CSCS Cards, Site Audit Scheme, Market Research - ARCA Continuing to Support Members and their businesses
F
rom a date yet to be announced, which could be as early as next year and as late as 2020, no blue skilled worker CSCS cards will be issued to an asbestos operative unless they hold an NVQ Level 2 Diploma in removal of Hazardous Waste (Licensed Asbestos) qualification, and this includes renewals of existing blue cards for operatives.

ARCA continues to work on securing the most appropriate solution for our members to gain the NVQ qualifications that will be necessary to obtain a CSCS card in the future. ARCA has identified that in addition to the Specialist Upskilling Program (SUP) and On Site Assessment and Training (OSAT) NVQ assessment processes, there is also an Experienced Worker Practical Assessment (EWPA) route to gaining an NVQ EWPA offers experienced learners a way of achieving a qualification. It is available to very experienced workers who do not require any further training. This assessment method combines the use of witness testimonies, employer endorsement, practical assessment, professional discussion, and questions and answers. It normally involves the learner going to an off-site location to have their practical skills and occupational knowledge assessed. ARCA has already started the process with CSkills to develop a EWPA route for the Level 2 NVQ Diploma in Removal of Hazardous Waste (Construction) - Licensed Asbestos and we hope to have this available for delivery in November. Throughout 2016 ARCA has been piloting unannounced site audits. The main concern prior to the pilot being carried out was that ARCA auditors would have difficulty gaining access to sites if they turned up unannounced. Whilst this has happened on a limited number of occasions, it has not been so frequent as to make unannounced audits unworkable. ARCA is now in the process of amending the site audit scheme to make all ARCA site audits unannounced from 1st January 2017. In addition to the revised audit scheme, the audits will be conducted electronically, on tablets, this will allow the completed audit to be emailed
to the company being audited as soon as the audit is completed, network connections allowing. Once the electronic auditing system is proven to be working efficiently it will be made available to members via an app so that they can use the system for their own internal audits. More detail as to exactly how the unannounced audit scheme will work will be presented at the AGM, and all members will be notified of the new arrangements soon after. ARCA has recently commissioned a market research company to look at member’s clients’ perceptions of ARCA and the extent to which membership ‘makes a difference’ when clients are appointing asbestos removal contractors. The results of this research will be invaluable when ARCA is looking at strategies to better position its members with clients and potential clients. An update on how this project is progressing will be given at the AGM. For the first time ARCA is holding a Charity Week between the 24th and 28th October, please take a look at pages 36 and 37 for details. It would be great if as many members as possible could support the week by holding an event of their own to raise money for the charities. We can send you the Charity Week logo to use in your event promotion. Member Portal
...further developments
In July we were pleased to announce the launch of the newly designed ARCA and ATaC Member Portal. When a member logs into this private area they have an individual dashboard, which highlights a few management tools and displays website traffic statistics per office. Members have the opportunity to upgrade their profile on the search result webpages via a new simple online form and can update the content as required. By upgrading a profile member’s services are displayed on the search result webpages making it easier for visitors to see what this contractor can offer. Also, within an upgrade a member can populate a full webpage on the ARCA/ATaC websites to provide visitors more information about the company and routes to contact them. The job vacancies submission process and how the information is displayed on the ARCA and ATaC websites have been completely revamped. Since launch over 50 job adverts have been placed on the ARCA website! Another new feature is that members can now see, within their private portal, how many times a specific job advert has been viewed … and are seeing great results! “Our next stage of development is well underway as we continue in our aim of providing an excellent management tool for our members,” commented Sarah Haslam, Marketing Manager for ARCA and ATaC. A resources section will soon be available where members can find information and forms for booking ARCA audits and for CHAS registration via ARCA/ATaC, with more information being added over time. Currently under development is a training and qualification information section.
The aim of this is to make information available on a member’s bookings and candidates individual training/qualifications … information at your fingertips! This will mean that on a ‘booking’ page a member will be able to view all the ARCA/ ATaC training courses and qualifications they
have booked (when and where) and the names of the candidates on that specific booking. The ‘candidate’ page will display all the member’s candidates and their training/qualification history. Hopefully this will be an invaluable tool to our members.

