New Developments, Changes to Rules of Membership, and more.
A
t the time of writing this I have just finished the November regional meetings, and once again, there was an excellent turnout with 179 attendees over the 6 meetings held in the UK. At these meetings I was able to inform members of the changes to ARCA Rules of Membership from 1st January 2020, which were announced at the AGM and communicated to members by letter in early November. Many of the changes are as a direct result of feedback from members received during member visits carried out 18 months ago, where members told us their biggest problem was the availability and quality of labour.

Members heard that ARCA is developing an App, the Asbestos Labour Feedback App (ALFA), which connects ARCA Labour Supply Members (labour agencies) to ARCA member asbestos removal companies (ARCA Full Contracting Members). Through the App ARCA members will be able to view operative training certificate details and performance ratings from previous jobs. ARCA member site supervisors can rate agency labour operatives for their job, and this rating will be added to their average overall rating. The operative will also be able to see their ratings via the App on their mobile device. We are currently piloting this App with three agencies and five ARCA Full Contracting Members. The pilot is going well and once we have reviewed the pilot, we plan to make the App available free of charge to every ARCA Full Contracting Member in Q1 of 2020. From 1st January 2020 there will be a requirement that any ARCA Full Contracting Member who uses agency labour for licensed asbestos removal work, shall source that labour only from an ARCA Labour Supply Member (labour agency) and use the ALFA App to rate all agency labour that is utilised once the App is available. The ARCA Labour Supply Members have agreed that from 1st January 2020 they will only use ALFA to assign operatives to the ARCA membership: operatives who have valid licensed asbestos removal training certificates from 2019, or where renewal has taken place post 1st January 2020, operatives who have attended a licensed asbestos removal training course, which has been delivered to a syllabus which includes mandatory practical training. This syllabus has been agreed between ARCA and UKATA, and will need to have been delivered by a training organisation who has been audited to ensure they have appropriate facilities to deliver
the necessary practical training. We are now working to provide a list of approved trainers for this purpose. We are confident that by implementing the above we will see a marked improvement in ARCA members’ experiences when using agency labour. The ALFA App will also act as a record keeping system of the quality and standards of agency labour that ARCA members have been employing and will also be useful when submitting a licence renewal application to the HSE. Also, members have been advised about another major change from January 1st 2020, that is, the ARCA Site Audit Accreditation Scheme (SAAS) will consist of three unannounced* site audits per membership year. We have seen the SAAS have a real positive influence on the standards of workmanship employed on ARCA member asbestos removal sites, particularly since the introduction of the mandatory unannounced site audits. Auditing ARCA members three times a year will provide an even stronger reassurance of ARCA member’s competency to both clients and the HSE at licence renewal. I believe that the measures outlined above will continue to achieve our aim of differentiating ARCA members from the rest of the HSE asbestos licence holders by demonstrating a commitment to quality and working to the highest standards in the industry. The new HSE asbestos licence renewal process was a topic of discussion at the regional meetings with feedback on what HSE should provide. For example, better guidance on making an application, better communication as to the progress of the application and ability to contact the inspector carrying out the assessment. I will be attending an HSE meeting to discuss the asbestos license renewals process on 17th December and will report back to the membership following this meeting. We have made great progress this year and I look forward to working with ARCA staff and members to put it all into action next year. Until then I wish you a Merry Christmas and a peaceful New Year.

ARCA and Members commit to a third unannounced site audit each year Association members take a further step to demonstrate high standards

o continue supporting high standards across membership, ARCA announced last month that the Site Audit Accreditation Scheme requirement would now be increased from two to three unannounced site audits each membership year from January 2020. The Association’s Rules of Membership set out the requirements of the ARCA Site Audit Accreditation Scheme (SAAS), which has been established as a requirement for asbestos removal contractor membership for over 18 years. Currently the scheme requires members to undertake two satisfactory unannounced site audits every year to maintain membership (both audits became unannounced, that is no prior notice, from January 2017(i)). “ARCA has seen members maintain
high standards of performance over the two years site audits have been unannounced. Now this increase in the number of site audits is a further step in our commitment to support our members’ maintenance of high standards, and a further step in providing reassurance to end-clients,” stated Steve Sadley, Chief Executive of ARCA. “ARCA is the association raising standards.” Being unannounced (no prior notice), ARCA membership audits give a more realistic view of a contractor’s usual performance on site and are also an indicator of the effectiveness of management arrangements of the contractor. These audits have become more recognised by third parties, such as the HSE and end-clients, as an excellent
independent assessment of a contractor’s performance and standards. Steve concluded; “As I have said previously, undertaking two ‘unannounced’ audits of every member, every year, was an expensive strategy as sometimes when our auditors arrive at a job it is not at a stage reasonable to audit or may have finished early(ii). We believe this to be a cost worth paying to ensure audits are truly unannounced.” “This announcement confirms our ongoing commitment to provide a strong level of reassurance of our member contractors’ competency to all parties.”

