Immigration Policy. According to him, it is okay to sit on the other side and criticise, but maintained that Government “spends countless hours” working for the people of the TCI. He said: “We are here every day seeking ways to introduce new employment opportunities… the Opposition has never come up with solution.” Gardiner stated that rather than criticise, the Opposition should come up with constructive comments. “It is a ludicrous comment,” Gardiner stressed. School separation will take some time STUDENTS and teachers at the overcrowded Clement Howell High School in Providenciales could have to wait until next year for the anticipated split of lower and upper forms, Education Minister, Akierra Missick has advised. The separation of the first and second formers, and possibly third formers, at the school is intended to, among other things, ease the tension among students at the Blue Hills location. Responding to a query last Friday at a press briefing, Minister Missick urged patience as the procurement process for the new building is still on-going. The building that has been identified so far is the Whole Gospel Christian Academy on Leeward Highway. She said the property has been evaluated by the relevant Ministry and the price of commercial rental and/or for refurbishments to the location, should the students be moved there, is being worked out. Missick also advised that a tender will be going out for any other property to officially apply for consideration, so as to facilitate the earliest movement of the students. She said: “These procurement rules are very onerous, they are very detailed and we as a government, we are walking the path. “The general public has to understand that, as much as I would like this to have happened in December when the idea came about, we are now in May and we are still following these procedures and we are not even towards the end yet.” The Education Minister remarked that various stumbling blocks are still being crossed and tweaks made to aspects of the procurement rules. As regards the overcrowding issue at the school, Missick commiserated with the students and teachers and sought to explain the cause of the problem and the steps her Government is taking to alleviate the same. According to her, the building was built to facilitate some 300 students but now accommodates approximately 900. She said: “When things were absolutely amazing in the Turks and Caicos Islands, and everyone was financially prosperous, you had a lot of new and private schools opening up. “Now that we are feeling the pinch in the wallet, the numbers in the school will keep continuing to increase as children transfer from private institutions or institutions from other islands, as Providenciales is the mecca for people to move to for work. “That is where we continue to see an influx of students and the

ratio between students and teachers, which on a holistic global scale is one to 19, but then you have a school in Middle Caicos with 14 students, and then you have Clement Howell with 900 now.” The Minister assured that her Government is looking for a workable solution for all involved. She said: “We will look to address these concerns whether it is continuously moving on to splitting the lower and upper forms of Clement Howell, or finding the magic number to build a new high school. “In turn, we hope the split happens this year, if anything, it may go into the new school year.” The school has reported a number violent episodes and other inappropriate behaviour among students and outside forces within the past several months. When asked by the Weekly News what the cause(s) of these violent encounters were, principal of the school, Gerald Persaud, noted that there a lot of factors involved, only one of which is the overcrowding situation at the learning institution. “It starts from the community. There is a lot of tension in the community and so when students come into this one environment they bring all their tension here and that is causing all the risks,”

Persaud said. He also raised the issue of the need for additional teachers at the establishment, which the Education Minister also addressed last week. Persaud noted that with the proposed expansion of the school, there will be a need for more teachers. Minister Missick had acknowledged, during last week’s press conference that schools on the Islands do have a need for more teachers. She further acknowledged that a mass exodus could soon happen because teachers are not being remunerated properly and because of contract renewal issues. Missick also alluded to the problem of security with the Providenciales high school. The Minister said: “A big issue with security with one of our high schools in Provo, a lot of contract teachers are not willing to renew their contracts until there can be some sort of assurance that these sort of activities will not be continued on the property.” She noted that discussions will be conducted with students, during the education consultation, as to why they are being disruptive during school hours, and how the Ministry can design ways to keep and direct their interest properly. Finance Minister optimistic about lowering debt FINANCE Minister, Washington Misick, has projected that by 2016 only $85m of the Turks and Caicos Islands’ debt will be left to be repaid and refinanced. The United Kingdom guaranteed a $260m loan when the country faced difficulties and it was necessary to finance the deficits from 2007 onwards and to repay all outstanding creditors. At the beginning of the 2012/2013 financial year, the TCI’s national debt was a massive $228.7m. These included loans held by TCIG totalling $214.6m and $14.1m held by the statutory body TCInvest, but guaranteed by TCIG. To date the remaining debt stands at $170m. However, Misick, in an interview with the Weekly News last week noted that the TCI has one of the lowest debt rates compared to other countries in the Caribbean and even in Europe. According to the Minister, the Fiscal and Strategic and Policy Statement (FSPS) projections, as it relates to debt repayment, places the

TCI in better standing. He said he was confident that the TCI would be able to refinance its remaining debt come 2015/2016, as well as have more control over its operating surplus. Currently, because of the extent of the debt, only $2m of the operating surplus for any year is available to the Government, the rest being deposited into the sinking fund which was created to help pay down the national debt by 2016.

No increase in firearm fees (extract) Dear Editor, I am extremely perturbed after lending ears to a public statement made by the Commissioner of Police Mr. Colin Farquhar, in regard to increasing the ‘Keep and Carry’ firearms licence from $400 to $800. I find it extremely perplexing that the Commissioner of Police would make such a decision and public statement claiming that carrying firearms in the TCI is not necessary, when he himself created the potential havoc by flooding the streets of the TCI with guns and ammunition, all in the name of revenue collection. As a widely experienced police officer from such a large country, I would expect the Commissioner of Police to be more proactive, rather than reactive. An additional statement made by the Commissioner that qualifying for future ‘Keep and Carry’ licences in the TCI may be focused on risks in the security sector.