audit matters A
uditing remains a key component of monitoring performance, for both the effective planning of licensed asbestos removal works and the implementation of those plans on site. It also helps to demonstrate to clients and the public that predetermined standards are being met, particularly when conducted by an independent, external body. Further developments in ARCA’s Site Audit Accreditation Scheme (SAAS) are being welcomed by Full Contracting ARCA Members, auditors, clients and enforcement officers.
Unannounced Audits to Support High Standards and Expectations One of these developments involves the ‘unannounced’ element of the ARCA site audit - contractors have no knowledge, not even an inclination, of when or where an audit will take place. The pilot scheme, running throughout 2016, includes one unannounced site audit in addition to the two scheduled audits under the SAAS. The pilot scheme gives opportunity for ARCA and its members to get used to auditing without an appointment, and to iron out any unexpected creases.
ARCA is keen to be able to demonstrate that membership standards are reached and maintained regardless of whether a site is scheduled for an audit or not. From 2017, all audits under the SAAS will be conducted on an unannounced basis. While the unannounced element of the audits is a new concept for some contractors to get used to, numerous ARCA members have long applied the principle of not informing site teams of an impending audit, as part of their own management strategy. These companies have generally performed well in the pilot scheme. Their view is to expect a visit on any site, at any time, and be prepared to demonstrate the manner in which the job has been planned, and the plan implemented. Site teams should be able to demonstrate full and proper use of all required control measures, that these measures are maintained, and records are kept of all examinations and tests (Regs. 12 & 13, Control of Asbestos Regulations 2012). Site visits could be from an auditor, an inspector, or a well-informed client.
Out With the Old and in With the New Another development is the discarding of paper-based audits, with a move to an electronic system using a tablet device on site to capture audit information. This is being introduced for all ARCA site audits during October 2016, both under the Site Audit Accreditation Scheme and for the additional audits that many companies undertake through ARCA. “Moving to an electronic system has several significant benefits over the old paper system” states ARCA Membership Compliance Manager, Geoff Silver. “The system will enable the automatic generation of a Corrective Action Report to prompt appropriate and timely remedial actions, should these be required. The site audit report will also be emailed on completion to the site audit contact for the Member Company, thus allowing immediate management involvement in evaluating the outcomes of the audit. Contractors will no longer have to wait for the full report to arrive sometime later, at times arriving after the job has finished!”

arca news Making the App available to ARCA Members Phase 2 of the electronic-based audit system will be to make the audit app available to Member Companies for their own internal audits. This is planned from early 2017, so ARCA Members will be able to conduct their own in-house audits following the ARCA format, enabling direct comparison of their internal audits with those undertaken by ARCA. The app will also be updated regularly by ARCA to reflect any legislative or best practice changes or developments, thus the Member Company will always be auditing against the latest version.
Audit Programme not just Important, but Essential Auditing remains a key method of measuring site performance against predetermined standards, and to initiate any required management interventions. All Licensed Asbestos Removal Contractors should have an audit programme, ideally a combination of both internal and external audits, from which to gather information on site performance, training needs and management effectiveness. If such a programme is not in place, or is considered insufficient, the Asbestos Licensing Unit (ALU) can add Condition 14 to a Licence to undertake work with asbestos. Condition 14 requires that ‘an auditing system, carried out by a competent, independent person, unrelated to the licensee and as agreed with the Asbestos Licensing Principal Inspector (ALPI) at the XXXX office of the Health and Safety Executive, should be instituted. Such auditing should cover XX% of the notifications submitted annually by the licensee under the Control of Asbestos Regulations 2012. The results from the audits should be reviewed, recorded and required actions implemented every 3 months. A report of the review, summarising findings, should be submitted to the above ALPI every 3 months until agreement is reached with the said ALPI that the practice should cease.’ Many members book additional ARCA site audits to be carried out throughout the year as these provide a further quality control mechanism to support the business (please see the article on page 25) .

Assessment and Recognition of Performance Finally, one question often asked of ARCA site audits is how they are assessed. This is achieved using a standardised marking scheme, under the direction of the ARCA Membership Committee. The nature of the marking scheme is that each audit ‘item’ has a points score assigned to it, which is weighted according to seriousness, e.g. no dust suppression in use is far more serious than a viewing panel that is slightly smaller than the standard size. The points are added together, and the total corresponds to bandings that reflect the grade to be awarded (Grades A to F). Therefore, a poor grade may be the result of one or two serious issues identified, or may result from an accumulation of a number of minor issues, that collectively result in a poor grade. It is also possible, for very serious issues, that one single non-conformance could lead to a failed audit, e.g. DCU not functional. The distinction between critical non-conformances, major non-conformances and minor nonconformances is being made clearer, enabling those reviewing site audits to more clearly identify any priorities for action and allocate sufficient resources as required. Considering that the audit assesses more than 140 items, a high grade demonstrates compliance in all or most of the criteria, and any non-conformances are seen as minor rather than major. The ARCA Gold Site Audit Award, presented annually to the best performers, is based on consistent performance in the ‘A’ to ‘C’ range, with an average of a ‘B’ grade or better over 6 site audits.

