n Jan. 13, 2015 the 84th Texas Legislature will convene and make policy decisions that will impact the lives of real estate industry professionals. Throughout Texas’ 83rd session in 2013, 5,868 bills and 449 constitutional amendments were introduced. During that time, the Texas Association of Builders (TAB) tracked over 1,100 pro-real estate bills, including, but not limited to the State Water Implementation Fund of Texas; a

property rights amendment to SB 1596, giving home buyers control over installing fire sprinklers; and a homestead tax exemption for veterans. Of those, 182 were signed into law. This past November, voters elected a new slate of freshman legislators, plus a new governor and lieutenant governor. So on the eve of the 84th session, the question is whether real estate industry representatives have been able to make headway on top issues and forming relationships with the House and Senate’s newest, most influential members. On the plus side, says Scott Norman, executive director at TAB, many incoming representatives campaigned on issues that affect real estate professionals, as well as home owners and new home buyers. To find out what bills and constitutional amendments the Texas real estate community is working on in 2015, Realty Line spoke with representatives at TAB, the Texas Association of REALTORS (TAR), and Home Builders Association of Greater Austin (HBA). “The number-one priority for any number of associations, including HBAs across the state, is in finding adequate funding for roadways, which includes transportation and infrastructure funding,” says Harry Savio, VP of public policy for HBA Greater Austin. While Proposition 1 passed by a margin of four to one this past November, more work needs to be done to secure funding that will accommodate Texas’ population boom. Daniel Gonzalez, the government affairs representative at TAR, is confident that lawmakers are not going to increase fees or taxes. “We’re looking at taking the motor vehicle sales tax and dedicating that revenue stream over to transportation.” TXDot is estimating a $3.3 billion shortfall in funds without this bill. Historically, however, the outlook is not as promising as some would like. In their 2015 Public Policy Statement report, HBA said “the gasoline tax has not been raised from its current 20 cents

per gallon since 1991.” Water and energy-related legislation is another infrastructure concern shared by Williamson County Association of REALTORS (WC REALTORS) and TAB. During the 2015 Session, legislators are focusing on eliminating court-enacted barriers to implementing the State Water Plan, a 50-year approach to balancing infrastructure improvements, public interests, property rights, and water rights. As far as energy infrastructure legislation is concerned, Norman describes an atmosphere in which market demand has dramatically driven up the cost of all forms of energy in recent years. While there is a movement for greener, cleaner, less expensive energy options, consumers just aren’t seeing these savings. Second on the agenda is proposed legislation that deals with appraisals, taxation, and property values. “A lot of people would like to do something about property taxes, specifically increase property exemptions from $15,000 to something higher,” says TAR’s Gonzalez. In their 2015 report, TAR is calling for a homestead exemption up to $45,000. And that’s just “one component of a comprehensive solution for property tax relief.” The state already requires school districts to provide a $15,000 exemption to every residence homestead for the purpose of ad valorem taxation. Gonzalez worries that if costs continue to rise, “many first-time homebuyers will be excluded from purchasing a home.” Gary Cocanougher, 2014 president of WC REALTORS and broker associate at ERA Colonial, says “reducing property taxes is always on the minds of constituents, but it is easier said than done.” That sentiment is especially true when

Passing the torch As my term as president of the board wraps up, I am excited to pass the torch to a respected colleague and a true friend of mine, Barb Cooper. I want to be clear: Barb and I have different leadership styles, but we both believe that every decision made by your association must be in the interest of our members. As the 2015 president of the board, Barb will bring and build value to your association, and usher it into a new era—an era highlighted by integ-

rity, honesty, our new home, new leadership in the Austin City Council, new board members, and all of you. I think you will find 2015 the year that the members connect with the association under Barb’s leadership.

Where has the time gone? t seems like just yesterday when I sat down to edit my first column, and now it’s already January again. Well, it’s been quite the year. We’ve accomplished so, so much these last 12 months, so take a second and pat yourself on the back! No accomplishments would have been possible without the input of our members. I would like to thank everyone who has served our association with me, including the board of directors, volunteer committee members, and all of the members at large. It’s truly been an honor.

A New Year, a New ABoR

s you know by now, the new ABoR headquarters has opened its doors, and I hope you’ve had a chance to visit your new home. If you haven’t yet, come stop by! The new ABoR headquarters located at 4800 Spicewood Springs Road is the start of a new era for Central Texas REALTORS. The building was designed with your needs in mind: improved technology, more education options, and plenty of member space. In addition, our new logo and slogan are about building connections — connections that will prepare you to best serve your clients and the community. All of this change can lead to a lot of questions, but I encourage you to engage and ask those questions.

President’s Column By Jack Stapleton • 2015 President

What is the value of a REALTOR association?