This is simply bosh and should have nothing to do directly with the security business. With the increase of crime in the TCI, the Commissioner of Police should appreciate more seriously the value and security of personal life of all (family, home, property, personal business) rather than the protection of a specific group, money and valuables in the context of the security business milieu. To cut the chase and get to the meat and potatoes of what I would like to express; I do not support or encourage the Commissioner’s decision to increase ‘Keep and Carry’ firearm licence fees from $400 to $800 with some abstruse justification that carrying a firearm in the TCI is not necessary. I also do not support the Commissioner’s decision that ‘Keep and Carry’ firearm licences in the future may be directly focused on risks in the security business in the TCI. This is nonsense. many responsible ‘Keep and Carry’ firearm licence holders (ordinary individuals) in the TCI who have more legitimate and just reasons to carry a concealed firearm on their person than any security guardsman and should not have to dish out his/ her life savings to do so. Therefore the Commissioner’s justifications to implement these new changes is unmerited, a slap in the face and clean cut discrimination to legitimate responsible law abiding firearm licence holders in the TCI. By way of this article, we the legitimate and responsible licenced firearm holders of the TCI are pleading to the Commissioner of Police to reconsider his decision and not implement any further increase on firearm license fees which are already at an excessive and unreasonable cost and the highest in the region. I suggest the Commissioner of Police meet with the gun club and licensed firearm holders at the earliest to jointly brainstorm innovative and acceptable alternatives. In addition, I encourage other ‘Keep and Carry’ licenced firearm holders to speak out and address their concerns publicly and/or personally with the Commissioner of Police Mr. Colin Farquhar. If we fail to speak out, the Commissioner of Police will pursue his plan to eradicate the less fortunate from obtaining the privilege to legally protect themselves and their families while away from home. Premier calls for Opposition to ‘stop complaining’ THE USE of time in the House of Assembly was an area of contention between the two sides on Friday. Leader of the Opposition, Sharlene Cartwright-Robinson, said the Government is not only waiting until the last minute to call a session, but Government Ministers are also misusing the House’s time, hardly ever completing the agendas that guide the session’s conduct. She pointed out too that the slot of time assigned for ministerial statements is being “abused” by Members of Parliament (MPs), who launch into litanies that could be made at different forums. However, when asked for a response to these criticisms, Premier, Dr. Rufus Ewing called for the Opposition to “stop complaining” and made it clear that there was adequate time to address the business of the House. Ewing said: “The ministerial statement is a provision where we exercise our prerogative and we will continue to give it. “In the interest of time some ministers will not give a statement… we as Ministers have the obligation

to give a complete picture of what is happening. “I am sure public appreciates this. Sometimes even the press conferences do not have the time to give a whole picture.” The Premier stated that as it relates to the House’s legislative agenda, if less questions were asked the House’s business may be completed faster. He said: “If less questions are asked then yes we can complete the agenda…the questions are their opportunity to so call ‘shine’ and be in the spotlight and the ministerial statements is our opportunity to be in the spotlight and shine. It is politics.” The Opposition Leader maintained that questions are on the table for several reasons - to create awareness of issues that sometimes go under the Government’s radar, to hold Government accountable, and to request information. “It is the role of the Opposition to provide oversight,” she stressed. Two separate American tourists on two different days were found to have one 9mm unfired bullet in their luggage. One tourist was a 60-year-old woman accompanied by her husband and the other an 80-year-old retired brain surgeon accompanied by his wife. If they had handled the bullet(s) their fingerprints would be on it. If another person’s fingerprint was present the tourists could be instantly cleared. If there were no prints, someone wearing gloves or wiping the bullet

clean handled the bullet. Who wears gloves while handling or inspecting luggage? What are the tourists’ MO? If the police performed a fingerprint test and the tourists’ prints were found, the arrests were proper. Otherwise the judge should have thrown the cases out and apologised to the tourists. These single bullet incidents with American tourists follow up the Airport Road shut down and the firefighters’ flight arrival and departure shut downs performed by the former and present members of the Government. Two high ranking USA senators, one Democrat, one Republican, have joined hands to check on the bullet

cases and this follows physical attacks on American tourists by a TCI master criminal whose MO is well known. What will be the next step by the USA Department of State? TCI is now under a microscope reaching the office of Secretary Kerry. The six-week shutdown by Beaches will pale by comparison to what may be coming. The nice letter by the Tourist Board will not heal the wounds inflicted by this Government and this police department. TCI has been going backwards since late 2003. Will we soon need grants and aid?

Governor in London for leadership event THE FOREIGN and Commonwealth Office’s (FCO) annual leadership opened in London on Monday and Governor Ric Todd is in attendance. The five-day session, from May 13 to 17, is currently being held in the Queen Elizabeth II conference centre. The event is attended by UK Ministers; senior officials from the FCO and other Government Departments; and Governors of the UK Overseas Territories, Ambassadors and High Commissioners from around the world to discuss policy, activity and to share ideas and experience. Discussions are taking place with stakeholders including parliamentarians, business leaders and commentators. The Governor, who left the Islands last Friday (May 10) to attend, is expected to take the opportunity to meet UK ministers to update them on the situation in the TCI. He will also lead one session in the margins of the main events where he plans to provide a personal account of the

challenges of leading a technocrat interim administration and returning TCI to self government. Attorney General Huw Shepheard was sworn in as Acting Governor until Sunday (May 12) when the role was transferred to the Anya Williams. She recently returned from the Commonwealth Secretariat’s Caribbean Head of Public Service leaders’ conference in St Lucia followed by two days personal leave. This arrangement will continue until Governor Todd’s return to office on Monday, May 20.

Clerveaux appointed to top Gov’t role THE OFFICE of the Premier and Ministry of Tourism is to be strengthened by the appointment of Permanent Secretary (PS) Wesley Clerveaux to oversee and develop its portfolio. The announcement came last Friday (May 10) and the new joint office was set up by the Premier’s recent ministerial reshuffle. Clerveaux was transferred from his role as PS in the Ministry of Government Support Services (GSS) on Monday (May 13). He is now acting PS of the new office and will assist the Premier in overseeing all ministers and ministries in the Government. He plans to make use of his wealth of government knowledge and experience, having served several

years in a range of ministries. The permanent full-time rank and office of the senior civil servant in the Office of the Premier and Ministry of Tourism will be decided in the future. This appointment was initiated by the Deputy Governor, Anya Williams, in consultation with Governor Ric Todd. Premier, Dr. Rufus Ewing, has also welcomed the move as a key aspect of his delivering on his manifesto commitments, and also to fully engage his Ministry in the budget planning process. Ian Astwood has been appointed as the Acting Permanent Secretary in GSS where he will be assisted by recently appointed Deputy Secretary Russell Cox.

