Winter sales Don’t believe anyone who says that you can’t sell a home during the party season. You can make your home sparkle by maximising the twinkle factor while keeping festive decorating minimal Anna Hart is an expert in staging homes for sale, working with house sellers to maximise their chances of selling as quickly and as profitably as possible. She says: “Don’t listen to anyone who says you can’t sell your house at Christmas. It may be more difficult to sell during the traditional housing market ‘slow’ months of December and early January, with fewer active buyers due to a widespread family and party focus, but that doesn’t mean it’s impossible. There’s even a wonderful opportunity for sellers, as buyers at Christmas are likely to be serious ones, so you could well secure a great sale while everyone else is out stocking-filler shopping or regretting the office party.” So how do you make sure your doors are fully open to the Christmas-time buyer without ignoring the festive season altogether? Balance and subtlety, that’s how. But first of all, you must follow Anne’s single cast-iron rule: no Christmas decorations in property photos. And only in the home over the minimal festive period and only then with care. During December itself, the decorations will only serve to distract buyers from the room you’re trying to show them. Six tips for successful seasonal selling 1. Minimalism rules for tasteful, nondistracting decorations. Less is more – keep to one colour of tinsel and baubles that complements your existing colour scheme for a stylish look, and don’t go overboard with the amount of decorating you do.

Keep your Christmas decorating in line with the style of your property – cottages suit traditional and classic styles, whereas new apartments can take more contemporary decorating. 3. If you’re not so keen on a minimal or so if you are still on the market in the New Year, people will know immediately how long your house has been for sale. Particularly bad is leaving those decorated photos on your listing into spring; it will send a very negative message that no-one wants your house. So if you are just about to put your house on the market or you’re planning to during the next month, leave the decorations in their boxes until after your house has been photographed. When the time does come for putting the tree up and decking the halls, here is your opportunity to make a conscious decision. Do you want to prioritise your house sale or Christmas this year? If it’s your house sale, then decorating with a subtle hand is the best option. Tasteful, stylish decorations can enhance the warm, homely feel of your living areas, as long as they don’t take over the whole show. But if you do want to shower your house with a Christmas cannon and give the festive season all you’ve got, then you should make this decision in the knowledge that buyers may be overwhelmed by your decorations and may not be able to fully appreciate the space they’re trying to view. It’s completely fine to do this; just be aware that you could be putting your house sale on the back burner until January.

Make sure your Christmas tree isn’t too big for the room; in the same way as wedging a king-size bed into a small double bedroom will make that room appear very cramped, an over-sized tree will also make your room seem smaller than it is. Size matters with rooms, so scale back your tree size to complement and enhance your room, and make sure viewers don’t have to squeeze past the tree to get to the window or the next room.

5. Be conscious that all the extra things we tend to have in our houses over December can make the house look very cluttered. Extra furniture for guests, bags of presents and giant food stocks take up valuable space you need to be showing off, so try to keep these items out of sight for viewings.

If you really don’t think you can follow these tips, then it might be a good idea to come off the market until the New Year. No viewings may actually be better than bad viewings, and you can start your marketing again, once Christmas is over, with a renewed sense of purpose and focus.

LEGO WALL When it comes to large-scale Lego home decoration, not much compares to this Lego wall partition. Using over 55,000 colourful Lego bricks, and featuring a customised star detail, this nifty room divider took the builders a whole year to construct. But with an end result like this, it was definitely worth it. Ground Hazards Angela Gordon-Lennox from Landmark on Understanding the Risks of Ground Hazards The word ‘subsidence’ is an uninviting prospect for any homeowner. The thought of such an occurrence happening near to your home is one that conjures up images of hefty bills, insurance issues and massive repair works. Having seen various headlines and images of houses displaying large cracks, or even sinkholes appearing in and around residential areas, you would like to think that consumers are mindful of the potential hazards when purchasing a new home, but of course it isn’t front of mind for those on the hunt for their ideal property. One example is in North Tyneside where the Bayfield Development was discovered to have been built on top of mine workings. The subsequent subsidence damage was so extensive that several homes have since had to be demolished (1). For solicitors, undertaking appropriate checks into

a property’s risk of ground instability, as part of the conveyancing process, offers insight or assurances before any purchase is completed. Unless there are known examples of ground stability hazards in an area, it isn’t always something that clients have considered when buying a property, so being able to deliver intelligence related to any risk is paramount. There are various reasons why a property could be at risk from subsidence. This includes naturallyoccurring hazards based on land’s underlying geology, through to a range of man-made, historical factors due to activities that may have occurred on the land in the past. Former mining activity is one contributor. Old mine shafts and tunnels that were created as part of mining activities have the potential to collapse and damage properties above them. Disturbed ground and spoil tips can also be prone to settlement,

