June 2016 Strata Titles Act Reforms As I write we are less than a fortnight from the Federal Election. Housing affordability and the role of the property sector in the economy have gained much attention in the course of the thick and thrust of campaigning. When we emerge from this imminent contest, eyes will quickly turn from Canberra back to the state government and progress on initiatives closer to home. For SCA (WA) Inc. and other allied industry associations, the focus will be very much on the STAR Reforms. It’s been said many times in many forums: a great deal of work has been done to date to pull together a package of reforms which are much needed, albeit omitting the sensible step of strata manager licensing. The reforms to the Strata Titles Act are now long overdue. As no draft bill or portions of a draft bill have been released to stakeholders for review or comment, we are becoming nervous about the lack of progress. That is why we have and will continue to call upon the state government to support the drafting process and bring the Bill before parliament this year. We will join with the Property Council of Australia, the WA Law Society and other stakeholders to voice the industry’s call for timely action. We will do this because housing affordability and liveability go hand in hand. Housing affordability will not be achieved by tax reform alone. The future of sustainable, affordable cities for our growing population requires flexibility in forms of title, good governance in strata schemes, careful planning and quality in building. The reforms to the Strata Titles Act are a major part of delivering the Australian dream of home ownership in the future. I would like to thank of all SCA(WA) Inc.’s members who have assisted the Association to make representations to government and the Opposition about these reforms including those who have responded to our surveys and the Legal Affairs and Public Policy Committee members: Mark Atkinson, Kara Grant, Paul Keet, Jake Kneebone and Ida Smithwick.


SCA Structure During the course of the last 6 months, SCA Ltd Board and SCA (WA) Inc. Council have been working steadily to explore the opportunities for, and the pathway to, a single national entity to represent the strata community. The milestones reached in this endeavour include:  February 2016 –National Council gave unanimous in principle agreement in support of a single national entity for the future of SCA.  March/April 2016- Development of a written Unification Proposal outlining a proposed governance and staffing structure and timelines for key steps  April 2016- WA Council resolution to support the Unification Proposal subject to certain assurances regarding: o o o o

Status of life members Board representation Budgetary processes Uniformity in staff structure

SCA Ltd Board and SCA (WA) Inc. Council see important opportunities that can be more easily realised through the proposed new structure. The proposed structure is the natural landing place for the process that was commenced in 2011 when SCA Ltd was incorporated and branding across the country was standardised. A single national structure should, we believe, enable acceleration towards uniformity and raising the benchmark in education, professional standards and accreditation, communications and our public relations activities. However we hope too that it will unlock internal efficiencies, costs savings and achieve economies of scale. Like all strategic decisions, there will be trade-offs involved in choosing this course. Council is conscious of the trade-offs and believes that the long term sustainability and effectiveness of SCA demands that this trade-offs be made. However what should not and cannot be compromised is the level of service to members at a local level. We also know that the vision cannot be achieved without the support and commitment of our members to this vision. Professional Standards SCA (WA) Inc. Council has formally endorsed and adopted a new Code of Conduct for our members. The Code of Conduct is not different in substance to the previous Code of Conduct. However the new Code of Conduct has also been adopted by the SCA Ltd Board and so is a uniform Code for members of all state affiliates of SCA Ltd. A national Code of Conduct is a significant benefit to our members and clients of our strata manager members. Members of the public can deal with our members with confidence knowing that, by their membership, they have agreed to be bound by a Code that applies throughout Australia. This step is also a precursor to the formation of a national disciplinary committee to deal with allegations of breaches of the Code of Conduct. This will bring added vigour, independence and transparency to disciplinary processes and aid in our goal of raising public confidence and professional standards in the sector. Rachel Cosentino