Surveyors undertake asbestos qualification with ATaC
E
arlier this year, Futures Housing Group looked to the Asbestos Testing and Consultancy Association (ATaC) to deliver asbestos surveying qualification to their team of surveyors. Futures Housing Group (FHG) owns and manages a portfolio of 9,000 properties across the East Midlands, as well as managing nearly 200 privately owned homes for a range of landlords. The Group’s property management team includes a team of 12 surveyors. The surveyors have asbestos awareness training, however, at the end of last year FHG looked at what specific asbestos surveying training or qualifications were available to support the team and the business. Dean Tonks, Health, Safety and Environment Manager at FHG, explained: “We recognise our legal duty to understand where and what material contains asbestos, and manage any associated risk. Therefore, as a business we took the decision to invest in furthering the asbestos knowledge base of our surveying team. After reviewing the available qualifications, the most
suitable was the RSPH qualification which is delivered by ATaC. “The qualification delivered what we needed and more,” said Dean. “Properties have full asbestos surveys carried out by external professionals, and this will continue, however by having asbestos surveying expertise inhouse, re-inspections can be carried out by our own team of surveyors. Also, as the team are now fully aware of what to look for they can recognise any concerns at a property visit. This meets our aim of bringing more expertise in-house, reducing costs and adding a further benefit to our tenants and landlords.” After completing the three days and the assessments all the surveyors were awarded the RSPH qualification. Candidates feedback included: “Very well structured and presented.” “The tutor was excellent and very informative.” “Well explained by the tutor (Shaun).” “Very informative and delivered very well by Matt.”

Today employers are at the forefront of the development of apprenticeships and learning; creating people with workplace skills that are relevant to business and industry. The term ‘Trailblazer Apprenticeship’ is used when a group of employers work together to design new apprenticeship standards for occupations within their sectors. As a trade association ATaC is working as part of the Trailblazer Group to produce an apprenticeship scheme for asbestos analysts and surveyors. Who is this apprenticeship for?
Institute for Apprenticeships
The Asbestos Analysts and Surveyors Apprenticeship scheme has been designed for any organisation thinking of recruiting new staff to conduct asbestos fibre counting and 4-stage re-occupation tests, bulk asbestos identification and surveying for asbestos containing materials.
What is the status of this new Trailblazer Apprenticeship scheme? The Trailblazer Group has created an industry standard, which has now been approved by the Department of Education (DfE). Also funding for the scheme has been allocated at CAP3. This allows the Trailblazer Group a total of £9,000 for training and assessing an apprentice through the two years of the scheme. The Government is planning to change the way Apprenticeships are funded by introducing an Apprenticeship Levy, in April 2017, for employers with a wage bill of >£3 million. Due to these plans, the Trailblazer Group intends to have the apprenticeship scheme up and running in advance of a levy introduction.

The Institute for Apprenticeships (IfA) will be operational from April 2017, to support the delivery of a world-class apprenticeship programme for England, giving employers control and decision-making over content and quality of apprenticeship standards. The IfA will be employer-led; an independent chair will lead the work of a small board made up primarily of employers, business leaders and their representatives, to ensure employers continue to drive apprenticeship quality to the highest level. A shadow Chair will be appointed through a public appointments process by the end of 2016.
What’s next? Following acceptance of the industry standard and allocation of funding, the Trailblazer Group has completed the assessment plan for the scheme. This has now been submitted to the DfE for approval.

Essex school fined after refurbishment disturbs asbestos
A
n Essex school has been fined after poorlyplanned and managed refurbishment and maintenance activities exposed school staff and others to asbestos. Chelmsford Crown Court heard that managers at The Boswells School, Chelmsford, decided to convert an old boiler room at the school into a cleaning store. During the course of this work, asbestos residue on the walls was disturbed and caretakers swept contaminated debris from floors. Their exposure to risk only came to light after a later asbestos survey was completed in the area. The Health and Safety Executive (HSE) investigated this incident and learned that asbestos containing materials (ACM’s) were also present in other areas. School caretaking staff and contractors disturbed the fabric of school buildings over many years without being alerted to the presence of ACM’s. Persons who entered potentially contaminated areas were placed at risk of developing serious ill health conditions arising
from exposure to airborne respirable asbestos fibres. The school also failed to ensure that spread of asbestos was prevented or reduced. The Boswells Academy Trust, of Burnham Road, Chelmsford, Essex, pleaded guilty to breaching the Health and Safety at Work etc. Act 1974 – Sections 2(1) & 3(1). The trust was fined £26,000 and ordered to pay costs of £20,000. HSE Inspector Glyn Davies said after the hearing: “The Boswells Academy Trust should have controlled this potentially lethal risk by identifying the type, location and condition of any asbestos-containing-materials within the fabric of the school, and by implementing suitable
precautions to prevent its disturbance. It should then have ensured that such information was shared with anyone liable to disturb this fabric. It may also have arranged for a licensed asbestos contractor to remove any dangerous asbestos safely before commencement of any work. “This prosecution should act as a reminder, not just to schools but to all persons in control of the repair and maintenance of non-domestic premises, of the need to ensure that a suitable and sufficient assessment of risk from asbestos is carried out, and that correct control measures are put in place to ensure that exposure to asbestos is prevented, so far as is reasonably practicable.”

