Why Would I Consider a Trust For My Estate Planning

In 2025, everyone needs an estate plan, regardless of your socio-economic circumstances.

A simple estate plan will typically contain at least three documents; a durable medical power of attorney and a durable financial power of attorney. These documents give the authority to a person of your choice, to speak on your behalf on your medical and financial issues if you’re not able to make necessary decisions due to health issues. The third document, a will, is a way to pass your property upon death to whom you wish.

A trust might be an option in your estate planning instead of or in addition to a will. Trusts are useful estate planning tools that can accomplish a variety of goals. They can help avoid probate, minimize taxes, and be used to give property to minor or disabled loved ones. Trusts can be created during a person’s lifetime (Living Trusts) or at the person’s death (Testamentary Trusts). Some different types of Trusts from both categories are:

Living Trust

A person can transfer their assets to a Living Trust and, as trustee, continue using their assets as needed during their lifetime.

Tax Planning Trusts

Several different types of Living Trusts provide flexible alternatives for minimizing capital gains and estate taxes, including the Charitable

Testamentary Trusts

A person can create a Trust under a Will, called a Testamentary Trust, which does not take effect until they are deceased.

Disability Trusts (also known as Special Needs Trusts)

A Disability Trust is a type of Living Trust that allows a disabled person under the age of 65 to use his/ her own assets, other than for food and shelter, for their special needs and keep public benefits, such as Medicaid and Supplemental Security Income (SSI).

n Do you want to provide for children, grandchildren or charitable organizations?

The types of assets you own is another important consideration. Three typical reasons you might need a trust:

A loved one cannot be trusted with a large financial gift or has special needs. If you have concerns that a child does not have the financial skills to manage a financial gift or the loved one receives government benefits.

2You want to transfer complex assets in a thoughtful manner Trusts can be effective for keeping a vacation home or a closely held business in the family. For large charitable donations, a trust allows you to leave a vision for how you would like the gift used.

Many of us procrastinate when it comes to writing a will.

Many of us procrastinate when it comes to writing a will. Perhaps we don’t want to be reminded of our mortality. It may be a fear of the anticipated expense or a loss of control over property. But having a will extinguishes those fears. Want a few other reasons? A will contains your selection of who will receive what, when and how upon your death. You decide who will take care of your minor children. You facilitate the probate process (making it less expensive and quicker). You can disinherit individuals, make gifts or charitable donations and provide for your pets.

You decide who administers your estate to see that everything goes as you have directed. If no will exists, the state will determine how your property is divided.

This can be easily avoided with proper planning. By creating your will now, you can always add to the provisions or alter the document as your life evolves. It’s advisable to review your current will every five years to be sure that it’s up to date and still reflective of your future wishes.~

Medicare 2025 “In A Nutshell” (Parts

A, B & Medigap Plans)

Original Medicare is a government health insurance program primarily for people age 65 and older. It has four main parts: A, B, C & D. The chart below is an example of how Parts A & B work together with a traditional Medicare supplement also known as a “Medigap Plan.”

Medicare Part A Hospital Insurance

Generally no cost (If you paid Medicare taxes while working)

$1,676 deductible (per benefit period)

It is possible to pay the $1676 deductible and other daily charges for multiple stays & extended care.

Plan covers: Inpatient hospital care, home health care services, hospice, inpatient skilled nursing & more.

Providers are paid by Medicare assignment.

No coverage outside USA.

No out-of-pocket maximum.

Many people add a Medigap plan, Part D or an Advantage Plan (Part C) to fill the “gaps” in the coverage.

Medicare Part B Medical Insurance

Most people pay monthly $185 (Premium could be higher based on income)

$257 annual deductible. (this can increase each year)

80/20 after deductible.

Plan covers: health care providers, ambulance, emergency care, outpatient surgical, wellness & other Medicare approved benefits

Most doctors accept Medicare.

Medicare Advantage plans are governed by Medicare. They are only offered through insurance companies that have an annual contract with Medicare. They are NOT the same as Medigap policies. They must cover all Medicare approved services. Most Advantage plans include Part D prescription drug coverage.

REHABILITATION HOSPITALS

Rehabilitation Hospitals, sometimes referred to as Inpatient Rehabilitation Hospitals, provide intensive rehab to patients who are generally medically stable but need help to recover from injury or other medical conditions.  They can be found within a hospital or in a free-standing building.  Rehabilitation hospitals were created to provide services less costly on a per diem basis than general hospitals

but provide a high level of professional therapies such as physical, occupational and speech therapies. Rehabilitation Hospitals must offer a minimum number of physician visits, increased daily rehab hours (3 hours/day, 5 days/week of PT, OT, and/or Speech), and interdisciplinary services including increased RN oversight and nursing hours per day.

HOSPICE CARE

What is it:

Who is it for:

Medical care at home for patients with a lifelimiting illness. Hospice emphasizes palliative care rather than curative treatment. An interdisciplinary team (Doctor, Nurse, Aide, Social Worker, Chaplain and Volunteer Services) works together to help the patient, caregiver, and family.

Suitable for patient with a terminal illness. A doctor must refer a patient for hospice care.

Staying on Top of Your Health: Tips for How Older Adults Can Track Important Medical Information

As we age, managing our health often becomes more complex— multiple doctors, prescriptions, and procedures can make it difficult to keep everything straight But staying organized is key to maintaining good health, ensuring continuity of care, and avoiding unnecessary complications.

. Here are a few simple and effective ways older adults can keep track of their medical history and doctor visits.

Start a Health Journal, Notebook or Binder – Include in your dedicated health journal a list of current medications and dosages, past surgeries and diagnoses, allergies and immunizations, healthcare provider contact information, and a log of appointments and any test results.

Use a Digital App or Smartphone Calendar – A simple smartphone calendar can track upcoming appointments, prescription reminders and questions to ask during provider visits. Or if not comfortable with technology, use a paper calendar and keep it in an easy to access spot.

We hear it all the time: “I wish we’d called sooner.”

If you’re not sure whether it’s time for help, try this: ask yourself whether tasks that used to feel easy now feel exhausting, confusing, or risky. Are meals skipped? Medications missed? Are you—or your loved one—avoiding the stairs, struggling with hygiene, or feeling more isolated than usual? These signs often whisper before they shout.

Aging with dignity doesn’t mean doing it alone. It means doing it wisely. ~

The strongest people know when to say: “I want to stay in my home, and I’m smart enough to get help to do that.”

Every Veteran Has A Story Worth Telling

Remember and Honor is a project dedicated to honoring our veterans by preserving their life stories, with emphasis on their time in uniform—so they are never lost, never forgotten.

To date, I’ve had the privilege of sitting down with over 600 veterans from Northern Colorado.

There has always been only one rule with this project: every veteran’s story matters.

It doesn’t matter whether they stormed a beach or spent their service peeling potatoes in KP duty. Their voices deserve to be heard for those who would like to tell their stories.

When starting this project twenty years ago, I focused on World War II and Korean War veterans because the clock was ticking with them. Of the 400 WWII veterans I’ve interviewed, only five are still with us today, as of summer 2025. My focus now is the Vietnam Veterans. The clock is now ticking for them, with age and many sadly battling the devastating effects of Agent Orange.

To every veteran reading this: please, share your story.

Whether through an interview, a written account, or simply a conversation with your family, your experiences matter. You have lived history. You have seen and felt what textbooks cannot capture. And those who love you will be forever grateful

To family members and friends: ask the veterans in your life to tell their story.

You may think you have all the time in the world, but the truth is, one day, the chance will be gone. The greatest way to honor them is to listen—to show them their experiences, their sacrifices, and their lives meant something.
