District 202 expects $194.4M levy

fsarver@shawmedia.com PLAINFIELD – The tentative property tax levy for Plainfield Community Consolidated School District 202 is estimated to be $194.4 million this year, about 5 percent less than last year’s levy.

At Monday’s meeting, the board heard a presentation on the levy for Will and Kendall counties. District officials expect the levy will be higher than what they will eventually receive with the tax extension, or the actual amount of money received by the district.

The projected tax extension for the levy is $183.6 million. The 2015 tax extension was nearly the same amount.

“We balloon the levy,” said Rick Engstrom, assistant superintendent for business and operations. “We balloon the levy because we only have preliminary num-

bers, and the county does not have all the exceptions and appeals determined by the time tax levies are filed.”

Engstrom noted how in 2014 and last year the amount levied was more than the amount received through the tax extension. In 2014, the district levied $205.8 million but received $177.7 million. In 2015, about $204.8 million was levied but $183 million was received.

District officials said in a news release that it is normal for governments to request more money than is needed to ensure they receive the full share of taxes. If they ask for less than what they ultimately are due, they lose any funds greater than what is requested.

The assumptions for this year’s levy is that overall assessed property values are projected to increase by either 9 percent or 10 percent, with estimated property values at $3.2 billion and new construc-

tion estimated at $48.2 million.

The total tax rate is projected to fall from $6.24 per $100 of equalized assessed value this year to about $5.70 per $100 of equalized assessed value because of “rising property values, refinancing several bonds and conservative budgeting,” according to the district’s news release.

The actual tax rate will not be determined until after the district’s EAV is finalized early next year, according to the district.

District officials said in a news release that about $163.6 million from the levy will go toward the district’s operating funds: education, operations and maintenance, transportation, working cash, IMRF and tort.

A public hearing on the levy will be at 6:30 p.m. Dec. 19 at the district’s administrative center. That also will be the day the board will consider adopting it.

mmallory@shawmedia.com PLAINFIELD – The Plainfield Police Department will be able to communicate better and keep the public safer after village trustees unanimously approved an intergovernmental agreement with WESCOM on Monday.

The department’s existing analog radios are outdated and increasingly expensive to replace, Cmdr. Ken Ruggles told the board.

Under the current contract with STARCOM21, owned and operated by Motorola, the village would spend an estimated $752,472 on replacement radios and monthly user fees over the next 14 years.

But by joining a contract agreement WESCOM reached with Motorola, the village will save an estimated $437,268 over the current STARCOM21 contract.

Beginning Jan. 1, the village will replace outdated radios and have improved radio infrastructure in the area.

Additionally, in an effort to bring live government to the people, the board on Monday approved the purchase of a streaming appliance and services at an upfront cost of $3,695.80, with a $500 monthly subscription that will allow the village to live-stream and archive its meetings on its website.

Trustee Jim Racich said this is something residents have asked for. Currently, the village uploads meeting videos to YouTube the day after the meeting.

Trustee Garrett Peck supported the expense but asked whether viewership data could be reviewed after some time to evaluate whether the expense remains a worthwhile one.

The Plainfield Village Board also unanimously approved several other measures, including: • The purchase of 38 $250 Target gift cards for the Plainfield Police Department’s annual “Shop with a Cop” program. This money is raised by the department at events such as a charity basketball game, Chief John Konopek said. Plainfield cops will shop with those less fortunate on Dec. 23.

• The preliminary estimate of the 2016 tax levy in the amount of $6,139,600.

RETAIL SPACE IN HIGH DEMAND New development in the works for Route 30 in Joliet

bokon@shawmedia.com JOLIET – Potbelly Sandwich Shop opens Wednesday, the latest addition to the Route 30 retail strip stretching in front of the Louis Joliet Mall.

More construction is underway and more is planned in the near future as retailers and restaurants continue to seek space on the highway where it runs past the mall.

The city of Joliet earlier this year contracted a retail study to determine consumer needs in the area. But the biggest problem may be finding space to develop.

“There’s a huge interest among retailers to locate near the mall on Route 30, and there just isn’t any property left,” said Steve Caton, a principal with Caton Commercial.

While there isn’t exactly a lack of property, pickings have gotten slimmer.

The Potbelly is in a strip mall that was built on property where houses were cleared away to make room for commercial development.

Other homeowners have started to put property up for sale as a once-residential section of Route 30 increasingly becomes an extension of the Louis Joliet Mall retail district.

“The road isn’t what it used to be,” said Caton, who has one home up for sale for potential commercial development.

O’Reilly Auto Parts is building a store at Route 30 and Kellogg Street on the Crest Hill side of Route 30.

That intersection is the center of the retail study commissioned by Joliet, which found a population of 77,100 with an average income of $74,300 within 3 miles. Extended to

10 miles, the population is 447,900, and the average income is $91,500.

Some area school districts show improvement

fsarver@shawmedia.com Several major Will County schools showed high, stable percentages across several academic measures under the 2016 Illinois Report Card.

The report card from the Illinois State Board of Education measures academic progress under several categories, including freshmen on track, graduation rate, the American College Testing exam and the Partnership for Assessment of Readiness for College and Careers exam, which will be replaced by the SAT this year at the high school level.

Plainfield District 202

Freshmen on track at Plainfield Community Consolidated School District 202 showed a 2 percent increase from last year with about 96 percent of freshmen on track to graduate.

The four-year graduation rate also increased slightly at 94 percent.

Composite PARCC scores were above state averages, with 36 percent of students meeting expectations for the test and 5 percent exceeding them.

For the ACT, 53 percent of students achieved a combined score of at least 21, which is higher than the state average.

Tom Hernandez, the district’s spokesman, said that over the years district officials have improved the curriculum to make it more rigorous but still accessible for students.

Police: Joliet man had cocaine, gun during car incident

bstanley@shawmedia.com JOLIET – Police said a man had drugs and a gun in his pockets when he attracted an officer’s attention by hanging out the window of a moving car early Saturday in Joliet.

Erik Hernandez, 34, of the 900 block of Plaza Drive in Joliet, was arrested on charges of armed violence, being an armed habitual criminal, delivery of drugs and resisting arrest, and booked into the Will County Jail.

At 4:38 a.m., an officer was driving on Jackson Street when he “observed a westbound black Chrysler 200 with a male subject hanging out the passenger window up to his waist,” Joliet Deputy Police Chief Ed Gregory said. “The Chrysler then ignored the flashing red light at the next intersec-

tion and crossed over the bridge before the officer activated his emergency lights.”

The Chrysler went up the hill and turned onto the 500 block of North Broadway Street before it stopped.

“Hernandez immediately opened the passenger door and took off running – clutching his waistband as if he was armed,” Gregory said.

Erik G r e g o r y s a i d t h e Hernandez Chrysler drove away from the scene while the officer pursued Hernandez across a vacant lot.

“The officer pulled his own weapon and observed [Hernandez] throw a small silver handgun into the next yard,” Gregory said. “He then ran southbound down the alley and hopped

one fence. Our officer kept pace with him and deployed his Taser as he attempted to scale another fence.”

After Hernandez was handcuffed, police allegedly found “a large amount of cocaine in his left pocket and approximately $2,000 in his right,” Gregory said.

A loaded handgun also was recovered from a nearby porch.

When other officers stopped the Chrysler at Lime and Center streets, a 22-year-old woman who was driving complied with their commands, but Brandon L. Shelby initially “refused to follow directions” in getting out of the car or allowing police to see his hands, Gregory said.

Shelby, 33, of Lithia Springs, Georgia, eventually complied and was arrested on a charge of obstructing a police officer. The driver was released

without being charged.

Hernandez was sentenced in 2005 to five years in prison for unlawful use of a weapon and eight years for another conviction on the same charge in 2007. He also has been convicted of robbery.