Motor Manufacturer Fined over Asbestos Contamination
A
motor manufacturer has been fined after discovery of asbestos boarding panels contaminated a site. General Motors UK Ltd was prosecuted by the Health and Safety Executive (HSE) after work being undertaken at its North Road, Ellesmere Port site in 2014 exposed contractors to risks associated with asbestos. An investigation by the HSE found that during work to replace high pressure hot water boilers with gas burners in the company’s paint unit, suspected asbestos insulating boards (AIB) were discovered beneath external cladding on the

stores building. Contractors carrying out the refurbishment had submitted a risk assessment and method statement for the work which was originally due to traverse a roof. When the location of the new pipework was changed to the side of the building no review of the risk assessment for the job, specifically in relation to asbestos was undertaken. Subsequent sampling confirmed the presence of asbestos. On the day the suspected boards were discovered the asbestos register was not fully available to the contractor to allow them to check whether the boards contained asbestos. No direct instruction was given by General Motors to the contractor to stop the work to prevent any AIB being disturbed. The work, including the removal and cutting of holes in AIB board, continued without suitable precautions. Liverpool Crown Court heard no assessment of the risk was undertaken by General Motors to
determine if the work was notifiable or licensed asbestos work. On completion of the work licensed contractors were employed to conduct a clean-up and decontamination programme of the roof and in the stores. General Motors UK Ltd, of Osborne Road, Luton, Bedfordshire, pleaded guilty to a single breach of Section 3 (1) the Health and Safety at Work etc. Act 1974 and was fined £120,000 and ordered to pay £ 11,779 in prosecution costs. Speaking after the hearing, HSE inspector Jane Carroll said: “Asbestos kills around 5,000 workers each year; this is more than the number killed on UK roads. Asbestos can be present within any premises built or refurbished before the year 2000. “Whenever asbestos containing materials are found to be present, companies have a legal duty to document and implement an Asbestos Management Plan which includes measures to adequately control the risk of exposure to asbestos fibres.”

Guidance Notes The status of legal provisions, approved codes of practice (ACOP) and guidance
A
RCA guidance notes are an important way of setting and sharing improved industry standards; they also clarify how existing law applies in the licensed asbestos industry. The expectation (across all business sectors) is for industry to play a significant role in setting standards and providing guidance. Trade associations are clearly crucial to this and ARCA’s Guidance Notes are a source of “Competent Advice” for members. In the past 12 months, ARCA has published guidance on some key subjects that are very likely to form part of licence renewals and site inspections. See the ARCA website for full details. This brief article gives an overview of a selection of recent notes. w Asbestos licensing and employment status w Air management in enclosures w Personal air monitoring w The provision of welfare facilities for asbestos work w Electrical isolations in asbestos work w Guidance for clients appointing asbestos removal contractors Many members continue to report open and approachable relationships with their local HSE operational teams. However, it is also true that many report increasing difficulties in being able to talk through specific issues with local Inspectors. This is not surprising, given that HSE’s Inspector resource is very limited and under increasing pressure; HSE’s main purpose is to ensure dutyholders are complying with Health and Safety law and they are increasingly unlikely to act as (unpaid) consultants!

Compliance with the law is ultimately tested in a court: courts decide whether or not legal requirements have been breached. HSE guidance is intended to help employers (and ultimately, the courts, too) understand what compliance looks like. ACOPs have a special status: they describe preferred or recommended ways of complying and if you are following the ACOP, you can be confident you are doing enough to comply. Employers could decide to take alternative equally effective measures, but if challenged, the onus is on them to prove that what they were doing was equally effective – this is often difficult to demonstrate after things have gone wrong. ACOPs and published guidance will be referred to in order to help establish whether or not there has been a breach. In order of persuasiveness: Most persuasive