Applecross Exterior one-off repaint with access issues Comments: Perrott Painting were engaged to supply our service in carrying out the repaint project of this building in Applecross. The property had fretting and static cracking in the rendered surfaces (this is crazed or mapped looking cracking) and prescribed the use of an Elastomeric Membrane. Sustainability In Strata Schemes Policy Purpose Strata Community Australia (WA) provides this policy as a guideline for its members to use when necessary to educate owners of property within a Strata Scheme. It has been created for the members to distribute should the question arise about the SCAWA’s position regarding sustainability. What is Sustainability (in property) As the world adjusts to the climate changes affecting the environment, people are becoming fast aware of options allowing them to exercise their rights to enact sustainability in their homes. It comes in many forms covering, photovoltaic panels (electricity from the sun), solar panels, (hot water from the sun), grey water waste systems (watering gardens and lawns), rain water tanks, ceiling insulation, window treatments etc. WA is now home to the largest residential solar powered building in the Southern Hemisphere (640 panels), sustainability and or greening of buildings will increase and the demand for new technology will develop. Issues that a Strata Company may face when a request is made 1. Aesthetics. People’s POV’s or opinions will vary greatly on this issue. What to some owners will look unsightly others will not. Some of the sustainability initiatives will be out of sight and therefore this may not present itself as a problem. 2. Uniformity. By permitting an owner to take an initiative, may imply that other owners can do the same, but not necessarily result in the same design or materials being used. 3. Damage. Some Strata Schemes may experience damage as a result of the installation process, this can be compounded by using “industry cowboys” who may not be licensed or the DIY sector. 4. Permission. Some owners will simply proceed in doing their sustainability without permission of the Strata Company, this can cause friction amongst owners and de-stable the community living spirit. 5. Right Of Refusal. In the same vain as “permission” owners may exercise their right to simply say “NO” thus eroding the community spirit. 6. Fair Distribution. Some Strata Schemes may not have enough physical area to allow for the installations to occur for every owner. 7. Resolutions. Depending on the Strata Scheme, it may be necessary to seek a RWD as part of the approval process. These can be difficult to obtain. Policy Recommendations For SCA (WA) Members It is the policy position of the SCAWA to endorse all forms of sustainability, but only where it meets the requirements of the legislation contained in the Strata Titles Act 1985 and any other local authority By-Laws. Owners should not be affected negatively when considering implementation of any sustainability measures. Strata Company’s should consider additional By-laws to address, approval processes, design, materials, colours and future responsibility of equipment and or damage to common property (if any).

PRE-ELECTION CHALLENGE TO TURNBULL AND SHORTEN AUSTRALIA’S $1.2 TRILLION STRATA PROPERTY SECTOR SAYS “JOBS, SAFETY AND GROWTH” AT RISK OF BEING COMPROMISED Leaders of Australia’s $1.2 trillion strata sector are calling on the major Federal political parties to announce bans on unsafe building materials before the July 2 Federal poll and in turn create thousands of new jobs by supporting Australian made products. Australian property is suffering from the widespread use of dangerous, noncompliant building materials and industry leaders are adamant their elimination will lead to more local jobs and economic growth, along with the protection of property owners and manufacturers. The unsafe building materials in question are cheap, substandard imports and according to Australia’s strata property leader, stopping their use must be a top priority for the next Federal Government. “Cost over quality is an unfortunate principle that too many within construction have taken on recently and it is costing property owners on one hand, and Australian manufacturers on the other,” Strata Community Australia CEO Kim Henshaw said today. Mr Henshaw says it would be impossible to miss the impact this issue has had on Australian building standards and he calls for local construction manufacturers to be supported. “We understand first-hand what unsafe imports are capable of doing to strata property owners and the near extinction of locally made materials is a very ominous sign for our many thousands of stakeholders,” Mr Henshaw said. “As one of the key stakeholder groups, we have followed this issue at every turn and are clear on the fact that tightening regulations for building materials would avoid the major manufacturing job losses seen in places like South Australia.” Recent reports paint a grim future for the steel industry in Australia, with the Arrium Steelworks in Whyalla teetering on the edge of collapse and Mr Henshaw says if this repeats across other industries, Australian property will struggle to safely house residents. “Federal leaders have the opportunity to shut the door on dangerous products and open another that leads to home-grown job growth, so we call on leaders of all parties to consider the value of this action.” “Currently, some regions have the unenviable stats of 85% of buildings being defective on completion, and without the necessary attention, this could be a reality for the entire nation.” “This is costing owners millions and countless jobs in manufacturing and we want to see this issue given the attention it merits.” Mr Henshaw says a Senate Inquiry initially slated to deliver findings on the spread of unsafe building materials in September of last year, has again been delayed until September 30 this year, and owners need action to come sooner. “The action we’re recommending Federal leaders to immediately consider is a ban on the known offending products in Australia, with penalties for all involved in the supply chain and use of the products on building sites.” “Without a clear end in sight for the Senate Inquiry’s completion, Australia is dragging the chain on this issue and for the benefit of jobs and growth, we ask for it to be made an immediate priority.” ENDS ............/3 Strata Community Australia (National Office) Suite 101, Level 1, 845 Pacific Highway, Chatswood NSW 2067 P 02 9492 8250 | E admin@stratacommunity.org.au | W www.stratacommunity.org.au

