As we progress through 2025, ARCA continues to strengthen its position as the leading voice for the asbestos removal industry, whilst actively engaging with the evolving regulatory landscape.

Regulatory Developments and Industry Engagement

I recently represented ARCA at the Asbestos Network Technical Working Group meeting, where we continue developing essential industry guidance. The working group made significant progress on several key areas benefiting our members’ operations.

Particularly significant was progress on the ‘Leak Testing Appendix’, still under development and likely to be published under a different title encompassing all necessary actions for maintaining enclosure integrity. This comprehensive guidance will include detailed procedures incorporating both smoke testing and leak testing strategies, providing invaluable support to help members maintain the highest operational standards.

We also progressed discussions on Restricted Space Enclosures, addressing complexities of working in restricted spaces,

especially within occupied social housing environments. This work recognises unique challenges our members face when spatial constraints and resident considerations require careful planning and execution.

The group examined timber reuse guidance, focusing on safe distinction between contaminated internal materials and potentially reusable external components from enclosure frameworks. These developments will be covered at our regional meetings, beginning 3rd June.

Lyndsey Baldwin’s recent presentation on HSE’s approach to the Work and Pensions Select Committee recommendations provided valuable insights into current policy landscape. Her presentation outlined HSE’s consideration of three key areas: notifiable non-licensed work categorisation, surveyor accreditation requirements, and four-stage clearance analyst independence. Importantly, she indicated it is unlikely the UK will mirror the EU Asbestos Worker Protection Directive in lowering the control limit.

Member Satisfaction and Continuous Improvement

I’m delighted to share highlights from our recent member feedback analysis, demonstrating the value our members place on ARCA services. The comprehensive survey, conducted between November 2024 and May 2025, gathered nearly 300 responses and revealed an outstanding Net Promoter Score of 88, with 90% indicating they would speak positively about ARCA services.

Particularly pleasing was the exceptional performance of our Site Audit Accreditation Scheme (SAAS), achieving an NPS of 95. This feedback came directly from site supervisors following their audits, representing the first time we’ve engaged at this operational level. Their response rate of 33.9% was the highest surveyed, and their comments highlighted the professionalism, fairness, and expertise of our audit process.

OUR VISION

We envision being an essential strategic partner, through membership of ARCA and ATaC, to all companies providing asbestos management and licensed asbestos removal services, or services to those companies, by providing solutions which contribute to the overall success of their businesses and provide reassurance to their clients.

Our training programmes performed strongly with an NPS of 81, reflecting the quality of instruction and practical relevance delegates value. However, we received comments regarding food selection at one of our centres. We recognised an opportunity for improvement and investigated alternative providers. We will soon switch to a new catering provider at that centre, demonstrating we actively monitor feedback and listen to our members.

These results reinforce our commitment to data-driven service improvement.

Operational Updates

Following successful review and update of our site audit forms for full members, we’ve commenced updating audit forms for maintenance licence holder members. This ensures consistency and relevance across all membership categories whilst reflecting current industry practices and regulatory requirements.

Finally, I’m pleased to announce our Annual General Meeting will take place on 3rd October 2025 at the IET London: Savoy Place. It represents an excellent opportunity for members to review our progress and contribute to our strategic direction. Please mark this date in your diaries - the booking process will open soon.

ARCA Site Audit Form Version 17 Enhances Quality Standards

ARCA is pleased to announce the release of Version 17 of our Site Audit Form, effective from 14th April 2025. The updated form represents our ongoing commitment to maintaining the highest standards of quality and safety within the asbestos removal industry.

The annual review process ensures our audit procedures remain relevant and effective, incorporating feedback from auditors and members while reflecting current best practices and regulatory requirements.

Key Enhancements

Several important additions have been incorporated into the new version to strengthen our quality assurance process:

w A new requirement for auditors to confirm that supervisors unde rstand audits should not impede ongoing work

w Enhanced documentation requirements for baglock arrangements when separate baglocks are not provided

w Ve rification that Plans of Work have undergone proper peer review b efore implementation

w Improved RPE documentation requirements, including unique identification for orinasal respirators

These changes, while relatively modest in scope, address specific gaps identified during the past year of site audits and member feedback.

Member Feedback Drives Continuous Improvement at ARCA

Data-Driven Approach Reveals Strong Satisfaction Results

At the 2024 Annual General Meeting, ARCA committed to becoming a data-driven organisation. To fulfil this commitment, ARCA introduced a new text-based feedback system in November 2024, with full implementation completed by February 2025.

The system sends short, focused feedback requests to customers by text (SMS messaging) immediately after they use ARCA services. This approach ensures feedback is timely and specific.

The recent analysis of feedback gathered nearly 300 responses between November 2024 and May 2025. Results show an overall Net Promoter Score (NPS) of 88, with 90% of respondents indicating that if the opportunity arose, they would be likely to speak positively about ARCA services.

Response rates demonstrate strong customer engagement, with the highest rates (21%) achieved in November 2024 and January 2025 during the system’s rollout period.

“We view these survey results as vital feedback rather than merely performance metrics,” notes ARCA Chief Executive, Steve Sadley. “Every response helps us better align services with industry needs. We’re committed to reviewing all feedback and implementing practical changes where necessary.”

Key Service Areas Performance

The survey shows strong satisfaction with ARCA’s Site Audit Accreditation Scheme (SAAS), which received an NPS of 95, with 96% of respondents indicating that if the opportunity arose, they would be likely to speak positively about ARCA’s Site Audit Accreditation Scheme.

This feedback was provided by Site Supervisors after having their sites audited by ARCA. It is the first time ARCA has engaged with supervisors at this level, making these results particularly noteworthy. The association values the feedback provided by the supervisors, who have delivered the highest response rate of any service surveyed at 34%.

