MSMS/SCMS Represents All Physicians in All Specialties Whether Solo, Group or Employed HOSPITAL EMPLOYED PHYSICIANS – WHY JOIN MSMS AND THE SCMS? We are often asked by hospital-employed physicians what benefit there is to joining MSMS/ SCMS. If you read MSMS policies below, this should answer it. If physicians need help in their hospital on any of these, MSMS/SCMS can try to involve itself as best it can. Ultimately, MSMS/SCMS best represents ALL physicians… including hospital-employed physicians.

Hospital Boards

Amending Medical Staff Bylaws MSMS will assist medical staffs by providing legal help and support, if determined appropriate by the MSMS Board of Directors, when a hospital board of directors unilaterally changes the medical staff bylaws. (Res27-94A)

Physician Representation on Hospital Boards of Trustees MSMS supports the principle that all physicians seated on hospital boards of trustees be elected to their position by the hospital medical staff members. (Res51-06A)

Physician Representation on Hospital Governing Boards MSMS encourages all physicians to participate on their hospital governing boards and/or boards of trustees, and recommends in addition that elected chiefs of staff be voting members of their hospital governing boards.

Hospital-Physician Relations

Arbitrary Denial or Termination of Medical Staff Privileges MSMS recognizes hospital medical staff bylaws as a contract that affords due process to all members of the medical staff. (Res14-95A)

Consolidation of Medical Staff and Departments MSMS supports the concept that consolidation of medical staff and departments and associated bylaws and departmental policies and

procedures must require the approval of all medical staffs and/or departments so involved. (Res15-95A)

Guidelines – Applications for Hospital Medical Staff Privileges MSMS endorses the Guidelines on Applications for Hospital Medical Staff Privileges. (Prior to 1990)

Guidelines for Medical Staff Funds 1. Participation in such funds shall be voluntary.

2. Control of the use of medical staff funds shall be limited to the physicians who have contributed to the fund.

3. The constitution, bylaws or other governing rules of the fund shall provide that all elections and votes on major decisions by the membership shall be by secret written ballot.

Guidelines for Physician-Hospital Relations 1. Hospital-employed physicians should be included as members of the medical staff and should be subject to its bylaws, rules and regulations.

2. The medical staff should include proper safeguards in all appropriate sections of the medical staff bylaws, rules and regulations to make certain that they apply to all physicians serving on the medical staff, including those employed by the hospital.

3. While medical staff bylaws must be approved by the governing board and, for this reason, are considered to be binding on the governing board, it would appear desirable to include a provision in any contracts with physicians, as well as, in the medical staff bylaws, to assure the desired result. The following is suggested: “In accordance with and subject to the procedures of the organized medical staff, Doctor _______ is granted and accepts appointment as a member of the medical staff.

This Agreement shall terminate automatically if the staff privileges of Doctor ______are revoked upon recommendation of the organized medical staff.”

4. If there is no organized democratic departmental structure which allows for

communication and input, the medical staff should establish an advisory committee to counsel and assist the administrator in carrying out his or her responsibilities.

5. Where the employment of a full-time physician to carry out departmental administrative and operational functions is being considered, it is recommended that consideration be given to employing this physician as an administrative assistant to the elected chief with the delegated functions appropriately spelled out in the medical staff or departmental bylaws.

6. Medical staffs in all types of non-federal hospitals should be alert to the potential dangers of governing board dominance over the executive committee and the need for careful bylaw structuring of the executive committee to prevent this.

7. The American Medical Association (AMA) should firmly oppose the specific proposals of the American College of Hospital Administrators and the Catholic Hospital Association concerning medical staff structure and medical staff-administratorboard relationships. (Note: The Board has only with those specific sections of the documents.)

8. It is emphasized that medical staffs should take a firm stand against governing board control of medical staff activities related to patient care.

9. State and local medical societies are urged to supplement AMA’s effort to assist and offer support to hospital medical staffs involved in negotiations with governing boards and administrations. (Prior to 1990)

Hospital Admissions by Allied Health Professionals Only physicians and surgeons with staff privileges may admit patients. Allied health professional services may be available, within limits of skill and law, only under direction and supervision of a member of the medical staff qualified in that field. Such services are to be under direction of the department or section responsible for that type of service.

Hospital Medical Staff Credentialing of Physicians who Provide Electronic and Other Telemedicine Services for Hospital Patients MSMS supports the requirement of physicians

who provide diagnostic or therapeutic services on a regular, ongoing or contractual basis via electronic or other communications to patients in a hospital setting within Michigan to be fully credentialed by that hospital’s medical staff in accordance with the medical staff bylaws.

