AGC of Wisconsin AGC Leads With Safety Service and Training AGC Safety Committee is Active AGC’s Safety Committee, led by Mark Hintz of Market & Johnson, Inc., continued its’ work of monitoring safety and health issues which impact members and keeping the members informed of best practices to comply with OSHA regulations. These are some of the issues the Committee followed in 2012: Safety & Education Day 2012 marked the 35th anniversary of Safety & Education Days, five regional safety training events were held that provided safety training to hundreds of tradesmen and tradeswomen. With over 300+ attendees, the Safety & Education Day Award luncheon was a perfect venue for presenting 31 member firms with Wisconsin Safety Excellence Awards. OSHA Whistleblower Protection Program The Committee is enlightening AGC members on OSHA’s increased focus on whistleblower complaints. It is evident not only from the rising number of complaints filed in the last year, but also the increased OSHA agency resources devoted to investigating these complaints. OSHA’s revised job site poster - required of all employers - which now prominently advises employees of their rights to file safety complaints, request OSHA inspections, and make whistleblower claims. Moreover, the damages awarded under OSHA whistleblower complaints are often greater than the penalties assessed in the agency’s citations for violations for other safety and health standards.

Safety Management Training Course and Advance Safety Management Training Course The Committee sponsored AGC of America’s Safety Management Training Course (SMTC) and the Advance Safety Management Training (ASMTC) conducted by the AGC of America, and over 60 participants from across the nation attended the courses. AGC Leads with Safety Services & Training Safety continues to be a critical service for AGC Members. AGC is fortunate to have two safety professionals with over 38 years of combined construction safety experience leading this important effort. The safety professionals assist members with: CPR/First Aid Training-Jobsite Workplace Inspections-Jobsite Specific Training-Health and Safety Committees-Video Library- Safety Certificate Program-OSHA Liaison Luncheons-Safety and Health Consultations -Customized Written Programs and Nemours safety training topics. 2012 was a very rewarding and successful year for AGC Safety with 150 days of training sessions in the past year. AGC provided 5 OSHA 10-hour classes, 11 First Aid & CPR classes, 15 Forklift Certification classes, 3 Competent Person classes for Trenching & Excavating, Scaffolding and Fall Protection, 1 Confined Space Awareness class and 125 jobsite safety audits. AGC’s safety services reached almost 1,500 individuals in 2012 plus affected an untold number of employees of subcontractors to our general contractor members.

OSHA’s Injury and Illness Prevention Program (I2P2)

AGC Leads with Crane Operator, Signalperson and Rigging Certification

The Committee is working with local OSHA offices to educate AGC’s members on I2P2 issues. The Injury and Illness Prevention Program is OSHA’s initiative to create a standard that would compel employers to find and fix hazards. The I2P2 program will include six key components: Management Leadership, Worker Participation, Hazard Identification and Assessment, Hazard Prevention and Control, Education and Training and Program Evaluation and Improvement. In summary, employers will be responsible for ensuring there is top to bottom participation in the prevention of hazards, and a systemic approach to finding and fixing hazards, as well as planned assessment.

Eight years ago, AGC anticipated that crane operator certification would be an important service to provide to members as crane safety was, and continues to be, a primary focus of OSHA. In response, AGC Director of Safety Brent Miller became certified to become a practical examiner by the by the National Commission for the Certification of Crane Operators (NCCCO). In 2009, Mr. Miller became a practical examiner for Crane Signalperson Certification through NCCCO. Associate Director of Safety Jim Falbo started the process of becoming a practical examiner by becoming a NCCCO Certified Crane Practical examiner along with the NCCCO Basic Rigging Certification. We have assisted

Education and Workforce Development continued to play a key role in 2012 by engaging members and expanding our effectiveness in reaching out to the future workforce.

Leadership AGC The ninth class of Leadership AGC, continued the tradition of excellence and success. The twenty applicants accepted into the 2011-2012 program met once a month for nine months to develop the industry and personal knowledge that they need to succeed as leaders. BJ Bowen (J.H. Findorff & Son Inc.), a graduate of the 2010-2011 class of Leadership AGC served on the 2012 Board of Directors as the Leadership AGC appointee. The 2011-2012 Class of Leadership AGC presented an exciting class project at the Summer Membership Meeting. While multiple classes of Leadership AGC have delved into workforce related issues, this year’s group identified a gap in the outreach to pre-high school students. After researching multiple organizations that have strong connections with youth, the class decided to work with the Boy Scouts of America to propose a Construction Merit Badge. The proposed Construction Merit Badge exposes scouts to the sophistication and high level of coordination and leadership required to be successful in the construction industry. Topics are built off of three core concepts areas; planning, construction, and leadership. The proposed merit badge is not moving ahead for the 2013 year but we have been encouraged by Boy Scouts of America to

