Another year passed, and it was a doozy in the real estate world. 2022 turned out to be quite the roller-coaster ride, with rising interest rates, cooling prices, and the shift away from being a seller’s market.

In my column over the past year, we discussed new problems and rehashed some classics. I have put together a few thoughts to help you navigate the ebbs and flows of the 2023 real estate market.

– Document everything. When something happens, take notes and photographs as soon as you can. If you communicate with someone on the phone, follow up with an email. It is easy for someone to deny what was said on a phone call, but a follow-up email or photo creates a permanent record. In my experience, photos, notes and emails carry more weight with the court than recounting the memory of what was said a long time ago.

– When your home is damaged, the first thing you should do is stop it from getting worse. Too many people will let the problem fester

while they try to get the person who caused the problem to fix it. If the problem later turns into a lawsuit, it is hard to recover for damage you could have avoided.

– No one likes to pay for insurance, but you should still maintain the best insurance you can afford. Repairs are expensive and tend to be necessary at the most inconvenient moments. Lawyers are expensive, and even a small lawsuit, like one from your downstairs neighbor because of a leaking pipe, can lead to a massive legal bill that proper insurance would have covered. And yes, this applies to individual insurance covering your

condominium unit. The building’s policy rarely provides the unit owner with much help.

– If you live in a community association, be ready to follow the rules. Association living is a tradeoff. Know your community’s rules before you agree to live there.

– Even though getting permits is a hassle, if you get in trouble for unpermitted work or if the work is not done to code, it will be difficult and expensive to fix. And unpermitted work is usually found when trying to sell your home, which is far from the best time to deal with it.

Whether you’re a millennial, retiring or starting a family, the beautiful state of Colorado hit all the right buttons in 2022.

Rated exceedingly well for desirable factors like a high quality of life, a robust job market, and strong economy, Colorado appeared in the top ten on multiple “best of” lists published in 2022 by analysis websites U.S. News & World Report and WalletHub.

Colorado named 10th Best State for Millennials

Starting with millennials – the generation quickly rising in their rate of home ownership – this mid20 to early-40-year-old group chose Colorado as a favorite place to call home, scoring the state in the No. 10 position in the 2022 WalletHub analysis

With a population of around 80 million, millennials surpassed baby boomers in 2019 and are now the nation’s largest generation. Millennials control more than 21% of consumer discretionary spending in the U.S. and hold trillions of dollars in purchasing power as well as higher educational attainment, according to WalletHub.

e analysis compared the 50 states and the District of Columbia across 34 key metrics and sorted locations based on a ordability, education and health, quality of

life, economic health and civic engagement. Overall, Colorado scored as follows on a scale from 1 to 50, with 1 being best and 50 being worst:

• Economic health: 10

• Education and health: 23

Boulder and Fort Collins: Best Places to Live for Quality of Life

Many factors make up “quality of life” and at least two Colorado metros deliver them in abundance.

Boulder ranks No. 2 across U.S. metros while Fort Collins shines in the eighth position, according to the 2022-2023 U.S. News & World Report’s Quality of Life Index.

Boulder pulled a quality-of-life score of 7.7 on the U.S. News’ Index, topped only by Ann Arbor, Mich., with a score of 8. Fort Collins hit eighth and achieved 7.2

for quality of life.

What makes these areas such an exceptional life-quality place to live? A beautiful Rocky Mountain backdrop surrounded by open space is a good start. e foothills are not only a feast for the eyes; the area is a haven for outdoor activity. “Trail runners, hikers, climbers, cyclists, and more move here to live in this perpetual playground, where the answer to “What do you do?” is often one’s activity of choice, not occupation,” writes U.S. News.

Why invest in real estate in 2023?

Most people consider their single-family home they live in as an investment in real estate.

In fact, when they fill out a financial statement, it is even listed as an asset. It’s true that the home will likely go up in value over the years, and as the loan is paid off, it could represent a significant part of a person’s net worth. However, in the truest sense of the word, the personal residence is really a liability rather than an investment.

Think about it: for your home, you are paying the mortgage payment, taxes, utilities, maintenance, etc. It all adds up to a pretty good amount of money being expended each month with no money coming into the equation from the property. It really is a liability.

Now think of a single-family rental property. If you have an amortizing mortgage on it and the rent pays the mortgage and expenses, each month you build equity via principal reduction. Eventually rents go up and the property becomes free and clear. It produces cash flow that you can use for buying groceries or daily purchases, for example.

Potential for appreciation

Residential real estate has proven to be a good investment over the years. Over the long term, values have

The primary reason appreciation occurs is job growth. If job growth is occurring, new families move and need a place to live. When job growth stops, the real estate market will level off. Job growth is even more important than interest rate levels on the overall market. Lower interest rates will stimulate the local move-up market. If someone doesn’t have a job, it probably doesn’t matter what the interest rate is.