MSMS supports the requirement of physicians who provide diagnostic or therapeutic services on a regular, ongoing or contractual basis to patients in a hospital setting within Michigan solely via electronic or other distant communications (and so would not otherwise ever have any direct personal interaction with the remainder of the medical staff ) be credentialed as active members of that hospital’s medical staff, and be held to the same standards of requisite responsibilities as other active members of the medical staff.

Medical Doctors and Department Heads of Hospital Staffs It is inappropriate for hospital medical departments in acute care general hospitals to be chaired by persons other than licensed physicians or, when appropriate, dentists.

Medical Staff Reappointment Reappointment of doctors to the active medical staff should not be denied except for medical ineptitude, character deficiency or conviction of unethical conduct, revocation of license by the state or violation of the hospital medical staff bylaws that have been approved by the medical staff. (Prior to 1990)

Medical Staff Self-Rule

All hospital medical staffs should have the right to formulate and implement their constitution, bylaws, rules and regulations with the understanding that they are subject to the hospital corporate body. (Prior to 1990) – Edited 1998

National Practitioner Data Bank MSMS supports repeal of the National Practitioner Data Bank. (Res7-90A) – Amended 1993 – Edited 1998

Oppose Mandatory “Hospitalist” Care MSMS opposes mandatory requirements that a patient’s physician turn over inpatient care to “hospitalists.” (Res15-99A)

Physician Rights Regarding PerformanceBased Reporting MSMS supports a physician’s right to prompt notification, review and comment regarding any complaint made to a hospital pertaining to the physician’s professional behavior; that a physician shall be given an adequate opportunity to provide written comment in response to the specific complaint; and that a physician’s comments shall be included adjacent to the specific complaint in any hospital generated report. MSMS supports a fair process of physician collaboration in the development of professional behavior programs or reporting by hospitals. (Res7-14)

Qualifications for Chief of Medical Staff MSMS encourages medical staffs to include in their bylaws a provision that all physicians be eligible for election to chief of staff unless the physicians serve in a major medical administrative position at the hospital.

Required Physical Exams of Physicians by Hospitals MSMS opposes hospital medical staff policy that mandates all physicians of a particular age undergo physical and neuropsychological exams in order to remain on staff. (Res16-12)

We represent physicians in all specialties and in all types of practices – solo, group, employed, etc. Active membership is open to MDs and DOs. • Active physician dues are $795 per year ($495/ MSMS and $300/SCMS). One hundred percent of SCMS dues and 87 percent of MSMS dues are tax deductible as a business expense.

• The SCMS offers a 50 percent discount for first year physicians.

• MSMS offers 75, 50 and 25 percent discounts for first through third year physicians, respectively, and discounts the second membership 50 percent when physician spouses are both members.

SCMS Efforts on Suicide Awareness Training Directly Result in New AMA Policy To combat the growing suicide epidemic in this country, and as a direct result of SCMS efforts starting at the MSMS House of Delegates in April 2018, the AMA adopted a new policy to increase awareness and physician training on suicide at their Annual Meeting in Chicago in June 2018.

What We Offer SCMS Members and Their Staff: • Five Membership Meetings per year where our members have an opportunity to network and enjoy the camaraderie of fellow physicians in a neutral setting. Meetings include interesting speakers and an opportunity to earn FREE CME credit.

• Liaison with MSMS for assistance on practice issues, billing and coding, health information technology, legal alerts, legislative issues, insurance and much more.

• An independent voice for physicians on issues they face at the hospitals.

• The Bulletin is printed and distributed nine months per year via mail and email with articles and information pertinent to SCMS members and their staff.

• Pictorial Membership Directory is published annually and used by members and their staff on a regular basis. Our Private Directory provides information on your practice to other member physicians outside your specialty.

MEDICAL STUDENT LOAN APPLICATIONS Do you know of a medical student (with ties to the Saginaw area) in need of a loan?

The SCMS Foundation may be able to help. The Foundation was formed in 1968 and originally funded through physician donation of earnings from educational and charity work. The Annual Golf Outing and donations now fund the Foundation which makes low interest loans to medical students with ties to the Saginaw area. The intent is to encourage physicians to return to Saginaw County to practice medicine.

The terms of these loans are generous. No interest is charged while the student is in medical school, simple interest is charged at a rate of four percent per annum during a residency program, and interest is charged at a rate of eight percent per annum upon the completion of a residency program.