Member comments from site supervisors included feedback such as “professional attitude, very clear and fair audit,” and appreciation for auditors who were “very knowledgeable and polite... took time to explain things.”

ARCA’s training programmes received an NPS of 81, with 86% of delegates stating that they would be likely to speak positively about ARCA training courses. According to the survey data, members valued the quality of instruction and content relevance. Delegate surveys achieved an 18% response rate.

Results From Different Service Users

The survey gathered feedback from various individuals who use ARCA’s different services, all showing positive results.

Company contacts who receive audit reports provided the most enthusiastic feedback, with a perfect 100 NPS score—meaning every single respondent indicated they would be likely to speak positively about ARCA’s Site Audit Accreditation Scheme reports.

Those responsible for booking training courses gave very strong feedback with a 92 NPS, indicating high satisfaction with the booking experience and customer service.

Regional meeting attendees rated their experiences positively with a 71 NPS and a response rate of 14%, while individuals completing ARCA qualifications showed the highest engagement, with a response rate of 43%. Their NPS of 67, while the lowest among the groups surveyed, still represents a strong positive score.

All scores exceeded industry benchmarks for professional services, with even the lowest score of 67 falling into what would typically be considered the “great” range.

Consistency in Feedback

Monthly NPS scores over the six-month period show consistently excellent results with some seasonal variation:

• November 2024: 96 NPS

• December 2024: 79 NPS

• January 2025: 85 NPS

• February 2025: 89 NPS

• March 2025: 86 NPS

• April 2025: 96 NPS

The December decrease and April increase likely reflect seasonal patterns in our industry. In December, we typically see fewer site audits due to the holiday slowdown in construction activity, which means our feedback mix shifts toward training delegates and qualification participants who tend to provide slightly lower ratings. April’s uptick coincides with increased construction activity in spring, bringing more feedback from site supervisors who consistently provide our highest satisfaction scores.

Through analysing comments provided in survey responses, four themes consistently appeared across different months:

w Professionalism in communications and service delivery

w Quality service with attention to detail

w Fairness, particularly regarding the audit process

w Knowledge and expertise in addressing industry issues

These consistent themes reinforce that ARCA is delivering reliable quality service throughout the year despite seasonal fluctuations.

How We Collect and Use Feedback

“Our text-based feedback system gives us immediate insights into member experiences across all our service areas,” explains ARCA Chief Executive, Steve Sadley. “By surveying members right after they use our services, we capture their impressions while they’re still fresh, allowing us to identify both strengths and improvement opportunities in real time.”

The system sends short SMS surveys to different member groups—site supervisors after audits, delegates following training courses, company contacts receiving audit reports, individuals booking courses, attendees after regional meetings, and qualification participants.

“We review this feedback continuously rather than waiting for quarterly or annual reports,”

states Steve Sadley. “This allows us to spot and address issues quickly, and to recognise and reinforce what’s working well.”

Understanding the Numbers

Net Promoter Score (NPS) is calculated based on responses to the question “If the opportunity arose, how likely would you be to speak positively about ARCA?” Respondents provide a rating between 1 and 10.

w Promoters (score 9-10) are likely to continue using services and refer others

w Passives (score 7-8) are satisfied but not enthusiastic

w Detractors (score 1-6) may be dissatisfied with aspects of service

The NPS is calculated by subtracting the percentage of Detractors from the percentage of Promoters, yielding a score between -100 and +100. Industry benchmarks typically consider any positive score to be good, +30 as great, and +70 or higher as excellent.

The high proportion of promoters (90% for the overall ARCA score) indicates that the vast majority of surveyed members not only value their membership but are also likely to speak positively about ARCA if the opportunity arises. Looking at the distribution of scores, 230 of 296 responses gave a perfect 10 rating, 37 gave a 9 rating, while only seven responses were 6 or below.

ARCA to Exhibit at Contamination and Land Remediation Expo 2025

ARCA will be exhibiting at the Contamination & Land Remediation Expo on 17-18 September 2025 at the NEC Birmingham.

ARCA’s Site Audit Best Practice Course

This course equips site teams with essential knowledge of the ARCA audit process, improving health and safety management performance. Designed for supervisors and operatives, it clarifies auditor expectations and team member responsibilities.

Based on HSE’s “Successful Health and Safety Management HSG65,” audits are categorised into Plan, Do, and Check performance areas. The Site Audit portal identifies improvement opportunities and addresses noncompliances.

Delivered in-house, the course includes comprehensive guidance notes and reviews company-specific non-conformances to develop best practices. Implementation of these principles can help members achieve the ARCA Site Audit Gold Award.

HSE’s 2025-2026 Business Plan:

Key Implications for Licensed Asbestos Removal Contractors

The Health and Safety Executive (HSE) has published its Business Plan for 2025-2026 (April 2025 to March 2026) with significant developments for licensed asbestos removal contractors. As the Asbestos Removal Contractors Association (ARCA), we have analysed the key implications for our members.

Major Inspection Programme for Licensed Contractors

HSE will deliver 800 asbestos contractor licence compliance inspections during 2025-2026 to ensure contractors “remove and dispose of asbestos safely.” HSE emphasises they will be “continuing to regulate licence compliance for asbestos contractors.”

Regulatory Reform Consultation

HSE plans to “Complete proposal for consultation about targeted reform to the Control of Asbestos at Work Regulations” by Q4 2025-2026 (January-March 2026). This consultation will provide licensed contractors an opportunity to contribute to regulatory development.

