s Austin tops every major top 10 list for its small business friendliness, abundance of green homes, proclivity towards fun and opportunities for job growth, the city’s real estate market grows more susceptible to real estate scams. As more REALTORS learn about the various types of deception that can occur in this industry, they will be better qualified to help clients avoid potentially risky situations. “I think Austin is currently ripe for investor scams because we are the ‘it’ place to be,” says Vanessa Nunez of HomeCity Real Estate.

“Since we are on every major top 10 list of the best places to live, scammers are ready, willing and making their way here. As agents, the most important thing we can do is research diligently, ask all the right questions and put our clients in contact with our trusted team of inspectors, lenders and title officers.”

The Short Sale Scheme In a short sale, the lien holders agree to release their lien on the real estate and accept less than the amount owed on the debt. There are short sale specialists who are not licensed, but understand how the banks work. “They suggest making a low-ball offer to see what the bank will accept,” says Patrick Easter of Easter and Easter REALTORS. “This is bad for the seller, and only delays the bank on making a decision when they are trying to figure out why their appraised value is so much higher than the offer that has been presented.” When one of Nunez’s clients returned from a tour in Iraq, he encountered a short

sale scheme. “A house flipper told my client that he could take the house off his hands, had him sign over the deed and then proceeded to wholesale the property and lease-to-own,” says Nunez. In truth, the house flipper transferred the property to another flipper who was supposed to manage the lease purchase and make payments to the mortgage company. When the soldier was being deployed again, his clearance was denied because the property was headed to foreclosure. In the end, Nunez called the bank and helped administer a short sale to keep him eligible for the military. “The sad part is the flipper had a real estate license and was misrepresenting the way ethical REALTORS are supposed to work,” she says.

2014 a buyer’s market for haunted listings

W

hile much of the US real estate market has recovered in 2014, it is still a buyer's market for these haunted homes. Also known as stigmatized properties, these legendary houses were all placed on market in 2014, but remain unsold. An online MLS ad for 1217 Marion St, Dunmore, PA reads: "Built in 1901, this Victorian home in the Hollywood section of Dunmore features 1850 sf of living space. Original hardwood floors. 4 bedrooms, 2.5 bathrooms. Off-street parking. Freshly painted. Slightly haunted. Nothing serious, though. E.g. The sounds of phantom footsteps. A strange knocking sound followed by a very quiet (hardly noticeable, even) scream at 3:13 a.m., maybe once a week. Twice a week, tops. And the occasional ghastly visage lurking behind you in the bathroom mirror. Even still, this occurs very rarely and only in the second floor bathroom." 108 Ocean Avenue is a "pristine, charming 3-story waterfront Dutch colonial with commanding views of the Amityville River. ‘Amityville’? Yes, this house that has been the subject of 11 horror films since Ronald DeFeo, Jr. shot and killed six members of his family and it can be yours for just under $1 million. On 306 French St, Fall River, Massachusetts sits a fine 14-room Queen Anne Victorian home. The property features two sunrooms, seven fireplaces, original parquet floors, tin ceilings and mahogany moldings. The previous owner was a quiet librarian named Lizzie Borden. None of these houses were sold in 2014, and they have since been removed from the market, but there are some tips you should know when trying to sell a stigmatized property. Believe it or not, the NAR has done some research on the topic of haunted houses which can be found at: http://www.realtor.org/field-guides/fieldguide-to-dealing-with-stigmatized-properties. Forty-one percent of respondents said they would buy a home with reported ghost sightings, but only 15 percent would pay the full market value. The Williamson County Association of RE-

Loan Documentation Fraud Primary residence disclosure is the most common example of loan documentation fraud. “People who tell lenders that they plan to reside in the house and don’t are committing fraud,” says Easter. “Stated loans are used to purchase high dollar properties and then the ‘angel investor’ drops out of the deal after the agent(s) involved and the loan officer pocket the money. The bank is left holding the bag.”

Predatory Lending Fraud “A company that tells the homeowner: ‘You better sign now because this deal will not be offered later’ is untrustworthy, says Easter. Companies that take liens on properties in exchange for over half of the potential equity are also suspect. “These companies disguise this fee as a prepayment penalty so there is no cap on the interest,” says Easter. “I had a client who lived in a property for over 20 years and an ‘investor’ showed up with an offer that would make the client current on his taxes and back payments,” says Easter. After reading his proposal, the investor was supplying the client with $30,000 (to be used towards the taxes and back payments) so that he could take half of the equity in the property when the client was selling within six months. This equated to over $40,000 in profit for the inves-

tor for a $30,000 investment. “I told my client to hire an attorney and not sign the proposed documents. Luckily, his family loaned him the money and he was able to repair the house and not have to share the profit,” says Easter. Easter continued, “If the same people who create these schemes would put the same amount of effort into an honest business, they could be extremely good REALTORS but they will not stay on the straight and narrow.”

Legitimate Resources Any third party website that is not governed by the real estate commission is susceptible to fraud. “Every time I post a property on Craigslist, I am bombarded with junk mail from people in Nigeria asking for money,” says Hepp. “The most credible website for marketing property is www.Realtor.com because it is associated with the National Association of REALTORS, (NAR) which is synched with our reliable MLS system.” Checking specific phone numbers and names of previous satisfied clients is a good way to determine a company’s credibility. “If they can't provide some examples of these relationships, they are not credible,” says Easter. “The MLS is the most credible resource, a REALTOR's own website or the Broker Underground on Facebook works well too. It is all about informing other REALTOR members about a potential home.” Educating the client should be a REALTOR’S priority throughout the entire process. “It is our moral and ethical duty to supply our clients with effective resources, such as websites, organizations, title officers, lenders and inspectors, that help them make the most effective, educated decision,” says Nunez. HBA’s Lakeway/Bee Cave Chapter makes donation to charity Recently, the Lakeway/Bee Cave Chapter of the Home Builders Association (HBA) of Greater Austin made a donation of $7,256.64 to local, Lake Travis charity group Families for Families. Gayle Berkbigler, co-founder of the Lakeway/Bee Cave Chapter and her co-committee member Lisa Hall of Service Tech presented the check at last month’s Chapter meeting. The annual golf tournament has been held for the last four years and proceeds from each tournament have been donated to local Lake Travis charities. Families for Families is an official non-profit organization started in September 2009 as an Eagle Scout project of Lake Travis High School
