Responsibilities of the government agencies under the Ministry of Justice

Office of The Minister is responsible for information collection and analysis with a view to preparing recommendations for the consideration by the Minister. The Office also supports the Minister in his administrative and political duties by collaborating with other Ministries, the Parliament and public; reviews petitions and complaints submitted to the Minister; and performs other tasks as may be required by the law, the Ministry or the Cabinet.

The roles and function of the Office of the Permanent Secretary are as follows: 1. 1. Take charge of the administrative work of the NCJAD and other works as assigned by the commission. 2. Study and analyze policies, strategic plans and management guidelines of the justice system as directed by the NCJAD. 3. Support and implement the justice strategic plan. 4. Coordinate and conduct researches on law, justice administration system and criminology, as well as conduct follow-up and evaluate law enforcement. 5. Department of Special Investigation กรมสอบสวนคดีพิเศษ

The missions of the DSI abided by the ministerial regulations are to prevent, suppress, and control serious cases affecting the nation’s economy, society, security, and safety by monitoring crime, investigating, and prosecuting criminals so as to protect and preserve nation’s income; to suppress corruption; and to dismantle transnational organized-crime. The power and duty of the DSI are as follows: 1. To deal with administrative work of the Board of Special Case (BSC) under the Special Case Investigation Act and related laws; 2. To prevent, suppress, and investigate serious cases pursuant to the Special Case Investigation Act and the rules or the resolution made by the BSC as well as to perform its work conforming to the Criminal Procedure Code and other laws relating to the criminal offences regarded as special cases; 3. To study, collect, systematize, and analyze information for the benefit of performance of the BSC and for serious crime prevention, suppression, and investigations; 4. To educate about, train on, and develop a special case investigation system as well as to enhance knowledge and evaluate work performance of DSI’s personnel; 5. To perform its work relating to the laws and regulations under the responsibility of the DSI and related work; and 6. Justice Administration Cluster

Rights and Liberties Protection Department กรมคุ้มครองสิทธิและเสรีภาพ Department of Rights and Liberties Protection Department of Rights and Liberties Protection is responsible for promoting, protecting and guarantee the people’s rights and liberties in accordance with human rights standards. These responsibilities consist of providing legal and financial aid such as state compensation for innocent injured person or accused in criminal cases in compliance with the Compensation and Expenses for Injured Person and the Accused Act B.E. 2544 (2001) and the Amendment of this Act (No. 2) B.E. 2559 (2016), receiving human rights violation complaint, providing free legal advice, providing financial assistance for lawyer fee in order to ensure the right to counsel, at investigation process, for the accused which is in line with Section 134/1 of Criminal Procedure Code. Other services provided by the Department also include promoting dispute resolution, providing witness protection in accordance with Witness Protection Act B.E. 2546 (2003) as well as disseminating knowledge on rights, liberties and human rights.

Legal Execution Department กรมบังคับคดี

Legal Execution Department has missions relating to civil case enforcement and bankruptcy case management and debtor’ business reorganization under the court order, liquidation under the court order, receipt of deposit money or property, and property valuation, by the process of seizure, garnishment, disposal of property, collecting bankruptcy case debor’s property, including monitoring a debtor’s business reorganization. To serve the purpose that the creditors and interested persons receive a just compensation, the Legal Execution Department shall have the powers and duties as following; 1. Proceed civil case management under the court order. 2. Proceed bankruptcy case management under the court order. 3. Proceed debtor’s reorganization under the court order. 4. Examine interested persons’ accounting right for receiving dividends. Examine expenses and charge for execution fees. 5. Liquidate partnership, company, or juristic person on behalf of liquidator under the court order. 6. Receive deposit money or property from debtor and entitled individuals. 7. Carry out the valuation of properties. 8. Serve notices, pleadings, documents or order of court, or other agencies under the Legal Execution Department. 9. Department of Juvenile Observation and Protection กรมพินิจและคุ้มครองเด็กและเยาวชน

The Department of Juvenile Observation and Protection (DJOP) of the Ministry of Justice, Thailand, is the organisation of the Thai government that provides services for juveniles and families in criminal and family cases through the Juvenile Observation and Protection Centre, juvenile remand homes and juvenile training centres throughout the country. Promoting a better treatment for children in conflict with the law is the most important aim of DJOP: that is, to bring positive changes into the lives of juveniles in the juvenile justice system by delivering excellent services for children’s rights protection, rehabilitating children in conflict with the law and reintegrating productive juveniles back into society.

Department of Corrections have a mission in keeping inmate custody and rehabilitation the behavior of inmates and persons who are under the control or supervision of the duties and powers of the Department. To develop the Department to be an efficient human resource development organization. To rehabilitate inmates and persons who are under the control or supervision of the duties and powers of the Department for successful reintegration and for being a good physical and mental person. To provide academic and vocational training for ensuring that inmates have the basic skills and abilities to find employment and have a normal living in society after they have released. Department of Correction have the following authorities and duties 1. Providing treatments for offenders according to court rulings by means of Penitentiary Act and relevant laws 2. Stipulating guidelines of treatment of prisoners under relevant laws and regulations, penological practices, and the United Nations Standards on Treatment of Offenders and all relevant United Nation suggestions 3. Providing social welfares and welfares for prisoners and the person who is under the control or supervision of the duties and powers of the Department. 4. Develop a system of standards, measures, standardized procedures and the treatment of one who are under the detention in order to be checked in the premises for verification according to the law on drug rehabilitation. 5. Performing other duties assigned by the Ministry of Justice and the Cabinet.
