Child abuse, a social stigma in the society

T

he sexual offence against children is an act of unparalleled in the annals of crime in this country. Most of the cases occur owing to non-awareness of the punishment imposed by the court recent and past time. The incident occurred against the sexual offence to the children because of the social and societies system prevailing in this country. The human beings are called social animals among the societies; it does not mean that the male person should dominate over the children. Before taking to act against the children they should think twice or thrice to have sexual by forcefully by the rapist the consequences. The human body function differs from person to person as a result most of the sexual offences occurs. The main reason in the male body has the symptoms called ‘Testosterone’ which means that the hormone produced by the testes which stimulates the development of sex characteristics. The same act not only penetrates but also stimulates the person to do sexual offences. At that juncture the person should undergo proper medical treatment then only the same can be controlled and can be relieved from that act. At the same time our Judgement Delivery System lacking some point of time, Whereas the Judgement Delivery System in some Foreign Countries comes as quickly as possible. So that the victim get better relief very quickly. A few years back a murder took place in Chennai, Tamilnadu. In this murder case the investigating officer took up the case immediately and filed FIR and secured the accused subsequently filed a Charge Sheet before the concerned Hon’ble Court. The Hon’ble Court had took up the murder case on file and instructed the Investigating Officer to complete the trial on daily basis. The Investigating Officer also took up the challenge and conducted the trial on daily basis. The murder case was completed within 17 days in a rapid way. The Judgement was delivered by the Judge on the 17th day. This is the quickest Judgement. In another case during the year 2018 in the State of Rajasthan four persons were arrested under POCSO ACT, the Honourable Court has conducted the Trial in day to day affairs and completed the Trial within 16 days and the Judgement was delivered after four days in all total it took twenty days for delivering the

Judgement. The respectable Honourable Court has convicted all the four accused for pronouncing Life Sentences. This is the another case for completing the Judgement within twenty days. If the Court and the Investigating Officer act according to the above case, the crime ratio will come down particularly the gravity of the offences particularly sexual offences against Children as to be fixed as time bound case. So that the Crime ratio will come down against Children Sexual Offences . The time period for conducting the crime for POCSO Act commencing from 30 days to 1 year period. In order to avoid Sexual Offences against children to utilize the Media like Televisin, Radio, Paper Publication. Social Media that it will take to the general public to know about the Punishment if any person indulge such an act and also to create awareness among the public. The sexual abuse of children is one of the most heinous crimes in India. It is an affailing violation of the trust, confidence and courage. It is our duty to protect the innocent children. In the year 2007 a study conducted by the Ministry of Women and Child development found that more than 53% of the India’s children had undergone rather experienced some form of the sexual abuse. Now the percentage of the sexual

abuse against children is being raising day by day. The sexual abuse of the children can occur in a different number of settings either by Intrafamilial or by Extra familial. A rape of a minor in Dhanajoy Chatterjee vs. State of WB which involved a rape cum murder the Trial Court. The High Court and the Suprement Court unanimously agreed it to be a fit case of imposition of fine of death penalty. The object of sentencing should be to the criminal does not go unpunished and the victim of crime as also the society as the satisfaction as justice has been done. The recent amendment in Protection of Children from Sexual Offences Act, 2018 has been given enough relief and compensation for medical treatment to the children at the same time the perpetrator should not be let-off instead they should undergo the rigorous punishment till their death.

