CQC - DSPT deadline approaching

As a care provider you are entrusted with safeguarding the information you hold about the people in your care and colleagues you work with, regardless of whether you keep paper or digital records. You should complete the Data Security and Protection Toolkit at least once a year to evidence you have good practices in place to protect people’s information.

The deadline for 2022/23 is 30 June.

The Data Security and Protection Toolkit

Funding will continue for another year to enable us to offer training and support to help providers complete their DSPT. This announcement from the Department of Health shows their commitment to improve Data and Cyber Security within Adult Social Care.

Keeping your paper and digital information safe is key to running a care service people can trust. You can protect your business, your service users and your staff from data losses and take steps towards protecting yourself from cyber attacks by completing your Data Security and Protection Toolkit.

The DSPT is easier to complete than you think.

It is not an assessment but a self-evaluation and you probably have most of the policies and procedures in place already. If you need any help or support, you can not only attend one of our free webinars but we can provide significant (and free) one to one support at a time that suits you.

All CQC registered care providers should complete the DSPT at least once a year.

We hold regular online sessions to help you complete your first DSPT, and we can also offer further support for those who are Republishing their annual self-assessment.

DSPT - The Gateway to your digital futur

Data Protection & Compliance

p p cialising in social care, learn how to stay compliant with the Data Protection and UK GDPR legislations, which in turn will help you stay compliant with the CQC and avoid fines for data breaches by the ICO. Whilst during the pandemic, data protection was not high on the agenda for either the CQC or the providers, this is about to change.

As a part of their assessment relating to caring and well led, CQC will be looking at the way you manage your data. Some of the questions you may be asked are:

· What personal data do you hold or collect?

· What do you do with that data?

· Who do you share it with?

· How long do you keep the data?

· What is the lawful basis for processing the data?

CQC will check that your records comply with Regulation 17 Health and Social Care Act 2008 (regulated activities) Regulations 2014:

· Data protection legislation. Accessible information standard and

· The toolkit (where necessary)

Some of the common problems you can avoid that CQC inspectors have identified are:

· Personal and special category data (health information) not being shared securely:

· Password protect or encrypt documents,

· Secure sharing sites

· Egress for emails

· Software up to date.

· Doors to offices is being left unlocked, open and unattended

· Data being taken off site and not backed up/ sufficiently protected

· Staff not being sufficiently trained

Completing the DSPT self assessment can help prove your compliance with Data protection legislation and UK GDPR. It can also help you prevent data breaches, reduce the risk of cyber attacks and make dealing with requests from individuals to exercise their rights in respect of personal data much easier.

Completing the toolkit can help you reduce the risk of fines from the ICO for non-compliance as you will be able to show the steps you have taken to minimise the risks.

CQC supports digitising social care

In her monthly update newsletter to the adult social care sector, Kate Terroni, Chief Inspector of Adult Social Care (now interim Deputy Chief Exec) at the Care Quality Commission (CQC) confirmed the commission's commitment to digital transformation of adult social care.

Here's her update:

Since January 2022, the Provider Information Return (PIR) has asked providers: Do you use a Digital Social Care Record (DSCR)? This information has been shared with the NHS Transformation Directorate to understand the uptake of DSCR across England

We'll now allow NHS Transformation to share this data with local authorities and Integrated Care Systems We're sharing this data to reduce the burden as local collections will no longer be needed, to empower local systems to support and understand local need, and to enable targeted funding. There's a lot of support available, from getting the skills in place for your workforce to choosing a digital records supplier

We believe that digital record systems can be more effective than paper-based records and are supportive of the Digital Social Care programme, led by the NHS Transformation Directorate. We know that around half of social care providers are using digital social care records and we support this growing move to digitisation. We want to work closely with NHS Transformation to help them support providers who face barriers to adopting digital social care records

Going Digital - What to expect

GOING DIGITAL: THE BENEFITS AND WHAT TO EXPECT

We will be speaking to a panel of experts about their experiences in “going digital” in social care services, hearing about the benefits for Service Users, staff and managers and the difference it makes to care delivery, operational efficiency, quality monitoring and compliance.

We will also hear about proven approaches to ensure that going digital is a success, preparing and involving your teams, embedding your culture into going digital and vice versa, overcoming perceived barriers and adapting to new ways of working.

There will also be an opportunity to ask the panel questions.

CQC - Single Assessment Framework

Development and plans

In summer CQC will start to roll out their new provider portal, notifying providers to sign up. They will do this in stages and provide support and guidance. In this in to submit information such as statutory notifications to them as they move away

When they roll out their new assessment approach later in the year, providers will also be able to review their draft judgements through an improved process for checking the factual accuracy of draft reports

CQC will work to improve how they use the information they get through the Give feedback on care service. In time, this work will be crucial in enabling them to properly close the feedback loop with the experiences they hear from people

Throughout this period, CQC will review published evidence from all local authorities and integrated care systems across specific thematic areas, alongside the early piloting of our approach.