3rd place: Ace Green and Sustainable (Submitted by Burlington High School)

Construction Career Academies 2012 was a big year for AGC’s Construction Career Academies (CCA). Burlington, Fond du Lac, and Marshfield High Schools continue to develop their programs. New academies in La Crosse and Tomah enrolled their first class in the Fall of 2012 and Kimberly High School joined the group, committed to developing an academy for Fall 2013. Burlington High School Enrollment is steady for the Burlington ACE Academy. The average GPA for ACE students is up and attendance has improved since last year. BHS has developed a new unit in the Building Trades course with brick and block laying masonry and in 2012 the students built pillars on the walkway into the school. ACE Coordinator Casey Miller is developing new and updated curriculum for the Carpentry units. Many of the Seniors who graduated in May of 2012 are pursuing careers in the construction industry. Fond du Lac High School Still in development but growing, Fond du Lac’s academy has 57 students for the 2012-2013 year and the largest class of seniors since inception in 2008. Second year students are busy AGC of Wisconsin


AGC of Wisconsin building mini-homes while the third year students are building a two-story garage in the community. Strong support from FHS administration has allowed for the expansion of academy offerings to include math and English with dual credit at Moraine Park Technical College. Academy coordinator Nate Lehman is hoping to secure similar credit arrangements for the construction classes. Kimberly High School Kimberly High School’s academy is preparing for a Fall 2013 start with planning sessions to discuss goals and class structure. Principal Mike Rietveld will present a proposed academy structure to the school board in early 2013. Academy coordinator Steve Masanz met with other department coordinators to share the ACE Academy idea to develop a relationship with staff who may be interested in being part of the ACE Academy. Initial feedback from the Math, Family & Consumer Ed, Guidance, and Marketing departments is positive.

Marshfield High School Marshfield High School’s Architecture and Construction Academy completed quality work in residential, commercial, and educational settings during 2012. A significant project at the high school was our ongoing efforts creating infrastructure at the Marshfield Outdoor Learning Sanctuary; this year we added walkways to the trail system. The Architecture and Construction Academy continues to seek diverse experiences for our student learners, preparing them to enter the construction industry, ready to work and continue learning. Tomah High School The Tomah Area High School District (TASD) is in its first year of implementing their new Architecture, Construction, and Engineering (ACE) Academy at Tomah High School. During the 2012-2013 school year a group of sophomore students have combined their passion for construction-related courses with their core academic courses. Each year these students will work as a cohort to learn various architecture, construction, and engineering disciplines and experience how those disciplines can make learning core academic courses such as math, English, and science more relevant.

Legal Services: Addressing Industry Issues and Member Needs The AGC of Wisconsin distinguishes itself from other chapters by employing a full-time General Counsel to provide legal services to members as well as manage all aspects of labor relations. AGC of Wisconsin contractor members benefit through representation on industry-wide issues and access to the General Counsel for advice on day-to-day legal questions. Amicus Brief Success Earlier this year, in a case of great importance to the AGC of Wisconsin and its members regarding commercial general liability (CGL) insurance coverage, the AGC retained DeWitt Ross & Stevens to advance its interests by filing an amicus brief in the Wisconsin Supreme Court case of Acuity v. Society Ins., et al. AGC asked the Supreme Court to affirm a published favorable Court of Appeals decision. AGC of Wisconsin


