ocket listings have been a sticky topic in real estate blogs lately, with many agents concerned about the legality of such a practice. “Pocket listing” is just the general term for any active listing that is not on the Multiple Listing Service (MLS). The seller’s agent assumes the exclusive right to sell the property and markets it off the MLS, hence it is “in their pocket.” There are many reasons sellers and their agents choose to keep their listings

private or semi-private. Potential questions of legality and ethics tend to center around how the listing is attended throughout the selling process, so there are some precautions to take with pocket listings. Here are some legitimate reasons that choosing to market a listing off the MLS (at least for a time) could be beneficial to the homeowner.

The homeowner is not sure he/she wants to sell Sometimes a pocket sale is the result of a casual agreement between an agent and a homeowner who is not completely committed to selling. In this case the homeowner may decide to test the market: “If you find me a buyer at the right price, I’ll consider selling.” Since the market is hot right now, it can be easier to negotiate a sale privately than to go to the expense of fixing it up, staging it, marketing it and having open houses—especially if the homeowner is on the fence about selling. A pocket listing can also be a viable way to test the price and beat the “days on market” ticker if there aren’t a lot of comps. If the price seems too high, they can lower it without a public price reduction.

Homeowner wants to sell privately Celebrities, public officials, people with young children, the elderly—and anyone who would rather not have to make a hasty exit for a showing or have pictures of their home on the Internet—may choose to under-expose their listing when privacy is a concern.

An offer was made during a “prelisting” period Technically, a listing can be called a pocket listing in the time between when the sellers’ agent secures the listing and when it appears on the MLS. For instance, if the listing sold to someone who knew about it outside the MLS (a buyer known by the listing agent, friend of

the seller, someone who works with the listing agent), or if it sold before the MLS paperwork was completed.

“Coming soon” scenarios Sometimes listings are pre-marketed through the brokerage and the agent’s social media network to drum up momentum and keep the seller happy while the listing is prepared for the MLS. Or, an agent will file an exclusion to give sellers more time to prepare the property. These practices can help to solidify the contact and provide attentive service to the seller: while the agent is giving the listing the official workup for the MLS (setting up photographers, virtual tours, preparing a marketing plan, completing paperwork), they are also quietly marketing the home. The seller’s agent lets her office agents know about the listing, alerts her buyers, and posts the listing on social media to create excitement without losing time to the process. Many sellers love the idea of possibly selling before the listing even goes up on MLS, if the price is right. Pocket listings have traditionally been more common at the upper end of the market, but now that inventory is declining, they can create a sense of urgency that generates greater buzz for a listing. Still, there are some questions and concerns about whether the best interests of the sellers, buyers and the market at large are served by pocket listings—especially when they are being used to generate sales between brokers of the same firm. Here are some areas where pocket listings get tricky, and when it is best to cover all your bases. In cases where the agent keeps the listing internal and “double-dips” on commission Critics of pocket listings say that some agents may be tempted to keep the entire sale

he year 2013 is over and done with, and we have all cleared the decks for 2014. After we take a few minutes to catch our collective breaths, we will all look back on last year with fond memories! 2014 is going to be a busy year for all of us as REALTORS, and several important topics that were started last year will continue this year.

The syndication decision was made to protect the data consumers use to make important decisions and empower REALTORS to assist their clients in the best way possible.

Some thoughts about syndication

What is the impact of the decision?

One topic that was hot last year was listing syndication. As you may know, the Austin Board of REALTORS recently decided to put the decision about listing syndication back into the hands of the brokers. As of April 30, ABoR will discontinue the facilitation of listing syndication to non-REALTOR consumer websites. As that date approaches, there is important information we must all remember for our businesses to make the transition.