Two burglaries reported to police A NUMBER of incidents were reported to police between last Thursday and Friday (May 9 and 11) in Providenciales. One theft was reported in the Lower Bight area and several items were stolen, including an Apple IPhone 5 64G. Another attempted burglary in Five Cays was also reported and being investigated by the Royal Turks and Caicos Islands Police Force (RTCIPF). Two more burglaries were reported on Sunday (May 12) in Five Cays and Discovery Bay, and a sum of cash and clothing were reported missing. The theft of one peddle bike was

also reported stolen on Sunday. A more serious incident was reported over the weekend and police are investigating an incident of assault occasioning actual bodily harm. Police are appealing to anyone who may have any information about criminal incidents to call 911 or Crime Stoppers anonymously on 1-800-8477. TCI prepares as hurricane season approaches AS THE 2013 hurricane season approaches, the Government has stepped up its drive to make residents more aware and prepared for the effects and damages of this natural phenomenon. In a new approach to disaster preparedness, the Department of Disaster Management and Emergencies (DDME), has launched a week of activities, themed ‘ Be ready, it only takes one storm!’ to further educate and ensure persons are prepared for any eventuality come the start of the season on June 1. At a press launch held at the Leeward Highway, Providenciales headquarters, Deputy Director of the department, Sophia Mitchell said the week of activities is to improve on the nation’s readiness. She said the rationale behind the initiative is that preparedness efforts need to start as soon as possible and that knowledge and awareness are imperative to this. This year there are predicted to be 18 main storms, nine of which are expected to become hurricanes with four possibly being category three or greater, Mitchell said. She added: “The forecast also notes an above average probability for major hurricanes.” The activities planned for the week include island wide communications tests to ensure communication lines are up and running within the territory as well as with the subregional focal point, Jamaica.

Two new public prosecutors appointed THE OFFICE of the Director of Public Prosecutions last week appointed two new public prosecutors, Shantelia Hall and Clement Joseph. Joseph, of Dominica, who joined the Office on May 1, was previously a police officer in Dominica and a human resource manager with the US Army. He attended the University of West Indies in Barbados where he obtained a Bachelor of Law Degree followed by a Legal Education Certificate from Hugh Wooding Law School in Trinidad and Tobago. Joseph joined the prosecution service in Dominica in June 2010 and was admitted to the Bar of Dominica in October 2010. Hall, of Grand Turk, who joined the office earlier on April 15, previously attended the University of Buckingham where she received LL.B. Hons. Hall was admitted to the Bar of England and Wales in November 2010 and the Bar of the Turks

and Caicos Islands in June 2011. She has experience working with the TCI Supreme Court and was a member of the Royal Turks and Caicos Islands Police Force as Special Constable and instructor at the RTCIPF Training School. The Office of the Director of Public Prosecutions also consists of Director of Public Prosecutions, JoAnn Meloche, Deputy Director of Public Prosecutions, Angela Brooks (Grand Turk), Senior Prosecutor Leonard Franklyn, Senior Prosecutor Latisha Williams, (Grand Turk), Prosecutor Samantha Williams-Glinton, Prosecutor Leanna Brooks, and Prosecutor Oreika Selver. They must also ensure there is adequate drainage and he advised persons to get their properties insured. The Premier said: “The Government is still engaged with the Caribbean Catastrophic Risk Insurance Fund that we can access after a certain level of intensity of storm passing our way. “So you likewise, as regular citizens also need to insure your property, cars, homes etc. You need to ensure your food supplies are well

stocked and you are prepared.” He also stressed the importance of volunteering and helping one’s neighbours during this time. “Hurricane Ike is a good lesson and I hope those of you who have passed through it would remember those experiences and would learn from those experiences that Hurricane Ike provided to us,” the Premier reminded. Opposition Leader, Sharlene Cartwright-Robinson, in a statement, congratulated the DDME on the bold step and expressed her pleasure that the Minister of Government Support Services had committed to supply the essential resources needed to ensure that DDME is able to be effective. She said: “We are therefore expecting that shelters will be made ready; shelter managers will be

properly trained and in place, and that adequate personnel are ready to be mobilised, be they in the Government or volunteers, enlisted from the private sector. “It is important that the Government plays its part and take disaster preparation and management seriously having now had the experience of Hurricane Ike and its devastating consequences,” Cartwright-Robinson said. Meanwhile, daughters of the Opposition Leader, A’Janea and Laci Robinson, shared with the gathering, their experiences during Hurricane Ike. In an emotional recitation of that period the sisters recounted how their family had to seek shelter and aid from neighbours when the storm destroyed their home. Past president of the Rotary Club, Art Forbes in remarks stated that the TCIG needs to ensure that disaster risk management is strengthened at the national level and incorporated into key sectors like tourism, planning, health and education, among others. Forbes: “We need to enhance community resilience in the other islands to mitigate and respond to the adverse effect of climate change and natural disasters… greater efforts need to be made in advancing actions that support a holistic approach to disaster management and building resistance in spite of challenging human and financial resources. “In moving forward we need to be smart, we need to be efficient and effective in our approach to disaster risk management. “We need to develop and leverage our national work programmes to mobilise financial resources.” He further suggested recruitment of adequate in-house personnel to draft proposals to attract regional and international funds for these programmes. Causeway work to be completed in June WORK is progressing at a steady pace on the causeway between North and Middle Caicos. Premier, Dr. Rufus Ewing, when asked, noted that construction is expected to be completed by the end of June. Currently there is some traffic interruption as redevelopment works go ahead, but one lane remains open to cater for traffic between the Islands. Wesley Clerveaux, former Permanent Secretary of the Ministry of Government Support

Services, said: “We believe that the improvements made in the design of the causeway will improve water flow thus permitting greater water exchange for mangroves and also improve the resilience of the causeway.” Cove Construction was awarded the $2.042m contract last September - the extent of repairs meant an increase from the initial $1.35m allocation. The works include the reconstruction of the causeway

including filling and resurfacing both the bridge and its approaches, improving the barriers that protect the causeway from tides and winds, and repairing the bridge’s waterproof membrane. It also includes replacing the existing street lights with new solar powered units, removing casuarina trees and replacing mangroves. The North and Middle Caicos Causeway was constructed in 2007, but suffered massive damage caused by Hurricane Ike.