In February 2015, Hernandez was found not guilty of murder and attempted murder in the March 19, 2012, slaying of Juan A. Gonzalez and wounding of Ricardo Martinez.

Police said Gonzalez and Martinez were in Gonzalez’s garage in the unincorporated Crest Hill area when two men came in and shot both of them in what investigators called “a drug deal gone bad.”

Martinez identified Hernandez as one of the intruders, but other witnesses in the house and nearby yards did not, according to trial testimony.

LOCAL BRIEF Carbon monoxide suspected in 2 Plainfield women’s deaths

PLAINFIELD – Two women died and five police officers were hospitalized after being exposed to carbon monoxide Monday.

Police were called for a welfare check in the 12700 block of Shelly Lane in Plainfield and found two victims inside the residence.

“We could see they were down and were also informed there were possibly children inside, so we went in to conduct a search,” Plainfield Police Sgt. Mike Fisher said.

Denise Carlini, 65, and her daughter, Morgan D. Becker, 29, were pronounced dead at 11:09 a.m. at the scene, according to the Will County Coroner’s Office.

No one else was found inside, but three dogs also died, Fisher said.

“Firefighters arrived and took readings that were high enough to require us to go to the hospital,” Fisher said.

The officers were taken to Rush-Copley Medical Center in Aurora for observation, but all were released by Monday evening.

Fisher said the investigation is ongoing, but authorities suspect the carbon monoxide originated from the home’s furnace.

No space heaters were found inside the residence.

Will County forest preserve board approves plan for bikeway system Officials also give OK to $48.2M 2017 budget

mmallory@shawmedia.com JOLIET – The Forest Preserve District of Will County now has an official bikeway plan that the county, municipalities, park districts and neighborhoods can reference when planning for the future.

The district’s Board of Commissioners approved the plan at a Nov. 10 meeting.

There was a public comment period open through September.

The bikeway plan identifies areas where nonmotorized transportation opportunities can be expanded in Will County and beyond.

Greenways, roadways and utility corridors all were reviewed as possible sites for bicycle access improvements.

hensive planning guide was needed to improve clarity between multiple user groups and levels of government.

The goals of the plan are to expand transportation choices, enhance connectivity, promote bicycling benefits and improve safety and comfort.

The district’s chief operating officer, Ralph Schultz, said Friday that the plan – the first of its kind for the county – will help various entities as they seek federal, state or local funding for projects that increase multimodal transportation.

“The plan is about connecting people to places,” Schultz said. “From their homes to the next neighborhood, to local grocers and libraries, all while getting out into nature.”

Schultz said many of the bike corridors noted in the plan will be near existing transportation corridors such as highways, roadways and even ComEd transmission lines.

The next step for the district regarding the plan is to encourage entities such as municipalities and park districts to reference it when doing future projects.

Also at the Nov. 10 meeting, the Board of Commissioners approved its 2017 budget.

The $48.2 million budget includes $17.2 million for operations and just more than $24 million in debt service.

The budget is balanced and will use $1.25 million in unassigned funds for a capital improvement program and the emerald ash borer removal program.

It is anticipated 2017 will be the final year of removals.

Among the capital projects slated to start in 2017 are bike path bridges over the DuPage River and Interstate 55 on the south side of Black Road in Joliet.

The bridges will safely connect the trails of Hammel Woods on the west side of I-55 to the Rock Run Preserve on the east side of I-55.

“It fulfills a long-term vision to connect the DuPage River Trail to the Rock Run Greenway Trail,” Schultz said, adding that the project will connect people from Shorewood and Joliet all the way to Minooka via the trail system.

JOLIET – A man was left in critical condition after being shot Saturday night outside a Joliet bar.

The incident occurred at 10:52 p.m. at Los Tres Hermanos, 670 E. Jackson St., Joliet Deputy Chief Al Roechner said.

“We were called to a report of a large group in the parking lot and shots fired. While officers were en route, it was learned one man Juan had been shot,” Roech- Mandujano ner said.

The 31-year-old Joliet man was taken to Silver Cross Hospital in New Le-

nox with multiple gunshot wounds to his abdomen.

He was listed in critical condition in the intensive care unit Monday afternoon.

“When officers arrived, there were several witnesses holding the shooter down on the ground,” Roechner said.

Juan Mandujano, 21, of the 200 block of Henderson Avenue in Joliet, was identified as the suspect and arrested on charges of aggravated battery, unlawful use of a weapon, unauthorized possession of a firearm and possession of a stolen firearm.

Mandujano was arrested in July in connection with drug possession, according to jail records.

Roechner said police recovered a gun at the scene.

Al’s set to host annual Thanksgiving dinner

roesterle@shawmedia.com MORRIS – For the 14th year in a row, Al’s Family Restaurant in Morris will host a free Thanksgiving dinner for those who are alone during the holiday season.

It was started by local optometrist Dr. Phillip Ortizas as a project by I Care International and has continued to grow.

This year, there will be two seatings at Al’s, which is owned by Al Lopez and located at 306 Liberty St. in Morris. The first will be at noon, and the second will be at 1:30 p.m. Ortiz said the restaurant fills up quickly, so those who want to partake in the meal are encouraged to call 815-942-0921 for reservations.

“It’s become a pretty popular thing over the years,” Ortiz said. “Both seatings are usually full, so if people want to get a meal, they should call for a reservation. Al’s family pretty much takes care of everything else as far as serving, and the fire department delivers about 30 to

40 meals to Elliot Manor as well.

“Overall, I would say we probably serve close to 200 meals that day.”

The dinner is a full Thanksgiving meal with all the trimmings, including stuffing, mashed potatoes and other side dishes.

“A lot of people like to bring in desserts and stuff like that, too,” Ortiz said.

“There is never a shortage of food.”

Ortiz is dedicating this year’s dinner to his late wife, Gay, who was involved in the founding of the dinner but died 10 years ago. He also mentioned that the late Charles “Chuck” Greenway, who died last Friday, also was involved in putting on the dinner, along with Gary Rockis and Jim Baum.

“We started it out for people that were by themselves on Thanksgiving,” Ortiz said. “We didn’t think anyone should be alone on the holiday. It has grown each year, and a lot of local businessmen have gotten involved.

“It has turned into quite a local tradition.”

IHSA itself, including a case in which days after a football game had concluded, the IHSA issued a foul against several players.

The complaint also claimed the IHSA is a state actor bound by the Illinois Constitution, under which Fenwick’s interest in participating in the state championship game is protected as both a property interest and a liberty interest.

However, an appellate court ruling in June determined the IHSA, a nonprofit entity, has an existence separate

from any government agency, according to an IHSA statement on that ruling.

Plainfield North Athletic Director Ron Lear was not immediately available to comment on Fenwick’s legal action. IHSA officials declined to comment.

Fenwick High School has taken legal action against the Illinois High School Association after an officiating error in Saturday’s Class 7A football semifinal game against Plainfield North led to the Tigers being awarded an untimed down that forced the contest into overtime and ended with North taking the win.

The Oak Park-based Fenwick filed a complaint and restraining order Monday in Cook County court against the IHSA, demanding the school be awarded the victory. A court appearance is scheduled for 9:30 a.m. Wednesday, a mere three days before the state championship game.

During the semifinal game, Fenwick’s Jacob Keller threw a fourthdown pass as the final seconds of the fourth quarter expired. Officials ruled it was grounding, a final play was awarded to North, Connor Peplow made a field goal to tie things up and the Tigers defeated the Friars in overtime, 18-17.

IHSA Executive Director Craig Anderson admitted in a statement released Saturday that an error was

made, but cited an IHSA bylaw that “the decision of game officials shall be final” and that protests against those decisions will not be considered by the IHSA board.

Fenwick appealed to the board, but the board determined Monday morning it would not hear the appeal, according to a statement from Fenwick. “... in an effort to protect the rights and rightfully earned opportunities of its students, Fenwick High School has filed a lawsuit … seeking declaratory, injunctive and other relief against IHSA,” the statement reads.

