We are all familiar with the value of alliances. There are military alliances, political alliances, business alliances, and a host of others. At Rental Housing Alliance Oregon, we connect small landlords, large landlords, property managers, and the trades that serve these constituencies. Are you taking full advantage of this alliance?

The way in which individuals and organizations build and maintain alliances have changed dramatically over the past few years. In addition to face-to-face events, we now network through Facebook, LinkedIn and Instagram. We use Nextdoor to find a babysitter or report crimes in our neighborhoods. At RHA Oregon, the Marketing Committee is expanding our use of social media in order to improve the way we communicate with our members as well as the broader community. A primary goal of these efforts is to make it easier for affiliate and dual members to place their products and services in front of our landlords, and to make it easier for landlords to find reputable providers who are familiar with the rental property market.

We know this is no simple task. Information overload is widespread. There are dozens of resources on the internet available to landlords ranging from Angie’s List and HomeAdvisor to BiggerPockets and Rehab Valuator, to name a few. As more of us have shifted to the internet to find information, contractors, or suppliers, paid advertising in RHA Oregon’s UPDATE magazine has fallen markedly, while printing and mailing costs have increased. We recognize that we need to update the UPDATE. Towards that end, effective immediately, RHA Oregon will be publishing only a limited number of UPDATE magazines each month. These will be used primarily for distribution to new members as part of their welcome package; there will also be a few copies available at our office. Even though we will no longer be mailing out the hard copy of theUPDATE, we will continue publishing a digital version. We are also evaluating printing a pocket directory of affiliate and dual members.

IRS Revenue procedure regarding Section 199A, how it affects you and how you calculate your taxes By Cliff Hockley with Bluestone & Hockley Real Estate Services

Once again IRS revenue procedures have been updated. In this case, the changes relate to businesses. These savings may be garnered with an additional deduction of up to 20% of the taxpayers qualified business income, for non-corporate taxpayers, operating through partnerships, S corporations or sole proprietorships. This change is significant, and I urge you to reach out to your tax advisor to strategize the best course for you and your investments. Section 199A was enacted on December 22, 2017, and was amended on March 23, 2018, retroactively to January 1, 2018, by the Consolidated Appropriations Act, 2018, Pub. L. No. 115-141. The Treasury Department and the IRS wanted to clarify the rules and prepared a document* to explain the Section 199A deductions. This article below aims to explain the rules as written. Rules of Application Safe harbor. Solely for the purposes of section 199A, a rental real estate enterprise will be treated as a trade or business if the following requirements are satisfied during the taxable year with respect to the rental real estate enterprise: 1. Solely for purposes of this safe harbor, a rental real estate enterprise is defined as an interest in real property held to produce rents and may consist of an interest in multiple properties. 2. The individual or relevant pass through entity (RPE) relying on this revenue procedure must hold the interest directly or through an entity disregarded (such as an LLC) as an entity separate from its owner under ยง 301.7701-3. 3. Taxpayers must either treat each property held, for the production of rents, as a separate enterprise or treat all similar properties held for the production of rents as a single enterprise (i.e. owned by the same LLC). 4. Commercial and residential real estate may not be part of the same enterprise. (There is a question regarding the treatment of mixed-use buildings under this ruling, that has not been resolved yet) www.rhaoregon.org

5. Note: Taxpayers may not vary this treatment from year-to-year unless there has been a significant change in facts and circumstances. 6. This includes a deduction of up to 20 percent of aggregate real estate investment trust (REIT) dividends and qualified publicly traded partnership income. Additional Safe Harbor Requirements (A) Separate books and records are maintained to reflect income and expenses for each rental real estate enterprise; (B) For taxable years beginning prior to January 1, 2023, 250 or more hours of rental services must be performed (as described in this revenue procedure) per year, with respect to the rental enterprise. For taxable years beginning after December 31, 2022, if in any three of the five consecutive taxable years that end with the taxable year 250 or more hours of rental services are performed (as described in this revenue procedure) per year with respect to the rental real estate enterprise; and the taxpayer maintains a record of the following: 1. Hours of all services performed. 2. Description of all services performed. 3. Dates on which such services were performed. 4. Who performed the services. Rental activities allowed in the 250 hours for the purpose of this revenue procedure include: 1. Advertising to rent or lease the real estate. 2. Negotiating and executing leases. 3. Verifying information contained in prospective tenant applications. 4. Collection of rent. 5. Daily operation, maintenance, and repair of the property. 6. Management of the real estate.

