The suspected Cocaine in EXHIBIT #25 was later weighed (620.7 grams including packaging), then tested by Officer D'Onofrio utilizing NIK field test kit "G". The test was performed according to the manufacturer's instructions and in the manner that previous test have been conducted. These past test have been confirmed through follow up testing at the Connecticut State Laboratory. The test was completed using a small representative sample, which showed a positive response for the presumpti ve presence of Cocaine HCL. The suspected Crack Cocaine in EXHIBIT 1126 was later weighed (36 grams including packaging), then tested by Officer D'Onofrio utilizing NI K field test kit "G ". The test was performed according to the manufacturer's instructions and in the manner that previous test have been conducted. These past test have been confirmed through fo llow up testing at the Connecticut Slate Laboratory. The test was completed using a small representative sample, wh ich showed a positive response for the presumptive presence of Cocaine Base a"a crac" cocaine.

The suspected marijuana in EXHIBIT# IO was later weighed (701 .3 grams including packaging), then tested by Offi cer o·Onofri o utilizing NIK field test kit "e". The test was performed according to the manufacturer's instructions and in the manner that previous test have been conducted. These past test have been confinned through follow up testing at the Connecticut State Laboratory. The test was completed using a small representative sample, which showed a positive response for the presumptive presence of Marijuana.

EXHIBIT #3 : was identified as Alprazolam 2 mg aka "Xanax" bars, EXHIBIT #4 was identified as Oxycodone Hydrochloride 20mg utilizing the site "Drugs.com". EXHIBIT #17 was identified as Oxycodone Hydrochloride 30mg, EXHIBIT # 18 was identified as Oxycodone Hydrochloride 30mg, EXHIBIT# 19 was identified as Oxycodone Hydrochloride 20 mg, and EXH IBIT #20 was identified as Oxycodone Hydrochloride 15mg. These controlled substances were identified through the website "Drugs. com", which as been proven reliable through past continnations.

ACTION TAKEN: On the 26th day of February at approximately 1945 hours, Officer Pellegrini and this officer were operating an unmarked vehicle in the area of South Colony St and Grant St (this officer was driving and Officer Pellegrini was the front seat passenger). These officers are assigned to the Meriden Police Department's Crime Suppression Unit (CSU) and were wearing exterior vest that are clearly labe led "POLICE" in the front and back. Also, the unmarked vehicle the officers were operating is equipped with a flashing red/blue light.

As the officers were traveling northbound on South Colony St, toward Olive St, the operator of the vehicle directly in front of us threw a plastic bag out of the window. The vehicle, a black 2019 Chevrolet Tahoe bearing CT registratio~then turned right onto Olive St. This officer knows that this vehicle is commonly operated by Jonathan Rivers ( D O ~ ~ e r knows that Rivers, who is a known drug dealer within the City of Meriden, lives a t • • • • This officer knows that illegal drugs are commonly packaged in plastic bags. Based on this, this officer believed that Rivers observed the officers and tried to discretely throw illegal drugs out of his window.

This officer retrieved the (EXHIBIT# 1) plastic sandwich bag with a tom end that the vehicle operator threw onto South Colony St. The bag was empty, but this officer knows that the corners of plastic bags are commonly used to package illegal drugs. This officer wanted to speak with the operator of this vehicle regarding the littering. This officer could not find the vehicle anymore, but decided rn go roaiL see if the vehicle went there.

This officer went northbound on Broad St and turned left onto Arch St. As our vehicle was going d0wn Arch St (westbound), a vehicle turned right onto Arch St from Hobart St (the vehi cle was traveling eastbound on Arch St, coming t0ward 0ur vehicle). Rivers angrily stared right at the officers and began throwing his hands in the air like he was angry with the officers. Officer Pellegrini exited our vehicle and yelled numerous clear commands for Rivers to stop the vehicle. This officer also yelled commands from inside the vehicle, but Rivers just appeared yelling back in a extremely angry manner.

Rivers ' vehicle was now on the sidewalk (northbound side) at the intersection of Hobart St/Arch St near I00 Hobart St. The vehicle then began reversing down the sidewalk, before re-entering the roadway about half way down the street. Rivers would not stop his vehicle even with a clearly identifiable Officer Pellegrini yelling commands outside the vehicle, and this officer ye lling commands from inside a vehicle with a flashing red/blue light.

