MANTI — John Coltharp appeared before Judge Marvin Bagley May 2 in Sixth District Court for a pre-trial conference. During the hearing, Coltharp expressed his dissatisfaction with his representation and insisted that he, Coltharp, should be allowed to represent himself to make sure certain facts were told to the jury during his upcoming trial. Coltharp is being represented by court-appointed defense attorney, Paul Frischknecht, who has advised Coltharp against making the change. During the conversation with Judge Bagley, Coltharp said he didn’t like the misinformation that’s being told. He said, “There’s a lot of truth to what has been presented.” To which Judge Bagley warned Coltharp, “You just made an admission there!” Coltharp was repeatedly warned about making admissions, which could be used against him at trial and was told, “You should not do that.” Frischkencht was asked by Judge Bagley if he would be willing to assist Coltharp as necessary as a “stand by counsel.” To which Frischknecht replied, “No.”

During a pre-trial conference held May 2, John Coltharp considered whether to fire his attorney. Another conference has been set May 30, prior to the start of Coltharps trial-by-jury on July 9. A private meeting was then held with Judge Bagley and both lawyers. There was also a meeting with Coltharp, his attorney, Frischknecht and Sanpete County Attorney Kevin Daniels. After the consultations were done, Coltharp decided to retain his appointed attorney, for now. Daniels reported that a plea deal had been made to Coltharp in an effort to eliminate the need in

this case for the child victims to testify in court. Coltharp expressed some interest in the plea deal that was offered. Coltharp is one-of-two Utah men who believe in polygamy and doomsday and allegedly have sexually abused young girls after conducting secret marriages they thought were ordained by God, according to prosecutors. Each man believed they were married to two girls, ages four through eight, one of whom was related to them, prosecutor Kevin Daniels said. The pair formed a group called Knights of the Crystal Blade and created a remote, makeshift compound from shipping containers in the southern Utah desert. Months ago the children of Coltharp were rescued from the compound. They are currently living with their mother at an undisclosed location in Colorado while Coltharp awaits trial. A follow-up pre-trial conference has been set May 30, prior to the jury trial scheduled to begin July 9, in Sixth District Court, Manti. Coltharp is facing charges of child kidnapping, obstruction of justice-harbors or conceals a person, sodomy and child bigamy.

2018 Utah Primary Election set June 26 MANTI — Now that the political party conventions are over and the various parties have selected their choices for political office, it is now time to consider the Primary Election. The 2018 Utah Primary Election has been scheduled to take place on Tuesday, June 26. This year there will only be primary run-off elections for Republican voters in Sanpete County. It is a small ballot with only four

with turkey theft, burglary

candidates on it, but the vote is important as those selected in the primary will move on to the General Election in November. There are two races in Sanpete County with two Republicans each, who are seeking office. The two seats up for election are, Sanpete County Commissioner Seat A, and the Utah U.S. Senate seat being vacated by Senator Orrin Hatch. The two Republican candidates seeking the commissioner seat are

Edwin B. Sunderland and Justin B. Atkinson. The two candidates seeking the senate seat are Dr. Mike Kennedy and Mitt Romney. The Sanpete County Clerk’s Office will soon mail letters to all active unaffiliated voters in the county, to notify them of their ability to vote in the upcoming Primary. To vote in the primary, all unaffiliated voters will need to become affiliated with the Republican Party. Anyone who has questions about

their status is welcome to call the Sanpete County Clerk at (435) 8352131. All active affiliated Republican voters will receive ballots by mail for the Primary Election. Those ballots will be mailed out starting May 29. Any voter that has not received a ballot by June 15, and wants to vote in the Primary Election should also contact the Sanpete County Clerk.

MANTI — Six members of an animal rights group known as Direct Action Everywhere (DxE), were charged with burglary and theft, on May 2, by Sanpete County Attorney Kevin Daniels, for their actions during January 2017 at one of the turkey farms contracted to raise turkeys for Norbest. The six defendants charged and named are Jonathan David Frohnmayer, Diane Gandee Sorbi, Samer T. Masterson, Wayne Hansen Hsiung, Andrew George Sharo, and Paul Darwin Picklesimer. The six persons charged in the incident have been summoned to appear at a hearing scheduled Wednesday, June 13, in Sixth District Court, 160 North Main, Manti. All six defendants have been charged with burglary of a building, a third degree felony; specifically that each defendant, as a party to the offense, did enter or remain unlawfully in a building or any portion of a building with intent to commit a felony. In addition, each has been charged with theft, a third degree felony; specifically that each defendant, as a party to the offense, did obtain or exercise unauthorized control over the property of another with intent to permanently deprive them thereof and the property taken was poultry being raised for commercial purposes. The activist group recently announced is a press release that the six activists were charged following, “a nine month investigation of national turkey supplier Norbest.” Their press release goes on to state that the group, “removed a sick turkey chick from a massive industrial shed, in an act they call “open rescue,” and took the bird to a vet.” The press release further advocates that “rescuing a dying bird is not a crime; it’s an act of compassion.” The group has estimated the chick’s age as around one month old and has refused to release the name or contact information of the veterinarian involved. Last November 2017, the activist group released the results of their alleged investigation and the next day they disrupted a turkey pardoning speech at the Utah State Capitol which was attended by Governor Gary Herbert. In the press release, the activist group repeatedly refers to their actions as an investigation, as in, “The 2017 investigation uncovered…..”, and, “A day after the investigation’s release in November 2017…..” Please see TURKEY, Page A1