Broader Asbestos Strategy Context

Licensed contractors operate within HSE’s strategy to “address the legacy of asbestos in Great Britain by targeting those most at risk,” including:

w 8,000 broad health priority inspections covering “asbestos –duty to manage”

w 700 inspections targeting “Duty to manage asbestos in public sector buildings” (40-60% enforcement rate expected)

w Enhanced communications and guidance for workers

HSE’s Strategic Context

The asbestos programme supports HSE’s objective to “Reduce work-related ill health, with a specific focus on mental health and stress” using “a blend of regulatory approaches” including driving sustainable compliance and building evidence bases.

HSE acknowledges that “demand has exceeded our capacity” in some areas and may need to “reprioritise our resources,” but the 800 contractor inspections remain a defined priority.

Looking Ahead

The 800 planned inspections represent significant focus on our sector within HSE’s 2025-2026 programme. The regulatory reform consultation, ready by March 2026, provides an important opportunity to contribute industry expertise to regulatory development.

ARCA recognises the importance of maintaining professional standards while ensuring regulatory developments support both safety objectives and viable operations. We encourage members to stay engaged with current requirements and our association throughout 2025-2026 as these developments progress.

The focus on asbestos reflects the ongoing importance of professional removal services in protecting workers and the public. Through operational excellence and constructive regulatory engagement, ARCA members continue demonstrating the vital role of licensed contractors in managing Britain’s asbestos legacy safely and effectively.

HSE Public campaigns are reaching new audiences

HSE’s public awareness campaigns have achieved significant reach and engagement, particularly through innovative approaches to access audiences not traditionally engaged with health and safety messaging. The combined “Asbestos, Your Duty” and “Asbestos and You” campaigns generated 28 million engagements between April 2024 and February 2025, with nearly 200,000 page views of HSE guidance materials and almost 60,000 downloads of resources including guidance documents, duty to manage templates, and educational videos. The domestic renovation campaign represented

a new strategic approach, targeting homeowners and small-scale renovators who might not typically encounter HSE materials through professional channels. This campaign specifically focused on encouraging domestic clients to ask contractors about asbestos risks before work begins, then directing them to appropriate guidance and resources.

Perhaps most innovatively, HSE has begun working with social media influencers within the building trades, recognising that traditional channels may not reach all relevant audiences. Two influencers

were engaged to create authentic content speaking directly to their followers in language and contexts that resonate with working tradespeople. One roofer from Devon developed a memorable catchphrase “eyes on” to remind viewers to consider asbestos before drilling or cutting, demonstrating how authentic voices can deliver safety messages more effectively than formal guidance. The YouTube component alone of this influencer campaign achieved 80,000 views, suggesting significant potential for this approach to reach workers who might otherwise miss important safety information.

It was a glorious sunny morning on the 3rd April 2025, during Global Asbestos Awareness Week, when Asbestos Information CIC presented its comprehensive proposal for a national asbestos strategy at a parliamentary launch event in Portcullis House, London.

The event started at Parliament Square under the watchful eye of Sir Winston Churchill and was well attended by many industry professionals, including ARCA and ATaC, stakeholders, trade unions, victim support groups and media. Demonstrating strong support to address one of the UK’s most pressing public health challenges

Key innovations presented at the event included:

w The Asbestos Information Certificate (AIC) - providing clear, accessible risk information

w A data-driven framework for prioritising removal, focusing first on scho ols and vulnerable populations

w Integration with broader infrastructure maintenance and Net Zero planning.

This comprehensive industry participation reflects a shared commitment to improving asbestos management standards nationwide. As Industry professionals we have seen first-hand how this coordinated approach could transform asbestos management across the UK.

Parliamentary Launch of Asbestos Information CIC’s National Strategy Report

A Data-Driven Approach to an Ongoing Challenge

Despite the UK’s ban on asbestos use since 1999, the country continues to have one of the highest rates of mesothelioma deaths globally. With over 5,000 asbestosrelated fatalities per year, accounting for 40% of the UK’s occupational cancer cases and costing society around £1.2 billion annually.

Liz Darlison, CEO of Mesothelioma UK said: “We supports patients and relatives most affected by the UK’s asbestos tragedy. We are keen to support initiatives that prevent others experiencing the same devastating diagnosis. We welcome the findings of this important report, and hope that the Government will take the necessary action, by adopting the proposals set out here, to help protect future generations.”

With over 7 million lines of data from nearly 400,000 properties, arguably the largest dataset ever gathered in the UK, the report revealed some alarming statistics. The data identified almost 3 million asbestos items, with the highest risk group (E-G) accounting for nearly 26%. At current removal rates, addressing this issue could take up to 100 years.

Even more concerning, the report found that 71% of recorded asbestos items had some form of damage, and almost 30% of high-risk items suffered moderate or significant damage, suggesting that asbestos management was ineffective.

The report author John Richards states: “The data clearly shows that those asbestos materials which represent the highest risk to human life are the products with the highest levels of damage. The arm’s length policy that places a duty on owners and

leaseholders to manage asbestos in their buildings isn’t working.”

Central to the proposal is the introduction of an Asbestos Information Certificate (AIC). This innovative approach would provide clear, accessible information, to Dutyholders, about asbestos risk in their buildings, while forming the foundation of a comprehensive national database.

The incorporation of an ‘Asbestos Information Certificate’ builds further from this, presenting any worker or the wider public with an accessible method to understand the risks of a building - based on the format of the Energy Performance Certificate which the UK public are well accustomed to.

Strategic Implementation

While the asbestos sectors remain relatively small economically, no-one can undertake work on pre-2000 properties without considering asbestos. Therefore, the asbestos strategy has outlined five necessary steps -

1. Identifying properties likely to contain asbestos

2. Rat ionalising data collection and terminology

3. Presenting data through the Asb estos Information Certificate

4. Implementing the AIC across sectors, b eginning with education

per annum, the event emphasised the critical importance of integrating asbestos management into broader infrastructure and Net Zero planning.