New Asbestos Licence Renewal Process ...Guidance

RCA has published a guidance document, including guidance from HSE, to support members in making their asbestos licence renewal application. This publication covers:
w Communication and Timeline HSE/ALU write to licence holders 4 months prior to renewal, a sample letter is included, and an application should be made at least 10 weeks (preferably 12) prior to the licence expiry date.
w Advice on re-applying for an Asbestos Licence This covers a number of topics including; prepare in advance of reminder letter, follow the application form carefully, relevant evidence, the referencing of documents and the amount of data provided. Also, when applying, if HSE has raised concerns they will want to see evidence of how those were addressed, preferably with evidence of effective controls in-place and working. THIS IS CRITICAL.
w Choosing and sending evidence There have been reports of numerous issues over the evidence (relevance and amount) supplied by some applicants, so this guidance (from HSE) is very important. The guidance covers evidence on assessing competency, air monitoring, Plans of Work and more. As well as, how to send and list evidence. Audit results show standards continue to rise ARCA award recognises 6 consecutive excellent audits

ore member contractors gain the ARCA Gold Site Audit Award this year, even when nearly 90% of the combined audits were unannounced. ARCA acknowledges member contractors’ consistent high performance on-site by presenting a Gold Site Audit Award. This award is not for just one excellent audit in one year but for 6 consecutive excellent membership audits in 3 years. “This is a very meaningful award as it proves high standards and best practice is maintained over a lengthy period of time and over various removal jobs,” commented Geoff Silver, Membership Compliance Manager for ARCA. “It is very important to recognise that, from the combined site audits undertaken by these winners in the 3 years, nearly 90% were unannounced audits. Royal Society for Public Health (RSPH) Centre of Excellence Award recognises centres which show commitment to their learners through high levels of teaching and support, alongside proven high pass rates. “This is a superb acknowledgement from RSPH and a tremendous boost for the team at ARCA,” commented Satish Patel, Training Manager for ARCA. “The teams’ commitment in supporting our candidates has been proven. When supported well, candidates perform well.”

RCA is proud to announce its support for Mates in Mind, a charity that strives to improve and promote positive mental health in the workplace. Mates in Mind was established to support and improve the mental health across the construction industry. Due to success in transforming mental health culture of workplaces across the sector, recognition was gained in new sectors. The charity’s aim is to increase awareness and understanding of mental health, as well as breaking the stigma around mental health through promoting cultures of positive well-being. “I would like to thank Stephen Haynes of Mates in Mind, for delivering an informative and interesting presentation at the ARCA Annual General Meeting in October, raising awareness amongst our members of mental health issues
within the workplace and how they can support,” commented Steve Sadley, Chief Executive for ARCA. “It was shocking to hear that the construction sector, which includes the asbestos industry, has the highest rate of deaths as a result of mental health issues. ARCA appoints Membership & Client Relationship Officer

RCA is pleased to announce the appointment of Peter Glossop as the Association’s Membership & Client Relationship Officer. Over the last few years managers of the Association have been visiting ARCA and ATaC members, to provide the opportunity to discuss directly with the owners or senior managers, any issues affecting individual members and how the Association is, and can support their business. “We received extremely positive feedback on visits. Both members and the Association saw the benefits of these visits in building closer relationships and as a private communication forum,” commented Steve Sadley, Chief Executive of ARCA. “Over the last two years, due to several new developments and initiatives the Association’s resources were stretched, which unfortunately meant that we could not undertake the number of member visits we would have liked.
We appreciate the importance of these meetings, and also the time required to undertake them, so we made the decision to create a new role to focus on visiting ARCA members on a regular basis.” “I’m pleased to welcome Peter to the team. To fulfil this role Peter brings with him over 35 years’ experience working in various roles within the asbestos management industry, including asbestos removal management, surveying and training.” “This is an exciting move for me as I know ARCA is a well-respected association and I look forward to working with the team,” added Peter. “I was delighted to meet many members at the November regional meetings and look forward to holding deeper discussions during individual member visits.”