Fenwick’s complaint refers to the situation as an “obvious and fully admitted breach of contract” and a “travesty.”

It argues the IHSA’s constitution, mission statement and bylaws are a legally binding contract between the IHSA and its members.

“To allow this unjust result to stand would fly in the face of everything the IHSA stands for in its administration of high school athletics – fairness, reliability, accountability and integrity,” the complaint states.

“We’ve had good success in Joliet,” said Stacey Domzalski, general manager for the new Potbelly. “We wanted another spot on this side of town by the mall.”

Potbelly opens Wednesday, but it will test the waters Tuesday with one of its pre-opening Oven Warming events.

The restaurant will be open from 11:30 a.m. to 1:30 p.m. for lunch and from 5 to 7 p.m. for dinner. Proceeds will be donated to the Plainfield Central High School Parent Teacher Student Organization.

“Auto parts did pop up as one of the areas where there’s greater demand than there is supply,” said Steve Jones, economic development director for Joliet.

The biggest potential areas for new growth, according to the study, are grocery stores and specialty foods. Other retail categories with potential are general merchandise, gas stations, florists and lawn and garden.

There also is room for more drinking places, according to the study.

There is more supply than demand for full- and limited-service dining within 3 miles, although demand gets greater using a 10-mile radius.

That may have contributed to Pizza Hut, one of the first restaurants outside the mall, closing earlier this year.

Jones said developers plan to demolish the building and replace it with a small retail center.

Born: August 18, 1942 Died: November 16, 2016

Joe Nathan Baines Sr. was born on August 18, 1942 in Bolton, Mississippi, was a lifelong outdoorsman, and on November 16, 2016 he was called to heaven to receive the prized catch of a lifetime, eternal rest with his personal Savior, Jesus Christ.

Joe received Christ at an early age at Brownsville Missionary Baptist Church in Bolton, Mississippi. He attended the Brownsville Grade School in Bolton and Summer Hill High in Clinton, Mississippi.

Joe moved to Joliet, Illinois in 1963, where he soon found employment at Caterpillar Tractor Company. He later joined Margaret Jean King in holy matrimony, becoming the proud father of three children. He joined Mt. Zion Missionary Baptist Church. After thirty years of service, he retired from Caterpillar Tractor. He later enjoyed several years of employment at Mount Zion Baptist Church and Sunny Hill Nursing Home in Joliet, Illinois.

Joe is now reunited in heaven with his daughter, Charlene Baines; father, Willie Baines; and mother, Lillie (Mason) Baines Gilmore; brothers, John D., Eddie, and Willie Baines Jr.; and his sisters, Mosella Norfleet, Willie B. Graves, and Earnestine Hill.

Joe leaves to cherish his loving memories to his devoted wife, Margaret Baines of 50 years; daughter, Dwanna Baines Tucker and son Joe Jr.; grandchildren, Amber (Lorenzo) York and Autumn Norwood; three great-grandchildren, Mekhi, Jaiden and Carmon York, all of Joliet, Illinois. He will be

LONDON – Irish novelist and playwright William Trevor, a master of short stories that often explored life’s disappointments, has died at the age of 88 in his adopted English home, his publisher announced Monday.

Trevor set his tales mainly in his native Ireland or in England, where he had lived since graduating from Trinity College Dublin in 1952.

He won one of Britain’s top literary prizes, the Whitbread, three times; was short-listed four times for the Booker Prize, most recently in 2002 for “The Story of Lucy Gault;” and was a perennial object of speculation as a potential

CHICAGO – A strike by hourly workers at O’Hare International Airport in Chicago will add another dimension to a nationwide day of protests by fast-food employees who have been pushing for a $15 hourly wage and union rights, organizers said Monday.

Thousands of workers plan to walk off the job at McDonald’s restaurants and other fast-food spots in more than 340 cities on Nov. 29, organizers said in a news release. The planned “Day of Disruption” will mark the fourth anniversary of the first protests at McDonald’s restaurants in New York.

The attention-grabbing airport strike is “going to cause complete disruption in travel plans for the day and maybe days to come,” said Kendall Fells, national organizing director of the Fight for $15 campaign. “Four decades ago, airport jobs were jobs you could live off of. Now airport jobs are just like fast-food jobs.

We’re all standing together.”

The Service Employees International Union announced Monday that hundreds of workers will strike that day at O’Hare, one of the nation’s busiest airports. The union has helped fund and staff the Fight for $15 campaign.

Funeral planned for Chicago congressman’s grandson

CHICAGO – A funeral is planned Saturday for a Chicago congressman’s grandson who was shot dead after an argument about basketball shoes.

A spokeswoman for U.S. Rep. Danny Davis said 15-year-old Javon Wilson’s funeral will be Saturday at Carey Tercentenary AME Church on Chicago’s South Side. A wake will be at 10 a.m. followed by services at 11 a.m.

A Cook County judge on Sunday denied bail for a 16-year-old boy and 17-year-old girl charged with first-degree murder in the teen’s death. Authorities said Wilson was shot in the head. Police said the two were arrested after they were identified as suspects in Friday’s shooting.

6 Chicago firefighters ill after returning from scene of fire

CHICAGO – Authorities said six Chicago firefighters were taken to hospitals after they reported feeling ill after working to extinguish an earlier fire.

The Chicago Fire Department said firefighters had returned to the Engine 26 firehouse early Monday and several reported feeling sick. Five were taken to several different hospitals, where they were treated for chest pain and breathing problems.

WLS-TV reported that one firefighter at another firehouse also was taken to a hospital. The fire department said all are expected to be OK. The department was working to determine what caused the illnesses, but an irritant released into the air at the fire in the West Town neighborhood may be to blame. That fire was related to a furnace at a home, and everyone at the home got out safely.

He said he’s also concerned about being asked to check planes for weapons and explosives without training.

There had been concern that the strike would fall during the busiest travel days. In announcing the Nov. 29 strike, the union and workers on Monday portrayed the date as a concession to families.

“O’Hare airport workers often can’t afford a proper Thanksgiving dinner and know what it’s like to miss Thanksgiving with our families,” said baggage handler Raquel Brito, who announced the strike date. “However we respect families traveling to be together and that is why we’re holding off our strike until after the Thanksgiving holiday.”

Study finds hormones, medications in groundwater

CHAMPAIGN – Scientists at the University of Illinois said they’ve detected prescription and over-the-counter medications in groundwater in southwestern Illinois.

The university’s Prairie Research Institute study had researchers collect 58 water samples from eight springs and five cave streams during 2014 and 2015. Researcher Walt Kelly said medications and personal care products were detected in 89 percent of those samples.

Scientists said the two most common products found were triclocarbans, which are used in antibiotic soaps, and the cardiovascular drug gemfibrozil. Researchers said contaminant levels were “well below” human dosages, but they said even low levels can affect aquatic organisms.

The researchers also found hormones in 23 percent of their groundwater samples, which Kelly said “can cause a lot of damage to fish and possibly other animals.”

Trump auditions Cabinet prospects in Manhattan

NEW YORK – Donald Trump held court from his perch high above Manhattan on Monday, receiving a line of former rivals, longtime allies and TV executives while overseeing a presidential transition that at times resembles a reality show like the one he once hosted.

Trump met with nearly a dozen prospective hires, all of whom were paraded in front of the cameras set up in the Trump Tower lobby as they entered an elevator to see the president-elect. Out of public view himself, he fell back on his TV star roots by filming a video that touted his legislative goals once he takes office.

Trump did not immediately announce any appointments after the meetings, which came on the heels of a two-day whirlwind of interviews at his golf course in Bedminster, New Jersey.