There are two complicating factors for licence holders. Firstly, the Licensed Contractors’ Guide was published some time ago and does not always reflect the best industry standards (for example, there have been changes in expectations with regard to soffit removal, which is reflected in ALG memos). Secondly, and most importantly, licence holders are in a special position with regards to guidance and compliance due to HSE’s approach to “permissioning” and the licence assessment process. Licences have been granted on the understanding that the licence holder is capable of complying with the law,
guidance and associated industry standards. If a licence holder does not follow guidance and common industry standards, this may not lead to court proceedings, but it could still lead to licensing action, such as term reductions and / or licence refusals.
An overview of selected ARCA Guidance Notes 2015/2016 Asbestos licensing & employment status This ARCA note clarifies the implications of employment status for licence holders: it is particularly important for licence holders to appreciate that employer duties apply with respect to all staff working under the terms of their licence, regardless of how that employee was engaged and how temporary the contract or relationship might be. Company arrangements for the induction, training, checking of equipment, supervision etc. of temporary staff will need to be as robust as the arrangements for permanent, full-time employees. The note clearly explains what the licence holders’ duties are, prior to and during any employment, and what kind of checks will be appropriate for any employee.
Air management in enclosures Changes in the Approved Code of Practice to the Control of Asbestos Regulations 2012 reflected industry research into air mixing inside enclosures: it made reference to the need for very good airflow (1000m3/hour)

in small enclosures rather than the previous standard of 8 air changes. The ARCA guidance note summarises the reason for the change and explains the practical implications of the research, in a concise and user-friendly way.
Personal air monitoring This ARCA note was produced due to HSE concerns about the way personal monitoring has been carried out in the industry over many years. There has been no change to existing law or guidance: but there is concern about the “custom and practice” that has developed over many years. The note addresses three areas of concern: (a) A lack of understanding about why monitoring data is being gathered (b) Poorly defined methods for collecting data that is representative of actual exposures and typical work activities (c) Poor use of the collected data Many contractors may have been spending significant sums of money on sampling that added little benefit or reassurance. Typically, records do not capture enough information about the actual activity being undertaken and / or sampling durations are too short to provide meaningful exposure data. The issue is very likely to be discussed at licence assessment interviews, and the ARCA note provides guidance on how to ensure that appropriate strategies and methods are in place. Well planned and executed monitoring
will provide reassurance to workers and others, and can provide excellent performance information for the company (and regulator).
The provision of welfare facilities for asbestos work and electrical isolations in asbestos work These two ARCA guidance notes gather together existing HSE guidance on particular legal requirements, clarifying what this is likely to mean in the context of licensed asbestos work. “Welfare facilities” has a broad meaning. It covers washing, changing and rest areas as well as toilet facilities. Although the legal requirements are not new, many contractors may be vulnerable on this subject, particularly with regard to small-scale, short duration works. The note clearly describes the expectations, giving example scenarios of how compliance could be achieved in particular situations. Similarly, the ARCA note on electrical isolations interprets long-standing legal requirements. Electrical hazards are significant for removal companies, but plans and risk assessments frequently do not adequately address the subject. Equipment / conductors need to be considered live unless they have been positively identified as “dead”. Isolation is likely to be appropriate when staff are, for example, using surfactant near light fittings or cable runs. The note includes photographs of
equipment used to establish good isolations. Although the licensed contractor always has the basic duty for the safety of employees, the note explains the need for cooperation and coordination with others to enable this risk to be managed appropriately.
Guidance for clients appointing asbestos removal contractors This note stresses the crucial role that clients play in enabling a project to be delivered safely. Contractors may often find it useful to direct clients towards this guidance: legal provisions place responsibility directly on clients for ensuring appropriate arrangements are in place to manage and organise projects in the “pre-construction” and “construction” phases. The note explains these duties in plain English and is structured to provide a step-bystep reference guide. F

Case Studies
Responding to HSE correspondence A member contacted ARCA to discuss a recent HSE inspection and correspondence received from the HSE inspector. The HSE letter described a number of issues that had been discussed on site and asked for a senior response. The inspector had queried w changes to the plan of work (and the concern that this was indicative of poor planning) w generic risk assessments w small damage to RPE The member had drafted a response and was looking for ARCA input before replying to the HSE. ARCA was able to discuss the site and the nature of the response in detail,
highlighting the underlying nature of HSE concerns and how they might be addressed. Contractors often provide extensive detail to explain how the specific circumstances arose, but fail to report on the full nature of the review process that has actually been triggered by the inspection. In this case, there were sensible reasons for changes to the plan and (unusual) client demands prevented the planned use of cctv. It was acknowledged that the minor damage to the RPE should have been recorded on the inspection record. ARCA’s input resulted in consideration of more general issues: in this case, the interest was in the company’s general approach to authorising changes to plans and the arrangements for initial liaison and coordination with clients. Similarly, we explored the general approach to checking RPE. A ‘poor’ inspection raises questions about management arrangements but it is also an opportunity to show what systems are in place and to demonstrate the ability to learn and reflect. ARCA helped the member provide HSE with more general reassurance and confidence in underlying systems and management competence.

