Tennessee’s 114th General Assembly
Legislative Shifts, Housing Policy, and the Future of Multifamily Advocacy
The 114th General Assembly gaveled in for the first of two legislative sessions on Tuesday, January 14, 2025. The first week of session was spent performing a series of procedural steps outlined in the state constitution and state law in order to officially convene.
Once the new lawmakers were sworn in and officially began their tenure, each chamber of the legislature must elect leadership, assigned committees, and confirmed the state’s Constitutional Officers. These officers include the Secretary of State, the State Treasurer, and the Comptroller of the Treasury.
Additionally, each the bodies voted on the rules to establish the parliamentary procedure for how the lawmakers will conduct business during the session. These rules govern how lawmakers conduct official business, including how they introduce motions, cast votes, speak on the floor of each chamber, the conduct of each lawmaker, and the timing of filing bills and amendments of bills.
Upon conclusion of the legislature’s organizational session, the Governor called for a special session to address to address school choice legislation, disaster relief for Hurricane
Helene, and a framework for immigration enforcement in anticipation of federal policy changes enacted by the Trump Administration.
During this four-day special session, the legislature considered and passed,

among other things, the cornerstone of Governor Lee’s education policy agenda, the Education Freedom Act, legislation which establishes a statewide school voucher program and provides additional funding for teacher bonuses and K-12 facilities.
Once the special session adjourned, the legislature returned to its customary business with bill filing deadline for both the House and the Senate being February 6. Each House member is limited to twelve bills (down from the previous fifteen bill limit) with the exception of subcommittee and committee chairmen who can file additional bills relative to their committee’s subject matter. The Senate does not have a bill filing limitation. This year, just over 1,400 pieces of legislation have been filed for consideration. This is roughly a twelve percent decrease in the number of bills filed from previous years.
On February 10, Governor Lee presented his seventh annual State of the State address Monday evening before a joint session of the 114th General Assembly at the Tennessee State Capitol, outlining his $59.5 billion proposed budget and legislative agenda for FY25-26. While the Lee administration passed several major initiatives during January’s special session, including a state wide school choice scholarship program and immigration reform,
the governor’s remaining policy platform centers on home grown innovation in the energy sector, affordable housing (singlefamily), economic and workforce development opportunities, child care solutions, public education investment, government efficiency, public safety support, enhanced transportation funding, and conservation.
While Tennessee Apartment Association leadership opted not to initiate legislation this year, there are a number of bills of interest to the multifamily industry filed for consideration. Key landlord-tenant legislative policy issues that we will monitor and influence include: rent control, security deposit regulations, eviction procedures, maintenance responsibilities, fair housing compliance, late fee limits, notice requirements for rent increases, tenant screening criteria, and the right to repair and deduct for landlord neglect; all of which aim to balance the rights of landlords to manage their property with the rights of tenants to live in safe and habitable housing.
The Tennessee Apartment Association remains the premier resource and advocacy organization for the multifamily industry. TNAA coordinates support for or opposition to legislation that affects rental housing while enhancing business opportunities for all Tennessee members and associates.
FHFA Pauses Federal Landlord-Tenant Requirements
The Federal Housing Finance Agency (FHFA) has issued a three-month pause on its directive imposing three new federally mandated landlord and tenant requirements on covered multifamily properties financed through Fannie Mae and Freddie Mac (the Enterprises). FHFA has instructed the Enterprises to delay implementation until at least May 31, 2025. Given the imminent effective date of this directive, February 28, 2025, FHFA’s announcement is a win for the industry.
This directive would have been applicable to rental properties with new loans through the Enterprises that are signed on or after the effective date, and covered housing providers would be required to provide their residents with a 30-day notice for rent increases; 30-day notice for lease expirations; and five-day grace period for late fees.
According to the policy grids issued by Fannie Mae and Freddie Mac, housing providers would have to notify their residents of the new protections and change all residential leases at these communities to include the new standards. National Apartment Association (NAA) Click & Lease users can expect to receive a broadcast announcing the retraction of the new FHFA Amendment to Lease Contract that was released on February 12, 2025.
In its comment letter to the Agency, NAA and its coalition partners argued that required leasing compliance with this mandate does not serve the public interest. Required changes to millions of leases are unnecessary, given the layers of state and local requirements with which housing providers already comply. These laws and regulations already provide renters with robust protections.
Moreover, NAA strongly urged FHFA to reevaluate this directive through the lens of President Trump’s executive orders and memoranda. More time is needed for the Trump Administration to evaluate whether these Biden-era policies align with Presidential priorities.
FHFA continues to pursue a measured and deliberative approach to policymaking which carefully considers stakeholder input, including comments from more than 3,000 NAA members and affiliates who joined NAA’s call to action when the Agency considered rent control. NAA will keep the industry abreast of new developments and continue its advocacy with federal policymakers to promote responsible and sustainable solutions to address renter’s housing affordability challenges and increase access to quality, affordable housing options. 6. Allow Flexible Payment Options for Gig Economy Workers
Proposed EV accessibility rule burdens providers, residents
On September 4, 2024, the federal Architectural and Transportation Barriers Compliance Board (ATBCB) published a notice of proposed rulemaking to address the accessibility of electric vehicle (EV) charging stations for people with disabilities. While the proposed rule remains in limbo due to the Trump Administration’s regulatory freeze, the National Apartment Association (NAA) continues to track its progress and evaluate the need to engage federal policymakers on our concerns. If finalized, this rule could place significant compliance burdens on housing providers.

The proposed rule would mandate potentially significant changes to EV charging stations in new and existing rental housing covered by the Americans with Disabilities Act. It aims to ensure that EV charging stations are accessible to and usable for people with disabilities by setting enforceable standards for size, placement, number of accessible spots and more. Practically speaking, this could mean retrofits to EV chargers, EV charging spaces and potentially substantial changes to parking areas or structures, all of which are covered by ATBCB’s proposal. Significant
industry concerns include: the required size and clearance of EV charging spaces, required accessible route requirements and new slope standards.
What’s Next
Ultimately, the proposed rule imposes significant financial and logistical challenges for housing providers in ways that make them less able to meet their residents’ needs and demands for community amenities such as EV charging. Any new federal mandates must conform with existing fair housing accessibility and building code requirements to prevent duplicative or conflicting responsibilities for providers and to reduce potential for increased legal liability for compliance errors. The rental housing industry takes its fair housing responsibilities very seriously. At the same time, NAA and its members remain acutely aware of the costs of overregulation to rental communities.
NAA continues its federal advocacy efforts with Congress and the Administration to promote responsible and sustainable housing policies.