Unlike his predecessors, who often spoke with Cabinet candidates under a cloud of secrecy, Trump has turned the search into a very public audition process. The extraordinary exercise took on a routine feel on Monday: First, former Massachusetts Senator Scott Brown stepped off the gold-plated elevator into the marble-coated lobby after his meeting to declare to waiting reporters that he was “the best person” to become Veterans Affairs secretary.

No one was saying whether Trump would announce more appointments before heading to Florida for Thanksgiving. Pence, who touts openness, tries to stop document release

INDIANAPOLIS – Lawyers for Indiana Governor and Republican Vice President-elect Mike Pence argued in court Monday that the state’s judicial branch has no authority to require him to comply with Indiana’s public records law.

The civil case before Indiana’s Court of Appeals was brought by Indianapolis attorney William Groth, who sued in 2015 after the Pence administration denied a request for un-redacted records, including a document related to Republican efforts to stop President Barack Obama’s immigration executive order.

Pence has long presented himself as a champion of a free press and the First Amendment. That’s a contrast to President-elect Donald Trump, who made attacks on reporters a hallmark of his campaign and refused to release his tax records as other modern presidential candidates have done.

In March, Pence vetoed a bill that would have exempted private univer-

sities from releasing some police records, calling it “a disservice to the public and an unnecessary barrier to transparency.” And on the campaign trail he aggressively criticized Democrat Hillary Clinton for refusing to release emails sent from a private server she maintained while secretary of state.

But his gubernatorial administration has argued against the public release of emails and other documents that could shed light on his tenure as governor. In some cases, his office has withheld documents, delayed responses or flatly denied public records requests filed by The Associated Press and other news organizations.

On Monday, Pence attorney Joseph Chapelle told the judges that the separation of powers established under the state’s constitution should prevent the court system from forcing Pence and his immediate staff to comply with the open records law if they are sued.

“Inquiry into the personal papers of the governor would (interfere) with the affairs with of the governor’s office,” Chapelle said. “He’s different than oth-

er state agencies.”

The appellate court took up the case after a lower court ruled that Pence did not have to turn over emails, billing invoices or a document authored by the chief-of-staff to now-Texas Gov. Greg Abbott. The documents, sought

by Groth, outlined legal arguments for the GOP’s successful challenge to Obama’s immigration executive order.

Pence’s administration released 57 pages of emails with some redactions, as well as redactMike Pence ed invoices to Groth, a Democrat. But it declined to provide an attached document that Abbott’s staff had emailed to many Republican governors while trying to recruit other states to join the legal challenge.

Pence’s attorneys argue that the governor’s office acted within its rights by refusing to release the records, which they say are “work product” that is “deliberative” in nature and also protected by attorney-client privilege. But Pence’s attorneys also

argued that an Indiana Supreme Court ruling that effectively exempted the state’s General Assembly from releasing emails should also apply to them.

The state’s highest court ruled in April that it could not order the Legislature to release lawmakers’ email correspondence because it would violate the state constitution’s separation of powers between the legislative and judicial branches of government.

“It’s extremely ironic because hidden emails were a hot topic during the presidential campaign,” said Julia Vaughn, the policy director for the left-leaning government watchdog group Common Cause Indiana. “He could set an example by walking the walk and not just talking the talk. Sadly, I don’t expect him to do that.”

A ruling in the case against Pence is not expected immediately. But government watchdog groups said that if the courts ultimately agree with Pence’s interpretation, the Indiana governor’s office would police itself when it comes to the release of public records, seriously weakening the law by limiting the ability to sue for records.

CANNON BALL, N.D. – Authorities on Monday defended their decision to douse protesters with water during a skirmish in subfreezing weather near the Dakota Access oil pipeline, and organizers said at least 17 protesters were taken to the hospital – including some who were treated for hypothermia.

The clash occurred late Sunday and early Monday as protesters trying to push past a long-blocked bridge on a state highway were turned back by authorities using tear gas, rubber bullets and water hoses.

One officer was injured when struck in the head with a rock. One protester was arrested.

Protesters and officers massed at the bridge again late Monday morning, but protesters dispersed a few hours later at the request of tribal elders after police warned the crowd that they’d identified firearms and that anyone with a weapon should leave.

The Standing Rock Sioux and others oppose the 1,200-mile, four-state pipeline being built to carry oil from western North Dakota to a shipping point in Illinois because they say it threatens drinking water on their nearby reservation and cultural sites. Pipeline

Authorities dispute that. Additional testing is needed to make sure the bridge is safe, and that can’t be done until the area is deemed safe for inspectors, state Transportation Department spokeswoman Jamie Olson said.

At least 17 protesters were injured severely enough to be taken to hospitals during the overnight skirmish at the bridge, said Dallas Goldtooth, an organizer with the Indigenous Environmental Network.

“Hypothermia, a number of head injuries from being shot with rubber bullets, one individual had a heart attack,” he said.

Daniel Kanahele, 64, a native Hawaiian, said he was hit with tear gas, water spray and a rubber bullet in a leg, and “it took me off my feet.” He was treated at the scene.

Although Goldtooth said a water cannon was used to douse the protesters, Morton County Sheriff Kyle Kirchmeier said only fire hoses were used.

Sheriff’s spokesman Rob Keller said a tactical vehicle spraying tear gas has been mistaken by some people as a water cannon.

Kirchmeier defended the use of water hoses, saying protesters were using aggressive tactics themselves.

“We’re just not going to let people or protesters in large groups come in and threaten officers. That’s not happening,” the sheriff said.

We liked it so much that we bought a Subaru Forester as a second car late last year. I’d like to buy Subaru stock, but I can’t find it listed anywhere.

Where can I find it? And please tell me whether you think the stock is worth buying. – NE, Fort Lauderdale, Fla. Dear NE: You’re looking in all the wrong places. Though you probably know that the demand for Subaru’s Outback and Forester models is so strong that Subaru is in the process of expanding its American plant to produce an additional 100,000 vehicles by the spring of 2017, you probably didn’t know that when spelled backward, “Subaru” is pronounced “you are a bus.”

Subaru (the Japanese name for the Pleiades star cluster, or the Seven Sisters) is the automobile manufacturing division of Fuji Heavy Industries (FUJHY-$18). The company is the 18th-largest automaker (by production) in the world. Subaru is different from its Japanese competitors in that 75 percent of its cars and parts are

Its only overseas manufacturing facility – which is in Lafayette, Indiana – is currently in the process of trying to handle record demand.

Owning shares of parent Fuji Heavy Industries is the only way to own shares of Subaru. Fuji should earn $2.54 a share this year, and its 70-cent dividend yields 3.8 percent.

Fuji Heavy Industries is a $31.6 billion-revenue company with a very impressive 13.3 percent net profit margin, which is 21/2 times better than Ford’s and General Motors’.

Frankly, if Ford and GM were managed as well as FUJHY, those issues might be trading at twice their current prices. This year, Subaru may sell over 1 million vehicles, which would account for 92 percent of FUJHY’s 2016 revenues.

FUJHY employs 31,000 workers to manufacture and sell automobiles and their various parts. The remain-

ing $3 billion of revenue is derived from the sale of aerospace-related machinery and components, agricultural machinery and components, and construction machinery and components.

Subaru’s product line is intentionally limited, and management focuses on building safe, fuel-efficient, reliable all-wheel-drive vehicles. Demand is booming, and Subaru is on track to having its seventh consecutive record sales year in the U.S. However, record sales are made easier by anything-goes financing.

Dealers are super eager to sell cars, and the banks are extra eager to lend money so that together they can get pet pigs approved for seven-year nomoney-down loans.

Though Subaru is earning record revenues in the U.S., the story isn’t so positive in the rest of the world. Sales in Japan are off 3 percent from a year ago, and revenues from China and Europe remain flat.

As a result, the price of FUJHY shares has fallen 66 points in the past dozen months. Despite all that, Thomson Reuters, Charles Schwab and Credit Suisse have “buy” ratings on

the stock and the price talk of $21-$24 in the next dozen months.