Debt reduction

Every month when a payment is made on a mortgage, a certain amount goes towards principal reduction. If one of your goals is to own real estate free and clear with no mortgage payment, a payment schedule can be created on a 30-year loan that will pay off the loan in whatever timeframe is desired. In the case of an investment property, rent is covering the mortgage payment. Each month that goes by, the tenant is helping pay off the loan and equity builds.

Leverage

The concept of leverage is what is known as using “other people’s money” or OPM. When investing in real estate, it makes the most sense to get a loan for a good portion of the purchase price. To illustrate

If the real estate market were appreciating at 5% a year and you held the property for five years, the condominium would be worth $122,347 or a gain of $22,347.

Now let’s say that, instead, you took that same $100,000, put $20,000 down on each of five $100,000 condominiums. You now own $500,000 worth of real estate. If the market appreciates at the same 5% per year for five years, your real estate would be worth $638,140 or a gain of $138,140 on the same $100,000 investment. As you trade up, it is important to keep your equity position at a level that allows you to survive downturns in the rental market.

Tax break

Everyone should consult a tax advisor on how ownership of real estate will affect them personally. The 1986 Tax Reform took away many of the major benefits of owning real estate and made real estate “pay for itself.” Today, there is no “doubling declining depreciation”. We still have depreciation, but it is subject to income limits and other rules. Depending on how someone fits in with the IRS rules, they could potentially get a tax break for a property’s depreciation. Depreciation is a tax concept whereby you get a write off, but don’t have to spend the actual dollars to get it. For example, on a $100,000 purchase, an accountant may choose to declare

80% of the value as depreciable. You can’t declare the whole value as depreciable because some of the value is attributed to land and land doesn’t “depreciate.” Therefore, in this example, $80,000 would be depreciable. Under the current IRS rules, you can take the $80,000 and divide it by 27.5 years for an annual depreciation deduction of about $2,900. In addition to depreciation, real estate taxes and other expenses of the property can offset rental income. The bottom line is that real estate, in the early years of ownership, will show a loss, which results in a tax deduction and tax savings. There are limits as to the amounts that can be deducted due to real estate losses. Depreciation can also be “recaptured” at time of sale, which means that there is a higher taxable gain. You need to consult a tax advisor to determine how all the IRS rules will affect you personally.

Cash flow

In the early years of ownership, especially in Boulder, it is difficult to achieve immediate positive

cash flow. In other words, when a property is first purchased, the rental income probably won’t cover the mortgage payment and all the expenses. If the cash flow is about break-even on a month-to-month basis, after taxes and appreciation factors are considered, the overall cash flow is positive. After owning the property for several years, rents should go up while the mortgage payment on a fixed rate mortgage stays the same (except for increases in taxes and insurance), and the monthly cash flow increases.

Liquidity-conversion to cash

Real estate is not a “liquid” investment compared to many other investments available. If someone needed to sell a property to generate cash, market conditions will dictate how marketable a particular property will be. Generally speaking, individual housing units, whether single family or condo, have been readily saleable in our marketplace. However, one does not need to sell a property in order to generate cash. If you have owned the

property for a while and its equity has increased, you can refinance your loan to pull cash out. With refinancing, you don’t have to pay any selling expenses or pay any tax on the cash pulled out. The money can be used for daily expenses, other investments, or for the down payment on another rental property.

Single family for appreciation

In Boulder, rents compared with value don’t create much cash flow. So why do people still buy them as investments? 2023 Home Color Trends

With a new year comes new trends. And while interior design is more about personal taste and bold creativity, trends are cornerstones of good design in their own right. They can guide your designs when you don’t feel particularly inspired. And they can inform your choices when all of the options feel like too much.

According to Realtor.com, six paint colors will be influencing 2023’s interior design trends.

Warm greens

For a comforting and natural look, warm green tones are a great way to go.

“Warm greens are welcoming colors that feel rich yet vibrant,” Gena Kirk, vice president of Corporate Design Studio, told Realtor.com. “We have seen an increased interest in greens in kitchen spaces as people look to move away from solid white and gray spaces.”

Neutrals

Neutrals never go out of style, so expect earthy tones to remain popular next year.

“They provide a foundation that you can layer on, change seasonally, and update periodically,” Kirk told Realtor.com. “That blank canvas provides a backdrop for homebuyers to envision their own version of the space and how special mementos, heirlooms, and art might make it their own.”

Bolder grays

According to Decorilla lead interior designer Devin Shaffer, bolder gray shades are spreading fast.

“Clients have been bored with the shortlist of grays that builders and paint specialists default to,” he told Realtor.com. “Fortunately, more inventive hues continue to pop up.

