Terms & Conditions TERMS: The terms of the sale are cash or cheque payable at par at Heartland Livestock unless satisfactory credit arrangements have been made with the clerks of the sale before any cattle will be released. PURCHASER’S RISK: Each animal becomes the risk of the purchaser as soon as sold. Animals will be cared for at all the purchaser’s for a reasonable length of time. BIDS: All animals sell to the highest bidder. DISPUTES: In cases of disputed, bidding will be reopened between the parties involved. If no further bid is made, the buyer will be the person from whom the auctioneer accepted the last bid. The auctioneer’s decision will be final. ANNOUNCEMENTS: Any errors or changes in information contained in the catalogue will be announced from the auction block and such announcements take precedence over printed matter in the catalogue.

BREEDER’S GUARANTEE - BULLS: Should any bull fourteen (14) months of age or over fail to prove a breeder after being used on cows known to be breeders, the matter shall be reported in writing to the seller within six (6) months after the bull has reached fourteen (14) months of age. The seller will then have the right and privilege of six (6) months to prove the bull a breeder. No guarantee is given that semen collected from the bull will freeze. EXCEPTION TO GUARANTEE: In cases where the animal is subjected to any hormonal r surgical reproduction techniques after the sale, this guarantee shall be null and void. SETTLEMENTS: Transportation charged on animals returned to the seller are the sole responsibility of the purchaser. NO incidental expenses such as feed, care, all signing fees, interest, veterinarian charges, etc., will be charged by either party when making settlement. If the seller is successful in proving the animal in question to be a breeder the said animal will be

reclaimed by the purchaser at his expense. Should the seller fail to prove the animal a breeder, then the buyer is guaranteed satisfactory replacement, F.O.B., or ranch or location of originator a 90% refund of actual purchase price F.O.B. selling point, in no event shall the seller be responsible for more than 90% of the purchaser price F.O.B. selling point. Should a dispute arise over the quality of a replacement animal, the Sale Committee will appoint a mediator. LIABILITIES: All persons who attend the sale do so at their own risk and the seller, Southwest Bull Development Test Centre, and Cattleman’s Classic assumes no liability for an accident that may occur, nor any liability for loss or injury to livestock due to theft, mysterious disappearances, sickness, improper handling or Act of God. Southwest Bull Development Test Centre and Cattleman’s Classic act only as a medium between the buyer and seller. They are not responsible in any way for any failure in the part of the buyer and the seller to live up to his obligations

expressed or implied. Neither does Southwest Bull Development Test Centre and/or Cattleman’s Classic assume any financial obligations to collect or enforce collection of monies between parties. Any legal action that may in exceptional cases be takes, must be between the buyer and seller. CONTRACT: The above terms and conditions of the sale shall constitute a contract between the buyer and the seller and be equally binding to both. Resale of animals following purchase in this sale constitutes a separate transaction and the rights and obligations of the two parties concerned thereto are not covered by the terms and conditions of this sale. DELIVERY: Delivery is $50 per bull. Maximum of $100 per buyer to a maximum of 200 km. Remainder at cost to buyer. Delivery within one week after the sale at sellers convenience. SEMEN TEST: All bulls will have passed a breeding soundness evaluation.
