AsofmylastknowledgeupdateinSeptember2021,theeligibilitycriteriaforsurrogacyin NewDelhi,India,wouldalignwiththeprovisionsoftheAssistedReproductiveTechnology (ART)RegulationBill,2020,whichcoverssurrogacyregulationsatthenationallevel.The eligibilitycriteriaunderthebillincludethefollowing:
1.IndianCitizenship:TheintendingparentsmustbeIndiancitizens.Non-resident Indians(NRIs)andoverseascitizensofIndia(OCIs)arealsoeligible.
2.MarriageandDuration:Theintendingcouplemustbelegallymarriedandhavebeen marriedforatleastfiveyears.Same-sexcouples,singleindividuals,andlive-inpartners arenoteligibleforsurrogacy
3.AgeLimits:Thefemaleintendingparentmustbebetween23and50yearsofage,and themaleintendingparentmustbebetween26and55yearsofage.
4.MedicalFitness:Bothintendingparentsmustbemedicallycertifiedashavinginfertility orprovenmedicalconditionsthatpreventthemfromcarryingachild.
5.SurrogateRelationship:Thesurrogatemothermustbeacloserelativeofthe intendingcouple.Sheshouldbemarriedandhaveatleastonehealthybiologicalchild ofherown.