“This color is perfect for living spaces, entryways, and bedrooms. When used in an entryway, it can help set a welcoming tone. If

used in the bedroom, it can evoke feelings of rest and repose. A large portion of our clients mention the words ‘sanctuary’ or ‘retreat’ when describing how they want their homes to feel.”

Navy blues

Navy blue offers a safer route for those looking to spice up their living spaces with a bold color. Alex Capozzolo, co-founder of SD House Guys, told Realtor.com that the color has become increasingly more popular.

“Navy blue has been steadily increasing in popularity over the

past few years and is expected to be a major color trend in 2023,” he said. “Try using it as an accent wall, or pair it with lighter shades of blue for a more subtle effect.”

Understated reds

Subtle reds are back in a big way, Fig Linens and Home’s Carlin van Noppen said.

“Soft, understated reds add a splash of color while retaining the neutral feel of exposed brick,” he told Realtor.com. “This means that prospective buyers will be impressed with the put-together look of your space and be able to imagine

themselves in it.”

Mustard yellows

For a little extra color in your living space, consider a mustard-yellow. “Easy-to-work-with mustard tones can find their way into your home naturally,” Robin DeCapua, owner and designer at Madison Modern Home, told Realtor.com. ““Keep in mind that darker walls dictate lighter furniture, so be sure to mix creamy whites with this color — not gray — as it truly has a warm base.”

What options do the heirs have when it comes to reverse mortgages

One of the largest misconceptions with reverse mortgages is that the homeowner loses ownership of the home, and they cannot pass the home onto their heirs. That is simply not true, you still retain ownership, and you can absolutely still pass the home to your heirs in the future. Moreover, there are no major differences between a traditional mortgage vs. a reverse mortgage when passing a home onto the heirs.  As a matter of fact, because a reverse mortgage is a non-recourse mortgage, the reverse mortgage provides additional protections for the homeowner and the heirs that a traditional mortgage typically does not provide.

Since the reverse mortgage does not need to be paid off until the last living borrower permanently leaves the home, the reverse mortgage can remain in place for many, many years. The date when the reverse mortgage is due and payable is the youngest borrower’s 150th birthday. However, once the homeowner no longer occupies the home as their primary residence, the clock starts ticking for the reverse mortgage to be paid off. From the time the homeowner permanently leaves the home, the reverse mortgage must be paid off within 6 months. FHA does allow up to two 90-day extensions in many cases which can provide the family up to a total of 1 year to pay off the reverse mortgage.

The heirs have several options, and each option needs to be considered. So, let’s take a closer look into the different options that the heirs have to payoff the reverse mortgage:

The heirs can sell the home and pay off the reverse mortgage. If the sales price is greater than the reverse mortgage balance, the heirs can sell the home, pay off the reverse mortgage and keep the remaining equity/ proceeds, just like if there was a traditional mortgage.

However, if the reverse mortgage balance ends up being greater than the value of the home, the heirs can still sell the home for fair market value. In this case, the heirs would sell the home for fair market value and the entire reverse mortgage balance would get paid off (even if the amount owed was above the value of the home) and the heirs would have no financial liability or debt.  The reason is because reverse mortgages are non-recourse mortgages and the homeowners, and the heirs do not have any financial liability for the reverse mortgage. The house is the only recourse.

The heirs can pay off the reverse mortgage and keep the home. The heirs can pay off the reverse mortgage with cash, inheritance, life insurance or any means that they would like. Alternatively, they can get a new mortgage to pay off the reverse mortgage and keep the home. If the mortgage balance is greater than the value of the home, the heirs have the ability to “buy the

house” at 95% of fair market value and the entire reverse mortgage goes away.  Let’s take an example: When Mom and Dad pass away, their reverse mortgage balance is $1M and the home is only worth $800K.  The heirs can keep the house by paying $760K (this is 95% of the $800K home value) and the entire $1M reverse mortgage would be paid off in full with no recourse.  In this example, the homeowners would use $200K more equity than actually existed and the heirs would inherit the home for only 95% of the fair market value. In my opinion this could be considered a windfall for both the homeowners and the heirs!

The last option would be to turn the keys over to the lender and do what is called a deed-inlieu of foreclosure. In this case, the heirs simply walk away from the home and the heirs have no financial liability for the home or the reverse mortgage balance. I do not typically recommend this option, but it is certainly an option that is

available to consider under certain circumstances.

The irony of this concern is that 99% of seniors want to pass their home onto their kids and 99% of adult children do not want their parents’ home.  Therefore, 99% of the time, the kids will inherit their parents’ home and simply sell the home and pay off the mortgage.  With all this being said, it is likely the heirs could inherit less equity, but it is also possible that they could inherit more cash instead when the reverse mortgage is used strategically in an orchestrated strategy during retirement.