7. Purchase of materials. 8. Supervision of employees and independent contractors. 9. Rental services may be performed by owners or by employees, agents, and/or independent contractors of the owners. The following tasks are excluded and not allowed to be counted as part of the 250-hour Safe Harbor: 1. Financial or investment management activities, such as arranging financing. 2. Procuring real estate. 3. Studying and reviewing financial statements or reports. 4. Planning, managing, or constructing long-term capital improvements. 5. Hours spent traveling to and from the property. Clearly Excluded from Safe Harbor: 1. Real estate used by the taxpayer including an owner or beneficiary of an RPE (relevant passthrough entity), as a residence, for any part of the year. 2. Real estate rented or leased under a triple net lease for purposes of this revenue procedure, a triple net lease includes a lease agreement that requires the tenant or lessee to pay (at least a portion of) rent, utilities, maintenance, taxes, fees, and insurance 3. LLC’s where commercial and residential real estate are part of the same enterprise, such as an apartment complex and industrial building in the same LLC. These rules place the burden of keeping time spent records of the rental services, on the Taxpayer. The work can be performed by a combination of owners, agents, and contractors. The key will be that all those involved in an investment will need to keep time records starting January 1, 2019, and will need to consolidate them for the next tax year. The goal, of course, is to obtain 250 Hours of Services to qualify for the Safe Harbor and the tax savings. You should talk with the managing partner of the pass-through entities you own and make sure these requirements are being meet starting January 1, 2019. Your goal as a real estate investor is to reach the 250-hour safe harbor mark so you can take these deductions. This www.rhaoregon.org

will not be easy. If you are excluded from the safe harbor, look for ways you can accelerate depreciation so you can save on taxes instead. This tax change is significant and very complicated. I urge you to reach out to your tax advisor to strategize a best course for you and take advantage of the tax savings today. *IRS notice 2019-07 (https://www.irs.gov/pub/irsdrop/n-19-07.pdf) explains the administrative rules and defines a safe harbor for real estate investors as is defined in Section 199A of the Code. Don’t have 250 hours? Should you not be able to reach the 250 Hour threshold to shelter your income, you can instead focus on reducing income instead to reduce tax expenditures. To reduce income, property owners may want to consider cost segregation studies to increase/accelerate depreciation. One of our clients recently saved over $1,000,000! This strategy is especially effective if you continue to utilize 1031 exchanges as you grow your net worth. Also, under the new law, improvements to the interior of a building may qualify for bonus depreciation. Unfortunately, there seems to be a wording error in the legislation, which will need to be fixed by Congress. The error in the legislation is technical, so property owners will want to consult their tax advisors to determine what position they want to take on the error. Summary The Treasury Department and the IRS have clarified their understanding of Section 199A of the revenue code. In this case the changes relate to businesses and additional savings that can be garnered with an additional deduction of up to 20% of the taxpayers qualified business income for non-corporate taxpayers including businesses operated through partnerships, S corporations or sole proprietorships.

How Accidental Landlords Can Avoid Two Common Mistakes by David Crown

Ownership of property might seem like something that can only happen through careful planning, but as a property manager in Los Angeles, I get calls all the time from folks who’ve become landlords through unplanned scenarios. Maybe a family member has passed away and willed them a property. Maybe they wanted to sell their home but couldn’t fetch the right price for it, so they had to rent it out until the market improved. Just today, we got a call from an owner whose property had been declared a historic landmark, so he couldn’t remodel it to sell at the price he had hoped. Regardless, what they share in common is that they’ve come into possession of rental property without having studied or prepared for becoming a landlord. It’s possible for a new rental owner to find a natural knack for management and decide to devote their time to managing their own properties. But for the uninitiated, this article will lay out the two most common mistakes accidental landlords make managing their own property — and how to avoid them. Mistake No. 1: Choosing Bad Tenants You could own a breathtaking property and maintain it with perfect efficiency, and it wouldn’t be worth a dime to you if you couldn’t get it rented by good tenants. Not just any tenants, but ones who pay rent on time and don’t lie about damages to the property or sue the owners/managers with false claims. New owners and landlords are often all too willing to rent their property to people whose credentials (credit, work history, criminal history, etc.) they haven’t thoroughly verified. Looking into tenant’s history is of the utmost importance, so don’t just call their most recent landlord — call two or three of the landlords they’ve rented from. After all, the most recent one might speak positively about the tenant only because they want him to become your problem, not theirs.

