Upcoming Events

As we move into the summer months, I would like to remind you of a few of SAMCAR’s upcoming events. On Monday, July 20th, SAMCAR will hold its charity golf tournament at Peninsula Golf & Country Club. Hole sponsorships and foursomes are still available, so mark your calendar and come on out for a good cause! On Thursday, August 6th, SAMCAR will hold its Member Appreciation Barbecue and Softball Game at Central Park in San Mateo. I hope that you are able to join us for this great event. Then, on Thursday, September 17th, SAMCAR will be holding its annual Spaghetti Feed. Board of Directors Election

As we move into mid-year, it is also time to start planning for 2010, and specifically, the SAMCAR Board of Directors election.

SAMCAR has a number of vacant positions coming up on the Board of Directors – all of which are at-large positions – and is looking for REALTOR® members to contribute their expertise. I strongly encourage you to consider submitting an application. The deadline to submit an application is Friday, July17th, 2009. The prerequisite to be considered as a SAMCAR Director is to have served a minimum of one (1) year on a minimum of one (1) SAMCAR committee within the last five years.

I hope that you might consider yourself, or consider encouraging a colleague who you may think would be a good fit for the Association.

What’s in it for me?

I

Claire Earley asked me to run for director of SAMCAR. It was 2004 and I was busy running my real estate business and honestly, I had never really given any thought to the SAMCAR involvement, let alone running for a director seat.

But people who really know me know that I’m always ready for new experiences, and I said yes without knowing what a priceless opportunity it was. remember when

I saw it as an opportunity to learn something new, but when I got involved I realized it was more about making a contribution. I was told, “Attend a few board meetings” or “It’s a chance to travel” and “It’s an opportunity to meet new people.” Well, it’s certainly that and a whole lot more. Here are some of the things I have gotten out of the experience to date: Personal growth: Public speaking was one of my greatest fears especially since English is my second language. I am now happy to say that I have comfortably addressed gatherings of over 300 people, run the monthly combined tour meeting, and lead the board of directors’ meetings.

Friendship: I have deepened friendships and made new friends and acquaintances all around the state and nationally.

Greater Sense of Appreciation: Over the last few years I have had the chance to learn about and appreciate the structure of SAMCAR, local level, regional level, state level and national level. I’ve also discovered why we have a powerful real estate voice in the nation.

You and I can be part of the voice.

Leadership: Running for the board and for President has allowed me to learn about the importance of leadership qualities.

Communication skills: I can honestly say I never stop learning how to work with people to try to bring out the best in them and build consensus.

If you are remotely interested in running for the 2010 directorship of SAMCAR, you are ready. Fill out the application today. You are in for a memorable and fun journey. If I can do it, so can you.

DRE Regulation in Effect July 1

DRE Number On All Points of Contact Section 2773.

Disclosure of License Identification Number on Solicitation Materials First Point of Contact with Consumers.

F

ollowing please find the relevant text for the DRE regulation that requires the disclosure of your DRE license number on all solicitation materials used as the first point of contact with consumers. DRAFT regulations will be in effect July 1, 2009, as the final regulations have not yet been approved.

Please note:

It is advised that you include “DRE License Number” or “DRE #” before listing the number.

(a) A real estate broker or salesperson, when engaging in acts for which a license is required, shall disclose its, his or her real estate license identification number on all solicitation materials intended to be the first point of contact with consumers. If the name of more than one licensee appears in the solicitation, the license identification number of each licensee shall be disclosed.

Solicitation materials intended to be the first point of contact with consumers, and in which a licensee must disclose a license identification number, include the following: (1) Business cards; (2) Stationery; (3) Websites owned, controlled, and/or maintained by the soliciting real estate licensee; and (4) Promotional and advertising fliers, brochures, email and regular mail, leaflets, and any marketing or promotional materials designed to solicit the creation of a professional relationship between the licensee and a consumer, or which is intended to incentivize, induce or entice a consumer to contact the licensee about any service for which a license is required. The type size of the license identification number shall be no smaller than the smallest size type used in the solicitation material. (b) For the purposes of Business and Professions Code Section 10140.6, solicitation materials do not include the following: (1) Advertisements in electronic media (including, without limitation, radio, cinema and television ads, and the opening section of streaming video and audio); (2) Print advertising in any newspaper or periodical; and (3) “For Sale” signs placed on or around a property intended to alert the public the property is available for lease, purchase or trade.

San Mateo County

Midcoast LCP Update The County has been in the process of updating its Local Coastal Plan (LCP) which governs land use and development polices for the unincorporated areas in the Midcoast. A couple of years ago, the County sent its final proposed amendments to the California Coastal Commission (CCC) for review and approval. In response, the CCC staff issued a 300+ page document that virtually eliminated or substantially changed the County’s proposal. The CCC staff recommendations were of major concern, as they included a prohibition of private wells, a reduction of the annual growth rate limit, traffic mitigation and capacity studies as a precursor for development, to name a few.

SAMCAR attended the public hearing held on Tuesday, June 16th, at which time County staff outlined its response to the CCC proposals. Thankfully, the staff recommended rejecting most of the proposals, including the key items mentioned above.

The Board of Supervisors will determine whether to accept those recommendations at the next public hearing on July 7th.

SAMCAR gave public comment in support of the County staff recommendations.

In terms of next steps, the County and the CCC staff will meet in August to hash out details. Should the County and CCC fail to agree, a possible action is for the County to pull the proposed amendments, as this was a voluntary update.