Later in 2023 they will gradually start to carry out assessments of providers in the new way This means using our new assessment framework, powered by their integrated assessment teams and supported by our new technology.

At this stage, providers will also be able to apply to register with the CQC and make ongoing changes to registration through the portal By this point all their online interactions with providers will be on the portal

To allow more time for testing, they have also taken the decision to move back the rollout of their improved enforcement processes

Keeping you updated

These changes will take time and will continue into 2024. But the CQC will continue to keep everyone informed as they know that providers, local authorities, integrated care systems and others need time to prepare for the changes

Over the coming months they will provide much more detail about how they will use their new assessment approach when they start to roll it out later in the year. They will give an update on what good looks like under the new assessment framework, the evidence they will prioritise and how providers will interact with the new operational teams CQC will also start to share case studies from the engagement work they have been doing on their provider portal

We have also arranged for the RWK Goodman Solicitors to do a presentation for you on the Single assessment framework on 20th September at 1430.

As it is often the case, things may change by September so we do not have the details but they plan to talk about the changes that CQC is implementing to their system of inspection and regulation.

Having digital skills – even just basic onescan make a big difference in both your personal and work life.

Working collaboratively with Barclays, we are able to offer you this amazing, free Digital Champion programme. The programme was designed for anyone who wants to support the people around them to develop these essential digital skills. You will be teaching essential digital skills to help people become more skilled or avoid becoming digitally excluded and isolated The programme uses virtual sessions alongside online learning modules on Digital Wings to create an environment for Digital Champions to develop their digital skills ready to start supporting people around them. You don’t need to be a digital expert to become a Digital Champion but you do need a passion for helping others.

Getting started!

Follow the steps below to get started:

1 - Register - When you register to become a Digital Champion, you’ll join a cohort of other Digital Champion trainees. You’ll stay in this group throughout the programme, and you’ll have to attend each session to complete the programme and become a Digital Champion.

2 - Complete the learning - In addition to attending the virtual sessions, you’ll need to complete three specially selected Digital Wings modules which cover all the topics you’ll be expected to start sharing in your Digital Champion role. In each session and module, we'll give you some ideas on how you can use the learning to help others.

3 - Tell us how you’re doing - Once your learning is complete Barclays team will ask you to share how you’re doing after 30, 60 and 90 days so keep a note of how many people you’re helping. This could be by sharing Digital Wings or showing people how to do something digitally for the first time. You will also have the opportunity to let Barclays know if you need any more help.

Dementia Dictionary

Working together to improve our understanding Dementia.

y free to use resource helping people to learn the language of dementia and communicate more effectively with people living with dementia.

The Dementia Dictionary contains thousands of definitions for a wide range of behaviours, actions, and vocalisations, helping people to understand what is being communicated through these actions, as well as some useful pointers and advice for how to respond to these situations based on what is being communicated

Anyone can use the Dementia Dictionary to search for behaviours, actions, & vocalisations that they see being displayed by people living with dementia but do not understand They will then be able to view behaviours that are similar to what they are seeing and go through all of the possible interpretations to see if there is anything there that matches their situation

If they do, then fantastic, they will be able to better understand and respond to this situation in the future

If they do not find anything that they believe matches what they are seeing then people are able to ask for their own specific situation to be interpreted All of the interpretations in the Dementia Dictionary are provided by our worldwide network of Dementia Interpreters, who have completed a training course to enable them to be registered, and they use the knowledge gained during this training, as well their own first-hand experiences of dementia, to come up with potential interpretations for all of the behaviours that people would like help with.

The Dementia Dictionary is enabling people around the world to better connect with people who previously had been unable to do so. Our ultimate aim is that this resource will stop all of the labelling that tends to happen with people living with dementia, labels such as ‘challenging’ and ‘aggressive’, as people will now be able to understand that these behaviours are actually forms of communication.

Cyber Security Breaches Survey

The latest Cyber Security Breaches Survey report has revealed that 31% of micro businesses and 32% of small businesses have identified cyber breaches or attacks in the past 12 months, with phishing making up the majority of these (79-83%)

The Cyber Security Breaches Survey is a research study for UK cyber resilience, aligning with the National Cyber Strategy It is primarily used to inform government policy on cyber security, making the UK cyberspace a secure place to do business. The study explores the policies, processes and approach to cyber security for businesses, charities, and educational institutions. It also considers the different cyber attacks and cyber crimes these organisations face, as well as how these organisations are impacted and respond.