As of 2012, the Foundation Board voted to forgive all interest if the student returns to Saginaw upon completion of a residency to practice. Additionally, the Board voted in May 2016 to start a loan forgiveness program. If the loan recipient returns to Saginaw to practice upon completion of their residency and they are a dues paying member of the SCMS/MSMS, 25 percent of the principal balance will be forgiven at the end of each year they are practicing in Saginaw County, with a maximum of $5,000 per year forgiven.

The Foundation Board generally considers students who are past their first year of medical school, and among other things, according to: • Strength of connection to Saginaw • Financial need • Scholastic performance • Community service/extracurricular activities The intent of the Foundation loans are to assist and encourage students to return to Saginaw to practice medicine.

If you know of a medical student in need (with an interest in the Saginaw area), please encourage him or her to apply.

NURSING SCHOLARSHIP APPLICATIONS The SCMS Alliance and SCMS Foundation provide $500 nursing scholarships to Saginaw County residents. Over the years, we have awarded many scholarships to help students continue their nursing education.

Requirements for consideration: • Must be a permanent resident of Saginaw County; AND • Currently enrolled in a nursing program or beginning nursing clinical core courses for award year; AND • Overall college GPA no lower than 2.79.

Application packet MUST be complete for consideration. Incomplete applications will be denied. All applications must include a one page essay describing your nursing career goals and how this scholarship would help you financially in completing your nursing degree.

Two letters of recommendation from past or current professors must be included.

NOTE: Prior award recipients must complete a new application packet with new letters of recommendation.

This scholarship is not for graduating high school seniors.

MEDICAL RECORDS

The SCMS does not, and never has, had possession of any patient medical records.

If a physician was a member of the SCMS and is either retired or no longer practicing in Saginaw, we may know where the records are located. Generally, if a patient is looking for records from a specialist, we advise them to check with their primary care physician if the specialist is no longer practicing.

Minimum Required Retention Period Unless a longer retention period is otherwise required under federal or state laws or regulations or by generally accepted standards of medical practice, a licensee (physician/health care provider) is required to keep and retain each record for a minimum of seven (7) years from the date of service to which the record pertains.

Destruction of Medical Records Less than Seven (7) Years Old A licensee may destroy a record that is less than seven (7) years old only if both of the following are satisfied: a. The licensee sends a written notice to the patient at the last known address of that patient informing the patient that the record is about to be destroyed, offering the patient the opportunity to request a copy of that record, and requesting the patient's written authorization to destroy the record. b. The licensee receives written authorization from the patient or his or her authorized representative agreeing to the destruction of the record.

Fees Pursuant to the Michigan Medical Records Access Act, licensees may charge a fee for the records.

For 2019, the maximum charges are: o An initial fee of $25.06 per request for a copy of the records o $1.25 per page for the first 20 pages o $.63 per page for pages 21-50 o $.25 per page for pages 51+ If you are looking for medical records from the last seven years, please feel free to contact us at (989) 790-3590. Again, no matter what you may have been told by a physician, hospital, etc., the SCMS does not, and never has, had possession of any patient medical records.

Who sets MSMS policy? You Do! The Michigan State Medical Society (MSMS) House of Delegates (HOD), comprised of 319 elected delegates, is the official legislative and policy-making body of MSMS and its component societies, including the Saginaw County Medical Society (SCMS).

Resolutions debated during the annual MSMS HOD are the vehicles by which MSMS policies, priorities and directives are determined. Deadline for resolutions is March 1 at 5 p.m. Resolutions must be submitted via the online submission form. If you have any questions, contact Stacey Hettiger at (517) 336-5766.

The best way to get your idea or recommendation adopted as MSMS policy or directive is at the grassroots level. As a member in good standing of MSMS/SCMS, you have the right to bring your ideas to the annual HOD for consideration by MSMS’ "legislators." To do so, present your suggestion and rationale at the SCMS meeting. If the SCMS agrees, the SCMS will work with you to draft a resolution to be presented at the next HOD meeting. The resolution should specify the desired MSMS policy or directive for MSMS action. If the SCMS does not agree with your idea, you may ask another delegate

to submit a resolution on your behalf as an individual delegate.

It is also prudent to check MSMS’ current Policy Manual and, if relevant, the AMA Policy Finder to determine if policy on the issue already exists.

Caduceus Meeting for Recovering Health Care Professionals Third Thursday of each month at 7 p.m.

Caduceus meetings are available to health care industry professionals, and have adopted many of the principles of 12-Step programs.

Caduceus meetings are “closed” meetings for recovering health care professionals including, but not limited to, nurses, doctors, dentists and pharmacists.

We engage in group discussions where members may want to speak up, ask questions or share thoughts with fellow members.