For conveyancers, help is at hand in being able to confidently research known risks

which could cause structural damage to buildings. In fact, according to data (2) compiled by Landmark Information for Property Week, it found that almost one-third of residential properties in England, Scotland and Wales are considered to be at some form of risk as a result of historic mining activities. Other forms of ground stability hazards come from former Brine Extraction and Salt Mining. This type of mining leaves large cavities in the ground which could collapse and cause problems for properties built in the area. Landfill sites and infilled ground, which is indicated from historical mapping such as ponds, drains and small pits, have the potential to create cause for concern. Infilled land can be susceptible to settling so any houses that have been built on these areas could experience stability problems and subsidence resulting in damage to the property. There are also natural ground stability hazards as a result of the natural underlying geology. For conveyancers, help is at hand in being able to confidently research known risks. Landmark’s RiskView report assesses 12 forms of environmental risk, including ground stability. In addition, a specific Homecheck Mining and Subsidence report provides details on any potential mining, subsidence or ground stability hazards. The latter uniquely includes details of insurance claims from Crawford & Company, which are a result of damage caused by subsidence to nearby properties. Reassuringly, Crawford & Company is the world’s largest independent provider of claims management solutions to insurance companies and self-insured entities. It includes the details of successful Coal Mining

Subsidence Damage Claims that have been handled by the Coal Authority, rather than going through an insurer. If it is clearly identified that the property is located in an area used for coal mining in the past, it recommends that a full coal mining report is then purchased to better understand the specific nature of coal mining operations at or close to the property in question. All of this provides a very clear picture on potential hazards and ‘real life’ evidence of those near to a given address, enabling further site investigations to take place if they are at all concerned. Ultimately, when it comes down to home-buying, subsidence, mining risk or sinkholes isn’t at the top of everyone’s consideration list when looking for the home of their dreams. It is therefore down to solicitors to be able to research and advise on any potential hazards before the sale completes to ensure clients are fully briefed, and full and proper due diligence has taken place.

Festive flavour A touch of luxury with a great recipe for Oysters with Apple Horseradish Cream, by Hugh Fearnley-Whittingstall I’m in the process of launching my latest book, which is focused on the wonder of vegetables, and how with a bit of imagination, entire meals can be created from these most simple of foods. I think, as a nation, we’ve become a bit lazy when it comes to vegetarian food, and I’d like to see people rediscovering these delicious, healthy, rich, vibrant tastes and flavours in 2018. However, if there’s one luxury we should all allow ourselves at Christmas, it has to be oysters. It’s hard to beat spanking fresh, glistening oysters in their naked state or simply served with lemon, Tabasco or a splash of mignonette sauce, but at Christmas even oysters can take a little dressing up. This simple sauce is a great combination of cool, sweet, fresh and fiery – just add oysters and a crisp, chilly glass of champagne.

One ingredient too often overlooked at this time of year is fish, yet Christmas and New Year is the perfect opportunity to lay on a few fishy delights at some point, be that in the form of canapés, starters or main course. And if you really love fish, what’s to stop you making it the star of the show at the big feast?

Serves four to six. Recipe •

1 small, crisp eating apple

2 tbsp freshly grated horseradish, or 2 tbsp hot horseradish

80g crème fraiche

12 oysters

2 tbsp finely chopped parsley

Method Core and grate the apple Now mix about two to three tablespoons of it with the horseradish and crème fraîche. Chill for an hour or so for the flavours to develop. To serve, shuck the oysters, place them on a suitably grand platter (ideally supported on a bed of rock salt, so they don’t slip around and lose their juices). Finally, put a small dollop of apple horseradish cream on to each one and sprinkle parsley on top.

Stamp Duty Reform in Wales The Welsh Government have publicised a new land tax system, which will see stamp duty scrapped and replaced with Land Transaction Tax, with new thresholds. This change means that home buyers purchasing homes for less than £250,000 will benefit from paying up to £500 less in tax. However properties in excess of £400,000 will

pay more land tax at an increased rate of 7.5%. Land tax for commercial properties will have a top rate of 6% for transactions over £1M. To avoid mistakes and accurate completion of land tax forms, Searches UK recommend the SDLT online portal for solicitors. For more details please contact us.