Whereas Ford and GM will probably post lower revenues in 2017, the consensus is that Subaru could have an eighth consecutive record sales year in the U.S. And helping next year to be another record year will be the Subaru Impreza, a compact sedan to be built at the expanded Lafayette plant on a new global platform.

Next year should be a good year for FUJHY, and there’s a possibility that FUJHY’s superb management team will increase the dividend.

According to Market Watch, there are 17 brokerages following FUJHY. Nine have “buy” ratings. Two have “overweight” ratings. Five brokerages rate FUJHY a “hold.” And one brokerage recommends that investors “sell.” I’d buy the cars because of their impressive reputation for quality. But my gut tells me not to buy the stock. Something doesn’t feel right to me.

Stocks home in on records as energy companies rise

The Associated Press NEW YORK – U.S. stocks are rising, putting major indexes on track to close at record highs, as energy companies climb with the price of oil. Investors are hoping that OPEC countries will soon finalize a deal that would cut oil production and help support prices. The start of the week once again brought several corporate deals, with companies in the energy and technology industry making moves.

KEEPING SCORE: The Dow Jones industrial average gained 69 points, or 0.4 percent, to 18,936 as of 3:05 p.m. Eastern time. The Standard & Poor’s 500 index rose 14 points, or 0.6 percent, to 2,195. The Nasdaq composite gained 41 points, or 0.8 percent, to 5,362. The Dow has been setting records since the presidential election earlier this month, while the S&P 500 and Nasdaq reached all-time highs this summer. Small-company stocks, which are at record highs already, also continued to climb.

If stocks close around their current levels, it will be the first time all of those indexes set records on the same day since December 31, 1999, according to Ryan Detrick, senior market

strategist for LPL Financial.

ENERGY: Benchmark U.S. crude oil rose to its highest price this month. It gained $1.80, or 3.9 percent, to $47.49 a barrel while Brent crude, the international standard, rose $2.04, or 4.4 percent, to $48.90 a barrel in London.

That led to gains for energy companies. Marathon Oil added 80 cents, or 5.1 percent, to $16.42 and Exxon Mobil added $1.12, or 1.3 percent, to $86.40.

OPEC nations will meet in Vienna on Nov. 30. They have agreed to preliminary terms of a deal that will reduce the production of oil slightly, but the details remain to be determined.

THE QUOTE: Quincy Krosby, market strategist at Prudential Financial, said investors are encouraged that OPEC is trying to limit production. But she doesn’t think a deal, if one happens, will have much effect on oil prices.

“There’s nothing to suggest the agreement’s going to hold,” she said.

“When all is said and done, supply and demand will ultimately dictate the price.”

CHICKENING OUT: Meat producer Tyson Foods tumbled $9.82, or 14.6 percent, to $57.95. The company’s fourth-quarter profit and sales fell far short of Wall Street’s forecasts as Ty-

son’s chicken business struggled. The company also said CEO Donnie Smith will step down at the end of this year, and company president Tom Hayes will replace him.

Competitor Hormel Foods lost 66 cents, or 1.9 percent, to $34.92.

LOCKED UP: Identity theft and fraud protection company LifeLock jumped $3.12, or 15 percent, to $23.87 after security software maker Symantec agreed to buy the company for $2.3 billion. The deal values LifeLock at $24 a share. Symantec picked up 90 cents, or 3.8 percent, to $24.65, a sign investors approve of the purchase.

WATERS RISING: Building products company Headwaters agreed to be bought by Boral Ltd. of Australia in a deal the companies valued at $2.6 billion, or $24.25 per share. Its stock climbed $3.50, or 17.4 percent, to $23.59.

LOGGING ON: Technology stocks also made substantial gains. They have lagged the market since the election after very strong performance over the summer. Facebook rose $4.64, or 4 percent, to $121.66 while online payments company PayPal advanced 43 cents, or 1.1 percent, to $40.51 and Alphabet, the corporate parent of Google, picked up $9.07, or 1.2 percent, to $785.04.

“First games are always ugly,” the Lincoln-Way West senior guard said Monday night after scoring 34 points to lead Lincoln-Way West to a 53-41 victory over Plainfield Central in the opening game of the 21st annual WJOL Thanksgiving Classic at the University of St. Francis Sullivan Center.

“This my fourth one, and they don’t get any prettier.”

The Warriors (1-0), coming off a season where they finished second in the state in Class 3A, suffered some significant graduation losses. But Pettinato, the team leader through virtually all of his four-year high school career, is back.

He did not shoot particularly well Monday, but at the same time, he was unstoppable. He finished 13 of 31 from the floor, 2 of 5 on 3-pointers and 6 of 8 from the free-throw line. He also grabbed 15 rebounds, five on the offensive end. Jay Bumsead chipped in 12 points, including 7 of 9 free throws.

“You can play all the fall league games you want, nothing is like the real deal until it’s here,” Pettinato said. “I thought overall we did a good job with the little detail stuff.

“The scoring will come from some of the other guys once they get adjusted. Right now it’s OK if they don’t score much, they’re getting some of those little details down.”

“And our big man, Mark Lorenz, played big minutes for the first time, really, and he did some good things.”

From an overall perspective, though, West coach Brian Flaherty agreed with Pettinato’s assessment.

“It was a Game 1, kind of what you

would expect,” he said. “But what was disappointing was I thought our intensity, focus, vision and communication were better in practice than they were tonight.

“Give Plainfield Central credit, though. They were gritty and played hard. They were athletic in terms of attacking the basket.”

Central (0-1) led, 21-11, after one

quarter and still was within 26-22 at halftime and within 36-31 after three quarters, before West began to pull away.

Shaw Media correspondent JOLIET – New coach, same result, but it took overtime. In fact, two overtimes.

The Joliet Central boys basketball team, under new coach Lawrence Thompson Jr., beat Romeoville in double overtime, 73-66, Monday night at Joliet Junior College in the opening round of the 21st annual WJOL Thanksgiving Classic.

JoJo McNair hit three free throws and Jose Grubbs added a pair with 28 seconds left in the second overtime to seal the Steelmen victory.

Thompson, who was the head man at Lockport for 16 years and spent last season as the sophomore coach at Joliet West, was happy to get the first win.

“I’ll take the extra basketball at this time of the season,” Thompson

said. “These kids had no quit in this game and that comes from the previous coaching staff and I’m going to ride that as long as we can.

“We got more comfortable as the game went on and I thought we rebounded really well in the second half. At times we were a little hesitant and afraid to make a mistake.

But my wife always told me you can’t bake a cake without a few broken eggs.”

The Steelmen, the three-time defending tournament champions, were led by Grubbs, the senior, who left the floor only for a brief 30-second rest in the first half. He scored 22 points and grabbed 13 rebounds.

“This win means a lot,” Grubbs said. “They beat us last year in this tournament and we wanted to get them back. I started out a little slow, but coach just told me to play my game.”

Junior Cameron Blackmon added 18 points for the Steelman and scored most of his points at critical times in the game.

“I have to credit my teammates, they put me in good positions to score,” Blackmon said.

The two Southwest Prairie Conference rivals played a very physical game at both ends of the floor throughout the night.

The Spartans led, 45-42, after three quarters and then put together a 7-0 run, sparked by a dunk by Dontia Johnson, to go up, 52-42.

But the Steelmen scored the next eight points to get within 52-50 with 4:00 remaining. But Romeoville called a timeout and held the lead until Ryan King hit a 3-pointer with :19 left to knot the game at 61-61.

Romeoville was called for an offensive foul on the next possession, but Grubbs missed a long 3 at the

buzzer, and it went to overtime.

The game was tied at 64-64 after the first overtime.

The Spartans were led by 21 points from junior DeAndre Heckard and 17 from Johnson.

