New county magistrate named

There will soon be a new magistrate in Union County. A retirement party was held at the courthouse last week for longtime magistrate Marion James who has held the position since Feb. 7, 1995, when he took over for Don Clark. “I’ve enjoyed my time as magistrate — working with the law on the other side of the bench so to speak,” James said. “I liked hearing the facts of each case and applying the law using those facts whether it be civil, criminal or committment cases.” A county magistrate is a state employee who issues warrants, sets bonds, appoints attorneys and conducts preliminary hearings, among other tasks. James, 71, is retiring because he will meet the mandatory retirement age set by the state legislature on Nov. 17 (his birthday). He said he does plan to continue his practice on Elm Street
The PTO Carnival at Creston Elementary School has been pushed back to Friday, Nov. 21, because of the Creston/Orient-Macksburg playoff football game against Dallas Center-Grimes Nov. 7. The carnival will run from 5:30 to 8:30 p.m. and features games, food, prizes, raffle and auction.

in Creston. James said his retirement as magistrate will allow for more free time, which he plans to use traveling, spending time with grandchildren and devoting to his practice. Replacing James on Nov. 17 will be 52-year-old Todd Nielsen of Creston. He was selected by a magistrate nominating committee last month. That committee consisted of district court judge Gary Kimes, three
lay people and two practicing attorneys. “I look at this as a new challenge,” Nielsen said. “I’ve been doing attorney work for 25 years and this gives me an opportunity to apply those skills on the other side of the bench.” Nielsen — a 1989 graduate of Cumberland School of Law at Samford University in Birmingham, Ala. — has been shadowing James for the past

Nielsen and his wife Beth have three children — Evan and Olivia who are both attending Iowa State University and Alex — a senior at Creston High School and starting quarterback of the Creston/O-M footballl team that defeated Norwalk 59-31 Monday evening at Panther Field. Union County Auditor Sandy Hysell reported more than 2,300 people submitted absentee votes in Union County, which surpassed the previous gubernatorial election of about 1,600. Voting is open today from 7 a.m. to 9 p.m. Polling places in Union County are Afton Methodist Church, Arispe Methodist Church, Salem Lutheran Church, Southwestern Community College, Trinity Lutheran Church, Supertel Inn, Crest Baptist Church and Lorimor City Hall. Water main replacement near uptown Creston
The building owned by Jeanette Gildsig on W. Townline Street in Creston just east of True Value is in the process of remodeling the storefronts with a mixed pattern of stone slabs and bricks. Workers started the project Thursday and finished the lower level of the building Monday afternoon.
A contractor will be working to replace a water main on Union Street along the north side of Casey’s south in Creston today and Wednesday. Access to Casey’s south will be limited but maintained. The next water main project will begin late this week working on the section of Elm Street from south of the railroad crossing to the alley south of Union Street. From 6 a.m. to 6 p.m., the south lane of Elm Street will be closed between Adams Street and Union Street. It will be reopened in the evening.

State troopers release details in Newton death NEWTON (AP) — The Iowa State Patrol has identified a man who was fatally struck by a vehicle after troopers say he fled from a patrol car into traffic while handcuffed. Authorities say 36-year-old Matthew Lentzkow of Newton died Saturday on Interstate 80 in Jasper County. A trooper pulled him over on suspicion of operating while intoxicated. The trooper was taking an inventory
of Lentzkow’s vehicle when Lentzkow escaped from the patrol car. The trooper says Lentzkow was able to get out of his seat belt and the car while his hands were bound behind his back. A vehicle hit Lentzkow on the highway and he was pronounced dead at the scene. The trooper has been placed on paid administrative leave while state investigators review the case.