AGC of Wisconsin The case was settled on the steps of the Wisconsin Supreme Court, with the outcome affirming the favorable Court of Appeals decision, and protecting the interests of contractors as advanced by AGC in the amicus brief. At risk was overturning well-established insurance coverage precedent in Wisconsin. A reversal of the Court of Appeals decision would have significantly reduced the scope of insurance coverage contractors bargained for under CGL policies, subjecting them to great risk as years of assumed coverage for which they paid would have vanished. While the availability of insurance coverage will always depend upon the facts and the language in the specific insurance policy at issue, the Court of Appeals decision that remains good law is extremely valuable in the event of future coverage disputes. Member Services In a slow economy, the construction industry predictably saw an increase in the number of legal disputes and industry partners seeking additional protections against monetary loss. Construction contract language, for example, has evolved to provide one-sided protections in favor of the drafting party. Furthermore, prequalification before a construction contract is offered has become the norm instead of the exception. Both of these steps are aimed at mitigating potential losses in the event of a dispute or default. AGC members may contact the chapter for advice on how to interpret new and unknown contract language and/or prequalification requirements. This is particularly true when members travel to other states and encounter language that may be illegal or not utilized in Wisconsin. Situations arise every day that are rife with potential liability for AGC members. Human resources decisions, for example, are highly regulated by laws designed to encourage and facilitate claims of unequal treatment by members of your staff. AGC of Wisconsin regularly assists members with unmeritorious claims of unequal treatment to protect your bottom line from a process often tilted in the employee’s favor. AGC members are encouraged to contact us with questions or concerns about bid awards, construction liens, human resources issues, construction contracts, labor disputes, workers compensation and other situations where legal advice is necessary for members to achieve the best possible outcome. Labor Relations: Continuing the Tradition of Strong Bargaining On May 31st the collective bargaining agreement between the AGC of Wisconsin and the North Central States Regional Council of Carpenters expired; making 2012 an important year for the AGC of Wisconsin’s Labor Relations agenda. Negotiation of collective bargaining agreements is a committee-driven process whereby signatory contractor members are granted an equal voice through participation in the AGC of Wisconsin Union Labor Relations Committee. The Union Labor Relations Committee, headed by Chairperson Barry Scholz of The Boldt Company, meets on a regular basis to discuss industry issues, ongoing grievances and other matters particular to signatory contractors. When collective bargaining agreements are opened for reconsideration, the Union Labor Relations Committee sets the policy and priorities for negotiation. Furthermore, each collective bargaining agreement is negotiated by a subcommittee selected from Union Labor Relations Committee members. In a slow economy, the Union Labor Relations Committee predictably set economic issues as the top priority. In addition to a wage package that reflects the amount of work available to signatory contractors, the Union Labor Relations Committee sought relief on other cost drivers such as defined benefit pension funds that are the retirement vehicle for most union-represented employees. The result was a two year settlement with increases of approximately two percent each year. The defined benefit pension funds present a more complicated problem, and the AGC negotiating committee had productive discussions towards a solution that provides for a secure retirement without the structural risk inherent in a defined benefit pension fund. Looking forward, 2013 will bring additional challenges as the changing economy impacts our available workforce and brings a variety of new projects. Even without collective bargaining agreements to negotiate, we are anticipating the need to discuss and resolve existing jurisdictional disputes and work towards solutions that will limit jobsite disruptions. The Union Labor Relations Committee will continue to work towards fixing the defined benefit pension funds and maintaining strong relationships with the various construction trade unions.

AGC of Wisconsin Legislative Update Why Elections Matter: I know, you are sick and tired of politics, and political ads, and polling phone calls and people asking for money for candidates. Wisconsin has had two of the craziest, most intense political years in our nation’s history. Yes, it sure is getting old. It all started in January of 2011 when newly elected Governor Scott Walker was sworn into office and introduced his landmark and controversial reformsx of public employee compensation and labor rules to help alleviate a $3.6 billion deficit. Labor unions led a tremendous political fight against the changes that resulted in massive protests in and around the Capitol, with 14 Democratic Senators heading off to Illinois to avoid voting on the proposal, and the recall elections of 9 State Senators. That was only the beginning. We also had a very tight State Supreme Court race that ended up in a recount after a clerical error threw the election into doubt. This led right into the petition drives in November and December that resulted in the June 2012 recall elections against

Governor Walker and four GOP State Senators. While two of the State Senators did lose, temporarily giving the majority control of the State Senate to the Democrats, Governor Walker won a surprisingly easy victory in the recall, reaffirming that the majority of Wisconsin voters supported his budget changes. For Wisconsin, November 2012 was a classic good news/bad news election:

The Bad News – Federal Elections: President Obama won by 7% in Wisconsin with 52.8%. Tammy Baldwin also upset Tommy Thompson in the US Senate race helping the Democrats maintain control of the US Senate. Wisconsin now has both the most liberal and one of the most conservative (Ron Johnson) US Senators in the country. In the House races, Republicans Reed Ribble and Sean Duffy held off strong challenges and Paul Ryan won his congressional seat again, even though he lost his simultaneous race for Vice-President, helping the GOP retain control of the US House of Representatives. With control of the Presidency, Senate and House remaining status quo, it guaranteed 2 more years of contentious political battles over spending and taxes.

The Good News - State Elections: What was somewhat overlooked last fall because of the high profile federal election was the fact that the state Republicans regained control of the State Senate by picking up 2 seats for an 18 to 15 majority. In the Assembly, Republicans actually picked up a seat in the face of the federal headwinds to build a very strong 60 to 39 margin.