The syndication decision

Here’s what the decision boils down to: After April 30, the Board will no longer offer an ‘easy button’ tool for syndicating listings. Brokers will choose independently whether to provide data to non-REALTOR websites on a listing-by-listing basis, determined by the client’s best interest. ABoR will continue syndicating listings to REALTOR-affiliated websites AustinHomeSearch.com, REALTOR.com and TexasRealEstate.com. These sites are trusted and accurate resources of property data provided by REALTORS.

new year is upon us and as we get older, the years start going by at a faster pace. We all need to live today to its fullest, for none of us knows what tomorrow brings. This past year we have seen things that we have not seen in a long time: multiple offers on homes before they actually go on the market, coming soon signs and pocket listings selling quickly, and the highest recorded monthly sales volume for Williamson County. This is all good news, but always remember what is the most important. Represent your client to the best of your ability according to our Code of Ethics. Treat your fellow REALTORS with the respect they deserve. Give back to the community that has brought us to where we are today. The Williamson County Association of REALTORS is committed to service and wants to serve you, our members. You have several opportunities to be more involved in your association by joining one of our committees listed below. Please contact the committee chairperson, if you are interested in joining their committee, to see if there are any spots

This tournament is a fun networking and team building opportunity, but it’s also a major source of revenue for the Association. —The Bylaws and Policy Committee, led by Elaine Byrne, reviews new policies and procedures, and helps implement the standards by which we all abide. —The Finance Committee, led by Shavonne Martin, ensures the financial stability of the Association. —The Events Committee, led by Tiesa Hollaway, organizes and leads many of the special events we have throughout the year, including the Super Bowl of Builders, the bus tours, the Wild Ride, the Holiday Bazaar, among others. —The TREPAC Committee, led by Mary Miner, facilitates communication between REALTORS and lawmakers, and raises money to support Texas legislators who protect property rights, encourage homeownership, and reduce regulatory burdens for the real estate industry.

ATP and QMs: The new challenges for homebuyers (and their REALTORS)

W

hen most Americans think about controversial legislation passed in 2010 that takes effect only this month, their minds jump to the Affordable Care Act. REALTORS and mortgage professionals have another law in mind: The DoddFrank financial reform act. On Jan. 10, the Consumer Financial Protection Bureau (CFPB) rolls out new rules governing how mortgage lenders originate loans. The regulations are designed to prevent shady or predatory lending and otherwise protect consumers. Financial institutions have been preparing for the changes for months. The big fear is that potential homebuyers will be blindsided. The two keywords from the new rules are “ability to pay” (ATP) and “qualified mortgage” (QM). The ATP provision requires lenders to gather extensive documentation to assure that borrowers will be able to keep up with their mortgage payments. One provision caps origination fees at 3 percent for loans of $100,000 or more. A more controver-

sial part requires that the mortgage payment, including taxes and fees, plus credit card and other loan payments not exceed 43 percent of a borrower’s gross monthly income. Lenders don’t have to adhere to the 43 percent debt-to-income ratio, but if they don’t, they probably won’t be able to sell the loan to Fannie Mae or Freddie Mac. Most of these loans won’t be QMs. Qualified mortgages are a new standard that excludes certain mortgages types — interest-only, adjustablerate balloon loans, and negative-amortization mortgages, for example — that helped prompt the housing crisis. Again, lenders are legally able to sell non-QM loans — but they won’t be protected from lawsuits if the loan goes south, as QM loans will now be. Most people agree with the goals of the new rules — safer loans and fewer defaults — and in fact, mortgage lenders insist they’ve already adopted many of them voluntarily. “Mortgage lenders have no appetite for loans that may go bad, the consequences are too far reaching, and the sins of the past are

still warm and steamy,” says Mark Greene at Forbes.com. But the devil is in the details, and details can bring unintended consequences. One outcome is almost certainly a decrease in new loans in the first part of 2014. The selfemployed and low-income borrowers are the most likely to be challenged by the new rules.

Real estate attorney Shari Olefson estimates that “about 20 percent of people who have mortgages right now will not be able to get qualified mortgages.” If you believe lax mortgage standards are a threat to the housing market, that’s probably a feature, not a bug. CRS Austin Chapter A S S O C I AT E S I N P R O G R E S S - A d v e r t i s e r P r o f i l e b y R i k i M a r k o w t i z