The report represents a game-change on this point, providing the ability to highlight where asbestos is located and enable strategic action to tackle the problem. An interactive map shows the level of asbestos risk in each parliamentary constituency, for example, the Prime Minister’s constituency of Holborn and St Pancras has 40,000 buildings contain asbestos, with over half of the highest risk items found to be damaged.

The development of an interactive map is a significant step forward, demonstrating how amalgamating existing asbestos data could inform national and regional strategies to help duty holders manage asbestos compliance; enable the identification of the highest-risk buildings, such as schools and hospitals; improve oversight by the HSE; and ultimately enable the phased removal of asbestos from all buildings in the UK.

UK Government is always looking for examples of competitive industries that stand up proudly to state how they can together help the public good and find innovative solutions to tackle society’s greatest challenges. This report is a model of that behaviour. Now we need Government to match this drive from industry, take the foundations of this report and support it.

Contractor sentenced after uncontrolled spread of asbestos

Aself-employed roofing contractor has been ordered to undertake unpaid work after the uncontrolled spread of asbestos in a back garden, putting two young workers and local residents at risk.

Doorbell-cam footage shows parts of an old garage roof being disposed of with a lack of control measures.

The footage has been released by the Health and Safety Executive (HSE) at the start of Global Asbestos Awareness Week today, Tuesday 1 April, to highlight the dangers.

Stephen Wilks, trading as S Wilks Roofing, pleaded guilty to breaching asbestos safety regulations after work carried out under his control led to the contamination of a residential area with asbestos-containing materials.

The court heard how Mr Wilks had been commissioned by a property management company to replace asbestos cement roof sheets on three garages off Green Walk in Bowden, Altrincham in February 2022.

HSE began an investigation after a local resident raised concerns about debris that had fallen into their garden during the work. Analysis confirmed the debris contained chrysotile asbestos.

HSE inspectors discovered ripped bags of asbestos waste stored in a publicly accessible

area in front of the garages, with asbestoscontaining materials spilling onto the ground and contaminating nearby undergrowth. Further investigation revealed that residents’ personal belongings stored in the garages had also been contaminated.

The footage showed two workers under the supervision of Mr Wilks improperly clearing asbestos debris from a neighbouring garden and disposing of it in domestic waste bins, highlighting the unsafe practices that led to this prosecution.

HSE’s campaign “Asbestos and You” reminds tradespeople about the dangers of asbestos and the importance of working safely with it.

The regulator also provides comprehensive guidance for workers and employers about working safely with asbestos on its website. This includes information on how to identify asbestos, what to do if you find it, and the appropriate safety measures needed when working with or around asbestoscontaining materials. Workers in trades such as construction, maintenance, demolition and installation are particularly at risk and should ensure they have appropriate training before starting work that might disturb asbestos. This guidance is available on the HSE website.

The property management company

subsequently arranged for a licensed asbestos removal contractor to safely collect the waste and thoroughly clean the affected areas.

Mr Wilks pleaded guilty to breaching Regulation 11(1) and Regulation 16 of The Control of Asbestos Regulations 2012, which require proper planning and precautions to prevent exposure to and spread of asbestos during non-licensed work. He was sentenced to a 12 month Community Order with 200 hours of unpaid work and was ordered to pay £3582.13 costs at a hearing at Ashton-Under-Lyne Magistrates Court on 28 March 2025.

HSE Inspector Phil Redman said: “This was a serious incident that put Mr Wilks, those working under his control, and members of the public, at risk from the potential harmful effects of being exposed to asbestos-containing materials. Duty holders are reminded to ensure they fully control the risks associated with the removal of asbestos-containing materials that do not require removal by a licensed asbestos removal contractor.”

The prosecution was supported by HSE enforcement lawyer Kate Harney and paralegal officer Rebecca Withell.

Family wins compensation after asbestos-related death

The family of a man who died from an asbestos-related cancer have won compensation from his former employer and donated a portion of it to the hospice which cared for him.

Vincent Downton, 63, Amesbury, Wiltshire, died in October 2023 after working as a painter and decorator for five years more than four decades ago.

As part of their settlement, his wife and son secured £23,000 for Salisbury Hospice, which cared for him before his death.

Carol Downton said giving something back to the charity meant everything to her. She added: “His last few months would have been unbearable without the hospice’s help.”

Their son Bradley told BBC Radio Wiltshire: “They enabled dad to live during his last few months.”

Mr Downton died just a year after he was diagnosed with mesothelioma, which is classified as an industrial disease.

He was exposed to asbestos between 1977 and 1982 when he worked as a painter and decorator.

Following his diagnosis, Mr Downton was able to enjoy one final

holiday with his family thanks to the hospice’s help with his medication.

Mrs Downton said: “Vincent so wanted us to go on holiday to Majorca – and if it wasn’t for the support of Salisbury Hospice in helping to manage his pain that would never have been possible.

“The staff and volunteers were absolutely amazing with him, we will never forget that.

“Vincent said he felt secure in the hospice, and we as a family felt supported the whole time. They did everything for us they possibly could.”

‘Heartfelt gesture’

Their son Bradley added: “If we can help even one other family, then that’s all we want.”

Tom Goodinge, director of fundraising and marketing at hospice, said the charity was “incredibly thankful to the Downton family”.

“It is a heartfelt gesture that reflects the trust they placed in our care during such a difficult time,” he added.

Builder sentenced for unlicensed asbestos removal

Abuilder has been fined after carrying out unlicensed asbestos removal work at a house in Cheadle, Manchester.