Squatters given 30 days to move

ALTHOUGH 30 day notices have been issued to squatters on Crown land in Five Cays, the Department with oversight for Crown Lands is not taking a strict ‘move or be moved’ stance. In an invited from the Weekly News, Director of Crown Lands, Leroy Charles, however advised that all possible ways to have these persons moved within a timely fashion will be considered before final action is taken. Last Tuesday, May 6, the department, along with the Department of Environment and Maritime Affairs, the Royal Turks and Caicos Islands Police Force and other social groups in a joint exercise issued notices to squatters along with persons constructing illegal buildings on Crown land. Charles said: “It is always a difficult thing. I know there are social issues involved and that is why we have the Social Department on board, the Red Cross, the Human Rights Commission, the Immigration Department and the Social Security Department. “And may I say that some of these people are illegal immigrants also and you will have to look at it in the context of what is taking place in Providenciales,” Charles told this publication. Pointing to the crime situation, the

Director stated that disobedience of the rule of law in one area can very well lead to the same unacceptable behaviour in another. Charles said: “If we have people who are not obeying the rule of law, those very people are likely to be the people who do the attack on peaceful citizens, because they may not be able to seek employment and so forth. “But they have to live, so they go and they rob and they take refuge in these illegal settlements, so it may be a haven for criminals.” He noted that these issues are being taken into consideration. Charles is advising those who are having difficulty finding alternative housing to contact the above named social bodies for assistance. He said: “I think we have involved all the stakeholders, we have had meetings about this. These settlements are developing very quickly… so that is our problem. We are trying to contain them in the first instance. “We have a programme that is designed to address the issue, but what we are finding is that these things are going up overnight and it is getting out of control.” On Friday, a team of officials conducted a dismantling exercise in the Five Cays area near Silverado, of unoccupied structures on Crown

land. Notices were also given out on May 6 and owners were advised that the buildings would be taken down as soon as possible. Charles said: “We didn’t interfere with any structure that is being occupied at the moment. “What we dismantled was structures that have begun to spring up recently that are not occupied and are unfinished, we have a right to stop those structures because there is no building permission granted to them.” During a press conference on Friday, May 10, Premier, Dr. Rufus Ewing, commended this action. However when asked if he had foreknowledge of the exercise, he said no. He said: “The Government did not have any knowledge of it, and the agencies have their statutory responsibility to exercise their duties independent of Cabinet. “But I would have appreciated a heads up and know this is taking place so that we could have ensured that things are in place to deal with possible untoward repercussions of that decision,” the Premier said. In spite of this, he did note that more monitoring from the Planning Department is needed to catch the illegal constructions and settlements at an early stage.

Land admin team gets extensive update SEVENTEEN members of staff within the Land Registry, Crown Land Unit, and the Survey and Mapping Department were the proud recipients of certificates of participation, last Friday (May 10). They successfully completed the first ever local training in land administration practices and procedures. This three week course was organised by the Commissioner of Lands with funding provided by the Overseas Territory Programme Fund (OTPF) of the Foreign and Commonwealth through the Governor’s Office. Governor Ric Todd said: “This training initiative aligns with the UK government’s goal to strengthen engagement between the Overseas Territories and the UK. “It is about investing in people and building the technical capacity within the islands. “We will continue to identify opportunities similar to these, to increase the capacity and expertise of the TCI public services.” Commissioner of Lands, Tatum Clerveaux, explained that it was necessary to hold such training courses in order to up-skill staff, with a view to improving efficiency of both the front and back offices of these departments. The training programme was designed to equip staff of the Lands Division with a detailed and

comprehensive in-depth knowledge and understanding of certain aspects of Land Law and practices at the Land Registry and the Crown Land Unit. She said: “Our vision is to put service to the customer first, and what better way to do this, than to improve the knowledge base and skill set of our staff, in order to provide a better service. She added: “The training course has provided the participants with a better understanding of how the various statutes, including the Registered Land Ordinance, Stamp Duties Ordinance and the Crown Land Ordinance and concepts of land law relate to the daily operations. “Equipped this knowledge staff will be more confident and analytical in solving land related problems. “This should then result in an improvement in the turnaround time of documents and transactions lodged in both the Land Registry and the Crown Land Unit.” Attorney General (AG), Huw Shepheard, also expressed his delighted in the success of the programme and noted that this training course was just one of several initiatives that planned to develop and encourage staff within the Lands Division. The training course, which ran from April 22 to May 9, entailed three weeks of intensive lectures provided by Derek Evans from Teraquad, a UK consultancy firm with extensive practical experience

in delivering training in this field. Evans has almost 40 years of land administration experience with Her Majesty’s Land Registry in the UK. The foundation level training programme presented the statutory background to both the Land Registry and Crown Land Unit day to day operations and related administrative practices. Particular attention was also paid to the application of the Registered Land Ordinance and the Crown Land Ordinance to the day-to-day procedures. Emphasis was also placed on the importance of transparency and accountability in land administration. Participants also had an opportunity to process practice transactions and undertook technical assessments at the end of each study topic to test their grasp of the material and understanding of the procedural and statutory requirements. Each participant also received a detailed training manual, written specifically for the TCI Land Division. Other staff development initiatives are planned for staff within the Lands Division and includes in-housing training in areas such as surveying and GIS tools. The division is also exploring opportunities for long and short-term secondments to equivalent or more advanced agencies in UK or other Overseas Territories.

“The problem you will have after that is where those people will go; especially if those persons are legal residents in the TCI. But it does not mean that we should not address the problem.” Meanwhile, on the same issue of monitoring, the Crown Lands Director did note that the department does have continuous monitoring which also involves aerial imagery of these developing areas. He said a lot of them are on privately owned land, where there are absent landlords. Ewing: “Developments are taking place there, but since those lands are privately held lands, we are advising where people need assistance in eradicating the problem, they should approach the department.” In the area of Five Cays, Charles said this has been a problem from as far back as 2001.