A

s we usher in the New Year, the distant memory of all that was “2014” begins to quietly fade into the abyss. Some things, however, need to stay in the forefront! The industry in which we love and serve is quickly and somewhat quietly changing and it is up to us to determine the end point. If you pause for a moment and personally reflect upon the question “What is the value of a REALTOR association?” What comes to mind? While you are reflecting upon this; lets move on to another more esoteric topic for a moment; Time. Time is truly the world’s most precious and valuable commodity. It is non-renewable, finite, and wholly uncertain to the inventory that remains in the “vault” for our own personal consumption. We are busier today than ever before. Our schedules and calendars are packed, our days are long, and boredom has become a luxury that few can afford. This past year, 2014, was a record-breaking year. As of Dec. 31, 2014, we closed 27,255 units for a total of $8,511,884,044 in reported

residential sales; of that number, 9,101 units and $2,265,798,120 of volume were in Williamson County. That means 33 percent of the inventory, and 27 percent of the volume is in the WC, demonstrating the phenomenal growth in this area of Central Texas. During a time of unprecedented growth and prosperity, we were also hit head on with dozens of major industry issues where groundbreaking decisions were made that made national headlines. In times like these, finding the balance between the demands of our trade, our family obligations, our passion for philanthropy and our faith, we find our “time” being taxed into oblivion. Yet, many important issues stood before us requiring significant additional time commitments such as: syndication, unreported sales, multiple offers, pocket listings, coming soon, third party data integrity standards, water and groundwater conservation districts, improving our flagship MLS product so as to retire our legacy systems, and more. Each of these important topics required RE-

www.myRealtyLine.com ALTORS stepping up and getting involved in meaningful ways by learning the issues, joining committees, taking on leadership roles to ensure the marketplace is fair for consumers, that new emerging products, tools, and third party aggregators coming online are consistent with the integrity and high moral code we have subscribed to as part of our REALTOR Code of Ethics. Yet, looking ahead to 2015 we once again have no shortage of pressing issues facing us. Whether it is the fight for search engine keyword dominance, third parties continuing to present our data inaccurately, the future of Realtor.com, an astonishing lack of a national consumer industry website, affordable housing, transportation, water and conservation, or inventory shortages coupled with consistent population gains, we as real estate professionals need to focus. The Texas Association of REALTORS is over 80,000 strong and as of June 30, 2014 over 1 million strong across our great nation; (1,063,950 to be exact). A good friend and mentor recently reminded me that many times our biggest strength is also our biggest weakness. The greatest value of our REALTOR association is a powerful unified voice. Our strength is our size. Our weakness is disorganization. Our National Association has grown and changed over the decades. Originally formed as; “National Association of Real Estate Exchanges” in 1908. They later adopted the name; “National Association of Real Estate Boards”, and in 1974 was changed to what we know them as today; “The National Association of REALTORS”. I call this change in 1974 “The end of the identity crisis” for our National Association. It took our National Association 66 years to find its identity. It’s identity is you! Our National As-

sociation is not about the exchange of property, it is not about the local or state associations, it is about its members. You are the value of our Association. While our National Association found its identity, it is up to us to collectively harness the power of it. With a membership of over a million members we could literally move mountains. That is, as long as we put our heads together, stay organized, and speak with one voice. Let me clarify, not 1 million people with 1 million voices, rather, 1 million people with one, unified voice. Each of us has an inherent responsibility to learn the issues, get involved, join a committee, and if suited for it, step into leadership roles. The reward of our powerful unified voice is not fitted to be self-serving. As we work and give freely of our time to protect private property rights, discourage unfair taxation, and collectively build a strong foundation for consumers to realize their dreams of homeowners, the side effect of this builds stronger communities, a stronger REALTOR brand, and a thriving, relevant, dominant industry in which we can all continue to be proud to serve. So, when asked the question, “What is the value of the REALTOR Association” you are armed with the answer. But, more importantly as you are outlining your goals for 2015 add getting involved to your list. There’s an opportunity for you to contribute to your industry’s success regardless of your schedule. Read and share relevant legislative updates, become a Texas REALTOR delegate, respond to Calls for Action, or join a committee. There are tools such as YouTube which need to be utilized like the Natives utilize to keep marketing front of mind. And, YouTube is free. The practice of direct mail and cold calling are not to be thrown out to the curb but must be mixed heavily with the myriad of devices

that make for speed, humor, effectiveness and advertising previewed at the leisure of the client. Yes, the boomers and silents built the sales world with their concepts and practices but now the Generations Y , X and Z are building the sales world more efficiently as they believe anything is possible, should be tried and innovation is certain. RL

Who are the next marketers?

T

he next generation of marketers are marketing their products and services like none of us have done before. These are the Digital Natives. Digital Natives are primarily Generation Y and Z and to some extent Generation X. These generations have grown up with the latest technology; they use the tools and principles of the latest mobile technology to integrate their personal relationships and to market and plan their business success. Boomers are Digital Immigrants in that all the technology and Internet were learning curves for them which took “leaps of faith” and “giant steps of trial and error.” With every new tech tool, software, contact management program with the Immigrants, boomers and silents, there was a blind trust. That blind trust being if we conquered what we feared with the technology learning curve, we would increase our production and be more time efficient. While the Natives literally grew up with the tools in their hands, Immigrants took classes, tried out new concepts in the hopes of reshap-

ing the business world for the better. This has happened. In the days of paid newspaper and magazine ads as being the only tool truly available, those forms of marketing were costly. Today, with your own software, a good e-marketing task can be done with little money and simply more of one’s time needed. Showing a house for sale, or any product you are hoping to sell, via media, video and pictures take time and practice; once it is embedded in your ad, it is launched to hundreds of prospects and your cost is minimal while your coverage is huge. Digital Natives convey messages quickly. They do communication succinctly with texting and e-mailing and social media is targeting their prospects consistently. All Immigrants have to keep pace with the fast, efficient interactive and colorful marketing demonstrated by our Natives. There are some technologies that are changing daily and all Generations must be in the loop to keep marketing fresh. These