Gavin Mutch, trading as G Mutch Developments, had been contracted to carry out renovations at the property including roofing work. Despite being warned by the customer that asbestos was potentially present in the fascia boards, Mr Mutch proceeded to remove the asbestos-containing materials on 8 September 2022.

An investigation by the Health and Safety Executive (HSE) found Mr Mutch had carried out unlicensed and therefore illegal asbestos removal work. This type of work should only be undertaken by a licensed asbestos contractor with appropriate safety controls in place.

Mr Mutch, of Cheadle Hulme, pleaded guilty to breaching Regulations 3(2) of the Health and Safety at Work Act 1974 at Manchester Magistrates Court on 8 April 2025. He was sentenced to a 12 month Community Order with 180 hours Unpaid Work and ordered to pay £2000 in costs.

This case highlights the importance of HSE’s current “Asbestos and You” campaign, which reminds tradespeople about the dangers of asbestos and the importance of working safely with it.

HSE has provided a comprehensive update on asbestos regulation developments, inspection activities, and research findings. Key highlights include evidence supporting mandatory UKAS accreditation, ongoing regulatory reform consultations, and expanded inspection programmes targeting schools and local authorities.

n Key Developments

New research on asbestos survey quality shows clear differences

HSE has completed a significant study comparing the quality of asbestos surveys conducted by UKAS accredited organisations versus those without accreditation. This research was undertaken to provide an evidence base for whether HSE should make accreditation mandatory for all asbestos surveyors, following recommendations from the Department for Work and Pensions (DWP) Select Committee.

The study analysed 62 survey reports equally split between UKAS accredited and non-accredited providers. The surveys reviewed were a mixture of management, refurbishment, and demolition survey reports. HSE’s science division developed a weighted scoring system with a maximum possible score of 760 points, where a score of 600 was indicative of high compliance. The study compared the survey reports against HSG 264 guidance (Asbestos: The survey guide) using this scoring framework.

The results showed that UKAS accredited surveys scored higher than non-accredited ones, with higher mean scores and the dataset being more skewed towards the higher end of the scoring matrix. In contrast, the non-accredited surveys included a couple of reports that scored in the lowest category, with very few scoring at the highest end compared to the accredited reports.

The accredited surveys performed better particularly in three key areas: clarity of caveats (which indicate to clients where areas haven’t been inspected and where you must presume asbestos could be present), having a technical reviewer who was a different person to the author, and including no-access areas in the executive summary. The better performance in having

independent technical reviewers likely reflects that many non-accredited survey organisations are sole traders who might have administrative staff but may not actually have someone employed as another surveyor to provide that technical review service.

Desktop Study: The red lines denote the mean average scores

However, both types of surveys showed room for improvement, particularly in recording whether the surveys deviated from the scope, and ensuring that no-access areas reported in the survey report itself were also marked on the plans. This finding is significant because plans are often the go-to reference used by duty holders for asbestos management purposes, or by those on site looking to identify where asbestos is and areas that haven’t been checked, which is important particularly if the scope has changed.

Regulatory changes are slowly moving through the system

Following the DWP Select Committee recommendations from several years ago, HSE continues working on three outstanding recommendations that would significantly change asbestos regulation in Great Britain. The proposed changes include making UKAS accreditation mandatory for all asbestos surveying organisations, creating a legal requirement for clients to appoint independent four-stage clearance analysts for highrisk removal work, and providing clearer definitions around the three classes of asbestos work (licensed, notifiable non-licensed, and non-licensed work).

HSE has been following the Government’s formal policy appraisal process as set out in the Treasury Green Book, which requires extensive evidence gathering, stakeholder engagement, and cost-benefit analysis before any regulatory changes can be implemented. The department has completed internal research including the survey quality study mentioned above and social science work examining the broader asbestos industry ecosystem.

The process has now progressed through informal stakeholder engagement, where policy options were shared with professional bodies, trade associations, and trade unions for feedback. HSE also conducted surveys to gather cost and benefit information as part of the better regulation framework, which ensures new regulations are justified by their impacts. The next stage will be formal public consultation, though this requires ministerial approval before proceeding.

This year’s inspection programme looks familiar

HSE is largely repeating its successful inspection approach from the previous year, with approximately 700 planned inspections focusing on duty to manage compliance. The programme begins with around 350 inspections of schools outside local authority control, running from April through September 2025. This will be followed from October by local authority head office visits, where HSE inspectors will examine duty to manage arrangements at the organisational level before selecting four individual premises within each authority for detailed inspection.

The selection criteria for individual premises focuses on buildings where the public has access and where the risk profile of any asbestos present warrants attention. This approach recognises that local authorities often manage diverse property portfolios including libraries, town halls, crematoriums, and heritage sites, each presenting different asbestos management challenges.

Results from the previous year’s inspections revealed interesting compliance patterns. Schools achieved the highest

compliance rate at 65%, likely reflecting years of targeted HSE engagement and updated Government guidance. Most non-compliance in schools was administrative rather than risk-based, typically involving inadequate management plans rather than actual exposure risks. Other HSE-regulated premises showed moderate compliance levels, whilst local authority premises recorded the lowest compliance rates, suggesting this sector may require additional support and guidance.

Asbestos considerations are also being integrated into HSE’s broader health-focused inspection programme, with all factory site inspections now including duty to manage questions where buildings are of an age that could contain asbestos. The rolling programme of licensed contractor inspections continues throughout the year, maintaining oversight of the companies authorised to undertake the highest-risk asbestos removal work.

HSE is taking a tougher line with poor service providers

HSE has introduced new operational guidance for inspectors specifically targeting third-party service providers, including those in the asbestos sector. This represents a significant shift towards holding service providers directly accountable for poor advice or inadequate work that puts others at risk. The guidance focuses on Section 3 of the Health and Safety at Work Act, which places duties on employers whose work affects people outside their employment.