Management system review, prior to licence renewal ARCA often works with members who are preparing for a licence renewal application. We help members obtain performance information from HSE and interpret how this is likely to be viewed by the assessing inspectors and ALU. Typically, we will carry out a “desktop review” of the company’s management system before meeting with senior staff to test and challenge this system in more detail. One member recently requested a review following a period of extensive change in the organisation. Our review was able to clarify areas of strength and weakness, helping concentrate minds on how to prioritise attention. For example, our review of performance information identified a “pattern of performance” liable to raise concerns about planning and performance monitoring. Our knowledge of regulatory processes enabled us to advise on the level of risk this posed and this framed further discussions about the organisation’s own auditing / performance monitoring arrangements. We were able to distil our review into three major action points for senior management:
A. Defining company-wide performance measures and targets B. Clarifying internal audit strategies and ensuring audit formats captured planning quality issues C. Reviewing the use of existing pricing / planning templates etc. to ensure consistency
Licence renewal meetings One ARCA member asked us to work with some members of the senior management team who were relatively new to the licence assessment process. We arranged two workshops. In the first workshop, we discussed asbestos licensing, leadership and management and the way licensing assessments were approached by HSE. We fully explored the subjects HSE would examine and the kind of evidence that could be used to provide HSE with confidence. Prior to a second meeting, we carried out an in-depth review of the organisation’s management arrangements and examined representative samples of on-going and completed projects. Following this, and using the HSE’s ASB4 assessment report form as a template, we conducted a “dummy” interview.
Managers found this session invaluable: ARCA was able to be a “critical friend” by challenging, testing and debating various aspects of the organisation’s approach. Again, our unique expertise with regard to HSE’s assessment approach, enabled us to give balanced feedback: we could suggest best and worst case interpretations of the current state of affairs and we could also suggest where to focus attention in order to continue to make progress. Our pragmatic approach was found to be extremely beneficial; the senior management team was given a chance to experience a rigorous assessment, but in a supportive atmosphere and with time and space to debate the issues. If you would like ARCA to help review any aspect of your management arrangements or prepare for licence assessment, we advise that this work is carried out well in advance of licence renewal (mid term, or 6-12 months prior to the HSE assessment meeting, for example). This would allow plenty of time for modifications to be put in place and their impact monitored. The Insurance Act 2015
What it means for you? T
he Insurance Act took effect on the 12 August 2016. It represents the most significant changes, to the legal framework underpinning insurance contracts in the UK, in over a century. It is particularly relevant to business insureds.
What does this mean? w “Material circumstance”– a circumstance is material if deemed to influence the judgement of a prudent insurer in determining whether to take the risk and, if so, on what terms.
The Act aims to….. w Improve transparency and improve the exchange of information between insurer and insured;
w “Known or ought to be known” – includes actual knowledge of an insured’s senior management (or knowledge which ought to be known following a reasonable search) and the person(s) responsible for arranging an insured’s insurance.
w reduce disputes and rejected claims, therefore saving legal costs and avoiding disruption to insureds and insurers; w increase confidence in the insurance sector. The main changes relate to disclosure and warranties but the Act also introduces a number of other changes.
Disclosure The Act centres on the insured providing a “fair presentation of risk” to its insurer. A fair presentation is one that discloses, in a clear and accessible manner, every material circumstance which is known or ought to be known by an insured’s senior management and by those responsible for arranging the insurance, following a reasonable search. A presentation can also be deemed “fair” where disclosure puts a prudent insurer on notice that it needs to make further enquiries for the purpose of revealing material circumstances.

w “Senior management”– includes individuals who play a significant role in making decisions about how the insured’s activities are managed or organised. This will include the main board but could extend to others, depending on the management structure and reporting lines within the business. w “Reasonable search”– no definition is provided by the Act but it will be circumstance and risk dependent. w “Reasonably clear and accessible”– no definition is provided by the Act but it is clear that material circumstances cannot be hidden. What happens if you do not comply? If the duty of fair presentation is breached, “proportionate remedies” will apply.
How do “proportionate remedies” work? If the insured’s failure to make a fair presentation is deliberate or reckless, the insurer will be entitled to: w cancel the contract from day one and treat it as if it never existed; w refuse to pay any claims arising; w retain any premium paid. The Act defines a breach as “deliberate or reckless” if the insured “knew that it was in breach of the duty of fair presentation, or did not care whether or not it was in breach of that duty”. If the insured’s failure to make a fair presentation is not deliberate or reckless, the insurer can apply one of the following remedies. These are based on the actions the actual underwriter would have taken had a fair presentation been made: w if the insurer would not have entered into the contract on any terms, it can avoid the contract and refuse to pay any claims but must return the premium. w if the insurer would have entered into the contract on different terms (other than relating to premium), the contract will be treated as if it included those terms from the outset.