Upon re-entering the roadway, the vehicle crossed the street and struck the opposite curbing. The vehicle then again crossed the street in the opposite direction toward the northbound side of the street. The vehicle (still in reverse) went over the curb, onto the sidewalk, over another curb, then struck two garbage cans and a vehicle parked in front of 80 Arch Parkway (gray 06 Honda Civic bearing CT registration AS5 l 632). Both garbage cans were destroyed and the Honda suffered rear end damage.

It should be noted that the entire time the vehicle was in reverse ' Rivers was starinor:, at the officers vehicle and yelling in a animated . manner. He never once looked behind to see where his vehicle was going or who was behind it. At times, Rivers didn ' t even have a hand •on the steering wheel in an attempt to steer the vehicle away from vehicles/pedestrians.

Once Rivers' vehicle came to final rest in front of 80 Arch Parkway, he exited his vehicle in the same agitated manner that he was displaying before. He stood concealed by his open driver door, yelling toward this officer. This officer pointed his department issue firearm at Rivers and told him to show his hands, then get on the ground. Rivers stated "FUCK YOU, look what you did to my car(!".

Rivers body was still concealed behind the driver door. This officer was fearful that Rivers was canying a firearm/weapon because his actions to this point were bizarre and irrational. As the officers continued shouting clear commands at Rivers, he just yelled back, then opened the rear driver door and leaned into the vehicle. While ignoring the officer's commands, he again shouted "Fuck You", then casually began walking northbound on the sidewalk, away from the officers.

This officer went after Rivers, at which time he began running. This officer caught him shortly after, at which time he was brought to the ground. Rivers landed on his left side, with his right arm visible. This officer grabbed his right arm and brought it toward his back. This officer went to pull his left arm from under his body, but he used his body weight to prevent this officer from freeing the arm. This officer then felt Rivers tensing his left ann muscles. The arm was laid underneath his body, toward his waistline area. Still fearing that Rivers had a weapon and was trying to gain access to it, this officer delivered a knee to Rivers .1.ower back area. This officer wanted Rivers to give a reaction which would loosen and free his arm. Upon delivering the knee, Rivers loosened his arm and this officer was able to control both arms. Officer Pellegrini then handcuffed Rivers.

Rivers was searched by Officer Pellegrini, Officer Shedlock and Officer Severino. The officers did not locate any contraband on his person. Officer Shedlock told this officer that he tried to search Rivers groin/buttocks area and Rivers got extremely fidgety . He tensed his legs and would not spread his legs. Rivers did have (EXHIBIT #5) $2373 cash (ASSET FORFEITURE) in US cun-e ncy in his pockets. The cash was in denominations that are consistent with what this officers knows is exchanged during street level drug deals.

This officer believes this money is proceeds from illegal drug sales and therefore, the officers will be applying for asset forfeiture ) Officers searched Rivers vehicle for weapons, at which time Officer D'Onofrio located (EXHIBI T #2): a plasti c b:iggie contai ning suspected crack cocaine on top of the front seat arm rest (.3 grams). Officers also located (EXHIR IT 11 9) a black Apple Iphone, (EXHlBIT #9a) black Motorola Phone and (EXHIBIT //9b) Verizo n ZTE flip-phone. The flip ph0ne was ringing co nstantly and receiving text messages. Through trai ning and experience, this offi cer k11uws that it is cnmmn n f0r drug de:ikrs 10 uti lizing several phc'nes so their personal phone is separate from th eir "drug" phones.

The officer located the following exhibits in the trash bag: (EXHIBIT #6) a large plastic heat seal-able bag containing remnants of suspected marijuana, (EXHIBIT #8) bills/bank paperwork for Jonathan Rivers at-■■■t (EXHIBIT #7) several ripped plastic baggies. These ripped plastic bags appeared similar to the plastic bag that Rivers threw out of his vehicle on South Colony St.

This officer knows through training and experience that larger distribution amounts of marijuana are commonly packaged in these plastic heat seal-able bags. More specifically, it is common for a pound(s) of marijuana to be packaged in these plastic heat seal-able bags. The suspected marijuana remnants was tested by Officer D' Onofrio utilizing NIK field test kit "E" . The test was performed according to the manufacturer' s instructions and in the manner that previous test have been conducted. These past test have been confirmed through follow up testing at the Connecticut State Laboratory. The test was completed using a small representative sample, which showed a positive response for the presumptive presence of Marijuana.

