YOUR NEWS Message from the City Manager Council takes a stand on Toll Road extension The Transportation Corridor Agencies (TCA) is revisiting alignments that will impact San Clemente. The alignments seek to connect the 241, now ending at Ortega in San Juan Capistrano, to the I-5 freeway. TCA began looking at options to the 241 extension since the California Coastal Commission and the U.S. Commerce Secretary would not allow the agency to extend the 241 Toll Road 16 miles from its Oso Parkway terminus to I-5 south of San Clemente. Had this been allowed, the toll road would have traversed behind San Clemente as opposed to cutting through the town, like we already experience with the I-5 freeway. Further, in November, the TCA settled several environmental lawsuits that contested the extension of the 241 Foothill South down to Basilone Road/Trestles area, so any proposal to circumvent San Clemente is now off the table. The City of San Clemente’s representative on the TCA board, and the City of San Juan Capistrano’s representative on the TCA board both voted “no” on the settlement. The TCA’s proposed alignments could potentially include: 1) extending the toll road through Avenida La Pata and connecting to Avenida Pico; and 2) extending the toll road around the eastern portions of San Clemente and into Cristianitos. Last fall, the San Clemente City Council took a position against the extension of the 241 toll road into San Clemente. The council’s Resolution included opposition to any attempt to cut through San Clemente with the 241 or extend the 241 south from Oso Parkway to the inland terminus of Avenida Pico. Also taking place last fall, were two South Orange County Mobility Forums organized by TCA with the purpose of seeking public input on ways to relieve traffic on the I-5 freeway. One of the two forums was held in San Clemente at St. Andrews Church and was well attended by over 200 people. The City Council has directed me to develop an action plan that addresses the negative impacts of any toll road alignments that would bisect the town. The City Attorney is also considering legal scenarios. We will share more details when the information becomes available. San Clemente Adopted Marine Unit Update On Saturday, December 10, the City of San Clemente and the Marine Monument at Park Semper Fi hosted its annual Christmas Lunch for 600 members of San Clemente’s adopted HMLA469 Marines and their families. The Marines just returned from deployment in time to celebrate the holidays with family and friends. Thank you to the community who donated toys for this special event which brought Christmas cheer to all the children.

The City of San Clemente and the San Clemente Chamber of Commerce welcomed home San Clemente’s adopted unit, the 2-4 Marines at a fun-filled barbecue this past weekend. Prevent Crime: Lock It Up Every Time Studies have shown that most thefts and burglaries from vehicles occur because valuable items were left in plain view and / or the vehicle was not properly locked and secured with the windows rolled up. This is by far the most common type of crime that occurs throughout our city of San Clemente. It seems simple and obvious, yet many people can become complacent with a false sense of security and fail to insure that their vehicle is locked after parking it. It is also important to take the extra step to be sure valuables are either taken with you or placed out of view, so as not to entice a would be thief thinking of entering your vehicle. Even a cup holder filled with spare change or electronic chargers showing can tempt someone from wanting to enter your vehicle and take those items as they are easy grabs. Basically, if you aren’t comfortable with losing it, don’t leave it. Make sure to also place any bags/purses or other valuables in your trunk before you arrive at your destination so no one actually sees you place the items in there when you exit your vehicle and enter your desired location. In an effort to help spread this message and encourage residents to not become a victim of such crimes, the Prevent Crime: Lock It Up Every Time campaign was born. This safety initiative is meant to serve as a reminder for the community to keep all homes and vehicles locked and secured at all times, with no valuables left in plain sight. Doing so will not make it easy for thieves to make us victims and will keep our valuable property protected that we all work so hard for. California Operation Lifesaver Raising Rail Safety Awareness to Save Lives