“That was a great game, no one gave in and it came down to execution at the end,” Romeoville coach Marc Howard said.

Romeoville never had more that a four-point lead in the first half until an 6-0 run with under two minutes left put the Spartans up, 30-23.

The Steelmen had the game tied at 16-16 after a 3-pointer and a layup

by Blackmon. They scored a basket at the end of the half to cut the deficit to 30-25 at the intermission.

Both teams will be in action at University of St. Francis on Wednesday. Central will take on Providence at 4:45 p.m., after Romeoville tests Lemont at 3 p.m.

“Our guys competed,” Central coach Steve Lamberti said. “We knew we would be in a situation where we could win going into the fourth quarter, but we didn’t get it done then.”

Lamberti glanced at the stats sheet.

“We shot four free throws and took 28 threes [hitting seven],” Lamberti noted. “We obviously have to work on getting the ball inside.”

Lamberti said Central has “four guys who can average 10-15 points, we just didn’t get the balance tonight.”

For example, senior Michael Hood went scoreless, and that is not likely to happen often. “He’s one of our good players,” Lamberti said. “He’ll be fine.”

West overall is a small team, and Central managed a 31-27 rebounding advantage, with Morganfield grabbing 11 and Williams seven. However, the Wildcats shot only 31.3 percent from the floor to West’s .409.

“We have to use defensive intensity to make up for our lack of size,” Flaherty said. “We have to find the right spot on the boards and get a body on someone.”

Lamberti said Central did a relatively good job defending Pettinato.

“He took 31 shots,” he said. “A player like that takes 31 shots, he is bound to score a lot. He did do a good job getting inside and scoring in the second half.”

“Teams are going to try to deny Marco outside,” Flaherty said. “The best way to beat that is to get him the ball inside, where he might have a mismatch.”

When the tournament resumes Wednesday, Lincoln-Way West will meet Minooka at 6:30 p.m. and Plainfield Central plays Lockport at 8:15 p.m.

Joliet West boys basketball coach for awhile. I thought that our intensity was fantastic. There are obviously a lot of things that we need to work on, but we forced 16 turnovers in the first half, and that’s pretty impressive.

“I was happy on the defensive end but not happy with some other stuff, but that comes from only getting about two weeks of practice before the first game. We’ve been playing like this for a couple of years, and they’ve been playing together for two straight years. We try to do that in practice, competing against each other. You know what to expect going into a game.

“The newspapers and community

have large expectations, but we have our own expectations, and we’ll keep working at our goals since in the end it’s about our guys and what they want.”

The Titans (0-1) took a 3-2 lead on a 3-point basket from Brelyn Moore (nine points, six rebounds, but then the Tigers took control with the decisive run. Bell made three baskets and a free throw while Kirk added three buckets, including a 3-pointer, during that key stretch.

It was more of the same during the second period as Kirk and Bell each scored eight more points to put the Tigers up by 38 points at the break. Tinley Park turned over the ball 23 times in the opening half while West grabbed a 20-11 advantage on the boards.

The Tigers also received 12 points and eight rebounds from Elijah Ward, 10 points each from Tabyous Casterberry and Eddie Creal and seven points apiece from Michael Smith and Derren Williams. Tinley Park was paced by 10 points from Mark Cross.

“We’re really focused this year on our goals,” Bell said. “We have huge goals, and I think that everyone knows

that. We knew what we wanted to do in this game, and we took it over right from the start and we just controlled the game the whole time.

“We have a humongous chip on our shoulders, so we’re going to come out and play every game like it’s our last one, like we did tonight. It doesn’t matter what team we’re playing, we play them like they’re the best team in the state. We have really good players from one to 11, and what I like the most about our team is that none of us are selfish.

We don’t just have one guy who gets all of our points and does everything. We all do everything that we need to do.”

Shaw Media correspondent JOLIET – In some corners of Minooka, the citizenry would like to advance the calendar from November to March.

Nothing against Thanksgiving, Christmas, New Year’s Day or Super Sunday, mind you. Or even Black Friday.

But the way the Indians look on the basketball court, the biggest holiday before springtime may well be an extended season of March Madness that involves a weekend in Peoria.

The Indians looked as sharp or sharper in Monday night’s season opener – a 62-37 dissection of Lockport Township in the WJOL Thanksgiving Classic at the University of St. Francis – as they did in advancing into sectional play last season en route to a 23-9 record. With only two starters back, Jonny Butler and Keegan Graebner comprising that duo, the Indians still dominated both ends of the court from start to finish.

Butler led the way with 24 points, 22 in the first half. Keegan Graebner scored 15 points while passing out six assists, with twin brother Kyle Graebner adding 11 points. There were assists on 15 of Minooka’s 25 baskets, an indication of carried-over cohesion.

The Indians weren’t perfect, as Butler acknowledged.

“There are always things to correct,” Butler said.

Tanaka agreed that the Indians were sharp for those first 24 minutes, largely because new starters John Carnagio, Antonio Milazzo and Kyle Graebner picked up where their forebears left off.

“Our kids have done a great job of buying into what we do,” Tanaka said. “Last year, our bench pushed us in practice, which is how you get better.”

Said Butler: “The sky’s the limit.

We have size and toughness.”

And speed. The Indians were a step

ahead of Lockport all night.

For the Porters, there’s nowhere to go but up.

“The first half, we weren’t ready to play,” coach Scott Hespell said. “At Minooka, the culture of their program is fantastic. We want to be like that, and we’re not there right now.”

Lockport was led by sub Jacob Karli’s eight-point showing. Starters John Meyer and Matt Smietanski each scored five points, the Porters shooting 35.7 percent (15 of 42) overall.

Defensively, they were worse.

“I think we know our identity on offense, but we have to find an identity on defense,” Hespell said. “It’s on me that we don’t have one. They hit a lot of open shots. Part of that identity is we can’t give up that many open shots.”

Minooka outrebounded Lockport, 26-21.

The Indians meet Lincoln-Way West, a 53-41 winner over Plainfield Central in the night’s first game, at 6:30 p.m. Wednesday. Lockport meets Plainfield Central in Wednesday’s 8:15 p.m. nightcap.

JOLIET – Joliet West’s boys basketball team enters the season as one of the top-ranked teams in Illinois.

And while one game doesn’t indicate whether the Tigers are capable of achieving that high status, one thing that was very clear in Monday’s season opener is that coach Nick DiForti’s squad certainly figures to be one of the more entertaining teams in the state.

West put on a clinic of both steals and slams in the opening half to help it grab a 30-7 lead after one quarter and a 54-16 advantage at halftime before settling for a 91-49 victory over Tinley Park in its own Tiger Thanksgiving Classic.

Teyvion Kirk (nine rebounds) and Trevian Bell (six rebounds) each scored 19 points to lead the Tigers (1-0), who broke things open with a 24-0 outburst in the opening quarter.

“We felt that we had unfinished business since we didn’t go out the way that we wanted to last year,” DiForti said. “So our guys have been waiting for and preparing for this first game

“The newspapers and community have large expectations, but we have our own expectations, and we’ll keep working at our goals since in the end it’s about our guys and what they want.”

Plainfield North’s focus all on East St. Louis VIEWS Dick Goss The job for the Plainfield North football team really is no different than it has been every week through the course of the playoffs.

The Tigers are blocking out the outside noise, putting their full concentration on preparing for their next opponent.

That’s the way it has to be, coach Tim Kane said Monday as the controversy created on the final play of regulation in Saturday’s 18-17 Class 7A semifinal victory over Fenwick continued to swirl.

“All we can focus on is what we can control,” Kane said. “Football is an emotional game, and you’ve got to be mentally under control. There are some things that you can’t control, like the weather, field conditions or officials’ calls.”

The officials’ interpretation of the final play in regulation, where intentional grounding was ruled and an untimed down was awarded – which the rule book says should not have been awarded – resulted in Connor Peplow’s game-tying field goal. North then made the plays it needed to make to win in overtime.