While searching Rivers jacket pocket at Police Headquarters, this officer located (EXHIBIT #3) a plastic bag containing ( 19) yellow pil Is labeled "P039" and (1) while pill labeled "G3722", (EXHIBIT #4) a plastic bag containing (7) pills labeled "K57" . Officer Shedlock stated Rivers was searched on scene and he did not find these pills in his jacket pocket. It is believed Rivers at the pil Is stored near his buttocks/groin area and was able to move them in the police vehicle. Rivers was stripped searched, yielding negative contraband.

It should be noted that an individual approached the members of the Connecticut State Police' s Statewide Narcotics Task Force while this officer was assigned to said unit. This individual was arrested on drug charges and wanted to conduct controlled buys for consideration with their case. This individual stated it could buy large amounts of crack cocaine/cocaine from Jonathan Rivers. This individual stated it knows Jonathan Rivers lives and stores his illegal drugs at his residence o ~ n Meriden.

On 2/26/20 at 2300 hours, the Honorable Judge Klatt approved and signed a Search and Seizure warrant for At approximately 2310 hours, the officers served the Search and Seizure wan-ant at the said address. The officers knocked on the front door and announced they had a Search Warrant. After receiving no answer, forcible entry was made throuo-h the front door. . - w a s read her Miranda Warnings at 2319 hours, to which she stated she understood. She told this officer that Jonathan ·s friend called her and stated Jonathan was just arrested by her house. She stated the male said he was on the phone with Jonathan when he started saying they are "blocking me in". ~tated she knows Jonathan is a drug dealer, but she doesn 't think anything is in the house.

She cleans the house regularly and knows nothing is in the house. She stated he might use the basement to store drugs, but she was unsure. She told this officer that she does not have a Pistol Permit and nobody in the house has any guns.. . added that Jonathan has several plastic bins full of clothes in the master bedroom.

This officer asked . . . f she moved anything or got rid of anything prior to the poli ce comi ng to the house. She stated she did not. This officer asked her about any vehicle 's on the property that might contain contraband. She stated the ve hicle parked in th e backyard h:is not been moved in about 4 months. She stated it was registered to Jonathan 's ffi()th cr but she does not think it is rtgisterf:'d :inymorc-. She stated she knows the vehicle 's bat1ery is dead . She showed thi s offi cer the vehi cle key, whi ch was hanging from a hook in kitchen. omplained of chest pain so Hunters EMS was di spatched to the scene. officers then began a systematic search of the residence. While searching the dining room area, Detective Dorais located a plastic baggie contain ing suspected marijuana ( 11.3 grams including packaging) that was later packaged together in EXHIBIT # 10. Officers moved to the master bedroom, where this officer observed Jonathan Rivers (DOBal■■tT identification card on a bin near the doorway. While searching a small filing cabinet in the comer of the room, Officer Pellegrini located (EXHlBIT #11) a unlabeled prescription pill bottle containing (28) twenty-eight pills labeled "m 15" and later detennined to be Oxycodone Hydrochl oride 15mg, (EXHIBIT # 12) a di gital scale, (EXHIBlT #13) a box of (18) eighteen .40 caliber rounds of ammunition and (EXHlBIT # 14) $60 cash in US cunency (ASSET FORFEITURE). Officer Pellegrini stated this filing cabinet was full of bills addressed to Jonathan Rivers, as well as paperwork for Rivers· business.

While searching the plastic bins full of male clothing (which-stated belong to Jonathan Rivers), thi s officer found (EXHIBIT # 15) an empty unlabeled prescription pill bottle in a men' s sweatpants pocket. This officer also found a (EXHIBIT# 16) a letter addressed to Jonathan Rivers at . . .in another plastic bin. This bin was full of letters addressed to Jonathan , as well as paperwork and bank information for Jonathans" business.

K-9 Officer Ficara told this officer that his K-9 detected the odor of narcotics emanating from the 2002 blue Toyota Camry bearing CT registration rked on the rear lawn (See Supplement for further details). This officer knows through training and experience that drug dealers will commonly hide drugs outside/around their house to prevent the drugs from being found by law enforcement. This officer also knows that immobile vehicles are commonly used to store illegal contraband.

This officer observed the immobile vehicle to be a 2002 blue Toyota Camry bearing CT registration _.,,hich had expired in 2018 .

The vehicle had obviously not been moved in an extended period oftime and was in a state of disrepair. The sides of the vehicle had dirt lines, as well as the tires. Some of the tires were flat and the steering wheel was missing pieces. There were no tire arms leading to the vehicle's position, meaning it had not been moved recently. This officer observed that there were several large black trash bags, full of contents, throughout the vehicle. There were other items on the seats that made it appear this vehicle was being used as storage. The doors to the vehicle were all unlocked. !