ARCA Annual General Meeting 2019
T
he 34th ARCA Annual General Meeting (AGM) was held at Lords Cricket Ground, London on the 4th October. The Chairman, Jason Davy, welcomed everyone to the AGM and thanked Stephen Haynes from Mates in Mind for kindly speaking at the meeting. Stephen’s presentation informed the meeting about the work Mates in Mind, a registered UK charity, does to raise awareness and address the stigma of poor mental health, so promoting positive mental well-being across workplaces. Mates in Mind helps to support employers to address mental health within their workplace, working across industries, focusing on construction, as well as related sectors. Following on the Chairman introduced the Association’s Chief Executive, ARCA staff members and Committee Chairmen to report on the activities of the Association over the past 12 months and outline the plans for the future. Members present heard that the Association had introduced new developments to the Site Audit App, one being automatic marking of the site audits. This was, following feedback from members that results of audits were being provided to members far too long after the audit had taken place. ARCA has listened to this feedback and developed the App to automatically score and grade the audits, which is then emailed, along with an audit report to the ARCA member, normally immediately after the audit was completed. Also, the App identifies and collates any non-conformities within the internal audit report and presents the information within a separate Corrective
Action Report, so any actions to be rectified without delay. Members heard that the ARCA Site Audit Accreditation Scheme was the only scheme of its kind in any industry in the UK, as it is truly independent and unannounced. Therefore, ARCA site audits represent the best independent evidence to the HSE when submitting third party audits as part of the evidence for the new asbestos licence renewal process. As a result of the success of the Site Audit Accreditation Scheme to date, members were informed that from the 1st of January 2020 the scheme would be revised to include 3 unannounced site audits per membership year. Last year ARCA reported that when visiting members, it had identified that the biggest problem for Full Contracting Members was labour. That is availability of reliable and competent labour in general. The Chairman pledged to tackle this, and since the last AGM the Association has been working on a solution. The progress of the Asbestos Labour Feedback App (ALFA) was also communicated to members. The meeting was informed that the App will allow ARCA Member Site Supervisors to rate labour agency operatives working on their sites. An overview rating will then be available to other ARCA Member contractors to review prior to hiring the operative. The process has required the support of the labour agencies, and the Chief Executive was pleased to report that
all of the ARCA Labour Supply Members have agreed to support the system and play their part in making it work. The Chief Executive also informed members of the appointment of a Membership and Client Relationship Officer who was due to begin his employment with ARCA shortly. In this role, Peter Glossop, will be tasked with visiting members at their offices to discuss ARCA’s services, and listen to feedback from members on the services that ARCA offers. The revised HSE licence renewal process was discussed, and it was reported that this was not without problems as far as some ARCA members were concerned. The main problems seemed to be with submissions being either late or incomplete, resulting in the HSE not being able to process the application prior to the company’s existing asbestos licence expiring. These issues were raised by ARCA at the Asbestos Liaison Council Licensing Subgroup meeting, which was attended by Archie Mitchell, Head of the HSE Asbestos Licensing Unit, and Jo Makin, HSE Head of Customer Services. It was reported that HSE stated if a good submission was made in good time then the renewal licence would be issued in advance of the existing licence expiring. It was also stated that the incidence of issues with licence renewal, as a result of the new process, did seem to be diminishing. This was probably down to the guidance on submitting evidence,

which had been issued by the HSE and circulated by ARCA, along with the advice to submit your application early. Members heard an update regarding the development of an apprenticeship scheme for Asbestos Analysts and Surveyors. ATaC were now in a position where it is fully approved to deliver the Analysts and Surveyor Apprenticeship, and has now engaged the services of a consultant, a previous employee of the Education and Skills Funding Agency, to help put the correct admin process in place to operate the apprenticeships. The apprenticeship is over two-years,
with ÂŁ6,000 worth of funding available. The apprenticeship includes the RSPH qualifications for asbestos surveying, asbestos air monitoring and clearance procedure, and asbestos bulk analysis. ATaC hopes to be in a position to register apprentices by the end of the year. The Chairman, Jason Davy of Rhodar Ltd, closed the meeting and stated that his key goals for ARCA during his remaining year as Chairman remained the same, that is to continue to improve standards within the Association and the industry, including delivering better training and producing better performing labour.
Following the meeting members enjoyed a 3-course silver service lunch in the Thomas Lord Suite, and were entertained by Robin Horsfall, ex-member of the SAS and part of the Iranian embassy assault team, who provided the afterdinner speech. The ARCA AGM is always held on the first Friday of October, so next year that will be the 2nd October and will be held at Lords Cricket Ground, London. Please put this date in your diary now.

Company fined following multiple safety failings on construction site A
construction company has today been fined after failing to ensure the safety and welfare of workers on site during the renovation of a property. Preston Magistrates’ Court heard how, between 12 December 2015 and 14 June 2018, Navkaar Limited put its workers at serious risk of personal injury or death at a construction site in Blackpool. The company failed to prevent risks from falls from height, exposure to asbestos and dangerous electrical systems. There were no suitable welfare facilities and no measures to prevent fire on site. An investigation by the Health and Safety Executive (HSE) found that workers on site had carried out work in an unsafe manner without the appropriate measures in place to ensure their health, safety and welfare. The employees and contractors on site did not have the appropriate skills, knowledge and experience to complete the work. Navkaar Limited failed to comply with their duty as principal contractor to plan, manage and monitor the work being carried out on site. Navkaar Limited of Station Approach, Northwood pleaded guilty to breaching Regulation 13(1) of the Construction (Design and Management) Regulations 2015. The company was fined £35,000 and ordered to pay costs of £3,860. Speaking after the hearing, HSE inspector Jacqueline Western, said: “These risks could so easily have been avoided by simply carrying out correct control measures and safe working practices. Companies should be aware that HSE will not hesitate to take appropriate enforcement action against those that fall below the required standards.”