This approach recognises that poor service provision can have far-reaching consequences, particularly where service providers work for multiple clients across wide geographical areas. For example, a refurbishment survey that fails to identify asbestos insulation board due to insufficient intrusive investigation could lead to unknowing exposure of demolition workers who rely on the survey’s conclusions. HSE has already initiated several enforcement actions under this approach, with options ranging from advisory letters through to prohibition notices depending on the severity of the service failure.

The guidance covers various specialist services including workplace air monitoring, noise assessments, and legionella testing, but Annex 2 is dedicated specifically to asbestos surveyors and analysts. This targeted approach aims to improve industry standards by directly addressing service providers whose poor performance could affect multiple worksites and numerous workers.

Licensed work numbers remain steady but quality issues persist

The licensed asbestos removal sector remains relatively stable, with the number of licence holders staying constant at current levels. HSE conducted slightly fewer inspections of licensed work compared to the previous year, whilst licence refusals

dropped from eight to three, suggesting either improved applications or fewer marginal cases being submitted. However, significant quality issues persist within the licensed sector. The HSE licensing unit continues to identify problems with face-fit testing certification, including some instances of forgery discovered in the previous year. Medical certifications and training provision also remain areas of concern during licence renewals and inspections. Additionally, the unit is now examining how personal monitoring is being managed and whether the results are being properly utilised to inform risk assessments and control measures.

A particularly persistent problem is the poor quality of plans of work submitted by licensed contractors. These documents, which should provide site-specific details of how asbestos removal will be conducted safely, are often generic templates rather than tailored assessments. This still represents a significant gap, bearing in mind HSE published specific guidance on plan preparation in 2018, yet compliance with this guidance remains inadequate.

The number of licensed work notifications continues at approximately 22,000 per year, with three-quarters involving asbestos insulation board removal, 20% addressing asbestos insulation such as pipe lagging, and only 2% concerning asbestos coatings. This distribution has remained consistent year-on-year, indicating stable patterns in the types of licensed work being undertaken across Great Britain.

Non-licensed work reveals some concerning patterns

For the first time, HSE has provided detailed analysis of notifiable non-licensed work, revealing this category generates approximately the same volume of work notifications as licensed removal activities. Based on six months of data that can be extrapolated to annual figures, this sector appears to involve around 22,000 notifications per year, representing a substantial portion of asbestos-related activity previously less visible in HSE’s reporting.

The work breakdown shows that two-thirds involves textured decorative coating removal, commonly known as Artex removal, which reflects the widespread presence of this material in domestic and commercial buildings from previous decades. Asbestos cement work accounts for 7% of notifications, typically involving buildings that are being demolished remotely or have suffered fire damage or explosion, where the cement products have been broken up into debris requiring careful handling. Smaller proportions involve short-duration work on asbestos insulation and insulating board that falls below the licensing threshold, whilst 21% falls into an “other” category that includes various activities such as substantially broken floor tile removal. However, HSE has identified concerns that some work currently being notified as non-licensed may actually require full licensing, suggesting either misunderstanding of the regulatory requirements or deliberate misclassification to avoid more stringent controls. This represents an area requiring closer HSE scrutiny in coming years.

What are the changes to the National Minimum Wage & the National Living Wage?

The changes to the National Minimum Wage (NMW) and the National Living Wage (NLW) were implemented on the 1st of April and are as follows:

• N LW - £12.21 per hour (risen from £11.44).

• NMW for 18 to 21-year-olds £10 per hour (risen from £8.60).

• NMW for 16 to 17-year-olds £7.55 per hour (risen from £6.40).

• NMW apprentice rate £7.55 per hour (risen from £6.40).

Increases to Employers’ National Insurance contributions

Alongside the increases to the National Minimum and Living Wage, there has been an increase in Employers’ National Insurance Contributions (NICs) from April 6th with an increase to 15% (Up from 13.5%). This means there will be an additional 1.2% on applicable earnings.

The payment threshold for employers to pay NICs for employees has been lowered on April 6th, from £9,100 to £5,000.

Employers will need to consider their payroll costs, especially in larger organisations, employing more staff.

The employment allowance has been raised £5,000 to £10,500; this means that smaller employers particularly will gain some relief.

Raised lower-earnings limit and increase in Statutory Sick Pay

April yielded an increase in Statutory Sick Pay from £116.75 to £118.75 per week. Similarly, the lower earnings threshold is raised to £125.00 per week. This is in line with other statutory and family-related payments.

The government is currently planning to remove the obligatory 3 day waiting period that an employee must undergo before they can claim SSP. Also, there are plans to increase the amount payable to those under the lower-earnings limit, to 80% of their pay.

Increases in statutory awards and payments

The Employment Rights (Increase of Limits) Order 2025 outlines the increase of the statutory limits and award payments, like statutory redundancy pay, compensatory awards for employment tribunals and statutory guarantee pay.

As of the 6th of April, the following has come into play.

• Statutory redundancy pay cap for calculating a week’s pay increased to £719.

• Compensatory awards for unfair dismissal maximum limit incre ased to £118,223.

• Statutory guarantees pay, increased to £39 per day.

Family leave changes

The Neonatal Care (Leave and Pay) Act 2023 came into play on April 6th meaning that parents whose child requires specialist neonatal care will be entitled to 12 weeks statutory neonatal care leave with a payment maximum of £187.18 per week.

Additionally there has been an increase in the payment for statutory family related leave such as Maternity, Paternity, Shared Parental and Adoption Leave. This also includes statutory Parental Bereavement Pay, which increased from £184.03 to £187.18.

For anyone involved with licensed asbestos removal work, understanding the re-occupation process is essential. This procedure determines when a building or affected area can be re-occupied following asbestos removal work.