A

certified residential specialist (CRS) is an elite designation, and the highest credential, awarded to residential brokers and sales agents. In order to earn the CRS designation, at the point of submission, applicants are required to have sold at least $25 million in residential properties or show 75 transactions — all within a five-year period. Today, there are an estimated 38,000 certified residential specialists in the U.S. The Austin chapter consists of roughly 200 CRS designees and members. The two-year old Austin Area Chapter is the result of an evolution that began over two decades ago. Jim Smith, CRS, joined the Council in the 1980s, a time when there was only one state chapter representing Texas. Smith eventually achieved full CRS designation by 1990. He was the 17th CRS in the Austin market. In 1992, Smith, along with officers that are still active today, decided to create a local Council subchapter. The founders are Mark Minchew, CRS, recent CRS National president, Rise’ Johns, CRS, founding president of the Austin chapter, and David Pavliska, CRS. Smith recalls that the subchapter clipped along for a while but then the national organization declared there couldn’t be subchapters. The group was absorbed back into the state chapter — Lone Star. The founders continued maintaining a strong local presence and met regularly.

By the fall of 2011, the core Austin members took another stab at creating a local chapter and by then, the members got permission to form the separate chapter. “Oddly enough,” says Smith, “the founding officers of the official Austin chapter were basically the same group that formed the subchapter in the early 1990s.” By Jan. 2012, the Austin Council was validated, joining 56 regional chapters. Only about 3 percent of REALTORS have their CRS designation, according to the Council of Residential Specialists, a program that originated in 1977. Simply put, getting a broker's license is like getting a college degree; getting your CRS designation is like getting a graduate degree. “Here’s what is important about all this,” says Smith. “It’s not just taking courses. You have to have a lot of experience and actually close transactions. You must also show involvement in the REALTOR community.” One way Austin CRS members are involved with the community is through the organization's philanthropic program, Chapter with a Heart. Currently, its primary focus and recipient is Any Baby Can. Last year, the chapter also raised money for the Austin Board of REALTORS Foundation scholarship program, which awards two scholarships in the name of CRS. In its first two years in existence, chapter president, Rise’ Johns, CRS, was responsible for establishing the group. Smith, the na-

scent group’s second president, plans to reach out to young people in the real estate community, many of whom don’t see CRS as a shortterm attainable goal. “They look at it as something you need to be in the business for 20 or 30 years before you can earn it,” says Smith. Smith’s focus is growing his membership. Along with president-elect Michelle Busby, CRS, treasurer Hellena Frazier, CRS, secretary Christine Choate, CRS, and immediate past-president Rise’ Johns, the Austin officers are planning to reach out to the Austin Young Real Estate Professionals, among other groups, to let members know about CRS resources. The local chapter is putting together a mentoring program for new members and will assist them in earning their CRS designation. “For those of us who have survived different cycles of real estate phases, we feel we have a lot to offer to new members,” explains Smith. Austin chapter officers also plan to create more networking opportunities throughout Texas and provide more local classes. It doesn’t sound like attracting new members should be problematic. On the one hand, national statistics show the average REALTOR earns around $26,200 per year while the average CRS makes $79,000. On the other hand, members are required to prove their dedication to the industry with a proven sales record. This designation is not for the average broker. “It is for those REALTORS who view their real estate career as a profession and are willing to put forth a concerted effort,” says Smith. Being part of the larger CRS community affords even further benefits. The organization’s website lays out just a few: “CRS chapters offer a variety of services, including education and networking events to encourage referrals, newsletters, website and social media promotion, ad-

vertising and sponsorship opportunities, cutting edge business resources and more.” Another benefit of having a CRS designation is that today, consumers are more educated than ever before. Smith explains that buyers are researching whom they work with. “They don’t want to waste their time with someone who doesn’t know what they’re doing. They don’t want to make a bad investment decision.” Having a CRS designation alone does not necessarily mean you’re the professional to go to, but it’s the right starting point. The Council is very big on sharing information and helping each other out. “There’s a great deal of referrals that go on just within our chapter,” says Smith. The mindset of the CRS is that they’re always looking out for the client’s best interest. Smith explains that if he has a client who is looking for a property exclusively in south Austin, it’s likely that he’ll refer that client to a CRS member who specializes in that area. Essentially, it’s crucial for real estate professionals, including those who are CRS-designated, to be flexible and have the ability to work in a cyclical real estate climate. That’s why it’s important to surround yourself with professionals who know what they’re doing. “Nobody has a crystal ball,” says Smith, “but I can look at trends and say, ‘OK, I see where things are going.” With help from the national organization, which provides members with trending data and reports, you’re in a better position to see what direction things will go in over the next few years. For Smith, CRS afforded him the opportunity to learn a tremendous amount about real estate without having to make every mistake in the book. That’s just one more thing he wants to share with new members. RL