Property development company and director prosecuted after unsafe demolition work
A
building development company and its director have been sentenced after unsafe demolition work took place at a former pub in Bexley. Westminster Magistrates’ Court heard that on 22 June 2016, the former Ye Olde Leather Bottle pub was completely demolished without appropriate action taken to ensure members of the public were not in danger of harm. An investigation by the Health and Safety Executive (HSE) found no safe system of work existed at the time of the incident. There had been no asbestos survey done before the demolition work began, which meant any asbestos-containing materials present would, during the demolition, have caused asbestos fibres to be released and widely spread. The company had not arranged for gas and electricity supplies to be properly disconnected by the appropriate bodies, leading
to a potential risk of explosion or of electrocution of people on site. There were no measures, such as hoarding or fencing, of the site to prevent access to the dangerous activity, or to prevent the ejection of materials from site. The building was on a busy road and pedestrians passing by, including primary school aged children going to and from a school 200 metres away, and traffic were all at risk. Balmonza Ltd of Woolwich Road, London pleaded guilty to breaching Section 3(1) of the Health and Safety at Work etc. Act 1974 and has been fined £20,000 with £1000 costs. Mr Kulvinder Singh, also of Woolwich Road, London pleaded guilty to Section 37(1) of the Health and Safety at Work etc. Act 1974 and was sentenced to £5000. He was ordered to pay costs of £1000.

JW Building Solutions Limited, a contractor carrying out refurbishment work at the Sea Hotel in South Shields, and Hotel 52 (Sea) Limited, the client company who arranged this work, were sentenced after workers disturbed asbestos. South Tyneside Magistrates’ Court heard that while workers were refurbishing the bar area of the Sea Hotel in September and October 2018, they disturbed asbestos. An investigation by the Health and Safety Executive (HSE) found that both companies had failed to ensure an appropriate assessment was carried out to check for the presence of asbestos in the areas of the Sea Hotel where refurbishment work was taking place. RJW Building Solutions Limited of Bridge End Industrial Estate, Hexham pleaded guilty to breaching Regulation 5 of the Control of Asbestos Regulations 2012 and was fined £20,000 with £1,084.59 costs. Hotel 52 (Sea) Limited of Stockbridge, Newcastle upon Tyne pleaded guilty to breaching Section 3 (1) of the Health and Safety at Work Act 1974 etc and was fined £16,000 with £1,246.90 costs.
After the hearing, HSE inspector Loren Wilmot said: “Asbestos is a naturally occurring mineral fibre which was widely used in both building and engineering materials for its strength, heat and chemical resistance. There are several different types of asbestos however they all share similar properties. When asbestos is disturbed, fibres are released into the air where they can be inhaled and may penetrate the lungs. This can cause serious diseases including mesothelioma, lung cancer and asbestosis. These diseases do not have an immediate effect, they often take a long time to develop, but once diagnosed, they are often fatal. “Asbestos related disease is responsible for the premature deaths of approximately 5000 people annually. Whilst the supply and manufacture of asbestos has been prohibited in the UK for approximately 20 years it can still be present in any building or industrial process plant built or refurbished before the year 2000. “In this case both the client and contractor failed to protect workers from the risks to their health by failing to prevent their exposure to asbestos.”

Pre-Clean
Asbestos Environmental Cleans
The following is a summary of the ALC Technical Working Group (TWG) discussions and conclusions on Asbestos Environmental Cleans (Appendix 1/19). This information aims to clarify the meaning and licensing position of certain terms used in asbestos cleaning and removal activities, including ‘environmental clean’ and ‘preclean’. Category and Type of Work
It is important to ensure that the correct categories and work types are established as this has implications for the standards of control that should be employed. It is the responsibility of the asbestos contractor to assess the nature and duration of the work to establish if the work will be ‘cleaning’ (and the type of cleaning) or ‘removal’, and if the work is licensable or not.
Environmental Clean The term ‘environmental clean’ is often used in the asbestos management industry to describe certain types of asbestos clean-up and related activities. It has not been defined in Health and Safety legislation or associated ACOPs and Guidance. The term is sometimes used in different circumstances and there is often uncertainty as to whether a licence is required in order to carry out the work. The term may also have been applied to incorrectly classify licensed work.