“It’s been a little bit of an uncomfortable distraction to some degree,” Kane said. “But we played a tough, hard-nosed football game against a very good team and won the game in overtime.”

That’s the bottom line.

The Fenwick camp is upset, and in this social media era, remarks have been made that Fenwick deserves to be at state rather Plainfield North. Thus, Kane’s directive to his players.

“There was outside noise after we beat Highland Park, about how that was the first time we ever won a playoff game,” he said. “Then there was a lot of outside noise about how we beat Bradley and they were the No. 1 seed.

“After each of those games, we kept telling the kids to block it out and focus their attention on the next game. The message I am giving them has been the same every week, and it’s that way this week. We can’t worry about things we can’t control.”

What North can control this week is preparing mentally for the state championship game against East St. Louis, one of the state’s most ballyhooed teams regardless of class. The Flyers (13-0) and Tigers (11-2) will kick off at 4 p.m.

East St. Louis always is a powerful offensive team, and this edition is no exception. But what probably sets these Flyers apart from many of their predecessors is defense.

“Most of the time we have had a very explosive offense,” East St. Louis coach Darren Sunkett said. “This year we lost three starting offensive linemen to ACL injuries in Week 2, and that set us back.

We sputtered at times.

“Defense really has been carrying us.

We’re more of a defensive team than in previous years.”

Even with the injuries, though, the Flyers still feature one of the state’s – make that the nation’s – best wide receivers in Jeff Thomas, who has not decided on a college. Quarterback Rey Estes is headed to Missouri, and the Flyers also sport quick running backs.

Meanwhile, North’s defense has been strong all season, boasting one of the state’s best points-against averages.

“We have some very good football players on the defensive side, and really, we’re undersized there,” Kane said. “We have an explosive defensive line and our two inside linebackers [DJ Frey and Will Stoll] are three-year starters. Our line and linebackers have done a great job against versatile running backs the last couple weeks.”

Two of the unsung heroes of the defense are members of the secondary in the Tigers’ 4-2-5 alignment. Safeties Rob Ostapkowicz and Zach Nadle have made plays throughout the playoffs. Ostapkowicz intercepted a pass in the end zone to snuff out a Fenwick threat.

“Rob Ostapkowicz does not get a lot of recognition,” Kane said. “He did not even start at the very beginning of the season. But he works hard and is very disciplined. And Zach Nadle makes a lot of plays in the middle of the field.”

Nobody has scored more than 22 points against North. If the Tigers can extend that streak against an opponent as good as East St. Louis, they will be giving themselves a shot.

LB Freeman suspended for PEDs The ASSOCIATED PRESS LAKE FOREST – Linebacker Jerrell Freeman on Monday became the second Bears player suspended for violating the league’s performance-enhancing drug policy in as many weeks.

Freeman was suspended for four weeks and is eligible to return to practice before the Dec. 24 home game against the Washington Redskins. Freeman, in his first year in Chicago after signing as a free agent, leads the Bears with 69 tackles and 22 assists.

He apologized and said he took full responsibility for a “mistake with my prescription medication.” Last week, wide receiver Alshon Jeffery was suspended four games for the same violation and will be eligible to return for the Dec. 18 game against Green Bay. “Obviously it puts us in a tough spot,” coach John Fox said a day after his team lost 22-16 to the New York Giants . “That’s why you usually see apologies, I think they understand that and it’s obviously a mistake and one they typically regret.”

“These guys understand all the parameters of the drug testing involved in our league,” Fox added. “But much like

Alshon, we move on and we’ll move on without Jerrell.”

Despite the pair of suspension in such a short time, Fox said he didn’t think it was a problem specific to the Bears.

“It’s an issue everywhere in the league,” he said. “That’s why we have drug testing in any professional sport or even Olympic sports. It happens, unfortunately.”

Without Freeman, the Bears will turn to either John Timu or Nick Kwiatkoski alongside Danny Trevathan at inside linebacker.

“For me, I know what type of person Jerrell is,” Bears tackle Charles Leno Jr. said. “He made a mistake, he owned up to it and I forgive him. It’s a loss that we’re going to have on the defensive side of the ball, but that gives opportunities for guys like Nick to step up, so I’m excited to see Nick play this week if he gets the opportunity, and John Timu.”

The suspensions come at a poor time for the Bears, who lost tight end Zach Miller to a broken right foot against the Giants as they dropped to 2-8. They also lost several other players in the game, including rookie linebacker Leonard Floyd to a scary neck injury.

How Kellogg worked with ‘independent experts’ to tout cereal

The Associated Press NEW YORK – On its website, Kellogg touted a “Breakfast Council” of “independent experts” who helped guide the company’s nutritional efforts.

Nowhere did it say this: The maker of Froot Loops paid the council members and fed them talking points, according to a copy of a contract and emails obtained by The Associated Press.

The company paid the experts an average of $13,000 a year, prohibited them from offering media services for products “competitive or negative to cereal” and required them to engage in “nutrition influencer outreach” on social media or with colleagues.

“I’m still feeling great from my bowl of cereal & milk this morning!

Mini-Wheats are my fave,” a dietitian on the council posted during a Twitter chat with Kellogg. Another council member and dietitian chimed in to say they were her favorite, too, and included a photo of the cereal.

For Kellogg, the council – in existence between 2011 and this year – deftly blurred the lines between cereal promotion and impartial nutrition guidance. The company used the council to teach a continuing education class for dietitians, publish an academic paper on breakfast and try to influence the government’s dietary guidelines.

Kellogg said the council’s activities were clearly sponsored.

Yoni Freedhoff, an obesity expert at the University of Ottawa who writes about industry influence in nutrition, said he didn’t believe it was clear to the public that the council members were compensated, especially since Kellogg described them as “independent.”

“It’s not an automatic leap. I don’t think people think about these conflicts that deeply,” he said.

Dayle Hayes, a dietitian who participated in the Twitter chat in 2014, said in an email that she prides herself on her ethics and transparency and that her disclosure practices have changed as standards have evolved. Based on current standards, she said she would include the word “ad” in tweets referencing Kellogg products. She said she did not share any information without appropriate disclosures.

Kellogg said on its website that the breakfast council helped guide the company. But it wasn’t always clear who was providing the guidance.

When Kellogg sent the council research it commissioned, Hayes expressed enthusiasm and requested language to share the information. Hayes and Sylvia Klinger, another dietitian on the council, tweeted the lines Kellogg provided verbatim. Hayes included the word “advisor” and Klinger included the word “client.”

Kellogg also supplied the experts with a “toolkit” of tweets for a promotional event in New York. When the council members received a critical email from someone they didn’t know criticizing their work with the company, the company suggested a response for that, too.

“I appreciate and share you(r) interest in the health of our children,” the suggestion read. “It’s for this very reason that I work with Kellogg.” The council members decided not to re-

spond.

The work with dietitians wasn’t unusual. Coca-Cola has paid dietitians who wrote columns casually suggesting mini-sodas as a snack. Disclosures said the author is a “consultant” for food and beverage companies, “including Coca-Cola.”

Jessica Levinson, a dietitian who has appeared in TV news segments for Coke and PepsiCo’s Frito-Lay, told the AP that producers were told if her healthy eating tips were sponsored.

Yet the disclosures weren’t always shared with viewers.

In a segment on NBC Baltimore on “dos and don’ts” in 2009, Levinson presented bags of Fritos with dip – as an example of a “do.”

“Are those regular Fritos?” asked the reporter, indicating her surprise.

‘KEY MESSAGES’

One of the breakfast council’s accomplishments was publishing an academic paper defining a “quality breakfast,” which Kellogg touted as being written by “our independent nutrition experts.”

A Kellogg employee oversaw the

editing and provided feedback, including asking for the removal of a line saying a recommendation that added sugar be limited to 25 percent of calories might be “too high.”