The four-stage re-occupation test isn’t only good practice — it’s a legal requirement under the Control of Asbestos Regulations 2012 (CAR 2012).

When planning licensed asbestos removal, both clients and Licensed Asbestos Removal Contractors (LARCs) must allocate sufficient time for this testing. The process can take anywhere from a few hours to several days depending on the area’s complexity. Factoring this into the timeline is important, as overlooking it may delay subsequent works and hold up other contractors.

What is a 4-stage re-occupation test?

This comprehensive series of tests is conducted after licensed asbestos removal and before the work area is handed back to the client. Licensed removal typically happens inside a sealed enclosure, and the four stage re-occupation test ensures all planned work has been properly executed. It confirms the area is clean, dry and dust-free (as far as reasonably practicable) and therefore suitable for re-occupation.

Legal Requirements

The four-stage re-occupation test is required by Regulation 17 of the Control of Asbestos Regulations 2012. It’s not optional—it’s the law.

Who Can Perform the Test?

Only a United Kingdom Accreditation Service (UKAS) accredited testing laboratory (accredited to ISO 17025) can conduct this test. This requirement is explicitly stated in Regulation 20 of CAR 2012. To avoid conflicts of interest, the Health and Safety Executive (HSE) strongly recommends that the analyst for site clearance certification is independently sourced and employed by the building owner or occupier in control of the premises—rather than by the contractor.

The Four-Stage Process

Before testing begins, the analyst must receive a signed handover form from the licensed contractor confirming thorough cleaning and visual inspection of the work area/enclosure. Once this form is signed and dated, the analyst can proceed with the four stages:

Stage 1: Preliminary Check

The analyst will:

w Confirm the scope of work

w Create or obtain diagrams showing areas requiring clearance, including the decontamination unit, enclosure, surrounding areas, waste and transit routes

w Check the integrity of the enclosure

w Inspect the enclosure interior using viewing panels or CCTV

w Estimate and record the time needed for thorough visual inspection

Stage 2: Thorough Visual Inspection

This comprehensive inspection includes:

w Detailed examination inside the enclosure

w Checking the completeness of Asbestos Containing Materials (ACMs) removal from underlying surfaces

w Looking for any visible debris, including in the airlock and baglock compartments

w Checking for settled dust on all surfaces within the enclosure

w Ensuring the enclosure is as dry as reasonably practicable

The time spent on this stage varies with the enclosure’s size and complexity, sometimes requiring multiple analysts.

Stage 3: Clearance Air Monitoring

Air sampling inside the enclosure involves:

w Disturbing surfaces by sweeping with a brush

w Ensuring all air sample results are below 0.010 fibres/cm³ All surfaces must be vigorously brushed for a minimum of 1½ minutes per sampling location. When fibre concentration is confirmed below 0.010 fibres/cm³, the enclosure can be dismantled.

Stage 4: Final Assessment

After the enclosure/work area has been carefully removed the analyst will undertake the final assessment:

w Visually inspect where the enclosure was located *

w Reinspect waste and transit routes for asbestos debris

* If during this inspection any residual asbestos is identified from the removal works the enclosure may have to be re-built and the asbestos residue removed.

Documentation of Approval

When all stages are successfully completed, the analyst will issue a re-occupation certificate to both the Licensed Asbestos Removal Contractor and the end-client. Photographic evidence supporting each stage should accompany this final certification, providing a complete record of the process.

Asbestos Management Institute Reports Growth and New Initiatives at Third Annual General Meeting

Industry body outlines progress and future plans as membership continues to rise

The Asbestos Management Institute (AMI) held its third Annual General Meeting on April 10th, 2025, bringing together professionals from across the asbestos management sector. Conducted remotely via Zoom, the meeting attracted over 160 attendees, reflecting the growing prominence of the organisation within the industry.

AMI President Eddie Strong opened proceedings by highlighting the institute’s achievements over the past year and outlining several new initiatives designed to support members and the wider asbestos management community.

Membership Growth and Industry Representation

In a positive sign for the organisation, it was reported that AMI membership has continued to grow steadily, with the total now standing at 98 members. This represents an increase of 26 new members since the previous AGM, demonstrating the institute’s expanding influence within the sector.

The President also noted that he now represents AMI at the Asbestos Network Technical Working Group, ensuring that members have a voice alongside other industry stakeholders. This development

marks an important step in elevating the institute’s profile and influence in key industry forums.

New Qualifications and Partnerships

The meeting announced two significant membership developments resulting from the institute’s partnership with ATaC.

First, candidates who complete the RSPH analyst or surveyor qualifications are now invited to join the institute as associate members.

Second, the institute has created a new membership category conferring CPQAMI status on candidates who successfully complete the RSPH lab and project manager qualification. This designation aligns with UKAS and Lab 30 requirements for competent person certification, establishing a clear professional development pathway within the industry.

Enhanced Member Benefits

Several new initiatives were unveiled designed to provide additional value to AMI members. These include:

w The introduction of a new corporate logo available to companies with at least two AMI members, allowing them to demonstrate their commitment to the organisation

Lyndsey Baldwin from the Health and Safety Executive’s Asbestos Policy Unit provided an update on current HSE policy in relation to the Department for Work and Pensions Select Committee recommendations. She focused on three main policy areas under review:

1. Notifiable Non-Licensed Work (NNLW) - Addressing confusion among duty holders regarding the categorisation of asbestos work

3. Independence of Four Stage Clearance Analysts - Examining potential conflicts of interest when clearance is commissioned by contractors rather than clients

Martin Saunders, from the HSE’s Exposure Control Group, presented research findings on the effectiveness of witnessed fourstage clearance procedures. The research, conducted between 2016-2019 and published in 2025, highlighted several key points including:

w The importance of accurate Certificates for Reoccupation

w Equipment checks to minimise contamination transfer

w Proper RPE selection for analysts

w Effective brush disturbance techniques

w The value of reassurance air tests

The health focus of the meeting was underlined by Phil Ormesher from Prostate Cancer Support, who delivered a presentation titled “What All Men and Their Loved Ones Should Know About Prostate Cancer.” Essential facts about prostate cancer were provided and testing options were discussed, while promoting the first AMI PSA testing event scheduled for May 22nd, 2025.