The term ‘environmental clean’ is sometimes used interchangeably with, or as a substitute, for the term ‘pre-clean’ which may have led to the uncertainty. An ‘environmental clean’ and ‘pre-clean’ are essentially the same and involve a clean of an area where small/certain amounts of loose/ unattached Asbestos Containing Material (ACM) dust and debris (or suspect material) have been identified and can be removed simply (e.g. by picking or wiping up, or vacuuming) and safely.
Short Duration Environmental Clean (Non-licensed) and Licensed Clean The term ‘environmental clean’ is often used to describe work which is non-licensed. To clarify the licensing position regarding ‘environmental cleans’, this guidance introduces the term ‘short-duration environmental clean’ for non-licensed environmental cleans. This term should be applied to the simple ‘cleaning-up’ of ‘short-duration’ amounts of loose (i.e. unattached) licensable ACMs i.e. the clean-up work involves loose material only and meets the ‘short duration’ exemption criteria specified in Control of Asbestos Regulations 2012 (CAR 2012), regulation 2(3). Therefore, the maximum duration of the work is limited to 2 hours and no person can work for more than 1 hour. Where the ‘short-duration’ criteria are not met, then the work is licensable and must be notified to the appropriate enforcing authority. This is ‘licensed clean-up’. There also needs to be a clear distinction between cleaning up and asbestos removal. If the ACMs are still attached to the fabric of the building or other item, this is asbestos removal work. If the work is a ‘re-clean’ (i.e. removal of remaining material from a previous poor removal), it is not an environmental clean. It is asbestos removal. Asbestos removal may still be “non-licensed” work if the work meets the short-duration criteria.
guidance In summary, for the work to qualify as a ‘short-duration environmental clean’ and be nonlicensed, it must meet the following criteria: w The asbestos is present in the form of “loose” or “unattached” fragments, pieces, debris and dust w The material can be simply cleaned-up by lifting, wet-wiping, vacuuming or wetbrushing or similar w Meet the short-duration exemption criteria (Note: Any work with asbestos coating is always licensed - there is no short duration exemption). The type of situation where a ‘short-duration environmental clean’ would apply is where there has been spread of a small amount of licensed ACMs (e.g. following a “small scale” disturbance). In situations, where there has been significant contamination or spread of asbestos (e.g. from a more serious incident) and clean-up will exceed 2 hours, this will be licensed work. In contrast, cleaning-up of ACMs carried out prior to the starting of a formal “removal” (i.e. stripping) process of licensed ACMs (i.e. before erecting the enclosure) is usually classed as a “pre-clean”. This ‘pre-clean’ is the initial part of the licensed removal job and is therefore licensed work.
Pre-Clean Licensed Work A ‘pre-clean’ is defined in the Licensed Contractors Guide (HSG 247) (paragraphs 6.276.28). The pre-clean is part of the inspection process to prepare a site/job for asbestos removal work. The proposed work area should be inspected and assessed. The main purpose of the inspection is to identify the need for a ‘pre-clean’ and to prepare the site for work (e.g. by sheeting over or removing items, i.e. a ‘soft strip’), and to deal with matters which may impede or cause difficulties in obtaining clearance certification (e.g. remaining ACMs, wet floors etc). The inspection should be performed in the areas where clearance will be required i.e. the planned enclosure area, the relevant surrounding places such as transit and waste routes, and the area immediately next to where the enclosure will be located. The ‘pre-clean’ will involve cleaning-up loose ACM dust and debris. The activity is work with asbestos and will require appropriate dust suppression controls and adequate RPE and PPE to be employed.
Pre-Clean Non-Licensed Work The Licensed Contractors’ Guide also identifies that the assessment/inspection of a formal removal job may also identify that a ‘preclean’ may apply to situations where only nonasbestos debris and materials are present (HSG 247, paragraph 6.28). If these materials are not removed before the formal removal process starts, they are likely to become contaminated during removal activities and therefore will need to be treated as asbestos materials leading to unnecessary hazardous waste materials. Definitions, applications and licensed status of various cleaning and removal terms used in asbestos work are shown in the table below.

