VICTORIAN RENTAL REFORMS: What every rental provider needs to know

Victoria’s rental market is set for major reform, with the introduction of the Consumer and Planning Legislation Amendment (Housing Statement Reform) Bill 2024. This legislation will reshape the rights and responsibilities of rental providers, property managers, and renters when it comes into effect from 25 November 2025.

With over 10 key changes, the reform package is one of the most significant updates to the Residential Tenancies Act in recent years. Here’s what you need to know:

1. No More ‘No Reason’ Evictions: Rental providers will no longer be able to end fixed-term leases without a valid reason i.e. moving into the property, renovations, or sale with vacant possession.

2. Stricter Rent Increase Rules: Rental increases must be justified with clear evidence i.e. market comparisons or recent improvements.

3. Longer Notice Periods: The required notice period for rent increases or ending a tenancy will increase from 60 to 90 days.

4. Mandatory Minimum Standards: All rental properties must meet minimum safety and efficiency standards before being advertised, including heating, insulation, and structural integrity.

5. Ban on Rental Bidding: Rental providers will be prohibited from accepting offers above the listed rental price.

6. Data Protection Measures: New data privacy laws will limit the personal information rental providers and agents can collect and store.

7. Licensing & Training for Agents: Real estate professionals must meet new licensing and CPD requirements by November 2026.

8. Tougher Penalties for Underquoting: Penalties for underquoting property prices and misrepresentation during sales have increased to a maximum fine of $47,422.

9. Dedicated Dispute Resolution Body: Rental Dispute Resolution Victoria (RDRV), will handle disputes between rental providers and renters.

10. VCAT Reforms: The Bill introduces reforms to streamline proceedings at VCAT (Victorian Civil and Administrative Tribunal).