good reason, and end up costing you dearly on legal fees even if you win the case. Verification of tenant records should never be skipped over in favor of guesswork. Remember: your rental property is only as good as its renters. Mistake No. 2: Legal Missteps I decided as a much younger man (to my parents’ chagrin) that law school was not for me, but it’s my responsibility as the CEO of a property management company to be familiar with the laws — local, state and federal — regarding rental properties and tenant-landlord relationships. Fair Housing regulations differ from state to state, and you should absolutely know those in the state you own/manage property in. Now, getting taken to court can cost quite a bit. Even if you win the case, you face the cost of having to defend yourself (which calls back to No. 1 — don’t take on a tenant who will put you through this), but it’ll cost a lot more if you’ve actually made the illegal mistake the tenant claims you did. I highly recommend hitting the books a bit to brush up on the laws in your state regarding landlord/ tenant relationships. The U.S. Department of Housing and Urban Development is a great place to start. If you’ve recently fallen into the role of rental owner, you’ve likely already found yourself responsible for a vast variety of decisions regarding your property, but perhaps the two most important are the way you choose your tenants and the thoroughness with which you learn Fair Housing law. Avoiding the pitfalls involved in these two areas of being a landlord can save you innumerable headaches, and give you the foundation you need to move forward profitably with your property. Fire Up the Grill...Not the Patio As temperatures begin to warm up, so do the barbecues. Keep it safe this year by following the tips below. Residents should also check with their landlord to ensure barbecues are allowed on decks or patios. 

Read your Owners Manual prior to operating any grill.

Never leave your barbecue unattended. Always have a hose, bucket of water, or fire extinguisher nearby in case of fire.

If you use a barbecue lighter, do not leave it out where children can access it.

Use charcoal lighter fluid only — sparingly and with caution.

Briquettes can stay hot for several days and burn through paper or plastic bags. It is safest to wait at least three full days before transferring briquettes/ashes to a METAL can. Store the METAL can away from things that can burn such as decks or wood siding.

If using a propane barbecue, open the lid while igniting it.

Dear Maintenance Men by Jerry L’Ecuyer & Frank Alvarez

Dear Maintenance Men: One of my maintenance chores I do is caulking and sealing shower/tub fixture flanges and shower walls. My problem is getting the caulking to dry before a resident uses the shower. Any Suggestions? David Dear David: A lot of people will say: “Just tell the resident not to use the shower till the caulking is dry”. Well it doesn’t work and by the time you are driving away from the building, your resident is already taking a shower and your fresh caulking is washing down the drain. Your caulk should cure at least 24 hours before use. Water based latex caulking is easy to use, but very susceptible to water until it is cured. Try using a silicone or polyurethane based caulking for doing tubs, showers, toilets, sinks or other wet locations. It tends to set quickly and will repel water during its cure time. Another solution we have found works well with very busy showers is to remove all the fixtures, including the showerhead & arm, valve handles and tub spout, before caulking. (A bit extreme, but effective) We then plug the showerhead and tub spout with a capped pipe. Then caulk the tub/shower. We come back 24 hours later and reinstall all the fixtures. One more thought; if you have sliding shower doors for your tub, check the bottom track. If it is loose, do not caulk until the track is removed, cleaned and dried. Reinstall the track with new adhesive caulk to hold it down and caulk the edges to keep the water out.

Dear Maintenance Men: I own a small apartment building with an average amount of landscaping around the property. I have a garden service that comes each week; they cut and edge and do what their supposed to do, I think, although they don’t spent a lot of time at the property. What should I expect from my landscapers or garden service? John

Dear John: We have a minimum list of items that must be completed at a property. If these items are skipped or ignored, we feel the property will suffer. On a weekly basis, we expect the garden service to provide the following: 1. Cut the grass. 2. Edge the grass. 3. Pull out weeds between the sidewalk cracks, walk around the building, including the alley. 4. Turn over the dirt in all the flowerbeds each week. 5. Pick up any trash around the property. 6. Broom, blow or hose down the walkways. 7. Turn on the sprinkler lines, check for clogged heads, broken lines etc. 8. Check that the timer is set properly. 9. Cut, trim and thin any shrubs or bushes. 10. Maintain communication with the owner about problems or improvements The above list takes time, half hour minimum at a small property. If your landscape gardener completed the list on a weekly basis, you could very well have the best-looking property on the block! Which means higher rents … if you add color flowers … even higher rents! Finding a landscape gardener to do above list consistently is not easy. Ask your local apartment association for recommendations or look in your neighborhood or city for a property with outstanding landscaping and ask who the gardener is. Have him give you a quote according to your “list”. Keep in mind a landscape company or gardener who give the above service will charge more than a “blow and go” gardener, however your property will reflect their above average service. Dear Maintenance Men, I am planning major remodel work to my 4plex and need some advice. My contractor has told me not to worry and he will have everything under control but I know that city inspections can cause serious delays if we are not ready for them or do something wrong. I am not an expert or experienced in construction, what should I watch for as far as the actual inspections are concerned? (continued on page 15)

As the largest provider of food assistance in the state of Oregon, we help nearly 10,000 people in need each month. SnowCap accomplishes this with the hard work of 1,000 volunteers led by a staff of 9 and without government funding. Since 1967, SnowCap has made healthy, fresh foods available to those who would otherwise go without. The majority of our clients are children, the elderly, disabled and folks who struggle to make ends meet.
