Inquest set in death of Richmond Hill man

Observatory ash trees under threat to ash borer: OMB witness The tenth day of the observatory Ontario Municipal Board hearing Thursday ended with the credibility of a witness being questioned, after the Richmond Hill Naturalists dredged up a past lawsuit. In cross-examining water resources engineer Robert Bishop, retained by Corsica, civil action involving the City of Ottawa brought by residents of a flooded neighbourhood was presented by Naturalists lawyer Virginia MacLean. Ms MacLean presented “court facts” stating that Mr. Bishop’s report of a 1996 neighbourhood flood was based on outdated information, leading to that neighbourhood flooding again in 2002. Mr. Bishop responded by saying the city in this case didn’t use his information properly, regarding that flood prone area. There was a settlement in this case, but neither the quality of Mr. Bishop’s work nor his report were the reason for civil action, pointed out Corsica lawyer David Bronskill, who objected to Ms MacLean “incorrectly characterizing information she had brought before the board”. The settlement regarding the civil action in Ottawa, which Mr. Bishop admittedly said he knew very little about, was in reference to costs associated with expert witness reports from the firm he formerly worked for. Much of Mr. Bishop’s observatory testimony and cross-examination this week centred on stormwater management and potential flooding in and around the property.

A coroner’s inquest will be held into the death of a man inside a Penetanguishene psychiatric facility this fall. Kulmiye Aganeh, who has family in Richmond Hill, died March 14, 2009 at the Waypoint Centre for Mental Health Care, where he was transferred after being found not criminally responsible for stealing a car. Mr. Aganeh, 22, who struggled with mental illness and was hallucinating during the non-violent car theft, was charged with several offences. During a 2009 news conference at the Afro-Canadian Bazaar in Toronto, members of Mr. Aganeh’s family said they believe after a scuffle with hospital attendants, he was given an injection before he collapsed and died. Family members said his death was suspicious. A hospital spokesperson said no indication of wrong-doing was found in the incident. The inquest will begin Oct. 2 at the Simcoe County council chambers, 1110 Hwy. 26 in Midhurst. Dr. David Evans will preside over the inquest, which will delve into the events surrounding Mr. Aganeh’s death. An inquest jury can make recommendations aimed at preventing similar deaths. The inquest is expected to call 35 witnesses and last about four weeks.