“People feel that they have a right to Crown land and therefore they are going to go there and squat and force the Government to regularise them. That is one of the strategies that have been taking place over the years.” He added that prior to the suspension of the constitution in 2009; this was being done in these areas but that this has only encouraged the problem. The Premier said: “So we declare that we are not going to tolerate squatting any further, we are going to look at those structures that have been placed before November 2009 and backwards, but those who develop afterwards we are going to take a very strong action against them.” Some do it for economic benefit, Charles said, referencing occasions where persons have sold Crown land. Senior personnel changes in Governor’s Office FORMER TCIG Chief Executive Patrick Boyle has been appointed the Director of Reform and Strategy in the Governor’s Office with effect from July 1. The announcement was made last Friday (May 10). Boyle takes over the role from Philip Rushbrook, who is returning to his home department in the UK Cabinet Office at the end of his secondment to the Foreign and Commonwealth Office (FCO) in the TCI in June. In addition to playing a central, senior role in managing the affairs of the Governor’s Office as the Deputy Head of Mission, Boyle will also be in charge of the FCO’s substantial technical assistance programme in the TCI. He has been developing this programme of support for the continuing public sector reforms in TCIG with the head of the TCI public service, Deputy Governor, Anya Williams, since standing down as TCIG Chief Executive of the interim administration. The technical assistance programme invests in the people and government of the UK’s Overseas Territories to develop local skills and competencies, recognising that there is not the same opportunity for personal or professional development in countries with small populations as there are in larger jurisdictions. Public interest being considered in tourists’ cases BY VANESSA NARINE

THE DEBACLE revolving around the arrests of two American tourists for the possession of ammunition continues, the latest development being comments made by United States Senator, Bill Nelson. Speaking to the Miami Herald, he called the circumstances surrounding the arrests “unusual” and “mysterious,” and said he hopes Americans are not being preyed upon in an immoral scheme. Nelson said: “If I were the Turks and Caicos and knowing that my main source of income is American tourists, the last thing in the world is they need some kind of scheme that is shaking down American. What that will do is dry up their tourism if

in fact this continues.” Late this week, Nelson and Republican Texas Senator, Ted Cruz, wrote to the U.S. Embassy in Nassau, Bahamas, which has responsibility for the Turks and Caicos Islands, asking if there have been other arrests of Americans on similar charges. The letter also asked U.S. Charge d’Affaires John Dinkelman to “convey to the proper authorities that the investigation needs to be expeditious, thorough, transparent and independent.” One of the tourists who were arrested, Horace Norrell, continues to be vocal about the issue. He told his hometown paper, the Sarasota Herald Tribune, last week that he considering skipping the sufficiency hearing, scheduled for

June 7, and forfeiting $4,000 in bail he posted. Norrell said that he would have spent at least $20,000 by the hearing date on travel and legal fees. He told the US paper that he has consulted with an extradition expert in Miami on whether to attend or avoid the hearing, where a judge is expected to decide to take the matter to trial or toss the charge. “We want his opinion on whether, if we travel outside the U.S. to Great Britain or any British protectorates, whether we would be extradited to the Turks and Caicos,” Norrell said. She explained that she is not in a position to comment on whether or not the charges against the tourists will be dropped at this point. Meloche said: “We are trying to deal with this expeditiously. The case is a priority and is being actively investigated…we want to make sure that the procedures employed are thorough.” Until the investigation is completed, she made it clear that no preconceived judgments will be drawn. Meloche added that further comments on the matter are not possible given that the investigation

is on-going. Premier, Dr. Rufus Ewing, asked to comment on the prosecution of the matter, stated that the determination as to whether charges are dropped is a decision that is up to the DPP’s office, which is independent of both him and the Governor. He said: “The best she can do is use her discretion, best judgement and the information available to her to ensure law is expedited in a fair manner.” The two individuals travelling to the United States from the TCI were charged by the Royal Turks and Caicos Islands Police Force for carrying ammunition in Providenciales International Airport on Thursday, April 25, and Friday, April 26.

Provo Water Company walks for cause AMONG the activities that Provo Water Company put together for the celebration of 2013 Drinking Water Week was a walkathon on Saturday geared to raise funds for the TCI Diabetic Association. The walk started at Tropicana Plaza where Connolly Motors is located then headed through the lower Bight and then back - a total distance of 3.8 miles. Organisers revealed that more than 150 people registered for the walk. Provo Water Company had a tent set up for registration and

refreshments, ACCU Diagnostics provided free blood pressure and blood sugar screening and Courtyard Family Chiropractic provided free spinal screenings. Water quality manager for Provo Water Company, Sherry BellParker noted that another motive was to raise more awareness to diabetes. She said: “Every year we want to support a recipient or a cause; we were very happy to launch this year’s walkathon which was in support of the TCI Diabetic Association.

“This was a great community walk that engaged new volunteers and donors in the Stop Diabetics movement around the country.” Bell-Parker added that the company also purchased glucose meters which will be distributed at the end of the month to help those individuals who are affected by this disease. Event co-ordinator and office manager for Provo Water Company, Kneshia Clarke-Forbes, said that the company will be donating 100 glucose monitors to the TCI Diabetic Association.

Over 100 Haitians support islandwide cleanup WHILE many may have been resting over the weekend, about 130 Haitian nationals were hard at work, cleaning up the Providenciales community that Saturday. Organizer of the event, Yviol Louis Jeune explained to the Weekly News that this event was put forth by him who then later brought Haitian Pastors and members of the Haitian community on board to help make the event possible. “This is a cleanup we organized, we realized that a lot of garbage is in our community so we decided to come together, sit down and see what we could do about it. Its something that we just started and we are hopeful to do more frequently.” Jeune went further on to say that if the country’s motto is beautiful by nature then the environment must

show just that. He said: “Our point is that the Turks and Caicos is beautiful by Nature, tourist and guest come here and many invest in the TCI but, if the place is dirty they may not return and that may be a problem for the country.” Although there was no official name for the group involved the organizer did make mention that this was not it for them and that they will be doing more in the near future. He was also reaching out for support from the community. “To my community try the best you can to keep the place clean and we ask the Government to support us and the private bodies, when we come to your establishment and ask for your support please don’t hesitate to help us,” he said. Mental health group to increase public awareness A NON-PROFIT organisation with a new vision has revealed plans to do more in sensitising the public about mental disorders - a leading, but often overlooked issue around the world. In observance of Mental Health Awareness Month this May, People Incorporated TCI through their ‘Let’s Talk about Mental Health Campaign’ seeks to bring awareness and educate the public on the illness. Founder of the organisation Sharvone Pratt encouraged residents to take the issue more seriously and not discriminate against persons suffering. She pointed out that some

mental health conditions people in the TCI are battling include schizophrenia, bipolar disorder, borderline personality disorder and depression. The organisation, established in 2007 by Sharvone and George Pratt, “aims to assist people with mental illnesses in leading more productive and autonomous lifestyles and to promote mental health through service, advocacy and education.” Sharvone Pratt, a psychiatric social worker with the Department of Social Development, said it has always been a passion of hers to assist people affected by mental

illness. Pratt began the organisation as a way to provide additional assistance to those in need, as the services offered by the Government are not enough. While the organisation aims to make a great difference in the lives of affected persons, they too cannot do it alone. She hopes that with assistance from the Government, the organisation will be able to “open the first residential group home to provide aftercare and a safe place for those with nowhere to go”. But until then, members plan to host workshops and disseminate

as much information as possible to educate the public on this matter. She said she does not think it is a case where people do not want to get involved, but they do not know how to get involved. Their mission is to “improve quality of life and reduce the burden of illness by providing comprehensive, community-based mental health services, giving priority to those with the greatest need.” Throughout the month, a ‘Let’s Talk about Mental Illness’ skit produced by the organisation will be aired through ROJ Network Television, PTV and WIV.

