BALLOT TITLE AND SUMMARY Title A Citizen’s Initiative Measure to Amend the City of South Lake Tahoe’s Existing Vacation Home Rentals (“VHR”) Regulations to Impose Additional Requirements for VHR Operations, Create a VHR Oversight Committee, and Create a Special VHR Commission. Summary On November 21, 2017, the City of South Lake Tahoe adopted Ordinance No. 1114, which adopted the City’s current VHR regulations. This Initiative proposes to amend Ordinance No. 1114 as follows: 1. Adds definitions concerning “transient occupancy facilities” and “upheld citations.” 2. Creates a five member oversight committee that meets semi-annually to make recommendations to the City Council concerning VHR regulations, enforcement, and other VHR-related issues. 3. Permanently prohibits the issuance or renewal of a VHR permit if an operator has an upheld citation for operating a VHR without a VHR permit. 4. Forbids the renewal of a VHR permit if the operator of the VHR generates less than $1,500 of transient occupancy taxes during the twelve month period prior to the expiration of the VHR permit. 5. Further limits occupancy by revising the maximum per bedroom occupancy formula and treating visitors as occupants under the maximum parking or bedroom occupancy formulas. 6. Requires the City to create, and provide VHR operators, a pamphlet on conduct at VHRs, to be distributed to VHR occupants. 7. Prohibits use of noise-related equipment such as speakers at a VHR, at all times. 8. Creates a five member special VHR commission to make recommendations to the City Council regarding allocation of transient occupancy taxes to housing programs. This Initiative includes in Section 7 a provision that provides “any person with a beneficial interest in vacation home rentals” may sue to enforce VHR regulations, and that the Initiative proponents may defend the Initiative against any challenges. However, Section 7 is not included as an amendment to Ordinance No. 1114 and thus would be an uncodified ordinance provision that will not be included in the City’s published municipal code. Section 4 of this Initiative states that if this Initiative receives the most votes, then this Initiative is effective and will supersede all other conflicting VHR initiatives on the ballot for this election.