By Nancy Sheehan-McCulloch, CA Operation Lifesaver State Coordinator Distractions are a growing phenomenon in our busy everyday lives that can impact our safety. Unintentional deaths and Injuries have risen so dramatically, that in 2015 the National Safety Council added “distracted walking” to its annual report. Distractions near and along railroad rightsof-way are extremely dangerous. It is always important to stay alert whenever you are near railroad tracks. Walking on train tracks or crossing the tracks anywhere but at a designated public crossing is trespassing. It is illegal and it is dangerous. As Operation Lifesaver, Inc. indicates in one of their “Train of Thought” blogs; “After dropping from 2014 to 2015, rail-related trespass deaths and injuries appear to be rising substantially in 2016.” Not only is distracted walking increasing, but people are also taking risks by taking photos and videos on railroad tracks. This dangerous behavior can be deadly and it is not worth risking your life! Here are a few safety tips from Operation Lifesaver that can help you make safe decisions near railroad tracks. Remember: When you see railroad tracks, ALWAYS think train! Safety Tips and Facts • Freight trains don't travel at fixed times, and schedules for passenger trains change. Always expect a train at each highway-rail intersection. • All train tracks are private property. Never walk on tracks; it's illegal trespass and highly dangerous. By the time a locomotive engineer sees a trespasser or vehicle on the tracks it's too late. It takes the average freight train traveling at 55 mph more than a mile—the length of 18 football fields— to stop. Trains cannot stop quickly enough to avoid a collision. • Trains have the right of way 100% of the time over emergency vehicles, cars, the police and pedestrians. • A train can extend three feet or more beyond the steel rail, putting the safety zone for pedestrians well beyond the three-foot mark. If there are rails on the railroad ties always assume the track is in use, even if there are weeds or the track looks unused. • Trains can move in either direction at any time. Sometimes their cars are pushed by locomotives instead of being pulled, which is especially true in commuter and light rail passenger service. • Today's trains are quieter than ever, producing no telltale "clackety-clack." Any approaching train is always closer, moving faster, than you think. • Remember to cross train tracks only at designated pedestrian or roadway crossings, and obey all warning signs and signals posted there. • Stay alert around railroad tracks. No texting, headphones or other distractions that would prevent you from hearing an approaching train; never mix rails and recreation. Spring is in the Air... Weed Abatement is not Far Behind

Sand Replenishment Project at North Beach

Each spring the City of San Clemente initiates the Weed Abatement Program to help prevent fire hazards created by vegetative growth and the accumulation of combustible debris through voluntary compliance. Through this program, the City notifies undeveloped parcel property owners of their responsibility to remove weeds from their properties. Due to the native and naturalized landscape of San Clemente being susceptible to fire, it is very important to reduce this fire potential through the removal of weeds and debris.

This past December, the City of San Clemente conducted a sand replenishment project to replace sand where it has slowly been disappearing from erosion. Sand replenishment is the process by which sand is replaced from sources outside of the eroding beach. In this particular instance, the sand was free to the City. It originated from the Santa Ana River dredging project, and the City was responsible for paying the $626,000 cost to transport the 12,000 cubic yards of new sand to North Beach. The much needed sand here at North Beach will cover up the cobblestone rocks that have plagued the beach for years, making it difficult for beachgoers to enjoy. The new sand will improve the amount of towel space available, sand for children to play and enjoy the playground equipment.