On May 15 the organisation will host a ‘Mental health in the work place’ workshop to discuss possible partnerships with local companies who are willing to hire fit individuals who have a mental illness. They have also produced a radio advert in Creole which will air on the two Creole stations - VHT Radio Turks and Caicos, 91.5fm and Example of Christ, 95.1fm and also on the ROJ Network radio station. Middle Caicos School concert a smash success IT TURNED out to be the event of the year on the country’s largest yet most sparsely populated island, Middle Caicos. A capacity crowd of delighted friends and family attended the Middle Caicos Primary School concert and were entertained by students and staff from the TCI’s smallest public school. The children put on a show which both entertained and stunned the crowd with their abilities during the school’s third annual concert and play. From the opening prayer by Pastor Evan Williams to the benediction by new Pastor Iona Harvey the audience who participated in congregational gospel hymns was entertained with the entertainment the school presented.

Beginning with ‘This Little Light of Mine’, which preached Doris Robinson School was “making us [the students] shine,” the young children put on a show. Folk songs and instrumental duets included 16 selections and were moderated over by mistress of ceremonies Yvette Tapfer. The topical play written by teacher Brenda Lee Harvey-Oladimeji reflected the challenges of TCI today when the student actors presented a school bully converted to accept Christ. The short play was so well celebrated by the crowd that it was repeated near the programme’s end. Compensation for victims of ponzi scheme run by David Smith THE United States says people who lost money from investments in companies operated by convicted Jamaican fraudster David Smith may be eligible to receive compensation from Washington. But the Association of Concerned OLINT Members in Jamaica said it is adopting a cautious approach to the payment, noting that there have been failed attempts in the past to compensate victims. Chairman of the Association, Dr Godfrey McAllister said given discussions with the District Attorney’s Office dealing with the David Smith case, no new money has been found nor are the authorities in a better position than they were a year ago to compensate. The US Department of Justice said the compensation for those who invested money in the failed Ponzi scheme, Olint, will be done through a process called “remission”. A date for the payout has not been set but only those who invested during the period February 3, 2005 through to July 15, 2008 will be eligible.

Only David Smith’s victims who invested during the period February 3, 2005 through to July 15, 2008 will be eligible for compensation.

Smith claimed that the companies were private investment clubs that purportedly traded in foreign currency on investors’ behalf. He made false and fraudulent statements indicating that members could expect

high returns on their investment with low risk to principal. Rather than investing the funds as promised, Smith used them for personal gain and paid returns using new investors’ money. He was convicted in the U.S. District Court for the Middle District of Florida in September 2011 on multiple counts of wire fraud and money laundering. In July last year, Smith was convicted in the Supreme Court of the Turks and Caicos Islands after pleading guilty to two counts of money laundering and two counts of conspiracy to defraud. The conviction triggered a mandatory confiscation hearing under the Turks and Caicos Islands Proceeds of Crime Ordinance. He is now serving a six-year sentence in the Turks and Caicos Islands and recently applied to be released from prison early. The US Department of Justice said to be considered for remission, a petition for Remission Form must be submitted to the remission administrator. (CMC)

Haiti cholera victims threaten to sue the UN VICTIMS of Haiti’s cholera epidemic have given the United Nations a 60-day deadline to start talks about billions of dollars worth of compensation or face legal action. The UN is accused of negligently allowing peacekeeping soldiers to pollute Haiti’s water with cholera. A UN cholera expert agrees that this is “most likely” to be true. The UN rejected an earlier call for compensation and continues to insist it is immune from legal proceedings. Every time I write about the cholera crisis in Haiti I have to pinch myself to make sure I’m not having a horrible daydream because the apparent facts are almost unbelievable. The UN is an organisation committed to doing good; I’ve seen it strive to do so in many parts of the world. But the available evidence does indicate that peacekeepers from Nepal inadvertently spread deadly cholera into the main waterway of one of the poorest, most vulnerable countries on earth. One of the UN’s own cholera experts, Danielle Lantagne, told me it was “most likely” the outbreak began in the Nepali camp. The UN says it is immune from compensation claims. But in private UN officials say the world body is facing a moral crisis over this case. They may be about to face a very public legal crisis as well. The cholera epidemic began in Haiti in 2010 near a camp for UN soldiers, where there were leaking sewage pipes. Some human waste

The numerous awards and recognition the resort has garnered over the years is a tribute to the genuine warmth, professionalism and dedication of our exceptional ladies and gentlemen,” said Tony Mira, general manager of The Ritz-Carlton Golf & Spa Resort, Rose Hall, in a press release early yesterday afternoon, announcing the brand’s exit. Rose Hall Resort LP, the Delaware-based owner of the property, later confirmed “the mutually planned departure” of the

THOUSANDS of supporters of Haiti’s former President JeanBertrand Aristide have defied a ban on protests to follow his convoy through the streets. LIME. Parker was the winner of a texting competition hosted by LIME, where she was taken to IGA and was given one minute to put as many items in her trolley as possible within that space of time.

The shopping spree was conducted during the early hours of the day to avoid interference from shoppers. Parker immediately made a stop in the television section grabbing two, then headed straight to the meat

section filling nearly two trolleys with various meats. When asked by the media how she felt, Parker explained that the shopping spree came just at the right time. “I feel great, it was very exciting,

I could do it again,” she said. “I was playing this before I actually won, I was thinking ‘head straight to the meat’. “When I told my mum I won she continued 

PDM reps rally supporters for cleanup campaigns ELECTED representative for Grand Turk South, Edwin Astwood, together with his team began what is to be a series of clean up campaigns on the island of Grand Turk. The weekend’s efforts concentrated in the North Back Salina’s area and dozens of bags of trash were collected and taken to the public dump site. Astwood joins the People’s Democratic Movement’s (PDM) efforts and his colleagues who were engaging in similar exercises throughout their constituencies. Party representatives for Leeward, Wheeland and Blue Hills, Ezra Taylor, Delroy Williams and Sean Astwood, have all began these initiatives in their constituencies. Astwood, also deputy leader for the PDM, said: “The PDM Party supports and endorses initiatives like this because it feels that clean environments promote healthy living and also promotes civic pride and hope.