WHY BECOME A NATIONAL ORGANISATION? WE MAY NOT HAVE ANY OPTION Nick Koerbin – Wednesday, May 18, 2016 Within the next few months, the Australian public will go to the polls to elect a Federal government that will aim to develop and implement policies that will benefit all Australians. Most of us take for granted that we have a national focus through our national parliament, however this did not come about easily. For over twenty years prior to Federation, there were numerous attempts to unify our nation, yet those attempts were hindered by a number of economic stakeholders. As we all know, 1901 marked the year of Australia’s federation, becoming a nation with one constitution and our first prime minister. Not unsurprisingly, this shift saw a definite move to a nationally unified country – it would have been very difficult to function as a new society if state interests overtook the wants and needs of an entire country. The Changing Face of Associations in Australia Thirty years ago, the core functions of many professional and industry-based associations were at a state level, relying on state based administrative bodies that would add value to local membership. Most communication to members was via letters, faxes or telephone and local training courses, events and membership was the core source of funding for state associations. I recall it was all hands on deck with mail outs used to promote events (with quite a high cost for the printing of the flyers), and registrations would come through the mail or fax machine. Our newsletters were printed and mailed out, and most of our communication to members was during meetings, over the phone or face to face. We relied heavily on staff and volunteers for the organisation to operate. In the last 20 years however, there have been many changes that have drastically altered the way things occur. With the introduction of the Internet, members do not have to rely on attending events anymore unless it is a part of their required personal professional development, or if it will help them directly with their business. As well as this, associations used to be responsible for the dissemination of a range of information and new knowledge. Attending association events were the prime place to access new information or connect with peers or access possible business opportunities. However, technological advances such as the Internet and social media have meant that the answer to any question is now at easy disposal. Associations used to offer industrial relations as a key benefit to their members; however they now have to compete with legal industrial relations firms that have a significant amount of resources at their disposal. Consequently, associations need to reinvent themselves and create a totally different membership model that is cost effective and a ‘value add’ for members. State Focus or National Focus? For associations to be relevant and grow their membership, they must be able to deliver quality services like any other business. They must consider how they deliver quality services like any other business. They must consider how they deliver their services, the cost of delivery and if those services really are meeting the needs of their members. It does not make sense if you are operating at a state level, and these services are being relocated throughout other states; the only option is to merge at one national entity.


WHY BECOME A NATIONAL ORGANISATION? WE MAY NOT HAVE ANY OPTION continued‌ Stakeholders, including the government, sponsors and funding bodies, all have a preference for working with a national association rather than separate entities. There are several reasons for this. From an economic standpoint, if there is a state association from NSW that delivers the same benefits and services as one in Victoria, then the overheads are essentially duplicated. Membership subscriptions need to cover the costs of staff, offices and infrastructure, so there is no use increasing membership subscriptions to cover costs, unless they are able to deliver added value. One of the key challenges to Associations is the nature of mirror organisations; these are for profit entities that deliver the same services as the association in a more cost effective manner. They are commercial organisations that term their clients as members and do not have to rely on the decision making of volunteer boards and committees to service the needs of their members. I have noticed a number of organisations of this nature that are filling the gaps where associations are not able to provide. Obstacles to Becoming a National Association If you are involved in the merging of state entities to become a national association here as some of the obstacles you will face. Power & Protection of Assets While forming a national body may seem like a natural next step, it tends to falter because of protection of jobs and state based income. Often when there is a drive to merge state entities as one body, the process falters due to self-interest. No matter how well you communicate with members, there will always be an individual or group within the association that will actively try to disrupt the process. Be prepared to spend considerable time working out the issues of those who believe their positions of power will be reduced. Process of Winding Up Even where there is a desire to merge as one national organisation, the process of winding up each state association can be long and tedious. The process usually includes holding special meetings, voting from members, and a liquidation of assets. No One is ready for a National Body In many cases, the national body doesn’t have the resources, or the capability to deliver services on a national basis to members throughout Australia. It is one thing having a national body, but if it does not have the systems and procedures in place to deliver cost effective services, then it can make things difficult. There are many cases where key industry and professional associations have merged, only to collapse because of poor planning and management decision and the power protection has not been fully addressed. In Summary There is no doubt that in the near future, more associations will be merging their like-minded or interstate counterparts. Associations of the future need to be proactive, consistently working to deliver the needs of their present and future members who are no longer confined by state boundaries. Their success or failure will be based on how responsible they are, their ability to deliver services on a national basis and also, how they present themselves to the entities and members that are willing to financially support them.