IPL 2019: A breeding ground for overseas players to strike form ahead of the World Cup

Supreme Court in a fix In a very dramatic move, the Supreme Court has ordered for the immediate assistance and talks with the top investigative agencies to probe the set of fixers in the judiciary's jurisprudence for manipulating and for getting favourable orders. The Court took a serious note over the allegations that two of it's women staff members who were earlier dismissed from services for altering the order of the industrialist Anil Ambani contempt case. The two women employees are said to be in collusion with the industrialist for favours and accused the CJI of sexual harrasment. There is also a sensational claim that there is a cash for Judge club in Delhi for getting favours in

judgments averred one lawyer, Utsav Bains who made a sensational claim that he was offered a bribe of 1.5 crore by a middleman named Ayay to frame CJI in a false case of sexual harassment which is a very serious issue. Immediately, the S.C has appointed a Special Bench consisting three judges to delve deep and go into root of the system which is a serious lacunae in the system. The S.C has also appointed three member judges under the head of of Justice Bobde, out of which there are two women judges to enquire and verify the bonafides of the sexual harassment charges and find out the real truth in the matter at an early date. that such judicial fixing is happening in the judiciary now adays which is an evil and should be eradicated sooner than later lest the faith in the system by the people will be lost. However, now it is a welcome sign by the S.C for ordering to find out the root causes of the system and probe the said matters in entirety and put a full stop for such evil designs. Otherwise, the entire system will go awry.

Formation of Lokpal - Kudos to Supreme Court It is a great welcome news in independent India that P.C.Ghose, an eminent retired Justice of Supreme Court has been appointed as Chair person of the First Lokpal and a panel of judicial and nonjudicial members after an unjustified long delay of 5 years a.e with the persistant pressure from Supreme Court. The body, being an anti-graft mechinery will fight corruption in high places. It is an anti-corruption Ombudsman which is an institutional mechanism. Thanks to Anna Hazare movement had pressurised the government which finally enacted a law in 2013 which was effected wef 16th Jan 2014. There was tardy progress except declaration of assets by public servants.

Despite Supreme Court's repeated insistance, there was lack of political will which was tardy and slow. Then Supreme Court expressed total displeasure over the delay and issued a stern ultimatum to appoint Lokpal within a time frame. The appointment is a two stage process.First, selection committee, recommendation of panel of names to the high power committee, consisting of Prime Minister, Speaker of Lok Sabha, head of opposition party and Chief Justice of India or his chosen representative. The selection panel has to choose for the posts of Chairman, Judicial and non-Judicial members. In a historic verdict on April 2017, S.C rejected the excuse of the government that there

is no leader of opposition. S.C sternly said that there is no bar legally on the selection of committees. Mallikarjuna Kharge of Congress did not attend the committee meeting and demanded full membership. At long last, the Lokpal is committed and the corruption matters have a better say in the redressal system. Lokpal will take over the work of prosecution and thereby order for the preliminary and full fledged investigation. The Chairman and members of Lokpal have a historic responsibility to live upto people"s expectations to wipe out corruption at high places. At least, there is a sigh of relief now. About three centuries back, there were noble people like Appayya Dikshitar, Govinda Dikshitar and Thiruvisainallur Ayyaval who did yeoman services to the society especially the poor and downtrodden people which are recorded history. The 12th edition of the Indian Premier League is moving into its business end. By the end of this week, each team would have played twelve matches. The beauty of IPL is the pace at which the tournament moves. Sometimes it seems like the tournament has just now started and at the blink of an eye, one would find the tournament reaching the half way stage. For an ardent cricket fan, depression will slowly set in at the halfway stage and before realizing what is happening, the tournament would be over and out. One will have to wait for another year for the next IPL feast. It goes without saying that this year’s IPL has been dominated mainly by overseas players. Which raises the question of whether this edition of IPL is acting as a breeding ground for overseas players to strike form ahead of the 50-over World Cup in England. Though the IPL and the World Cup are different formats played in different conditions, the form and confidence of the players going into the World Cup will have a huge impact on the fate of the participating nations. In this article, let us discuss whether this year’s IPL offers comparatively better opportunity for overseas players to find form ahead of the World Cup. Performances of Overseas Batsmen in IPL 2019 The top three spots for the most number of runs scored in this year’s IPL as on 24th April’ 2019 have been occupied by overseas batsmen David Warner (574), Jonny Bairstow (445) & Chris Gayle(421). Out of the top 10 run scorers, 6 are overseas batsmen. Strike rate wise Andre Russell (218) topped the list followed by Rishabh Pant(163) and Chris Gayle(159). Pant is not part of the 15 member squad announced for the World Cup. In hindsight, Pant should have been selected for the World Cup ahead of Dinesh Karthik for two reasons. First and foremost, he is a left hand batsman and as such there are no lefthanders in the middle order in the squad. Secondly, both Dhoni and Karthik won’t be around for the next World

