DEAR RMA MEMBERS, The Virginia Retail Federation (VRF) team wrapped up a very successful General Assembly Session the last weekend of February. The VRF team was present for all of Session to represent the retail business interests with legislators and decision-makers. We monitored over 100 bills, defeating all bills that would negatively impact the retail industry and passing those that have a positive impact on our members. See page 6 for a

scheduling, Border Adjustment Tax, as well as the internet sales tax issue. VRF representatives will attend the annual “Retail Advocates Summit” hosted by NRF at the Capitol in Washington, D.C., July 17-19. This provides VRF the opportunity to visit Federal representatives in support of retail issues.

Since 2008, RMA and UNOS have teamed up to bring awareness to organ donation with Retailers4Life, a campaign that marries retail to the cause in an attempt to educate consumers about the benefits of organ donation and encourage more people to become donors themselves.

Running throughout April, National Donate Life Month, Retailers4Life serves as a local movement alongside a national cause. Retailers can participate by promoting the campaign, using the hashtag

#WorkingTogetherSavingLives on all social media posts, and encouraging organ donation registration in their stores. It's just one of the many ways the RVA community is working together to save lives.

LEGISLATIVE UPDATES 2017 GENERAL ASSEMBLY WRAP-UP:

A SUCCESSFUL SESSION FOR THE RETAIL INDUSTRY The 2017 Regular Session of the Virginia General Assembly adjourned Saturday, February 25th. This was an extremely successful session for the retail industry and VRF members. As an RMA member, you were represented everyday at the Capitol during the General Assembly Session by the VRF lobbying team, Kate Baker and Jodi Roth. Not only did they work diligently to defeat bills that would negatively impact your business, but many of the bills VRF supported, on behalf of its members, passed both bodies and have already been signed into law by the Governor.

The General Assembly returned for “Veto Session” on Wednesday, April 5, 2017, to consider Governor McAuliffe’s vetoes and amendments to bills that were before him. These results were not available at the time this publication was sent to print, but you can find updates on these bills on VirginiaRetailFederation.com.

Your VRF team covered several issues throughout the 2017 Session. Below are some of the highlights: SALES TAX NEXUS (SB 962 & HB 2058):

The House and Senate both passed separate legislations to require out-of-state businesses to collect and remit sales and use tax on sales to customers in Virginia.

This legislation brings us one step closer to leveling the playing field for brick and mortar retailers and online retailers in the Commonwealth. VRF strongly supported this legislation on behalf of its members. Governor McAuliffe approved the legislation, and the law will go into effect July 1, 2017.

SALES TAX HOLIDAY (SB 1018 & HB 1529):

The “sunset” for the Sales Tax Holiday was initially set to expire in 2017, meaning the August Sales Tax Holiday would no longer take place in Virginia. Therefore, legislation was introduced to extend the sunset dates from July 1, 2017 to July 1, 2022. VRF strongly supported this legislation due to the importance of the August Sales Tax Holiday to its members. This too has been approved

by Governor McAuliffe and will go into effect July 1, 2017.

ACCELERATED SALES TAX:

Unfortunately, the Accelerated Sales Tax (AST) language from the Governor’s proposed budget remained in the amended balanced budget adopted by the General Assembly. The AST threshold will remain at $2.5 million for 2017, instead of unwinding to $10 million. In other words, if you are a retailer and have taxable sales of $2.5 million or greater, you will continue to pay May’s sales tax in the month of June, as well as an estimate of June’s sales tax, meaning you will make a double payment in June. On a positive note, the amended budget did include language which directs the Tax Department to convene a working group for the purpose of examining the AST requirement. The language also states that stakeholders from the retail industry will be a part of this working group.

PLASTIC BAG TAX (SB 925):

This bill sought to impose a five-cent per bag tax on plastic bags provided to customers by retailers located in localities within the Chesapeake Bay Watershed. VRF maintained its position on plastic bag bans/taxes, and opposed this bill. The bill was defeated in Senate Finance Committee.

ABC - DELIVERY PRIVILEGES (HB 1801):

This legislation sought to extend delivery privileges of persons holding a wine & beer license. Specifically, this bill allows a person holding such licenses to deliver wine or beer in closed containers for off-premises consumption to a person’s vehicle, allowing consumers to order wine and beer online with their grocery orders and pick them up from the grocery store. VRF supported this legislation. This was approved by Governor McAuliffe and will go into effect July 1, 2017.

MINIMUM WAGE (SB 978, SB 785, HB 1444, HB 1771 & HB 2309):

Several bills were introduced this Session that sought to increase the minimum wage in Virginia. The proposed increases ranged from $8 an hour to $11 in the first year,

MANDATED PAID SICK LEAVE (SB 824):

This bill would have required private employers to provide all full-time employees with paid sick days. Based on this legislation, these sick days would accrue at a rate of no less than one hour for every 50 hours worked in 2018 or, if an employer commences operations in 2018 or thereafter, in their employer’s first year of operations.

In subsequent years, paid sick days would accrue at a rate of no less than one hour for every 30 hours worked.

VRF maintained its position of opposing mandates such as these. The bill was defeated in the Senate Commerce and Labor Committee.

FELONY LARCENY THRESHOLD (SB 816, SB 923 & HB 1704):

This remains a perennial issue that VRF continues to work diligently to defeat. This year three bills were introduced that sought to increase the felony threshold for larceny from $200 to $500. Currently, if someone steals more than $200, they can be charged with a felony. If this legislation were to pass, that same person would be able to steal up $500 before they could be charged with a felony. VRF strongly opposed this proposed increase because of the negative impact it would have on all retailers in Virginia. The low felony threshold has been proven to be a deterrent to Organized Retail Crime in the Commonwealth. SB 816 (which encompassed SB 923) did pass out of the Senate, but was defeated once it reached House Courts of Justice, Criminal Law Subcommittee. HB 1704 was defeated in House Courts of Justice, Criminal Law Sub-committee.

BACKGROUND CHECK (SB 1044 & HB 1713):

Under current law, the complete date of birth (DOB) is public court record, however, the Clerk/Office of Executive Secretary (OES) is prohibited from putting it on the Internet. This forces employers and/or their background screening companies to contact each clerk’s office in the Commonwealth to determine if a particular person has a pending criminal case.

The legislation introduced this year provides that the Supreme Court and any other court clerk may provide online access to court records of non-confidential criminal case information to confirm the complete date of birth of the defendant. This legislation permits a narrow exception to the prohibition in existing law for access to DOB's on the Internet for the sole purpose of allowing someone who already has the DOB of an individual to enter that person’s name, SSN & DOB into the OES’s case management system to determine if the individual has pending criminal charges. VRF supported this legislation because it streamlines the background screening process for employers in Virginia. Approved

by the Governor, this law will go into effect July 1, 2017.

In addition to these issues, VRF worked to defeat many other bills that could have been detrimental to the retail industry, including, but not limited to:

• Assignment of Benefits

• Employment Law

• Family Medical Leave Insurance Program

• GMO Labeling Mandates

• Signage for Retailers Mandates

EXPECTATIONS FOR 2017 2017 will be a big election year in the Commonwealth of Virginia. On November 7, 2017, we will have an election for the Governor, Lieutenant Governor, Attorney General, and all 100 seats in the House of Delegates. Mark your calendars primaries for these elections will take place on June 13, 2017.