SCA (WA) office is busy implementing changes to better service our members. Due to the increased volume of phone enquiries received from the general public, we are in the process of improving our telephone system to direct calls efficiently to the information required. A new website for SCA (WA) has been a work in progress for the past couple of years and if everything goes to plan will be released before the end of this year. The website will provide a members login, with member benefits available online, it will also enable event registration/payments online and keep a record of your attendance and CPD points tally. We are working towards unification with SCA National with group discussions on a proposed national monthly newsletter which will replace the current E-News format. We are seeking feedback from our sponsors regarding their thoughts on the new format. FAREWELL JO Council have approved an increase of administration support in the SCA (WA) office from 3 days to 5 days per week. This was announced at the recent breakfast event held at Crown Perth on 23.6.16. Emerging Risks for Strata Managers Cyber Risks

Insurance advice – the risk of omission

Strata Managers increasingly find themselves in a very complex and competitive insurance marketplace. Some managers believe they are acting in the best interests of the Owners they act for by “covering the market” when they seek insurance quotations. This sometimes leads them to source direct quotations from the underwriting agency market and then also invite a broker to provide additional quotes from the balance of insurers and agencies that distribute only through brokers. This jumble of intermediation has potential to confuse owners as to who is actually acting in their best interests and who is able and willing to provide them with explanations and advice across the range of products and services on offer. The plethora of documents presented to owners in these scenarios will reveal that some quotes come from an agent of an insurance company and others from a broker acting in the owners’ best interests but who may have only sighted some of the product alternatives and prices. How are owners to make sense of who is acting for who? Owners will need to understand how the manager’s role straddles having a delegated authority and a contractual agency obligation to the owners on the one hand and meanwhile on the other hand they are acting as agents for an Australian Financial Services License Holder (either an Authorised Representative or Distributor). The manager or broker should clarify what role the broker has been asked to perform and the differences between the advice models available to the owners. The owners may have a particular risk exposure such as machinery or flood etc. and need advice on the optimum insurance solution. Perhaps there is already a special condition or cover in place for a particular exposure. How is the advice surrounding this exposure handled year to year, in particular when a policy is transferred? Often owners are simply provided with quotes, policy documents, financial services guides and the like to wade through. Owners are left alone with the responsibility to determine the most appropriate cover for their needs. When it comes to financial advice managers should consider not only what level of advice they can or can’t provide in particular circumstances, but also what they may be omitting to provide to owners to assist them make an informed decision.

Strata Managers are responsible for all sorts of Personal Information ranging from, Lot Owners, Executive Committees, Tenants etc. Personal information such as names, addresses, phone numbers, bank details, even potentially credit card information. There are varying levels of backups and protection on networks, some better than others, however, regardless of how good we think our system may be, we may still be vulnerable to Cyber-crimes or security breaches in one form or another. Often, it can take weeks to recover data or find out what caused the breach. You may lose revenue if you can’t trade and carry the cost of losing files or intellectual property. Your business reputation might also be damaged, particularly if customer records are compromised, leading to a long term impact on the business. More than 20% of Australian businesses experienced cyber-crime in 2012 (CERT Australia) and 40% of all attacks were directed at Small Business! (Symantec). GET VOLUNTEERING! During May, Property Services and Electrical Technologies team members volunteered at the house to cook as part of the ‘home for dinner’ program. Feedback from the employees who participated was fantastic with everyone enjoying their experience and acknowledging the great work RMH does for the community.

FACTS ABOUT RMH NEDLANDS RMH helps 1000WA families per year. The team prepares 730 meals per year. The number of volunteer hours required to keep RMH Nedlands running are as follows: 440 volunteer hours per week 22,990 volunteer hours per year