Cup in four year’s time. Had Pant been selected, he could have had a feel of the World Cup mega event. Coming back to IPL, this year’s IPL has provided the much-needed match practice for both David Warner and Steve Smith (295) who are coming back to cricket after a long lay-off. Bairstow, playing in his first IPL season, has a successful outing. This year’s IPL has improved the prospects of West Indies players like Andre Russell and Kieron Pollard to find a place in the World Cup squad. On the contrary, out of the Indian batsmen selected for the World Cup, only Shikhar Dhawan(401), KL Rahul(399), Virat Kohli(387) and MS Dhoni(314) have shown reasonable form with the bat. The other regulars like Rohit Sharma(228), Kedar Jadhav(156), Dinesh Karthik(117) and Vijay Shankar(165) haven’t exactly covered themselves with glory. Conversely, the so called fringe players like Rishabh Pant(336),Shreyas Iyer(331) and Ajinkya Rahane(318) are in tremendous form. But they are unfortunately not part of the World Cup squad. Performances of Overseas Bowlers in IPL 2019. Amongst the bowlers, Kagiso Rabada tops the list with 23 wickets followed by his country man Imran Tahir with 16 wickets. The other overseas bowlers like Chris Morris(12) and Jofra Archer(11) have also found a place in the top 10. Sam Curran did no harm to his confidence by taking a hattrick against Delhi Capitals. The Indian bowlers selected for the World Cup have done reasonably well with Yuzvendra Chahal(14), Mohammed Shami(13), and Jasprit Bumrah(11) finding a place amongst the top 10 bowlers in IPL 2019. However, Ravindra Jadeja(9) Bhuvneshwar Kumar(8) and Hardik Pandya(8) have a pretty ordinary IPL with the ball.

The biggest disappointment of this IPL so far has been Kuldeep Yadav. He has taken a mere 4 wickets in 33 overs at a strike rate of 50 balls per wicket and economy of 8.67 per over. Kuldeep’s mystery has evaporated in this year’s IPL due to continuous exposure to overseas batsmen. Kuldeep’s over exposure in IPL doesn’t augur well for India in the World Cup and his confidence has been shattered on account of the hiding he got at the hands of the batsmen. The fringe bowlers like Deepak Chahar(14), Shreyas Gopal(12), and Rahul Chahar(9) have all performed beyond expectations. The performance of Virat Kohli the leader. The biggest worry for India ahead of the World Cup is whether the losing form of Royal Challengers Bangalore in the IPL 2019 will affect the leadership of Virat Kohli in the World Cup. RCB under Kohli has lost their way and lost the winning habit in IPL. They have won only 3 out of the first 10 matches.In this year’s IPL, at times, Kohli looks helpless on the field with his hapless bowlers. Though the arrival of the champion bowler Dale Steyn has strengthened RCB’s bowling resources, the continuous toll should affect any Captain, leave alone Kohli. Though Virat Kohli the batsman is far too good to be affected by his performances in IPL, it would definitely affect his confidence and outlook as India’s captain in the World Cup. To sum up, IPL in the past has helped to shape up the careers of so many overseas players. In fact, a player with the talent of David Warner was first identified by the Delhi thinktank before the Australian selectors. Judging by the performances of the players in this year’s IPL, it seems the IPL might end up doing more favours to overseas players ahead of the World Cup in terms of form, confidence and match practice. Without prejudice to the fact that IPL is a different format, it would certainly have a positive impact on the confidence and performance of the overseas players in the World Cup.