w if the insurer would have entered into the contract but charged a higher premium, the amount paid on a claim may be reduced proportionately to the underpayment of the premium. The impact on claims handling The Act only refers to fraudulent claims. If a fraudulent claim is made, the insurer: w is not liable to pay the fraudulent claim; w can recover any amounts already paid in respect of the fraudulent claim; w terminate the contract from the date of the fraudulent act and refuse to pay claims relating to losses suffered after the fraud. Where insurers choose this course of action, they do not have to return premiums but will remain liable for all legitimate losses suffered before the fraud. There is no definition of fraud in the Act. However, the Fraud Act 2006 sets out how the offence of fraud can be committed and this, together with the common law principles, will determine what constitutes fraud. Making a Fair Presentation What you can do to prepare? This is not an exhaustive list but it should provide a useful starting point.
1. Consider how you will meet the requirement to conduct a reasonable search. 2. Identify who you consider your senior management to be for the purpose of conducting a reasonable search. 3. Identify any individuals (apart from your insurance broker) who are responsible for your insurance to ensure that appropriate enquiries are made of all relevant individuals prior to presenting information to insurers. Changes to Warranties and Other Terms Breach of warranty Prior to the Act, if an insured failed to comply with a warranty, the insurer was automatically discharged from liability from the date of the breach of warranty. This applied to the entire policy and effectively terminated coverage. Going forwards, an insurer will have no liability in respect of any loss after a warranty in the policy has been breached until that breach has been remedied. Basis of the contract clauses Clauses that turn all the disclosed information into a warranty (known as Basis of Contract clauses) are strictly prohibited under the Act. Terms not relevant to the actual loss Insurers will not be able to rely on non-
compliance with a term if the insured can show that the non-compliance did not increase the risk of the loss. For example, an insurer cannot refuse to pay a flood claim because an alarm warranty is breached. Contracting Out Insurers can contract out of some parts of the Act, although few are expected to do so. Where an Insurer has chosen to contract out, your insurance broker should bring this to your attention. The introduction of the Insurance Act highlights the importance of understanding both, the cover a business purchases and the duties that cover imposes on the insured in order to ensure that the policy responds effectively to a claim. Businesses requiring clarity in either regard should contact their insurance broker for advice.

A successful Golf Day held in June T
his year the ARCA National Golf Day was held at the Patshull Park Hotel, Golf and Country Club, set in 200 acres of Shropshire countryside. The par 72 course, designed by Golfing legend John Jacobs, is set in the hall’s parkland designed by Capability Brown in the 18th century. The course is not particularly long but it’s relatively tight, especially on the heavily tree-lined holes. On the 30th June, 60 ARCA Members and their guests competed in a Stableford competition. The course was in excellent condition and the weather was warm and sunny, in stark contrast to the previous day when it had rained cats and dogs! DKF on the move A
sbestos recruitment specialist, DKF, is set to relocate its operation, making way for further growth. The Manchester based firm, now in its third year of business, will take on commercial premises more than double the size of it’s original headquarters in a nearby business centre where the six strong team will relocate with plans to recruit an additional 4 staff in the coming 12 months. Lucion becomes first in field to be BIM certified
N
ational asbestos and risk management specialist, Lucion Services is the first company in its field to achieve independent certification to the BIM Standard PAS 1192-2: 2013, in line with the Level 2 framework. This means that Lucion is the only firm in the asbestos management industry that can demonstrate compliance with the UK Government’s mandate which came into force in April this year and states that all centrally procured projects must conform to BIM Level 2. The aim of the mandate is to ensure that all information on building projects is shared among the supply chain electronically. In response, Lucion has developed a specialist technology for facility managers, project managers and safety managers who need to clearly communicate, what, where and how to mitigate asbestos and safety risks. It works by linking buildings plans and drawings with data from asbestos surveys and
analysis information. Existing building plans are enhanced with 360º panoramic images and icons to locate hazards and safety equipment, which are then linked to web-based NexGen asbestos records. Charles Pickles, Finance Director at Lucion, said: “I’m hugely proud of the team at Lucion who have all worked so hard to achieve independent certification from a UKAS accredited body. In May Build UK announced the Safety Helmet Colours Standard for construction sites. Using simple colour coding to identify on-site personnel, this standard provides a clear and consistent approach to improve communication and safety across construction projects. ARCA announces the Association’s first Charity Week ARCA members have supported many charities over the years and this year, during our Charity Week, we hope more will get involved in some way, to support two worthwhile causes. Mesothelioma UK - a national resource dedicated to supporting people with asbestos cancer, providing specialist Mesothelioma information, support & improved care and treatment. Also, through donations the charity plans to provide patients across the UK access to mesothelioma clinical nurse specialists. Indee Rose Trust - helps children, and their families, who have been diagnosed with a brain or spinal tumour, by providing support such as, bespoke treasure boxes full of treats and holiday accommodation for the children and their families.
Get Involved! Whether you run, climb, cycle or bake a cake … all participation is fantastic and all donations count. Have fun while raising money …. organise a treasure hunt, cake sale, countryside walk, a football match …. there are many events you can take part in, either as an individual or as a team. You can make a difference to those suffering with an asbestos related cancer and to children with a life limiting tumour.