A special kudos is due to SAMCAR members on the Coast. This group has been extremely involved in this process since its inception, and extremely helpful throughout this years’ long process.

n Wednesday, June 3, 2009, SAMCAR REALTORS®, Affiliates and senior staff traveled to the California State Capital in Sacramento to participate in our annual Legislative Day. Attendees participated in several meetings with state legislators or their representatives including Assemblyman Jerry Hill, Assemblyman Ira Ruskin, Senator Leland Yee and Senator Joe Simitian to discuss issues of importance to the real estate industry.

Code of Conduct (hvcc)

T

his new regulation has created a significant amount of discontent in the real estate community. Per the HVCC, Appraisal Management Companies (AMCs) can order independent appraisals. The fee that would normally go to an appraiser now gets divided among both the AMC and the Appraiser, which adds a layer of complexity to the process.

More importantly, the concern about the new process created by the HVCC is that these appraisers are not local, and often unfamiliar with the unique qualities and characteristics of the neighborhoods where the homes are located. The result is the reporting of a value not consistent with other homes sold in that same area.

On June 29th, Representatives Childers (D-MS) and Miller (R-CA) introduced H.R. 3044 calling for an 18 month moratorium on the HVCC. We will keep you informed as this bill makes its way through Congress.

Sp tlight Q Can you give us a little background- Where were you born? Where do you live now and how long have you lived here?

Virginia Maddan: I was born in San Francisco and never left! My husband and I bought a house last October just a few miles from my childhood home.

Q Tell us about your family, hobbies, education VM: My favorite hobbies are baking, reading and traveling. Luckily, my husband shares my love of traveling and we have been on many trips together. Our furthest destination was Bali and this year we’re planning on taking another trip (although something a little closer).

Virginia Maddan, CORT Q What organizations, affiliations are you a part of and /or what designations do you hold?

VM: I recently joined SAMCAR and am glad that I did. Everyone has been warm and welcoming. Since joining the SAMCAR affiliate group, I’ve enjoyed getting more involved with the affiliates and REALTORS®.

Cort recently held the first affiliate mixer at our showroom in San Mateo and Deayn Boger (another Cort employee who’s a member of SAMCAR) and I were happy to have everyone.

In my industry, we also work closely with apartment communities, so I’m also a member of the California Apartment Association.

rust is the foundation of the relationship between REALTOR® and Affiliate, and this relationship is the livelihood of SAMCAR. As a REALTOR® member, you strive and work toward a common goal of success with a TEAM. A team, of professionals that works towards closing a deal or influencing policy so that we can work together to strengthen the real estate industry. SAMCAR Foundation Grants $19,000 to Support Local Charities The San Mateo County Association of REALTORS® Foundation provided $19,000 in funding to four local non-profit organizations: • Shelter Network received $10,000 to support the Shelter Network Annual Breakfast.

• The Society of St. Vincent de Paul received $5,000 to support the SVdP’s Peninsula Family Resource Center.

• The Daly City Youth Health Center received $2500.

• The Peninsula Library System received $1500 to support its Fall reading program; “One Book, One Community: San Mateo County Reads”.

MLSListings Matrix® Continues to Meet Enthusiastic Response The soft launch of MLSListings Matrix® continues to be successful, with office managers requesting demonstrations and agents signing up for the training. In many offices, multiple classes are being taught simultaneously. In addition to on-site training in various locations, MLSListings, Inc. also offers webinars and soon will have Matrix® tutorials and an MLS Minute video. The Realist statewide tax offering that is bundled with Matrix® is a powerful tool and has proven to be a major draw. The Matrix® client relationship management tools and advanced CMA features are provided at no additional charge to subscribers, enabling subscribers to drop some third party services.

Arton said he sees that banks want to see the seller provide the bank with $5,000−$10,000 to close the deal and avoid the short sale from slipping into foreclosure.

t both the Central Tour meeting and the North Tour meeting, the vexing issue of short sales has been a hot topic. Arton Chau, Milestone Mortgage, speaker at the June 9th Central Tour meeting, stated that the main obstacle of closing a short sale seems to be waiting for the banks to negotiate with each other on settling the first and second mortgages on the home. In many cases, if a buyer agrees to a higher sales price or will help pay the second mortgage, the bank with the first mortgage will not accept the terms and argues the

Get Educated About Short Sales NAR has set up a webpage on short sales. REALTORS® who are new to short sales can learn the basics and watch webinars to increase their knowledge. The site includes information about NAR’s advocacy efforts to improve the process, getting a short sale to closing, and informing buyers and sellers about the process. There is also information on the upcoming Obama Administration short sales program, which will be part of the Making Home Affordable Program. The Treasury Department is targeting the end of July for issuing guidance and uniform forms and for signing up servicers to participate in the new initiative.

Rick Whipple, Prudential California Realty in Daly City was the center of attention at the North Tour on June 16th when he discussed the fact that he interviews the seller’s agent of a short sale before bringing his buyer into the deal. He stated that many buyers waste their time and that of their agents when the short sale property has not been vetted for problems beforehand. Rick developed a “Seller’s Agent Interview” questionnaire that he very kindly gave to me to share with you. Here is a list of some of the questions that you should ask the listing agent long before bringing in an offer:

1. What is the seller’s hardship?

2. Does the seller have a monthly income shortfall?

3. Have you reviewed the seller’s financials?

4. What stage of foreclosure is the seller/property in? NOD/Auction date set?

5. How long has the property been listed?

6. Who is (are) the lender(s)?

7. Have you verified the parties on the mortgage and deed?

8. How many offers will you be submitting to the lender?

9. Have you submitted any offers to the lender? If you accept my offer, will you then stop submitting offers to the lender? Is that your policy?

Rick also asks the listing agent what is included in the short sale packet and it must include the same type of information that the bank receives to get a clear picture of what the facts are on the seller and why they are in a short sale.