internal to the brokerage in order to collect full commission. This means that the brokerage completes the transaction in-house, collecting both the buyer’s and the seller’s agents’ commissions. If the broker only exposes the property to a select group of buyers, or a certain type of buyer, there may be a discriminatory effect. If competing brokers agree to work together where a minimum commission must be paid, and the listing is only exposed to a small pool of buyers, say, in an investment club, the arrangement would be considered price-fixing and would infringe on anti-trust laws. These are not the practices of most ethical brokers, and many times the broker will charge a flat rate for the pocket sales—much less than a full percent commission. When the data never gets into the MLS The biggest detriment to the market created by pocket listings is the potential lack of market data. Agents will enter the data from the contract into the MLS post-sale for the purposes of comps, but this doesn’t always happen. In these cases those who need statistical data in order to analyze home values aren’t seeing the full picture. Ultimately, says attorney John Hay of Hay Darby PLLC, the dwindling data in the MLS hurts agents down the road because it's harder to operate without a true market snapshot. In some states, public tax records contain all the information needed for appraisals, but since Texas is a non-disclosure state, the sold price of a home is not required on tax records. “To not enter the information into the MLS after a certain period of time is really doing some damage to the rest of the market,” says Avis Wukasch, TREC Commissioner, who adds that not only are there fewer comps available to

establish fair market price for appraisals, but also that the tax appraisal district uses data from the MLS to assess property values and retain public funding for the schools in the area. When agents do not properly disclose risk If your seller has opted to pre-market the listing off the MLS or keep the listing off the MLS altogether, an MLS-exclusion form in the contract is an absolute must. A disclosure warning that limiting the exposure to the property may lower the number of offers and potentially the sales price could protect you from potential lawsuits down the road if the homeowner later feels he could’ve gotten a better price for the sale. “The real legal discussion surrounds disclosure and educating your seller,” Hay says. “I advise agents to ask the homeowner to sign a disclosure stating that the seller understands that they are selling the house without it officially going on the market, and that it was not exposed to the full MLS of Austin.” A seller may have very good reasons for wanting to market the home off the MLS, and the agent may have thoroughly educated them about how exposure affects demand (a quick sale can be made without listing on the MLS, but REALTORS are still bound by the Code of Ethics to get the best deal for their clients.) Would an out of town buyer who never saw the listing have paid more for the home? There isn’t anything illegal about choosing not to list a home on the MLS, as long as that choice conforms to the seller’s wishes. As social media marketing becomes more prevalent, pocket listings can be a way to build buzz around a listing and test the market, as long as data is shared and the interests of the seller and buyer are the agent’s No. 1 interest. This is a person who will not be denied. The commitment is so strong, so clean, so congruent you just know they will do very well. And they typically do. I wanted to share a poem with you by W.N. Scott Norman wins AMBA's Kenton Brown Service Award W. Scott Norman, Sente Mortgage’s Reverse Mortgage Division vice president, received the Kenton Brown Distinguished Service Award. This annual award recognizes exceptional and outstanding service to the Austin Mortgage Bankers Association and the mortgage banking industry. The AMBA established this award to honor the late Kenton Brown, one of Sente’s founding partners and vice president of Sente Mortgage. Recipient Scott Norman, former AMBA president and 20-year active AMBA member is honored by this accolade. “I could not be prouder to receive the award," says Norman. “Kenton was a special person to a lot of people. He really defined service for me. We became friends during the last few years of his life, and I know how much he loved the mortgage industry and the Austin Mortgage Bankers As-

sociation. To receive this award with his name on it is something I will never forget.” Norman led the original campaign to amend the Texas Constitution to allow reverse mortgages in the state in 1999. Most recently he testified before the Texas House of Representatives and the Texas Senate and helped draft the reverse mortgage for purchase legislation that was overwhelmingly passed by voters this past November. The recipient of the Kenton Brown Distinguished Service Award must exhibit personal and professional integrity and make extraordinary contributions of time, judgment and talent to the mission and purpose of the AMBA. The honoree must also strive to bring credit to the AMBA by their work, actions and accomplishments. RL