Myth or truth: Designations are Dead

es and no. Today’s REALTOR is less enamored with the “alphabet soup” behind their name. We can all agree that we are more focused on success than a title that comes with a designation. However, designations can be the key to an agent’s success. The truth, which agents may not be aware of, is that many of the designation events are the best place to network with top agents. We’ve all heard the definition of insanity; in real estate it's continuing to do the same things in our business, with the same people, and is unlikely to lead us to the next level in our business. Designations open the door to a new community of REALTORS. We just returned from a national CRS event where we networked with top agents and came away with innovative ideas to implement in our businesses. On a local level, the connections we make can be the most valuable link in helping us break through our current success ceiling. Most agents enjoy luncheons and events where we can ask questions of agents who bring different perspectives, training, and understanding. This is particularly valuable for top level

agents who are laser focused on their business and may not always have the time to organize and host this type of event themselves or simply may not have access to other top level associates in their brokerage. Another under-appreciated benefit are the educational offerings. The agents expect a higher level of education from designations because they are investing in their future. This year our local CRS chapter will host two weeks of unparalleled classes. The instructors are engaging and the material is focused on results in your business. In addition, we have opportunities for snap learning throughout the year. These 30-minute sessions and speakers at the luncheons give members insight to local real estate issues and trends. Many agents know when we have another CRS educated agent on the other side of the transaction that they are someone worthy of respect in the industry. The truth is that, even though the titles and acronyms may not be the most important thing, the value those designations bring to our clients, our industry, and our community of REALTORS is unmeasurable. With a mission of innovation and a community focused mentality, owner Roy Jones formulated a plan in 2012 that expanded the Georgetown Mortgage into the area of Reverse Mortgage lending. “He quickly recognized the need to establish a separate division of the company managed by experts in the Reverse Mortgage field,” Cook says. “A team of sales and operations managers was assembled, and together with loan originators, processors, underwriters and closers, the Georgetown Mortgage team has a combined 75 years of reverse mortgage experience serving the needs of the senior homeowner and home

Previously, Cook has held regional, divisional and national mortgage banking sales positions with both traditional and reverse mortgage lenders. After more than 40 years in the mortgage banking business, Cook refocused his efforts in 2004 to managing reverse mortgage wholesale and retail sales positions, which allows him to assist senior homeowners and buyers with financial planning and retirement home purchases through a reverse mortgage. In April 2014, a desire to reduce travel and to educate Texas seniors and their trusted advisors on the benefits of reverse mortgages led Cook to Georgetown Mortgage. “One hundred percent of my business is based on referrals from long-time friends in the mortgage and related businesses, REALTORS and financial planners. I would only have made this decision with a locally-based company like Georgetown Mortgage, a faith-based business with private ownership, full mortgage banking services for reverse transactions, support like I’ve never enjoyed and absolutely zero bureaucracy,” he says. In addition to educationally focused employees, Georgetown Mortgage makes education a priority through continuing education courses for those in the industry. Financial planners can attend a class on reverse mortgages, and REALTORS can benefit from one-hour “Lunch & Learn” presentations or

you consider that in 1997, the state-mandated homestead exemption was tripled to $15,000, but since that time, resident homestead values have dramatically risen in value, making the increased exemption less and less of a relief for homeowners. For Norman, lowering appraisal caps on residential properties is also an agenda topper. Before the end of 2014, Senator Robert Nichols (R-Jacksonville) filed a constitutional amendment to slow the rapid rise of tax appraisals. Reforms and constitutional amendments are another way TAR, HBA, and TAB are working to initiate change. In recent years, access to an abundant amount of capital has created a situation where homeowners in some states are in debt to banks for amounts that exceed the value of their homes. For a long time, Texas has had some of the most conservative equity-lending protocols in the country. But for the past two decades, lender groups, as well as other interests,

have been working to loosen these protections. This legislative session, TAR is in opposition to diluting constitutional protections to home equity loans. While representatives of TAB, TAR, and HBA are already talking to legislators in their respective districts, industry professionals can get involved, too. “We encourage our members to donate to TREPAC, which fights for our rights, but more importantly, fights for the rights of property owners that we represent,” says Cocanougher. “With the new leadership in place, and starting a new legislative session, it is crucial that all of us support our representatives and let them know how we feel about the issues.” Gonzalez encourages Texas REALTORS to sign up to be a legislative liaison. Volunteers receive frequent e-mail updates from the TAR Governmental Affairs department during the legislative session and then on a monthly basis thereafter. These notifications will keep liaisons updated on legislative and political events nationwide. RL