Identification of cyber security breaches and attacks

Cyber security breaches and attacks remain a common threat. However, smaller organisations are identifying them less than last year. This may reflect that senior managers in smaller organisations view cyber security as less of a priority in the current economic climate than in previous years, so are undertaking less monitoring and logging of breaches or attacks

● 32% of businesses and 24% of charities overall recall any breaches or attacks from the last 12 months. This is much higher for medium businesses (59%), large businesses (69%) and high-income charities with £500,000 or more in annual income (56%)

● This is a decrease from 39% of businesses and 30% of charities in 2022 The drop is driven by smaller organisations – the results for medium and large businesses, and high-income charities, remain at similar levels to last year

● Among those identifying any breaches or attacks, we estimate that the single most disruptive breach from the last 12 months cost each business, of any size, an average of approximately £1,100 For medium and large businesses, this was approximately £4,960 For charities, it was approximately £530

● The proportion of micro businesses saying cyber security is a high priority has decreased from 80% in 2022 to 68% this year Qualitative evidence suggests that cyber security has dropped down the priority lists for these smaller organisations, relative to wider economic concerns like inflation and uncertainty.

Value of unpaid care matches NHS bu

The value of unpaid care in England ales is almost equivalent to a NHS, a new research estimate

Unpaid carers contribute an annual £162bn to the economy in the two nations, the Carers UK charity and the University of Sheffield found.

This is compared to an estimated £164bn in funding for the NHS in 2020/21

The Department of Health and Social Care said it was "supporting social care with up to £7 5bn over the next two years" Carers UK said social care pressures meant people were being "left without a choice but to put other areas of their life on hold and provide more care".

Researchers used 2021 Census figures and calculated the number of people providing unpaid care against the cost for replacement care, taken as £25 per hour in 2021 and £18 per hour in 2011.

Their estimate of £162bn per year was 29% higher in real terms than in 2011, they said

'Carers taken for granted'

The estimated NHS budget for England came from the King's Fund health think tank, researchers said, with an additional £8bn added as an estimate for the NHS budget in Wales

Helen Walker, chief executive of Carers UK, described the findings as "deeply concerning" and said unpaid carers felt they were being "taken for granted" "The ever-declining availability of social care means there is shrinking support for families to pull on," she said

"Having to care around the clock for a loved one has significant implications for people's ability to stay in paid work, remain financially resilient and maintain their health "

Matt Bennett, deputy director of the university's centre for care, said: "The economic contribution made by unpaid carers paints a stark picture of the savings they make to health care budgets.

"Without unpaid carers, our health and social care systems would collapse - we hope policy makers see the urgent need to act to support unpaid carers."

A Department of Health and Social Care (DHSC) spokesperson said: "We all owe unpaid carers a huge amount of gratitude for the time and care they give their friends and family".

They added the government was supporting social care with "up to £7 5bn over the next two years" and in April had published a reform plan. The DHSC also provides £325m through the Better Care Fund for "short breaks and respite services for carers, as well as additional advice and support".

Care England - A helping hand

England, the largest and most diverse independent providers of adult social car issued a raft of measures to the sector aimed curing complexities to create efficiencies.

On top of this, the Government requires Local Authorities to utilise funds from 2022-23 through to 2024-25 to move toward the Fair Cost of Care As such, any Local Authority that is offering uplifts less than inflation is unable to meet this requirement and is consequently failing to achieve the required reform objective The solutions Care England has highlighted to system partners, including care providers and local decision-makers, can be implemented with relative ease to improve the financial position of care providers, in addition to fee uplifts, to help meet this obligation with minimal cost impact to Local Authorities, or which can be funded via its current funding allocation from central government ”

The Independent Providers Support Briefing is available on the Care England website and contains a host of measures which cover key issues afflicting adult social care providers These measures include:

● Recruitment and Retention – Employee referral, reward, and recognition app Care Friends has been proven to recruit and retain staff longer for half the costs of traditional recruitment methods and introduce more new and loyal individuals to the sector.

● Energy Costs – Care England instigated support for care providers with energy procurement by consolidating buying power for energy, which is delivering up to 36% savings and has helped to recover £3 5m in VAT and CCL charges, as well as providing articles and briefings outlining practical steps that can be taken to minimise and save on energy costs

● VAT – Care providers are currently unable to recover input VAT, unlike most UK businesses Care England continues to run webinars on how care providers can recover VAT through restructuring and is encouraging providers to ask their respective Local Authorities to support VAT recovery and use the information provided to recover VAT where possible.

● Procurement – Care England is offering procurement support by combining purchasing power with other care providers to achieve economies of scale

● Fees – Care England has produced materials designed to help navigate the complex process of challenging Local Authority annual fee uplifts and the options open to providers.