He described the many achievements that his administration has already accomplished and what he wants to do in the future to get Wisconsin growing again.

put up with all of these political efforts, but to actually step up and do our best to make sure that the proconstruction, pro-growth candidates actually win? Results! The results of what happens when the right people get elected. Lost in all of the politics, protests and fighting over the public employee unions and the recalls was all of the great pro-growth legislation and policy changes that Governor Walker and the State Senate and Assembly were able to accomplish in the last two years. They balanced the budget, reduced the growth in local property taxes, passed a series of comprehensive tort reform laws and made significant changes to the tax laws to incentivize growth and investment. They also passed many construction specific law changes that will help the industry such as prohibiting the use of reverse auctions on public construction projects, prohibited local residency or sick leave rules for workers on public construction projects, repealed Executive Order #108 that mandated the use of apprentices on all State projects and maintained a strong Capitol Budget of State building projects.

Along with a coalition of partners that were coordinated by AGC of Wisconsin, the lawsuit was resolved in our favor and helped to insure stability in construction insurance law in Wisconsin. Wisconsin Civil Justice Coalition: The SIR Council, Inc. also provided financial support for the Wisconsin Civil Justice Coalition (WCJC). The WCJC monitors the courts and legislature for legal actions that would be detrimental

So yes, politics is getting nastier every year, and the partisan divide seems to be getting wider instead of smaller, and we are all sick of the many political ads on TV and the millions of dollars being spent, but you know what, at the end of the day it is all worth it!

AGC of Wisconsin PAC and Conduit: So how do we keep electing pro-construction legislators? The best way is to financially support the candidates through the AGCWI PAC and the AGC Conduit. AGC of Wisconsin had a very strong political fundraising effort in 2012 and gave over $57,000 to political candidates. AGC members were especially supportive of Scott Walker’s recall campaign AGC of Wisconsin

2011-12 Legislative Wrap Up Through all of the political turmoil Wisconsin experienced in 2011 and 2012 it has been difficult to see what progress has been made on issues that directly affect AGC of Wisconsin members and the construction industry as a whole. We are happy to report that AGC of Wisconsin had an extremely successful legislative session! Here are the major highlights:

Bills that Passed into Law: State Budget Bill (2011 Wisconsin Act 32): The State Budget Bill was one of the first major pieces of legislation in the 2011-12 legislative session. In addition to collective bargaining changes and other controversial budget and spending items, a number of policy items that affected construction were also included in the Budget:

Capital Budget – AGC of Wisconsin supports maintaining a steady Capital Budget that is in-line with historic spending levels. In light of the $3.6 billion budget deficit, spending in the Capital Budget was cut

requirements for workers and contractors on public jobs.

2011-12 Legal Reforms: Tort Reform (Wisconsin Act 2): A landmark legal reform package that included overdue policies that have been introduced and supported by the business community for many years. The important policies passed AGC of Wisconsin

Repeal Compensatory and Punitive Damages for WFEA Violations (SB 202): Repeals 2009 Wisconsin

Product Liability – This provision will assist small

Women will still be entitled to file a claim under the WFEA where they can seek reinstatement, back pay up to two years, and be awarded considerable attorney fees and court costs.

Expert Opinion (Daubert) – Wisconsin joins more than 30 other states, and the entire federal court system, by adopting the Daubert standards. This common sense provision affects both parties in a case by limiting testimony of experts and evidence to that which is based on sufficient facts or data and is the product of reliable principles and methods.

Risk Contribution – This provision overturns the Wisconsin Supreme Court’s 2005 decision, Thomas v. Mallet, where the Court adopted the deeply flawed “risk contribution” theory in cases involving lead-based paint. Wisconsin was the only state in the country to have adopted this theory. The Court’s decision led The Wall Street Journal to pen an editorial describing Wisconsin’s litigation climate as “Alabama North.”

Caps on Punitive Damages – Set a cap on punitive damages at $200,000 or two times compensatory damages, whichever is greater.

Frivolous Lawsuits – Reduce frivolous lawsuits by holding a party liable for costs and fees for bringing a lawsuit or claim that is done solely for the purpose of harassing or maliciously injuring another party.

Trespasser Liability Act (SB 22): Prevents courts from adopting the new Restatement Third of Torts which expands liability for injuries to trespassers. The bill codifies Wisconsin’s existing law, which adequately protects landowners and renters from unwanted trespassers.

Reasonable Attorney Fees (SB 12): Codifies 14 criteria which courts must consider when awarding attorney fees for the plaintiff. Also includes a rebuttable presumption that reasonable attorney fees are three times compensatory damages.

Agency Rules: DSF Meetings on State Construction Problems: A number of AGC members who work on State construction projects continue to run into the same problems from project to project. They asked if AGC could form a group to discuss what problems are common between them and see if we could develop constructive suggestions for addressing them. We pulled together a group of member general contractors and specialty contractors who met to identify those problems. The Division of State Facilities has agreed to meet with us this winter, along with several architects and engineers who also do a lot of State construction work to try to resolve these common problems.
