A MAN is appealing against a threemonth immediate jail term after pleading guilty to a 150km/h drag race and police pursuit through peaktime traffic which was described by a magistrate as “some of the most serious driving I’ve heard of”. Adrian Peter Petrusic, 24, had admitted in Dandenong Magistrates’ Court on Monday to ‘racing’ his Holden station wagon with another sedan - swerving through traffic at 150km/h in an 80km/h zone on Princes Highway, Hallam, about 6.30pm on 13 June. Police prosecutor Leading Senior Constable Duncan McKenzie told the court a passenger in the car recalled speeds of up to 200km/h. The court was told that police collisions experts assessed the occupants’ chances of survival were “essentially zero” if they had T-boned another vehicle. Petrusic’s car was found to be so unroadworthy due to mismatched front wheels and bald tyres that its potential braking distance was increased by 100 metres. Ldg Sen Const McKenzie said police followed the racing pair of cars for nearly two kilometres seeing them take off “at speed” with revving engines and screeching tyres from traffic lights at the Tinks Road intersection. Police pulled over the cars near the Hinrichson Drive intersection. After being asked to remain where he was, Petrusic slowly drove down a service lane for 100 metres while police attended the second car. He was ordered to turn off the car but Petrusic - who was unlicensed at the time - “sped off”. During the ensuing police pursuit, Petrusic drove about 60km/h through a car park at the corner of Hallam Road and Princes Highway.

“I don’t think people should go through (such places) at more than five kilometres per hour,” noted Magistrate Jack Vandersteen. The chase continued south on Hallam Road - Petrusic travelling 80km/h in a 60km/h zone, sometimes on the wrong side of the road causing head-on traffic to take evasive action. He turned right at a roundabout via the wrong side of the traffic island and was found by police sitting in the vehicle in a “far corner” of an industrial estate. He told police he was avoiding them because his driver’s licence was suspended. His car was impounded for 30 days. Earlier in the day, he had driven and picked up a passenger who stole tools to the value of $1200 from a Rowville factory. He also faced charges of driving a stolen vehicle in February. Defence lawyer Michael Kuzilny said Petrusic, who had since moved in with his mum in Queensland, had several months to reflect on his “dangerous and appalling behaviour”. “I’ve spoken to his family in Queensland. They say he’s done everything to change his life around.” Mr Vandersteen said he’d ordered Petrusic to complete a road trauma awareness course for similar offending in 2011, “which, for whatever reason, had no impact on you”. “It hasn’t at all slowed you down. This is some of the most serious driving I’ve heard of, save for when it’s led to death and serious injury.” Petrusic was sentenced to eight months’ jail - five months of which was suspended for the next 18 months. He was fined $2500 and disqualified from driving for two years. He has been bailed to a Noble Park address until an appeal hearing next month.
