AsofmylastknowledgeupdateinSeptember2021,Icanprovideinformationaboutthelaw ofsurrogacyinIndiaatthattime.However,pleasenotethatlawsaresubjecttochange,and it’salwaysbesttoconsultupdatedandauthoritativesourcesorlegalprofessionalsforthe mostcurrentinformation.
InIndia,surrogacywasregulatedbytheAssistedReproductiveTechnology(ART) RegulationBill,2020,whichwaspassedbytheIndianParliament.TheBillaimedtoprovide alegalframeworkforsurrogacyinthecountry.SomekeyprovisionsoftheBillinclude:
1.Eligibility:OnlyIndiancitizenswhoaremarriedandhavebeenmarriedforatleastfive yearscanavailofsurrogacyservices.Theymustalsofallwithintheagerangeof23to 50yearsforfemalesand26to55yearsformales.
2.TypesofSurrogacy:TheBillallowsforaltruisticsurrogacy,wherethesurrogate mothercanonlybeacloserelativeoftheintendedparents.Commercialsurrogacy, wheremonetarycompensationisinvolved,isnotpermitted.
3.NationalandStateSurrogacyBoards:TheBillestablishesaNationalSurrogacy BoardandStateSurrogacyBoardstoregulateandoverseesurrogacyarrangements. Theseboardsareresponsibleforgrantingpermission,reviewingapplications,and addressinganyconcernsrelatedtosurrogacy
4.ConsentandAgreement:TheBillrequiresboththesurrogatemotherandtheintended

5.ParentageandCitizenship:Thechildbornthroughsurrogacywillbedeemedthe biologicalchildoftheintendingcouple.Theintendingcouplewillbethelegalparents andthechildwillhavealltherightsandprivilegesofanatural-bornchild.Thechildwill beentitledtocitizenshipasapplicableunderthelaw