General manager for LIME TCI, Drexwell Seymour, was not bothered at all by the hefty bill. He said: “I am not worried about the bill at all, I’m really excited about the winner. “She only spent $3 and she got over $1,000 worth of groceries and I’m excited that we are able to help our customers. “It’s just the beginning we are going to continue to have these on a regular basis.”

Haysbert to star in film about The Bahamas’ first Prime Minister Popular American actor, Dennis Haysbert will be starring in “The Black Moses”, a film about the life and times of Sir Lynden Oscar Pindling, the first black Prime Minister of The Bahamas. Haysbert’s velvety-voice can be heard in the trailer which was just released. Pindling, regarded as the “Father of the Nation” in The Bahamas led it to independence in 1973 and served as Prime Minister of

The Bahamas from 1969 to 1992. He was leader of the Progressive Liberal Party (PLP) from 1965 to 1997 when he resigned from public life. He died in 2000. Star Wars: Episode VII to be filmed in UK THE latest Star Wars film is to be made in the UK, producer Lucasfilm has said. The seventh movie in the sci-fi series is due to start production next year and is scheduled for release in 2015. Filming on previous Star Wars also took place in Britain at studios including Elstree, Shepperton and Leavesden. Chancellor George Osborne met executives from Disneyowned Lucasfilm in London earlier this year to discuss the plans and the production is thought to be eligible for a tax break. Mr Osborne said Lucasfilm’s decision was “clear evidence” that incentives offered to large film studios are making the UK an attractive prospect. Hammond supports leaving EU DEFENCE Secretary Philip Hammond has become the second cabinet minister to say he would vote for Britain to leave the EU if a referendum were held now. But, like education secretary Michael Gove, he said David Cameron must be given a chance to bring powers back from Brussels before deciding. Mr Hammond told BBC Radio 5live it would be “defeatist” to leave the EU without attempting reform. Mr Cameron has pledged to hold a referendum in 2017. “If the choice is between a European Union written exactly as it is today and not being a part of that then I have to say that I’m on the side of the argument that Michael Gove has put forward,” said Mr Hammond in an interview on Radio 5live’s Pienaar’s politics. Earlier, Mr Gove became the most senior Conservative to date to publicly contemplate backing Britain’s exit from the EU, although “friends” of the cabinet minister have previously told a newspaper that is where he stands. ‘LETTING OFF STEAM’ “I am not happy with our position in the European Union but my preference is for a change in Britain’s relationship with the European Union,” said Mr Gove. “Life outside would be perfectly tolerable, we could contemplate it, there would be certain advantages.” Tory backbenchers have tabled an amendment to the motion welcoming the Queen’s Speech regretting the absence of legislation paving the way for a referendum in the government’s plans for the year ahead.

Former Guatemala military leader guilty of genocide A COURT in Guatemala has found former military leader Efrain Rios Montt guilty of genocide and crimes against humanity. A three-judge tribunal sentenced the 86-year-old to 80 years in prison. Rios Montt was convicted of ordering the deaths of 1,771 people of the Ixil Maya ethnic group during his time in office in 1982 and 1983. Survivors described horrific abuses committed by the army against those suspected of aiding left-wing rebels. The retired general had denied the charges, saying he neither knew of nor ordered the massacres while in power. He is expected to appeal against the court’s decision on the grounds of his age. Rios Montt’s former chief of military intelligence, Mauricio Rodriguez Sanchez, who was on trial with him, was acquitted.

It is the first time a former head of state had been found guilty of genocide by a court in his or her own country. Other genocide convictions have been handed down by international courts. Relatives and indigenous leaders cheered when the sentence was read out by Judge Jazmin Barrios in Guatemala City. Rios Montt was sentenced to 50 years for genocide and 30 years for crimes against humanity. “The Ixils were considered public enemies of the state and were also victims of racism, considered an inferior race,” Judge Barrios said. “The violent acts against the Ixils were not spontaneous. A DISPUTE over a bar bill is the supposed cause of the beating that killed Malcolm Shabazz (grandson of Malcolm X) on Thursday morning in Mexico City, according to the AP. Shabazz, who led a troubled life, was visiting his friend, recently deported activist Miguel Suarez, when “they and several other people had gone to a bar near the downtown plaza that is home to Mexico City’s mariachis.” After being confronted with a $1,200 bar bill by the owner of the establishment, a fight ensued and Shabazz was taken behind the building and beaten. Suarez told the AP that he “found Shabazz injured outside the bar and took him to a hospital where he died on Thursday.” Shabazz had recently been enrolled at the John Jay College

Brazilian woman survives harpoon shooting A BRAZILIAN woman has survived being shot through the mouth with a harpoon in a bizarre accident, doctors say. Neurosurgeon Allan da Costa said the harpoon came within 1cm (0.4 inch) of killing Elisangela Borborema Rosa, 28. She had emergency surgery to remove the harpoon and is expected to make a full recovery. Officials said Ms Rosa’s husband had accidentally fired his spear gun while cleaning it. Police said everything indicated it had been an accident. The incident happened on Monday in the coastal town of Arraial do Cabo, 150km (93 miles) east of Rio de Janeiro.

According to her family, Ms Rosa was in the kitchen when she was hit by the harpoon, which her husband had been cleaning in the living room. The harpoon, which her husband used for underwater fishing, entered through her mouth and was lodged against her spine. She was taken to a local hospital, but immediately transferred to the regional hospital in nearby Araruama, where a team of specialised surgeons operated on her. “This is the first case of this type I have seen,” Dr Costa said. “The peculiarity of this case is that the tip of the harpoon lodged itself between the anterior vertebral canal and the medullary canal,” he said.