wners and managers of a premises, whether an office, shop, factory or school, must understand their legal duties as a duty holder under Regulation 4 of the Control of Asbestos Regulations 2012, as the failure of to effectively manage asbestos can and does lead to enforcement action from the Health and Safety Executive (HSE). If the premises you manage or own was constructed prior to the year 2000, you need to know if asbestos is present and manage the associated risks, as you are responsible for ensuring that employees and non-employees are not exposed to health risks as a result of the presence of asbestos. Asbestos is a hidden danger as asbestos containing materials could be found in
numerous places within a building, such as pipe lagging, insulation board, vinyl floor tiles and cement products. Being aware of where asbestos can be found, and how to manage the risks, is vital to reducing the health risks faced by workers and the public. Legal duties are covered in the Health and Safety at Work Act etc. 1974, Control of Asbestos Regulations 2012 (CAR 2012) and Construction (Design and Management) Regulations 2015 (CDM 2015). w Locating asbestos containing materials (ACMs), through an asbestos survey, therefore assessing the amount and condition of the ACMs. This information should be recorded, referred to as an
asbestos register, and kept up to date. w The duty holder will also need to produce a management plan, detailing how the risks from asbestos will be managed. w If ACMs need to be removed clients need to appoint a competent asbestos removal contractor. w After removal an analyst will need to verify that a work area has been thoroughly cleaned prior to handover for re-occupation or demolition work. Maintenance of Equipment -
Company needs to hold a licence to work with asbestos ARCA has been informed by Associate Members, who carry out maintenance of equipment used during asbestos removal works, such as NPU’s and H Class Vacuums, that there are some companies doing this type of work without a licence, even when this work falls under the regulatory definition of licensed work with asbestos, and therefore the company must hold a licence to work with asbestos (a licence issued by the HSE).
Regulation 3(3) of the Control of Asbestos Regulations 2012 (CAR 2012) states: Where a duty is placed by these Regulations on an employer in respect of employees of that employer, the employer is, so far as is reasonably practicable, under a like duty in respect of any other person, whether at work or not, who may be affected by the work activity carried out by that employer except that the duties of the employer— (a) under regulation 10 (information, instruction and training) do not extend to persons who are not employees of that employer unless those persons are on the premises where the work is being carried out; and (b) under regulation 22 (health records and medical surveillance) do not extend to persons who are not employees of that employer. Regulation 3(3) of CAR 2012 extends the licence holder’s duties (except for Regulations 10 and 22) for their own employees to all other
persons; this includes the persons who are carrying out the maintenance activities if they constitute licensed work. This amplifies the overarching duties in Sections 2 and 3 of HSWA which also apply. Regulations 11 and 16 are the main goals of CAR 2012 (prevention of exposure to asbestos and prevention of spread of asbestos) and Regulation 3(3) extends these duties to those who are not employees. Licensed asbestos removal companies therefore have a legal duty, so far as is reasonably practicable, to ensure that any maintenance work, which constitutes licensed work with asbestos, carried out on their equipment by a third party, does not lead to exposure to, or spread of, asbestos. A reasonably practicable way of achieving this is by using the services of maintenance company who has been assessed by the HSE as competent to carry out this type of work. That is, a maintenance company that holds a licence to work with asbestos issued by the HSE.

The importance of prioritising mental health within the workplace
I
n 2018, a study revealed that out of 44,000 employees, almost half of those surveyed had experienced a mental health problem in their current role. This same research found that only half of those who had experienced poor mental health had disclosed this to their employer, suggesting that as many as one in four UK workers is struggling in silence. Businesses are increasingly interested in demonstrating the value that they can bring to society, but to some extent they are still trying to understand their role in what some consider is a complex public health issue. So, whilst dealing with a myriad of business issues, it can become challenging to unravel and assess what options are available to best address this. According to the Health and Safety Executive, forty-four per cent of work-related ill health cases were attributed to stress, depression or anxiety, which amounted to 15.4 million working days lost in 2017/18. Further evidence as to the impact was provided in the Centre for Mental Health report published in 2017 that estimated the overall cost of not addressing mental health problems to UK employers to almost £35 billion, or £1,300 per employee.
For a business considering their bottom line, regardless of size, this can quickly add up.
What can be done? There are practical ways in which employers can help colleagues within the working environment. A starting point is that workers need to acknowledge and look after their own mental health. Increasing awareness and understanding is a key first step in a journey towards a culture of prevention. Furthermore, if the culture is to change in a workplace, managers need much more guidance on how to spot the signs of illness. This guidance should help initiate a conversation with a worker and provide further tools to continue the conversation in an appropriate way moving forward. Consistent messaging is another key area that we see as being critical to supporting the change and is another fundamental element in terms of Mates in Mind’s approach. Changes in culture will only come about if we begin with changing the way we think and talk about mental health.