Perhaps the most forward-looking presentation came from John Richards of Asbestos Information Certificate, who discussed the National Asbestos Strategy for Great Britain. The work being done to establish a national asbestos database using machine learning and natural language processing technology was presented. The system can process approximately

one million lines of survey data in a single day and categorise asbestos materials according to risk. This innovative approach could link to Ordnance Survey’s Unique Property Reference Numbers (UPRNs) to create a comprehensive national register for asbestos management.

Financial Stability

The financial report presented at the AGM showed the institute to be in a strong position, with a profit of £8,076 for the year ending June 30th, 2024. This positive result was primarily attributed to higher revenues generated by new members, while expenses had been kept low with no legal fees to pay during the year. The balance sheet remained robust with shareholder funds totalling £8,816.

Members voted to accept the financial reports and reappoint Nuvo Accountants of Burton upon Trent as the institute’s financial auditors for 2024/2025.

The election of the Council of Management for 2025-2026 saw all nominees elected unopposed. The Council will consist of:

October 26th 2024 heralded the implementation of the Government’s Worker Protection Act and as part of this, employers are now required to take a proactive approach to preventing sexual harassment in the workplace.

New duty to prevent sexual harassment in the workplace

This act outlines the responsibilities that employers must uphold in taking reasonable steps to prevent instances of sexual harassment occurring, not only in their premises but outside of the workplace.

The Equality and Human Rights Commission (EHRC) also amended its guidelines to reflect the new preventative duties that employers are obligated to uphold.

What does the new duty to prevent sexual harassment

entail?

Under the Equality Act 2010, sexual harassment is prohibited already. This includes all conduct that is unwanted and of a sexual nature, regardless of the intention to cause distress.

If the effect of the conduct includes violating the dignity of the recipient, or creating a humiliating, degrading, hostile, intimidating or offensive environment, then it is considered sexual harassment.

Under the new rules liability can be held

against employers vicariously, even if they are unaware of the conduct, however they can defend against this as long as they can show that they took all reasonable steps to prevent harassment.

The new act brings in mandatory legal duties for employers to proactively prevent sexual harassment at work by taking “reasonable” preventative measures. The Act now also gives the EHRC powers to enforce the duties placed on employers, as well as jurisdiction over investigating breaches (including potential breaches), serving notices and legally binding employers to agreements to address issues regarding discrimination and harassment, to name just some of these new enforcement rights.

What steps should employers be taking?

There are several considerations employers can take to practically show that they have actively taken steps to prevent sexual harassment in the working environment.

Educating staff

Refer employees to the Equality Act 2010 definition and use examples to showcase unwanted conduct. Employers should also

outline to workers how to avoid committing such conduct.

Create an inclusive culture

Developing an inclusive workplace culture is key to tackling sexual harassment in the workplace. As an employer outlining a zero-tolerance approach to sexual harassment, sets the precedence of what will and will not be accepted in the workplace.

In order to create an inclusive culture, employers should first look at the prevailing dynamic in the workplace, for instance, are there any power dynamics that could potentially be problematic, and what preventative measures could be implemented to mitigate this?

Leadership should lead by example in order to help create this culture and should be visible role models for all other staff, in creating a positive working environment for all.

Regular training

All staff should also undergo regular training to be able to effectively recognise instances of sexual harassment. Training should be in line with the guidance, which recommends the training be tailored for the nature of the employer as well as the

intended audience. This also includes addressing third party harassment, where there is a risk of this.

Be sure to keep accurate records on who has received training and ensure that it is refreshed regularly.

Develop workplace policy that is effectively anti-sexual harassment

Employers should review their current policy, contracts and procedures to ensure compliance with the new duty and make amendments where necessary. When devising policy, it should clearly outline who is protected, state that sexual harassment is unlawful and will not be tolerated and also state that harassment may lead to disciplinary action, that could lead up to and include dismissal.

Conduct risk assessments

Identifying the risks of sexual harassment in the workplace can be achieved by conducting regular risk assessments, this could include the use of staff surveys, records of complaints, and exit interviews etc. Employers should consider that they should also consider the risk of harassment

from third parties in these risk assessments. Third parties can include (But is not limited to) customers, clients and visitors. Employers should also consider staff dynamics and potential power imbalances.

Ensure clear methods for reporting sexual harassment

The channels of communication for employees reporting sexual harassment to management, should be made clear. The complaint handling process should ensure that all complaints are handled properly. Anyone internal or external who is a point of contact to deal with claims must be appropriate to support the claimant and have been trained to provide appropriate support.

Consequences of non-compliance with the new employer duty

Failure to comply with the new duty can land employers in hot water, legally, financially and reputationally.

This can be in the form of a claim against your business resulting in a compensation

payout to the affected employee. If the preventative duty has been breached (in the ruling of an employment tribunal) then it can order an uplift in the amount of compensation to be paid by up to a maximum of 25% (the actual uplift amount is dependent on how much the employer has been shown to be in breach of the duty).

The EHRC can also take enforcement action against employers, including investigations and issuing unlawful act notices. They can also enter into legally binding agreements with companies to prevent further unlawful acts.