NAWAZ Sharif, the prime minister whose government was overthrown by a military coup more than a decade ago, appears to be back on top in Pakistan, election officials said Sunday. According to unofficial results in Pakistan’s violence-marred election, Sharif’s party looks to have won most of the seats in the National Assembly. It won 16 of the 23 seats in the lower house, election officials said. Imran Khan, candidate for the Tehreek-e-Insaf (Movement for Justice) party, said the elections were rigged. “Police (were) used, and how the -- the staff of the Election Commission were used,” he said. “And unfortunately it’s because the provincial governments were in power right up till 20 days before the elections -- so they had plenty of time to place their people.” Still, democracy moved forward, he said. “But I’m very optimistic that the foundation of what we call the new Pakistan has been laid,” he said. “Pakistan will never be the same again. ... A HONG Kong transsexual has won the right to marry her boyfriend, following an appeal to Hong Kong’s top court. The Court of Final Appeal ruled that Hong Kong’s current law, which barred the transsexual woman from marrying her male partner, is unconstitutional. The woman, identified only as W, underwent gender change surgery at a public hospital a few years ago. Hong Kong’s marriage registry had refused her request because her birth certificate still classes her as male. “The right to marry guaranteed by our constitution extends to the right of a post-operative transsexual to marry in the reassigned capacity,” the majority ruling, co-written by Chief Justice Geoffrey Ma and Permanent Judge Robert Ribeiro, said. “In present-day multi-cultural Hong Kong where people profess many different religious faiths or none at all... procreation is no longer

(if it ever was) regarded as essential to marriage,” it added. The ruling said that references to “woman” and “female” in Hong Kong’s marriage law should include post-operative male to female transsexuals. Four of the court’s five presiding judges supported the ruling, with the fifth voting against it. However, the court said it would not implement the judgement for the next 12 months, to allow the government time to consider amending the law. Permanent Judge Patrick Chan, who voted against the ruling, said including post-operative transsexuals in the definition of “man” and “woman” was “a radical change of the traditional concept of marriage”. “There is no evidence that the social attitudes in Hong Kong towards the traditional concept of marriage and the marriage institution have fundamentally altered,” he said, adding that changes should

BRADLEY Wiggins’ bid to add the Giro d’Italia title to his Tour de France crown suffered another blow Saturday as the British cycling star lost more time in the eighth stage time trial. Wiggins, who crashed in wet conditions on Friday, dropped to more than a minute behind the new leader Vincenzo Nibali after a puncture forced him to change bikes. The 33-year-old battled back to take second place in the 54.8-kilometer stage between Gabicce Mare and Saltara, 10 seconds behind the winner -- his compatriot Alex Dowsett. Nibali was 21 seconds adrift in fourth but it was enough to give the Italian rider a 29-second advantage over Australia’s 2011 Tour de France winner Cadel Evans, who was seventh.

Previous leader Benat Intxausti lost more than three and a half minutes as he dropped to 14th overall. Wiggins, who will not lead Team Sky at this year’s Tour, was frustrated after his latest setback. “I think there was some initial disappointment because I wanted to win the stage,” he told his team’s website. “It’s been a challenging few days with the crash yesterday and then to come back up. It wasn’t an easy course. “Then obviously to have a puncture and have to change bikes and disrupt the rhythm is never going to help. But then the second part of the course was really suited to me and I took back a lot of time on people there. “It’s put us right back up there now. It’s going to be a hell of a race for the next two weeks.”

WHO ARE THE NET ROCKERS? THE Net Rockers are the most extraordinary football club that ever existed in the history of the TCI. To be more precise, it’s a female football club. The most unusual feature about the make-up of this club is that its players reside in different islands of the TCI. Some live and work in GT, two reside in North Caicos and 19 are from Provo. It is very visionary to conceive the idea of creating a football club from such a scenario as this. The question arises as to how practical it would really be to assemble such a team and be able to facilitate competitive practice that would be effective to the point of rendering the team’s efficiency to the level of being competitive

Otuonye wins Kansas State “Freshman of the Year” award CAC Junior silver medallist Ifeanyi Otuonye has been named Kansas State University “Freshman of the Year” at the school’s annual award. The long jumper, who was outstanding in his indoor season bettering his personal jumps at every attempt, was also a valuable asset to the 4X100M and 4X400M relay teams. Over 100 new athletes were eligible for the award. “It’s a big award and it means a lot to me. Because its freshman athlete of the year for all sports at K-State (Football, track, golf, baseball, cross country etc.).” Outonye has impressed his track and field coach and was recently the subject of an article in the school’s publication. Despite not bettering his 7.50M, which he jumped at the Big XII Indoor Championships,

the youngster still made heads turn on the track during the outdoor season. At the Big XII Outdoor Championships earlier this month Otuonye jumped 7.39M to finish sixth. It was however his participation in the 4X400M which made school news. The relay team finished third in the event in a time of 3:09m which was one of their best finishes ever. With the win the male team scored 96 points which was the most ever scored by them at the Big XII Outdoor Championships. Last weekend the former Munro College athlete, who had won medals for TCI at numerous international meets, won the 100M at a school event. He slowed down toward the end to finish in a time of 10.54s with a tail win of 5.3m/s.

PABA Night League:

Flyers end Stallions’ unbeaten record

The Flyers made sure of that and lived up to their name “Giant Killers” when the best-inseven Provo Amateur Basketball Association (PABA) Night League Finals started at the Gus Lightbourne Sports Complex court last Friday night. The Stallions bounced back on Saturday night to draw even at 7367. Game one’s 88-85 win ended the 25-0 record of the Stallions. Flyers used their speed to counter the inside power of the Stallions. The absence of the dominant Ira Taylor (off island) also hurt the previously undefeated side’s chance. Adding to this their power player, Marcus Lightbourne, was not his usual explosive self since

he was battling foul trouble. In that game Dorado Fulford led the Flyers’ attack with 24 points, five boards, three assists, two blocks and two steals, while Anthony Cash added 18 points and 12 boards. Kino Williams led all scorers with 25 points, three steals and two assists for the Stallions while Lightbourne added 17 points, 10 boards, four blocks and three steals. On Saturday night Lightbourne grabbed a series high 19 rebounds to go with 13 points while Tamurii Lightbourne scored 20 points and pulled down 13 boards as the Stallions dominated the paint. For the Flyers Cash finished with 20 points, five boards and five steals while Fulford added 13 points and six boards.

Marcus Lightbourne was productive offensively and defensively for the Stallions in Game One and Two.

Dorado Fulford led Flyers to a three-point win over the previously undefeated GT Stallions in Game One.