Asbestos in Soil Classification of Work The following is a summary of the Asbestos Leadership Council (ALC) Technical Working Group (TWG) discussions and conclusions on Asbestos in Soil – Classification of Work (Appendix 2/17).
Licensed and Non-Licensed Work
Notifiable Non-Licensed Work (NNLW) and Non-Licensed Work
Licensable work is defined in the Control of Asbestos Regulations 2012 (CAR 2012), regulation 2(1) and is essentially work on certain defined asbestos products. These are asbestos coatings; and work on asbestos insulating board (AIB) or asbestos insulation which is not short duration. It is important to note that the definition of licensed product does not specify an asbestos type (e.g. crocidolite, amosite). Asbestos containing materials (ACMs) in buildings are often easy to identify as specific licensed products. However, the situation is generally different with ACMs in soils. Asbestos materials in soil will often have physically degraded and changed appearance. Therefore, they may not be readily identifiable as its original source material (e.g. lagging, insulation). For this reason, the definition of asbestos products used in CAR 2012 as a means of establishing licensable work cannot always be applied. Where the asbestos material in soil (e.g. debris) is not identifiable as a particular original product, then its removal would only become licensed work if the control limit or sporadic and low intensity limit (i.e. the STEL) (0.1f/ml (4-hour TWA and 0.6f/ml 10-minute TWA respectively) were likely to be exceeded. There is extensive airborne monitoring data which shows that these limits are very unlikely to be exceeded during soil related work. Therefore, most work on degraded asbestos materials in soils will be non-licensed. This process is presented schematically in Figure 1.
Non-licensed work also has requirements for notification, medical surveillance etc. unless it meets certain exemption criteria. The exemption conditions are set out in CAR 2012, regulation 3(2). The exemptions apply where the work involves either: (i) Short, non-continuous maintenance activities in which only non-friable materials are handled or (ii) Removal without deterioration of nondegraded materials in which the asbestos fibres are firmly linked in a matrix. The key considerations are whether the asbestos work can be classed as ‘maintenance’ or ‘removal’. If the work is not ‘maintenance’ then by default it is ‘removal’. The construction definition of maintenance work is used, i.e. renovation, repair, up-keep, redecoration. Most asbestos soil work is unlikely to be classed as ‘maintenance’. Therefore, it will default to ‘removal’. In this situation, the criteria to be used to assess whether the work is exempt from notification are: w The condition of the material at the outset (i.e. is it degraded?) and w The process of removal (i.e. will the material be degraded/deteriorate during the removal?). In many cases, the material will be considered to be in a degraded state and therefore the work will be notifiable (NNLW).

There may be some exceptions to this, for example; whole or fragments/pieces of rigid material still essentially intact, e.g. asbestos cement items, floor tiles or bitumen. Such materials even in fragment form still retains their structural integrity so that, each piece would still be regarded as non-degraded. If there is no further deterioration of the material during the removal from the soil (which there is not likely to be with excavation or handpicking procedures), then the work will be exempt from notification. However, where such materials were present as part of mixed asbestos waste, then the work would be notifiable (NNLW). A summary of the different licensed and notification categories of asbestos soil removal (with examples) is shown in Figure 2. Irrespective of the category of work involved, all work must be adequately controlled.

A contractor can request an audit to be unannounced, so the ARCA audit team will select when and where the audit will be carried out, or by arrangement, that is the contractor chooses the job/site/team to be audited. By arranging additional audits the business can select certain job types, enabling them to monitor various types of work that represents the business’s capability.
In fact, independent audits can be ‘arranged’ to monitor and provide verification for various situations, for example: w Cover all teams in all geographical regions w The client has requested an audit w The site is being overseen by a new Supervisor w The work has been planned by a new Contracts Manager w Forms part of the business’s TNA w The site is unusually complex or in a challenging environment. Just what is
Competent Advice? The introduction of the Management of Health and Safety at Work Regulations in 1993 established the principle of ‘competent advice’. This required employers to appoint someone competent to help their organisation to meet its health and safety duties. The Approved Code of Practice and guidance that accompanied the 1999 revision of these regulations provided further information regarding this requirement. Although this document has been subsequently withdrawn, the principles laid out relating to competent advice and assistance (and the regulations themselves) are still valid. When seeking competent assistance, employers should look to appoint one or more of their employees, with the necessary means, or themselves, to provide the health and safety assistance required. A competent person is someone with the necessary skills, knowledge and experience to manage health and safety. If there is no relevant competent worker in the organisation, or the level of competence is insufficient to assist the employer in complying with health and safety law, the employer should enlist an external service or person. In some circumstances a combination of internal and external competence might be appropriate, recognising the limitations of the internal competence. The appointment of health and safety assistants or advisers does not absolve the employer from responsibilities for health and safety under the Health and Safety at Work etc. Act 1974 and other relevant statutory provisions. Employers cannot devolve the management of health and safety risks to others. Competence, in the sense it is used in the Management of Health and Safety at Work Regulations 1999, does not necessarily depend on the possession of particular skills or