Kellogg said the paper was a supplement and that its involvement should have been clear. It noted a disclosure said a draft was written by an agency that represents Kellogg.

The Journal of the Academy of Nutrition and Dietetics said editorial rules for supplements are the same as for regular articles. The paper underwent peer review, and an editor suggested reducing or eliminating the detailed discussion of cereal, especially since the sponsor was a cereal company.

To amplify the paper, Kellogg planned to reference it in comments submitted for the government’s dietary guidelines, emails obtained by the AP through a public records request show. Kellogg also sent its breakfast council a plan with “Key Messages” to promote the paper.

One message: “A variety of Kellogg’s products and tools make it easier to enjoy a quality breakfast.”

28 New law means more stay-at-home ER care for Plainfield, Will County The HERALD-NEWS PLAINFIELD – Under a bill that became state law this summer, Freestanding Emergency Centers such as the Edward Plainfield 24/7 ER at 24600 W. 127th St. are now able to accept certain Advanced Life Support patients via ambulance.

Previously, all ALS patients had to be taken to an ER at the site of a full-service acute care hospital.

House Bill 4388, with primary sponsors Rep. Grant Wehrli, R–Naperville, and Sen. Michael Connelly, R–Naperville, was signed into law Aug. 5 by Illinois Gov. Bruce Rauner. Other sponsors of the bill included Rep. Mark Batinick, R– Plainfield, and Sen. Jennifer Bertino-Tarrant, D–Plainfield.

For example, before the new law went into effect, if a patient from Plainfield with a broken leg who was given IV medication for hydration or pain, Plainfield Fire Protection District paramedics

would have been required to take the patient to Edward Hospital in Naperville (13 miles from the Edward Plainfield campus) or another hospital in the area for treatment.

The new law allows the patient to be transported to the Edward Plainfield 24/7 ER, something that also benefits the fire department and community.

ALS patients with more severe injuries or life-threatening conditions, such as possible strokes or heart attacks, would still be taken to Edward Hospital or other hospital-based ERs in the region.

In 2015, Edward Hospital’s two ERs treated nearly 98,000 patients – 69,476 in Naperville, 28,309 in Plainfield – among the most for hospitals in the Chicago area and the state.

On Oct. 21, Lincoln-Way Central High School hosted the Chicagoland Teachers of Psychology in Secondary Schools Conference. Teachers of Psychology in Secondary Schools is an affiliate group of the American Psychological Association.

The annual conference travels between schools in the Chicago area.

Lincoln-Way Central welcomed guest speaker Dr. Laura Koehler from Linden Oaks. Koehler spoke with teachers about how to help students who

deal with test anxiety.

After Koehler’s presentation, volunteer teachers presented ideas, activities and tools that help in their own classrooms.

With the exception of this year’s conference, host and AP Psychology teacher Bobbi Pehle presents at the conference annually. Because Pehle was the host this year, other Lincoln-Way teachers presented to the audience.

Hearing impaired first-grader teaches sign language to students SHOREWOOD – When Troy Hofer Elementary School first-grade teacher Kimberly Pokrajac learned that a student with a hearing impairment would be joining her class this year, she saw it as a chance to teach the class about what it means to learn a different way.

She and SOWIC hearing itinerant Leah Casson created a program in the class called, “Sign of the Day,” where Casson and the student, Aliviah Spears, taught some sign language to Aliviah’s classmates every day during their snacktime.

They already have learned the signs for 75 words.

32 Eye drops offer relief for allergy sufferers Note to readers: This column originally ran in November 2014.

Dear Dr. K: I have allergies, and my eyes

are affected the most. They’re puffy, red and itchy. What can I do?

Dear Reader: Pollens, animal dander, dust mites and mold: The same allergens that cause sneezing and an itchy nose and throat can trigger allergy symptoms that affect your eyes, too. If your eyes are red and itchy, you also might have tearing, mucous discharge and swelling of your conjunctiva (the inside of your eyelid).

This constellation of symptoms is known as allergic conjunctivitis. It can be uncomfortable, but it is not a threat to vision.

To help improve your symptoms, try to avoid whatever triggers your allergies. If you are allergic to cats, avoid them, or at least don’t touch your eyes when near one.

If pollen is your nemesis, keep your windows closed. And keep an air purifier or air conditioner going in pollen season.

A simple but effective remedy is to place a cool, wet washcloth over your eyes.

Also, use artificial tears (available without prescription) frequently. They’ll give you some relief and help wash away allergens.

Try not to rub your eyes. Doing so causes mast cells, which play a key role in allergic reactions, to release inflammation-causing chemicals into the eye. This makes symptoms worse.

If your symptoms appear occasionally, try one of the newer generation of antihistamines you can take by mouth. Antihistamines block the action of histamine, a major cause of itchy eyes. Over-the-counter options include loratadine (Claritin), cetirizine (Zyrtec) and fexofenadine (Allegra).

Others are available by prescription.

Another option is eye drops that contain mast cell stabilizers, which limit release of the inflammation-causing chemicals.

Eye drops that contain antihistamines and decongestants (medicines that cause small blood vessels to narrow) are available over the counter. They can provide quick relief, particularly of the redness in the eye. But don’t use these medications for more than a week or two, as they can cause excessive narrowing of the blood vessels in your eye. And be prepared for a little redness to return after you’ve stopped using them.

If your symptoms persist, try eye drops that combine a mast cell stabilizer and an antihistamine. These drugs are available over the counter and by prescription.

If you use multiple types of eye drops, such as drops containing an antihistamine and artificial tears, don’t put both drops in your eye at the same time. Wait about five minutes between putting the two types of drops in your eye. Otherwise, the second type you put in your eye may wash away the effects of the first type.

If your symptoms are severe and don’t improve with other medications, ask your doctor about prescription eye drops that contain corticosteroids. These medications help control inflammation, but they only should be used under the guidance of an eye specialist (ophthalmologist). Without proper monitoring, corticosteroid eye drops can cause glaucoma, cataracts or other serious complications.

While, as you replied to “Sleepy in California” (Sept. 17), some parents do “cosleep” with their children for the first few months, what you were referring to actually is “bed sharing.” Bed sharing was shown in studies several years ago to be the greatest risk factor for sleep-related deaths in infants younger than 4 months of age.

The American Academy of Pediatrics and the March of Dimes both have recommended (for years) against bed sharing in these young infants. Instead, they recommend young infants sleep in cribs near their parents. They of course should be on their backs and should not be sleeping with blankets or toys.

These deaths, mostly from suffocation or overheating, are sad and mostly preventable.

The acceptance of bed sharing due to cultural influences is difficult to overcome. Please help by taking the time to educate your readers on the dangers of bed sharing with infants. – C.

In today’s deal South has finesses available in all three side suits. However, because he is in a small slam, he cannot afford to take two that lose.

How should he play in six hearts after West leads a trump, and East follows suit?

The bidding followed a modern path. Two no-trump was the Jacoby Forcing Raise, guaranteeing game-going values with at least fourcard heart support. Four no-trump was Roman Key Card Blackwood.

North’s reply showed the trump queen and two key cards (two aces, or one ace and the trump king). Five no-trump announced that all six key cards (four aces, the trump king and trump queen) were held and that South was thinking about a grand slam. Six hearts denied a side-suit king.

Declarer drew trumps ending on the board, then played a diamond to his queen. Sadly, it lost, and a diamond came back. Now South needed to maximize his chances in the black suits. He won with his diamond ace, cashed the club king, played a club to the ace, discarded his last club on the diamond jack and ruffed a club.

Here, the queen appeared to establish dummy’s jack, so the contract was home. But if the queen had not been seen, declarer would have crossed to dummy with a trump and tried the spade finesse.

The percentages on those finesses are basically 50, 75 and 87.5.