● Personal Budgets – Information for care providers to understand the part they play in contributing to Local Authority fees offered and maintained below the cost of care.

Mental Health Awareness Week is an when there is an opportunity for the w to get involved and focus on achievin health. The Mental Health Foundatio event 21 years ago, and it’s been thriving ever since! Each year the foundation continues to set the theme, organise, and host the week.

Mental Health Awareness Week is for everyone. It’s about starting conversations about mental health and the things in our daily lives that can affect it.

Why Anxiety? - Anxiety is the most common mental health issue in the world today but what are the common causes of anxiety?

Anxiety is not always related to an underlying condition. It may be caused by:

● Stress that can result from work, school, personal relationship

● Emotional trauma

● Financial concerns

● Stress caused by a chronic or serious medical condition

● A major event or performance

● Side effect of certain medications

● Alcohol consumption and drugs

If you notice yourself worrying more frequently and finding it difficult to quiet your anxious thoughts, the underlying cause may be more than just some personal troubles or a frustrating day at the office. Elevated stress may be to blame.

How can I help myself? - During Mental Health Awareness Week, you should take the time to do 3 things:

Exercise: Exercise is one of the best things you can do for your mental health Get your body moving this week and see how your mood lifts too

Experience nature: take time to recognise and grow your connection with nature during the week Take a moment to notice and celebrate nature in your daily life You might be surprised by what you notice!

Talk about anxiety: discuss in your family, school, workplace, and community how you can help encourage

CQC: Learning from safety incidents Learning from safety incidents

The CQC release a learning from safety incidents series which describe what happened, what CQC and the provider have done about it, and the steps working in health and care can take to avoid it happening in their service

Issue 12: Capacity and consent

When a person is asked for their consent, information about the proposed care and treatment must be provided in a way that the person can understand.

Issue 11: Promoting sexual safety

People who use health & social care services should be protected from sexual incidents & kept safe

Issue 10: Unsafe management of sepsis

Issue 9: Medicines management - assessment

The risks posed by poor medicines management can result in serious or fatal illness.

Issue 8: Hypothermia

Hypothermia can develop in vulnerable people after a relatively short exposure to cold weather It can even develop after a small drop in room temperature.

Issue 7: Falls from windows

Falls from windows often result in serious or fatal injuries, but they are avoidable.

In this session, we look at the recent changes to the DSPT and help you navigate through these to achieve ‘Standards Met’ when you republish your DSPT for the 22/23 year. Because things change in your setting, you need to review and republish your toolkit every year so that it reflects your current data and cyber security arrangements. For example, you may have introduced new staff, data systems, technology or services – which in turn will impact how you manage your information. The deadline for publishing your DSPT for 2022/22 is 30 June 2023

What is a DPIA? A DPIA is a process designed to help you systematically analyse the data protection risks of a project or plan. It is a key part of your accountability GDPR, and when done properly helps you assess and demonstrate how you com protection obligations

Why are DPIAs important? DPIAs are an essential part of your accountability obligations Conducting a DPIA is a legal requirement for any type of processing, including certain specified types of processing that are likely to result in a high risk to the rights and freedoms of individuals. Under UK GDPR, failure to carry out a DPIA when required may leave you open to enforcement action, including a fine of up to £8.7 million, or 2% global annual turnover if higher.

A DPIA must assess the level of risk, and in particular whether it is ‘high risk’ The UK GDPR is clear that assessing the level of risk involves looking at both the likelihood and the severity of the potential harm For more guidance on what this all means in practice, see the section on how to carry out a DPIA

Changes that CQC is implementing to their system of inspection and regulation.

CQC is developing a new approach to regulation called a single assessment framework. This applies to providers, local authorities and integrated care systems. They will continue to use:

● five key questions (safe, effective, caring, responsive and well-led)

● four-point ratings scale (outstanding, good, requires improvement and inadequate)

Under each key question there are a set of topic areas and quality statements. The statements describe what good care looks like and will link to the regulations. What will be different?

● Gathering evidence: CQC gather evidence to support their judgements in a variety of ways and at different times – not just through on-site inspections This means on-site inspections will support this activity, rather than being our primary way to collect evidence

● Frequency of assessments: They will no longer use a service's rating as the main driver when deciding when we next need to assess. Evidence we collect or information we receive at any time can trigger an assessment.

● Assessing quality: Judgements about quality will be made more regularly, instead of only after an inspection The assessments will be more structured and transparent, using evidence categories as part of the assessment framework and giving a score for what they find hoping to make their decisions about ratings clearer and easier to understand. The process will continue to be changed, refined and improved and our presentation will reflect this.