A
first group of operatives at recruitment specialists, DKF, have passed their ARCA ‘Agency Asbestos Operatives Upskilling’ course with flying colours. The firm is the first recruitment company in the UK to begin the roll out of this training amongst its team with every DKF operative set to take part utilising ARCA’s regional training centres located throughout the UK. Continuous development and training remains a number one priority for DKF in a high risk industry such as asbestos removal. Safe methods of removal and processes are continually scrutinised to ensure best practise and it’s important that the entire industry buy in to this approach to ensure the safety of their team and those working within an asbestos contaminated environment.
Another Level
for DKF Operative Training Developed by ARCA as a full day refresher training session and launched recently, the ‘Agency Asbestos Operatives Upskilling’ course ensures that staff are up to date with current practices and procedures, including changing legislation and best practice. A combination of theory and practical work was welcomed by both the site team and DKF management. Dominic Fagan, Managing Director of DKF commented: “We are keen to ensure our operatives have the most up to date skills and training, and felt that this refresher course was the perfect way to do this. Our guys were keen and willing to take part and this has shone through in the fantastic results we’ve had with not a single fail, so well done to all! “We are keen to embrace any new training and are committed to working under the guidelines established by ARCA, which we
believe to be led with a safety first approach.” A long-term DKF operative, Lee, was one of the first DKF team members to sit the course and offered his feedback: “Whilst I may have been sceptical at first, the course was undoubtedly beneficial. It brought back some useful reminders of the best way to approach certain aspects of our day to day work. It was also good to talk openly with the team and the instructors to share experiences.” Dominic concluded: “One of my senior managers attended the most recent course to not only use it as an opportunity to keep abreast of the course content but to also assess first-hand how our operatives engaged with the trainer and how much they each benefitted from the course. It really was a complete success and all of the DKF operatives and manager who took part thoroughly enjoyed
the course and were very pleased with the opportunity to refresh and increase their knowledge. “The continued development of all of our operatives is incredibly important to DKF. Whilst this programme isn’t compulsory, it’s undoubtedly worthwhile and gives both ourselves and our customer’s peace of mind.”

Refit for Rayleigh & new venue in Scotland O
ver the last few months a number of changes have been made – Rayleigh centre refit, new DUCs and a new training venue. ARCA’s training facility in Rayleigh has had a comprehensive refit, after seven years of continual use. With additions, amends and replacements made over this time the Training Committee gave the go ahead for a overall refit. The refit is now completed and provides additional benefits for asbetos removal candidates and also includes a dedicated area for the RSPH surveryors assessment. As part of the practical area refit the Training Committee also agreed to the purchase of a new decontamination unit for Rayleigh, and also for Burton.
“The refit of the pracitcal area has enabled us to ensure that training facilties match, as far as possible, the environments that our candidates will find on-site,” commented Glen Forder, ARCA Trainer. “The new DCU is also a great addition. The DCU we had worked well and I’m sure has seen over 1,300 operatives learn how to decontaminate.” Satish Patel, Training Manager, said, “The new DCUs at Rayleigh and Burton are timely, and I’d like to thank EASE for supplying the units, including the specific alterations that we needed. Alan and his team were helpful from the beginning, listening to our requirements and giving useful suggestions too. The training team are very pleased with the new units and feedback from operatives has been positive”.
There has also been some changes in Scotland, as ARCA has recently moved from the CITB Glasgow facility, where ARCA had been based for seven years, to the Nisbit Business Centre in Parkhead, Glasgow. Steve Bossley, Quality Assurance Manager, based at the Nisbit Business Centre, said, “Satish and I spoke about the training facilities we had to offer as ARCA at the time was looking for alternative facilities that would provide greater flexibility for practical training. We are delighted to able to support ARCA”. Satish Patel added, “The CITB has been a great place to provide training from, unfortunately space became an issue. The facilities in Parkhead were just what we were looking for, they have the space, the training rooms and the flexibility for more space when required. Steve and the team at Parkhead have been most welcoming and they’ve been a pleasure to work with.” “We look forward to welcoming candidates to this new ARCA training venue.”