In March of each year, the City Council of the City of San Clemente passes a Resolution declaring the need to abate weeds, rubbish, and refuse from undeveloped private parcels and vacant and unoccupied structured properties within the City. On or about April 1, the City’s Weed Abatement Contractor will mail notices to all owners of undeveloped parcels in San Clemente declaring the need for weed abatement. In May, the City Council is asked to pass a Resolution declaring that noxious or dangerous weeds on all undeveloped properties constitute a public nuisance which must be abated by the removal of the weeds, rubbish and refuse. If the property owner chooses not to remove the weeds, they will be removed by the City’s Weed Abatement Contractor and the cost of removal billed to the owner, including all the City’s administrative costs for such removal. If not paid, the amount will be assessed upon the land from which the weeds, rubbish, and refuse are removed and will constitute a lien on the property until paid. The notices refer to a parcel number(s) listed by the County Assessor’s office most recent tax roll. If the owner feels the property in question should not be included in the weed abatement program, the owner may contact the City’s Contractual Weed Abatement Administrator, Ed Stewart & Associates at (949) 498-9250, by mail at City of San Clemente Weed Abatement, 1000 Calle Negocio, San Clemente, CA 92673, or by email at ed@estewartinc.com. Owners will need to indicate the reason(s) why the property should not be included in the weed abatement program. Should an owner wish to clear their own lot of weeds, rubbish, and refuse, the lot must be cleared to City standards by May 15, 2017. Weeds must be cut no higher than one-inch (1”) from the ground and the property must be maintained in that manner for the remainder of the calendar year. All lots are inspected for compliance. The City has a coastal development permit that allows it to receive up to another 200,000 cubic yards of sand over the next two years. The sand has been placed up high on the beach for now, yet after the winter storm season, City crews will level out the new sand to increase the width of the beach by approximately 40 feet. Over time, some of the sand will make its way into the ocean, migrating to T-Street and Linda Lane, so it will be retained within the coastline. Update on FAA Oversight of Drones An unmanned aircraft system (UAS), sometimes called a drone, is an aircraft without a human pilot onboard – instead, the UAS is controlled by an operator on the ground. When you fly a drone it is your responsibility to understand and abide by the rules. There are two types of users: 1) recreational and 2) commercial. The Federal Aviation Administration (FAA) is the national authority with powers to regulate all airspace, including drones. They have established regulations for recreational drone use as well as for commercial drone use. These regulations are summarized below along with links to the appropriate FAA regulations for each category.

Safety Guidelines • Fly at or below 400 feet • Keep your UAS within sight • Never fly near other aircraft, especially near airports • Never fly over groups of people • Never fly over stadiums or sports events • Never fly near emergency response efforts such as fires • Never fly under the influence • Be aware of airspace requirements

Recreational Drone Use You don't need permission from the FAA to fly your UAS for fun or recreational use, but you must always fly safely. Before flying a drone for recreational use outside, the FAA

Commercial Drone Use For commercial use, below are the basic things an operator must know for flying under the small UAS rule (14 CFR part 107):

Pilot Requirements: • Must be at least 16 years old • Must pass an initial aeronautical knowledge test at an FAA-approved knowledge testing center • Must be vetted by the Transportation Safety Administration (TSA) A person who already holds a pilot certificate issued under 14 CFR part 61 and has successfully completed a flight review within the previous 24 months can complete a part 107 online training course at www.faasafety.gov to satisfy this requirement. Fun on the Run Mobile Recreation Celebrates 10 Years of Play In 2007, the City of San Clemente was challenged to meet the needs of a fast-changing community that sought out innovative programs that would better serve an underserved population. The concept quickly grew into a new park program called “Fun on the Run Mobile Recreation” (FOR). It would bring organized recreation activities to park sites across San Clemente, five days per week, for free. Presently, children can participate for a one-time fee of $5, with scholarships available. The mission to serve children of all ages and all backgrounds was well matched by the traveling truck that has become an icon at San Clemente parks. When children see the FOR truck pull down the street they know it’s only a matter of time before the whole neighborhood will be at the park playing sports and activities organized by City Recreation Leaders. As FOR expanded it was recognized at the state, national, and international level for its innovation in youth programming. In 2009, FOR received international recognition through the Learning Resources Network (LERN) International Award for Programming. One year later, FOR received statewide honors, earning a Governor’s Gold Medal and the esteemed title of Park Program of the Year by the California Governor's Council on Physical Fitness and Sports. In 2013, FOR accepted honors yet again by receiving the League of California Cities Helen Putnam Award for Excellence. Each of these incredible achievements were a result of FOR’s and its partners’ commitment to serve San Clemente’s youth through collaborative engagement. Today, the program is supported by a partnership with the Friends of San Clemente Beaches, Parks & Recreation Foundation, a Kaiser Permanente grant, and a Community Development Block Grant. These partnerships also include funding for “Swim & Learn”, a scholarshipbased swim lesson program held annually at the San Clemente Aquatics Center and managed through FOR. For a decade, Fun on the Run has provided children with a safe place to play, an encouraging place to grow, and a fun place to be a kid. Instructor Spotlight Jodi Powell: Special Fishies Jodi Powell, with Special Fishies started teaching with the City of San Clemente in the Winter of 2015. She has 20 years of experience in aquatics. As a high school student part of her community service on the swim team was to learn to teach children in the community to swim. She received a BA in Psychology specializing in children and adolescents and began getting her MFT. But teaching stuck with her and after college she lifeguarded and taught on and off before starting Little Fishies in Arizona in 2003. Having had a father who suffered from MS and then her own two spirited little boys her career shifted into the field of special needs. The universe kept putting these wonderful children