qualifications. Simple situations may require only the following: (a) an understanding of relevant current best practice; (b) an awareness of the limitations of one’s own experience and knowledge; and (c) the willingness and ability to supplement existing experience and knowledge, when necessary by obtaining external help and advice. More complicated situations will require the competent assistant to have a higher level of knowledge and experience. More complex or highly technical situations will call for specific applied knowledge and skills which can be offered by appropriately qualified specialists. Employers are advised to check the appropriate health and safety qualifications (some of which may be competence-based and/or industry specific), or membership of a professional body or similar organisation (at an appropriate level and in an appropriate part of health and safety) to satisfy themselves that the assistant they appoint has a sufficiently high level of competence.
Further Considerations When Engaging External Assistance Many employers manage most aspects of their business themselves, or with help from their staff. But if they are not confident of their ability to manage all health and safety in-house, they may need some external help or advice. Deciding what assistance is needed is very important. Unless employers understand their own needs and are clear about what they want, they probably won’t get the assistance they actually need. It is essential that any appointed specialist or consultant is competent to provide the organisation with correct, proportionate advice. Useful sources of competent advice include: w Asbestos Removal Contractors Association (ARCA) w safety groups w trade unions w consultants registered on the Occupational Safety and Health Consultants Register (OSHCR) w health and safety training providers w health and safety equipment suppliers

When liaising with an external provider of competent assistance and advice, it is recommended that employers: w clearly explain what you need and check that they understand you. Ask them to explain what they understand the work to be and what they will do, when they will do it and what they will charge you. w check for evidence of relevant training/ knowledge, such as formal qualifications or practical experience of providing advice in your industry specialism. Can they explain why they are competent to advise you on your particular situation? w shop around to find the right help at the right price. If you were buying equipment or another service for your business, you wouldn’t always accept the first offer, so do the same with health and safety advice. w check that the person you choose is adequately insured. w consider whether you have received the help you needed. Do you have a practical, sensible solution to your problem? Or have you ended up with something completely ‘over the top’ or a mountain of useless paperwork? If you are not happy with the solution, ask for an explanation and whether
there may be a simpler alternative. w try to make sure that you get a good follow-up service, and that you are able to get further advice on any issues that arise from implementing their recommendations.
Fit for Purpose In seeking health and safety assistance, the advice obtained must be: w Right: based on a correct assessment of the risk; and taking account of any established standards (e.g. legal requirements, exposure limits etc.) and best practice (e.g. as found in ARCA or HSE guidance); w Tailored: directed at the actual circumstances found in the workplace under consideration; based on knowledge and experience of the particular industry, process etc.; and tapping into the knowledge and experience of both the management and workers of the organisation. w Sensible: concentrating on practical action to control significant risks not over responding to trivial risks; not pursuing paperwork as an end in itself; and looking to control measures that are reasonably practicable.
Competence and value for money are demonstrated by quality and clarity of practical advice, not by volume of paperwork.
And Finally… Evaluate The most favoured arrangement is to develop the expertise in-house. If you don’t have this already, do you have a plan to appoint employees who have the level of health and safety competence required, or to develop existing employees to fill this role? If you have engaged external assistance, was the advice obtained proportionate and understood, and did its implementation achieve the impact intended? Did the external assistance focus on reducing real risks, both those that arise more often and those with serious consequences?

THERMAC LAUNCHES NEXT GENERATION WET VAC Powerful and reliable ‘H-Type Wet Vac’ features four-stage filtration and submersible pump

hermac, one of the UK’s leading suppliers of specialist equipment to the asbestos and construction sectors, has launched a new wet vac that has been designed to be fully compliant with the requirements of BS8520.3.2009. Thermac has a long history of developing pioneering solutions for the industry and this latest development, the ‘M-Series Wet Vac’, has been developed in direct response to an industry-wide demand for a fully compliant solution that also delivers increased efficiency, reduces downtime and the need for manual handling. Typically used within asbestos enclosures or flooded sites where there is a contaminated water risk, Thermac’s powerful and reliable wet vac features a submersible pump which continuously pumps out the filtrated water directly into a suitable drain, therefore removing the need for operatives to manually lift and pour away potentially contaminated water. Its four-stage filtration system includes a strainer bag, situated within the 90-litre collection tank, which collects the majority of the solids from the contaminated materials vacuumed. The water filters through the strainer bag into the collection tank, where it is pumped out via an external
filter system, housing a ‘5-micron absolute filter’, directly to a suitable drain. To deliver an efficiency level of 99.995%, the main HEPA filter is fitted to the underside of the motor head, ensuring the exhausted air from the unit is free from any contaminates. Another HEPA filter inside the head of the vacuum also ensures the motor cooling air is contaminant-free. Thermac’s H-Type Wet Vac is available to hire from January 2020. he Asbestos Removal Contractors Association is delighted to announce the thirty-seven member companies who have achieved the Gold Training Award for 2018/2019. NVQs require effective planning ARCA can provide an efficient assessment process Asbestos removal operatives and supervisors can gain an NVQ in the shortest possible time when the assessment process is planned well in advance, especially as a candidate can need up to three assessment sites and dates scheduled. By discussing appropriate sites and timings, ARCA will be able to provide members with the best possible assessment plan for a Level 2 and Level 3 NVQ.
