Resumen Este artículo se ocupa de examinar el debate en torno al aborto en la versión defendida por el profesor Pablo Rolando Arango en la Revista del centro de Investigaciones Sociojurídicas CIS de la Universidad de Caldas, Volumen. 3 No. 2 de Diciembre de 2006. Para empezar el análisis, primero expondré la manera como se interpreta la vida del feto y los términos en los que se protege la misma bajo la lógica constitucional. En un segundo momento, me ocuparé de mostrar, desde la perspectiva manejada por el filósofo del derecho Ronald Dworkin en su libro El Domino de la Vida, por qué resulta problemático sostener la decisión de la Corte Constitucional como un fallo incoherente. Asimismo mostraré, apoyado en esta perspectiva, los limitantes de sostener el debate sobre el aborto como un conflicto entre derechos.

Abstract This article takes care to examine the debate on the abortion in the version defended by professor Pablo Rolando Arango in the Magazine of the research center Sociojurídicas CIS of the University of Caldas, Volumen.3 no. 2 of December of 2006. In order to begin the analysis first I will expose the way as one interprets the life of the fetus and the terms in which the same one under the constitutional logic is protected. At a second moment, I will take care to show, from the perspective handled by the philosopher of right Ronald Dworkin in its book Life’s Dominion, why it turns out problematic to maintain the desición of the Constitutional Court as a incoherent failure. Also I will show supported in this perspective the limitantes to maintain the debate on the abortion like a conflict between rights.