While searching the vehicle, this officer located a black plastic garbag~ bag ~ontaining a jean material bag .... Inside the jean material bag, this officer Jt>cated (EXHIBIT 17) (2) ,unlabeled prescription pill bottles containing a total of (99) pills labeled "M30" (the bottles contained 88 and l J pills respectively), (EXHIBIT# 18) a unlabeled prescription pill bottle containing (24) pills labeled "k9", (EXHIBIT #19) a unlabeled prescription pill bottle containing (40) pills labeled "k57" , and a (EXHIBIT #20) a unlabeled prescription pill bottle containing (50) pills'labeled "m 15". :, •

On the rear passenger floor, this officer located (EXHIBIT #33) a black box containing (EXHIBIT #21) a Highpoint Model HCP .40 caliber handgun SIN: X709733. There was also a magazine in the box that held (5) five .40 caliber rounds . Dispatch could not find any record of this firearm . i

In the trunk of the vehicle, Officer D'Onofrio located (EXHlBIT #34) a gun case containing (EXHIBIT #22) a Smith and Wesson .44 Magnum Revolver with a scope SIN : 8802420. This gun was not loaded. Dispatch could not find any record of thi s firearm.

Underneath the driver seat, inside (EXHIBIT #35) a black winter hat, Officer D' Onofrio located (EXHIBI T #23 ) a Romani an MDCTTC 7.62x25 caliber handgun SIN : JB 1503 . This gun was loaded with a magazine that held (7) seven 9mm rounds , but there was no round in the chamber. Dispatch could not find any record of thi s firearm.

In another black trash bag, this officer located (3) three pl astic heat seal -able bags cont aining suspected marij uana in the weights of 183 grams, 249 grams and 258 grams respectively (which were later packaged together in EX HIBIT # 10). T hese bags appeared very simil ar to the plastic heat seal -able bag that was found in the trash can o~ (EX H 1B IT #6) .

In the same black trash back as the aforementioned cereal boxes, Officer D'Onofrio located a shoebox. Within this shoebox, he located (EXHIBIT #26) several plastic bags containing suspected crack cocaine (36 grams) and (EXHIBIT #27) several plastic bags containing suspected raw heroin/heroin (59 grams). The heroin was packaged in found in plastic zip loc bags containing rice . Heroin is commonly kept in rice to remove moisture. In addition to the plastic bags, there was (2) two wax paper folds with the insignia "DOA" containing suspected heroin and a double bagged plastic glassine bag containing suspected heroin. Also in this shoebox, officers located (EXHIBIT #29) a pill labeled "Fl290", and (EXHIBIT #30) (18) eighteen Buprenorphine Nalaxone Sublingual Film strips.

Inside another trash ba~, officers located (EXHIBIT #28) 4 bars of Mannilc Cicoqna. This officer knows this is commonly used by drug dealers as a cutting agent. Cutting agents are mixed with illegal narcotics to produce a greater yield and therefore, create a larger profit for the dealer.

In another black box in the vehicle, this officer located (EXHIBIT #31) two pieces of paper with apparent drug recipes on them.

While searching the home, officers located (EXHIBIT #32) a copy of a Search Warrant that a Meriden Detective had written a few years ago. Rivers made notes on the Search Warrant, apparently in reference to the person that provided information to the police. This officer knows Rivers 'was involved in a murder years ago and subsequently was convic:ted for his involvement in the incident.

At 0232 hours, this officer read Rivers his Miranda Warnings, to which he stated he understood. He initialed and signed his name on the Waiver of Rights form (See Attached). Rivers stated everything found in the vehicle belongs to him, including the drugs and guns. He stated he sells drugs to keep his family "afloat". He stated his wife and kids were not involved with any of the illegal activity. Rivers stated he had those guns since "before I went in the first time" (referring to before he went to jail). Rivers told this officer that when he was in his vehicle, he thought the police "froze" his car with some type of technology. He staed he couldn ' t put the vehicle in park or hit the brake to stop it. It should be noted that his vehicle was towed from the scene by Danby' s. The Danby' s driver stated the transmission and the brake appeared to be workign properly when the driver drove the vehicle to the flat bed.

Rivers was later booked and processed on the above mentioned charges.

This officer made an oral report to DCF careline worker Roxana Kehn (See Attached DCF-136).

Rivers was given a copy of Page 5 of the Search Warrant at Headquarters .

He was mailed a receipt for seized property.