in her life. She opened herself up to learn from them and the result is an amazing and unique special needs swim program for all special needs children. Check out the learn to swim and aqua freedom classes in the Aquatics section to learn more about these classes and when they meet. Jodi loves meeting all the wonderful people on the deck hard at work, the community members swimming laps, the people all around working and helping one another and the beautiful pool and facility. She feels truly blessed to teach in such a wonderful atmosphere! For the very first time Little Fishies is now offering Spring Break and Summer Camps. YOUR RECREATION

Prerequisite: Swimmer must have the ability to swim one lap of freestyle and one lap of backstroke. Kayne’s Instructional Swim School (K.I.S.S.) is a non-competitive class that will concentrate on the fundamentals of freestyle and backstroke. The purpose of this class is to focus on stroke refinement and endurance, which will be introduced through various drills and exercises. Please bring a bathing cap and goggles to each class. Junior Lifeguard Program

SPRING 2017

The San Clemente Junior Lifeguard Program is an ocean and beach safety program for 9 to 17 year olds. New students must pass a swim test to be eligible. Students must register for one of the swim test dates below. Swim test fee is $5. No refunds and no walk-ins will be accepted. Students passing the swim test will be eligible to register for the Junior Lifeguard Program beginning April 26, subject to space availability.

Aqua Physical Therapy This is a beneficial form of therapy that is useful for a variety of medical conditions. Aquatic therapy uses the physical properties of water to assist in patient healing and exercise performance. While submerged in water, buoyancy assists in supporting the weight of the patient. This aspect of aquatic therapy is especially useful for patients with arthritis, healing fractured bones and other disabilities or for special needs participants. PHOTO/VIDEO RELEASE: I understand that at various times City representatives may photograph and/or video activities of City recreation programs, special events and participants. By signing this form, I authorize the City of San Clemente to use or publish any photographs/videos taken of me or my child/children to promote classes on the City’s website and other internet publicity, and/or in future publications of City brochures and/or flyers. RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT: The undersigned hereby releases the City of San Clemente and its officers, agents and employees from all liability to the undersigned (and from any minor participants for whom the undersigned has the capacity to contract), thereby releasing, indemnifying, and holding harmless the City of San Clemente, its officers, agents, and employees from all liability to the undersigned (and said minors) for any loss or damage on account of physical, mental and emotional injury to the undersigned (of said minors) caused by negligence of the City of San Clemente, its officers, agents and employees. The undersigned hereby assumes full responsibility for, and the risk of, physical, mental and emotional injury due to the negligence of the City of San Clemente, its officers, agents and employees. The undersigned recognizes for himself or herself, and any minors, that the events and occurrences to which this release applies can be dangerous and as a result of signing below, the undersigned is accepting those risks for himself or herself, and for any minor participants for whom the undersigned can contract. AUTHORIZATION TO PROVIDE MEDICAL TREATMENT FOR MINOR PARTICIPANTS: The undersigned, who is the parent or guardian of the above named individual, a minor, hereby authorized the City of San Clemente, into whose care the above named individual has been entrusted, to consent to any x-ray examination, anesthetic, medical or surgical diagnosis or treatment and hospital care to be rendered to said minor under the general or special supervision and upon the advice of a physician and surgeon licensed under the provisions of the Medical Practice Act, or to consent to an x-ray examination, anesthetic, dental or surgical diagnosis or treatment and hospital care to be rendered to said minor by dentist licensed under the provisions of the Dental Practice Act. The undersigned furthermore authorized the City of San Clemente to transport or make arrangements for transport as may be required for the administration of health care consented to in the above program. REFUND POLICY: To drop a class, complete a Refund Request Form. If notification is received before the second class meeting date, a refund in the form of a check or left on the City account (minus an $8 withdrawal fee) will be processed. No refunds after the second class meeting.
